Rule-17
17.1 The authorised bank may credit the pension amount of non-resident to a non-resident(ordinary) account opened/maintained as per provision of the Exchange Control. The amount of pension of a pensioner who has become non-resident may be credited to the said account after ensuring the personal identification and other requirements as stipulated under the Scheme (Para 12).
* In case of NRI pensioners / family pensioners who are unable to come to India for personal identification may be allowed pension / family pension on the basis of a certificate to be issued by an authorised official of the India Embassy / High Commission of India or Consul of India consulate in the country where the pensioner is residing. This certificate is to be issued on verification of Pensioner / Family Pension on the basis of photograph pasted in the PPO or on the basis of photograph pasted on the Passport or any other such document.

17.2 In case of the existing accounts, the pensioner should intimate the fact that he has become non-resident Indian to the pension paying branch in India and on receipt of the same the paying branch in India should convert the account of the pensioner to Non-resident Ordinary (NRO) Account.
17.3 The pensioner has to furnish the life certificate issued by an authorised official of the Embassy/High Commission of India or Consul of Indian Consulates or a Notary Public or an Officer of an Indian Authorised Bank attached to its branch in the country where the pensioner is residing, once in a year, in November.
17.4 The pensioner has to furnish other certificates viz. non- employment/re-employment certificate, Re-marriage/Marriage certificate as prescribed in the pension scheme (Annexures XVIII & XXVI) (Page 45 & 55).
17.5 The paying branches will credit the amount of pension due every month to the Non-resident Ordinary Account of the pensioner.
17.6 Withdrawals from the Non-Resident Ordinary Accounts will be governed by the instructions contained in the Exchange Control Manual and the paying branch should allow the withdrawal accordingly.
17.7 Pension credited to the Pensioner's Non-Resident (Ordinary) Account may be remitted by the bank to the Pensioners outside India, in case the Non-Resident Pensioner so desires, by debit to his NR (O)Accounts either by direct remittance or by credit to his NR(E) Accounts.

17.8 The paying branch should return PPOs of such Non-Resident Indian pensioners who are drawing pension from them and are unable to furnish the prescribed life certificate to the pension sanctioning authority for arranging future payments to them.

Procedure for Transfer of Pension Payment from Branch/ Bank to another:

16.1 Applications for transfer of pensions may fall under the following three categories:

(a) transfer from one paying branch to another of the same AB within the same station or at a different station;

(b) transfer from one AB to another within the same station (such transfers to be allowed only once in a financial year); and

16.2 Request falling under category (a) above may be entertained by the AB itself. In case transfer is at the same station, Link Branch will make necessary entries in the register maintained by them in the form in Annexure VIII (Page 33) and forward the disburser's portion of PPO to the paying branch at which payment is desired under intimation to the Central Pension Accounting Office and the Pensioner. In case the transfer is at different station, Link Branch after keeping the requisite note will forward disburser's portion of the PPO to the Link Branch at new station for arranging payment through the new paying branch. Necessary intimation of affecting such transfer will be sent to CPAO by the new as well as old link branches in the form as at Annexure XXI (Page-49) for keeping a note of change in their records under intimation to the pensioner. The receiving Link Branch on receipt of the pension documents will ensure forwarding the PPO to the paying branch within three days and intimate the pensioner simultaneously as stipulated in para 10.1 above. Before forwarding the disburser's portion of PPO to the new paying branch/link branch, it will be ensured that the month up to which the payment has been made is invariably indicated in the disburser's portion of PPO.

16.3 (a) In cases falling under categories (b) & (c) above, when a pensioner applies for transfer on a simple sheet of paper the old bank (transferee paying branch) will send a letter duly signed by its Branch Manager to the Branch Manager of the new paying branch, wherever located, along with photocopy of the pensioner's PPO showing the last payment made. This will be sent by Speed-post/Courier/ Regd. post to the new paying branch at the new location, along with a copy each to the pensioner, CPAO and for information to the Link Branch of the old paying branch. Simultaneously, the old paying branch will send the Bank's copy of the PPO to its Link Branch, duly completing all entries for transmission to the new Link Branch. However, pensioner's copy of PPO will be retained by pensioner and produced at the new paying branch.

(b) The new paying branch will commence the pension payment immediately on receipt of letter of the last payment certificate as at (a) above. Simultaneously, it will send intimation to its Link Branch with full details of the commencement of the pension. The old paying branch and its Link Branch will ensure that the bank's copy of PPO is transmitted to the new paying branch through its Link Branch.

(c) Pension will be paid for 3 months on the basis of the photocopy of the pensioner's PPO at transferee (New) branch, from the date of last date of payment made at the transferee (Old) branch. During this time, it will be the joint responsibility of both transferee (Old) and transferee (New) bank branches to ensure that all the documents, under the procedure, are received by the transferee (New) branch within the period of 3 months.

16.4 To avoid the risk of overpayment at the time of transfer, the following certificate may be recorded on the Disburser's portion of the PPO by the paying branch of the AB:

"Certified that payment of pension has been made up to the month of ................ and that this PPO consists of ............... continuation sheets for recording disbursement."

16.5 Except as provided above, the transfer of a pension from one payment point to another will not ordinarily be permitted.

