Colonel Amani SULIANO of 3FIR Unit was reported to have collapsed at Albert Park yesterday whilst attending the Parade Rehearsal for tomorrow's Parade

to mark Fiji Day.

Sources say he is believed to have survived but had a stroke as well.

The colonel joins the ever-increasing list of military and regime figures struck down with sickness in recent times led by the dictator Bainimarama himself and his beloved puppet, the illegal Attorney General and Minister for All Things, Khaiyum.

No wonder critics of the illegal regime are celebrating and wishing the worse for these regime stooges as their illegal and repressive acts slowly catches up on them and their leaders.

Surely, each military personnel must be quietly asking why this onslaught of ailment striking amongst them? Equally, each one of them would have the answer and most likely it has to do with their being part of an illegal and repressive regime now terrorising the people of Fiji, including their very own Fijian chiefs, church ministers and fellow Fijians.

Accordingly, I say again to military officers:

turn away from being part of the illegal regime you're part of now;
gang up with like-minded officers and plan the removal of the leadership of the illegal regime;
give your support to those opposing the regime such as the Unions, Church and VTR
take care not to be part of the hit squad led by Ben Naliva, Aseri Rokoura and Sitiveni Qiliho who are torturing and assaulting civilians because they will answer for it in the end;
You will be ever-revered by the nation and people of Fiji if you are part of efforts, and if more so, succeed in removing the current illegal regime, that is preventing Fiji from realising its potential to be again a nation we can all be proud of.
If you have any doubt, carry it out this plea and find out. You will be pleasantly surprised how many others are just waiting for someone to begin the return to democratic rule. As military officers, you only, have the means and the opportunity to carry it out. You owe it to yourselves, your nation and your fellow Fijians.

A BILLION dollar mine is expected to start operating and producing gold and copper in the Namosi highlands within four years.

The Namosi Joint Venture mine is expected to generate an annual income of $1 billion at the current world market price of gold and copper.

NAMOSI COPPER MINE

Permanent secretary for Lands and Mineral Resources Filimone Kau said, "hopefully, the company should be able to get its mining lease by June next year.

"The company will be ready to invest in building infrastructure and mine developments costing about $1billion.

"We are looking at Namosi and also continuing work on a feasibility study, the viability of the business, model of the mine and environmental issues."

Mr Kau said landowners were continuing talks with the company for access to land for exploration and studies.

"There is also the compensation agreement but right now discussions are only limited to negotiations on exploratory work.

"It's both gold and copper and the land area involved for exploratory works is 72,352 hectares.

"There are hiccups here and there but we are trying to resolve it and the Ministry of Lands and Mineral Resources is playing a facilitating role to ensure all grievances are resolved.

"We have organised a meeting this week to look at some issues raised by the landowners and the company."

Mr Kau said as far as the Government was concerned, the ministry was the key sector ministry in discussions on the exploration and transition into the mining state.

He said lessons have been learnt from the Vatukoula mine and others in the Pacific that the management of mining needs to be co-ordinated with a broader participation of the Government.

"We are setting up a Government task force, which is bringing in all stakeholders to be part of the dialogue because we want to make it right as a lot is at stake.

"We want to do it properly and, hopefully, lessons from those places tell us that Namosi turns out to be a worthwhile, viable and well-thought out project.

"If all goes well, then the mine should be operating and producing by late 2014 or early 2015.

"As forecast by the company, it will be a $1billion return annually with regards to the gold and copper price now."

Fiji Corruption Kings - Dictator Bainimarama & his Puppet Khaiyum

The report by the Heritage Foundation merely reveals something we all know since the illegal regime of Bainimarama and Khaiyum came to power in Fiji in 2006. Corruption we all know always thrive in an environment of tight political and economic control over the affairs of government. That is precisely what we have in Fiji.

Even worse when regime leaders themselves are the ones actually engaging in heavy and organised corruption. That is again the case with the dictator Bainimarama and his puppet the illegal Attorney General and Minister for All Things, Khaiyum.

While the people of Fiji strive to make ends meet, both their overseas bank accounts, swell with all the kickbacks they have managed to organise from every deals made with investors wanting to invest in Fiji. To make matters worse, all this is happening under the very noses of those responsible for upholding the law because Dictator Bainimarama and Kahaiyum regard themselves as well above it.

Ying & Yang in the Illegal Fiji Regime

The blog site Coup 4.5 exposed the illegal AG Khaiyum’s title of Acting Prime Minister that is set in stone in the official Plaque commemorating the opening of the Fiji National University Film and TV studio. This use of the title, of Acting PM, portrays the illegal, power-hungry, Aiyaz Khaiyum’s clandestine ambition. It also broadcasts a signal of things to come.

The power-drunk and money-grabber Khaiyum, through the Plaque, is sending a loud and clear message to all and sundry, including his tyrant boss, the murderer Voreqe Bainimarama, that he (Khaiyum) intends to become, by hook or by crook, the next Prime Minister of Fiji. Acting as Prime Minister is only the first step. Khaiyum intends to continuingly act as Prime Minister of Fiji whenever the murdering dictator is absent from the country. This is Khaiyum’s next steps.

Bainimarama Not PM of Fiji

The people of Fiji and the countries of the South Pacific and the world all need to be clear that Bainimarama is not Prime Minister of Fiji.

The Fiji Court of Appeal ruled, in its historic judgment in 2009, that the 5 December 2006 Military Coup was illegal, the Military junta that replaced the SDL Government was illegal and all acts by it are illegal. Consequently, the ruling junta led by Bainimarama is illegal and thus is not the Government of Fiji. Ipso facto, Bainimarama is not the Prime Minister of Fiji. And therefore, Khaiyum is not the Acting Prime Minister of Fiji nor is Khaiyum Fiji’s Attorney-General.

In addition, according to informed sources, Khaiyum never informed his boss, the tyrant Bainimarama, of his (Khaiyum) plan to have the Plaque made and mounted. If this be true, then it was a self-enlightened move, by Khaiyum, to show Bainimarama who is the real boss of Fiji.

End Game for Dictator Bainimarama

2006 Coup and Military Junta Illegal

Since the December 2006 Coup is illegal and the regime is illegal, its 2009 Decree abrogating the 1997 Constitution of Fiji has no legal standing, is illegal and is null and void. The fruit of the poison tree is also poisonous.

The 1997 Constitution is the supreme law of Fiji.

In the High Court rulings, the Prasad case being one, one of the Judges wrote that a Constitution is immutable and cannot be abrogated. The 1997 Constitution of Fiji is still valid.

The 1997 Constitution, in Article 98, provides that Fiji’s President shall appoint as Prime Minister “the Member of the House of Representatives who in the President’s opinion can form a Government that has the confidence of the House of Representatives.” The same provision is contained in Fiji’s 1970, 1990 and 1997 Constitutions.

Fiji has no House of Representatives. Bainimarama was not then, or never was, a Member of the House of Representatives. This being the case, Bainimarama cannot be Prime Minister and he is not the Prime Minister of Fiji. Khaiyum cannot therefore be Acting Prime Minister.

The Plaque therefore dubbing the terrorist and former bomb-maker and Fiji’s illegal Attorney-General as the Acting Prime Minister is really, as previously stated, a sign of things to come.

Bainimarama and Khaiyum’s Evil Plan to Rule Fiji

The ultimate and sinister plot of the murderer Bainimarama and Khaiyum is to retain power by hook or by crook until they die. They are considering, subject to events and circumstances, to conduct a fraudulent and crooked election process in 2014. The ins and outs of that proposed election fraud were explained in a previous blog.

With a dubious and fraudulent victory assured by the murderer Bainimarama and Fiji’s Taleban terrorist, the plan, according to insiders, is for Khaiyum to be made Prime Minister and Attorney-General and the murderer Bainimarama to be made President of Fiji. And the two will rule Fiji forever.

Conclusion

The Plaque, commemorating the opening of the Fiji National University Film and TV studio, is only a snippet of the coming event. It also casts an evil shadow, loud and clear, that Aiyaz Khaiyum is Acting Prime Minister now, and will be Prime Minister later.

With Khaiyum as Prime Minister Fiji is doomed to destruction, just like Sodom and Gomorrah in the Bible, especially when Khaiyum’s illegal acts wear the false cloak of legitimacy and democracy. With this false cloak the rule of law, human rights and justice all become just words and Fiji, as a country, is doomed.

Australia waits for meaningful step towards democracy in Fiji

Evil Couples at the Root of Fiji's Problems

The Australian government says it is still waiting to see a genuine move towards democracy in Fiji.

Fiji’s interim Prime Minister Frank Bainimarama reiterated his plan at a recent meeting of the United Nations General Assembly for the run up to elections in 2014, saying electronic voter registration would start in January.

He also said from September next year Fiji must turn its attention to developing a new constitution.

But Australia’s Parliamentary Secretary for Pacific Island Affairs Richard Marles says it’s hard to see that plans for registering voters are a meaningful step, when in the same breath the regime announces a new decree targeting union activity.

