Regarding the additional customs duties for import of certain Chinese goods, covered import products that were exported from China to the United States prior to May 10, 2019 will remain subject to an additional 10 percent tariff if they are entered for consumption into the U.S. before June 15, 2019. Originally, the deadline to import into the U.S. before the goods would be subject to an additional 25 percent tariff was June 1, 2019

US Imports from China +25% tariff

On May 9, 2019, the USTR published a Notice of Modification of Action (84 FR 20459) in the Section 301 investigation increasing the duty rate to 25 percent on imports from China

The new tariffs apply to certain goods leaving China and entering the U.S. after midnight on Friday May 10.

Ocean cargo from China with a date export of May 9 or earlier will not be affected. Regardless of the export date, all affected 301 section 1 goods from China will be subject to the 25% tariff if they enter the U.S. after June 1, 2019.

Which US Seaport will Dominate in the years to come?

Of the top US seaports, Los Angeles/Long Beach, New York/New Jersey, Miami, Seattle/Tacoma, which is expected to dominate in the years to come given the major proposed developments in port and canal infrastructure?

Will constant congestion issues at the port of Los Angeles eventually cause it the top spot? NVO's are currently offering shippers and importers expanded services from the port of Miami to offset the current West Coast congestion.

The US Panama canal expansion is expected to be completed in 2016 and would be able to accommodate the new mega ships from the Pacific. The port of Seattle Tacoma has a proposed transportation renovation package aimed at speeding the movement of cargo. By far the most drastic change will be the proposed Chinese-backed Nicaragua canal with a 5 year completion date. If and when completed, a second canal would provide twice the volume of ships to the East Coast and Gulf ports. This canal is expected to accommodate ever larger tankers, many of which are too large for the Panama Canal, even after its 2016 expansion.

The constant West Coast disruption of cargo flow every few years may eventually be a thing of the past when the various alternate options become available to shippers and importers

Mexican Sugar Export License

Effective February 17, 2015, importers are required to submit Mexican export licenses as a condition of entry for consumption entries of imports of sugar from Mexico.

Any entries of Mexican sugar that are released without the submission of the export license are subject to redelivery. Failure to redeliver shipments at the request of U.S. Customs and Border Protection (CBP) will result in the imposition of liquidated damages.

FDA Issues Final Guidance on Labeling of Certain Beers

The U.S. Food and Drug Administration is issuing final guidance to help manufacturers in labeling bottled or otherwise packaged beers that are subject to FDA’s labeling laws and regulations. The final guidance, which was issued in draft form in August 2009, follows a 2008 ruling by the Tobacco Tax and Trade Bureau (TTB) clarifying that certain beers that do not meet the definition of “malt beverages” are not subject to the labeling provisions of the Federal Alcohol Administration Act. Specifically, this refers to beers that are not made from both malted barley and hops but are instead made from substitutes for malted barley (such as sorghum, rice or wheat) or are made without hops. These beers are subject to the food labeling provisions of FDA laws and regulations.

The guidance explains the requirements for such beers. As with other FDA regulated foods, mandatory information required on the labels of these non malt beers include, among other things, a listing of ingredients in the product, a Nutrition Facts label, and the name of the source of any major food allergen present in the product.
