BJYM through the President Anurag Thakur, Member of Parliament, has moved the National Human Rights Commission by filing a Human Right Petition on Monday praying for strict action to be taken against the Govt. of State of J&K and its functionaries for gross violation of human rights and fundamental rights of the members of the BJYM who recently were subjected to inhumane torture and mal treatment in the state of Jammu and Kashmir on 26th of January for being the members of the Ekta Yatra organized by the BJYM

A large number of youth of the country joined the Rashtriya Ekta Yatra in the noble national cause from various parts of the country with the intention to bring social and cultural cohesiveness of this great nation to the fore, and generate a feeling of patriotism across the country and among the Indian masses on the eve of Republic day by unfurling the Indian National Flag at Lal Chowk in Kashmir.

These following BJYM members were illegally arrested and tortured by the police officials of the State of Jammu and Kashmir:

Mr. Bhrigu Bakshipatra, Mr. Rajesh Chowdhary, Mr. Mohan Reddy, Mr. Suresh Bagashia, Mr. Shyantanam Basu, Mr. Mrigang Berman, Mr. R. P. Singh, Smt. Sikha Rai, Mr. Pradeep Singh Vaghela, Mr. Harsh Sanghavi, Mr. Alpesh, Mr. Pandya Shashikant, Mr. Gigar Kheda, Mr. Bhim Ji Jodani, Mr. Momayo Gadhavi, Mr. Mausam Patatye, Mr. Ajit Ram Vani, Mr. Hamir Chawda, Mr. Vijay Jadeja, Mr. Jitendra Meena, Mr. Virendra S. Khinchi, Mr. Lokinder Singh Rajawat, Mr. Vijay Upadhyay, Mr. Vinod Rawat, Mr. Bhupinder Chowdhary, Mr. Ashok Bhati, Mr. Hiren Mishra, Mr. Jitendra Kumar Gupta, Mr. K.K. Upadhyay, Smt. Halima.

The Ekta Yatra so organized was with the sole motive to strengthen the unity of our nation and to develop the feeling of nationalism and patriotism amongst all Indian and the best day for such an act could not have been other than the Republic Day, the 26th January, the day when India adopted its independent constitution and became a sovereign democratic republic.

However the treatment meted out to the members of the BJYM is very horrifying and is absolutely illegal and contrary to the law of the land and also against the guidelines settled by the Apex Court of the country in a number of judgments.

These members were not only arrested against law and without following any proper procedure but were also illegally detained in the Ram Munshi Police Station in Srinagar and were subjected to 3rd degree treatment and were beaten, slapped ruthlessly. The functionaries of the State Govt. of J&k, including the DGP, SP and SHO had misbehaved with the yatris of the Ekta Yatra and had committed extreme atrocities upon these innocent young people who had assembled in Srinagar after having passed through 57 cities, 12 states and covered almost 3037 kilometres across the country.

It is very unfortunate to mention that these functionaries (CRPF) of j&K has not left any gaps to execute their evil will of preventing these members of the Ekta Yatra from hoisting the National Flag at Lal Chowk at Srinagar, J & K,. These police officials have not only inflicted these innocent yatris with physical harassment but have also dishonoured their individual religious sentiments and have besmirched their pious feelings. They have gone to the extent that they had detained the female members of the Ekta Yatra without following the proper procedure and the guidelines laid down by the Hon’ble Supreme Court of India. Quite contrary to the legal principles the female members of the Yatra were beaten up and slapped by the male officers and were subjected to abusive and filthy language unbecoming the dignity and self esteem of a lady.

These police officials are required to be taken into strict account for their misconduct and their act against the National Honour of India by disgracing the national Flag and violating the human rights and fundamental rights of the members of the Ekta Yatra.

Therefore BJYM have come forth to protest against the arbitrary and illegal action of the State Govt. and its functionaries seeking immediate warrant of the National Human Rights Commission with the following prayers;

I. That a detailed investigation has to be ordered immediately to look into the matter and investigate the matter thoroughly and the guilty police officials should be made to account for their actions ;

II. That a serious human rights violation proceeding should be initiated against the guilty respondents and they should be committed to appropriate punishment for the same.

