No two water treatment programs are going to be identical, differences in the materials being treated, differences in water quality and temperature, and the type of heat exchange device being treated all effect the program, but in general, water quality is usually maintained within these guidelines;

Again, these levels are dependent on the particular application, your water treatment specialist should adjust these levels to your specific application. Proper chemical treatment of the water combined with periodic blow-down of the recirculating water can control these levels. Always be sure that the chemicals being used are compatible with the materials being treated, chemicals should be added in a manner that ensures total mixing and dilution before reaching the cooling equipment, when adding chlorine be sure the levels do not exceed 1 ppm, and if the condensers do not share a common sump, each sump should be treated as a separate entity.

The conditions within an evaporatively cooled condenser are also ideal for biological growth of algae, slime, and other micro-organisms such as legionella. and at this link you can find an article on biological fouling.

Proper water treatment and cleaning of the condensers can keep your rejection, corrosion, and biologicals at acceptable levels, extending the life of your condensers.

In the back of the nasal cavity is a patch of tissue called the olfactory epithelium. The olfactory epithelium is populated with neurons called olfactory receptors. Each receptor has cilia, small eye-lash-like structures extending from the neurons, that are in direct contact with the air passing through the nasal cavity. Extending from the cilia are proteins that bind to molecules in the air, which acts as a chemical stimulus. This chemical stimulus generates an electric signal. There are many different proteins extending from the cilia, and each protein will only bind with certain chemicals.

When the electric signal from the proteins reaches a threshold level, the neuron fires sending a signal along the olfactory nerve to the olfactory bulb, a part of the brain where interpretations of the smell begins. This is when things get complicated. The olfactory bulb acts as a relay station passing signals to the olfactory cortex in the brain, but before this happens, the olfactory bulb has already started relating the signal to past experiences with the substance inhaled. Additionally, which neurons fire and how many sets a pattern the olfactory bulb can use to identify particular odors. From this point on, everyone’s sense of smell differs due to past experiences, emotions, and memories of emotions. The olfactory cortex further processes the input from the olfactory bulb before sending the signal on to the central nervous system, which controls emotions and behavior, as well as basic thought processes.

From the olfactory cortex, signals are then sent to the amygdala, which is involved in the expression and experience of emotion, the hippocampus, which is involved with associative memory, and the hypothalamus, which is involved with the formation of memories. The olfactory cortex has a shorter synaptic path to these areas than any other sense, which is probably why associations between odors and emotions are so readily formed. So, it would seem that whether an odor is pleasant or unpleasant would be greatly influenced by associated memories and experiences tied to that particular odor.

Another important aspect to an odor that is often overlooked is that most odors have a ‘feel’ to them as well. For example, menthol feels cool, ammonia burns, etc. These feelings come from the trigeminal nerve, a nerve that runs through the face and nose that is used to convey sensations from the face to the brain. The trigeminal nerve is responsible for your eyes tearing up when cutting onions and sneezing when you smell pepper. Almost all odors have a trigeminal component, varying from mild to intense. For example, sweet rose is a mild stimulation, while acetone is an intense stimulation. Intense stimulations of the trigeminal nerve can be uncomfortable to irritating and even painful. It is often difficult to distinguish between the olfactory and trigeminal senses, so they are usually associated as one.

This would seem to explain why some people actually like the smell of ammonia and some don’t. In short, ammonia smells the way it does because of which neurons the ammonia molecules bind with and the memories and emotions you associate with that particular pattern, and it burns because of the intense trigeminal stimulation.

Surface filters collect particles on the filter medium surface. After shift changeover, I did my nightly routine of walkthrough and readings before required PMs.  After about three hours in I was sitting in the control room monitoring the system.  An ammonia alarm starting going off and it signaled that sensor number 2 was pegged out at 100 PPM.  I verified exhaust fans running on the controls and proceeded out of the control room with respirator at hand.  As the door shut, I could hear the compressor continuously running and could see that the exhaust vent intake louvers were open.  I started to cautiously walk towards the fresh air intake that was leading to vicinity of ammonia sensor number 2.

Once arriving to the area of concern, I never smelled any ammonia since leaving the control room.  I said to myself, another false alarm and headed back to my control station.  Arriving at the control station I can now see that sensor 4 is maxed out and sensor 1 is now reading 55 PPM.  There was a lot of chatter on the radio and my co-worker says he is on his way for support.  I said I would be in the control room clearing the alarms.  When he walked in to the control room, he was in full face respirator and I could see the look within his eyes.  He stated, what are you doing?  I tried to explain the situation.  He grabbed the sulfur sticks and progressed back into the engine room.  As I followed my co worker my eyes began to water, and then there it was, the invisible wall and I got quite choked up.  I just then realized there was an ammonia leak ongoing, it was not a false alarm, and I can’t smell it!  My entire career, the sense of smell has helped know when there might even be the slightest of leak and this tool was not working.  My mind had a hard time believing that this was true and how could this be.  I took a quick drench of water to help catch my breath, the experience was so surreal.

The leak source was identified and my coworker had isolated it.  We left the engine room and let the exhaust fan finish its job while monitory the ammonia sensors. We then went to discus the situation at hand.   It was apparent that I had lost my smell.  He then told me to eat something, I did and I could not taste it either.  I was suggested to go get tested and it came back positive for COVID-19.  Well I am now done with quarantine.  Smell and taste are still not back to 100% but as an ammonia mechanic, I will never take for granted again how effective the nose is for first line of defense of ammonia leaks. I have had much time to ponder this now and many lessons have been learned”

RETA’s Dr. Ron Rodgers states in the September/October 2020 publication of the RETA Breeze.

• “Scores dropped significantly for the new CIRO exams”
• “Average scores by content fell by more than 10 points”
• “The pass rate fell from 78% to 65%”
• “Test results are showing that not all candidates are preparing effectively for the new test”
• “The certification committee revalidated all existing CIRO questions and wrote over 400 new questions to support these examinations”

Below is the tested content area and the number of questions per subject. And the only thing to change in the published study guide is the addition of two more figures.

This is unfortunate that updating a successful exam/material has led to such a drop in scores.  As an educator I have to ask myself is it the tester/student or is it the material/exam? There have been no subject category changes the tester is tested in.  So the tester is tested on the same subject matter.

We are here for the success of each and every student for any certification they or their company desires.  We will never give up on any student until they give up on themselves.  As a RETA RAI, I encourage all whom take certification exams to prepare themselves. No test is perfect, of course. But, as Rodgers notes the tests have changed in recent months. The test results are significantly down. To blame candidates’ worsening performance on the test is to excuse failure–something educators have way too much experience at.

Housekeeping is extremely important and a system that does not look well maintained most likely is not well maintained. Here are some things you can look for when entering a compressor room that has process equipment:

• The area should not have an ammonia odor
• The area should be well lit
• The area should be clean and free of debris, puddles, etc…
• The area should not be used for bulk storage
• The equipment and piping should be clearly labeled
• The equipment should be free of visible corrosion
• The equipment should be free of excessive ice build-up
• Ammonia detectors should be in working order and free of obstruction
• Air intake for ventilation should be clean and free of obstruction
• The safety shower/eye wash should be clean and the path to it unobstructed

Ronnie was born June 2, 1965, in Ulysses, Kansas, to Warren and Loretta Bronson Peek. He graduated from Florence High School in Florence, Colorado, before beginning his career in public service. Shortly after high school, Ronnie joined the United States Navy, serving four years on the USS Missouri BB-63 based in Long Beach, California. He then spent time as a deputy with the El Paso County (Colorado) Sheriff’s Office. An opportunity to volunteer with the Grant County (Kansas) Fire Department helped Ronnie discover his love for firefighting. He joined the brotherhood of the Garden City Fire Department in 1998.