“To hang your hat on this investigation of electronic voter registration as being some meaningful step towards democracy is just not right. We need to see a genuine and meaningful step in the right direction but if that were to occur, we’re there with bells on and we’re there to work with Fiji to try and move to democracy as soon as they can.”

Amnesty head says Fiji uprising not impossible

The Secretary General of Amnesty International Salil Shetty says the popular mobilisations in the MiddleEast and North Africa show similar change is not impossible in Fiji.

He says if he’d been told a year ago that Egypt’s President Hosni Mubarak would be gone he would have thought it impossible.

Sign of things to come in Fiji

Mr Shetty says Amnesty worked for a long time documenting the abuses of the Mubarak regime as it’s doing in Fiji.

Amnesty International has recorded reports of torture and other human rights violations in Fiji and Mr Shetty says the situation is worsening.

“In all these places, we are talking currently about Syria, Yemen, I don’t see how Fiji is such an exception. If this level of violation of human rights continues and if people don’t have a voice and if they have no basic freedoms, in my view it’s a matter of time.”

Sources in Fiji are revealing that one of the most hated man in Fiji, the illegal Attorney general and Minister for All Things, Aiyaz Khaiyum, is sick in bed. It is reported he has measles.

As an indication of the hatred felt towards this man in Fiji, some are even wishing the worst for him. This no doubt reflects Khaiyum's repressive and manipulative influence over the dictator Bainimarama over the many policies implemented by the illegal regime. His hand can be seen in the many illegal decrees and orders covering his equally numerous portfolio areas impacting on the lives of the people and businesses in Fiji.

Back in history measles had claimed near a third of Fijian lives. Some are even touting Khaiyum's fate as already sealed by the souls of past Fijian lives owing to his part in demolishing Fijian institutions in partnership with the Dictator Bainimarama. Such has been the impact of his puppet's rule over Fijians that even those who have passed on are still spewing their wrath on the living dead like Khaiyum.

To make it worse, the collusion and close involvement of his family members in the affairs of government especially in cutting lucrative deals for them and for him and the Dictator Bainimarama is now well known. Fijians are now seeing any ailment on his part as payment for the many sinful and repressive acts he has been inflicting on the people of Fiji. It is pay back time Khaiyum. Just like your colleagues of late Pio Tikoduadua and Ratu Inoke Kubuabola.

Just as Fijians will say:

"O na galu mai Sakaraia (Khaiyum in this case!"

Khaiyum will be hoping and praying his sickness will only be temporary. Undoubtedly, he will find this health setback a total inconvenience, especially since it may be placing a hold on his temporary appointment as Acting Fiji PM. He has been seen thriving and milking for all the glory and adulation that came with the undeserving elevation in his status since his puppet's departure for foreign lands making him Acting PM.

So much so he even managed to open a premises in Suva with a plaque that labelled him as such, even though it is thoroughly illegal for interim regimes to do so. But no, not the coward Khaiyum, as he wants to be remembered for his illegal accomplishments well after he begins his deserved rest in Naboro prison, accompanied by his puppet and other colleagues when democracy returns to Fiji.

Another arrival party gets the red carpet treatment

Yet another Chinese company is looking to make its fortune in Fiji.

Gold Century Group (Fiji) Limited plans to inject about F$500 million in a commercial and residential project on 17 acres of land at Raiwai where it intends to build a multi-storey complex to house retail outlets, modern and professional office space, and up-market residential lots.

Bainimarama dotting down again

Gold Century Group's chairman, Shi Yubao, has himself revealed (at the handing over ceremony of the lease in Suva) that the regime fast tracked its application.

Yubao says the Frank Bainimarama government 'facilitation' ranged from Investment Fiji allowing it to register, to surveying the land, to approving the survey and building concept and the environmental management plans, all in the space of just 15 weeks.

In a MINFO release, the permanent secretary for Lands and Mineral Resources, Filimone Kau, lauds how hard Bainimarama has worked to attract investors to Fiji, saying the whole project could've easily taken 18-24 months.

“Government agencies are beginning to realize that time is extremely critical in the business world, and they are now taking concrete measures to satisfy the expectations of foreign investors." (see attached statement)Development and business is welcomed but cynicism continues to grow about the deals between China and Fiji and fears Bainimarama and Aiyaz Sayed Khaiyum are selling Fiji off as they line their pockets, in kickbacks.

Informants say the pair are getting $50 million in cuts from the Gold Century loan alone.

Those in-the-know also insistBainimarama and Khaiyum have almost $US30 million in offshore accounts, distributed in Hong Kong, Malaysia and Dubai. Coupfourpointfive is unable to verify these figures at this stage and can only say sources have proven to be right in the past on this sort of information.

Informants have also sounded the alarm about Bainimarama giving Chinese contractors army land to build a shop in Bay View. They claim the Chinese workers who are there are in fact 'Chinese army guys establishing a base in the Pacific under the nose of the dictator.'

"The Chinese vice president has visited twice in two years. This is not a coincidence. He comes to oversee the development of the mini chinese state that is Fiji," says a source.

"The Chinese government knows quite well Fiji is incapable of paying these loans and history shows that China took control of Tibet, Hong Kong and Taiwan by force. Fiji is its conquest and they have already started setting up a base by pouring in labours and businesses in Fiji."

Intel sources say they have been getting first-hand reports from the Chinese movements and that monitoring of workers has resulted in reports of some of them carrying satellite phones with a Chinese army encryption system.

It's believed as many as 10,000 Chinese nationals are now in Fiji as a result of work facilitated by Bainimarama since 2009.

Vindictive Regime Appeal Against Tuisolia Refused

Tuisolia still being pursued by illegal Fiji regime

AN appeal by the Fiji Independent Commission Against Corruption against businessman Ratu Sakiusa Tuisolia was refused yesterday.

Delivering the ruling yesterday, Court of Appeal Judge Justice Kankani Chitrasiri said the prosecution failed to establish any injustice had occurred to the prosecution at the trial.

He highlighted a Court of Appeal of New Zealand criteria to grant special leave to appeal out of time to justify a departure from the principle of finality.

Ratu Sakiusa was acquitted of three counts of fraudulent falsification of account charges by the High Court in Suva last year.

FICAC filed a Notice of Appeal against the judgment on November 29, last year and it was served to Ratu Sakiusa.

But on May 30, this year, Registry of the Court of Appeal informed FICAC the appeal was marked deemed and abandoned on December 7, 2010.

Fresh application for special leave to appeal was filed in July but Ratu Sakiusa had departed for the Philippines in December.

Justice Chitrasiri said FICAC failed to show any special circumstances identified in the New Zealand case for the grant of special leave to appeal.

Survey Reveals a Sick Fiji Economy & Getting Worse

Sugar Industry - destined to collapse

A recent survey has revealed what we all know to be the case - A sick Fiji economy and it is getting worse by the minute the longer the current illegal regime stays in power.

Authored by a group of economists at the University of the South Pacific, the report confirmed the bleak prospects for economic growth as a result of the political situation in Fiji and made worse by external global economic realities. The dire situation facing the sugar industry is there for all to see with the current regime's attempt at revitalisation destined to fail. As well, dilapidated infrastructure will stifle long term investment opportunities in tourism and other key areas.

In the other words, Fiji's situation has been made extremely difficult by the draconian policies of the current illegal regime, including restrictions on media freedom and human rights.

Again as everyone have noted, the solution identified by the report is a return to democratic government to ensure political and economic stability. This in turn would ensure effective and well-constructed policies that promote economic growth.

The Concluding Remarks of the Report are as follows:

The short-medium term prospects for Fiji on both the political and economic fronts look less than promising. On the economic front, GDP growth rates have not increased despite the numerous promises. While poor growth between 2007 and 2009 can be explained partly by the impact of the global economic crisis, natural disasters and some inherent weaknesses, the continued forecasts of low growth between 2010-2013 reflects the continuing state of poor investment caused by lack of confidence in the country. The imminent collapse of the sugar industry should be a serious concern and it appears that the current government’s game plan may not work. The sugar industry has a long-history of networks which may have sounded political but it is those networks that allowed farmers to keep the interest in the industry. The destruction of some of the historic institutions of the farmers may not augur well for the industry. The current media censorship and lack of dialogue with the stakeholders is likely to be harmful to the industry which is already on the brink of collapse.

The answer to Fiji’s serious economic problems may incidentally lie in a political settlement. The link between good economic growth, democracy, media freedom and rule of law cannot be underestimated. There is no substitute for well-constructed policy when it comes to economic growth and development. Previous governments in the last three decades have made similar mistakes about growth policies. There have been very limited successes to count particularly towards long run economic growth prospects and at this point in Fiji’s history any bandaid approach will not do any good. Firm commitments and definite steps are needed to build that confidence that has been lost. The much demanded open dialogue must start immediately and the media freedom be established by relaxing the emergency law and the current censorship of the media.
The government has a good opportunity now to open up dialogue with the political parties, external partners and organisations such as the UN and the Commonwealth to move Fiji towards a Constitutional democracy, good economic growth and development.