III. That the respondents may be called upon to show cause as to such atrocious behaviour and narrate cogent explanation of such 3rd degree treatment meted out to members of the petitioner organization.

IV. That the respondents have to be made heavily accountable for such seditious behaviour and for violating the human rights principles.

V. That the injured members ought to be compensated for physical and mental harassment caused by the respondent officials without any cogent reason or explanation and in violation of the laws and rules.

It is expected that a thorough investigation will bring out the truth of the incident at Srinagar on 26th of January and the guilty shall be taken into account and will be strictly dealt with under the legal boundaries and the principles of the Constitution.

MP and President Yuva Morcha (BJP) Anurag Thakur on expressed his gratitude to the people of the country for their affection and support during his Rashtriya Ekta Yatra which started from Kolkata on January 12 and ended on Republic Day. Calling the Yatra as a historic reassertion of India’s surging youth towards nation building, Thakur said going ahead his party would build on the goodwill generated and engage in many more constructive political programmes aimed at engaging with youth.

“We have been successful in our endeavor to excite and rejuvenate India’s youth into proactively taking the cause of national integration and sovereignty,” Shri Thakur said. He had a special word of appreciation for the media. “The message of the Yatra could not have reached millions of nationalist countrymen but for your support,” Shri Thakur said. “At a time when the country is faced with crisis of governance and faith of people in government is at an all-time low, the media has a tough job at hand. By highlighting mainstream political activities like the Yatra you have reached strong political messages to the people,” he added.

However, Shri Thakur slammed both the Central and Jammu & Kashmir governments for their high-handed and undemocratic interventions in trying to scuttle the peaceful and nationalist Yatra. “I am ashamed the Government which should have given us protection and ensured we went to Lal Chowk to hoist the National Flag succumbed to the pressure of the separatists and prevented us from reaching there,” he said.

The young BJP leader expressed shock at the mischievous role played by the government in returning one train full of Bhartiya Janta Yuva Morcha workers. “This is unheard of and an extremely shameful act. This also reflects the nervousness of the government. Such repressive measures exposes the bankruptcy of the government,” slammed Thakur.

He also condemned the illegal detention of three senior BJP leaders – Arun Jaitley, Smt Sushma Swaraj and Shri Anant Kumar. “On a day when the

whole nation was celebrating Republic Day, two leaders of opposition in the lower and upper house of the Parliament along with another senior BJP leader were made to spend their time under house arrest. What could have been more undemocratic than this,” rued Shri Thakur warning the agencies to stay away from such repressive tactics.

“I also seek an apology from the Omar Abdullah government for using third degrees on National Office Bearers, State President and other youth workers who were illegally detained and tortured. The Police hurled filthy abuses on our boys and this can’t be tolerated. This is a deplorable act,” he added

The Rashtriya Ekta Yatra, besides reviving the spirits of Yuva Morcha workers, has awakened large number of youth towards the critical challenges facing the country today. “During the course of my 15 days (3100 k.m.) Yatra.
I came across hundreds of youngsters who are willing to constructively engage in nation building process. They are outraged at the unbearable price rise, large number of corruption cases, apathy of UPA government towards the suffering of common people, and degeneration in public life. They want to raise their voice against such blatant disregard for democratic norms and we at Yuva Morcha are adamant to voice these very genuine concerns,” Shri Thakur said.

He also informed the BJYM would launch few constructive programmes for the Youth with the twin objectives of guiding them towards achieving their desired goals as well as seeking their participation in mainstream political process.

“We strongly believe we need the participation of modern youth into the mainstream political process to make our democracy more vibrant and robust,” he said.

“The country is in a chaotic state today and people across strata have lost faith in the Government. Governance is miserably and majorly missing. Corrupt and traitors are thriving in this age of dark governance. We seek it as our duty to rise to the occasion and launch aggressive campaigns and address the deepening of

chaos and crisis. Country’s youth is with us and we shall succeed in our mission,” said Thakur.

'BJP's Ekta Yatra revives memories of May 1953 march'

The clamp-down on BJP leaders on Tuesday reminds one of the scenes of May 1953 when the founder of the Jan Sangh, the previous incarnation of the BJP, Dr Shyama Prasad Mookerjee was arrested from the Madhopur-Lakhanpur bridge on May 17, 1953.