Special disability leave for accidental injury:

(1)The provisions of Rule 44 shall apply also to a Government servant whether permanent or temporary, who is disabled by injury accidentally incurred in, or in consequence of, the due performance of his official duties or in consequence of his official position, or by illness incurred in the performance of any particular duty, which has the effect of increasing his liability to illness or injury beyond the ordinary risk attaching to the civil post which he holds.
(2) The grant of special disability leave in such case shall be subject to the further conditions :-
(i)That the disability, if due to disease, must be certified by an Authorized Medical Attendant to be directly due to the performance of the particular duty;
(ii)that, if the Government servant has contracted such disability during service otherwise than with a military force, it must be, in the opinion of the authority competent to sanction leave,
exceptional in character’ and
(iii)that the period of absence recommended by an Authorized Medical Attendant may be covered in part, by leave under this rule and in part by any other kind of leave, and that the amount of special disability leave granted on leave salary equal to that admissible on earned leave shall not exceed 120 days.

Payment of cash equivalent of leave salary in case of death, etc., of Government servant:

In the event of the death of a Government servant while in service or after retirement or after final cessation of duties but before actual receipt of its cash equivalent of leave salary payable under Rules 39,39-A and 39-B, such amount shall be payable-
(i) to the widow, and if there are more widows than one, to the eldest surviving widow if the deceased was a male Government servant, or to the husband, if the deceased was a female Government servant;
EXPLANATION.- The expression “eldest surviving widow” shall be construed with reference to the seniority according to the date of the marriage of the surviving widows and not with reference to their ages;
(ii) failing a widow or husband, as the case may be, to the eldest surviving son; or an adopted son;
(iii) failing (i) and (ii) above, to the eldest surviving unmarried daughter;
(iv) failing (i) to (iii) above, to the eldest surviving widowed daughter;
(v) failing (i) to (iv) above, to the father;
(vi) failing (i) to (v) above, to the mother;
(vii) failing (i) to (vi) above, to the eldest surviving brother below the age of eighteen years;
(viii) failing (i) to (vii) above, to the eldest surviving unmarried sister;
(ix) 1[failing (i) to (viii) above], to the eldest surviving widowed sister;
1(x) [failing (i) to (ix) above, to the eldest surviving married daughter; and
(x) failing (i) to (x) above, to the eldest child of the eldest predeceased son.]

Special disability leave for injury intentionally inflicted:

• The authority competent to grant leave may grant special disability leave to a Government servant (whether permanent or temporary) who is disabled by injury intentionally inflicted or caused in, or in consequence of the due performance of his official duties or in consequence of his official position.
• Such leave shall not be granted unless the disability manifested itself within three months of the occurrence to which it is attributed and the person disabled acted with due promptitude in bringing it to notice:
Provided that the authority competent to grant leave may, if it is satisfied as to the cause of the disability, permit leave to be granted in cases where the disability manifested itself more than three months after the occurrence of its cause.
• The period of leave granted shall be such as is certified by an Authorized Medical Attendant and shall in no case exceed 24 months.
• Special disability leave may be combined with leave of any other kind.
• Special disability leave may be granted more than once if the disability is aggravated or reproduced in similar circumstances at later date, but not more than 24 months of such leave shall be granted in consequence of any on disability.
• Special disability leave shall be counted as duty in calculating service for pension and shall not, except the leave granted under the proviso to Clause (b) of sub-rule(7), be debited against the leave account.
• Leave salary during such leave shall:-
(a) for the first 120 days of any period of such leave, including a period of such leave granted under sub-rule (5), be equal for leave salary while on earned leave;
(b) for the remaining period of any such leave, be equal to leave salary during half pay leave:
Provided that a Government servant may, at his option, be allowed leave salary as in sub-rule (a) for a period not exceeding another 120 days, and in the event the period of such leave shall be debited to his half pay leave account.
NOTE :- Leave salary in respect of special disability leave granted to a Government servant who has rendered service under more than one Government may be apportioned between the Governments in accordance with the normal rules.
• In the case of a person to whom the Workmen’s Compensation Act, 1923 (8 of 1923), applies, the amount of leave salary payable under this rule shall be reduced by the amount of compensation payable under Clause (d) of sub-section (1) of Section 4 of the said Act.
• In the case of a person to whom the Employees’ State Insurance Act, 1948 (34 of 1948), applies the amount of leave salary payable under this rule shall be reduced by the amount of benefit payable under the said Act for the corresponding period.
• (a)The provisions of this rule shall also apply-
(i) to a civil Government servant disabled in consequences of service with a military force, if he is discharged as unfit for further military service, but is not completely and permanently incapacitated for further civil service; and
(ii) to a civil servant not so discharged who suffers a disability which is certified by a Medical Board to be directly attributed to his service with a military force.
(b) In either case, any period of leave granted to such a person under military rules in respect of that disability shall be reckoned as leave granted under this rule for the purpose of calculating the period admissible.

Maintenance of Service Books as per DDO Manual:

Maintenance of Service Books
The rules governing the maintenance of service books in respect of Government servants are contained in the FRs&SRs and the GFRs. Some important provisions of rules which should be kept in view while maintaining service books are mentioned in the ensuing paragraphs.
[SR 197]
A Service Book should be maintained by the Head of Office for every Government Servant (Gazetted and Non-Gazetted) holding a substantive post on a permanent establishment or officiating in a post or holding a temporary post likely to last for more than one year.
Custody of Service Books
[SR 198]

A service book shall be maintained for a Government servant from the date of his first appointment to Government service. It must be kept in the custody of the Head of the Office in which he is serving and transferred with him from office to office.

