<p>The Health insurance reform debate has taken a very interesting turn over the last few weeks, with one of the core areas of controversy being the inclusion of a &#8220;<a target="_blank" href="http://belowthebeltway.com/2009/09/09/obamas-speech-no-ultimatum-on-public-option/">Public Option</a>&#8221; framework imposed by the Federal Government. This provision, opens an avenue or &#8220;option&#8221; for individuals, small businesses and the self employed to access cheaper health insurance through government programs. But is it really worth the effort??</p>
<p><a target="_blank" title="State run public health insurance option" href="http://online.wsj.com/article/BT-CO-20091006-713614.html" target="_self">Patrick Yoest of Dow Jones Newswires</a>, reported that &#8220;U.S. Senate moderates on Tuesday praised a proposal to allow states to establish public health-insurance plans as part of health-care legislation, giving it a boost as a possible alternative to a public plan run by the federal government.&#8221;</p>
<p>The significance of this compromise will be that each State will have &#8220;authority to set up their own health-insurance plan or a non-profit &#8220;co-op,&#8221; or to allow their residents to enroll in that state&#8217;s employee health benefits plan.&#8221; This will open doors for new types of <a target="_blank" title="Joint Venture Strategy " href="http://www.bioanswers.com/joint-venture-strategy/" target="_self">joint venture strategy</a> and partnership between States and small business, an enticing proposition in these challenging times.</p>
<p>Susan Ferrechio, Chief Congressional Correspondent at the <a target="_blank" title="Washington Post" href="http://www.washingtonexaminer.com/politics/Senate-looks-to-redefine-_public-option_-to-ease-passage-8345936-63555817.html" target="_self">Washington Examiner</a>, on October 6th, reported on the approach now being presented and circulated among law makers of a &#8220;trigger-induced public option, or a system of state-run health insurance plans,&#8221;&nbsp; but also indicated that these proposals were &#8220;not guaranteed&#8221;</p>
<p>The critical question to be asked however by small businesses need to ask is will these changes ultimately lead to lowering health insurance costs to your business?&nbsp; Familiarity with the health insurance debate and the opening of&nbsp; a broader or different definition of what the &#8220;public option&#8221; structure will be and how it will be included in the range of private health insurance programs, should answer that question over the long run.</p>
<p>The challenge here is to formulate a system with a public and private health insurance mix that benefits as many of the interests as possible without facilitating the spiraling health insurance costs that the nation is saddled with.</p>

<p>What you <strong>DON&#8217;T</strong> want to do, when looking to buy small business health insurance for you and your employees, is buy the first group or small business health insurance plan that you come across.  Different health insurance companies offer different insurance plans and at different prices.</p>
<p>To prevent yourself from wasting your money and the money of your employees, you will want to make sure that you carefully choose which group or small business health insurance plan you purchase.  You will want to purchase one that is affordable, but you also want to make sure that it is a plan that you and your employees can benefit from.  In fact, if you have less than thirty or so employees, you may want to think about allowing your employees to have some say in the type of insurance purchased, especially since they will invariably end up helping you pay for it.</p>
<p>Once you have decided to purchase a small business health insurance plan, you will be given additional information,  such as when your insurance premium payments are due, the scope of the plan, what deductibles are available and so on.  It&#8217;s very important to know how the health insurance company requires their payments, whether in advance, at the beginning of each year for example, quarterly or monthly payments.  Whichever approach you take, it is important that your payments are made on time,</p>