Like their ailing leader and dictator, Bainimarama, sources in Fiji continue to report the declining health of other regime figures. Latest to be placed on the rapidly elongating sick list are Pio Tikoduadua and Ratu Inoke Kubuaboala.

Fiji Tax Agency Owe $Millions in Refund to Businesses

Read below the excuses by the Fiji Tax agency, FIRCA, for holding back on millions of dollars in tax refund for businesses. One wonders with all the so called reforms and changes carried out by the illegal regime the situation and service by agencies appear to be worsening.

On both sides it could said there are real concerns and contributing factors for this sad situation. FIRCA staff with all the pressures and changes to their conditions of work forced on them by the illegal regime, it has to have an impact on their morale and productivity. This can only get worse with the introduction of the repressive Essential Industry Decree which includes FIRCA. One can only expect the list of businesses waiting on their refund to get much longer before it ever gets any better. What then would be the FIRCA CEO's excuses?

Picture the impact of FIRCA's performance on investors wanting to invest in Fiji with that level of shockingly bad service! In any other other public service, the FIRCA CEO would be either sacked or his contract reviewed and closely monitored with perhaps conditions placed on reducing the waiting list or time for the refunds. That would ensure his remuneration directly relates to his performance as leader of FIRCA. But we are in Fiji where the public service is now overseen by regime lackeys at the PSC who readily turn a blind eye at situations where it gives them a bad press.

The FIRCA CEO has conveniently pointed to fraudulent claims as holding up the refund. It is doubtful if this is the sole reason as it is impossible these days to verify such a claim in the absence of a parliamentary committee or similar oversight body.

Illegality begets illegality is perhaps more applicable in describing the behaviour of tax payers who may want to put one past FIRCA with their claims. In an environment where the regime is illegitimate, derives and enforces its authority through illegal means, it is no wonder citizens and businesses would get to adopt similar inclinations in conducting their affairs, especially in transactions with the State. Even worse when citizens and tax payers get to learn of the fraud and corruption involving key regime figures beginning with the illegal PM and his illegal AG as reported in this blog and others.

What is blatantly clear is the hypocrisy of the illegal regime when it comes to one of their own. Rules of fair play and professionalism do not apply when it involves them as the guilty party.

I would urge Richard Naidu to go ahead with a court challenge on this point and test both the Essential Industry Decree and of course the partiality of the regime appointed judges now populating the Fiji benches. Even if Richard wins the argument, we all know how badly the illegal regime needs the Money, even that owed to businesses as VAT, never mind the interest.

The Fiji Islands Revenue and Customs Authority owes the business community around 30 million dollars in VAT refunds.

Questions have been raised on why FIRCA is holding back this payment.

Accused of double standards, at the recent Fiji Australia Business Council meeting, FIRCA is now being asked to explain why it continues to hold back on VAT refunds.

Suva lawyer Richard Naidu who is on the verge of filing a legal challenge against FIRCA on behalf of a client who is owed at least a million dollars says, patience is running out.

He described VAT refund delays as outrageous.

FIRCA CEO Jitoko Tikolevu admits they owe various businesses and individual VAT refunds totaling around $30 million.

FIRCA says one of the reasons behind delays is ongoing complex audits of some of these refunds.

They also admit the refund backlog hasn't always been this high.

Because of past cases of bogus VAT refunds, FIRCA has assured they will be paid immediately after stringent checks and verification have been completed.

THE high number of fraudulent claims will delay VAT returns of about $138 million.

And tax officers have vowed to prosecute business owners who try to change tax returns to make quick money.

Fiji Islands Revenue and Customs Authority chief executive Jitoko Tikolevu said a special team was set up last year to scrutinise VAT refund applications by businesses.

"Although I don't have any statistics with me, I can confirm this team has found cases relating to these cases," said Mr Tikolevu.

He said FIRCA had taken some of the cases to court.

'The normal procedure in this case is that we report the issue to court and the business or proprietor involved in these fraudulent claims is prosecuted," he said.

Mr Tikolevu predicted a slight delay in payment of VAT refunds. Hecould not say how long the delay would take.

Mr Tikolevu said $44,774,754 had been set aside to pay Income Taxreturns.

A further $138,519,183 was set aside to pay VAT returns.

"However, there may be some degree of delay in issuing VAT refunds merely because we have noted that there have been a lot of fraudulent claims in the past which needs time and effort to verify theaccuracy of these returns," said Mr Tikolevu. He said the authoritywas ready to accept and assess returns from last week.

"But the Income Tax returns for the year ended December 31, 2007 should be submitted or lodged to the authority by no later than March31, 2008," he said.

Australia's Parliamentary Secretary for Pacific Affairs, Richard Marles, says Australia is now more engaged with the Pacific than ever before.

In a speech to the Lowy Institute in Sydney, he says accusations that Australia does not take the Pacific seriously are simply not borne out by the facts.

He tells Bruce Hill that while the situation in Fiji is very challenging, he's confident that people there realise that Australia's conflict is with the coup installed military government, not them.

MARLES: We want to make it really clear that our beef is not with the people of Fiji, in fact quite the opposite. We want to stand with the people of Fiji in what is a very difficult time for them. Our issue is with the interim regime in Fiji and in fact what it is doing both to the country of Fiji and its people. I mean what we're seeing is the economy of Fiji is going backwards when the rest of the Pacific economies are going forward. We're seeing more people living in poverty now than have ever lived in poverty before in Fiji and we're seeing that in a context where human rights are being removed. There isn't the freedom of the press, there isn't freedom of association. Church organisations have their meetings banned and we're seeing ILO Conventions being flagrantly breached, that's what's going on and the people who are affected by that are actually the people of Fiji who we want to stand with. The people who are doing that are the interim regime of Fiji and they're the people we've got an issue with.

HILL: Is the Australian government coming under pressure to soften its stance on Fiji? We hear often business groups and also the Lowy Institute that you were giving the speech to came out with this poll showing that most Fijians support Commodore Bainimarama's coup?

MARLES: Well, I think the first thing to say about the poll from the Lowy Institute and I say it with all respect of the Lowy Institute. They do fantastic work and I really appreciate the interest that they've shown. But obviously doing a poll in Fiji now is absurd. If you're sitting at home in a country where human rights are being repressed and somebody comes and knocks on the door and asked you what you think about the government. I mean what do you think people are going to say. So I don't think there's any sense in which we can treat the outcome of that poll with any credibility. I think, in fact, the stand that we're now seeing around the world in relation to Fiji is becoming more and more firm. People, countries do understand that what's happening in Fiji is a concern, that the interim regime needs to be moving to a democracy as soon as it can.

HILL: One of the things in your speech, which was pretty striking was the tone I think almost of annoyance. There's a perception that Australia is ignoring is in disengaged with the Pacific. You seem to really take very strong issue with that idea?

MARLES: Well, I think we have never been more engaged in the Pacific than we are at the moment. Certainly from my point of view, I've visited every country and territory of the Pacific, at least all of them that have a runway. I haven't as yet been to Pitcairn but it's on my bucket list and it's not just me that's visiting the region, nor is it just visits to the region, but there are many other ministers and members of the executive who are also visiting the region and that is evidence of a very strong relationship that exists. But if you look at what we're doing in RAMSI, where we've restored a long with the other nations of the Pacific, peace and security to Solomon Islands. They now have experienced economic growth in five and six per cent over the last couple of years. That's a fantastic situation compared to what existed in 2003, if you look at the work we're doing in Papua New Guinea, around seeing more children attend school, more children being immunised against disease, working with PNG in relation to the LNG project, which is a giant resources project in PNG to really try and see the benefits of that project go to everyone in PNG and I might say we are doing that very much with the strong commitment and cooperation of the PNG government itself. If you look at what we're doing in education across the region with the University of the South Pacific, but not just that, the Australian Pacific technical colleges, what we're doing with Australia awards, where we're 500 people across the Pacific in the last year had the opportunity to study under one of these awards and these are the future leaders of the Pacific.

I think what all of that shows is that there is a greater engagement in the Pacific, in terms of our foreign policy than there has ever been. Actually, when you look at what we're doing, it's pretty impressive.

HILL: And yet like Rodney Dangerfield, Australia doesn't seem to get any respect, why?

MARLES: Well, first and foremost, it's not about us getting respect, first and foremost, it's about us doing good in the region and I hope we do that and I think actually the respect does come as a consequence of that. It follows the work that we do. But I think that as I travel around the Pacific at least, the sense that I get from the countries of the Pacific is one of incredible warmth to what Australia does and to the way in which we engaged. We've just come back from the Pacific Island Forum in Auckland, and one speaker after another from the countries of the Pacific talked about the projects that were being undertaken in their countries through Australian support and there was I think enormous well respect, but thanks that was being given to Australia for the role it played.