Attestation of Entries in Service Books
[Government of India decision (1) below SR 199 in the Swamy's Compilation of FRs & S Rs, Part 1 (7th Edition)]
The Head of Office can delegate, to a subordinate gazetted officer under him, powers to attest entries in the service books of all gazetted officers (except his own) for the maintenance of which he is responsible. The Head of Office should however scrutinize at least ten per cent of these documents every year and initial the same in token of having done so.
Entries of Foreign Service in Service Books
[SR 203]

If a Government servant is transferred to foreign service, the Head of his Office or Department must send his service book to the Pay & Accounts Officer who will return it after noting in it, under his signature, the order sanctioning the transfer, the effect of the transfer in regard to leave admissible during foreign service etc. On the Government servant's re-transfer to Government service his service book must again be sent to the Pay & Accounts Officer who will then note in it the fact of recovery of leave salary and pension contributions. No entry relating to the period spent on foreign service should be attested by any authority other than the PAO. This fact is ,however to be recorded by DDO in case of the merged DDO Scheme.

Leave Account
[Rule 15 of CCS (Leave) Rules]

A leave account shall be maintained for each Government servant (Gazetted or Non-Gazetted) by the Head of Office. Entries regarding leave in the leave account and the service book should be made distinctly and attested.

Nature of Entries in Service Books
[SR 199]
Every step in a Government servant's offical life should be recorded in his service book and each entry must be attested by the Head of Office or if he himself is the Head of Office, by his immediate superior. The Head of Office must see that all entries are duly made and attested and that the service book contains no erasure or over-writing, all corrections being neatly made and properly attested.

The entries regarding increments, and fixation of pay should be based on the Increment Certificates, and Pay fixation statements. The declaration of the Government servant electing the new scale of Pay and the statement showing the fixation of his initial pay in the relevant scale in support of the entry in the service book should be pasted in the service book.

The declaration of Home-Town for purpose of Leave Travel Concession duly accepted by the competent authority should be pasted in the service book.

Every period of suspension from employment and every other interruption in service must be noted promptly with full details of its duration and be properly attested.

Periodical Inspection of Service Books by the Govt. Servant Concerned
[SR 202]

The Head of Office should show the service book to each Government servant under his administrative control every year, and obtain his signature therein in token of his having inspected the service book. A certificate to the effect that he has done so in repect of the preceding financial year should be submitted by him to his next superior by the end of every September.
Entries regarding Date of Birth

The provisions of Rules 79 and 80 of GFRs should be observed with regard to the entry of the date of birth in the service book.

No alteration in the date of birth of a Government servant should be made except with the sanction of the Ministry/Department concerned of the Central Government, under which the Government servant is serving, provided :
(a) A request in this regard is made within five years of his entry into Government service
(b) It is clearly established that a genuine bonafide mistake has occured; and
(c) The date of birth so altered would not make him ineligible to appear in any School or University or UPSC examination in which he had appeared, or for entry into Government service on the date on which he first appeared at such examination or on the date on which he entered Government service.
Entries regarding verfication of service
(GFR 81)

(i) In the beginning of each year all the service books should be taken up for verification of service by the Head of Office in terms of Rule 81 of GFRs and a certificate in the following manner recorded therein over his signature :- "Service verified upto (date) from ........................the record from which the verification is made''.

(ii) If any portion of service cannot be verified from office records, the Head of Office should state distinctly that for the excepted periods (naming them) a statement in writing by the Government servant as well as a record of the evidence of his contemporaries ,is attached to the service book.

In case of transfer of Government servant, the Head of Office under whom he was originally employed should record the verification of service in respect of the whole period during which the Government servant was employed under him before forwarding the service book to the office where his services are transferred.

Providing certified copy of Service Book

A certified copy of service book may be supplied on payment of a copying fee Rs. 5/- to a Government servant who asks for it on quitting Government service, by retirement, discharge or resignation.
Note regarding receipts of nominations for pension/ DCRG & other important to entries
[Government of India Decision No. 1 below Rule 53 of CCS (Pension) Rules,1972]

A clear note should be made in the service book regarding the receipt of nomination for DCR Gratuity and Family Pension and related notices from the Government servant and where they have been lodged for safe custody.

The orders of the competent authority regarding the counting or otherwise of periods of extraordinary leave,or periods preceding breaks in service or qualifying service for pension should be obtained invariably at the very time the occasion arises and not later. Such orders should be noted in the service book.

General Provident Fund Account No. allotted to a Government servant (including any subsequent changes in the Account No.) should be entered on the right hand top of page 1 of his service book by means of a rubber stamp.

The Head of Office should ensure that necessary note of the membership of CGEGI Scheme has been made in respect of Government Servants who were in service on 1st November,1980 and who did not exercise the option to opt out of the scheme and those who joined the Government Service later.

The Head of Office should obtain from every Government servant who is a member of C.G.E.G.I. Scheme a nomination in Form 7/Form 8 as the case may be, countersign it and paste it in the Service Book. Whenever the nomination is revised by the Government servant, the fresh nomination should be similarly counter-signed and pasted.

The photograph of the Government servant should be pasted on the right side of page 1 of the service book.