<p>As several states are experiencing a fall in unemployment rates, the overall national average paints a bleaker picture, as it is starting to slowly rise, causing an array of social and economic problems for the ordinary citizen, most notable of which is health insurance.</p>
<p>There are more than 1.69 million Americans unemployed currently.  This number is awful and means that more Americans are slowly being put on state aid and draining society of invaluable resources which could otherwise be spent on education or health care provision.  This strikes at the core of the budget for the states, which are spread very thin as it is across all the required public departments.</p>
<p>As the economy continues to be very shaky and with numerous major corporations going under due to mismanagement in recent years; there has seen a spike in the number of companies who are crashing on the stock market, meaning jobs have disappeared, wages slashed, and health insurance and other job benefits significantly compromised.  Couple this with the fact that the inflation rate is rising, the minimum wage is the same, and you are looking at a very bleak outcome for the financial future of America and its people.  Something has to be changed now in order to reinvigorate our economy and our people.</p>
<p>Many people are able to enjoy comfortable lifestyles while many others are left with jobs that pay minimum wage, or barely over.  Many Americans are busy working 40 hours plus a week and barely struggling to make enough to cover the bare essential bills.  It is a tragedy the way the economy is functioning; with a great number of people getting richer, those who are financially struggling are continuing to struggle in a perpetual cycle of debt and poverty</p>
<p>The interest rates have hit all time lows, which has resulted in an enormous number of people purchasing their first homes.  This has increased the number of people moving from rentals to the homeownership world.  However, this has a price, owning a home is never cheap; the expenses must be paid somehow, and this is taking its toll on the already tightened purse strings of most Americans.</p>
<p>The biggest problems with the economy are the lack of jobs over all. There are several major companies all across the country who are being courted by cities all around for new plants and factories to be built in their area so that an abundance of jobs would be available.  These plants are few and far between, leaving the rest of the citizens without a job, and trying desperately to grapple over the few minimum wage jobs available that offer 10-20 hours a week.  If more was done to encourage big business to provide work domestically, this would at least work some way towards improving the lives of many Americans. Likewise if more opportunities were created for small business, the job creation process would begin to grow.</p>
<p>How important is the process of developing new federal legislation that addresses job creation strategies at the State level cannot be under estimated. The Health insurance and health care reform debate can actually provide new opportunities in the health sector. From simple activities such as the manual requirements of document management to landscaping and supply of a myriad of other support services, the creation of jobs at a reasonable pace over the coming years would be expected.</p>
<p>How to actually overcome these problems and implement solutions is something that many politicians are faced on a daily basis.  The residents of their areas are forced to seek guidance and attempt to make changes for the better in order to improve the quality of life for everyone.  People are always seeking ways to improve and better the economy, yet one of the biggest economic flaws is the national minimum wage staying the same for so many years, while the inflation rate has steadily risen.</p>
<p>The issues of new jobs, better benefits, higher pay, and more hours are always brought up in almost every state at political executive meets.  Some states are in a very fortunate position where they are not forced to worry about the unemployment rates, they have managed to find a recipe for success and have lowered the unemployment rates to cater for the needs of their populous.  If the nation as a whole can lower the rates, we will be moving towards some much-needed economic improvement, and the knock-on social benefits this brings through reduced crime and improving quality of life, i.e. shelter, health care etc  for the citizens of America all round.</p>

<p>Federalism is a legal and political concept suggesting that law is best made in a twofold relationship: centrally and locally with the current <strong>Health insurance</strong> and Health care reform debate, a perfect example of the process.  Operative in many nations around the world under many different guises, federalism is centered on the principle that locality is key to effective governance.  It holds that by making laws at a local level, the legislators can take advantage of local knowledge and opinion, whilst also lightening the load centrally for governance on the wider ranging issues.</p>
<p>This is not only bureaucratically significant, but also politically in the sense that those in power through the majority of local areas will assume power overall, creating fairer representation. Ultimately, in theory, federalism satisfies the will of the people more accurately than a purely central system of governance.  In this article, we will discuss the main advantages of federalism as a legal order, using the current Health Insurance and Health care reform debates as an example of the process. We&#8217;ll also discuss the main reasons for Federalism growing popularity and strength across the world.</p>
<p>The first argument put forward for a federalist legal order is that a central government is too cumbersome when it comes to legislating over region specific matters. The series of town hall style debates on Health insurance and health care reform, that are occurring across the US, typifies this process. This debate, opens an opportunity for consensus based reform, which can then be implemented by the Federal government. In a second example, the UK government in London was often required to legislate on agricultural and fisheries matters that related to issues over 1,000 miles away in the North of Scotland.  In this scenario, it would be unrealistic to expect the central government to have the requisite local knowledge and understanding required to make an effective decision for the prosperity of the region.  In this sense, it is argued that a federalist legal order is more desirable, on the basis of making &#8217;small time&#8217; decisions that affect specific localities with which it is acquainted.  This has proven to be one of the strongest features of the federalist system, which largely relates to local people and their specific needs, and engages in political and legal decision making &#8216;closer to home&#8217;.</p>

<p>Another very strong argument in favor of federalism is the fairer representation afforded by local and regional government. As an example, in the US <a target="_blank" href="http://www.usconstitution.net/consttop_fedr.html">reserved powers</a> are those that have been reserved specifically for the states or are of a traditionally state scope. These consist primarily of police powers, such as providing fire and police protection, determining health regulations, licensing, zoning and education. More broadly speaking in the UK there is a left wing political party (Labour) and a right wing political party (Conservative) &#8211; much the same way as the Democrats and Republican parties operate in the US. In the UK, the Conservative party have a strong hold over the South East of England, which makes up a sizeable proportion of the population although covers limited geography.  Labour have a traditional stronghold in Scotland which accounts for one third of the land mass but only one tenth of the population.  In this sense, federalism would provide a fairer system of representation by allowing regional governance that could account more easily for local tastes and opinions and provide an altogether more representative picture of the nations political favor.</p>