Two years earlier, in 1996, Ronnie married the love of his life, Lana Reid. The two raised three children, Haley Reid, Adriana Peek, and Logan Peek. Ronnie was a devoted husband and father and was very active in his children’s lives. When he wasn’t at work, he enjoyed spending time with family and friends. He also enjoyed hunting and fishing.

Around the firehouse, Ronnie was known for his extensive knowledge of the department’s trucks. He enjoyed operating each of them, particularly the CFR-7 at the Aircraft Rescue and Firefighting Station at Garden City Regional Airport. He was also known for his meticulous organization. He knew where everything was around the station and on each truck, down to the smallest or least used part. He also made sure each piece of Tupperware was stored with its lid.

Ronnie was an outstanding member of the honor guard, bringing his military experience to the group. He was incredibly generous with his time, making friends anywhere he went. Ron never missed the MDA Boot Block, the annual fundraiser held for the Muscular Dystrophy Association. He was always seeking to help others without expecting anything in return. This desire to help others led to a second career with Finney County EMS, where he served from May 2006 until he passed away.

Ronnie is survived by his wife, Lana; his children, Haley George, Adriana Peek, and Logan Peek; grandchildren, Selene George and Aniyah Peek; his Garden City Fire Department brothers; and a host of family and friends.

Ronnie lived his life according to his favorite quote: “Live for today, because you never know about tomorrow.”

GCAP will honor the life of this great man and has awarded scholarships to many students searching for continued education in his name.

Rusty Hutto of Pilgrim’s Pride in Enterprise said he has appreciated the training provided by Mr. Williams and GCAP. “(Mr. Williams) is a real world guy, so we can relate to what he’s telling us. This training has been more beneficial than any other education I’ve had.”

“A lot of us have worked with (ammonia and refrigeration) with our jobs, but we haven’t always understood why we did things the way we had to do them. This training will make us more efficient and safer. The theory is intense, but it’s something we need to know. Now, we know how to keep things running, and we know why we have to do what we do to keep things running,” said Macon Hodge with Sister Schubert’s in Enterprise.

Oscar George with Rembrandt Foods in Abbeville said, “Any extra training we can receive is going to be an advancement. College is not for everyone, and in a lot of cases, there are better jobs making more money with a trade. Opportunities are more available, but the passion (for the trade) has to be there.”

Joseph Nguyen of Today’s Foods in Piedmont, Missouri, agreed. “I wanted to make a move to this field, so that’s why I came for the training. I wish this (training) had been available to me 30 years ago. It’s exciting.”

Seventeen of the 22 students traveled to Snead State from other states, including Washington, Ohio, Illinois, Connecticut, Mississippi and Missouri. Within Alabama, students came from Abbeville, Luverne, Enterprise, Gadsden and Albertville.

Peter Starvish of Country Pure Foods in Connecticut shared the same sentiments as many of the workers with regard to the hospitality of the area and the positive experience they had while at Snead State.

If we take a gas and compress it, we will see an increase in temperature. The energy that is in the gas will concentrate into a smaller area. Focusing this energy quickly can get excessively hot. Man nor the machine creates the heat, it is only a focusing of the heat. All a compressor does is focus the energy through a reduction of space.

On October 16, 2017, the curling brine chiller at the Fernie Memorial Arena was put back into operation after a seasonal shutdown. During the shutdown and seasonal maintenance, ammonia had been detected in the curling brine system, indicating that the curling brine chiller was leaking. At 3:53 a.m. on October 17, 2017, an ammonia alarm in the arena’s mechanical room was triggered and the system was shut down. Between 9:15 a.m. and 9:38 a.m., rising pressure contained within the curling brine system led to the separation of a pipe coupling in the mechanical room. Upon separation of the coupling, an estimated 9 lb. of ammonia was rapidly released into the room followed by additional ammonia from the system. 10th Annual GCAP Safety Day in Kansas City KS Agenda

Ms. VanLiew serves as a Managing Consultant in Trinity’s Kansas City office and national expert in the Process Safety Management (PSM) and Risk Management Program (RMP) regulations. She has held environmental compliance responsibilities since 1998 in the consulting, regulatory, and manufacturing arenas. Ms. VanLiew is the National Instructor for Trinity’s Understanding and Application of RMP/PSM Requirements course, and a trained PHA leader in the HAZOP and What-If/Checklist methodologies. She earned a B.S. degree in Chemical Engineering from Northwestern University and is a licensed Professional Engineer in Missouri and Kansas.

Guest Speaker Jeremy Williams will present on “What do you know about NH3?”

Mr. Williams has dedicated his career to the enhancement and advancement of training for anyone in the fields of ammonia refrigeration, process safety management, and steam boilers. He is author of several books on industrial refrigeration am process safety that are used sole by GCAP.  Jeremy manages day to day activities for GCAP, instructors, websites, and social media avenues for the school as well as instruct all courses offered through the technical school.

GCAP’s Advanced RETA Refresher Competencies 

Prerequisite: Suggest prior Ammonia Operator 1 and/or Ammonia Operator 2 Credentials

This class is designed to be a refresher for any individual that is looking to attempt RETA Certification credentials such as the CARO (Certified Assistant Refrigeration Operator) or the CIRO (Certified Industrial Refrigeration Operator).  Individuals can also take this class as an overview refresher without sitting for the exams.

If a student was to take GCAP’s Ammonia Operator 1 Course that would be preparing for the CARO.  If a student was to take GCAP’s Ammonia Operator 2 Course that would be preparing the the CIRO and would be no need to take this class if sitting for those exams following the particular course.  This course is for individuals whom have have past experience, training and are now trying to sit for the exams and would like a review/refresher before taking the test. Also, many certifications/licenses across the country require continue education credits.  This class can meet what most require.

We suggest that you bring you past Ammonia Operator 1 and 2 books be supplemented with the book “Seeing Industrial Refrigeration from the Inside Out”. The class will be studying from multiple sources to prepare for the optional certification(s).  If you don’t have any prior books contact our office.

This last week in San Antonia Texas, Alfa Laval was showcasing their partially flooded U-Bend / U-Turn plate and frame heat exchanger.  Since ALfa Laval showcased this a few years back the crew at GCAP has had to have one.  Danny Hauenstein made it happen this week and it’s is getting shipped to Kansas.  We have saved a special place for this unit in the hopes getting one for the training lab.

When Anthony Verdugo came aboard in 2012, GCAP had the idea of developing a Spanish Division. Taking advantage of his bilingual abilities, he was given the responsibility to revise and re-edit the RETA Spanish book 1. After re-editing the RETA Spanish book 1, and developing Spanish lectures to go with it, we decided to launch our very first Spanish Seminar for Entry Level Operators. After doing a couple Spanish Seminars we realized that the material being presented was good, but the book wasn’t exactly what GCAP was trying get across to our students.

In 2015 GCAP decided to hire another Spanish Instructor, Miguel Bermudez was the perfect individual for the job. Therefore, Anthony and Miguel took the opportunity to begin converting the GCAP’s English book to Spanish.  A lot of hard work and dedication is being put into this book as we speak. “Translating an entire book to Spanish is not an easy task to do” said, Anthony Verdugo but “we look forward to offer a new Spanish Book for Entry Level Operators along with great Spanish lectures and the best hands on training lab in the U.S” said, Miguel Bermudez.  Once the book is completely done, we will be proud to announce that the Spanish Operator 1 Book “Understanding Industrial Refrigeration from the Inside Out” will be the new and improved textbook being used in our Spanish Seminars.

Two area students have been named the 2^nd recipients of the Ronnie Peek Memorial Scholarship for 2016 funded by Garden City Ammonia Program known as GCAP. The scholarship fund, named in memory of 16 year Garden City fire department veteran Ronnie Peek whom died during a training exercise in 2015.

