With the increasing popularity of GPS tracking devices there is a growing question as to their legality. For instance, the police in Wisconsin can attach a covert GPS tracking device to a car for any reason or for that matter, no reason at all. No warrant or any level of suspicion is required. This was brought about by a Wisconsin Court of Appeals decision stating “If police follow a car around, or observe its route by means of cameras mounted on lampposts or of satellite imaging as in Google Earth, there is no search.

Well, but the tracking in this case was by satellite. Instead of transmitting images, the satellite transmitted geophysical coordinates. The only difference is that in the imaging case nothing touches the vehicle, while in the case at hand the tracking device does. But it is a distinction without any practical difference.”

Then go to New York where the Court of Appeals split 4-3 on the issue. With the majority saying that when the police planted a tracker on a van for 65 days it violated the van owner’s constitutional protection against unreasonable searches. Chief Judge Jonathan Lippman wrote? “The massive invasion of privacy entailed by the prolonged use of the GPS device was inconsistent with even the slightest reasonable expectation of privacy.”

To further confuse the issue, in 1983 the U.S. Supreme Court ruled that when you drive on a public street you do not have a reasonable expectation of privacy. That particular ruling was to allow police to place radio beepers in cars without getting a warrant. It is yet to be seen how the lower Courts will interpret the U.S. Supreme Court ruling when it comes to GPS trackers.

Right now there does not appear to be a problem with a citizen using a tracker. For instance, tracking your teen driver or placing a tracking device in your child’s knapsack. None of these action violate the fourth amendment. The question is can authorities use it without a warrant and that will depend on where you live. Check with your local authorities.

Only a year or so ago, the idea that there even were best GPS units for under $200 would have seemed absurd. But prices have got down quite a bit in the past two years, and now, you can get quite a lot for your $200.

Now, there are quite a few excellent GPS units for under $200. Let’s take a look at a few of the best ones.

Consumer Reports did an article on what they considered to be the best rated GPS units. Two that made it on their list were the Garmin nuvi 350 and the Tom Tom One, 3rd Edition. Both are currently selling for under $200.

The Garmin nuvi 350 is truly a great GPS unit. It has maps of the United States and Canada. It also actually says the names of the streets you need to turn on, and has real-time traffic capability (with subscription). Currently, the nuvi 350 is running slightly less than $200.

The Tom Tom One, 3rd Edition is considered an entry level unit because of it’s price–about $150. But it has considerably more features than most entry level units. I especially like Tom Tom’s Map Share technology that lets users actually make suggested changes in the maps to reflect current road conditions.

In addition to these two units that Consumer Reports mentioned, let me point out the Garmin nuvi 200. It costs only slightly more than $150, but has maps of the lower 48 states plus Hawaii and Puerto Rico. It also has voice instructions for turns and it can double as a digital picture viewer. It’s hard to say, but the nuvi 200 might be my favorite entry level device because of Garmin’s market share and commitment to quality.

Magellan, the third largest manufacturer of GPS devices in the United States, is certainly not to be left out. Their Magellan Maestro 3100 is a direct competitor of the Tom Tom One, 3rd Edition and the nuvi 200. At slightly less than $150, the Maestro 3100 is an excellent entry level device.

There are certainly other manufacturers of GPS units, but personally I like to stick with the top three in the U. S. market. That way I know my purchase will be supported in the future.

Currently Garmin has about half the U. S. market, followed by Tom Tom and Magellan, each with about 20%. The other manufacturers fight over the scraps.

Garmin is known for their quality. Tom Tom has been rapidly gaining market share by pricing their products very aggressively. And Magellan was one of the original companies to even make these devices.

For under $200, you won’t go wrong with any of these GPS units I’ve mentioned.

The device allows you to track the cell phone through the cell phone network and relays back the location. Another feature is that you can track incoming and outgoing calls and numbers.