<p>On top of these reasons, federalism lightens the load as respects central parliamentary time, freeing up national level politicians to consider more strategic rather than operational matters.  This frees up resources and streamlines the process overall, although it does bring with it the complexities of an additional layer of authority and therefore raises issues for individuals and small business alike.  However, provided the legal system is well structured and defined in a codified form, federalism can make for more efficient governance and an overall fairer political and legal system, as well as bringing a host of other governmental and internal benefits to the table. A very well presented report entitled &#8220;<a target="_blank" href="http://content.healthaffairs.org/cgi/reprint/19/4/7.pdf" target="_blank">Early Experience With ‘New Federalism’ In Health Insurance</a>&#8221; published by the The People-to-People Health Foundation, Inc., provides a candid look at just how State and Federal legislation transformed health insurance regulation in the US. The implementation created small business opportunities within local and state boundaries, a positive outcome of this type of approach to governance.</p>

<p>Federalism has grown in popularity over the last century or so, and this is largely down to its particular successes throughout the world.  Much the creation of academic thinking and commentary, federalism brings about a system of governance that keeps the people happy, promotes local affairs, and leads to significantly more favorable governance nationwide.  For these reasons, it is quickly becoming the favored method of government worldwide, and has been adopted in centralist countries and larger regions alike to promote and maintain the diversity necessary for effective regulation at a national level.</p>

The article entitled <strong>“The Five Biggest Lies in the Health Care Debate”</strong> reviewed five lies that have been circulating the internet on Health care reform. Written by Sharon Begley, it speaks directly to some of the more troubling issues that as a self employed individual or small business owner we need to be familiar. The five issues raised are below.</p>
<p><strong>1.	You’ll Have No Choice in what Health Benefits you receive</strong><br />
Apparently the House Bill has a provision for a health care exchange. Basically this exchange is a list of private insurers and one government plan, where people without health insurance through their employers or other sources such as <a target="_blank" class="zem_slink freebase/guid/9202a8c04000641f80000000001ab164" href="http://en.wikipedia.org/wiki/Small_business" title="Small business" rel="wikipedia">small businesses</a>, can shop for a plan. This is similar to how seniors shop for a drug plan under <a target="_blank" class="zem_slink freebase/guid/9202a8c04000641f800000000006f9e9" href="http://en.wikipedia.org/wiki/Medicare_%28United_States%29" title="Medicare (United States)" rel="wikipedia">Medicare</a> Part D.</p>
<p><strong>2.	No Chemo for older Medicare Patients</strong><br />
This issue goes to the heart of, what people are calling the rationing scare. The problem stems from the fact that since no plan currently covers everything, the way in which insurance companies make coverage decisions is opaque. Making or calling for cost-effectiveness research, in which Medicare decides on whether or not a 70 year old cancer patient will receive “only end-of-life counseling and not chemotherapy” is not a part of the House Bill and particularly the word ration is not used.</p>
<p><strong>3.	Illegal Immigrants will get free Health Insurance</strong><br />
The House Bill states that “individuals who are not lawfully present in the United States will not be allowed to receive subsidies” </p>
<p><strong>4.	Death Panel’s will decide who lives</strong><br />
There is a provision in the House Bill that allows Medicare to make available resources to cover &#8220;optional counseling on end-of-life care for any senior who requests it&#8221;.  This suggests that individuals would not be forced to make that decision thus expanding the current scope of current Medicare support to seniors.</p>
<p><strong>5.	The Government will set doctor’s wages</strong><br />
In a nutshell, &#8220;Nobody is saying we want the doctors working for the Government; that&#8217;s completely false&#8221;. Response given by Amitabh Chandra, professor of public policy at Harvard&#8217;s Kennedy School of Government to the claim that Government will set doctor&#8217;s wages. There is however a provision on page 127 of the House Bill that says that physicians who choose to accept patients in the public insurance plan would receive 5% more for than Medicare pays for a given service, but doctor&#8217;s have the option to refuse those patients. More important though is the fact that although doctor&#8217;s can participate in the public health insurance plans, they are not salaried employees to these plans.</p>

People are unable to get medical coverage easily and desperate times can drive many people to take very desperate measures. The uncertainty in what health insurance for self employed individuals, small businesses and individuals will look like in the future, has further compounded the issue.<br />

<p>Unless you have a medical condition, you could keep your health insurance card in your wallet or purse and rarely ever use it. You might not even notice if it happened to disappear. </p>

The complications it can cause can threaten your life, the life of your loved ones, your business and so on. Blood types can be changed, diagnoses you never actually got can be put into your records and much more very scary things could happen.