Proper entries regarding medical examination of the Government servant at the time of appointment and attestation forms verifying antecedents and character etc. should be made at the appropriate place of the service book.

Deemed Suspension under Rule 10 (2) of the CCS (CCA) Rules, 1965 - Supreme Court decision in the case of Union of India Vs. Rajiv Kumar

1. Reference is invited to Rule 10 (2) of the CCS (CCA) Rules, 1965 which provides that a Government servant shall be deemed to have been placed under suspension by an order of the appointing authority with effect from the date of his detention, if he is detained in custody, whether on a criminal charge or otherwise, for a period exceeding 48 hours.
2. A question whether the order of suspension in a case covered under Rule 10 (2) of the CCS (CCA) Rules, 1965 has limited operation for the period of detention and not beyond it, was considered by the Supreme Court in the case of Union of India Vs. Rajiv Kumar (2003 (5) SCALE 297). Allowing the appeals of the Union of India in this case the Supreme Court has held that the order in terms of Rule 10 (2) is not restricted in its point of duration or efficacy to the actual period of detention only. It continues to be operative unless modified or revoked under Sub-Rule (5) (c) as provided in Sub-Rule 5 (a) of Rule 10 of the CCS (CCA) Rules, 1965.
3. Ministries/Departments are requested to bring the above ruling of the Supreme Court to the notice of all concerned so that the same is appropriately referred to in all cases where the question of validity of continued suspension after release from detention of a Government servant comes up consideration before the CAT, High Court or Supreme Court.

Acceptance of dowry by Government servants:

In this context, the provision contained in MHA OM No. 25/37/65-Ests.(A), dated 30.08.1965 is discussed below:
1. It is provided in MHA OM No. 25/8/57-Estt.(A) dated the 25th March, 1957, dowry should be regarded as a customary gift which a Government servant may accept without prior sanction and that subject to the provisions of the rules relating to gifts and transactions in immovable and movable property, all such gifts should be reported to the Government or other prescribed authority.
2. The matter has been reviewed in the context of the provisions contained in the Dowry Prohibition Act, 1961. Section 2 of this Act defines dowry as ‘any property or valuable security given or agreed to be given directly or indirectly by one party to a marriage to the other party to the marriage or by the parents of either party to a marriage or by any other person, to either party to the marriage or to any other person at or before the marriage as consideration for the marriage of the said parties, but does not include dowry or mahar in the case of persons to whom the muslim Personal Law (Shariat) applies’. For removal of doubts. Explanation I below Section 2 declares that ‘any presents made at the time of marriage to other party to the marriage in the form of cash, ornaments, clothes or other articles, shall not be deemed to be dowry within the meaning of the section unless they are made as consideration for the marriage of the said parties’. Persons who are guilty of giving or taking or abetting the giving or taking of dowry, or demanding any dowry, directly or indirectly from the parents or guardian of a bride or bridegroom, as the case may be, are liable to the punishments prescribed in Sections 3 and 4 of the Act. In the circumstances, Government servant should not give or take or abet the giving or taking of dowry; nor should they demand dowry, directly or indirectly, from the parents or guardian of a bride or bridegroom as the case may be. Dowry can, therefore, no longer be treated as ‘customary gift’ as has been stated in this Ministry’s OM of 25.03.1957 referred to in para 1 above (not reproduced). Any violation of the provision of Dowry prohibition Act, 1961 by a Government servant will constitute a good and sufficient reason for institution disciplinary proceedings against him in addition to such legal action as may be taken against him in accordance with the provisions of the Act.
3. Receipt of presents by Government servants at the time of their marriage in the form of cash, ornaments, cloths or other articles, otherwise than as consideration for marriage from relatives and personal friends will be regulated by sub-rules (2) of rule 13 of the Central Civil Services (Conduct) Rules, 1964. The receipt of such presents from persons other than relatives and personal friends, will be regulated by sub-rule (1) of rule 13 ibid read with sub-rule (3) thereof. Purchases of items of movable property for giving presents at the time of marriage will be regulated by rule 18 (3) of the Central Civil Services (Conduct) Rules, 1964, like other transaction in movable property.
This Ministry’s OM No. 25/8/57-Ests.(A) dated 25.03.1957 may be treated as cancelled.

Chit Funds/Life Insurance Policies/Fixed Deposits in Banks by Government servants-Clarification regarding:

Clarification sought by Shri John P on 26-09-2009, on the following points:
(i) Whether a Government servant requires permission of the Government for joining Chit Funds;
(ii) Whether a Government servant should report to or seek prior permission from the prescribed Authority for taking Life Insurance Policies; and
(iii) Whether a Government servant should obtain prior permission from the Prescribed Authority for making Fixed Deposits in Banks?
In this regard, the provision contained in Cabinet Sectt. (Government of India) DP&AR OM No. 11013/12/76-Estt. (A), dated the 4th October, 1976 are discussed below, parawise:

Para. 2
The subscriptions which a Government servant gives to a chit fund would be a transaction in movable property with-in the meaning of sub-rule (3) of Rule 18 of the CSS (Conduct) Rules, 1964. If the annual subscription to the chit fund exceeds the monetary limits, prescribed in Rule 18 (3) the Government servant has to report it to the prescribed authority under the aforesaid rule. Previous sanction of the Government would be necessary only if the Government servant concerned has official dealings with the chit fund and if it is not a registered chit fund company.
The amount that the Government servant may receive from the chit fund can be classified into two categories :-
(i) receiving the amount of the sum total of the contributions payable by all subscribers for any one installment less the discount or commission payable to the Chit Fund Company by bid before the expiry of the period upto which the subscription is to be made; and
(ii) receiving the amount at the time of maturity.