Each recipient has recieved $1,500 scholarship of the 2016/2017 school year.

This is Maria’s second year to to receive the the scholarship and she is in her sophomore year at K-State University studying Psychology.  She is an alumni of Garden City High School and her parent is employed with the Garden City Police Department.

Nicholas is a recent graduate from Garden City High School.  His parents are employed by the Garden City Police Department and Garden City Fire Department.  He will be studying localy at Garden City Community College and plans on becoming a EMT/Paramedic.  He enjoys tennis, computer programming, robotics, and attends Bible Christian Church.

We at GCAP wish you be best for you education and hope in launches you into a rewarding career.

Regions 7 EPA gave a yearly update and explained the new proposed rule, and top 10 list for EPA inspections.  They also explained Region 7 highest citations by element and examples of best practices.

Top 10 List by EPA for Inspection:

The Creek XL condensing boiler can be used as a high efficiency heating boiler. The heart of the Creek XL is a robust titanium infused stainless steel heat exchanger – the key to its high efficiency. This design allows the boiler to withstand the corrosiveness of condensed flue gases for years of reliable operation. A large horizontal combustion chamber limits the formation of Nitrogen Oxides (NOx) and is matched with a specially engineered vertical condensing section of AISI 316 Ti stainless steel.

The Creek XL is a flow-through design which means no dedicated boiler pump is required. The Creek XL has no limit on return water temperature, and is designed with TWO hot water returns, allowing for a system with two distinct loops and two different return temperatures. This makes the Creek XL a very flexible boiler that can be used in many situations.

The Sellers immersion fired S-Series steam boiler is a horizontal, single pass, firetube boiler designed to burn natural gas. The unique burner assembly delivers pre-mixed air and gas through multiple nozzles. The air-gas mixture is ignited as it exits each flame retaining nozzle at high velocity The resulting flames are long and small in diameter. The flame from each of these nozzles is directed into a 2″ O.D. tube that is completely immersed in liquid. There is a separate tube for each flame with the same amount of heat going into each tube. These small diameter flames burn in the first half of the tube lengths. Therefore, the “fire shines“ on half of the heating surface in the single pass boiler — 50% of the total heating surface is radiant heating surface.

The high percentage of radiant heating surface, the low heat input into each tube, and the even distribution of heat throughout the multiple tubes virtually eliminate thermal stress problems that are common in multiple pass boilers.

A tragic ammonia accident occurred last week in Massachusetts. Brian Caron, 43, died Wednesday in an ammonia leak at a Stavis Seafoods warehouse in South Boston, where he worked as the facilities manager. Caron was overcome by ammonia fumes inside the cold storage warehouse on Channel Street in South Boston. He was one of five workers who smelled the fumes just as their shift ended Wednesday at 6 p.m.

The workers pushed an emergency switch in hopes of stopping the leak, then rushed out the door. Four workers made it out safely, but Caron could not. A hazmat team found his body in a stairwell on the second floor.

The ammonia leak was found in a ruptured 1½-inch metal pipe, said Steve MacDonald, a spokesman for the Boston Fire Department. The department is investigating the fatal leak, along with the federal Occupational Safety and Health Administration.

Investigators are trying to determine what caused the pipe to burst, but it could take several weeks, MacDonald said. Here is a link to the report.

The incident occurred while he was replacing a bolt that was missing from the breakaway bracket of a rented toolbar.

“We’d just started running (anhydrous) that day,” Vande Noord said. “When I was going over everything, I noticed a hose on the ground. Then, I saw the bolt was gone that connected the right quick connect coupler bracket to the tool bar swivel bracket.”

As he lifted the hose to put the bolt in the brackets at eye level, the coupler sections separated, spraying both his eyes with anhydrous.

“It knocked me down to the front wheel of the tank rig,” Vande Noord said. “My eyes were burning; my eyelids were frozen shut; I couldn’t see. I felt my way back to the emergency water supply on the nurse tank and pulled on the hose, but it cracked and broke. There was no water in it.”

Vande Noord managed to make it back to his pickup where he had a half bottle of water left over from lunch. He poured it in his eyes and drove himself a half-mile to a neighbor’s, feeling his way along a windrow left by the road grader.

He estimates a critical 15 minutes had elapsed in the time it took to get to the neighbor’s before they could start flushing his eyes. His neighbor drove him to the Pella ER.

Vande Noord described the pain: “My foot was crushed in an accident in 2005. That pain didn’t even compare to the burning pain in my eyes.”

He spent a week at University of Iowa Hospitals and Clinics.

“I wasn’t able to open my eyes for a month and a half, . . . but we had to open them several times a day to put medicine in them,” he said. His wife, June, was at his side continually for two months.

A year later, he has not regained full vision.

“I’ve only recently been able to see well enough to start working in my shop,” he said. “My eyes still bother me a lot and I can’t take sunlight, dust, chemicals or wind. It bothers me to drive. But I had a good nurse,” he nodded toward June.

“I know I was lucky. I could have been killed,” he said, referring to the “accident near Pilot Mound.”

Mike Shaw, 58, of Ogden, survived the anhydrous release that killed his father in that accident.

In October 2011, he and his dad, Dick, were putting anhydrous on rented ground near Pilot Mound.

Dick got started early on Oct. 29, pulling tandem 1,000-gallon tanks while Mike went to town to get another tank.

“I was on my way back to the field with the tank, and I could see the cloud from a mile away,” Shaw said. He tried to radio his dad but couldn’t get any answer. Shaw called 911 and family members.

Upon arriving at the field, he drove partway into the cloud to locate the tractor. Even inside the truck, the vapor was noxious, and he had to back out.

He parked, turned up the radio and gulped water before going about 35 yards into the cloud, eventually finding the back tire of the anhydrous rig. He felt his way to the shut-off valve on one tank, stumbled out toward the truck radio, and then went back a second time to close the shut-off valve on the second tank.

His third and fourth attempts were to move the still-running tractor clear from the cloud and closer to where firefighters and emergency responders had gathered along the road a half-mile away. His dad was unresponsive.

Mike recounted how he felt unable to breathe and was completely contaminated with anhydrous. His lungs were burning and his skin felt like it was freezing.

Mike was airlifted to Des Moines. He learned two of the paramedics who treated him had also been admitted with anhydrous injuries from exposure to his own clothing and skin.

“My doctor told me, ‘You probably shouldn’t be here, and none of us can explain it,’ ” he said, referring to surviving the release that fatally injured his dad.

Like Paul Vande Noord, Mike Shaw avoids anhydrous exposure and hires his application done now. Both farmers are emphatic about anhydrous safety.

“People always need to be aware of the wind direction and stay upwind in the event of a release,” Shaw said. “You have to think ahead for your plan of escape if a release would occur.”

“Even if you’re doing simple maintenance, make sure to wear protective equipment and have a water supply with you,” Vande Noord added.

The Vilter Single Screw compressor is a rotary, positive displacement compressor which incorporates a main screw and two gaterotors. Compression of the gas is accomplished by the engagement of the two gaterotors with the helical grooves in the main screw. The drive shaft imparts rotary motion to the main screw which in turn drives the intermeshed gaterotors.

Three area women have been named the first recipients of the Ronnie Peek Memorial Scholarship funded by the Garden City Ammonia Program (GCAP) and presented by the Western Kansas Community Foundation.

The scholarship fund, named in memory of 16-year Garden City Fire Department veteran Ronnie Peek who died during training exercises in January 2015, was established by Randy and Rachel Williams and their son Jeremy Williams to honor Finney County first responders who provide for public safety. The fund provides three $1,000 scholarships for the children and stepchildren of Garden City Fire Department, Garden City Police Department and Finney County EMS employees.

