Question by : Do ordinary people “have” lawyers even if they are not in need of them at the time?
You people, say “ill have my lawyer look at it” or other statements which imply that they have lawyers on retainer. I was listening to a broadcast recently on NPR saying that having a lawyer in your phone is just as important as “life insurance”. Is this true?

Best answer:

Answer by lucy
Most ordinary people will never see a lawyer in their lifetime. Or, may only see for a will or a bankruptcy or divorce period. But many people will also do it themselves with legal software out there vs paying a lawyer.

Some people if they have seen 1 lawyer many times over the years knows that they can call that lawyer up if a legal problem arises and have this lawyer review, but they would not be on retainer per se, but if the lawyer is needed will charge them new for this particular reason.

The only people who might have a lawyer on retainer would be people who have serious money, or work in a company with a high rank that may use the company’s lawyer.

The only time I could see having a lawyers name on your phone might be important if you are arrested and if so, should never talk until you talk to a lawyer for your legal rights. Anytime you are charged with something, and if you state want to talk to a lawyer, all questions must stop period.

DARIEN, Ill., Feb. 20, 2012 /PRNewswire via COMTEX/ — Life Quotes, Inc. wants to remind consumers that a little-known side benefit of the dreaded life insurance exam is that it might uncover health problems that you didn’t even know were there. It’s possible that the simple life insurance paramedical examination can provide much more than financial protection.

Life insurance is typically used to protect loved ones from financial devastation in the event of a death, but in a number of cases, the lab results of a routine checkup uncovered something far more sinister–a serious illness that the policyholder was not aware they had, which ultimately saved their life.

“It’s quite common for the lab results of routine life insurance exams to reveal potentially life-threatening illnesses,” says Robert Bland, CEO and founder of Life Quotes, Inc. “Surprising illnesses or conditions are revealed most frequently among adult applicants who have gotten out of the habit of having annual physical checkups. This then puts the life insurance agent into the role of bearer of bad news. Understandably, the reaction upon receiving such news is first denial, then anger at us for bearing the bad news and then appreciation for having uncovered potential problems before they become life-threatening. It’s amazing what kinds of problems a comprehensive blood count test can reveal, which is why we always urge our customers to obtain regular annual checkups, in part so that their families don’t have to use the life insurance policy in the drawer.”

Life Quotes, Inc. gathered several personal stories provided by individuals whose lives were changed when they applied for life insurance.

In 1991, NBA All-Star Earvin “Magic” Johnson was diagnosed with HIV after a routine life insurance examination. Since then, Johnson has dedicated his life to promoting awareness about the deadly disease.

Dr. Joan Schaefer, chief medical officer of Nebraska’s Health and Human Services System, learned she was in the early stages of a rare developmental liver disease called congenital hepatic fibrosis due to the lab results of a simple life insurance medical exam. At the time of the discovery, she had otherwise believed she was healthy and was in the middle of training for a marathon. In 2008, Schaefer underwent an emergency liver transplant to correct the condition.

From a paramedical examiner’s standpoint, it is very common to come across a client who did not know there was a problem with their health until they saw the results of the examination.

“This is fairly commonplace, we don’t know every instance where this happens at a given moment, but we draw blood and ship the blood to the lab and are often privy to those results,” said James Fritz, President and Chief Operating Officer for APPS Paramedical Services in Jericho, N.Y. “An examiner may find an abnormal reading on an electrocardiogram or their blood pressure is extremely high or low and they realize something has happened and encourage the person to contact a medical professional saving the applicant from a significant episode or serious medical condition. This may not be publicly recognized, but it is a reality and it does uncover significant illnesses that do save peoples lives.”

According to Kim Anderson, Senior Vice President of Examination Management Services, Inc. (EMSI) her examiners see an applicant with a critical health risk at least twice a year.

“This is often presented to us during the exam. Examiners are trained to know what to look for and if they see something that is out of the ordinary they know they are to inform the applicant and recommend they seek immediate medical attention,” Anderson said.

Although examiners cannot diagnose or offer medical advice about a certain illness, they can refer applicants to medical specialists for further review. And often the insurance agent informs the applicant that the exam revealed a serious illness.

“I had an applicant who thought he was in perfect health and when I told him that the examination showed that he had Type 2 diabetes, at first he didn’t believe me,” said Margaret Thornton, New Business Director at Life Quotes, Inc. “I strongly recommended that he make an appointment with his doctor as soon as possible, especially since he was planning a trip overseas that year.”