Para.2.2
As regards 2 (i) above, since the amount received by a subscriber from the chit fund by bid would be more than the amount subscribed by him and the difference will have to be made good by him by future subscriptions upto the total period of the chit fund, the amount received in such case would amount to a loan received from the Chit Fund Company. Since the Chit Fund Company is not a banking company and the provisions of the Banking Regulations Act, 1949, are not, therefore, applicable to such companies, the loan received from the Chit Fund Company as explained above, may be regulated under sub-rule (4) of rule 16 of the CCS (Conduct) Rules, 1964. As regards (ii) above, if the amount received from the Chit Fund exceeds the prescribed limits in sub-rule (3) of rule 18 ibid the Government servant has to report to the prescribed authority under that sub-rule because the amount received by him would not be exclusively the amount subscribed by him but will also include the commission payable by the Chit Fund Company.

Para. 3.1
As regards the second point in para 1 (ii), it is clarified that a Government servant need not obtain prior permission from the Prescribed Authority for taking a Life Insurance Policy. He should, however, submit a report to the Prescribed Authority, if the annual premium on an insurance policy exceeds the monetary limits laid down in Rule 18 (3) of the CCS (Conduct) Rules, 1964. If , in any case, the annual premium initially determined was less than the monetary limits prescribed in the aforesaid rule 18 (3), but on conversion, the annual premium exceeds the said limits, a report to the Prescribed Authority is necessary at that stage. When a Government servant receives the sum assured as survival benefit/on maturity of the policy, he need not submit any report in this regard.

A Government servant need not report to the Prescribed Authority the fact of his having taken an insurance policy, if the annual premium thereon is less than the monetary limits prescribed in rule 18 (3) of the CCS (Conduct) Rules, 1964. He should, however, submit a report to the Prescribed Authority at the time of receiving the sum assured as survival benefit/on maturity of the policy.

Regarding the point raised in para 1 (iii) it is clarified the Fixed Deposits in Bank or Deposits in a Savings Bank account made by a Government servant from out of his salary or of accumulated savings would not come within the purview of rule 18 (3) of the CCS (Conduct) Rules, 1964.

LTC - Advance to an Officer on Deputation

The following procedure may be followed for grant of advance for Leave Travel Concession to an officer on deputation who, immediately on reversion to his parent office, wishes to proceed on leave and to join the parent office on the expiry of such leave:-

(a) In the leave application of the reverting officer, the fact that he would be availing of the Leave Travel Concession during the period of leave would have been mentioned by him. The borrowing department may, while forwarding the leave application to the lending department for sanction, inform the latter department that in the event of leave being sanctioned, they would sanction advance to the extent admissible under, and subject to the conditions laid down in, this Ministry’s Office Memorandum No. 43/3/57-Ests.(A), dated the 1^st April, 1958. On receipt of intimation regarding sanction to leave, the controlling officer for T.A. purposes in the borrowing department, in respect of the officer availing of the Leave Travel Concession may sanction the advance and endorse a copy of the lending department, which will keep a watch on the adjustment of Leave Travel Concession advance.

(b) The procedure in (a) above may be made applicable in the event of the reverting officer applying for leave and intending to avail of, during the leave, the Leave Travel Concession himself or with any or all members of his family. If during the period of leave in question, any or all members of his family alone intend to avail of the concession and not the Government servant himself, even then the procedure at (a) above may also be made applicable.(c) The Leave Travel Concession advance granted by the borrowing department will be adjusted against the account of the department/office which is ultimately liable to bear the expenditure on account of the LTC availed of by the Government servant concerned and/or his family.

Prohibition on brining any political or outside influence in respect of matters pertaining to service under the Government

Rule 20 of the CCS (Conduct) Rules, 1964 provides that no Government servant shall bring or attempt to bring any political or other outside influence to bear upon any superior authority to further his interest in respect of matters pertaining to his service under the Government. Instructions have been issued from time to time bringing to the notice of all Government servants the aforesaid rule provisions. Instances have come to notice where individual Government servants have approached the Ministry of Urban Development (Directorate of Estate) for out of turn allotment of residential accommodation, or for a departure from the allotment rules through Members of Parliament, prominent persons, politicians etc. Since the allotment of Government accommodation to a Government servant is made only because of his service under the Government, such canvassing for out of turn allotment through MPs and other political persons etc. constitutes a violation of the provisions of Rule 20 of the CCS (Conduct) Rules, 1964. The Government servants are, therefore, advised to refrain from such practice. They should not bring or attempt to bring any political or other out side influence to further their interests in respect of matters pertaining to their service under the Government, including allotment of residential accommodation.

