The Universal Declaration of Human Rights

The Universal Declaration of Human Rights (UDHR) is a milestone document in the history of human rights. Drafted by representatives with different legal and cultural backgrounds from all regions of the world, the Declaration was proclaimed by the United Nations General Assembly in Paris on 10 December 1948 (General Assembly resolution 217 A) as a common standard of achievements for all peoples and all nations. It sets out, for the first time, fundamental human rights to be universally protected and it has been translated into over 500 languages.

Preamble

Whereas recognition of the inherent dignity and of the equal and inalienable rights of all members of the human family is the foundation of freedom, justice and peace in the world,

Whereas disregard and contempt for human rights have resulted in barbarous acts which have outraged the conscience of mankind, and the advent of a world in which human beings shall enjoy freedom of speech and belief and freedom from fear and want has been proclaimed as the highest aspiration of the common people,

Whereas it is essential, if man is not to be compelled to have recourse, as a last resort, to rebellion against tyranny and oppression, that human rights should be protected by the rule of law,

Whereas it is essential to promote the development of friendly relations between nations,

Whereas the peoples of the United Nations have in the Charter reaffirmed their faith in fundamental human rights, in the dignity and worth of the human person and in the equal rights of men and women and have determined to promote social progress and better standards of life in larger freedom,

Whereas Member States have pledged themselves to achieve, in co-operation with the United Nations, the promotion of universal respect for and observance of human rights and fundamental freedoms,

Whereas a common understanding of these rights and freedoms is of the greatest importance for the full realization of this pledge,

Now, Therefore THE GENERAL ASSEMBLY proclaims THIS UNIVERSAL DECLARATION OF HUMAN RIGHTS as a common standard of achievement for all peoples and all nations, to the end that every individual and every organ of society, keeping this Declaration constantly in mind, shall strive by teaching and education to promote respect for these rights and freedoms and by progressive measures, national and international, to secure their universal and effective recognition and observance, both among the peoples of Member States themselves and among the peoples of territories under their jurisdiction.

Article 1.

All human beings are born free and equal in dignity and rights. They are endowed with reason and conscience and should act towards one another in a spirit of brotherhood.

Article 2.

Everyone is entitled to all the rights and freedoms set forth in this Declaration, without distinction of any kind, such as race, colour, sex, language, religion, political or other opinion, national or social origin, property, birth or other status. Furthermore, no distinction shall be made on the basis of the political, jurisdictional or international status of the country or territory to which a person belongs, whether it be independent, trust, non-self-governing or under any other limitation of sovereignty.

Article 3.

Everyone has the right to life, liberty and security of person.

Article 4.

No one shall be held in slavery or servitude; slavery and the slave trade shall be prohibited in all their forms.

Article 5.

No one shall be subjected to torture or to cruel, inhuman or degrading treatment or punishment.

Article 6.

Everyone has the right to recognition everywhere as a person before the law.

Article 7.

All are equal before the law and are entitled without any discrimination to equal protection of the law. All are entitled to equal protection against any discrimination in violation of this Declaration and against any incitement to such discrimination.

Article 8.

Everyone has the right to an effective remedy by the competent national tribunals for acts violating the fundamental rights granted him by the constitution or by law.

Article 9.

No one shall be subjected to arbitrary arrest, detention or exile.

Article 10.

Everyone is entitled in full equality to a fair and public hearing by an independent and impartial tribunal, in the determination of his rights and obligations and of any criminal charge against him.

Article 11.

(1) Everyone charged with a penal offence has the right to be presumed innocent until proved guilty according to law in a public trial at which he has had all the guarantees necessary for his defence.
(2) No one shall be held guilty of any penal offence on account of any act or omission which did not constitute a penal offence, under national or international law, at the time when it was committed. Nor shall a heavier penalty be imposed than the one that was applicable at the time the penal offence was committed.

Article 12.

No one shall be subjected to arbitrary interference with his privacy, family, home or correspondence, nor to attacks upon his honour and reputation. Everyone has the right to the protection of the law against such interference or attacks.

Article 13.

(1) Everyone has the right to freedom of movement and residence within the borders of each state.
(2) Everyone has the right to leave any country, including his own, and to return to his country.

Article 14.

(1) Everyone has the right to seek and to enjoy in other countries asylum from persecution.
(2) This right may not be invoked in the case of prosecutions genuinely arising from non-political crimes or from acts contrary to the purposes and principles of the United Nations.

Article 15.

(1) Everyone has the right to a nationality.
(2) No one shall be arbitrarily deprived of his nationality nor denied the right to change his nationality.

Article 16.

(1) Men and women of full age, without any limitation due to race, nationality or religion, have the right to marry and to found a family. They are entitled to equal rights as to marriage, during marriage and at its dissolution.
(2) Marriage shall be entered into only with the free and full consent of the intending spouses.
(3) The family is the natural and fundamental group unit of society and is entitled to protection by society and the State.

Article 17.

(1) Everyone has the right to own property alone as well as in association with others.
(2) No one shall be arbitrarily deprived of his property.

Article 18.

Everyone has the right to freedom of thought, conscience and religion; this right includes freedom to change his religion or belief, and freedom, either alone or in community with others and in public or private, to manifest his religion or belief in teaching, practice, worship and observance.

Article 19.

Everyone has the right to freedom of opinion and expression; this right includes freedom to hold opinions without interference and to seek, receive and impart information and ideas through any media and regardless of frontiers.

Article 20.

(1) Everyone has the right to freedom of peaceful assembly and association.
(2) No one may be compelled to belong to an association.

Article 21.

(1) Everyone has the right to take part in the government of his country, directly or through freely chosen representatives.
(2) Everyone has the right of equal access to public service in his country.
(3) The will of the people shall be the basis of the authority of government; this will shall be expressed in periodic and genuine elections which shall be by universal and equal suffrage and shall be held by secret vote or by equivalent free voting procedures.

Article 22.

Everyone, as a member of society, has the right to social security and is entitled to realization, through national effort and international co-operation and in accordance with the organization and resources of each State, of the economic, social and cultural rights indispensable for his dignity and the free development of his personality.

Article 23.

(1) Everyone has the right to work, to free choice of employment, to just and favourable conditions of work and to protection against unemployment.
(2) Everyone, without any discrimination, has the right to equal pay for equal work.
(3) Everyone who works has the right to just and favourable remuneration ensuring for himself and his family an existence worthy of human dignity, and supplemented, if necessary, by other means of social protection.
(4) Everyone has the right to form and to join trade unions for the protection of his interests.

Article 24.

Everyone has the right to rest and leisure, including reasonable limitation of working hours and periodic holidays with pay.

Article 25.

(1) Everyone has the right to a standard of living adequate for the health and well-being of himself and of his family, including food, clothing, housing and medical care and necessary social services, and the right to security in the event of unemployment, sickness, disability, widowhood, old age or other lack of livelihood in circumstances beyond his control.
(2) Motherhood and childhood are entitled to special care and assistance. All children, whether born in or out of wedlock, shall enjoy the same social protection.

Article 26.

(1) Everyone has the right to education. Education shall be free, at least in the elementary and fundamental stages. Elementary education shall be compulsory. Technical and professional education shall be made generally available and higher education shall be equally accessible to all on the basis of merit.
(2) Education shall be directed to the full development of the human personality and to the strengthening of respect for human rights and fundamental freedoms. It shall promote understanding, tolerance and friendship among all nations, racial or religious groups, and shall further the activities of the United Nations for the maintenance of peace.
(3) Parents have a prior right to choose the kind of education that shall be given to their children.

Article 27.

(1) Everyone has the right freely to participate in the cultural life of the community, to enjoy the arts and to share in scientific advancement and its benefits.
(2) Everyone has the right to the protection of the moral and material interests resulting from any scientific, literary or artistic production of which he is the author.

Article 28.

Everyone is entitled to a social and international order in which the rights and freedoms set forth in this Declaration can be fully realized.

Article 29.

(1) Everyone has duties to the community in which alone the free and full development of his personality is possible.
(2) In the exercise of his rights and freedoms, everyone shall be subject only to such limitations as are determined by law solely for the purpose of securing due recognition and respect for the rights and freedoms of others and of meeting the just requirements of morality, public order and the general welfare in a democratic society.
(3) These rights and freedoms may in no case be exercised contrary to the purposes and principles of the United Nations.

Article 30.

Nothing in this Declaration may be interpreted as implying for any State, group or person any right to engage in any activity or to perform any act aimed at the destruction of any of the rights and freedoms set forth herein.

လူတိုင္းသည္ တူညီ လြတ္လပ္ေသာ ဂုဏ္သိကၡာျဖင့္ လည္းေကာင္း၊ တူညီလြတ္လပ္ေသာ အခြင့္အေရးမ်ားျဖင့္ လည္းေကာင္း၊ ေမြးဖြားလာသူမ်ား ျဖစ္သည္။ ထိုသူတို႔၌ ပိုင္းျခား ေဝဖန္တတ္ေသာ ဉာဏ္ႏွင့္ က်င့္ဝတ္ သိတတ္ေသာ စိတ္တို႔ရွိၾက၍ ထိုသူတို႔သည္ အခ်င္းခ်င္း ေမတၱာထား၍ ဆက္ဆံက်င့္သုံးသင့္၏။

လူတိုင္းသည္ လူ႕အခြင့္ အေရး ေၾကညာစာတမ္းတြင္ ေဖာ္ျပထားသည့္ အခြင့္အေရး အားလုံး၊ လြတ္လပ္ခြင့္ အားလုံးတို႔ကို ပိုင္ဆိုင္ ခံစားခြင့္ရွိသည္။ လူမ်ိဳးႏြယ္အားျဖင့္ ျဖစ္ေစ၊ အသားအေရာင္အားျဖင့္ ျဖစ္ေစ၊ က်ား၊ မ၊ သဘာဝအားျဖင့္ ျဖစ္ေစ၊ ဘာသာစကားအားျဖင့္ ျဖစ္ေစ၊ ကိုးကြယ္သည့္ ဘာသာအားျဖင့္ ျဖစ္ေစ၊ နိုင္ငံေရးယူဆခ်က္၊ သို႔တည္းမဟုတ္ အျခားယူဆခ်က္အားျဖင့္ ျဖစ္ေစ၊ နိုင္ငံႏွင့္ ဆိုင္ေသာ၊ သို႔တည္းမဟုတ္ လူမႈအဆင့္အတန္းႏွင့္ ဆိုင္ေသာ ဇစ္ျမစ္ အားျဖင့္ျဖစ္ေစ၊ ပစၥည္း ဥစၥာ ဂုဏ္အားျဖင့္ ျဖစ္ေစ၊ မ်ိဳးရိုးဇာတိအားျဖင့္ ျဖစ္ေစ၊ အျခား အဆင့္အတန္း အားျဖင့္ ျဖစ္ေစ ခြဲျခားျခင္းမရွိေစရ။

ထို႔ျပင္ လူတစ္ဦး တစ္ေယာက္ ေနထိုင္ရာ နိုင္ငံ၏ သို႔တည္းမဟုတ္ နယ္ေျမေဒသ၏ နိုင္ငံေရးဆိုင္ရာ ျဖစ္ေစ စီရင္ ပိုင္ခြင့္ဆိုင္ရာ ျဖစ္ေစ တိုင္းျပည္ အခ်င္းခ်င္း ဆိုင္ရာျဖစ္ေစ၊ အဆင့္အတန္း တစ္ခုခုကို အေျချပဳ၍ ေသာ္လည္းေကာင္း၊ ေဒသနယ္ေျမတစ္ခုသည္ အခ်ဳပ္အျခာ အာဏာပိုင္ လြတ္လပ္သည့္ နယ္ေျမ၊ သို႔တည္းမဟုတ္ ကုလသမဂၢ ထိန္းသိမ္း ေစာင့္ေရွာက္ ထားရသည့္ နယ္ေျမ၊ သို႔တည္းမဟုတ္ ကိုယ္ပိုင္ အုပ္ခ်ဳပ္ခြင့္ အာဏာတို႔ တစိတ္တေဒသေလာက္သာ ရရွိသည့္ နယ္ေျမ စသျဖင့္ ယင္းသို႔ ေသာ နယ္ေျမမ်ား ျဖစ္သည္၊ ျဖစ္သည္ ဟူေသာ အေၾကာင္းကို အေထာက္အထား ျပဳ၍ ေသာ္လည္းေကာင္း ခြဲျခားျခင္း လုံးဝ မရွိေစရ။

လူတိုင္း၌ အသက္ရွင္ရန္ လြတ္လပ္ခြင့္ႏွင့္ လုံၿခဳံစိတ္ခ်ခြင့္ ရွိသည္။

အပိုဒ္ ၄
မည္သူကိုမွ် ေက်းကြၽန္အျဖစ္၊ သို႔တည္းမဟုတ္ အေစအပါးအျဖစ္၊ နိုင္ထက္စီးနင္း ေစခိုင္းျခင္း မျပဳရ၊ လူကို ေက်းကြၽန္ သဖြယ္ အဓမၼ ေစခိုင္းျခင္း၊ အေရာင္းအဝယ္ ျပဳျခင္းႏွင့္ ထိုသေဘာ သက္ေရာက္ေသာ လုပ္ငန္းဟူသမွ်ကို ပိတ္ပင္ တားျမစ္ ရမည္။

မည္သူကိုမွ် ညွဥ္းပန္းႏွိပ္စက္ျခင္း၊ သို႔တည္းမဟုတ္ ရက္စက္ၾကမ္းၾကဳတ္စြာ လူမဆန္စြာ ဂုဏ္ငယ္ေစေသာဆက္ဆံမႈ မျပဳရ၊ သို႔တည္းမဟုတ္ အျပစ္ဒဏ္ ေပးျခင္းမျပဳရ။

အပိုဒ္ ၆
လူတိုင္းတြင္ ဥပေဒအရာ၌ လူပုဂၢိဳလ္တစ္ဦး အျဖစ္ျဖင့္ အရာခပ္သိမ္းတြင္ အသိအမွတ္ ျပဳျခင္းကို ခံယူပိုင္ခြင့္ရွိသည္။