Shortly after an examination revealed that a new applicant had diabetes, Thornton was contacted again by a life insurance examiner who told her another recent applicant had a “stroke-level” blood pressure reading. The applicant was encouraged to contact her physician.

If it is found that you have a serious illness after a paramedical examination, the life insurance company may instill a waiting period based on the type of illness and the severity of the condition.

In the case of dangerously high blood pressure, the waiting period will likely be a year to make for certain the individual has the condition under control, but the policy could still be rated or declined depending on the outcome of the actual diagnosis and treatment.

“Bottom line, it doesn’t happen everyday, but it definitely happens and often these health problems are found from testing that is done at a low cost and in some cases absolutely free of charge to the applicant,” Thornton said.

Life Quotes, Inc. suggests contacting your health care provider immediately and making an appointment if a serious health condition is found in your test results.

For more, see “When Life Insurance Saves Lives” http://www.lifequotes.com/articles/lifeinsurance/when-life-insurance-saves-lives/

If you have a serious medical condition and have the need to shop for life insurance, Life Quotes, Inc. recommends the following to increase your chances of passing the examination and getting a better rate on life insurance.

Expedite the application process by submitting doctor letters or medical records to your insurance agent before taking the exam

Make sure you are properly hydrated

Avoid fatty foods for two days prior to taking the examination

Abstain from alcohol for 72 hours prior to the exam

Don’t take ibuprofen or aspirin prior to taking the exam since this will elevate your liver function

WATERVILLE — Local insurance agents say it’s not uncommon for a parent to buy life insurance for a child, an issue that has been raised recently as the investigation of missing toddler Ayla Reynolds enters its third month.

The role of life insurance for children has emerged as an issue since Ayla’s mother, Trista Reynolds, contends that she learned from state police that Ayla’s father Justin DiPietro bought a policy on the child. Reynolds shared the information on www.aylareynolds.com, a family-run website. Ayla was 20 months old when she was reported missing Dec. 17.

Local insurance agents said the reasons for buying insurance for a child vary from making the child easier to insure later in life to providing money for college or beyond and most parents don’t buy a policy with an eye toward collecting a benefit if the child dies.

The lack of information about the investigation into the toddler’s disappearance has raised the question what role the insurance policy plays. State police won’t confirm the existence of the policy and Ayla’s father, Justin DiPietro, could not be reached for comment.

Covering children with life insurance policies is routine, according to a senior official at the state agency that regulates insurance companies and brokers in Maine said.

“Parents having life insurance on their children is not at all uncommon. In fact, many group life insurance plans have dependents’ coverage because children do pass away,” said Tom Record, senior staff attorney for the Maine Bureau of Insurance.

Charles Reeves, a family law attorney in Waterville, said he would never consider buying a life insurance policy on a child, but added that the existence of a policy doesn’t signify something illegal in the Ayla investigation.

Three Waterville insurance brokers said this week buying a life insurance policy for children is a logical and responsible thing for a parent to do.

John Fortier, an insurance salesman, said he often sells cash-value policies to parents. He has policies on all his children, and his father bought a policy on him.

That type of policy is transferable and it serves as a savings account.

Naturally, if a child dies, the parent receives the benefit. However, that isn’t the intent, he said.

“No parent that I have ever known bought a life insurance policy looking for a death benefit,” he said. “They’re always looking to guarantee the insurability.”

Buying a life insurance policy ensures a child will always be eligible for coverage. Common chronic illnesses such as asthma and diabetes that develop as a child grows can keep a person from getting insurance, which often hinges on whether the person has a pre-existing condition. If parents buy a policy for a child early in life, however, that coverage is guaranteed for a lifetime, as long as the premiums are paid.

Also, the earlier a person is insured, the smaller the premiums will be.

Fortier said the minimum coverage he sells for a cash value policy is ,000. It costs about a month.

As the child grows, so does the cash value of the policy. The premiums that are paid into the policy gain compound interest, currently at 4.25 percent, just like a savings account.

Unlike a savings account, however, the interest isn’t subject to taxes until a withdrawal is made.

At age 18, the child can take ownership of a cash value policy and withdraw the accumulated money, but many times a parent will retain ownership of the policy until the child is financially stable enough to pay.

“In my own case, I handed over the ownership of the policies once my kids got through college, once they became self-sustaining and had the ability to pay for them.”

Doug Legg, another Waterville insurance salesman, said it’s not unusual for a parent to buy a police on a child and agreed that cash value policies make sense, particularly for parents who don’t have a lot of money.

“The cost is very, very small,” he said. “It could cost per year, which covers all children in your family.”

The minimum rider to a term policy is ,000, Legg said.