Subletting of Government accommodation – Departmental action against

The Hon’ble Supreme Court in its order passed on 29.11.1996 in Writ Petition No. 585/94 (S.S.Tiwari Vs. UOI & Others) had directed that disciplinary proceedings be initiated against the Government servants who sublet their accommodation allotted to them by the Government. It was also directed that the findings of the Directorate of Estates regarding subletting shall be binding on the disciplinary authority for the purpose of initiating the disciplinary proceedings. The relevant extract from the order of the Supreme Court is reproduced below :

"Rule 15-A has been inserted under the Central Civil Services (Conduct) Rules, 1964 by the Notification dated August 16, 1996 as published in the Government Gazette dated August 31, 1996. The said rule is as under :-

15-A. Sub-letting and vacation of Govt accommodation.

(1) Save as otherwise provided in any other law for the time being in force, no Government servant shall sub-let, lease or otherwise allow occupation by any other person of the Government accommodation which has been allotted to him.

(2) A Government servant shall, after the cancellation of his allotment of Government accommodation vacate the same within the time-limit prescribed by the allotting authority.

It is thus obvious that a Government servant who sub-lets the Government accommodation or otherwise allows occupation by any other person of the said accommodation, that would per se amount to misconduct. Even otherwise, keeping in view the shortage of Government accommodation and thousands of Government employees on wait list for years together (even today, according to Mr. Harcharanjit Singh, the wait list in certain types of houses is 20 years), the sub-letting of the Government accommodation by the Government servant for pecuniary gain is a grave misconduct. It is, therefore, obligatory for the disciplinary authority of the department concerned to initiate disciplinary proceedings against concerned Government servant under Rule 14 of the CCS (CCA) Rules, 1965. As soon as the allotment is cancelled by the Directorate of Estate on the ground of sub-letting, the disciplinary authority of the Department concern shall initiate disciplinary proceedings against the Government servant concerned. The findings of the Directorate of Estates regarding sub-letting shall be binding on the disciplinary authority for the purpose of initiating the disciplinary proceedings. Once the disciplinary proceedings are initiated, the procedure laid down under the CCS (CCA) Rules shall take its own course. Since the disciplinary proceedings in such cases would be initiated on a charge of grave misconduct, the competent authority may consider placing the delinquent Government servant under suspension."

2. All Ministries/Departments/Offices etc. are requested to bring the above ruling of the Supreme Court to the notice of all concerned under their control and to ensure that disciplinary proceedings are initiated against the Government servants in whose cases subletting of allotted Government residential accommodation has been established by the Directorate of Estates. It may be ensured that charge sheets are issued immediately in cases where persons are likely to retire shortly or those cases which are likely to become time-barred by virtue of the misconduct being more than four years old.

Contesting in elections to sports bodies etc

As the Ministries/Departments are aware, previous sanction of the Government in required as per Rule 15 (1) of the CCS (Conduct) Rules, 1964 for a Government servant to hold an elective office or canvass for a candidate or candidates for an elective office, in any body whether incorporated or not. Under Rule 12 of the CCS (Conduct) Rules, previous sanction of the Government or of the prescribed authority is also necessary for a Government servant associating himself with raising of any funds or other collections in pursuance of any object whatsoever. It hardly needs to be emphasized that the entire time of the Government servant, particularly a senior officer, should be available to the Government and no activities unconnected with his official duties should be allowed to interfere with the efficient discharge of such duties. The need for curbing the tendency on the part of a Government servant to seek elective office in sports federations/associations at the national/state level has been considered carefully and it has been decided that the following principles should be followed while considering requests from Government servants for seeking election to or holding elective offices in sports federations/associations :-

(i) No Government servant should be allowed to hold elective office in any sports association/federation for a term of more than 4 years, or for one term whichever is less.

(ii) While seeking office (for which prior permission of Government should be obtained) or supporting the candidature of any person for election to sports bodies, a Government servant should not indulge in conduct unbecoming of a Government servant.

(iii) A Government servant must refrain from raising of funds or other collections from official as well as non-official sources for the promotion of sports at any level.

(iv) Prior clearance from the Government of India must be obtained for any travels abroad in connection with the work or other activities of any sports federation/association. While seeking such clearance, the officer must indicate the source of funding for the foreign trip including travel, hospitality and other expenses and when permitted to go, he must do so by availing of leave due and admissible to him.

Participation of Government servants in competitions/events organized by Private companies etc. with the objective of promoting their products

Instances have come to notice where Government servants participated in competitions and other social events organized by some private companies and organizations with the objective of promoting their business interests. Attention in this regard is invited to the provisions of Rule 15 of the CCS (Conduct) Rules, 1964 which provides, inter alia, that while a Government servant may undertake honorary work of a social or charitable nature or take part in sports activities as an amateur, he should not, except with the previous sanction of the Government, engage directly or indirectly in any trade or business or take part in the registration, promotion or management of any company or co-operative society etc. for commercial purposes.

2. The social events and competitions promoted by various private companies can be put into different categories;

(i) where the social events are organized purely with an intention to promote the business interests of the company and the competitiveness amongst the participants is not relevant;

(ii) where the competition by way of games and sports are sponsored by private companies and the spirit of the competitiveness amongst the participants is very much evident.

The nature of events referred to in item (i) above are quite distinct from those referred to in item (ii) as in the latter case, it is the competition or the event which remains in the forefront and not the sponsors and as such the involvement of the private companies as sponsors cannot be taken as solely for the purpose of promotion of their business interests.