အပိုဒ္ ၇
လူအားလုံးတို႔သည္ ဥပေဒအရာ၌ တူညီၾကသည့္အျပင္၊ ဥပေဒ၏ အကာအကြယ္ကို ျခားနားျခင္း မခံရေစဘဲ တူညီစြာ ခံစားပိုင္ခြင့္ရွိသည္။ ဤေၾကညာ စာတမ္းပါ သေဘာတရားမ်ားကို ဖီဆန္၍ ခြဲျခားျခင္းမွ လည္းေကာင္း၊ ထိုသို႔ခြဲျခားျခင္းကို လႈံေဆာ္ျခင္းမွ လည္းေကာင္း၊ ကင္းလြတ္ ေစရန္ အကာအကြယ္ကို တူညီစြာ ခံစားပိုင္ခြင့္ ရွိသည္။

ဖြဲ႕စည္းပုံ အေျခခံဥပေဒက ေသာ္လည္းေကာင္း အျခား ဥပေဒက ေသာ္လည္းေကာင္း လူတိုင္းအတြက္ ေပးထားသည့္ အေျခခံ အခြင့္အေရး မ်ားသည္ ခ်ိဳးေဖာက္ ဖ်က္ဆီးျခင္းခံခဲ့ရလွ်င္ ထိုသို႔ ခ်ိဳးေဖာက္ဖ်က္ဆီးေသာ ျပဳလုပ္မႈေၾကာင့္ ျဖစ္ေပၚလာေသာ နစ္နာခ်က္ အတြက္ ထိုသူသည္ နိုင္ငံဆိုင္ရာ အာဏာပိုင္တရား႐ုံးတြင္ ထိေရာက္စြာ သက္သာ ခြင့္ရနိုင္ေစရမည္။

အပိုဒ္ ၉
မည္သူမွ် ဥပေဒအရ မဟုတ္ေသာ ဖမ္းဆီးျခင္းကို ျဖစ္ေစ၊ ခ်ဳပ္ေႏွာင္ျခင္းကို ျဖစ္ေစ၊ ျပည္ႏွင္ျခင္းကို ျဖစ္ေစ မခံေစရ။

အပိုဒ္ ၁၀
အခြင့္အေရးမ်ားႏွင့္ တာဝန္ ဝတၱရားမ်ားကို အဆုံးအျဖတ္ခံရာတြင္ လည္းေကာင္း၊ ျပစ္မႈေၾကာင့္ တရားစြဲဆို စီရင္ဆုံးျဖတ္ခံရာတြင္ လည္းေကာင္း၊ လူတိုင္းသည္ လြတ္လပ္၍ ဘက္မလိုက္ေသာ တရား႐ုံးေတာ္၏ လူအမ်ား ေရွ႕ေမွာက္တြင္ မွ်တစြာ ၾကားနာစစ္ေဆးျခင္းကို တူညီစြာ ခံစားပိုင္ခြင့္ရွိသည္။

အပိုဒ္ ၁၁
(၁) လူအမ်ား ေရွ႕ေမွာက္၌ ဥပေဒအတိုင္း စစ္ေဆး၍ ျပစ္မႈက်ဴးလြန္သည္ဟု ထင္ရွား စီရင္ျခင္းခံရသည့္ အခ်ိန္အထိ ျပစ္မႈႏွင့္ တရားစြဲဆိုျခင္း ခံရသူတိုင္းသည္ အျပစ္မဲ့သူဟူ၍ ယူဆျခင္းခံထိုက္သည့္ အခြင့္အေရးရွိသည္။ ထိုအမႈကို ၾကားနာစစ္ေဆးရာဝယ္ စြပ္စြဲခံရသည့္ ျပစ္မႈအတြက္ ခုခံေခ်ပနိုင္ရန္ လိုအပ္ေသာ အခြင့္အေရးမ်ားကို ထိုသူအား ေပးၿပီး ျဖစ္ေစရမည္။

(၂) လူတစ္ဦးတစ္ေယာက္အား နိုင္ငံဥပေဒအရျဖစ္ေစ၊ အျပည္ျပည္ဆိုင္ရာ ဥပေဒအရ ျဖစ္ေစ၊ ျပစ္မႈမေျမာက္ေသာ လုပ္ရပ္ သို႔မဟုတ္ ပ်က္ကြက္မႈအရ ဆြဲဆိုျပစ္ေပးျခင္း မျပဳရ။ ထို႔အျပင္ ျပစ္မႈက်ဴးလြန္စဥ္အခါက ထိုက္သင့္ေစနိုင္ေသာ အျပစ္ဒဏ္ထက္ပိုမိုႀကီးေလးေသာ အျပစ္ဒဏ္ကို ထိုက္သင့္ျခင္းမရွိေစရ။

အပိုဒ္ ၁၂
မည္သူမွ် မိမိသေဘာအတိုင္း ေအးခ်မ္းလြတ္လပ္စြာ ေနထိုင္ျခင္းကို ေသာ္လည္းေကာင္း၊ မိမိ၏ မိသားစုကို ေသာ္လည္းေကာင္း၊ မိမိ၏ ေနအိမ္ အသိုက္အဝန္းကို ေသာ္လည္းေကာင္း၊ စာေပးစာယူကို ေသာ္လည္းေကာင္း၊ ဥပေဒအရ မဟုတ္ေသာ ဝင္ေရာက္ စြက္ဖက္ျခင္း မခံေစရ။ ထို႔ျပင္ မိမိ၏ဂုဏ္သိကၡာ ကိုလည္း အထက္ပါအတိုင္း ပုတ္ခတ္ျခင္း မခံေစရ။ လူတိုင္းတြင္ ထိုသို႔ ဝင္ေရာက္စြက္ဖက္ျခင္းမွ ေသာ္လည္းေကာင္း ပုတ္ခတ္ျခင္းမွ ေသာ္လည္းေကာင္း ဥပေဒအရ ကာကြယ္ ပိုင္ခြင့္ရွိသည္။

အပိုဒ္ ၁၃
(၁) လူတိုင္းတြင္ မိမိ၏နိုင္ငံ နယ္နိမိတ္ အတြင္း၌ လြတ္လပ္စြာ သြားလာ ေ႐ႊ႕ေျပာင္း နိုင္ခြင့္၊ ေနထိုင္ခြင့္ရွိသည္။

(၂) လူတိုင္းတြင္ မိမိေနထိုင္ရာ တိုင္းျပည္မွ လည္းေကာင္း၊ အျခားတိုင္းျပည္မွလည္းေကာင္း ထြက္ခြာ သြားပိုင္ခြင့္ရွိသည့္အျပင္၊ မိမိ၏ တိုင္းျပည္သို႔ ျပန္လာ ပိုင္ခြင့္လည္းရွိသည္။

အပိုဒ္ ၁၄
(၁) လူတိုင္းသည္ ညွဥ္းပန္း ႏွိပ္စက္ ခံေနရျခင္းမွ လြတ္ကင္းရန္ အျခားတိုင္းျပည္ မ်ား၌ ေအးခ်မ္းစြာ ခိုလႈံေနနိုင္ခြင့္ရွိသည္။

(၂) နိုင္ငံေရးႏွင့္ မပတ္သက္သည့္ ျပစ္မႈမ်ားမွ ေသာ္လည္းေကာင္း၊ ကုလသမဂၢ၏ ရည္႐ြက္ခ်က္ႏွင့္ သေဘာတရား မႈမ်ားကို ဖီဆန္ေသာ အမႈမ်ားမွ ေသာ္လည္းေကာင္း၊ အမွန္ ေပၚေပါက္ လာေသာ ျပစ္မႈေၾကာင့္ တရားစြဲဆိုျခင္း ခံရသည့္ အမႈအခင္းမ်ားတြင္ အထက္ပါ အခြင့္အေရးကို အသုံးမျပဳနိုင္ေစရ။

အပိုဒ္ ၁၅
(၁) လူတိုင္းသည္၊ နိုင္ငံ တစ္နိုင္ငံ၏ နိုင္ငံသားအျဖစ္ ခံယူခြင့္ရွိသည္။

(၂) ဥပေဒအရ မဟုတ္လွ်င္ မည္သူမွ် မိမိ၏ နိုင္ငံသားအျဖစ္ကို စြန့္လႊတ္ျခင္း မခံေစရ၊ နိုင္ငံသားအျဖစ္ ေျပာင္းလဲနိုင္ေသာ အခြင့္အေရးကို လည္း ျငင္းပယ္ျခင္း မခံေစရ။

အပိုဒ္ ၁၆
(၁) အ႐ြယ္ေရာက္ ၿပီးေသာ ေယာက်ာ္း ႏွင့္ မိန္းမတို႔တြင္ လူမ်ိဳးကို ေသာ္လည္းေကာင္း၊ နိုင္ငံသားအျဖစ္ကို ေသာ္လည္းေကာင္း၊ ကိုးကြယ္သည့္ ဘာသာကို ေသာ္လည္းေကာင္း၊ အေၾကာင္းျပဳ၍ ခ်ဳပ္ခ်ယ္ ကန့္သတ္ျခင္း မရွိဘဲ၊ ထိမ္းျမားနိုင္ခြင့္ ႏွင့္ မိသားစု ထူေထာင္နိုင္ခြင့္ရွိသည္။ အဆိုပါ ေယာက်ာ္းႏွင့္ မိန္းမ တို႔သည္ လင္မယားအျဖစ္ ေပါင္းသင္းေနစဥ္ အခ်ိန္ အတြင္း၌ ေသာ္လည္းေကာင္း၊ အိမ္ေထာင္ကို ဖ်က္သိမ္း၍ ကြာရွင္းၾကသည့္ အခါ၌လည္းေကာင္း၊ လက္ထပ္ ေပါင္းသင္း အိမ္ေထာင္ျပဳျခင္း ႏွင့္ စပ္လ်ဥ္းေသာ တူညီသည့္ အခြင့္အေရးမ်ားကို ရရွိထိုက္သည္။

(၂) သတို႔သား ႏွင့္ သတို႔သမီး ႏွစ္ဦးႏွစ္ဘက္၏ လြတ္လပ္ေသာ သေဘာဆႏၵရွိမွသာလွ်င္ ထိမ္းျမားျခင္းကို ျပဳရမည္။

(၃) မိသားစု တစ္ခုသည္ လူ႕အဖြဲ႕အစည္း၏ သဘာဝက်ေသာ အေျခခံအဖြဲ႕တစ္ရပ္ျဖစ္သည္၊ ထိုမိသားစုသည္ လူ႕ အဖြဲ႕အစည္းႏွင့္ အစိုးရတို႔၏ ကာကြယ္ေစာင့္ေရွာက္ျခင္းကို ခံယူခြင့္ရွိသည္။

အပိုဒ္ ၁၇
(၁) လူတိုင္းတြင္ မိမိတစ္ဦး ခ်င္းေသာ္လည္းေကာင္း၊ အျခားသူမ်ားႏွင့္ ဖက္စပ္၍ ေသာ္လည္းေကာင္း၊ ပစၥည္းဥစၥာ တို႔ကို ပိုင္ဆိုင္ရန္ အခြင့္အေရးရွိရမည္။

(၂) ဥပေဒအရ မဟုတ္လွ်င္၊ မည္သူမွ် မိမိ၏ ပစၥည္းဥစၥာပိုင္ဆိုင္ခြင့္ကို စြန့္လႊတ္ျခင္း မခံေစရ။

အပိုဒ္ ၁၈
လူတိုင္းတြင္ လြတ္လပ္စြာ ေတြးေခၚ ႀကံဆနိုင္ခြင့္၊ လြတ္လပ္စြာ ခံယူရပ္တည္နိုင္ခြင့္ ႏွင့္ လြတ္လပ္စြာ သက္ဝင္ ကိုးကြယ္နိုင္ခြင့္ရွိသည္။ အဆိုပါ အခြင့္အေရးမ်ား၌ မိမိကိုးကြယ္သည့္ ဘာသာကို သို႔တည္းမဟုတ္ သက္ဝင္ယုံၾကည္ခ်က္ကို လြတ္လပ္စြာ ေျပာင္းလဲနိုင္ခြင့္ ပါဝင္သည့္ အျပင္ မိမိတစ္ေယာက္ ခ်င္းျဖစ္ေစ၊ အျခားသူမ်ားႏွင့္ စုေပါင္း၍ျဖစ္ေစ၊ ျပည္သူအမ်ား ေရွ႕ေမွာက္တြင္ ေသာ္လည္းေကာင္း၊ ေရွ႕ေမွာက္တြင္ မဟုတ္ဘဲ ေသာ္လည္းေကာင္း၊ မိမိ ကိုးကြယ္ေသာ ဘာသာကို သို႔တည္းမဟုတ္ သက္ဝင္ ယုံၾကည္ခ်က္ကို လြတ္လပ္စြာ သင္ျပနိုင္ခြင့္၊ က်င့္သုံးနိုင္ခြင့္၊ ဝတ္ျပဳကိုးကြယ္နိုင္ခြင့္ႏွင့္ ေဆာက္တည္ နိုင္ခြင့္တို႔လည္း ပါဝင္သည္။

အပိုဒ္ ၁၉
လူတိုင္းတြင္ လြတ္လပ္စြာ ထင္ျမင္ ယူဆနိုင္ခြင့္ႏွင့္ လြတ္လပ္စြာ ဖြင့္ဟ ေဖာ္ျပနိုင္ခြင့္ရွိသည္။ အဆိုပါ အခြင့္အေရးမ်ား၌ အေႏွာင့္ အယွက္မရွိဘဲ လြတ္လပ္စြာ ထင္ျမင္ယူဆနိုင္ခြင့္ ပါဝင္ သည့္အျပင္၊ နိုင္ငံနယ္နိမိတ္မ်ားကို ေထာက္ထားရန္ မလိုဘဲ သတင္းအေၾကာင္းအရာႏွင့္ သေဘာတရားမ်ားကို တနည္းနည္းျဖင့္ လြတ္လပ္စြာ ရွာယူဆည္းပူးနိုင္ခြင့္၊ လက္ခံနိုင္ခြင့္ႏွင့္ ေဝငွ ျဖန့္ခ်ီခြင့္တို႔လည္း ပါဝင္သည္။

အပိုဒ္ ၂၀
(၁) လူတိုင္းတြင္ လြတ္လပ္ ေအးခ်မ္းစြာ စုေဝးနိုင္ခြင့္ ႏွင့္ ဖြဲ႕စည္းနိုင္ခြင့္ တို႔ ရွိသည္။