This is exactly the spot where the BJP's Ekta Yatra was stopped on Tuesday nearly 48 years later.

One half of the bridge on Ravi is Punjab while the other half is in Jammu and Kashmir. BJP leaders have descended in Jammu to support the Ekta Yatra heading towards Srinagar to unfurl the Tricolour at Lal Chowk.

One of the co-protesters with Dr Mookerjee and former Punjab minister Balramji Dass Tandon recalled as soon as Mookerjee reached the middle part of the bridge, he told Atal Behari Vajpayee to inform the nation that Mookerjee had entered Jammu and Kashmir without a permit.

Mookerjee was taken to Srinagar and kept in Jail where he died of what the government claimed a 'heart attack'.

Tandon says a large number of followers of Mookerjee doubt the theory of heart attack as one of the nurses attending on the Jan Sangh leader had made statements contrary to that of the government. The Jammu and Kashmir government had said as he was a heart patient, he could not handle the 'pressure of height' in Srinagar.

Mookerjee had founded Jan Sangh in 1951 but in the 1952 election in both Lok Sabha and Punjab assembly, results were dismal. There was not a single seat in the Punjab assembly but the party could win three seats in the Lok Sabha, Tandon said.

The octogenarian leader recalls when Mookerjee was arrested, the Central and Punjab governments decided to let him go to Jammu and Kashmir and let the government there arrest the Hindu party's leader.

Then, anybody entering Jammu and Kashmir had to take a permit from the district magistrate. Punjab was the worst affected state as a lot of people could not even go to Vaishno Devi and Amarnath because of this restriction.

Even the Supreme Court writ then did not run in Jammu and Kashmir so it would have been difficult for Mookerjee to come out of jail, Tandon said. Jammu and Kashmir high court had the final say then, he said.

Mookerjee had decided to breach the permit regime in protest against the alleged shooting down of three Praja Parishad activists for trying to unfurl the Tri-Colour at Heeranagar, 15 km from Jammu towards Pathankot.

Mookerjee had also opposed Article 370 giving Jammu and Kashmir special status. This is still an agenda of the BJP.

Tandon said both the Ekta Yatra now and Mookerjee's yatra then were to expose how there could be a state in the country where country's national flag can not be unfurled. He said, "The government dare not touch those who hoist Pakistan's flag in Kashmir."

UPA must explain to people

BJP Leaders who were illegally arrested yesterday and day before in Jammu have been released.

Sushma Swaraj told the press that Omar Abdullah's Govt and UPA must explain to the people of India why were both the Leaders of Opposition are in detention on day of Republic day.

Despite and inspite of the heavily armed, battle ready forces of Jammu and Kashmir police, the nationalist brave-hearts led by Anurag Thakur, Sushma Swaraj, Arun Jaitely, Annanth Kumar crossed over to the state of J & K about 30 minutes back.

Sushma swaraj addressed the crowd at the bridge. Said the govt protects those who insult the tricolour but arresting those who respect it.

Then it happened...

BJYM and BJP workers braved the armed forces and some made it across the bridge, while more than a 1000 crossed across the river, many breached the tight barricades.

Sushma swaraj asks what is our crime ? Says it's a total surrender to terrorists by the government. Confirms that yatra goes on.

Another group of workers getting ready to march on to the bridge. Yatra goes on.

Meanwhile Anurag Thakur appeals to workers to maintain peace before courting arrest.Says workers already in Srinagar to unfurl the flag at lalchowk.

Shri Rajnath Singh (Former BJP National President) who is undergoing hunger strike at Rajghat along with many BJP workers and Delhi BJP Chief Vijendra Gupta to protest the UPA governments tackling and restraining the Ekta Yatra under non democratic methods.

What is the need for protesting at Rajghat and for the Hunger strike by BJP leaders led by Rajnath Singh?

Rajnath Singh stated that when our representations before the Prime Minister and the President of India have brought us no results, we have been left with only one recourse- to protest before the Father Of the Nation.

He said "By hoisting the National Flag, the Moral of the nationalists will increase , and if this is not done, the anti nationals will be encouraged."