3. The Government servants are advised not to take part in any competition or social event referred to in item (i) of para 2 organised by private companies or organizations, the primary objective of which is only to promote their business activities or their products, without the prior sanction of the Government. Such a participation without the previous sanction is liable to be construed as a violation of the provisions of Rule 15 of the Conduct Rules. However, the participation in the events referred to in item (ii) of the preceding para does not require any previous sanction of the Government.

Canvassing in support of business owned or managed by members of family

Under Rule 15 (1) (d) of the CCS (Conduct) Rules, 1964, no Government servant shall, except with the previous sanction of the Government, canvass in support of any business of insurance agency, Commission etc. owned or managed by any member of his family. Sub-rule (3), ibid, further provides that every Government servant shall report to the Government if any member of his family is engaged in a trade or business or owns or manages an insurance agency or commission agency.

2. The business of advertising agencies carried on by a member of the family of a Government servant besides other similar services, is thus covered under the aforesaid rules. A Government servant shall not, except with the previous sanction of the Government, canvass in support of any such business.

Sub-letting of Government accommodation by Government servants – Departmental action against

Where Government servants are found guilty of letting out the accommodation allotted to them by Directorate of Estates, action is taken against them under the provisions of Allotment of Government Residence (General Pool in Delhi) Rules, 1963. The question whether any departmental disciplinary action may be taken against such employees, apart from the action taken against them under the Allotment Rules, has been considered carefully. It has been decided that in all cases where a Government servant has been found guilty of letting out the Government residential accommodation allotted to him/her, the Directorate of Estates will intimate to the administrative authority concerned the details of the case and action taken against the employees under the Allotment Rules and the concerned disciplinary authority after considering the facts of the case may take suitable departmental disciplinary action under the disciplinary rules for imposition of a suitable penalty on grounds of unbecoming conduct of the Government employees involving violation of Rule 3 (1) (iii) of the CCS (Conduct) Rules, 1964 or any other similar rule governing them. Similarly, disciplinary action may be taken in those cases also where the accommodation in question is controlled by an authority other than the Directorate of Estates.

Confidential Report – Disclosure of identity of superior officers while communicating adverse remarks

Government have had under consideration the question whether the identity of the officer who recorded adverse remarks in the annual confidential report of a Government servant should be disclosed while communicating the adverse remarks to him. Cases have come to the notice of this Ministry where certain offices are reported to have disclosed the identity of the superior officer who made the adverse remarks while communicating them to the Government servant concerned. It is not necessary to disclose the identity of the Officer concerned since, what the Government servant should be interested in, are the defects/short-comings which his superior officers have found in his work and conduct and not the particular superior officer who recorded them in the confidential report and the representations on the remarks, if any, should be objective pertaining of short-comings noticed. Apart from this, disclosure of the identity of the superior officer is also likely to lead to unpleasantness and personal animosity. It is, therefore desirable that while communicating the adverse remarks to the Government servant concerned, the identity of the superior officer making such remarks should not normally be disclosed.

2. If, however, in a particular case, it is considered necessary to disclose the identity of the superior officer, the authority dealing with the representation may at his discretion allow the identity to be communicated.

3. In so far as persons serving in the Indian audit and Accounts Departments are concerned, these orders are issued after consultation with the Comptroller and Auditor General of India.

Guide Lines for Drafting:

Procedure for Drafting:

(1) No draft is required to be prepared in simple and straight-forward cases or those of a repetitive nature for which standard forms of communication exist. Such cases may be submitted to the appropriate officer with fair copies of the communication for signature.

(2) It is not always necessary to await the approval of the proposed line of action and the draft will be put up simultaneously along with the notes by the initiating level officer. The higher officer may revise the draft if it does not conform to the approved course of action.

(3) After a final decision is taken by the competent authority he may have the fair communication made for his signature and authorise its issue; otherwise, he will prepare a draft and submit it to the appropriate higher officer for approval.

The officer approving the issue of a draft will append his initials with the date on the draft. It is also expected of him that he passes orders on the file simultaneously whether the draft so approved should be kept on the file (along with the office copy of the communication issued in fair) or not.

Initial drafting will be done in black or blue ink. Modifications in the draft at the subsequent levels may be made in green or red ink by the officers so as to distinguish the corrections made.

General Instructions for drafting:

(1) A draft should carry the message sought to be conveyed in a language that is clear, concise and incapable of misconstruction.

(2) Lengthy sentences, abruptness, redundancy, circumlocution, superlatives and repetition, whether of words, observations or ideas, should be avoided.

(3) Official communications emanating from a department and purporting to convey the views or orders of the Government of India must specifically be expressed to have been written under the directions of Government. This requirement does not, however, imply that each communication should start with the phrase `I am directed to say' or `The undersigned is directed to convey', which has the effect of distancing the communicator from the reader at the very outset. A more direct and to-the-point format is to be preferred if some degree of rapport is to be established with the receiver of the communication. The obligatory requirement can be met in a variety of imaginative ways. For instance, variations of the phrase can be added to the operative part of the letter towards the end as under:

.......…….I have the pleasure to inform you that the government, on reconsideration of the matter, has decided to sanction an additional grant of........…….

…....…....In the light of the above developments, government conveys its inability to accede to.........……..

(4) Communications of some length or complexity should generally conclude with a summary.

(5) Depending upon the form of communication the subject should be mentioned in it (including reminders).

(6) The number and date of the last communication in the series, and if this is not from the addressee, his last communication on the subject, should always be referred to. Where it is necessary to refer to more than one communication or a series of communications, this should be done in the margin of the draft.