NZ ACT Party Leader Position on Fiji Marks Desperation to be Relevant

NZ ACT Party Leader Don Brash

Those of you worried by recent remarks by the leader of NZ's ACT Party, Dr Don Brash, supporting closer links and dialogue with the illegal regime in Fiji should not be the least bothered. It is no more than a quest by a divisive leader to stay relevant and gain leverage over an issue in order to lift his party's abysmal poll standing in the lead up to the November Elections here in NZ.

The ACT party is in disarray after none of the current MPs wanted to hang around come the next Elections and this is no small part due to its new leader who seized the leadership with a promise to deliver a rise in its standing in the polls. With only 2 months out from the Election, that is nigh impossible and its hope may rest solely on a former national Minister & former Auckland mayor, John Banks, winning the Epson seat following a deal with the ruling national party not to put up a candidate in the seat. Even Banks is now at loggerheads with Brash over his support to decriminalise cannabis!

Brash's stance on Fiji can therefore be regarded as another attempt to curry favour with the disaffected minority who favour relaxing NZ's tough stance on Fiji. Other major parties are generally in agreement in that Fiji first needs to demonstrate a serious commitment to returning Fiji to democratic rule before relaxation of current sanctions and bans can be effected. So far no such clear and serious indications, despite close door revelations and pontifications at the UN podium, have been forthcoming from the illegal regime in Fiji.

John Samy

What is disturbing though from Brash's speech on Fiji is the reference to the illegal Charter for Change, and its author, John Samy, as a key figure behind moves to soften NZ's position. It further reveals the regard people like John Samy have for a person known in NZ as strongly opposed to Maori self determination and positive discrimination in order to lift minority groups out of poor socio-economic situations. It says more therefore of John Samy's philosophical bias than it does Don Brash's well known libertarian and ultra conservative political ideology.

In a way though both are united in their views about the position of the first peoples of the country of their birth. John Samy's support for the illegal regime in Fiji is well documented with his contribution in developing the illegal Charter now touted to provide the bulwark for Fiji's next Constitution. If a new constitution is allowed to be forced on the people of Fiji, one thing is certain and that will be the further erosion of the position of the indigenous Fijians in the naive quest to forcibly bring about national unity to a multicultural nation. Given the current policies and programmes of the illegal regime in power since 2006, the groundwork for these are already in place with the destruction of Fijian institutions, opening up of Fijian lands and fisheries and the misguided notion of unifying a nation just by changing the reference for all Fiji citizens to now be called "Fijians".

Don Brash firmly believes in "One NZ" such that the indigenous Maori would not necessarily have the status as the first people of Aotearoa NZ. Yes he supports equal opportunity and equal status for all NZers while questioning efforts by Maori to obtain redress for past wrongs. In effect, it would be difficult to see Brash's NZ as something other than one populated by white middle class. In policy terms, mainstreaming would become the norm where targeting of programmes on the basis of need or ethnicity would not be favoured. In NZ, mainstreaming has not generally worked as a policy prescription given the persistence of poverty and poor outcomes within specific groups in society. One solution approach for differing levels of need and socio-economic circumstances rarely works and often result in far more cost to government.

Today's Wellington paper (page 2, The Dominion Post) carries two articles on Don Brash which sums up pretty well his impact as a politician.

"Brash may have sounded the death knell for ACT" - portray his propensity to inaccurately assess the public mood for major changes in attitude for key social issues with disastrous effect for his party!

"Leader's cannabis stance opens rift" - depicts his divisive nature in bulldozing through his personal views on decriminalising cannabis!

When Brash's position on Fiji is then calibrated against the sentiments above, it should be readily clear that it is no more than the panderings of a politician struggling to be relevant and dancing to the tunes of a disaffected minority at the fringes of society.

John Samy also shares a similar description as he attempts to remain in the good books of the dictator Bainimarama, even after fleeing Fiji, having handed over his blueprint for changing Fijian society, and pocketing handsomely from the nation's treasury.

SMI directors and link to aunt of Fiji's illegal attorney general revealed

We may recall that the dictator Frank Bainimarama recently told the Fiji Institute of Accountants that his illegal and un-elected government has awarded the first of many licenses to SMI – Sustainable Mahogany Industries Ltd. SMI has been given the right to buy mahogany from Fiji Mahogany Ltd. According to Bainimarama, “This is the first time that a licence has been issued to gain the right to purchase Fijian mahogany. It is the first time that a licensee will pay a separate levy for reforestation”.

The Congress of Accountants also heard that SMI would pay a licence fee of $70 for every cubic metre of mahogany logs bought from Fiji Hardwood Corporation Limited. This is expected to result in $14 million paid as licence fees over 5 years in addition to the price of the logs. A separate and additional reforestation fee of $25 per cubic metre of logs will also be payable.

DICTATOR CHAIRMAN OF FIJI MAHOGANY COUNCIL UNDER KHAIYUM’S ILLEGAL MAHOGANY DEVELOPMENT DECREE 2010

Let us be reminded that the dictator is not only Fiji’s illegal treasonist Prime Minister but he is also the chairman of the Fiji Mahogany Council under the Mahogany Industry Development Decree 2010, a decree drafted by fellow treasonist Aiyaz Sayed Khaiyum.

In introducing the Mahogany Decree, Khaiyum in his capacity as Minister for Public Enterprises, Industry and Trade claimed that the Decree “has introduced a transparent, efficient and results-oriented regime to develop a mahogany industry. It will leapfrog reforms and contribute to growing the GDP”. Khaiyum also disclosed that expressions of interest were called for the issuance of licences in the mahogany industry.

THE SMI BEGINNING: ANARETA NARAWA AND CHRISTINE MITCHELL – FIRST DIRECTORS

On 25 January 2010 Sustainable Mahogany Industries Ltd was duly incorporated under the Companies Act (CO NO RCBS2010L0271). Earlier, on 14 January, the acting Registrar of Companies was notified as follows: “Sustainable Mahogany Industries Limited hereby gives you notice. In accordance with Section 110 of the Companies Act, that the registered office of the company is situated at c/- aliz pacific, Level 8, Dominion House, Thomson St, Suva, P. O. Box 2475, Government Buildings, Suva.”

Aliz Pacific, as we are so familiar since the treasonous 2006 coup, is owned by Khaiyum’s aunty, Nur Bano Ali, who describes herself as managing director of the company, “one of the largest local professional services firms in Fiji, specializing in providing expert business and accounting advice and innovation in business through growth strategy”. She is also the President of the Suva Chamber of Commerce & Industry and President of Women in Business. And her office is as stated above in her application on behalf of SMI.

What she has not advertised, and understandably so, is that she is the illegal pay-mistress to Bainimarama’s Cabinet ministers. Her accountancy firm is also currently providing advice to SMI for Joint Venture set up and corporate group restructure.

The first directors of SM1, as listed in the company files from 14 January 2010 were Anareta Narawa and Christine Mitchell, both Fiji citizens, who gave Nur Bano’s office address as their postal address. Narawa was listed as secretary to the SMI. And in pursuance of the Memorandum of Association, they declared that the two were agreeing to take one share each in the capital of SMI. Accountant Nitesh Kumar, who also gave Nur Bano’s office address as his address, witnessed their signatures.

On 20 January 2010 Narawa while fulfilling other obligations under the Companies Act, declared that the objects of the Company, among other things, is “to carry on the trade or business of timber merchants, building contractors, saw milers and forestry”. The liability of the members was limited, and the share capital of SMI was two million dollars divided into 2million shares at $1each. Suva lawyer Peniana Mailoa Salele, presently representing deposed Prime Minister Laisenia Qarase in cases brought against him by FICAC witnessed the declaration.

But on 4 March 2010 Christine Mitchell resigned as director, and a sportswoman Alison Southey replaced her, with Narawa still acting both as director and secretary of SMI. Southey also gave Nur Bano’s office address as her correspondence address.

FOREIGN GREEN GOLD HUNTERS TAKEOVER SMI UNDER MAHOGANY DECREE

A DAY BEFORE MITCHELL RESIGNED AND SOUTHEY WAS APPOINTED, THE ILLEGAL A-G KHAIYUM, ON 3 MARCH 2010, SUDDENLY ANNOUNCED THAT THE CABINET HAD APPROVED THE PROMULGATION OF THE MAHOGANY INDUSTRY DEVELOPMENT DECREE 2010, BASED ON HIS SUBMISSION. HE ONCE AGAIN CHANTED HIS NOW FAMILIAR MANTRA: “THE DECREE SEEKS TO IMPLEMENT A TRANSPARENT, EFFICIENT AND RESULT-ORIENTED REGIME, WHICH WILL ENSURE THAT THE MAHOGANY INDUSTRY IS FURTHER AND BETTER DEVELOPED, HAVING REGARD TO THE INTERESTS OF ALL STAKEHOLDERS, INCLUDING THE LANDOWNERS, IN ORDER TO ENSURE THAT THE MAHOGANY INDUSTRY IS ABLE TO PROVIDE SUITABLE AND SUSTAINABLE RETURNS FOR THE BETTERMENT OF THE ECONOMY AND THE PEOPLE OF FIJI AND CREATING A DISTINCT BRAND OF FIJIAN MAHOGANY.”