Maria Klarissa Calvillo, Garden City, Abbygail Hogan, Cimarron, and Brianna Pauley, Holcomb, were each awarded $1,000 scholarships on August 14 and have the distinction of being the first recipients of the newly created scholarships.

Calvillo, a Garden City freshman at Kansas State University majoring in psychology and women’s studies, is the daughter of Garden City Senior Master Patrol Officer Gabe Calvillo. She is involved in Friends of Four Paws, K-State Dance Marathon, Hispanic American Leadership Organization, National Society of Collegiate Scholars- K-State Chapter and is a UNITY event coordinator. She maintains a 3.52 GPA.

Additionally, Calvillo is a first-generation college student and plans to complete her undergraduate degree in psychology at KSU and pursue a mater’s degree at the University of Kansas in clinical psychology. She plans to work with victims of sexual abuse.

Abbygail Hogan, daughter of Tom and Lisa Hogan, Cimarron, earned the EMS scholarship. Her father is a Finney County paramedic and her mother is a realtor with Regan & Co. with an EMT certification. She is a junior at Kansas State University, and throughout high school she was involved in 4-H and was elected to the Kansas 4-H Youth Leadership Council where she served for two years. As a high school senior, she received the Key Award which is only given to the top 10 percent of 4-Hers and is based on leadership involvement along with community service.

While a student at Garden City Community College, Hogan was a student athletic trainer and tutor who later achieved Master Tutor status. She was also an active volunteer with her church playing piano and hand bells for services, teaching Sunday school and confirmation classes, visiting nursing homes, helping with election campaigns and in the local public library.

Hogan plans to major in athletic training and said she would like to work in a military setting upon completion of her certification. She plans to add EMT or paramedic training to her repertoire of skills and to eventually pursue a master’s degree.

Brianna Pauley, daughter of Katy and GCPD Sergeant Paul Pauley, Holcomb, is the third recipient of the Peek Scholarship. She plans to become a homicide detective and is beginning her studies this fall at Garden City Community College.

Pauley is active in Big Brothers Big Sisters, the Fellowship of Christian Athletes, Future Farmers of America, vocal and instrumental music, student senate, and sports including basketball, cross country, and track. During her high school studies she maintained a 3.78 GPA.

No stranger to volunteerism, Pauley has spent time on her church’s mission trips building houses for families in Mexico, helping with vacation Bible school, helping with her church’s Fixin’ and a Paintin’ work days, serving as a Salvation Army bell ringer, and served at the ABC Pregnancy Banquet for the past two years. She has been a partner with the children in Families Together and was a representative to the Lutheran Youth Fellowship of Kansas. She also works part-time at Papa Murphy’s Pizza.

Pauley’s plans after completing a criminal justice degree at GCCC are to enroll in a four-year college to complete a bachelor’s degree in sociology before completing her training in homicide case work.

Funding to continue the yearly awards will be provided from the proceeds gleaned from GCAP’s annual Region 7 Ammonia Safety Day held each May at Kansas City Community College. The Williamses, along with several other staff members and instructors, present refresher courses and training throughout the entire day to 350-400 participants. They provide recertification and OSHA training to groups of technicians with varied skill levels and skill sets.

The scholarships have been set up and will be managed by Western Kansas Community Foundation.

CIMCO Refrigeration partners with Mayekawa to bring the NH3/CO2 Newton 3000 to the U.S.  In order to offer a new industrial solution to our market and trying to avoid some of the pitfalls of large-scale NH3 processes, including large charges and inventories throughout the plant.  This package is pre-fabricated and low-charge for the ammonia side, with automatic controls, single or two stage design, with option ecomonization.  It will include a semi-hermeitc IPM motor for the screws.  GCAP is very proud to say they have the first running semi-hermetic ammonia screw compressor running the the United States for ammonia design.

To date, around 500 NewTons have been successfully installed, and GCAP was at the celebration in Japan last year when they reached 300.  In the U.S, CIMCO recently completed its second installation in California.  CIMCO says they have another 10 projects with the NewTon in the workings.

To honor the Finney County men and women who provide for its citizens public safety, Garden City Ammonia Program, also known as G.C.A.P., has established the Ronnie Peek Memorial Scholarship Fund that will provide three $1,000 scholarships for the children and stepchildren of the Garden City Police department, Garden City Fire Department, and Finney County EMS.

The scholarship fund was named in memory of 16-year Garden City fire department veteran Ronnie Peek who died during training exercises in January 2015. “We have done safety training with the GCFD for a lot of years and Ron had gone through many of our classes,” said Randy Williams, president of the Garden City Ammonia Program (GCAP). “We know these men and women put their lives on the line for us every day so we made the decision to offer scholarships for their children and stepchildren as a way of recognizing their efforts and saying thanks.”

The scholarships, which have been set up and will be managed by Western Kansas Community Foundation, will offer three $1,000 awards each year—one each for police, fire, and EMS. Only children and stepchildren of those departments’ employees are eligible for award consideration. These students must have graduated or be graduating from a Kansas high school, have attained a 2.5 or better GPA, and must complete a scholarship application form.

“The scholarships will be utilized toward the student’s tuition and/or books,” said Shea Sinclair, Western Kansas Community Foundation executive director. “The post-secondary school must be accredited and may be a four- or two-year college, a vocational-technical program, or other state-recognized certification program. We are so pleased and honored to be part of helping make this scholarship available to the children of those who serve and protect in Finney County.”

Funding to continue the yearly awards will be provided from the proceeds gleaned from the Region 7 Ammonia Safety Day held each May at the Kansas City Community College. Williams, along with his son Jeremy and several other staff members and instructors, present refresher courses and training throughout an entire day to 350-400 participants. Vendors are also on hand to display and demonstrate the latest equipment and technology being used in ammonia and carbon dioxide refrigeration, boiler operations, and process safety management.

“We provide recertification and OSHA training to groups of technicians with varied skill levels and sets,” said Williams. “We understand the importance of education and the challenges that can arise when trying to pay for that education. From Ron’s tragedy came the opportunity for us to offer some help as well as to show our appreciation for these unsung heroes. It’s a start.”

As educators ourselves, we get the point that Taylor is making and generally applaud it. Some teachers do indeed make a difference – a very real difference – in the lives of their students. Taylor is taking a question that was made about his income and re-directing it to what he actually does for a living. Yes, teachers can make a difference – but some don’t. For that matter, there are plenty of lawyers that make a difference too.

Ultimately we should judge people by what they accomplish – not what their “profession” or job title is. With the rise of the college graduates since World War II, it’s our opinion that people have forgotten the value of real work. While there are some great people out there like Mike Rowe who are praising the value of the skilled trades, work defined as “blue collar” feels as if it’s looked down on.

Thankfully, the vast majority of the people in the skilled trades aren’t the kind of people that need a pat on the back on an hourly basis. They’re the self-motivated people who take pride in a job – ANY job – well done. There’s a story from 1961 where President John F. Kennedy was said to be touring the NASA headquarters during the race to put a man on the moon. JFK was said to stop a man holding a mop – a janitor – what he did at the facility. The man’s response was “Sir, I’m helping to put a man on the moon.”

Years ago, while working at a facility that made Ice Cream, we had a tour of grade-school children come through to see how an Ice Cream factory operated. When the kids left, the Plant Manager said something to me that I’ll never forget: “Did you see their faces when they tried the ice cream right out of the freezer? Man, we don’t make Ice Cream. We make smiles!”