(၂) မည္သူကိုမွ် အဖြဲ႕အစည္းတစ္ခုသို႔ ဝင္ေစရန္ အတင္းအက်ပ္မျပဳရ။

အပိုဒ္ ၂၁
(၁) လူတိုင္းတြင္ မိမိနိုင္ငံ၏ အုပ္ခ်ဳပ္ေရး၌ ကိုယ္တိုင္ျဖစ္ေစ၊ လြတ္လပ္စြာ ေ႐ြးခ်ယ္လိုက္သည့္ ကိုယ္စားလွယ္မ်ားမွ တစ္ဆင့္ျဖစ္ေစ ပါဝင္ ေဆာင္႐ြက္နိုင္ခြင့္ ရွိသည္။

(၂) လူတိုင္းတြင္ မိမိ၏နိုင္ငံရွိ ျပည္သူ႕ ဝန္ထမ္းအဖြဲ႕၌ ဝင္ေရာက္နိုင္ရန္ တူညီသည့္အခြင့္ အေရးရွိသည္။

(၃) ျပည္သူျပည္သားတို႔၏ ဆႏၵသည္ အုပ္ခ်ဳပ္ အာဏာ၏ အေျခခံျဖစ္ရမည္၊ အဆိုပါ ဆႏၵကို အခ်ိန္ကာလပိုင္းျခားလ်က္ စစ္မွန္ေသာေ႐ြးေကာက္ပြဲမ်ားျဖင့္ ထင္ရွားေစရမည္။ ေ႐ြးေကာက္ ပြဲမ်ားတြင္လည္း လူတိုင္းအညီအမွ် ဆႏၵမဲ ေပးနိုင္ခြင့္ ရွိရမည့္အျပင္၊ ထိုေ႐ြးေကာက္ပြဲမ်ားကို လွ်ို႔ဝွက္ မဲေပး စနစ္ျဖင့္ ျဖစ္ေစ၊ အလားတူ လြတ္လပ္ေသာ မဲေပးစနစ္ ျဖင့္ျဖစ္ေစ၊ က်င္းပရမည္။

အပိုဒ္ ၂၂
လူတိုင္းတြင္ လူ႕အဖြဲ႕အစည္း၏ အဖြဲ႕ဝင္တစ္ဦးအေနႏွင့္ လူမႈေရး လုံၿခဳံခြင့္ရယူပိုင့္ခြင့္ရွိသည့္အျပင္ နိုင္ငံေရးႀကိဳးပမ္းမႈျဖင့္ျဖစ္ေစ၊ နိုင္ငံတကာ ပူေပါင္းေဆာင္႐ြက္မႈျဖင့္ျဖစ္ေစ၊ နိုင္ငံအသီးသီး၏ဖြဲ႕စည္းပုံႏွင့္ လည္းေကာင္း၊ သယံဇာတအင္အားႏွင့္လည္းေကာင္း ထိုလူ၏ ဂုဏ္သိကၡာႏွင့္ စရိုက္လကၡဏာ လြတ္လပ္စြာ တိုးတက္ျမင့္မားေရးအတြက္ မရွိမျဖစ္လိုအပ္ေသာ စီးပြားေရး၊ လူမႈေရးႏွင့္ ယဥ္ေက်းမႈ အခြင့္အေရးမ်ားကို သုံးစြဲပိုင္ခြင့္ရွိသည္။

အပိုဒ္ ၂၃
(၁) လူတိုင္းတြင္ အလုပ္လုပ္ ရန္လည္းေကာင္း၊ မိမိႏွစ္သက္ရာ အသက္ေမြးမႈ အလုပ္ အကိုင္ကို လြတ္လပ္စြာေ႐ြးခ်ယ္ရန္ လည္းေကာင္း၊ တရား မွ်တ၍ လုပ္ေပ်ာ္ေသာ အလုပ္ခြင္၏ အေျခအေနကို ရရွိရန္ လည္းေကာင္း၊ အလုပ္လက္မဲ့ ျဖစ္ရျခင္းမွ အကာအကြယ္ ရရွိရန္ လည္းေကာင္း အခြင့္အေရးရွိသည္။

(၂) လူတိုင္းတြင္ ခြဲျခားျခင္းမခံရေစဘဲ၊ တူညီေသာ အလုပ္အတြက္ တူညီေသာ အခေၾကးေငြ ရနိုင္ခြင့္ရွိသည္။

(၃) အလုပ္လုပ္ကိုင္သည့္ လူတိုင္းတြင္၊ မိမိႏွင့္ မိမိ၏ မိသားစုအတြက္ လူ႕ဂုဏ္သိကၡာ ႏွင့္ ညီေအာင္ ေနထိုင္ စားေသာက္နိုင္ရန္၊ စိတ္ခ်ေလာက္သည့္ျပင္၊ တရား မွ်တ၍ လုပ္ေပ်ာ္သည့္ လစာေၾကးေငြ ရပိုင္ခြင့္ရွိသည္။ လိုအပ္ခဲ့လွ်င္အျခား နည္းလမ္းမ်ားမွ လူမႈေရး အေထာက္အပံ့ကိုလည္း ထပ္မံ၍ ရနိုင္ခြင့္ ရွိသည္။

(၄) လူတိုင္းတြင္ မိမိအက်ိဳး ခံစားခြင့္ကို ကာကြယ္ရန္ အလုပ္သမား အစည္းအ႐ုံးမ်ား ဖြဲ႕စည္းခြင့္၊ ပါဝင္ ေဆာင္႐ြက္ခြင့္ ရွိသည္။

အပိုဒ္ ၂၄
လူတိုင္းတြင္ သင့္ျမတ္ေလ်ာ္ကန္စြာ ကန့္သတ္ထားသည့္ အလုပ္လုပ္ခ်ိန္ အျပင္၊ လစာႏွင့္တကြ အခါကာလအားေလ်ာ္စြာ သတ္မွတ္ ထားသည့္ အလုပ္ အားလပ္ရက္မ်ားပါဝင္သည့္ အနားယူခြင့္ႏွင့္ အားလပ္ခြင့္ ခံစားပိုင္ခြင့္ ရွိသည္။

အပိုဒ္ ၂၅
(၁) လူတိုင္းတြင္ မိမိႏွင့္တကြ မိမိ၏ မိသားစုက်န္းမာေရးႏွင့္တကြ ကိုယ္စိတ္ႏွစ္ျဖာ ေအးခ်မ္းစြာ ေနထိုင္နိုင္ေရး အတြက္ အစာအဟာရ၊ အဝတ္အထည္ ေနအိမ္၊ ေဆးဝါး အကူအညီႏွင့္ လိုအပ္သည့္ လူမႈ အေထာက္အပံ့မ်ား ပါဝင္ေသာ သင့္ေတာ္ ေလွ်ာက္ပတ္သည့္ လူမႈ အဆင့္အတန္းကို ရယူခံစားခြင့္ ရွိသည္။ ထို႔ျပင္ အလုပ္လက္မဲ့ျဖစ္ေသာ အခါ၌ ေသာ္လည္းေကာင္း၊ မက်န္းမမာျဖစ္ေသာ အခါ၌ ေသာ္လည္းေကာင္း၊ ကိုယ္အဂၤါမစြမ္းမသန္ျဖစ္ေသာ အခါ၌ ေသာ္လည္းေကာင္း၊ မုဆိုးမျဖစ္ေသာ အခါ၌ ေသာ္လည္းေကာင္း၊ အသက္အ႐ြယ္အိုမင္းေသာ အခါ၌ ေသာ္လည္းေကာင္း၊ မိမိကိုယ္တိုင္က မတတ္နိုင္ေသာအေၾကာင္းေၾကာင့္ ဝမ္းစာ ရွာမွီးနိုင္ေသာနည္းလမ္း မရွိေသာ အခါ၌ ေသာ္လည္းေကာင္း၊ ေနထိုင္စားေသာက္ေရးအတြက္ လုံၿခဳံစိတ္ခ်ရမႈ အခြင့္အေရးရွိသည္။

(၂) သားသည္ မိခင္မ်ားႏွင့္ ကေလးမ်ားသည္ အထူးေစာင့္ေရွာက္ျခင္းႏွင့္ အကူအညီေပးျခင္းကို ရခြင့္ ရွိသည္။ ဥပေဒအရ ထိမ္းျမားျခင္းျဖင့္ျဖစ္ေစ အျခား နည္းျဖင့္ ျဖစ္ေစ ေမြးဖြားေသာ ကေလးအားလုံးသည္ တူညီေသာ လူမႈ ကာကြယ္ ေစာင့္ေရွာက္ေရးကို ရယူ ခံစားၾကရမည္။

အပိုဒ္ ၂၆
(၁) လူတိုင္းသည္ ပညာသင္ ယူနိုင္ခြင့္ရွိသည္၊ အနည္းဆုံးမူလတန္းႏွင့္ အေျခခံ အဆင့္ အတန္းမ်ားတြင္ ပညာ သင္ၾကားေရးသည္ အခမဲ့ျဖစ္ရမည္။ မူလတန္းပညာသည္ မသင္မေနရ ပညာ ျဖစ္ရမည္။ စက္မႈလက္မႈပညာႏွင့္ အသက္ေမြးမႈ ပညာမ်ားကို ေယဘူယ်အားျဖင့္ သင္ၾကားရယူနိုင္ေစရမည္။ ထို႔ျပင္ အထက္တန္းပညာအတြက္ အရည္အခ်င္းကို အေျခခံျပဳ၍ တူညီေသာ အခြင့္အေရး ရရွိေစရမည္။

(၂) ပညာသင္ၾကားေရးကို လူသားတို႔၏စရိုက္လကၡဏာအျပည့္အဝတိုးတက္မႈ အျပင္၊ လူ႕အခြင့္အေရးႏွင့္ အေျခခံလြတ္လပ္ခြင့္ ရိုေသ ေလးစားမႈ တို႔ကို ရွင္သန္ဖြံ႕ၿဖိဳးလာေစရန္ ရည္႐ြယ္၍ သင္ၾကား ေစရမည္။ ပညာသင္ၾကားေရးသည္ နိုင္ငံ အားလုံး တို႔တြင္ လည္းေကာင္း၊ လူမ်ိဳးစုမ်ား တြင္လည္းေကာင္း၊ ဘာသာေရးအသင္းအဖြဲ႕မ်ားတြင္ လည္းေကာင္း၊ အခ်င္းခ်င္းနားလည္မႈ၊ သည္းခံ မႈႏွင့္ ခင္မင္ရင္းႏွီးမႈတို႔ကို အားေပးရမည္။ ထို႔ျပင္ ၿငိမ္းခ်မ္းေရး တည္တံ့ေအာင္ ေဆာင္႐ြက္ရန္ အလို႔ငွာ၊ ကုလသမဂၢ၏ ေဆာင္႐ြက္မႈမ်ားကိုလည္း ျဖစ္ေျမာက္ ေအာင္ အားေပးရမည္။

(၃) မိဘတို႔တြင္၊ မိမိတို႔၏ ကေလးမ်ား သင္ယူရမည့္ ပညာ အမ်ိဳးအစားကို ေ႐ြးခ်ယ္နိုင္ေသာ လက္ဦး အခြင့္အေရးရွိသည္။

အပိုဒ္ ၂၇
(၁) လူတိုင္းတြင္ သက္ဆိုင္ရာ ယဥ္ေက်းမႈ ေလာက၌ လြတ္လပ္စြာ ပါဝင္ေဆာင္ ႐ြက္နိုင္ခြင့္ သုခုမပညာရပ္ မ်ားကို လြတ္လပ္စြာလိုက္စား ေမြ႕ေလ်ာ္နိုင္ခြင့္၊ သိပၸံ ပညာထြန္းကားေရး လုပ္ငန္းမ်ားတြင္ လြတ္လပ္စြာ ဝင္ေရာက္ လုပ္ကိုင္ နိုင္ခြင့္ႏွင့္ ထိုပညာ၏ အက်ိဳး အာနိသင္မ်ားကို လြတ္လပ္စြာ ခံစားသုံးစြဲနိုင္ခြင့္ ရွိသည္။

(၂) လူတိုင္းတြင္ သိပၸံမွ ျဖစ္ေစ၊ စာေပမွျဖစ္ေစ၊ သုခုမပညာမွ ျဖစ္ေစ၊ မိမိကိုယ္ပိုင္ဉာဏ္ျဖင့္ ႀကံစည္ဖန္တီးမႈမွ ျဖစ္ထြန္းလာသည့္ ဂုဏ္ႏွင့္ ေငြေၾကး အက်ိဳးအျမတ္မ်ားကို ခံစားရယူနိုင္ရန္ အခြင့္အေရးအတြက္ ကာကြယ္မႈကို ရရွိရန္ အခြင့္အေရး ရွိသည္။

အပိုဒ္ ၂၈
လူတိုင္းသည္ ဤေၾကညာ စာတမ္းတြင္ ေဖာ္ျပထားသည့္ အခြင့္အေရးမ်ား ႏွင့္ လြတ္လပ္ခြင့္မ်ားကို အျပည့္အစုံ ရယူနိုင္ေသာ လူမႈဆက္ဆံေရး အေျခအေနႏွင့္ အျပည္ျပည္ဆိုင္ရာ ဆက္ဆံေရး အေျခအေနတို႔၏ အက်ိဳးေက်းဇူးကို ခံစားနိုင္ခြင့္ ရွိသည္။

အပိုဒ္ ၂၉
(၁) မိမိ၏စရိုက္လကၡဏာ လြတ္လပ္စြာ ဖြံ႕ၿဖိဳးတိုးတက္နိုင္သည့္ တစ္ခုတည္းေသာ လူ႕အသိုက္အဝန္း အတြက္လူတိုင္း၌ တာဝန္ ရွိသည္။

(၂) မိမိ၏ အခြင့္အေရးမ်ားႏွင့္ လြတ္လပ္ ခြင့္မ်ားကို သုံးစြဲရာတြင္ လူတိုင္းသည္၊ အျခားသူမ်ား၏ အခြင့္အေရးမ်ားႏွင့္ လြတ္လပ္ခြင့္မ်ားကိုအသိအမွတ္ျပဳ၍ ရိုေသေလးစားေစရန္အလို႔ငွာ လည္းေကာင္း၊ ဒီမိုကေရစီက်င့္သုံးေသာလူ႕အဖြဲ႕အစည္းတြင္ ကိုယ္က်င့္တရားအျပင္၊ ရပ္႐ြာေအးခ်မ္းသာယာေရးႏွင့္ ျပည္သူ႕ အက်ိဳး စီးပြား ျဖစ္ထြန္းေရးတို႔ အတြက္၊ တရားမွ်တစြာက်င့္ ေဆာင္ရန္ အလို႔ငွာ လည္းေကာင္း၊ ဥပေဒက ျပဌာန္းထားသည့္ ခ်ဳပ္ခ်ယ္မႈမ်ားျဖင့္သာ ကန့္သတ္ျခင္းခံရမည္။