Steve Bousque, another Waterville insurance salesman, said life insurance policies for children used to be common.

“Years ago, it was a very common practice that grandma or grandpa would buy a very small ,000 policy on the kids. Today, I think parents have gotten away from that.”

Recently, Bousque said he has seen parents of older children buying life insurance policies.

“College students are incurring astronomical loans these days,” he said. “If parents co-sign on those loans, they will come in and buy a term policy, because otherwise they’re on the hook for that child.”

Question by Ruth G: Anyone know how I can go about canceling my Gerber LIfe Insurance?
Hi when my daughter was born I applie for a Life Insurance company called the “Gerber Life Insurance” policy. I’ve been paying it for about 2 years now but would like to cancel it. Does anyone else have it, can you please explain the benefits? or how I can go about canceling it and will my money be returned. Thanks!

Best answer:

Answer by Gem
How is it paid? If they just send a bill and you cut a check to pay it, it will cancel for non-payment when you quit paying.

If you signed up for an automatic deduction, you will need to call them to cancel it.

More than likely you will not be eligible for a refund, generally they bill you when for the current period. Again, call them to see how far ahead you are paid and how to cancel.

Or just quit paying it.

(CBS) – The mother of missing Maine toddler Ayla Reynolds says the girl’s father took out a life insurance policy on Ayla in the weeks before she disappeared.

Pictures: Ayla Reynolds missing

“In the same week Justin took Ayla from me, he took out a life insurance policy on Ayla,” said Trista Reynolds, according to Fox Boston. “Now, why did he take out that life insurance policy? I’m still trying to figure that one out myself. Because who takes a life insurance policy out on their own child?”

Ayla Reynolds vanished last December from her father’s Waterville, Maine home. Trista Reynolds says she was in rehab for alcohol abuse when the Department of Health and Human Services sent Ayla to live with her father, Justin DiPietro.

Trista Reynolds is also suing the state nearly two months after her daughter’s disappearance, claiming social service workers may be at fault, according to CBS Boston.

Reynolds says Maine officials could have done more and that she called them several times with concerns about her daughter, but they never investigated.

“You have this system that’s supposed to protect children and what kind of protecting do they do when a child goes missing or something happens?,” asks Reynolds.

When a “for rent” sign appeared in the window of Gerber/Hart Library in late January, community members shared concerns that the library was being forced to move against its best interests.

Karen Sendziak, president of the Gerber/Hart Library board, later confirmed that Chicago’s LGBT library and archives, now at 1127 W. Granville Ave., is moving. No further information was provided.

Community members expressed concern for the well-being of the library, and Windy City Times began examining both the structure and fiscal health of the organization. What WCT found is an organization struggling to stay compliant, quiet about its operations and more than two months behind on submitting its annual IRS form 990 on its finances.

On or around Jan. 22, a large red rental sign appeared in the window of the Edgewater-based library, encouraging interested parties to contact neighborhood B&R Developers.

The property was also listed in at least two Craigslist advertisements published Jan. 23. The listings did not mention the library specifically, but showed pictures and a description of the single-story library. The rental sign in the window’s library advertised 5,500 square feet of available space in the building.

Sendziak, reached by phone, initially declined comment on the rental advertisements, but later confirmed via email that the library would in fact move.

“Gerber/Hart will be moving,” she wrote to Windy City Times. “That is all I can say at this point.”

According to Rae Ann Cecrle, the building’s owner, Gerber/Hart asked for a one-month lease extension until the end of April. Cecrle said she sent the library a new lease in September, but was not given notice until December that the library planned to relocate.

“I couldn’t get a commitment out of them,” Cecrle said, adding that she sent several inquiries but received no response.

Cecrle declined to disclose the cost of rent but said that it has remained the same for two years. The latest lease did increase the rent by per square foot, but Cecrle offered to donate the cost of the increase to keep Gerber/Hart in the building, she said.

Cecrle said she does not know why the library is leaving the space, but added that she supports the organization and hopes it remains in the neighborhood.

At least one potential renter has inquired about the space thus far.

The library officially announced the move in an email newsletter to members Jan. 26, stating that after 13 years of operation on Granville, “it is time to move on.”

“As to where and when we are moving—once our deal is consummated ( yes, consummated! ) , you’ll be the first to know,” the newsletter read.

Cecrle was not the only one who wanted the library to stay in the neighborhood. Ald. Harry Osterman said that he met with Sendziak two months ago and asked what he could do to keep the library in the neighborhood. He said he had heard they were considering moving and requested a meeting.

“Gerber/Hart has been a phenomenal institution in our community,” Osterman told Windy City Times.