That thinking – knowing that you are part of a larger project and exerting your best personal effort to do your part – that’s what makes the skilled trades a pleasure to work with. In the skilled trades, you’re still judged by the quality of your work rather than your credentials or your history. Nobody cares how many classes you took if you can’t trouble-shoot the broken machine! You’re judged by whether you can get the machine running when it’s supposed to be running and how it’s supposed to be running.

This abnormal transient condition results in a sharp pressure rise with the potential to cause catastrophic failure of piping, valves, and other components – often prior to a hydraulic shock incident there is an audible “hammering” in refrigeration piping. The incident at Millard caused a roof-mounted 12-inch suction pipe to catastrophically fail, resulting in the release of more than 32,000 pounds of anhydrous ammonia.

Chairperson Rafael Moure-Eraso said, “The CSB believes that if companies in the ammonia refrigeration industry follow the key lessons from its investigation into the accident at Millard Refrigeration Services, dangerous hydraulic shock events can be avoided – preventing injuries, environmental damage, and potential fatalities.”

An estimated 3,800 people died immediately, and tens of thousands were injured. Eventually thousands more died from toxic gas-related illnesses – the release eventually killed tens of thousands of people.

In the wake of Bhopal, Congress enacted new laws to increase chemical emergency preparedness and to require companies to develop process safety and risk management programs, and to report their worst-case release scenarios.  Congress also established the Chemical Safety Board to independently investigate chemical accidents and recommend measures to prevent such catastrophic accidents.  But despite these actions in the 1990’s, the United States continues to experience serious chemical accidents.

In the video, CSB Chairperson Rafael Moure-Eraso says, “Process safety management regulations are in need of reform. There must be more emphasis on preventing the occurrence of major chemical accidents through safer design. Responding to emergencies and punishing people after the fact are not enough.

In the past few years, CSB investigations have found deficiencies in design and process safety management similar to those uncovered in Bhopal. The video points out that a 2008 explosion killing two workers and injuring eight others at a pesticide plant in Institute, West Virginia found that incomplete operator training and procedures similar to Union Carbide’s at Bhopal.

Furthermore, had the Institute plant vessel that exploded taken a different trajectory, pieces of it could have struck piping connected to a storage tank containing 13,700 pounds of MIC, potentially causing a large release of the same highly toxic chemical that killed thousands in Bhopal.

The safety message discusses a number of additional accidents currently investigated or previously investigated by the CSB which ultimately could have been prevented had current federal and state regulations focused on preventative measures or continuously reducing process risks.

To enhance safety in the chemical industry, the Board has voted to include “Modernize U.S. Process Safety Management Regulations” on the CSB’s list of most wanted safety improvements.

Chairperson Rafael Moure-Eraso concludes the video with the following call to industry and regulators, “Since Bhopal, both industry and government have increased their efforts to prevent major chemical accidents. But multiple CSB investigations show that much more needs to be done to assure that future tragedies will be avoided.”

The CSB is an independent federal agency charged with investigating serious chemical accidents. The agency’s board members are appointed by the president and confirmed by the Senate. CSB investigations look into all aspects of chemical accidents, including physical causes such as equipment failure as well as inadequacies in regulations, industry standards, and safety management systems.

It’s great to be out in the field working with the leaders in the Food Production and Cold Storage industries, but being on the road this often means we aren’t available in the office and have to work on new and innovative ways of keeping in touch with our customers.

Those of you who have attended the PSM/RMP class know that one of the best parts of the class is the CD that comes with the book. On the CD there are over 6,000 pages of reference material and templates for Guidelines, SOPs, Forms, etc. The PSM program on the CD can be used as a template to create your own PSM/RMP program. Several Food Manufacturing and Cold Storage companies have done just that and we use their feedback to continuously improve the program on the CD.

Unfortunately, that means that the CD is out of date just about the minute it is printed! We’re not kidding – we’ve made more than 300 changes to the PSM companion CD in the last three years and all of them made the example program just a little bit better. The question we’ve been struggling with is: How do we make sure these changes are made available to our former, current and future students?

Our solution was to set up a virtual CD on a shared Google Drive where students that had already taken the class can always have access over the Internet to the latest, most up-to-date version of the PSM companion CD. This service is totally free to all the students who have taken the PSM class in the last three years. All you have to do is contact the office and let them know a current email address so we can send you an invite to the Google Drive.

Once you receive your invite through email, just click on the link and login to your Google account to gain access to the files on the CD. You’ll notice an additional file in the Root Directory of the CD called “Update History.” For the past few months (and going forward) that’s where we’ve recorded the major changes we’ve made to the PSM companion CD.

RETA offers many course study materials to help operators to self-educate themselves but also offer a couple ANSI accredited tests known as the CARO Certified Assistant Refrigeration Operator, and the CIRO Certified Industrial Refrigeration Operator certifications.

There are several goals going along with these certification: to establish a nationally recognized standard of experience, education and training for refrigeration plant operators and supervisors, assist the refrigeration industry in developing and recognizing qualified plant operators and supervisors, encourage technical training and education as well as practical experience, promote safety, and increase public recognition of skills needed in the industrial refrigeration field.

It is extremely important that you just don’t study ready books to get knowledge o pass they exam, it is recommended to also study the supplemental packages before taking the exam.

CARO Certification

• No Experience Required
• Entry Level exam
• 110 Questions multiple choice
• 3 hour time limit
• Supplement Package
• 70% or higher to pass

The recommended study material to pass is Industrial Refrigeration 1 and Industrial Refrigeration IV from RETA.  GCAP’s Operator 1 course covers all this material and more and will also incorporate the practical “hands on experience” to enhance the learning experience.  If an individual can pass GCAP’s Operator I course and exam, they have a high probability they can pass the RETA CARO exam.  Since GCAP teaches refrigeration and this is a refrigeration exam the knowledge retained from our course greatly enhances your chances of passing this test.  As always you as an operator have to put forth the effort to apply yourself and utilize the knowledge.

CIRO Certification

• Minimum 2 years of experience
• 134 Questions multiple choice
• 3 hour time limit
• 70% or higher to pass
• Operators Exam
• Supplemental Package 1
• Supplemental Package 2

RETA recommends 7 different refrigeration materials to attempt this test although passing these courses does not guarantee a passing score.  GCAP uses the Industrial Refrigeration II course in our Operator II training and this second course is used in preparation for operators to attempt the CIRO exam.  GCAP also uses the CIRO supplement from RETA’s website during this course we approach this supplement as a training tool for Operators of any experience to apply the skills required to evaluate a refrigeration system from an analytical standpoint as well as visualize the system in their minds from the information provided.  The CIRO exam is the most successful attempt to date to gauge an operator’s knowledge of refrigeration theory and basis from real life scenarios.  Every Operator II it is a joy to see operators understand the importance of round sheets in their facilities, accuracy and evaluation of these rounds are windows to our system.  There are calculations of HP and KW that are figured and although the average operator will not calculate these in their plant it shows them how important a slightly abnormal pressure increase can affect energy consumption.  It is also a great gauge on an operator’s ability to find the correct information based on the questions posed.  This skill is vital to management since they are relying many times on operators doing exactly that in their facility.

From the GCAP Operator II course perspective not only are you seeing this on paper you can see the reactions in our lab as “YOU” operate our systems.  In the second course you are given the procedure to operate the system and you balance the system based on heat loads in the lab.  Many of the scenarios from the two stage, DX and Flooded systems will happen as your run our lab equipment allowing you the opportunity to make the proper adjustments to solve the issue should it arise. GCAP believes that the combination of theory and lab training has helped us enable operators the best possible single training environment to successfully pass the CIRO certification exam.

What I liked about this course was the two stage lecture and the topic on how & when you should manual or auto purge. It was a great experience to understand a mechanical refrigeration system. A CO2 course might be necessary in the future since it is a natural refrigerant.