Donlon, White and Wagner arrive at SMI

Following the promulgation of the Mahogany Decree, Narawa and Southey resigned as directors on 13 April 2010 but Southey was retained as SMI secretary. On the same day American John Whitney Wagner, Peter Kevin White, New Zealander and Christopher James Donlon, an Australian, became SMI directors. They listed their postal addresses as P O Box 2475 Government Buildings, Suva, i. e. Khaiyum’s auntie’s accountancy firm.

Curiously, although SMI company files state that the three were appointed on 13 April, the CEO for Fiji Islands Trade & Investment Bureau, Annie Rogers, issued a Foreign Investment Registration Certificate (FIRC) number 10-0045 on 7 April, as she informed Nur Bano Ali in a letter issued on that day: “Dear Madam – Re Sustainable Mahogany Industries Ltd – I attach herewith….issued under the provisions of the Foreign Investment Act 1999 and the Foreign Investment (Amendment) Act 2004 to your client, Sustainable Mahogany Industries Ltd to process and manufacture timber products.” Rogers also pointed out to Nur Bano: “The foreign investor must have at least $250,000 in paid up capital in the form of cash from the operational; date, to be fully brought into Fiji within the 12 months implementation period. In addition, the foreign investor must not engage in any other business activities not specified in this certificate.”

Annie Rogers noted the following, as she notified Nur Bano: “Sustainable Mahogany Industries (Fiji), shareholder, 99.9%, Christopher Donlon, shareholder, 0.1%, Peter White, director and John Wagner, director.”

Multi-million dollar profit forecast before registration of SMI?

Looking at SMI company files, Peter White was appointed company director on 13 April 2010, and Articles of Association was submitted to the Registrar of Companies in January 2010, and yet, in December 2009, the Fiji Sun was informing its readers under the headline:“$30M FROM NEW MAHOGANY DEAL”:

“Fiji is going to pocket more than $30million of revenue per year from a new venture where products made from mahogany will be exported. This was revealed at the launch of the expansion of the Sustainable Mahogany Industries mill at Pacific Harbour in Deuba yesterday. Company Principal Officer, Peter White, said the initiative would be structured as a Fijian domiciled business for the purpose of creating revenue and employment to the people of Fiji. “Our intention is to build something Fiji can be proud of,” he said. “This venture we can guarantee will provide no risk guaranteed return to the people of Fiji, through log revenues and employment. All its worldwide income will [be] repatriated back into the country.”

“Mr White said they were currently producing parts for more than 4500 musical instruments per month and for this they were predominantly using mahogany. “We are looking at raking about $30m worth of revenue per year.” The first stage of this joint venture will cost around $15m and that is to set it up with a number of high skill value adding facilities planned for commencement for the next two years. The overseas investors are Sustainable Forest Industries, Wood Product International from New Zealand and Pacific Western Timbers from the United States. Pacific Western Timber is a manufacturing and engineering company based in Washington. It manufactures machinery parts and components for the aerospace industry like NASA and Boeing. World Product International has been marketing Fiji mahogany since 2004.”

The chief guest at the announcement was none other than Nur Bano’s nephew Khaiyum who told the gathering that the venture would also Fijians to develop their skills and expertise in the mahogany industry. “Government is very keen on developing the mahogany industry in a sustainable manner. There is no point in capitalising in the mahogany industry if it is not going to be profitable. Therefore we need a partnership with the private sector so that workers are up-skilled and there is employment. The value must also go to the landowners, it’s very important to us that Fiji benefits as a country,” Khaiyum added. According to SMI records, Peter Kevin White resigned as company director on 28 January 2011.

Who is Christopher James Donlon

He is an Australian who doesn’t come from a forestry background. We will let him introduce himself as he did so in October 2004 to Ross Duncan of the ABC Radio Australia on a documentary “Mahogany Dreaming”, with music from Black Rose serenading in the background.

Ross Duncan: “There’s another Australian doing a bit of mahogany business in Fiji. Forty-one-year-old, Chris Donlon, was happy to hook up and talk timber. A few days later when I called again, he was on his way to see his lawyer and he suggested we meet there to record an interview. His lawyer is Isireli Fa who I’d spoken to before about the legal actions between the landowners and the government. It was just another reminder of what a small town Suva is.”

Chris Donlon: “If we’re studying the history of Chris Donlon, probably easier if I deliver it. Christopher Donlon, born in Byron Bay in 1963, educated Mullumbimby High School, St Joseph’s College, University of Sydney, studying economics and law. Developed into the financial community, and I guess after the ’87 stockmarket crash, determined in my own mind that one should disinvest from financial instruments and into resource-based industries, whether that be in mining, forestry. I invested in the company called Red Anchor Resources Limited, I’d invested in a company or a group of companies which is actually the spearhead of investments in Fiji and the Solomons, called the Axiom Group, and Axiom Investments Limited, which then owned Pacific Timber Development Limited, which in turn owned Vusena Forest Corporation.

Ross Duncan: “I knew a little already about one of the companies Chris Donlon mentioned. In 1990 Red Anchor Resources raised $1.5-million to fund gold mining exploration in Papua New Guinea, and managed to spend or lose most of the money in a year. In 1996 Chris Donlon was fined a total of $13,500 for being knowingly concerned in Red Anchor financing the purchase of its own shares by another company, misusing his position as a director, and making false and misleading statements to auditors. His brush with Australia’s corporate watchdogs concerned Fiji’s Immigration authorities.”

Chris Donlon: It in fact created a problem for me where I was asked not to be in Fiji for a period of about six months while we worked through those issues. Whether that’s part of sour grapes in a reverse manner and people picking on you, or whether it’s the authorities applying an appropriate amount of discretion and audit, either way, yes, that certainly occurred and has affected my status here in the past; if indeed errors were made, then hopefully everyone does watch me.

Ross Duncan: “Chris Donlon acknowledges he’s been through some tough times, and he’s learned a lot. He has a slight limp and wears a trucker’s cap. He says he came to Fiji to recover money he had loaned to a local timber company. He now runs a company called Sustainable Forest Industries, or SFI. Its website says: SFI has received the concession harvesting rights for the Fijian Mahogany plantations from the Fijian Hardwood Corporation.”

Ross Duncan: “In fact, Sustainable Forest Industries has no rights to harvest Fiji’s mahogany. Chris Donlon says he didn’t personally write the website. His company does buy logs from Fiji Hardwood Corporation and processes them into sawn timber for export. It was Fiji Hardwood’s first customer. The two companies recently settled a dispute in relation to about $600,000 Fiji Hardwood claimed it was owed for log sales…”

Donlon’s Sustainable Forest Industries Nur Bano’s client

According to Nur Bano Ali’s official Aliz Pacific website, as of yesterday, among her clients are SMI and Sustainable Forest Industries Ltd. In June 2011 Donlon expressed confidence in Fiji’s mahogany industry as SMI handed a cheque of $3.8million to the dictator for obtaining a licence to purchase mahogany from Fiji Hardwood Corporation. Donlon told Riyaz Khaiyum controlled propaganda broadcast FBC that Fiji has treated their company well in the past year and are delighted to have been approved the licence to be the first to buy mahogany: “We’ve had only the best reception from Fiji in the past 12 months. There has been a lot of restructuring and negotiations going on and there is difficulty in investment worldwide. We’re had a lot of support from government bodies and authorities to get us here and we’re comfortable in Fiji. And we’re particularly pleased that we now have something secure that we can provide to our customers worldwide.”

In July SMI showcased its factory in Deuba to the dictator and his master puppeeter Khaiyum, with Wagner saying the Deuba factory concentrated on “value adding” the mahogany timber by making guitar bodies as well as materials for yachts. In May Wagner had also presented the dictator an electric guitar costing over $7,000 made from Fiji grown mahogany. The guitar was a “gift of appreciation” to the dictator and his master puppeteer from Pacific Western Timbers Incorporated, an American-based guitar manufacturing company.

“Pacific Timbers Incorporated appreciates the opportunity to have access to sustainable supply of high quality of mahogany from Fiji. We now look forward to manufacturing guitars and musical instrument components for many world-recognised brands at our facilities in Fiji. “We thank Government and the people of Fiji for the opportunity to work toward a mutually beneficial relationship with this unique, sovereign and world’s sustainable mahogany brand,” said Wagner, who had handed the million plus cheque to the dictator.

In July Wagner had also informed the dictator that the world’s leading guitar maker Gibson Guitars has labelled Fiji Mahogany as “world class”. “We supply Gibson guitars for the last three to four years and they’ve wrote to us saying that Fiji Mahoganies are certainly superior,” Wagner said. And not to mention the recent deal between the dictator and Gibson Guitar!