(၃) အဆိုပါ အခြင့္အေရးမ်ားႏွင့္ လြတ္လပ္ ခြင့္မ်ားကို မည္သည့္ အမႈကိစၥတြင္မွ် ကုလသမဂၢ၏ ရည္႐ြယ္ခ်က္မ်ားႏွင့္ လည္းေကာင္း၊ အေျခခံမူမ်ားႏွင့္ လည္းေကာင္း ဆန့္က်င္၍ မသုံးစြဲရ။

အပိုဒ္ ၃၀

အပြည်ပြည်ဆိုင်ရာ လူ့အခွင့်အရေး ကြေညာစာတမ်း

၁၉၄၈ ခုနှစ်၊ ဒီဇင်ဘာလ ၁၀ ရက်နေ့တွင် ကမ္ဘာ့ကုလသမဂ္ဂအဖွဲ့ ညီလာခံအစည်းအဝေးကြီးက လူ့အခွင့်အရေးကြေညာစာတမ်းကြီးကို အတည်ပြု၍ ကြေညာလိုက်ရာ ထိုကြေညာစာတမ်းကြီး၏ စာသားသည်နောက်စာမျက်နှာ များတွင် အပြည့်အစုံပါရှိသည်။ ဤကဲ့သို့ ရာဇဝင်တင်မည့် ကြေညာချက်ကို ပြုလုပ်ပြီးနောက် ဤညီလာခံအစည်းအဝေးကြီးက ကမ္ဘာ့ကုလသမဂ္ဂအဖွဲ့ဝင် နိုင်ငံ အားလုံးအား ထိုကြေညာစာတမ်းကြီး၏ စာသားကိုအများပြည်သူတို့ ကြားသိစေရန် ကြေညာပါမည့် အကြောင်းကိုလည်းကောင်း၊ ထို့ပြင်နိုင်ငံများ၊ သို့တည်းမဟုတ် နယ်မြေများ၏ နိုင်ငံရေး အဆင့်အတန်းကို လိုက်၍ ခွဲခြားခြင်း မပြုဘဲအဓိကအားဖြင့် စာသင်ကျောင်းများနှင့် အခြားပညာရေး အဖွဲ့အစည်းများတွင် ထိုကြေညာစာတမ်းကြီးကို ဖြန့်ချိ ဝေငှ စေရန်၊ မြင်သာအောင် ပြသထားစေရန်၊ ဖတ်ကြားစေရန်နှင့် အဓိပ္ပာယ်ရှင်းလင်း ဖော်ပြစေရန် ဆောင်ရွက်ပါမည့် အကြောင်းဖြင့် လည်းကောင်း ဆင့်ဆို လိုက်သည်။

လူခပ်သိမ်း၏ မျိုးရိုးဂုဏ်သိက္ခာနှင့်တကွ လူတိုင်းအညီအမျှခံစားခွင့်ရှိသည့် အခွင့်အရေးများကို အသိအမှတ်ပြုခြင်းသည် လူခပ်သိမ်း၏လွတ်လပ်မှု၊ တရားမျှတမှု၊ ငြိမ်းချမ်းမှုတို့၏ အခြေခံအုတ်မြစ်ဖြစ်သောကြောင့်လည်းကောင်း၊
လူ့အခွင့်ရေးများကို အရေးမထား မထီလေးစားပြုခြင်းသည် လူခပ်သိမ်း၏ အကျင့်သိက္ခာကို ချိုးဖောက် ဖျက်ဆီးတတ်သည့် ရက်စက်ကြမ်းကြုတ်သော အပြုအမှုများကို ဖြစ်ပေါ်စေခဲ့သောကြောင့်လည်းကောင်း၊ လွတ်လပ်စွာ ဖွင့်ဟပြောဆိုနိုင်မှု လွတ်လပ်စွာ သက်ဝင် ယုံကြည်နိုင်မှု၊ ကြောက်ရွံ့ခြင်း၊ ချို့ငဲ့ခြင်းတို့မှ ကင်းလွတ်စွာ အသက်မွေးနိုင်မှုတို့ကို ခံစားရယူနိုင်စေမည့် လောကတစ်ခု ပေါ်ပေါက်လာရန်အရေးကို လူခပ်သိမ်းတို့က မိမိတို့၏ အထက်သန်ဆုံးသော လိုလားချက်ဆန္ဒကြီးအဖြစ်ဖြင့် ကြွေးကြော်ကြေညာပြီး ဖြစ်သောကြောင့် လည်းကောင်း၊
လူခပ်သိမ်းတို့သည်၊ တရားလက်လွတ် နှိပ်စက်ကလူပြုမှု၊ အုပ်စိုးမှုနှင့် ဖိစီး ညှဉ်းပန်းမှု တို့ကို နောက်ဆုံး မလွှဲသာ မရှောင်သာ လက်နက် စွဲကိုင်ကာ တော်လှန်ခြင်း၊ ပုန်ကန်ခြင်းမပြုစေရန်၊ လူအခွင့်ရေး များကိုဥပဒေဖြင့် ထိန်းသိမ်းကာကွယ် ပေးရမည်ဖြစ်သောကြောင့် လည်းကောင်း၊
နိုင်ငံ အချင်းချင်း ချစ်ခင်ရင်းနှီးစွာ ဆက်ဆံရေးကို ပိုမိုတိုးတက်စေရန် ကြံဆောင်ရမည်ဖြစ်သောကြောင့် လည်းကောင်း၊ ကမ္ဘာ့ကုလသမဂ္ဂအဖွဲ့ဝင်တို့သည် မူလလူ့အခွင့်အရေးများကို လည်းကောင်း၊ လူ၏ ဂုဏ်သိက္ခာကို လည်းကောင်း၊ ယောက်ျား မိန်းမတို့၏ တူညီသည့် အခွင့်အရေးများကို လည်းကောင်း၊ လေးစားယုံကြည်ပါသည် ဟုကုလသမဂ္ဂတွင် ထပ်မံ၍ အတည်ပြု ပြီးသည့်ပြင်၊ လူမှုကြီးပွား တိုးတက်ရေးနှင့်တကွ ပိုမို လွတ်လပ် ကောင်းမွန်သော လူ့ဘဝ အဆင့်အတန်းတို့ကို မြှင့်တင်ရန် သန္နိဋ္ဌာန်ချပြီး ဖြစ်သောကြောင့် လည်းကောင်း၊
ကမ္ဘာ့ကုလသမဂ္ဂအဖွဲ့ဝင် နိုင်ငံတို့သည် ကုလသမဂ္ဂအဖွဲ့နှင့်ပူးပေါင်း၍ လူအခွင့်အရေးများကိုလည်းကောင်း၊ အခြေခံလွတ်လပ်ခွင့် အခွင့်အရေးများကိုလည်းကောင်း၊ ကမ္ဘာ့တဝှမ်းလုံးတွင် ရိုသေလေးစား ကျင့်သုံးစောင့်စည်းကြခြင်းကို အားပေးမည်ဟု ကတိပြုပြီးဖြစ်သောကြောင့် လည်းကောင်း၊

အပြည်ပြည်ဆိုင်ရာလူ့အခွင့်ရေးကြေညာစာတမ်းကို လူတိုင်း အဖွဲ့ အစည်းတိုင်းသည် အစဉ် နှလုံးသွင်းလျက် ကမ္ဘာ တဝှမ်းလုံးတွင် အဆိုပါ အခွင့်အရေးများနှင့် လွတ်လပ် ခွင့်များကို ရိုသေလေးစားကြစေရန် ဆုံးမ သွန်သင်ခြင်းဖြင့် အားထုတ် ကြရမည်ဟုလည်းကောင်း၊ ကုလသမဂ္ဂအဖွဲ့ဝင်နိုင်ငံများနှင့် ထိုနိုင်ငံတို့၏အာဏာပိုင်အတွင်းရှိ နယ်ပယ်ဆိုင်ရာ တိုင်းသူပြည်သား များအား အဆိုပါ အခွင့်အရေးနှင့် လွတ်လပ်ခွင့်များကို ကျယ်ကျယ်ပြန့်ပြန့် ထိရောက်စွာ သိမှတ်ကျင့်သုံး စောင့်စည်းကြစေရန် ပြည်တွင်းပြည်ပဆိုင်ရာ တိုးတက်သော ဆောင်ရွက်ချက်များဖြင့် အားထုတ်ကြရမည်ဟုလည်းကောင်း ရည်ရွယ်ပြီးလျှင် လူ့အခွင့်အရေး များဆိုင်ရာ အပြည်ပြည်ဆိုင်ရာ ကြေညာစာတမ်းကို နိုင်ငံခပ်သိမ်း၊ လူခပ်သိမ်းတို့ တပြေးညီစွာ ဆောင်ရွက် နိုင်ကြစိမ့်သောငှာ ယခုထုတ်ပြန် ကြေညာလိုက်သည်။

အပိုဒ် ၁

လူတိုင်းသည် တူညီ လွတ်လပ်သော ဂုဏ်သိက္ခာဖြင့် လည်းကောင်း၊ တူညီလွတ်လပ်သော အခွင့်အရေးများဖြင့် လည်းကောင်း၊ မွေးဖွားလာသူများ ဖြစ်သည်။ ထိုသူတို့၌ ပိုင်းခြား ဝေဖန်တတ်သော ဉာဏ်နှင့် ကျင့်ဝတ် သိတတ်သော စိတ်တို့ရှိကြ၍ ထိုသူတို့သည် အချင်းချင်း မေတ္တာထား၍ ဆက်ဆံကျင့်သုံးသင့်၏။

အပိုဒ် ၂

လူတိုင်းသည် လူ့အခွင့် အရေး ကြေညာစာတမ်းတွင် ဖော်ပြထားသည့် အခွင့်အရေး အားလုံး၊ လွတ်လပ်ခွင့် အားလုံးတို့ကို ပိုင်ဆိုင် ခံစားခွင့်ရှိသည်။ လူမျိုးနွယ်အားဖြင့် ဖြစ်စေ၊ အသားအရောင်အားဖြင့် ဖြစ်စေ၊ ကျား၊ မ၊ သဘာဝအားဖြင့် ဖြစ်စေ၊ ဘာသာစကားအားဖြင့် ဖြစ်စေ၊ ကိုးကွယ်သည့် ဘာသာအားဖြင့် ဖြစ်စေ၊ နိုင်ငံရေးယူဆချက်၊ သို့တည်းမဟုတ် အခြားယူဆချက်အားဖြင့် ဖြစ်စေ၊ နိုင်ငံနှင့် ဆိုင်သော၊ သို့တည်းမဟုတ် လူမှုအဆင့်အတန်းနှင့် ဆိုင်သော ဇစ်မြစ် အားဖြင့်ဖြစ်စေ၊ ပစ္စည်း ဥစ္စာ ဂုဏ်အားဖြင့် ဖြစ်စေ၊ မျိုးရိုးဇာတိအားဖြင့် ဖြစ်စေ၊ အခြား အဆင့်အတန်း အားဖြင့် ဖြစ်စေ ခွဲခြားခြင်းမရှိစေရ။
ထို့ပြင် လူတစ်ဦး တစ်ယောက် နေထိုင်ရာ နိုင်ငံ၏ သို့တည်းမဟုတ် နယ်မြေဒေသ၏ နိုင်ငံရေးဆိုင်ရာ ဖြစ်စေ စီရင် ပိုင်ခွင့်ဆိုင်ရာ ဖြစ်စေ တိုင်းပြည် အချင်းချင်း ဆိုင်ရာဖြစ်စေ၊ အဆင့်အတန်း တစ်ခုခုကို အခြေပြု၍ သော်လည်းကောင်း၊ ဒေသနယ်မြေတစ်ခုသည် အချုပ်အခြာ အာဏာပိုင် လွတ်လပ်သည့် နယ်မြေ၊ သို့တည်းမဟုတ် ကုလသမဂ္ဂ ထိန်းသိမ်း စောင့်ရှောက် ထားရသည့် နယ်မြေ၊ သို့တည်းမဟုတ် ကိုယ်ပိုင် အုပ်ချုပ်ခွင့် အာဏာတို့ တစိတ်တဒေသလောက်သာ ရရှိသည့် နယ်မြေ စသဖြင့် ယင်းသို့ သော နယ်မြေများ ဖြစ်သည်၊ ဖြစ်သည် ဟူသော အကြောင်းကို အထောက်အထား ပြု၍ သော်လည်းကောင်း ခွဲခြားခြင်း လုံးဝ မရှိစေရ။

အပိုဒ် ၃

လူတိုင်း၌ အသက်ရှင်ရန် လွတ်လပ်ခွင့်နှင့် လုံခြုံစိတ်ချခွင့် ရှိသည်။

အပိုဒ် ၄

မည်သူကိုမျှ ကျေးကျွန်အဖြစ်၊ သို့တည်းမဟုတ် အစေအပါးအဖြစ်၊ နိုင်ထက်စီးနင်း စေခိုင်းခြင်း မပြုရ၊ လူကို ကျေးကျွန် သဖွယ် အဓမ္မ စေခိုင်းခြင်း၊ အရောင်းအဝယ် ပြုခြင်းနှင့် ထိုသဘော သက်ရောက်သော လုပ်ငန်းဟူသမျှကို ပိတ်ပင် တားမြစ် ရမည်။

အပိုဒ် ၅

မည်သူကိုမျှ ညှဉ်းပန်းနှိပ်စက်ခြင်း၊ သို့တည်းမဟုတ် ရက်စက်ကြမ်းကြုတ်စွာ လူမဆန်စွာ ဂုဏ်ငယ်စေသောဆက်ဆံမှု မပြုရ၊ သို့တည်းမဟုတ် အပြစ်ဒဏ် ပေးခြင်းမပြုရ။

အပိုဒ် ၆

လူတိုင်းတွင် ဥပဒေအရာ၌ လူပုဂ္ဂိုလ်တစ်ဦး အဖြစ်ဖြင့် အရာခပ်သိမ်းတွင် အသိအမှတ် ပြုခြင်းကို ခံယူပိုင်ခွင့်ရှိသည်။