Dealing with ammonia and the potential to have a gas leak with any line opening this blanket could be very beneficial to safety for all involved.  GCAP has requested theirs for show students how this tool works. Earlier this year, due to a FOIA we read an inspector quote from OSHA course book “3430 – Advanced Process Safety Management in the Chemical Industries.” We’ve long known of this course, but it’s only available from the OSHA Training Institute and only allows OSHA inspectors to attend the class. The quoted line that drew our attention was this: “The loss of Ml due to external corrosion is the single biggest concern in industrial ammonia refrigeration components.”

We wondered – if OSHA is saying this in the course, what else are they saying? What was their source for this information? We again requested to be able to attend the course at our own cost and were turned down.  GCAP’s  recalled a court ruling that was referenced in the MEER decision (http://www.oshrc.gov/decisions/html_1997/95-0341.html) from the 1990’s from the Fifth Circuit Court of Appeals in Diamond Roofing v. OSHRC, 528 F.2d 645, 649 (5th Cir. 1976):

“An employer, however, is entitled to fair notice in dealing with his government. Like other statutes and regulations which allow monetary penalties against those who violate them, an occupational safety and health standard must give an employer fair warning of the conduct it prohibits or requires, and it must provide a reasonably clear standard of culpability to circumscribe the discretion of the enforcing authority and its agents….

If a violation of a regulation subjects private parties to criminal or civil sanctions, a regulation cannot be construed to mean what an agency intended but did not adequately express.”

We didn’t think that an OSHA course on how they interpret the standard could be refused under FOIA so we requested the coursebook from the course under the Freedom of Information Act. Jeremy Williams, Managing Director of GCAP stated: “They can’t rig the game like this – if we’re being held to certain standards, we should know what they are. Sure, this is a legal issue, but at the end of the day it’s about Process Safety – Safety being the key word here.”

Eventually OSHA approved our FOIA request and we received three books totaling about 500 pages.

Unfortunately, they had redacted quite a bit of the information we were actually interested in. One example is the Ammonia Refrigeration Processes and Equipment presentation which was of particular interest.

Slides that were redacted include titles like:

• Does PSM Apply?
• What About NH3 Refrigeration Processes < 10,000lbs?
• What are Signs of a Poor NH3 Refrigeration PSM Program?
• What Design Codes and Standards Could be Expected in PSI?
• Inspection RAGAGEP?

You can understand why we would want access to that information. OSHA had redacted it under provision 7(e) of the Freedom of Information Act. Provision 7(e) protects records or information compiled for law enforcement purposes the release of which could reasonably be expected to disclose techniques and procedures for law enforcement investigations or prosecutions. Essentially, they are arguing that if we knew what they were looking for we would be able to avoid citations.

Look, we at GCAP don’t necessarily disagree in that argument, but this same argument could be made to block any information requested about any citation at all! If they are looking for things because those things indicate a safety issue, then solving those things would alleviate the safety issue. Isn’t that what they are in business for? We don’t think citations should be the primary business that OSHA is in!

We’d rather have the problem solved by the PSM practitioner and refrigeration technicians to ensure the safety of the community and the employee BEFORE the odd OSHA inspection or chemical release. OSHA’s position seems to be that the information on these slides shows inspectors where there are gaps in a program but that information should only be known to the inspectors – not the people actually endangered by the process or the people in charge of ensuring its safety.

Is OSHA more interested in citations than employee safety? It certainly shouldn’t be – according to their own website (https://www.osha.gov/about.html) the reason that congress created OSHA was “to assure safe and healthful working conditions for working men and women by setting and enforcing standards and by providing training, outreach, education and assistance.”

Is hiding information that would show those operating a chemical process where there might be flaws in that process really how they intend to “assure safe and healthful working conditions for working men and women”? We at GCAP don’t think that’s right and we intend to appeal these redactions.

Look for an upcoming podcast where we discuss what we learned from the information they did provide including the answer to the original question: What was the source of that quote in the original citation?

Residents of Garden City are more than familiar with the Lee Richardson Zoo and the 2.2 million gallon “Big Pool,” but not as well known to some in Garden City would be being home to the world’s largest industrial, hands-on technical school and training lab.

Along the winding road of Fulton Street, just before one hits the highway, stands a facility recognized as one of the premier programs of its kind in the United States.

The Garden City Ammonia Program provides training for more than 600 different companies and instructs about 1,800 to 2,000 students a year.

“We’re kind of like a two-year technical school, but instead of going to school for two years, they are coming in and taking week-long courses,” Jeremy Williams, directing manager of the Garden City Ammonia Program, said.

And by “they,” Williams is referring to the students who take observation tests and written exams to check their knowledge on operating the machinery.

The program has close to 40 people in Garden City per week, who take two to three classes a week.

“We train refrigeration technicians and managers on how to use refrigers such as ammonia, refrigeration processors, carbon dioxide and steam boilers,” Williams said.

“What they are learning here is how to operate — safely and efficiently — these industrial systems,” he said.

Williams added that most of the students already have a “mechanical aptitude” and work for corporations such as Nestle, Sara Lee and Tyson.

“We want to see if they can exceed and go to the next level and progressively build their careers,” he said.

GCAP works with students from all of over the world, with 90 percent of its enrollment by people outside the state of Kansas. This week, there are 13 people from different states and five people from different countries, ranging from Alaska to Australia.

“It’s a fantastic program here,” Alessandro Silva, 41, who arrived at the program Nov. 5 from Brazil, said. “In Brazil, we don’t have a program like this which motivated me to come here. Everything is put on the table very clear. I want to learn as much as I can here to provide information for my country and colleagues.”

Patrick Fossey, 35, a Venezuelan from Chile, said he was “very satisfied with the program and facility.”

“Everything here is conceived to teach,” Fossey said. “It is a facility where you will come and learn.”

• Requirement of reporting of fatalities and hospitalizations of 2 or more employees (currently 3)
• 5 years imprisonment for a 1st offence violation that causes or contributes to serious bodily harm to any employee but does not cause death to any employee – 10 years for subsequent offences
• 10 years imprisonment for a 1st offence violation that causes or contributes to the death to any employee – 20 years for subsequent offences
• Increases federal oversight of state OSHA plans
• Increases whistle-blower protection
• Allows multiple general duty citations – one for each affected employee

These would be massive changes to the enforcement of the OSHA rules.

GCAP’s PSM/RMP Video

OSHA and the IIAR have not seen eye to eye on the issue of Hydrostatic trapping since 2006 when OSHA issued the Palmer interpretation letter which said the following:

If a liquid expansion hazard exists and the only safeguard to protect against this hazard is the use of trained operators/technicians, then OSHA would not consider this hazard to be adequately controlled, as required by 1910.119(e). After addressing the liquid expansion hazard in the PHA, the employer must address and resolve any of the PHA team’s findings and recommendations [1910.119(e)(5)]. Employers could abate this hazard and address and resolve the PHA finding/recommendation by installing the hydrostatic relief device(s) required by ANSI/IIAR 2 — 1999, Section 7.3.4(a)

Thankfully the IIAR was adamant in their resolve which resulted in the following letter: OSHA agrees that this revised language addresses the concems expressed in our response to question 10 in Palmer by clarifying that engineering controls, e.g., hydrostatic relief devices or expansion compens ation devices must be used when liquid filled equipment or piping can be automaticolly isolated under either nonnal or abnormal operating conditions. We also agree that

“trained technicians” acting in accordance with the requirements of 29 CFR 1910.147 (lockout/tagout) can safely perform manual isolation of potentially liquid filled equipment and piping. e.g .. to prepare equipment or piping for maintenance…

OSHA intends to revise Palmer by striking all or part of the reply to question 10 and adding either an explanatory note or footnote referencing the revised language in ANSI/IIAR 2-2008

EXECUTIVE ORDER

IMPROVING CHEMICAL FACILITY SAFETY AND SECURITY

By the authority vested in me as President by the Constitution and the laws of the United States of America, it is hereby ordered as follows:

Section 1. Purpose. Chemicals, and the facilities where they are manufactured, stored, distributed, and used, are essential to today’s economy. Past and recent tragedies have reminded us, however, that the handling and storage of chemicals are not without risk. The Federal Government has developed and implemented numerous programs aimed at reducing the safety risks and security risks associated with hazardous chemicals. However, additional measures can be taken by executive departments and agencies (agencies) with regulatory authority to further improve chemical facility safety and security in coordination with owners and operators.