To paraphrase a book by Joachim Kohler, Wagner's Hitler: The Prophet and His Disciple, it is worth reminding SMI’s John Wagner that no matter how much he sings praise for Fiji’s dictator for granting SMI the exclusive right to the nation’s mahogany, when democracy returns, Wagner and SMI will be forced to sing the right tune, with the Khaiyums, Nur Bano Ali, Christine Mitchell, Anareta Narawa, Annie Rogers and the dictator forced to provide in court a true copy of SMI “commercial notes”.

Dictator Bainimarama - out of place & out of depth at the UN

Reports reveal that Bainimarama's lack of education and intellect continues to be shown up at the various international fora he attends.

His recent contribution at the UN General Assembly can only be described as abysmal, lacking in substance and depth.

For one with an illegal mandate and guilty of repressive rule over the people of Fiji, to be preaching about the virtues of equality before the law and unity among citizens, is hypocrisy at its maximum. Yet he seemed totally oblivious to all that is known about his repressive regime which continues to terrorise the people of Fiji. Such is the mindset now rampant and deliberated cultivated by his regime. To ram through all and any reform which in their eyes are the solution to Fiji's multifaceted problems, never mind if the rights of the people are tramped underneath. Yet one can sense innate fear in Bainimarama as he seeks to justify his illegal and repressive rule.

Bubbling away inside of him is the guilty conscience resulting from his part in the deaths and murders of a number of Fiji citizens. The evidence is there for all to see each day as his security retinue continues to elongate in the attempt to preserve his life and rule. A ruler with a popular mandate would not require such bloated security detail, let alone afford it.

A man with intellect and inner conscience will sooner or later come to realise when the life of pretence, fake and stolen mandate runs out. But this only happens when the contrast with reality becomes pronounced over time and only when the sense of reality is shared widely. For Bainimarama, he has in fact created his own reality, in which he and his closest of supporters and family exist. Those outside of that reality do not matter to them or are just tools to preserve their ongoing existence. It therefore becomes a self sustaining existence.

Of great concern is the value placed on being part of the inner sanctum of the dictator's life as supporters and sycophants compete for his attention and favour. This is why dictators become entrenched in their rule over time, and as such, the cost for their removal escalates accordingly, whether in human or financial terms. Earlier attempts to remove Bainimarama were therefore wasted opportunities and such opportunities will even become rarer. The dictator himself knows this. This in turn will drive him further to extend his followings whether within the military or outside, especially those unaware of the true extent of his illegal rule.

The reverse scenario is equally true - removing the dictator Bainimarama would be far more cheaper now than later. That is precisely what Fiji needs in order to avoid a great deal more sufferings for its people. For Bainimarama's foot soldiers, even those untainted will inevitably be dragged and sucked into the repressive cycle of deceit and at worse, become agents of inflicting physical abuse, torture and even deaths on the citizens of Fiji.

That is why soldiers within Fiji's military, in particular those currently untainted with any direct criminal acts, have a personal interest and responsibility to Prevent and Stop Bainimarama.

Unlike the rest of the civilians in Fiji, each one of you have the opportunity to take direct action to end all the madness that has now engulfed Fiji. Picture yourselves as Fiji's saviours, receiving the everlasting gratitude and blessing of all Fiji's people when you act to remove Bainimarama, Khaiyum and their supporters from power. Would that not be a far worthy and honourable tribute than to be labelled as agents of torture, abuse and repression? Where is the glory when you, your family and friends become tainted with the blood of those murdered by Bainimarama and his torture squad led by Ben Naliva and others?

The answer to those questions lay well within your hands each day you receive your issue from the Australian government funded armoury at Nabua. Each day you fail to act is a day longer for the suffering, humiliation and degradation for the people of Fiji and those closely connected to each of you. The majority of the people of Fiji want a return to a government that respects human dignity and the rule of law. Bainimarama and Khaiyum have shown no indication over the last 5 years of ever returning Fiji to its citizens because they fear the consequences for them.

So act Now to Prevent Far Worse Suffering in Future.

Lt Col Pio Tikoduadua is adamantly (yet delicately) continuing to bat for the stood down Carl Ngamoki-Cameron and his stooge at one of Fijian Holdings subsidiary bodies Merchant Finance (MF), Greg Cathcart.

We suspect Sharon Goebbel’s efforts of the In flagrante delicto nature could also be at play here.

We understand that Cathcart is currently in Vanuatu on unauthorised company costs and is seeking legal advice on his options. Good luck with that one mate because your “legal status” in this country could nullify any of those “legal options”.

We post here a letter that implicates Tikoduadua and his delicate “invitation” to the board to reverse their decision and reinstate both Ngamoki and Cathcart.

In doing so, Tikoduadua is in fact trying to pervert the course of justice and undermine what Bainimarama has mandated to be done.

Now any right thinking person would be asking what Tikoduadua’s interest in Fijian Holdings is (apart from Sharon’s needling). And the answer where any of these illegal and treasonous military regime members are concerned is, as usual, MONEY.

Tikoduadua has a standing loan account (that has failed to be serviced for some time now) at Merchants Finance for about FJD$65K.

With the status of Tikoduadua’s health in question, what he owes to Merchant Finance and therefore shareholders — such as retirees, dalo farmers, cane farmers, copra farmers, yaqona farmers — is at risk of being written off and one can only surmise that he was hoping to get it written off sooner by taking a hit for his mates.

Frank and Aiyaz Pay Aliens to Write their Repressive Laws

Fiji is waking up again to another miserable day when its citizens become aware that what they want and how they want their Fijian law to look like is absolutely beyond their control. In other words, Fiji’s sovereignty is becoming a complete cop out by Frank & Co.

It has never been about the Fijian people anyway from the day Frank usurped authority with the barrel of the gun.

It was always about themselves, the usurpers, in particular the two main players, Frank and Aiyaz and their crone Nazhat Shameem who has become very prominent in thinking up all the different law making maneuvers to prolong their stay in power.

The expose` by Coup 4.5 that Air Pacific paid US lawyers in New York to dream up and scribe the regime’s Essential Industries Decree is a very credible evidence that prove without doubt that Frank’s regime is willing to draw big bucks from its affiliated quasi-government owned companies to pay aliens to write Fiji laws.

This is exactly what’s happened here where some freaky people in New York who are completely detached from the Fijian system in its totality have put together a piece of cut and paste decree meant to protect the interest of a tyrannical military dictator whose illegal regime has claimed ownership over 51% shares of Air Pacific they have accepted as a client.

The lack of consensual approach where the voices of the Fijian citizens are not heard in determining the law they will be subjected under via a free media, their parliamentary representative or interest groups makes this fanciful decree null and void and possibly inciteful.

MILBANK, TWEED, HADLEY & McCLOY LLP should be ashamed of themselves for propping up a murderous dictator like Frank with their Essential Industries Decree opinion.

If these guys from this New York law firm are able to scribble Fiji’s Essential Industries Decree just like that without any scrutiny from the very Fijian people its going to affect, what’s going to stop Frank and Aiyaz from hiring similar kinds of aliens to write their much talked about new Constitution who are only in it for their own vested interest and their dictator client?

If Air Pacific is able to write its own decree that gives them an unfair advantage over their workers and gets the regime to rubber stamp it as they’ve done here, it means that Fiji’s laws are now determined and written by overseas lobbyists/lawyers and not by the people of Fiji for the people of Fiji.

This is also a sad case of what Fijians already know – where only a handful of Muslim Indo-Fijians and expatriates are messing up the credibility and integrity of tried and established systems with their own deceitful corruptive agenda.

Frank & Co. are not in control. Even their laws are written by some zombies who don’t give a damn what happens in Fiji or its people.

They are all helping themselves to the “wham bam thank you maam” kinda game Frank & Co. is imposing onto the Fijian people.

Megalomania Khaiyum Consolidates Control over Government Machinery

While those politically ignorant cheer, clap and salute the illegal and treasonous regime's appointment of a (first ever) female Fijian (we don't subscribe to the itaukei farce) to the position of chief of our national Foreign Policy bureaucracy, the underlying currents point to a whole different ball game.

Firstly, it is no secret that in any foreign policy of a nation, bilateral and multilateral "cooperation" is always underpinned by the promise of trade relationships. No one "cooperates" internationally out of the sheer goodness of their hearts. Foreign policy and trade relationships provide sovereign nations with carrot and stick leverage and all over the globe the two functions of cooperation and trade are almost always inextricably tied -- you have to know the credibility of one's relationship (cooperation) with another country before you can trade with them.

So when the illegal and treasonous Aiyaz Sayed Khaiyum starts grunting warnings about him controlling who Fiji can and cannot trade with, and slamming trade relationships that have fared us well within the Pacific region wearing his hat as "Attorney General", the situation is glaringly clear.