The current position in Kashmir is due to the weak policies and legacy of Nehru who had foolishly taken up the Kashmir issue to the UN in 1948 and this resulted in 3 wars with Pakistan, the present UPA government is replicating the same policies which may create a war like situation and this in action by UPA is reflecting its lack of vision and lack of decision power.

He further asked the rationale behind the UPA's decision in witch hunting and merciless crackdown on Nationalists who want to unfurl the National Flag when they refuse to take action against anti India people like Gilani and Arundhati Roy who had the audacity to proclaim Kashmir as a separate entity.

He wondered that this strong arm tactics of the Omar Abdullah government which is shared equally by the Congress Party has been approved by the congress? If not, then why are they waiting? They should withdraw from the J & K Government immediately.

There is an electrifying atmosphere now at the border of... hold your breath , it is not Pakistan and Indian border but the border between Punjab and J & K

Arun Jaitley, Sushma Swaraj, Anath Kumar, Anurag Thakur, Navjot Singh Siddhu are addressing the large crowd.

There is a barricade on both sides. Punjab police and J & K police.

It is belived that the team who will move ahead on top of the bridge spanning river Rabi will attempt crossing the river as soon as the sabha gets over.

There is a buzz here on the ground as 30 BJP workers from kathua in J & K have reached the yatra sabha after dodging the police.The moral is high.

This is the same bridge across which Dr Shyama Prasad Mukherjee walked and got arrested. There is a smarak in his name here and the leaders have shown their respects to him, by garlanding at the memorial.

Kashmiri Pandits say that by stopping the BJP's Rashtriya Ekta Yatra, Centre and state governments have submitted themselves to the wishes of bullies

After senior leaders of the Bharatiya Janata Party Arun Jaitley and Sushma Swaraj were prevented from entering the city of Jammu in support of the party's Rashtriya Ekta Yatra and asked to return to Delhi, Kashmiri Pandits have strongly deplored the state government's move.

"I am not surprised at the response of Central and Jammu and Kashmir governments. They have been behaving this way all the while. They have submitted themselves to the wishes of bullies," said Sushil Pandit, a representative of Roots in Kashmir (an organisation of Kahmiri Pandits). "Kashmir is an integral part of India. If people are not allowed to hoist national flag in Kashmir, will they go to Islamabad for that," Pandit added.

Jammu- based convenor of Panun Kashmir, Agnishekhar said, "This is not opposition to BJP but to the very act of hoisting the national flag in Kashmir. Had the flag been in the hand of Sonia Gandhi, Lalu Prasad Yadav or Nitish Kumar, the reaction would have been the same. The incident has shown that the normalcy has not returned to Kashmir as claimed by the Central and Jammu and Kashmir governments. We knew it and now whole country and world has come to know of it,' he said.

The leader said that it was an irony that when Arundhati Roy, Yasin Malik and SAS Geelani talk of breaking this country into pieces, nothing happens to them. But when somebody plan to hoist the flag, he is prevented from doing so," said the leader.

Meanwhile, 'Roots in Kashmir' boycotted a meeting called by the Home Ministry in Delhi on Monday in protest against Jammu incident. "The Home Ministry had invited us for meeting on security concerns of Kashmiri Pandits after terror threats. We did not attend it in protest of the Ministry's stand against hoisting of national flag at the Lal Chowk," said Aditya Raj Kaul of the organisation.

20,000 from HP eager to join ekta yatra: BJP

State BJP chief Khimi Ram said on Monday that more youths were showing their eagerness to join the Rashtriya Ekta Yatra of the Bharatiya Yuva Janata Morcha (BYJM), which was evident from the fact that their number had swelled from the 15,000 earlier to 20,000, in Himachal Pradesh.

Asserting that the youths were keen to join the yatra and participate in the unfurling of the tricolour at Lal Chowk in Srinagar, he said that the block and district units had sent this number to the BYJM.

Coming out strongly against the Centre and the Omar Abdullah government in Jammu and Kashmir, he said that while the BJYM and BJP were keen to create a feeling of national unity and integrity by unfurling the tricolour, efforts were being made to stop the yatra with the help of the security forces.