အပိုဒ် ၇

လူအားလုံးတို့သည် ဥပဒေအရာ၌ တူညီကြသည့်အပြင်၊ ဥပဒေ၏ အကာအကွယ်ကို ခြားနားခြင်း မခံရစေဘဲ တူညီစွာ ခံစားပိုင်ခွင့်ရှိသည်။ ဤကြေညာ စာတမ်းပါ သဘောတရားများကို ဖီဆန်၍ ခွဲခြားခြင်းမှ လည်းကောင်း၊ ထိုသို့ခွဲခြားခြင်းကို လှုံဆော်ခြင်းမှ လည်းကောင်း၊ ကင်းလွတ် စေရန် အကာအကွယ်ကို တူညီစွာ ခံစားပိုင်ခွင့် ရှိသည်။

အပိုဒ် ၈

ဖွဲ့စည်းပုံ အခြေခံဥပဒေက သော်လည်းကောင်း အခြား ဥပဒေက သော်လည်းကောင်း လူတိုင်းအတွက် ပေးထားသည့် အခြေခံ အခွင့်အရေး များသည် ချိုးဖောက် ဖျက်ဆီးခြင်းခံခဲ့ရလျှင် ထိုသို့ ချိုးဖောက်ဖျက်ဆီးသော ပြုလုပ်မှုကြောင့် ဖြစ်ပေါ်လာသော နစ်နာချက် အတွက် ထိုသူသည် နိုင်ငံဆိုင်ရာ အာဏာပိုင်တရားရုံးတွင် ထိရောက်စွာ သက်သာ ခွင့်ရနိုင်စေရမည်။

အပိုဒ် ၉

မည်သူမျှ ဥပဒေအရ မဟုတ်သော ဖမ်းဆီးခြင်းကို ဖြစ်စေ၊ ချုပ်နှောင်ခြင်းကို ဖြစ်စေ၊ ပြည်နှင်ခြင်းကို ဖြစ်စေ မခံစေရ။

အပိုဒ် ၁၀

အခွင့်အရေးများနှင့် တာဝန် ဝတ္တရားများကို အဆုံးအဖြတ်ခံရာတွင် လည်းကောင်း၊ ပြစ်မှုကြောင့် တရားစွဲဆို စီရင်ဆုံးဖြတ်ခံရာတွင် လည်းကောင်း၊ လူတိုင်းသည် လွတ်လပ်၍ ဘက်မလိုက်သော တရားရုံးတော်၏ လူအများ ရှေ့မှောက်တွင် မျှတစွာ ကြားနာစစ်ဆေးခြင်းကို တူညီစွာ ခံစားပိုင်ခွင့်ရှိသည်။

အပိုဒ် ၁၁

(၁) လူအများ ရှေ့မှောက်၌ ဥပဒေအတိုင်း စစ်ဆေး၍ ပြစ်မှုကျူးလွန်သည်ဟု ထင်ရှား စီရင်ခြင်းခံရသည့် အချိန်အထိ ပြစ်မှုနှင့် တရားစွဲဆိုခြင်း ခံရသူတိုင်းသည် အပြစ်မဲ့သူဟူ၍ ယူဆခြင်းခံထိုက်သည့် အခွင့်အရေးရှိသည်။ ထိုအမှုကို ကြားနာစစ်ဆေးရာဝယ် စွပ်စွဲခံရသည့် ပြစ်မှုအတွက် ခုခံချေပနိုင်ရန် လိုအပ်သော အခွင့်အရေးများကို ထိုသူအား ပေးပြီး ဖြစ်စေရမည်။
(၂) လူတစ်ဦးတစ်ယောက်အား နိုင်ငံဥပဒေအရဖြစ်စေ၊ အပြည်ပြည်ဆိုင်ရာ ဥပဒေအရ ဖြစ်စေ၊ ပြစ်မှုမမြောက်သော လုပ်ရပ် သို့မဟုတ် ပျက်ကွက်မှုအရ ဆွဲဆိုပြစ်ပေးခြင်း မပြုရ။ ထို့အပြင် ပြစ်မှုကျူးလွန်စဉ်အခါက ထိုက်သင့်စေနိုင်သော အပြစ်ဒဏ်ထက်ပိုမိုကြီးလေးသော အပြစ်ဒဏ်ကို ထိုက်သင့်ခြင်းမရှိစေရ။

အပိုဒ် ၁၂

မည်သူမျှ မိမိသဘောအတိုင်း အေးချမ်းလွတ်လပ်စွာ နေထိုင်ခြင်းကို သော်လည်းကောင်း၊ မိမိ၏ မိသားစုကို သော်လည်းကောင်း၊ မိမိ၏ နေအိမ် အသိုက်အဝန်းကို သော်လည်းကောင်း၊ စာပေးစာယူကို သော်လည်းကောင်း၊ ဥပဒေအရ မဟုတ်သော ဝင်ရောက် စွက်ဖက်ခြင်း မခံစေရ။ ထို့ပြင် မိမိ၏ဂုဏ်သိက္ခာ ကိုလည်း အထက်ပါအတိုင်း ပုတ်ခတ်ခြင်း မခံစေရ။ လူတိုင်းတွင် ထိုသို့ ဝင်ရောက်စွက်ဖက်ခြင်းမှ သော်လည်းကောင်း ပုတ်ခတ်ခြင်းမှ သော်လည်းကောင်း ဥပဒေအရ ကာကွယ် ပိုင်ခွင့်ရှိသည်။

အပိုဒ် ၁၃

(၁) လူတိုင်းတွင် မိမိ၏နိုင်ငံ နယ်နိမိတ် အတွင်း၌ လွတ်လပ်စွာ သွားလာ ရွှေ့ပြောင်း နိုင်ခွင့်၊ နေထိုင်ခွင့်ရှိသည်။
(၂) လူတိုင်းတွင် မိမိနေထိုင်ရာ တိုင်းပြည်မှ လည်းကောင်း၊ အခြားတိုင်းပြည်မှလည်းကောင်း ထွက်ခွာ သွားပိုင်ခွင့်ရှိသည့်အပြင်၊ မိမိ၏ တိုင်းပြည်သို့ ပြန်လာ ပိုင်ခွင့်လည်းရှိသည်။

အပိုဒ် ၁၄

(၁) လူတိုင်းသည် ညှဉ်းပန်း နှိပ်စက် ခံနေရခြင်းမှ လွတ်ကင်းရန် အခြားတိုင်းပြည် များ၌ အေးချမ်းစွာ ခိုလှုံနေနိုင်ခွင့်ရှိသည်။
(၂) နိုင်ငံရေးနှင့် မပတ်သက်သည့် ပြစ်မှုများမှ သော်လည်းကောင်း၊ ကုလသမဂ္ဂ၏ ရည်ရွက်ချက်နှင့် သဘောတရား မှုများကို ဖီဆန်သော အမှုများမှ သော်လည်းကောင်း၊ အမှန် ပေါ်ပေါက် လာသော ပြစ်မှုကြောင့် တရားစွဲဆိုခြင်း ခံရသည့် အမှုအခင်းများတွင် အထက်ပါ အခွင့်အရေးကို အသုံးမပြုနိုင်စေရ။

အပိုဒ် ၁၅

(၁) လူတိုင်းသည်၊ နိုင်ငံ တစ်နိုင်ငံ၏ နိုင်ငံသားအဖြစ် ခံယူခွင့်ရှိသည်။
(၂) ဥပဒေအရ မဟုတ်လျှင် မည်သူမျှ မိမိ၏ နိုင်ငံသားအဖြစ်ကို စွန့်လွှတ်ခြင်း မခံစေရ၊ နိုင်ငံသားအဖြစ် ပြောင်းလဲနိုင်သော အခွင့်အရေးကို လည်း ငြင်းပယ်ခြင်း မခံစေရ။

အပိုဒ် ၁၆

(၁) အရွယ်ရောက် ပြီးသော ယောကျာ်း နှင့် မိန်းမတို့တွင် လူမျိုးကို သော်လည်းကောင်း၊ နိုင်ငံသားအဖြစ်ကို သော်လည်းကောင်း၊ ကိုးကွယ်သည့် ဘာသာကို သော်လည်းကောင်း၊ အကြောင်းပြု၍ ချုပ်ချယ် ကန့်သတ်ခြင်း မရှိဘဲ၊ ထိမ်းမြားနိုင်ခွင့် နှင့် မိသားစု ထူထောင်နိုင်ခွင့်ရှိသည်။ အဆိုပါ ယောကျာ်းနှင့် မိန်းမ တို့သည် လင်မယားအဖြစ် ပေါင်းသင်းနေစဉ် အချိန် အတွင်း၌ သော်လည်းကောင်း၊ အိမ်ထောင်ကို ဖျက်သိမ်း၍ ကွာရှင်းကြသည့် အခါ၌လည်းကောင်း၊ လက်ထပ် ပေါင်းသင်း အိမ်ထောင်ပြုခြင်း နှင့် စပ်လျဉ်းသော တူညီသည့် အခွင့်အရေးများကို ရရှိထိုက်သည်။
(၂) သတို့သား နှင့် သတို့သမီး နှစ်ဦးနှစ်ဘက်၏ လွတ်လပ်သော သဘောဆန္ဒရှိမှသာလျှင် ထိမ်းမြားခြင်းကို ပြုရမည်။
(၃) မိသားစု တစ်ခုသည် လူ့အဖွဲ့အစည်း၏ သဘာဝကျသော အခြေခံအဖွဲ့တစ်ရပ်ဖြစ်သည်၊ ထိုမိသားစုသည် လူ့ အဖွဲ့အစည်းနှင့် အစိုးရတို့၏ ကာကွယ်စောင့်ရှောက်ခြင်းကို ခံယူခွင့်ရှိသည်။

အပိုဒ် ၁၇

(၁) လူတိုင်းတွင် မိမိတစ်ဦး ချင်းသော်လည်းကောင်း၊ အခြားသူများနှင့် ဖက်စပ်၍ သော်လည်းကောင်း၊ ပစ္စည်းဥစ္စာ တို့ကို ပိုင်ဆိုင်ရန် အခွင့်အရေးရှိရမည်။
(၂) ဥပဒေအရ မဟုတ်လျှင်၊ မည်သူမျှ မိမိ၏ ပစ္စည်းဥစ္စာပိုင်ဆိုင်ခွင့်ကို စွန့်လွှတ်ခြင်း မခံစေရ။

အပိုဒ် ၁၈

အပိုဒ် ၁၉

လူတိုင်းတွင် လွတ်လပ်စွာ ထင်မြင် ယူဆနိုင်ခွင့်နှင့် လွတ်လပ်စွာ ဖွင့်ဟ ဖော်ပြနိုင်ခွင့်ရှိသည်။ အဆိုပါ အခွင့်အရေးများ၌ အနှောင့် အယှက်မရှိဘဲ လွတ်လပ်စွာ ထင်မြင်ယူဆနိုင်ခွင့် ပါဝင် သည့်အပြင်၊ နိုင်ငံနယ်နိမိတ်များကို ထောက်ထားရန် မလိုဘဲ သတင်းအကြောင်းအရာနှင့် သဘောတရားများကို တနည်းနည်းဖြင့် လွတ်လပ်စွာ ရှာယူဆည်းပူးနိုင်ခွင့်၊ လက်ခံနိုင်ခွင့်နှင့် ဝေငှ ဖြန့်ချီခွင့်တို့လည်း ပါဝင်သည်။

အပိုဒ် ၂၀

(၁) လူတိုင်းတွင် လွတ်လပ် အေးချမ်းစွာ စုဝေးနိုင်ခွင့် နှင့် ဖွဲ့စည်းနိုင်ခွင့် တို့ ရှိသည်။
(၂) မည်သူကိုမျှ အဖွဲ့အစည်းတစ်ခုသို့ ဝင်စေရန် အတင်းအကျပ်မပြုရ။

အပိုဒ် ၂၁

(၁) လူတိုင်းတွင် မိမိနိုင်ငံ၏ အုပ်ချုပ်ရေး၌ ကိုယ်တိုင်ဖြစ်စေ၊ လွတ်လပ်စွာ ရွေးချယ်လိုက်သည့် ကိုယ်စားလှယ်များမှ တစ်ဆင့်ဖြစ်စေ ပါဝင် ဆောင်ရွက်နိုင်ခွင့် ရှိသည်။
(၂) လူတိုင်းတွင် မိမိ၏နိုင်ငံရှိ ပြည်သူ့ ဝန်ထမ်းအဖွဲ့၌ ဝင်ရောက်နိုင်ရန် တူညီသည့်အခွင့် အရေးရှိသည်။
(၃) ပြည်သူပြည်သားတို့၏ ဆန္ဒသည် အုပ်ချုပ် အာဏာ၏ အခြေခံဖြစ်ရမည်၊ အဆိုပါ ဆန္ဒကို အချိန်ကာလပိုင်းခြားလျက် စစ်မှန်သောရွေးကောက်ပွဲများဖြင့် ထင်ရှားစေရမည်။ ရွေးကောက် ပွဲများတွင်လည်း လူတိုင်းအညီအမျှ ဆန္ဒမဲ ပေးနိုင်ခွင့် ရှိရမည့်အပြင်၊ ထိုရွေးကောက်ပွဲများကို လျှို့ဝှက် မဲပေး စနစ်ဖြင့် ဖြစ်စေ၊ အလားတူ လွတ်လပ်သော မဲပေးစနစ် ဖြင့်ဖြစ်စေ၊ ကျင်းပရမည်။

အပိုဒ် ၂၂

လူတိုင်းတွင် လူ့အဖွဲ့အစည်း၏ အဖွဲ့ဝင်တစ်ဦးအနေနှင့် လူမှုရေး လုံခြုံခွင့်ရယူပိုင့်ခွင့်ရှိသည့်အပြင် နိုင်ငံရေးကြိုးပမ်းမှုဖြင့်ဖြစ်စေ၊ နိုင်ငံတကာ ပူပေါင်းဆောင်ရွက်မှုဖြင့်ဖြစ်စေ၊ နိုင်ငံအသီးသီး၏ဖွဲ့စည်းပုံနှင့် လည်းကောင်း၊ သယံဇာတအင်အားနှင့်လည်းကောင်း ထိုလူ၏ ဂုဏ်သိက္ခာနှင့် စရိုက်လက္ခဏာ လွတ်လပ်စွာ တိုးတက်မြင့်မားရေးအတွက် မရှိမဖြစ်လိုအပ်သော စီးပွားရေး၊ လူမှုရေးနှင့် ယဉ်ကျေးမှု အခွင့်အရေးများကို သုံးစွဲပိုင်ခွင့်ရှိသည်။