Sec. 2. Establishment of the Chemical Facility Safety and Security Working Group. (a) There is established a Chemical Facility Safety and Security Working Group (Working Group) co-chaired by the Secretary of Homeland Security, the Administrator of the Environmental Protection Agency (EPA), and the Secretary of Labor or their designated representatives at the Assistant Secretary level or higher. In addition, the Working Group shall consist of the head of each of the following agencies or their designated representatives at the Assistant Secretary level or higher:

(i) the Department of Justice;

(ii) the Department of Agriculture; and

(iii) the Department of Transportation.

(b) In carrying out its responsibilities under this order, the Working Group shall consult with representatives from:

(i) the Council on Environmental Quality;

(ii) the National Security Staff;

(iii) the Domestic Policy Council;

(iv) the Office of Science and Technology Policy;

(v) the Office of Management and Budget (OMB);

(vi) the White House Office of Cabinet Affairs; and

(vii) such other agencies and offices as the President may designate.

(c) The Working Group shall meet no less than quarterly to discuss the status of efforts to implement this order. The Working Group is encouraged to invite other affected agencies, such as the Nuclear Regulatory Commission, to attend these meetings as appropriate. Additionally, the Working Group shall provide, within 270 days of the date of this order, a status report to the President through the Chair of the Council on Environmental Quality and the Assistant to the President for Homeland Security and Counterterrorism.

Sec. 3. Improving Operational Coordination with State, Local, and Tribal Partners. (a) Within 135 days of the date of this order, the Working Group shall develop a plan to support and further enable efforts by State regulators, State, local, and tribal emergency responders, chemical facility owners and operators, and local and tribal communities to work together to improve chemical facility safety and security. In developing this plan, the Working Group shall:

(i) identify ways to improve coordination among the Federal Government, first responders, and State, local, and tribal entities;

(ii) take into account the capabilities, limitations, and needs of the first responder community;

(iii) identify ways to ensure that State homeland security advisors, State Emergency Response Commissions (SERCs), Tribal Emergency Response Commissions (TERCs), Local Emergency Planning Committees (LEPCs), Tribal Emergency Planning Committees (TEPCs), State regulators, and first responders have ready access to key information in a useable format, including by thoroughly reviewing categories of chemicals for which information is provided to first responders and the manner in which it is made available, so as to prevent, prepare for, and respond to chemical incidents;

(iv) identify areas, in collaboration with State, local, and tribal governments and private sector partners, where joint collaborative programs can be developed or enhanced, including by better integrating existing authorities, jurisdictional responsibilities, and regulatory programs in order to achieve a more comprehensive engagement on chemical risk management;

(v) identify opportunities and mechanisms to improve response procedures and to enhance information sharing and collaborative planning between chemical facility owners and operators, TEPCs, LEPCs, and first responders;

(vi) working with the National Response Team (NRT) and Regional Response Teams (RRTs), identify means for Federal technical assistance to support developing, implementing, exercising, and revising State, local, and tribal emergency contingency plans, including improved training; and

(vii) examine opportunities to improve public access to information about chemical facility risks consistent with national security needs and appropriate protection of confidential business information.

(b) Within 90 days of the date of this order, the Attorney General, through the head of the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF), shall assess the feasibility of sharing data related to the storage of explosive materials with SERCs, TEPCs, and LEPCs.

(c) Within 90 days of the date of this order, the Secretary of Homeland Security shall assess the feasibility of sharing Chemical Facility Anti-Terrorism Standards (CFATS) data with SERCs, TEPCs, and LEPCs on a categorical basis.

Sec. 4. Enhanced Federal Coordination. In order to enhance Federal coordination regarding chemical facility safety and security:

(a) Within 45 days of the date of this order, the Working Group shall deploy a pilot program, involving the EPA, Department of Labor, Department of Homeland Security, and any other appropriate agency, to validate best practices and to test innovative methods for Federal interagency collaboration regarding chemical facility safety and security. The pilot program shall operate in at least one region and shall integrate regional Federal, State, local, and tribal assets, where appropriate. The pilot program shall include innovative and effective methods of collecting, storing, and using facility information, stakeholder outreach, inspection planning, and, as appropriate, joint inspection efforts. The Working Group shall take into account the results of the pilot program in developing integrated standard operating procedures pursuant to subsection (b) of this section.

(b) Within 270 days of the date of this order, the Working Group shall create comprehensive and integrated standard operating procedures for a unified Federal approach for identifying and responding to risks in chemical facilities (including during pre-inspection, inspection execution, post-inspection, and post-accident investigation activities), incident reporting and response procedures, enforcement, and collection, storage, and use of facility information. This effort shall reflect best practices and shall include agency-to-agency referrals and joint inspection procedures where possible and appropriate, as well as consultation with the Federal Emergency Management Agency on post-accident response activities.

(c) Within 90 days of the date of this order, the Working Group shall consult with the Chemical Safety Board (CSB) and determine what, if any, changes are required to existing memorandums of understanding (MOUs) and processes between EPA and CSB, ATF and CSB, and the Occupational Safety and Health Administration and CSB for timely and full disclosure of information. To the extent appropriate, the Working Group may develop a single model MOU with CSB in lieu of existing agreements.

Sec. 5. Enhanced Information Collection and Sharing. In order to enhance information collection by and sharing across agencies to support more informed decisionmaking, streamline reporting requirements, and reduce duplicative efforts:

(a) Within 90 days of the date of this order, the Working Group shall develop an analysis, including recommendations, on the potential to improve information collection by and sharing between agencies to help identify chemical facilities which may not have provided all required information or may be non-compliant with Federal requirements to ensure chemical facility safety. This analysis should consider ongoing data-sharing efforts, other federally collected information, and chemical facility reporting among agencies (including information shared with State, local, and tribal governments).

(b) Within 180 days of the date of this order, the Working Group shall produce a proposal for a coordinated, flexible data-sharing process which can be utilized to track data submitted to agencies for federally regulated chemical facilities, including locations, chemicals, regulated entities, previous infractions, and other relevant information. The proposal shall allow for the sharing of information with and by State, local, and tribal entities where possible, consistent with section 3 of this order, and shall address computer-based and non-computer-based means for improving the process in the short-term, if they exist.

(c) Within 180 days of the date of this order, the Working Group shall identify and recommend possible changes to streamline and otherwise improve data collection to meet the needs of the public and Federal, State, local, and tribal agencies (including those charged with protecting workers and the public), consistent with the Paperwork Reduction Act and other relevant authorities, including opportunities to lessen the reporting burden on regulated industries. To the extent feasible, efforts shall minimize the duplicative collection of information while ensuring that pertinent information is shared with all key entities.