He said that he told Sendziak that his office wanted to help them stay in the neighborhood. He also said that he does not know if the library plans to move to another location in Edgewater but said he “got the sense that it’s been a good fit for Gerber/Hart and its community.”

Several sources close the library have wondered why, if rent is not immediately increasing, the library has decided to move its more than 14,000 volumes, 800 periodical titles and 100 archival collections.

Sendziak has thus far declined to comment on the reason for the move.

Wil Brant, who served as the organization’s board president more than a decade ago, helped the library move from its Paulina Street location to its current home. Brant speculated that moving the current library will require a large volunteer base.

“It’s a major undertaking,” he said.

According to Brant, the Granville location had to undergo renovations in order to support the library. That included reinforcing the floors to bear the weight of its books and installing two separate air-conditioners—one for its special collection and another for its general collection.

Some have speculated that the Gerber/Hart intends to purchase a space, rather than continuing to rent.

It remains unclear if the library has the financial resources to purchase property. Going into 2010, the library’s net assets totaled 5,976. Much of those funds originated from bequests and life-insurance donations that came to the library over the last five years.

However, more current information on the organization’s assets is inaccessible, in part because the library failed to file its 990 IRS form, the document that most tax-exempt non-profits are required to file on their finances annually.

Two staffers at the Illinois attorney general’s Charitable Trust Bureau confirmed that the library filed for two extensions on its 990 forms. After the extensions, the form was due Nov. 15, 2011, but it has not yet been filed.

Robyn Ziegler, press secretary at the attorney general’s office, said that in situations where a non-profit fails to file a 990, the bureau sends a 30-day notice letter to the organization. That letter has not yet been sent to Gerber/Hart but could be sent shortly, Ziegler said.

A failure to come back into compliance after those 30 days may lead to legal action against an organization, Ziegler added.

“Generally speaking, when that happens we would continue to pursue them and it could lead to us filing a lawsuit for violations of the Charitable Trust Act,” said Ziegler.

Windy City Times contacted several sources close to the library for this story. Most spoke at length about a myriad of concerns for its future, but few would go on the record about the state of the library or their history with it.

To date, Windy City Times has not been able to obtain the names of any board members, nor has the paper been able to obtain a copy of the organization’s current bylaws. Neither is published on the Gerber/Hart website, and Sendziak has not provided such information.

Windy City Times posed the following questions to Sendziak Jan. 27:

—What is your official title with Gerber/Hart? Is it a compensated role? If you are board president, how long have you served in that capacity?

—Are there any compensated positions within the organization? If so, who are they and what are their salaries?

—Who are the current board members and what are their titles?

—Did Gerber/Hart file a 990 form for 2010? If so, please provide a copy.

—When did Gerber/Hart decide to move and did the board vote on this decision?

—Why is Gerber/Hart moving?

—Is the library purchasing property or renting?

—How many dues-paying members does Gerber/Hart have? Are these all voting members?

—When was the 2011 annual meeting?

—When was the last election of board members?

—Please provide the most current copy of the bylaws.

—What is the agency’s current bank balance?

—What are the anticipated costs of the move?

Sendziak wrote back Jan. 30: “Our legal counsel is out of the country. Once our attorney returns, we will obtain guidance from our attorney as to how to proceed in answering your inquiries.”

Few seem to know much of anything about the organization’s workings since 2009, including the names of current board members. In nearly two dozen media inquiries sent regarding the library, no source was able to name a board member beyond Sendziak. It is further unknown when the organization had its last annual meeting and board elections.

The library, the Midwest’s largest LGBT library, has been a fixture in Chicago’s LGBT community for more than 30 years. It opened in 1981 in a basement on Sheffield Avenue and later moved to a storefront on Paulina Street before landing in Edgewater.

It houses a significant portion of LGBT community’s historical documents and artifacts in its archives, which have been donated by community members. Over the years, many LGBT leaders have served on the Gerber/Hart’s board and served as its president. The space has also hosted numerous community events, local organizations and held its own programs and book clubs.

Many credit Sendziak with keeping such activities alive, while others lament that space has not been made for others within the organization.

What is clear about Gerber/Hart is that community concern for the organization runs deep.

Jennifer Brier is professor of history and gender studies at University of Illinois-Chicago and co-curated the Chicago History Museum’s Out in Chicago exhibit. She said that archives like those housed at Gerber/Hart are vitally important to the community.

“Chicago is pretty unique in its longstanding commitment to recording, preserving and interpreting the queer past,” Brier said. “And archives like Gerber/Hart are critical to that effort.”