Aiyaz trusts only his boy (and a fellow muslim to boot) to handle trade under his direct command while the foreign policy folks will be limited to shallow roles such as "meet and greet" of international counterparts.

In other words, fellow regime supporter Rt Inoke Kubuabula's role, just like Solo Mara the former chief of Foreign Affairs, has being weakened and they will be put out to pasture very soon.

And that means that as Khaiyum consolidates greater control of the government machinery, the rest of the regime are powerless and are essentially sitting ducks. Even Bainimarama.

AG warns against signing deals

ATTORNEY General and Minister for Industry and Trade Aiyaz Sayed-Khaiyum warned against Fiji ratifying or signing up to trade agreements that did not benefit the country.

Speaking at the opening of the Top Executives Conference held at the Sofitel Fiji Resort and Spa in Nadi last week, Mr Sayed-Khaiyum said past government's were quick to sign up to regional and international trade agreements without carrying out a thorough investigation on the merits of doing so.

"If you go back, even Fiji's hurried agreement to sign up to the World Trade Organisation when many other advanced economies did not because of the provisos in signing up with WTO. Perhaps governments in the past have been prone to looking good in front of the public and the media to please the international community at the expense of being able to control your own destiny to an extent- whether it be tariff control or whether it be incentives to direct businesses in a particular direction," he said.

Mr Sayed-Khaiyum said this government's commitment to encouraging regional and international trade with the interest of the country put first and foremost had clearly been outlined in recent times.

"From Monday, the international trade arm that exists in Foreign Affairs will move to the Ministry of Industry and Trade to provide the synergy that is critical in terms of whenever we have our own trade officials negotiating trade agreements or discussing trade internationally, they need to be first and foremost, mindful of what will the impact be in Fiji-for business houses, for employment, for our ability to grow our businesses," the AG said.

As part of the move to improve trade relation negotiations, former deputy permanent secretary of Foreign Affairs and International Trade, Shaheen Ali, replaces Saipora Mataikabara as the new PS for Industry and Trade. Ms Mataikabara will assume a post at the Ministry of Foreign Affairs.

New Zealand Denies Claims it’s Biased Towards Fiji’s Judiciary

New Zealand’s Ministry of Foreign Affairs says New Zealand does work co-operatively in criminal matters with any country including Fiji.

This comes after a Fiji judge Justice Salesi Temo was quoted by the website Fijivillage last week as saying that New Zealand is against Fiji’s judiciary and that there is no co-operation from New Zealand in judicial matters.

Justice Temo made the comment while presiding over the case of a bailed defendant seeking permission to visit New Zealand this week.

He also said Fiji couldn’t get people back after they absconded to New Zealand.

A spokesperson for the Ministry says under the Mutual Assistance in Criminal Matters Act, countries, including New Zealand, provide assistance to each other in criminal investigations and prosecutions.

The Fiji regime failed in an extradition bid this year when it sought New Zealand’s help to return a coup co-conspirator, Ratu Tevita Mara, who was wanted for skipping bail while being charged with sedition.

Kiwi Ngamoki-Cameron Fingered for Incompetence & Misusing FHL Office

The chairman of the Fijian Holdings Ltd, Carl Ngamoki-Cameron (a New Zealander by birth but naturalised Fiji citizen) is under fire for why he has been running the Fijian Holdings Ltd, and is now under investigation following allegations received against him. According to Fiji Live and Fiji Village news reports, mysteriously removed for further consumption, a team from the Prime Minster’s Office and the Ministry of Finance is now conducting a special audit against Cameron.

The FHL board, according to Fiji news reports, met and also appointed Iowane Naiveli as the Acting Chairman until the special audit is completed. The Board said at this stage the audit is focused on corporate governance related issues and the recent appointment of the General Manager for Merchant Finance, Greg Cathcart. Cameron was appointed as the Chairman of Fijian Holdings on the 27th of June this year and is also the Chairman for Merchant Finance and Investments, Fijian Property Trust, FHL Logistics Limited, Blue Lagoon Cruises Limited and PNG based Pasifika Holdings Limited. Meanwhile, the FHL board said it is business as usual for the company and the enquiry will have no impact on the day to day running of the group’s business activities.

The Charges Against Carl Ngamoki –Cameron

What are the charges against this wannabee Cameron who seems to be involved in all sorts of shoddy deals in the country? A letter leaked to me from the dictator’s own office, and written by a group of FHL’s concerned shareholders on 12 September 2011 to Cameron begins by informing him: “We the undersigned are most concerned at the way Fijian Holdings Ltd is operating under your chairmanship. Firstly, Mr Nausab Fareed continues in an acting role as chief executive officer of FHL with all the uncertainties involved in that situation. This is the vital leadership post in FHL’s management structure. We need a confirmed CEO as soon as possible. This will allow him to perform his duties with total confidence and commitment. Further delays in confirmation are simply unacceptable and will have negative impact on his performance and the way he carries out his responsibilities. There is a morale factor here. This will trickle down to the staff and over time affect the Group performance. We, therefore, recommend that action be taken on this matter immediately.”

Misuse of FHL Office

The letter continues: “Secondly, we have learned from FHL staff that you appear to be using your office at FHL as an extension of your legal firm. If this is true it is highly irregular and unacceptable. It would be an abuse of your position as FHL Chairman and offensive to Class A shareholders as well as employees. ”

Cathcart as GM of Merchant Finance: Nepotism and Favoritism

On 30 August Cameron announced the appointment of Greg Cathcart as the new General Manager for Merchant Finance Investment Company Limited (MFIL). But the shareholders are unhappy with the way a local was sidelined withi the FHL: “Thirdly, your choice of Mr Greg Cathcart as GM of Merchant Finance represents a blatant disregard for one of FHL’s core roles. That is to train and promote indigenous people to enter into and participate effectively in higher corporate management. Hence Mr Napoliono Batimala now finds that he does not have a proper role to play within the Group as he has now being displaced by the aforementioned person.”

On Cathcart’s appointment, the shareholders questioned Cameron’s role and called for Cathcart’s employment termiantion: “We also object to the manner in which Mr Cathcart was appointed. The procedure did not follow due process and the rules of good corporate governance. We are told that the position was advertised but Mr Cathcart’s application was received late. He had come in initially as a consultant, and then applied for the position of GM. We are led to believe that the position was filled by Mr Cathcart on your personal endorsement. The normal procedure would be for a report to go to the Merchant Finance board seeking approval for an appointment, which would then be endorsed by the FHL board. It is critical in a major corporation such as FHL, for all appointments to be made in a proper manner. The hiring process should be designed to discern personal and commercial values, professional attitudes, depth of experience and successful work performance. From this a judgment is finally made on the suitability of a candidate for contributing to the organisation and its goals. Our sense at the moment is that Mr Cathcart’s appointment may be a case of nepotism or favouritism. We suggest that Mr Cathcart’s employment should be terminated and Mr Batimala should replace him.”

Cameron’s Track Record Questioned – Consider Stepping Down

The concerned shareholders challenged his own credentials: “Questions are also being raised about your experience and track record in operating successfully at a high level in a diversified group such as FHL. We do not have full details of your qualifications and past experience, but from what we have read have doubts about their relevance for the important position you now occupy. So we are asking what advantages and executive commercial abilities you bring to FHL? You have been with the company for two-and-a-half months but have not yet offered a vision and plan to accelerate the company’s growth and reverse its alarming decline in profitability. We would like to know how you intend to inspire the grassroots indigenous communities to take part in business and benefit from the Group. If you cannot answer these questions to the satisfaction of shareholders, then we believe you should step down to make way for a more suitable appointee.”

Deputy Chairman – Why the Delay?

The shareholders also questioned Cameron on the appointment of a deputy to him: “We also want you to know we are concerned about the delay in the appointment of a Deputy Chairman for FHL Group. A conglomerate of FHL’s size should have someone in that post. Why, then, is it being kept vacant? Please understand that the shareholders hold FHL in high esteem as the flagship for the aspirations of the indigenous people to compete in and benefit from participation in commerce and industry. This is an important national issue. We are proud of what FHL has achieved previously but I have to tell you that there is an impression that the company has now gone into a cycle of decline. We are, therefore, duty-bound to make our views known and to exercise our rights as shareholders. We are demanding that vigorous action be taken forthwith to recover what has been lost and position the company for the strong record of growth that it previously enjoyed.”

Who is Carl Ngamoki-Cameron?

According to some Maori websites, “Carl holds double degrees in Law and Sport Science, is admitted to the High Courts of NZ and Fiji, has current legal practicing certificates for both countries, owns and operates his own legal practice in Fiji specialising in foreign investment, tourism property development and construction law.”

In June 2001 it was none other than the brutal dictator Frank Bainimamra, who had appointed Cameron as the new chairman of the FHL. The dictator was exercising his power of appointment as the Minister for iTaukei Affairs. Cameron had replaced Iowane Naiveli, who was acting in that position for the past four months following the resignation of former chairman Isoa Kaloumaria in February. The dictator had also appointed Ilimo Cawi as a director replacing Michael Makasiale.