Sec. 6. Policy, Regulation, and Standards Modernization. (a) In order to enhance safety and security in chemical facilities by modernizing key policies, regulations, and standards, the Working Group shall:

(i) within 90 days of the date of this order, develop options for improved chemical facility safety and security that identifies improvements to existing risk management practices through agency programs,

(ii) within 90 days of developing the options described in subsection (a)(i) of this section, engage key stakeholders to discuss the options and other means to improve chemical risk management that may be available; and

(iii) within 90 days of completing the outreach and consultation effort described in subsection (a)(ii) of this section, develop a plan for implementing practical and effective improvements to chemical risk management identified pursuant to subsections (a)(i) and (ii) of this section.

(b) Within 90 days of the date of this order, the Secretary of Homeland Security, the Secretary of Labor, and the Secretary of Agriculture shall develop a list of potential regulatory and legislative proposals to improve the safe and secure storage, handling, and sale of ammonium nitrate and identify ways in which ammonium nitrate safety and security can be enhanced under existing authorities.

(c) Within 90 days of the date of this order, the Administrator of EPA and the Secretary of Labor shall review the chemical hazards covered by the Risk Management Program (RMP) and the Process Safety Management Standard (PSM) and determine if the RMP or PSM can and should be expanded to address additional regulated substances and types of hazards. In addition, the EPA and the Department of Labor shall develop a plan, including a timeline and resource requirements, to expand, implement, and enforce the RMP and PSM in a manner that addresses the additional regulated substances and types of hazards.

(d) Within 90 days of the date of this order, the Secretary of Homeland Security shall identify a list of chemicals, including poisons and reactive substances, that should be considered for addition to the CFATS Chemicals of Interest list.

(e) Within 90 days of the date of this order, the Secretary of Labor shall:

(i) identify any changes that need to be made in the retail and commercial grade exemptions in the PSM Standard; and

(ii) issue a Request for Information designed to identify issues related to modernization of the PSM Standard and related standards necessary to meet the goal of preventing major chemical accidents.

Sec. 7. Identification of Best Practices. The Working Group shall convene stakeholders, including chemical producers, chemical storage companies, agricultural supply companies, State and local regulators, chemical critical infrastructure owners and operators, first responders, labor organizations representing affected workers, environmental and community groups, and consensus standards organizations, in order to identify and share successes to date and best practices to reduce safety risks and security risks in the production and storage of potentially harmful chemicals, including through the use of safer alternatives, adoption of best practices, and potential public-private partnerships.

Sec. 8. General Provisions. (a) This order shall be implemented consistent with applicable law, including international trade obligations, and subject to the availability of appropriations.

(b) Nothing in this order shall be construed to impair or otherwise affect:

(i) the authority granted by law to a department, agency, or the head thereof; or

(ii) the functions of the Director of OMB relating to budgetary, administrative, or legislative proposals.

(c) This order is not intended to, and does not, create any right or benefit, substantive or procedural, enforceable at law or in equity by any party against the United States, its departments, agencies, or entities, its officers, employees, or agents, or any other person.

“Implementing Process Safety Management for Ammonia Refrigeration” was written for the exclusive use of Garden City Ammonia Program as a textbook for their Process Safety Management class and to outline a standard of educational material, guidelines, and best practices for the Ammonia industry. Throughout the years we’ve all met hundreds of PSM practitioners and every one left at least one good idea with each of us; In some sense, the text presented here represents the collected wisdom of those hundreds of PSM practitioners operating thousands of facilities. Our focus is on real-world implementation; with due deference given to the practical needs of the facility, the requirements under the regulations and the challenges we face in an increasingly fast-paced and competitive business world.

Most of the PSM implementations in our industry rely on the IIAR’s Process Safety Management Guidelines for Ammonia Refrigeration and its companion Risk Management Program Guidelines for Ammonia Refrigeration. While we believe these books provided an excellent resource for their time, PSM implementation has continued to evolve rapidly in the years since they were published and they no longer reflect the “state of the art”. This book is an attempt to re-envision Process Safety Management implementation based on the experiences of the Ammonia refrigeration industry over the past 15+ years.

OSHA’s NEP or National Emphasis Program (and the fines that came with it) has served to highlight the deficiencies in the way Process Safety Management for Ammonia refrigeration is currently implemented. The NEP draws from PSM experience in the chemical process and petroleum refinery sectors, so we have adopted some of the ideas and approaches present in the excellent Center for Chemical Process Safety (CCPS) books to improve the system first presented by the IIAR considerably. We believe that the IIAR is still the appropriate source for information regarding the proper design, installation, maintenance, and operation of mechanical Ammonia refrigeration systems; however we turn to the CCPS and other organizations for guidance on how the Process Safety Management programs that cover these systems should be designed and implemented.

PSM Covered Chemical Facilities National Emphasis Program

GCAP has just finished rewriting their PSM (Process Safety Management) and NEP (National Emphasis Program) courses.

The new PSM course offered exclusively by GCAP is a re-envisioning of Process Safety Management implementation based on the experiences of the Ammonia refrigeration industry over the past 15+ years, the guidance from the Center for Chemical Process Safety (CCPS), the NEP guidance from OSHA and the over 8,000 pages of OSHA citations GCAP has amassed from Freedom of Information requests.

NEP – OSHA’s National Emphasis Program for Chemical Facilities evolved in part from the consistent deficiencies found in OSHA’s PSM NEP on refineries. After a 2 year pilot program in 3 regions, OSHA has now rolled out their Chemical NEP inspections nation-wide targeting Ammonia Refrigeration Systems. In anticipation of this massive change in PSM implementation compliance auditing, GCAP designed this course around the lessons learned in the pilot program. Currently, GCAP is the only training organisation in the world offering a 40-hours course specifically on how to implement PSM to the modern requirements under the NEP compliance initiatives.

Jeremy and Randy Williams of Garden City Ammonia Program discuss the CSB findings of a propane explosion in 2007.  Some factors to blame was unqualified technicians, unqualified training and inadequate training for when things may go wrong such as an emergency.  We will compare their findings and recommendations to the industrial ammonia refrigeration industry.

The CSB is an independent federal agency charged with investigating industrial chemical accidents. Headquartered in Washington, DC, the agency’s board members are appointed by the President and confirmed by the Senate.

The CSB conducts root cause investigations of chemical accidents at fixed industrial facilities. Root causes are usually deficiencies in safety management systems, but can be any factor that would have prevented the accident if that factor had not occurred. Other accident causes often involve equipment failures, human errors, unforeseen chemical reactions or other hazards. The agency does not issue fines or citations, but does make recommendations to plants, regulatory agencies such as the Occupational Safety and Health Administration (OSHA) and the Environmental Protection Agency (EPA), industry organizations, and labor groups. Congress designed the CSB to be non-regulatory and independent of other agencies so that its investigations might, where appropriate, review the effectiveness of regulations and regulatory enforcement.

The CSB investigative staff includes chemical and mechanical engineers, industrial safety experts, and other specialists with experience in the private and public sectors. Many investigators have years of chemical industry experience.

Both accident investigations and hazard investigations lead to new safety recommendations, which are the Board’s principal tool for achieving positive change. Recommendations are issued to government agencies, companies, trade associations, labor unions, and other groups. Implementation of each safety recommendation is tracked and monitored by CSB staff. Jeremy Williams and staff of Garden City Ammonia Program discuss the outline of the chemical and refinery NEP and the results as of March 2011 for both NEP inspections from OSHA.

A NEP course has been developed through GCAP for the need of understanding OSHA’s regulations regarding 1910.119.  It was developed for the petroleum industry after numerous accidents in recent past including the BP explosion in Texas .  Programmed inspections for ammonia and other HHC’s have taken place in Region I, VII and X for the year 2009, 2010, and 2011.  It will expand to all regions permanently.

Purpose:  To understand and describe the policies and procedures that will take place with a NEP inspection.  The NEP is designed to reduce or eliminate the workplace hazards associated with the catastrophic release of highly hazardous chemicals.
