Unless, of course you are the Jolly Green Monster. Hey, tablet manufacturers have tried every other size. But, the upcoming Viewsonic version of a giant, over $1,000, tablet, is monstrous indeed. Seriously, there will be some business and industrial uses for this thing. You could put it on the wall of the library or conference room, and you and your clients could play Angry Birds. However, how about watching movies, or doing legal research as a group, or doing demos if you are an Android developer? Of course, the smart users will buy a $200 32 inch TV and connect it to their existing Android phone. But, nobody ever said computer manufacturers were in tune with their users.

It postulates that planning to die at your desk is a likely result for lawyers who don't have a retirement plan. I agree that failing to plan for the future can have bad consequences. However, in a technical and Internet age, there is no reason why a lawyer can't continue to practice law part time (when he or she feels like it) and why the desk location has become irrelevant. My personal example is a case in point. My law practice is a big part of who I am. However, it does not control me. I control my time and location with a smart phone, a Windows computer, an Android tablet, and I can be a lawyer wherever I am. I go home early in the day, and I can fool around if I want, or take calls from clients if I want, or work on documents if I want, in the comfort of my den. I can drive to the movies in the afternoon, and control when I return calls, because I have the tech. So, planning is important. However, having the technology to work as little or as much or wherever you want is just as important. Now, I want to go shopping at the computer store. If you are a client, you can reach me on my smartphone, where all my calls go with Google Voice. I will call you back after I spend a relaxing hour playing with the gadgets.

Now, the stock is falling, and the smart money thinks it will go below 20 by the end of the year. Some think that Facebook will unveil some money making ideas around the time Google announces the next new thing at the IO conference. Now, we are seeing the first volley in the Facebook money wars. Facebook is going to charge its users to guarantee eyes on the posts and pages. For businesses with a Facebook page (every print and other kind of ad nowadays seems to have a "Like Me On Facebook" component), will this be a way to spend ad dollars? Some pundits have suggested that Facebook charge users a dollar a month to have a Facebook account. See how many millions of users would run, and how many would stay. Say, at a discounted $10 a year, times 900 million users (if you believe Facebook), that is a lot of dollars. So, what do you think? Would you pay to use Facebook? How much? Would you pay for a sponsored post? How much?

I tend to pass down my tech, as I upgrade, to the members of my family. When I moved to the smaller form factor and thin and light goodness of the Galaxy Tab 7.7 this week, I passed my Galaxy Tab 10.1 to She Who Must Be Obeyed, and she returned my old Asus Pad Transformer tablet that she had been using. She now has an on board radio, and gets 2 Gigs of data monthly for the same price I was paying for her hotspot access on her phone. I had forgotten how great the Transformer is. It is a little thicker and heavier than the Galaxy 10.1, and it is WiFi only; but, it has been upgraded to Ice Cream Sandwich, has a fast processor, and ICS has greatly improved its speed. On top of that, it still has the best keyboard attachment in the business, making it a great Android netbook for use in real work. You can't run your Windows productivity software on it; but, the Android versions of Word compatible products are really good. I have used Documents to Go, Polaris Office, and QuickOffice, and they are all great. The best part is that you can get one of these for around $300 now, a bargain in anybody's book. If I want to do something in big screen again, I will have it available.

While it was the thinnest, lightest tablet out there (sorry iPad), I have downsized to the new 7.7 inch Galaxy Tab, which has a screen large enough for video and books and magazines, and is as thin and even lighter than the 10.1. However, the really cool thing about the 7.7 is that it is the only tablet in the U.S. with Samsung's bright, Super AMOLED screen, which is brighter and crisper than the new IPad's retina display. It also has a built-in 4G LTE radio, and has a fast dual core processor. Go to the store, and hold one of these next to a new iPad. Amazing. But, I digress. Now that I have the lightest, thinnest, brightest tablet on the planet, what do I use it for while waiting for the plane? Here are some cool apps to bide your time with. My favorite is Tango, because I can do video calls with She Who Must Be Obeyed, and she can tell me to focus on making money so the kids can stay in school. Some things never change.

However, we all learned in law school that there is a limit to that liability, in the doctrine of "forseeability". See Palsgraf v. Long Island Railroad, 248 N.Y. 339, 162 N.E. 99 (N.Y. 1928). Okay, enough Torts I. What about a person who is texting another person they "know" is driving a vehicle. Can the injured person state a cause of action against the texter? This argument will be made in a New Jersey case, and the Court will be asked to decide the limits of forseeability. This should be a Torts Final Exam question for the Y generation law classes. I agree with this post by Bruce Carton. The doctrine of forseeability has limits, and a wireless phone text is beyond the limit. However, I stand ready to be corrected. We shall see.

APIs, which link software programs to perform many functions, are not really susceptible to ownership by one software developer. Allowing Oracle to control them would stunt the growth of software, and stifle innovation. The win by Google, in the most important phase of the trial, is a victory for all open system fans. Of course, there are other claims, and Oracle has the money to appeal. However, today is Google's day, and it is a big win.