အပိုဒ် ၂၃

(၁) လူတိုင်းတွင် အလုပ်လုပ် ရန်လည်းကောင်း၊ မိမိနှစ်သက်ရာ အသက်မွေးမှု အလုပ် အကိုင်ကို လွတ်လပ်စွာရွေးချယ်ရန် လည်းကောင်း၊ တရား မျှတ၍ လုပ်ပျော်သော အလုပ်ခွင်၏ အခြေအနေကို ရရှိရန် လည်းကောင်း၊ အလုပ်လက်မဲ့ ဖြစ်ရခြင်းမှ အကာအကွယ် ရရှိရန် လည်းကောင်း အခွင့်အရေးရှိသည်။
(၂) လူတိုင်းတွင် ခွဲခြားခြင်းမခံရစေဘဲ၊ တူညီသော အလုပ်အတွက် တူညီသော အခကြေးငွေ ရနိုင်ခွင့်ရှိသည်။
(၃) အလုပ်လုပ်ကိုင်သည့် လူတိုင်းတွင်၊ မိမိနှင့် မိမိ၏ မိသားစုအတွက် လူ့ဂုဏ်သိက္ခာ နှင့် ညီအောင် နေထိုင် စားသောက်နိုင်ရန်၊ စိတ်ချလောက်သည့်ပြင်၊ တရား မျှတ၍ လုပ်ပျော်သည့် လစာကြေးငွေ ရပိုင်ခွင့်ရှိသည်။ လိုအပ်ခဲ့လျှင်အခြား နည်းလမ်းများမှ လူမှုရေး အထောက်အပံ့ကိုလည်း ထပ်မံ၍ ရနိုင်ခွင့် ရှိသည်။
(၄) လူတိုင်းတွင် မိမိအကျိုး ခံစားခွင့်ကို ကာကွယ်ရန် အလုပ်သမား အစည်းအရုံးများ ဖွဲ့စည်းခွင့်၊ ပါဝင် ဆောင်ရွက်ခွင့် ရှိသည်။

အပိုဒ် ၂၄

လူတိုင်းတွင် သင့်မြတ်လျော်ကန်စွာ ကန့်သတ်ထားသည့် အလုပ်လုပ်ချိန် အပြင်၊ လစာနှင့်တကွ အခါကာလအားလျော်စွာ သတ်မှတ် ထားသည့် အလုပ် အားလပ်ရက်များပါဝင်သည့် အနားယူခွင့်နှင့် အားလပ်ခွင့် ခံစားပိုင်ခွင့် ရှိသည်။

အပိုဒ် ၂၅

(၁) လူတိုင်းတွင် မိမိနှင့်တကွ မိမိ၏ မိသားစုကျန်းမာရေးနှင့်တကွ ကိုယ်စိတ်နှစ်ဖြာ အေးချမ်းစွာ နေထိုင်နိုင်ရေး အတွက် အစာအဟာရ၊ အဝတ်အထည် နေအိမ်၊ ဆေးဝါး အကူအညီနှင့် လိုအပ်သည့် လူမှု အထောက်အပံ့များ ပါဝင်သော သင့်တော် လျှောက်ပတ်သည့် လူမှု အဆင့်အတန်းကို ရယူခံစားခွင့် ရှိသည်။ ထို့ပြင် အလုပ်လက်မဲ့ဖြစ်သော အခါ၌ သော်လည်းကောင်း၊ မကျန်းမမာဖြစ်သော အခါ၌ သော်လည်းကောင်း၊ ကိုယ်အင်္ဂါမစွမ်းမသန်ဖြစ်သော အခါ၌ သော်လည်းကောင်း၊ မုဆိုးမဖြစ်သော အခါ၌ သော်လည်းကောင်း၊ အသက်အရွယ်အိုမင်းသော အခါ၌ သော်လည်းကောင်း၊ မိမိကိုယ်တိုင်က မတတ်နိုင်သောအကြောင်းကြောင့် ဝမ်းစာ ရှာမှီးနိုင်သောနည်းလမ်း မရှိသော အခါ၌ သော်လည်းကောင်း၊ နေထိုင်စားသောက်ရေးအတွက် လုံခြုံစိတ်ချရမှု အခွင့်အရေးရှိသည်။
(၂) သားသည် မိခင်များနှင့် ကလေးများသည် အထူးစောင့်ရှောက်ခြင်းနှင့် အကူအညီပေးခြင်းကို ရခွင့် ရှိသည်။ ဥပဒေအရ ထိမ်းမြားခြင်းဖြင့်ဖြစ်စေ အခြား နည်းဖြင့် ဖြစ်စေ မွေးဖွားသော ကလေးအားလုံးသည် တူညီသော လူမှု ကာကွယ် စောင့်ရှောက်ရေးကို ရယူ ခံစားကြရမည်။

အပိုဒ် ၂၆

(၁) လူတိုင်းသည် ပညာသင် ယူနိုင်ခွင့်ရှိသည်၊ အနည်းဆုံးမူလတန်းနှင့် အခြေခံ အဆင့် အတန်းများတွင် ပညာ သင်ကြားရေးသည် အခမဲ့ဖြစ်ရမည်။ မူလတန်းပညာသည် မသင်မနေရ ပညာ ဖြစ်ရမည်။ စက်မှုလက်မှုပညာနှင့် အသက်မွေးမှု ပညာများကို ယေဘူယျအားဖြင့် သင်ကြားရယူနိုင်စေရမည်။ ထို့ပြင် အထက်တန်းပညာအတွက် အရည်အချင်းကို အခြေခံပြု၍ တူညီသော အခွင့်အရေး ရရှိစေရမည်။
(၂) ပညာသင်ကြားရေးကို လူသားတို့၏စရိုက်လက္ခဏာအပြည့်အဝတိုးတက်မှု အပြင်၊ လူ့အခွင့်အရေးနှင့် အခြေခံလွတ်လပ်ခွင့် ရိုသေ လေးစားမှု တို့ကို ရှင်သန်ဖွံ့ဖြိုးလာစေရန် ရည်ရွယ်၍ သင်ကြား စေရမည်။ ပညာသင်ကြားရေးသည် နိုင်ငံ အားလုံး တို့တွင် လည်းကောင်း၊ လူမျိုးစုများ တွင်လည်းကောင်း၊ ဘာသာရေးအသင်းအဖွဲ့များတွင် လည်းကောင်း၊ အချင်းချင်းနားလည်မှု၊ သည်းခံ မှုနှင့် ခင်မင်ရင်းနှီးမှုတို့ကို အားပေးရမည်။ ထို့ပြင် ငြိမ်းချမ်းရေး တည်တံ့အောင် ဆောင်ရွက်ရန် အလို့ငှာ၊ ကုလသမဂ္ဂ၏ ဆောင်ရွက်မှုများကိုလည်း ဖြစ်မြောက် အောင် အားပေးရမည်။
(၃) မိဘတို့တွင်၊ မိမိတို့၏ ကလေးများ သင်ယူရမည့် ပညာ အမျိုးအစားကို ရွေးချယ်နိုင်သော လက်ဦး အခွင့်အရေးရှိသည်။

အပိုဒ် ၂၇

(၁) လူတိုင်းတွင် သက်ဆိုင်ရာ ယဉ်ကျေးမှု လောက၌ လွတ်လပ်စွာ ပါဝင်ဆောင် ရွက်နိုင်ခွင့် သုခုမပညာရပ် များကို လွတ်လပ်စွာလိုက်စား မွေ့လျော်နိုင်ခွင့်၊ သိပ္ပံ ပညာထွန်းကားရေး လုပ်ငန်းများတွင် လွတ်လပ်စွာ ဝင်ရောက် လုပ်ကိုင် နိုင်ခွင့်နှင့် ထိုပညာ၏ အကျိုး အာနိသင်များကို လွတ်လပ်စွာ ခံစားသုံးစွဲနိုင်ခွင့် ရှိသည်။
(၂) လူတိုင်းတွင် သိပ္ပံမှ ဖြစ်စေ၊ စာပေမှဖြစ်စေ၊ သုခုမပညာမှ ဖြစ်စေ၊ မိမိကိုယ်ပိုင်ဉာဏ်ဖြင့် ကြံစည်ဖန်တီးမှုမှ ဖြစ်ထွန်းလာသည့် ဂုဏ်နှင့် ငွေကြေး အကျိုးအမြတ်များကို ခံစားရယူနိုင်ရန် အခွင့်အရေးအတွက် ကာကွယ်မှုကို ရရှိရန် အခွင့်အရေး ရှိသည်။

အပိုဒ် ၂၈

လူတိုင်းသည် ဤကြေညာ စာတမ်းတွင် ဖော်ပြထားသည့် အခွင့်အရေးများ နှင့် လွတ်လပ်ခွင့်များကို အပြည့်အစုံ ရယူနိုင်သော လူမှုဆက်ဆံရေး အခြေအနေနှင့် အပြည်ပြည်ဆိုင်ရာ ဆက်ဆံရေး အခြေအနေတို့၏ အကျိုးကျေးဇူးကို ခံစားနိုင်ခွင့် ရှိသည်။

အပိုဒ် ၂၉

(၁) မိမိ၏စရိုက်လက္ခဏာ လွတ်လပ်စွာ ဖွံ့ဖြိုးတိုးတက်နိုင်သည့် တစ်ခုတည်းသော လူ့အသိုက်အဝန်း အတွက်လူတိုင်း၌ တာဝန် ရှိသည်။
(၂) မိမိ၏ အခွင့်အရေးများနှင့် လွတ်လပ် ခွင့်များကို သုံးစွဲရာတွင် လူတိုင်းသည်၊ အခြားသူများ၏ အခွင့်အရေးများနှင့် လွတ်လပ်ခွင့်များကိုအသိအမှတ်ပြု၍ ရိုသေလေးစားစေရန်အလို့ငှာ လည်းကောင်း၊ ဒီမိုကရေစီကျင့်သုံးသောလူ့အဖွဲ့အစည်းတွင် ကိုယ်ကျင့်တရားအပြင်၊ ရပ်ရွာအေးချမ်းသာယာရေးနှင့် ပြည်သူ့ အကျိုး စီးပွား ဖြစ်ထွန်းရေးတို့ အတွက်၊ တရားမျှတစွာကျင့် ဆောင်ရန် အလို့ငှာ လည်းကောင်း၊ ဥပဒေက ပြဌာန်းထားသည့် ချုပ်ချယ်မှုများဖြင့်သာ ကန့်သတ်ခြင်းခံရမည်။
(၃) အဆိုပါ အခွင့်အရေးများနှင့် လွတ်လပ် ခွင့်များကို မည်သည့် အမှုကိစ္စတွင်မျှ ကုလသမဂ္ဂ၏ ရည်ရွယ်ချက်များနှင့် လည်းကောင်း၊ အခြေခံမူများနှင့် လည်းကောင်း ဆန့်ကျင်၍ မသုံးစွဲရ။

Dala Township (township map is shown in figure below) is located 16°45′30″N 96°9′30″E on another bank of Yangon River, opposite side with the downtown area of Yangon. Dala Township has 23 for wards and also 23 for village-tracks (counting 50villages) and is limited by a waterway in the northern and eastern, the Canal of Twante in the western, and Twante in the southern. In spite of its key area close to Yangon City, the township is still to a large extent rustic and undeveloped predominantly in light of the fact that despite everything it does not have an extension over the Yangon River. Everybody can visit to Dala by taking just 15 minutes to across the River of Yangon by ferry passenger ships that are supported and constructed by Japan or traditional boats with motors. There are 30 for primary schools and 2 for high schools in this area. The area is 86.51 square miles and its land has totally 55368 acres. The land of area is only as a plain type and it has not hill, mountain, cliff etc(Department of Population, 2014).

Dala Township, another bank of Yangon is being developed by the project of YCDC. Although the project has been implementing, there is no development because of existing unsystematically. In Dala Township, according to The Myanmar Population and Housing Census Report at 2014, there are 172857 populations, 84671 for males and 88186 for females. In urban area, its population is 119366, 58358 for male and 61008 for female. Most of them are poor and low in education level. Most of people, especially men from the area are daily hard workers. They go to another side of river daily. Not only men but also some children work for daily life. So, they can’t go to school. Because of poverty, most of children from the area have just a primary education level although there are 30 for primary schools and 2 for high schools in this area.
Dala-Twante road crosses through the area. Two sides of township are surrounded by water from river. So, it gets tide twice a month. There has no waste management system. Waste pollution occurs along-side of the area. The environmental pollution is in the high state. The area has no drainage system. Sometimes, during the time of tide, people live in water. The area can’t get underground water, so people depend on lakes filling with rainwaters as their water resources. They use the water from lakes for drinking and daily using. Most of lakes are dirty, no wall to prevent from the incoming of animals, some rubbishes are in the lakes mixing with water, water should not use for drinking because the cleanness of water is empty. However, the water is dirty, people are using it because they have no more water resources. The area has streets, mostly width is around 9ft as maximum. In emergency cases, transport issues can’t be solved.
The area got Nargis Cyclone at 2008, it causes many people to the death and rescuing didn’t get in time because of being informal and unsystematic area. In each ward, streets are formed informally, no crossings, no pavements, no parking space. People from the area use motor-cycles for transportation. By the Myanmar Population and Housing Census 2014 report, the area has 366 for cars, 6726 for motor-cycles, 16074 for bicycles, 449 for boats, 655 for motor-boats and 2349 for carts. And then, there is no public transportation process or system. Some people act transportation activities by using their owned-vehicles illegally. So, the crime rate is higher day by day.