We will “Never Give Up”

Carl Ngamoki-Cameron is best remembered for that recent shoddy rugby world cup song and video. FHL sponsored the Flying Fijians song for the Rugby World Cup 2011, with Cameron boasting that it was the first time for the company to back a sporting team. “We hope that this Flying Fijians music video ‘Never Give Up’ is going to have the same impact as what Waka Waka had for the soccer World Cup. The song is sung by Steve Macomber and is collaboration between FHL and the Ministry of Information’s Film and TV Unit.”

FRU board chairman Colonel Mosese Tikoitoga said the song will inspire fans to support the Flying Fijians: “Full credit to Fijian Holdings for coming up with the idea and it will no doubt remind the players of the support they have back home and will also unite the country to get the Flying Fijians like never before.”

The dictator’s propagandist Sharon Smith-Johns indicated that it was very important for the Government to support such initiative: “This is nation building. We hope this song is going to inspire the boys to try harder and never give up”

Meanwhile, sources inside the dictator’s office have informed me that FHL Board was not aware of “the stupid song” and are worried that other sporting bodies will also be queuing for sponsorship from FHL.

As to Carl Ngamoki-Cameron and other treasonous supporters of the illegal and dictatorial regime, we say: “We will Never Give Up” in pursuing and exposing your scams and transgressions in Fiji.

The Fiji Judiciary: Perceptions and Reality

To almost all military dictatorships, apart perhaps from North Korea and possibly Burma, perceptions, especially international perceptions, are of greater importance than reality. The current Fiji military junta is no exception.

From its very inception, after the murderer Bainimarama’s illegal coup in 2006, the regime has studiously slaved to present an image of international respectability. Chief proponent of this illusion is the alleged Attorney General and his think-tank. With studious care they in particular (amongst other illusions which they have fostered) have sought to create an image of an independent judiciary. Such an exertion on behalf of the alleged AG mirrors other efforts by the junta to give a false appearance of respectability. These are all false and do not reflect the truth.

The alleged Attorney General, articulate and apparently sincere, has sought to weave a web of deceit over the eyes of the international community. Notwithstanding the systematic campaign of torture and abuse of human rights orchestrated by the junta which gives him a living more lucrative than any he could have dreamed of in his previous career in the Australian law firm of Minter Ellison.

The alleged Attorney General has consistently asserted the continuing independence of the judiciary under his watch, nut the facts say otherwise. The alleged Attorney General has elaborately created alleged "independent" bodies for appointment purposes. He is the "voice of reason" of the military junta and more articulate and subtle than his puppet the murderer Bainimarama, whose paranoid ramblings he seeks to replace.

The real truth about Fiji’s judiciary is evident in the recent statements by both the New Zealand and Australian Law Societies condemning Fiji’s military junta and the enforced demise of the Fiji Law Society.

Fiji’s judiciary is not independent. To call the Fiji judiciary independent is an abuse of language, notwithstanding the fine garments, which the junta has given the judiciary to wear, and notwithstanding the appearance of normality of court proceedings that the alleged Attorney General works so feverishly to maintain -- The use of “smoke and mirrors” to hide the true picture from the people of Fiji, especially in the rural areas.

The alleged Attorney General was rightly stripped of his Australian Permanent Residence for his involvement in the latest coup. His activities will undoubtedly expose him to prosecution once the current military junta falls and a new democratic Government is elected. All those people currently masquerading as Judges will also suffer an equivalent fate.

Fate of Fiji’s Current Judges.

All current purported Judges, including those garnered by a worldwide trawl by the alleged Chief Justice, took office knowing the full legal and Constitutional position. That legal and Constitutional position was established by the Fiji Court of Appeal ruling of 2009, which declared the coup of 2006 to be unlawful and all actions taken under it to be unlawful. No alleged Judge currently sitting can claim ignorance of this basic truth.

These purported Judges must have taken an oath of some sort or other, no doubt concocted by the alleged Attorney General. These are ALL False oaths. Taking any oath other than the proper oath to Fiji’s Constitution, which was endorsed by the Court of Appeal in 2009, is a false oath. The making of a false oath is a serious criminal offence. Such false oaths were the basis of charges laid against the leaders of the 2000 coup.

Any person who makes an oath swears allegiance, no matter what else that person may say or do. Any oath taken by the current purported Judges, other than the proper oath, reveals allegiance to the military dictatorship. Involvement of alleged "independent" commissions does not solve this problem.

A person who swears allegiance to the current military junta should be an outcast from the international legal community.

Further, all current purported Judges are fully aware or capable of being fully aware of the campaign of torture and abuse of human rights currently being waged across Fiji by the junta against any real or imagined opponents. Simply put, by their oaths and their actions they pledge themselves to accept the validity of the "decrees" created by the alleged Attorney General that purport to preclude them from dealing with human rights abuses by the junta. They must turn a blind eye to the systematic torture while gilding themselves in splendid robes to adjudicate in respect of anything, but such illegal matters.

Giving judgements, in certain cases, against the junta does not in any way falsify the above picture. The judges are not dealing with the one thing that matters most- the regimes campaign of torture.

Current purported Judges would do well to resign now to avoid the wrath to come. All will in fullness of time stand trial for their misdeeds as described above.

SDL Will Run for 2014 Elections: Qarase

With government’s promise to hold elections in 2014 sealed, political parties are starting to show interest in running for the coveted seats in parliament.

One such party is the Soqosoqo Duavata ni LeweniVanua (SDL) with prominent member and former Prime Minister Laisenia Qarase confirming they will run for elections.

“If it is under the 1997 Constitution or a new constitution that has been approved by parliament, we will run for elections in 2014,” Qarase told FijiLive.

Qarase reiterated SDL will only take part in the 2014 elections if there is a parliament approved constitution in place.
“That is the legal process,” the former Prime Minister said.

Meanwhile, current (and illegal) Prime Minister Commodore Voreqe Bainimarama has hinted there are steps being taken to construct a new constitution for Fiji.

At a meeting with Canadian investors last week, Commodore Bainimarama said Fiji’s new constitution will be tailor-made to benefit Fiji and her people.

Kenneth Zinck has sent to Coupfourpointfive the following statement after our request for a reply to the claims from the illegal government that his motives for seeking political asylum in Australia are questionable. Zinck - a former government minister and unionist - has revealed he is making an application for asylum saying his safety can no longer be guaranteed in Fiji as the military is looking for him.

MINFO's Sharon Smith Johns has told FBC News: "The government is completely baffled regarding this. There is no truth to what Kenneth (Zinck) is saying. It's alarming the people are fabricating these sort of stories. He has a reason why he's doing this and the reasons are known only to him."

She claims Zinck has been free to travel and has attended overseas rugby matches without ever being taken to task or put on a watch list.

Zinck issued the following statement to Coupfourpointfive asking for it to be printed in full.

Sharon Smith Johns knows nothing of the happenings in Fiji. She should resign her job now before she goes to jail with Bainimaramama, Khaiyum, Nailatikau and cronies. I have a three year multiple visa to Australia and New Zealand and am only here now for safety sake from her thugs in the Fiji army. Why would I make up a story to stay here in Australia when I have families back home plus a job, a parish, a house a car and everything I need? The army hounded me in a tinted white twin cab and followed my car in the main streets of Suva on Thursday 25th August 2011 but couldn't catch up when a taxi got in between us.

I slept at the Pacific Regional Seminary that night and flew to Australia on Friday 26th August 2011 against my will but for safety's sake. I have been taken up to the Fiji Army camp three times and tortured and am not willing to be taken up a fourth time. NO WAY.

Doesn't Sharon know that I am currently blacklisted from leaving the country on instructions from her illegal PM's office and this is already on computer in Nadi in the border control area? The instructions came on the 29th August three days after I had left. The army even switched the street lights off in my street and then came at 3am in balaclavas to take me from home. My daughter and niece were home at the time and soldiers even gave them their ID.

Sharon can also check with the Police Staion in Samabula where my daughter has lodged a complaint about the soldiers for harrassment and trespass. Does Sharon think that I am making all this up just for a visa to Australia? If I had wanted to migrate to Australia I would have applied when I was much younger, not in the eve of my retirement Sharon.

My advice to Sharon is: if you dont know what you are talking about then just SHUT UP.

Her days are numbered together with Bainimarama, Khaiyum, Nailatikau and cronies and they will all go to JAIL for TREASON. When democracy is restored back home I will catch the first plane back to Fiji, Sharon, and I don't intend to live here in Australia forever.

Oh, and I will come and visit the lot of you when you are all in the MAXIMUM PRISON IN NABORO. For the moment Sharon get your facts right before opening that BIG MOUTH OF YOURS. I dare the Fiji Media to print what I have written above or are they all cowards and LAMULAMU.