Institution/Organization and Participants relating to the complex transportation situation and issues in Myanmar - by Elbert Titus - Myanmar, present situation is Hybrid Regime in transition process to Democracy. Before this stage, Myanmar had very complex political processes. At the time of independence 1948, Burma Administrative Authorities focused to introduce the Parliament Democracy System. A few years later, some ethnic and other armed-groups emerged and then started civil wars. At 1962, Revolutionary Council led by General Nay Win seized the State Power from Prime Minister U Nu. As their slogan “Burmese road to Socialism”, they founded Myanmar Socialist Government led by President U Nay Win. They created nationalism state and cut all connections outside of country. They seized and controlled all private-ownership as state-ownership. At that time, they didn’t set up state or governmental affairs, law and policy making and state’s infrastructure systematically. They also destroyed Educational Systems and they pushed Country to be the poorest as a developing country until now. The worst one is that they systematically broke and destroyed the mind, standard and behavior of community to be negative. They closed eyes and mouths of community to control and continue their powers for long-live. Finally, most of citizens in trouble countered the Myanmar Socialist Government and the famous 8888 political uprising happened. It seemed that some political leadership changes occurred in government. And, new five presidents changed in the State level. However, General Nay Win still had as a leader of Myanmar Socialist Party. Actually, new five presidents are like as puppets controlled by U Nay Win. Finally, Myanmar Army seized the State Power again and governed as an Autocracy Government led by Senior General Than Shwe. At that time, all unsystematic Myanmar’s Institutions were destroyed again. Country was impoverished more year by year because of their criminality acts in which unlimited production of natural resources, corruption and others. They were not interested in State reforming process to re-build Myanmar as other countries. They also governed Myanmar by using unsystematic authorities, power, policy and laws. Besides, Cronyism is bigger and cronies controlled Myanmar Economic Institution. At 2010, first Democracy Government led by President Thein Sein from USDP under the control of “Myanmar Constitution 2008” appeared. They changed all institutions to Democracy Standard under 2008 Constitution. At that time, country got many difficulties and issues in almost all sectors because they did many things as only they desire. I mean that they didn’t care “what is the most important things or issues to make or solve first”, didn’t listen voices of community and didn’t show transparency in their processes. They neglected specialists’ words, technology, information, communication and suitable methods. So, they faced with many problems and issues as challenges. Among them, I’ll discuss only on transportation issues which is the first priority to solve and find solutions to support and give a force in country development processes or state reforming processes. Transportation issues are available until now. After 2015 Election, Daw Aung San Su Kyi’s NLD Party won almost all constituencies around the country. And then, U Htin Kyaw who is from NLD Party became as a President and Daw Aung San Su Kyi as a State Counsellor. At the time of NLD Government, by the need of Country’s reform and transition, transportation issues must be solved as an essential. Firstly, I would like to describe about why transportation issues occur. The previous time of Myanmar was disfigured condition. Former Government’s Bureaucratic Mechanisms were decayed by authorities and some citizens. There have been both administrative and political corruption. Another one is transparency which is important to be clean government. As results of lacking in transparency, we got corruption and defalcation. Long time ago, British Colony’s Time, Rangoon was built to become a city. British Colonies well-structured infrastructures for transportation. At that time, our country had big and heavy trade in local and foreign. At the time of Myanmar Socialism, they didn’t think about transportation to upgrade because they kept on using British transportation system and infrastructures. If some parts of system or infrastructures needed to upgrade or repair at that time, government couldn’t do for them because of lacking budget to use. General Nay Win was a nationalism, so he didn’t allow foreign in the country and at another side, he stopped exporting to foreign countries. He introduced Closed System for Myanmar and he tried to replace imports with local products. Actually, government had not any saving and investment. But, he did it as he desires. Finally, Myanmar got debts from international as a result. All people from Myanmar lived with lacks. At that time, people used transportation to distribute food and commodities around the country. At the time of dictatorship, situations changed that not same with previous. Population rate increased, Urbanization increased. But, all transportation systems and infrastructures were out of date. At that time, economic situation was better than Myanmar Socialism’s time. Many cronies, relations with dictators were implementing their businesses. Myanmar and China Government had the diplomatic agreement. So, many Chinese company got permissions to work in Myanmar Land. Actually, government had revenues that were from production of electricity and natural resources, trading, income from State-owned Enterprises and Taxes. Transportation was not too much different from previous. They also still used British remains. A big problem was the lack of transparency in State’s Budget. Nobody didn’t know how many incomes government received. Dictators used State’s Budget as their ownerships. They had bank accounts in other countries. At the same time, our neighbor country, Thailand has owned bullet trains, latest and updated infrastructures. In Yangon, people were using old and faded buses as public transportation and some were using irregularly and packed out circular trains. However, dictators, cronies and their relations were driving brand-new cars in roads. At that time, it was very difficult to own a car because the price of a car was more expensive than an apartment. Later, dictators knew that they had ideas to comfort all citizens because they saw Arab-spring revolution and they knew how dictators will end in future. So, they changed some infrastructures and system for transportation and they built roads, bridges and other transportation system. One problem was they bought transportation equipment and materials in very low quality as buying second hand or used things and the worst one was buying expired models that are not used in other countries. By doing like that, they got good responses from the people. Yangon City Development Committee – to reduce the traffic-jam, firstly you must give more ways for buses and cars. In Yangon, there are many street vendors, they do their businesses, but they always take space in pavements or parking areas. So, we should solve this problem. As a solution, I think that we should provide spaces for street vendors at public areas, it’s suitable for street vendors and visitors at public areas. For the cleanness, we must provide trainings or activities to improve their awareness. At the time of USDP Government, it was many challenges in transportation. A few later USDP became government, first they did was permissions to import higher-model cars. Many people imported cars. As a result, Yangon has traffic-jam every day. It was absolutely wrong that it should first repair and build roads and then should arrange and provide public parking areas. And then, car importing permission shouldn’t open freely. It should have limitation. If these two would be alright and ready, they couldn’t give permissions because public parking areas couldn’t not provide for all, they have limitation because of population and buildings took some free spaces and finished constructed buildings couldn’t reconstruct to have private parking areas. Actually, I think if you want to change anything, you should have a research or something like that before the first of implementation. Thus, you will know what things you need to do first, what’s more important, how will you solve and manage risks. It’s better that we can do downtown area as car free zone. If YCDC support bicycles for transportation, it will be alright. By doing this, we will automatically reduce air pollution. And for Health, bicycling is exercise that can do even a child. People Police Force – to reduce traffic jam. In Yangon, there are many private cars more than necessary. The more the numbers of car increase, the less the traffic control system works. Almost private car owner said, they don’t want to use any bus because it waste my time, I don’t feel safe and security on buses. As my point of view, police force must protect civilians as a duty. If we feel we don’t safe and security, police force must do us to be safe. Finally, we can do for this is a police will be on a bus to protect civilians for safety. If we do like that we can control bus drivers to obey laws. And, we can implement to provide 24 hours bus service. Ministry of Transports and Communication – need to change public transportation system. You must control private car importing to reduce traffic-jam. In public, old, fades buses are been clear off. I think you should use a private networking tool for bus drivers to control on ways. You can operate public buses to keep in a time standards. Another issue was very hot around the country since early days of 2017. U Phyo Min Thein, Yangon Region Prime Minister declared all Ma Hta Tha Buses won’t serve in Yangon, he also introduced his new YBS system and only YBS buses will serve in Yangon and others. New YBS buses started at 16th of Jan, 2017. At first, they had many problems and some private buses and cars help them to solve their problems. So, before and after office hours, at almost all bus-stops, there were so many staffs who were waiting buses to go to work or home. Some waited for an hour, some said I hadn’t enough money to take a taxi, some said buses took too much time, some said in the bus, there were full of people, no space to stand up. This was about the beginning time problems. Now, YBS goes alright? No one won’t answer like that because almost all users cannot still comfort yet. Unfortunately, if another buses develop, all YBS users will say “Bye Bye … YBS”. Why YBS still have many issues? It was lack of planning and analysis. Actually, YBS should change buses one line by one line, if only YBS did like that, it is sure to be able to control and manage risks. For next bus line, he will take care previous examples of risks and he will prepare more specific planning and preparing at his turn. Another one is YBS needs to do a research or an analysis. Therefore, YBS can find their weak points, can get solutions to reduce risks and YBS will know what must YBS do? How should YBS do? What’s important to YBS? Myanmar Investment Commission – It’s the business between public sector and individuals around the country. I think government should improve the public transportation as an investment in local. To Government Bureaucratic Mechanism can circulate normally, Government needs income. If transportation changes to private sector, it will be a problem between daily workers and bus fees rate. Civil Society Organization for Environmental Conservation – Increasing the usage of cars causes air pollution. Climate changes are happening all over the world, it is the world request us to save the environment. I have ideas to cooperate with CSOs to clean and save the environment. To reduce air pollution, we must decrease production CO2 rate. We must coordinate with the environment. We must try to reduce production of natural resources. By THE IRRAWADDY 15 March 2018 YANGON — Since gaining independence from the British in 1948, Myanmar (formerly known as Burma) has been governed by two types of president. From the post-independence period until dictator Ne Win’s coup d’état in March 1962, the country had democratically elected heads of state. Under military rule from that year to the end of the quasi-civilian government that was in power from 2011-2016, successive generals installed handpicked protégés. But with the inauguration of President U Htin Kyaw in March 2016, the people of Myanmar witnessed the return of civilian government for the first time in 54 years. Meet Myanmar’s post-independence presidents. Sao Shwe Thaik (1894 — 1962) Sao Shwe Thaik, an ethnic Shan, was the first president of the Union of Myanmar and the last Saopha — or hereditary prince — of Shan State’s Yawnghwe. Sao Shwe Thaik served as the head of state alongside Prime Minister U Nu, from the date of Myanmar’s independence on Jan. 4, 1948 until March 12, 1952. Before he was President, Sao Shwe Thaik had served in the British army. When General Ne Win took power in a military coup in 1962, the Shan prince was arrested. He later died in prison. Dr. Ba U (1887 — 1963) Dr. Ba U was the second president of Union of Myanmar and an ethnic Bamar. Ba U graduated with a law degree from the University of Cambridge and served as the chief justice of the Supreme Court of Myanmar before he succeeded Sao Shwe Thaik as president in March 1952. He served in the position for five years, until March 1957. Mahn Win Maung (1916 — 1989) Mahn Win Maung was an ethnic Karen Buddhist and the third president of Union of Myanmar. As a former government minister, he was selected by Prime Minister U Nu for the presidency and succeeded Dr. Ba U in March 1957. Mahn Win Maung served until March 1962, when General Ne Win ousted U Nu’s government in a military coup. He was then imprisoned for five years. General Ne Win (1910 — 2002) Born as Shu Maung, U Ne Win briefly took control of Myanmar in 1958, during a period of military rule known as the Caretaker Government. He came to power more permanently in March 1962 through a military coup and would act as Myanmar’s head of state for nearly 20 years, until Nov. 9, 1981. A military commander of Bamar-Chinese descent, he founded the Burma Socialist Program Party (BSPP) in 1962 and served as its chairman until 1988, resigning during the student uprisings that year. Throughout this period, the BSPP was the only legal political party in the country, and through it U Ne Win championed the nationalization of business and ushered in a period of intense xenophobia. U Ne Win remained the commander-in-chief of the military for a total of 26 years. He later died while under house arrest in Yangon. General San Yu (1918 — 1996) Gen. San Yu, also of Bamar-Chinese descent, was the commander-in-chief of Myanmar’s military and the fifth president of the country, which was then known as the Socialist Republic of the Union of Burma. He served from November 1981 until July 1988, a time during which U Ne Win was still the BSPP party chairman. Before Gen. San Yu became president, he played an integral role in drafting the military’s 1974 Constitution. Brigadier General Sein Lwin (1923 — 2004) Brig. Gen. Sein Lwin, an ethnic Bamar, served as the sixth president of Myanmar for only 17 days, during a period of intense pro-democracy uprisings. During his rule — from July 27 to August 12, 1988 — he was better known as the “Butcher of Rangoon” for giving the order on Aug. 10, 1988, to open fire on student demonstrators near Yangon General Hospital. The protests continued until Brig. Gen. Sein Lwin stepped down. He was reportedly taken care of by the government, and provided with cars, food and support for many years that followed. Dr. Maung Maung (1925 — 1994) Dr. Maung Maung, an ethnic Bamar, was the seventh president of the Union of Myanmar and a well-known writer. He studied law at the Netherland’s Utrecht University and at Yale University in the US, and served as chief justice under U Ne Win’s BSPP government. He served as president for only one month — from Aug. 19 to Sept. 18, 1988 — before being ousted in a military coup led by General Saw Maung. Myanmar’s government would undergo name changes, from the State Law and Order Restoration Council (SLORC) to the State Peace and Development Council (SPDC), led by military men like Senior General Than Shwe. The country would not have another leader with the title of “president” until 2011. U Thein Sein (1945 — ) Selected by the Union Parliament for the presidency in March 2011, the general-turned-politician became Myanmar’s eighth president after an election that was boycotted by the NLD and described by Western countries as “neither free nor fair.” U Thein Sein served as the prime minister in the previous military regime from 2007 to 2011. In 2010 he retired from the military, where he had attained the rank of brigadier general, and instead led the military-backed Union Solidarity and Development Party. His tenure as the country’s president ended on March 30, 2016. U Htin Kyaw (1946 — ) Current President U Htin Kyaw was born in Yangon in 1946. The second son of respected national poet Min Thuwun, he graduated from the University of London, where he studied computer science. His family has a political pedigree: Min Thuwun was elected to Parliament in 1990 and U Htin Kyaw’s father-in-law, U Lwin, is one of the NLD’s founding members. U Htin Kyaw was a senior executive with the Daw Khin Kyi Foundation, a non-profit health and education charity named for Daw Aung San Suu Kyi’s mother. He is believed to be one of The Lady’s right-hand men and has a reputation within the NLD as an honest man. His wife, Su Su Lwin, was a Lower House NLD lawmaker and the chairwoman of the chamber’s international relations committee. U Htin Kyaw is also an author who, being of both Mon and Burmese heritage, wrote under the nom de plume Dala Ban, the name of a famous Mon warrior chosen by his father. He published a book about his father in 2009. His term as president will end on March 30, 2021. U Win Myint (1951 – ) With his inauguration on Friday, U Win Myint has become Myanmar’s tenth president. The House speaker-turned-president is the second head of state elected by the Daw Aung San Suu Kyi-led National League for Democracy (NLD) government in two year’s time, following U Htin Kyaw’s sudden retirement from the post in the third week of March 2018. Like the former president, the one-time lawyer is one of the State Counselor’s allies. A hardcore NLD member since the formation of the party in 1988, the 67-year-old had three electoral victories on the party ticket—being elected for the seats in his hometown Irrawaddy Delta’s Danubyu in the 1990 election, Irrawaddy’s Pathein Township in the 2012 by-election and Yangon’s Tamwe township in the 2015 election. During his time in the Lower House, U Win Myint was known to be a strict taskmaster. He often warned lawmakers to do their homework before the parliamentary session and to keep their proposals and questions specific and to the point. The lawmakers were not alone in receiving his stern warnings. Union ministers were also among those faulted for poorly prepared answers in Parliament. Moreover, he has occasionally given military appointees in Parliament a hard time. Like many other political activists and politicians, U Win Myint was arrested several times by the previous military regime. သမ္မတရာထူးကို ဆက်ခံရန် ဝန်ကြီးချုပ်ဦးနု၏ ရွေးချယ်ခြင်းခံရသည်။ ဗိုလ်ချုပ်ကြီးနေဝင်းက စစ်တပ်အာဏာသိမ်းမှုအဖြစ် ဦးနုအစိုးရကို ဖြုတ်ချသည့်အချိန် ၁၉၆၂ ခုနှစ်၊ မတ်လအထိ မန်းဝင်းမောင်က အာဏာထိန်းသည့်ကာလတွင် မြန်မာနိုင်ငံကို ခေတ္တမျှ ထိန်းချုပ်ခွင့်ရလာသည်။ သူသည် အမြဲတမ်း အာဏာရယူထားနိုင်ရန် ၁၉၆၂ ခုနှစ်၊ မတ်လတွင် စစ်တပ်က အာဏာသိမ်းခဲ့ပြီး မြန်မာနိုင်ငံ၏ အကြီးအကဲနေရာကို ၁၉၈၁ ခုနှစ်၊ ဆဋ္ဌမမြောက်သမ္မတအဖြစ် ၁၄ ရက်မျှသာ ထမ်းဆောင်ခဲ့ရသည်။ သူ အာဏာရခဲ့သည့်ကာလသည် ၁၉၈၈ ခုနှစ်၊ ဇူလိုင်လ ၂၇ ရက်မှ သြဂုတ်လ ၁၂ အထိဖြစ်ပြီး ၁၉၈၈ ခုနှစ်၊ သြဂုတ်လ ၁၀ ရက်တွင် ရန်ကုန်ဆေးရုံကြီးအနီး ဆန္ဒပြကျောင်းသားများကို ပစ်သတ်ရန် အမိန့်ပေးခဲ့သဖြင့် ရန်ကုန်မြို့၏ သားသတ်သမားဟု လူသိများထင်ရှားသည်။ ဆန္ဒပြမှုများ ဆက်လက်ဖြစ်ပွားနေစဉ် ဗိုလ်မှူးချုပ်စိန်လွင် ပြုတ်ကျသွားခဲ့သည်။ သူ့ကို အစိုးရက နှစ်ပေါင်းများစွာကြာသည့်တိုင် စောင့်ရှောက်ထောက်ပံ့ခဲ့ရကြောင်း ပြောကြသည်။ ဒေါက်တာမောင်မောင် (၁၉၂၅-၁၉၉၄) ဗမာလူမျိုးတဦးဖြစ်သူ ဒေါက်တာမောင်မောင်သည် ပြည်ထောင်စုမြန်မာနိုင်ငံ၏ သတ္တမမြောက်သမ္မတဖြစ်ပြီး ထင်ရှားသည့်စာရေးဆရာတဦးလည်း ဖြစ်သည်။ သူသည် ဥပဒေပညာကို နယ်သာလန်နိုင်ငံ၊ Utrecht တက္ကသိုလ်နှင့် အမေရိကန်နိုင်ငံ၊ ယေးလ်တက္ကသိုလ်တို့တွင် သင်ယူခဲ့ပြီး ဦးနေဝင်း၏ မဆလပါတီအစိုးရအောက်တွင် တရားသူကြီးချုပ်အဖြစ် တာဝန်ယူခဲ့သည်။ ဗိုလ်ချုပ်ကြီးစောမောင်ခေါင်းဆောင်သည့် စစ်တပ်က အာဏာမသိမ်းမီ ဒေါက်တာမောင်မောင်သည် သမ္မတအဖြစ် ၁၉၈၈ ခုနှစ်၊ သြဂုတ်လ ၁၉ ရက်မှ စက်တင်ဘာလ ၁၈ ရက်အထိ တလသာ ထမ်းဆောင်ခဲ့ရသည်။ ယင်းနောက် အစိုးရ၏ အမည်ကို ခေတ်ကာလအလျောက် ပြောင်းလဲခဲ့ရာ နိုင်ငံတော်ငြိမ်ဝပ်ပိပြားမှုတည်ဆောက်ရေးအဖွဲ့(နဝတ)နှင့် ဗိုလ်ချုပ်မှူးကြီးသန်းရွှေကဲ့သို့ စစ်ခေါင်းဆောင်များဦးဆောင်လျက် နိုင်ငံတော်အေးချမ်းသာယာရေးနှင့် ဖွံ့ဖြိုးရေကောင်စီဟု ခေါ်ဆိုခဲ့သည်။ အဆိုပါကာလမှ ၂၀၁၁ ခုနှစ်အထိ တိုင်းပြည်တွင် သမ္မတဟူသောရာထူးဖြင့် နောက်ထပ်ခေါင်းဆောင် ပေါ်ထွက်မလာခဲ့ချေ။ ဦးသိန်းစိန် ( ၁၉၄၅- ) အမျိုးသားဒီမိုကရေစီအဖွဲ့ချုပ် (NLD) က သပိတ်မှောက်ပြီး အနောက်အုပ်စု တိုင်းပြည်များက လွတ်လပ်၍ တရားမျှတမှုမရှိဟု သတ်မှတ်ခြင်းခံရသော ရွေးကောက်ပွဲအပြီး စစ်ဗိုလ်ချုပ်ကြီး အသွင်ပြောင်း နိုင်ငံရေးသမားကို အဋ္ဌမမြောက်သမ္မတအဖြစ် ၂၀၁၁ ခုနှစ်၊ မတ်လတွင် ပြည်ထောင်စုလွှတ်တော်က ရွေးကောက်တင်မြှောက်ခဲ့သည်။ ဦးသိန်းစိန်သည် ယခင်စစ်အစိုးရလက်ထက် ၂၀၀၇ ခုနှစ်မှ ၂၀၁၁ ခုနှစ်အထိ ဝန်ကြီးချုပ်အဖြစ် တာဝန်ယူခဲ့သည်။ ၂၀၁၀ ပြည့်နှစ်တွင် သူသည် စစ်တပ်၌ ဒုတိယဗိုလ်ချုပ်ကြီးရာထူးမှ အငြိမ်းစားယူလိုက်ပြီး စစ်တပ်က ကျောထောက်နောက်ခံပေးထားသည့် ပြည်ထောင်စုကြံ့ခိုင်ရေးနှင့်ဖွံ့ဖြိုးရေးပါတီကို ဦးဆောင်ခဲ့သည်။ တိုင်းပြည်၏သမ္မတအဖြစ် ၂၀၁၆ ခုနှစ်၊ မတ်လ ၃၀ ရက်အထိ ထမ်းဆောင်ခဲ့သည်။ ဦးထင်ကျော် ( ၁၉၄၆- ) လက်ရှိသမ္မတဖြစ်သူ ဦးထင်ကျော်ကို ၁၉၄၆ ခုနှစ်တွင် ရန်ကုန်မြို့၌ မွေးဖွားခဲ့သည်။ အမျိုးသားစာဆို မင်းသုဝဏ်၏ ဒုတိယသားဖြစ်ပြီး လန်ဒန်တက္ကသိုလ်တွင် ကွန်ပျူတာသိပ္ပံဘာသာရပ် လေ့လာဆည်းပူးပြီး ဘွဲ့ရခဲ့သည်။ သူ့မိသားစုမှာ နိုင်ငံရေးအစဉ်အလာကြီးမားပြီး ဖခင်ကြီး မင်းသုဝဏ်သည် ၁၉၉၀ ပြည့်နှစ် ရွေးကောက်ပွဲတွင် အရွေးချယ်ခံရသကဲ့သို့ ဦးထင်ကျော်၏ယောက္ခမဖြစ်သူ ဦးလွင်သည်လည်း အမျိုးသားဒီမိုကရေစီအဖွဲ့ချုပ် တည်ထောင်သူတဦးဖြစ်သည်။ အကျိုးအမြတ်မယူဘဲ ကျန်းမာရေးနှင့် ပညာရေးထောက်ပံ့နေသော ဖောင်ဒေးရှင်းတခုဖြစ်သည့် ဒေါ်အောင်ဆန်းစုကြည်၏ မိခင်အမည်ကို ဂုဏ်ပြုခေါ်ဝေါ်ထားသော ဒေါ်ခင်ကြည်ဖောင်ဒေးရှင်းတွင် ဦးထင်ကျော်သည် ထိပ်တန်းအမှုဆောင်တဦးဖြစ်သည်။ သူသည် ဒေါ်အောင်ဆန်းစုကြည်၏ ညာလက်ရုံး ယုံကြည်စိတ်ချရသူအဖြစ် သတ်မှတ်ခံရပြီး NLD ပါတီတွင်း၌လည်း ရိုးသားသူအဖြစ် ဂုဏ်သတင်းရှိသည်။ သူ့ဇနီးဖြစ်သူ ဒေါ်စုစုလွင်မှာ NLD ပြည်သူ့လွှတ်တော်ကိုယ်စားလှယ်ဖြစ်ပြီး နိုင်ငံတကာဆက်ဆံရေးကော်မတီတွင် ဥက္ကဋ္ဌအဖြစ် တာဝန်ယူထားသည်။ ဦးထင်ကျော်သည် စာရေးဆရာတဦးလည်းဖြစ်ပြီး မွန်နှင့်ဗမာအမွေအနှစ်နှစ်ခုစလုံး ဆက်ခံလျက် ထင်ရှားသည့်မွန်စစ်ပွဲကို အစွဲပြုလျက် သူ့ဖခင်ကြီး ရွေးချယ်ပေးသည့် ဒလဘန်းဟူသော ကလောင်အမည်ဖြင့် စာပေများ ရေးသားလေ့ရှိသည်။ သူ့ဖခင်ကြီးအကြောင်း ရေးသားထားသည့် စာအုပ်တအုပ်ကို ၂၀၀၉ ခုနှစ်တွင် Risks in Transition to Democracy -written by Elbert Titus & Rose Mary. Transition is a being state of moving a situation to another term of situation eventually. When we think about transition, there are many kinds of transitional regime all over the world, also Myanmar includes. Transition is mostly occurred in countries which are trying to move forward to democratic country. In transition period, changes happen step by step by negotiating, communicating, discussing and so on. Besides, transitions are period of political instability and now democracies are usually flowed systems. In transition, there are some outcomes: 1) weak democracy 2) hybrid regime 3) Instability 4) State failure Mostly, duration of transition takes 20 years or 30 years. Sometimes, it can take longer time. In transition, we can see two different kinds of transitions which are political transition and economical transition. From my understanding point, political transition is changing the process of government, its power, its roles and its systems. In here, by building relationship between autocrats and democrats to get national reconcile. By running government between autocrats and democrats, they do elections, parliamentary systems, rule of laws and citizen participation. When the political systems change, economic system will be also change automatically. In democracy countries, market based economy are used. So, it causes to try to decrease role of government in the economic field and market. Why risks occur in transition to democracy? As for us, it is really important to know. By knowing this, people can reduce that risks with every way they can. Because of books which I read and lectures which I got, it is very clear to that before this stage, autocracy government or dictatorship had been. They tried to hide their previous actions so the risks are uprise. In another way, they create those risks to withhold processes of transition. And then, some risks are here in this paper. As risk 1, Risk of nationalism is one of the facts among so many risks. It is very popular risk in many countries. General population have different identities. So, they are very sensitive upon their identities. And then, with the aim of unrest in general population, risk of nationalism is very useful. From the lessons learnt from the world, some autocratic governments use this risk to increase their roles and to take more places in governance system. In this risk, most of them are based on religion. Before the starting place of this risk, some nationalists are emerged in the country. They may be people who are from religious side as the key person of the target area. Although the lack in evidence, most of them are controlled by the former dictatorship or autocratic government. The target areas are chosen under the situation of uneducated community, risk in poverty or bad people. For risk 2: repressive and unwilling regime are chosen to describe in this paper. According to the lessons from the world history, most dictators change their actions. They try to crate changes to fake general population. They artifice general population by giving new government or situation under controls. It is a being state called as fake or weak democracy. They change citizen’s view on government. They chose a new government to continue in loyalty of their forces. However, they act in this stage, protests are also available. At that time, they act violence and crack-down as reflection. As risk 3, we want to mention here is that lack of functional state structures. At the time of dictatorship, the dictators have no function to govern the state. During a period of transition, the state and government try to build a functional structure to stability. At that time, many issues can emerge because of poor state institution. And then, some issues will also emerge from general population because of failing to provide education, health, and infrastructure. Risk 4 is about privatization. At the time of dictatorship, all resources and enterprises are owned by dictators and their relatives, however thy named as state-owned. Their relatives and their trusted people got permission in many enterprises. It empowered to rise of cronyism. In transition to democracy, most of government do to decrease their roles in economy. So, they start privatization which is the changing of state owned enterprises to private sector. Sometimes, privatization is occurred because the public sector can’t manage enterprises. It can be caused because of budgeting, no skills to manage. In transition, if privatization emerges, cronies from the previous dictatorship get permission to work automatically as private sectors because they have stood as country top wealthy people since the time of dictatorship. If cronies get enterprises by the statement of privatization, it is also same with rise of cronyism. Corruption is that we want to mention as risk 5. It is the global issue around the world. Corruption are occurred at the state without transparency. Corruptions are found mostly in unformal and unfunctional government be bureaucratic mechanism systems. Under corruption, government authorizes and cronies act to increase their owns and plays government processes and activities with their wishes. In transition, parliament acts laws to stop corruption. However, it acts corruptions are still being with various versions, forms and reasons. Risk 6: general population expectation. For general population who are waiting changes, transition is their first hope. All of them have their expectations for the future. If they have a chance to claim, they will do. On the other hand, this issue emerges because of congressman or representatives’ words and promise before election. They give promises to general population easily before election. After election, if they cannot keep on their promises or implement their promises, this issue occurs quickly, mostly, easily and seriously. Rise in poverty is the last one which our group want to describe as risk 7. At initial period of transition, most of states face with rise in poverty because the former dictators stole all natural resources and all state-owns. For a new government, it has no budget to circulate processes. At that time, there is no any foreign investments because foreign investors watch situation. For general population, government cannot create jobs and work-places for them. So, the unemployed rate in citizens become higher day by day. In general, it is called as rise in poverty. In conclusion, as we mention above, our world is facing with so many risks in transition period on the way to democracy. Currently, Myanmar meets with the risks in transition and state is going to weak democracy or unwilling regime. Here in this paper, our group describe seven risks when a country is standing or trying to go forward to democracy.