(7) All drafts put up on a file should bear the file number. When two or more communications are to issue from the same file to the same addressee on the same date, a separate serial number may be inserted before the numeral identifying the year to avoid confusion in reference, e.g., A-11011/5(I)/2001-Est., A-11011/5(II)/2001-Est.

(8) A draft should clearly specify the enclosures which are to accompany the fair copy. In addition, short oblique lines should be drawn at appropriate places in the margin for ready reference by the typist, the comparers and the despatcher. The number of enclosures should also be indicated at the end of the draft on the bottom left of the page thus-`Encl. 3'.

(9) If copies of an enclosure referred to in the draft are available and are, therefore, not to be typed, an indication to that effect will be given in the margin of the draft below the relevant oblique line.

(10) If the communication to be despatched by post is important (e.g., a notice cancelling a licence or withdrawing an existing facility) or encloses a valuable document (such as an agreement, service book or a cheque) instructions as to whether it should be sent through registered post or speed post or in an insured cover, will be given on the draft by the section officer concerned with its issue.

(11) Urgent communications with bulky enclosures to far-flung areas like Andaman & Nicobar Islands will be arranged to be despatched by Air Parcel through Indian Airlines. The addressee will also be advised through wireless to take delivery of the consignment. Instructions to this effect will be given by the Divisional Head/Branch Officer/Section Officer at the time of approval of draft.

(12) The name, designation, telephone number, fax number, and e-mail address of the officer, over whose signature the communication is to issue, should invariably be indicated on the draft.

(13) In writing or typing a draft, sufficient space should be left for the margin and between successive lines to admit additions or interpolation of words, if necessary.

(14) A slip bearing the words `Draft for approval' should be attached to the draft. If two or more drafts are put up on a file, the drafts as well as the slips attached thereto will be marked `DFA I', `DFA II', `DFA III' and so on.

(15) Drafts which are to issue as `Immediate' or `Priority' will be so marked under the orders of an officer not lower in rank than a Section Officer.

(16) Instructions contained in Appendix 7 will be observed while drafting.

Difference between Retail invoice and Tax invoice:

IF THE BUYER WANTS TO GET TAX CREDIT, THEN THE PARTY HAVE TO GIVE TIN NUBMER AND SELLER ISSUE TAX INVOICE OTHERWISE THE PARTY ISSUE RETAIL INVOICE. IN BOTH CASE THE PARTY HAVE TO PAY TAX ON GOODS. IN CASE OF OUT OF COUNTRY SALE OF GOODS, RETAIL INVOICE IS TO BE ISSUED. THE BUYER DOES NOT GET TAX CREDIT AND IN CASE OF TAX INVOICE THE SELER HAVE TO GIVE THE DETAIL OF TAX INVOICE IN THE FORM 201 AND SUBMIT TO THE RELATED TAX DEPARTMENT.

Scope of Internal Audit:

Internal audit is one of the internal control procedures that are to be followed by the various departments and employees of the organization.

The objectives and scope of internal audit cover the following:

-Verification of compliance with established policies.
-Verification of the effective operation of established systems and other controls.
-Verification of both fixed and current assets of the organization.
-Based on the above findings, suggest improvements in the system controls in order to plug the loopholes.

An internal audit manual indicating the scope of verification of each functional area within the organization is necessary so that the responsibility entrusted to the internal audit department is clear to the functional departments and external auditors also. Whether the controls as aforesaid are operating normally without breakdown of any system is to be observed by internal auditor. In judging the adequacy or otherwise of the internal audit functions, the following aspects need to be taken into consideration:

- Qualifications and experience of the internal audit staff.
- The level of the head of the department in relation to other departmental heads.
- The scope of internal audit is incorporated in the internal audit manual and its adequacy to the needs of the organization.
- Adequacy and competency of staff employed in the internal audit department.
- The frequency of reports issued to the departments and the following up till final recommendations are sent to the Chief Executive or Audit Committee.
- The coverage of internal audit in all areas as mentioned in the internal audit manual.
- Objectivity of the reports issued and the promptness with which the action taken by the company on such reports.

The cost auditor should go through the financial auditor’s observations before finalizing this item. Where there is no internal audit system in the company the cost auditor should advise for instituting internal audit considering the size, etc, of the organization. Thus in order to comment on the scope and performance of internal audit the statutory cost auditor should review the work of the internal auditor with special references to his competence, objectivity and work performance. The following questionnaire will enable the cost auditor to evaluate the work of the internal auditor as well as the internal audit department:

- What is the organizational step-up of the departments?
- Is the staff employed in the department adequate?
- Are the qualifications of staffs adequate?
- Is the staff competent?
- Is the staff independent?
- To whom do they report frequently and with what effect?
- Is there any internal audit manual?
- Is a program of internal audit drawn up before the commencement of the financial year?
- Does the program cover the audit of all the important transactions and records of the company including statutory cost accounting records?
- Is the scope of the internal audit wide enough to extend to areas such as management audit, operational audit and the system analysis?
- What is the system of reporting irregularities noticed during internal audit?
- Is prompt corrective action taken by the management on the basis of internal audit reports?
- Is there much duplication of work between the statutory audit and internal audit?

The cost auditor has to study and comment on the capacity utilization. While ascertaining such capacity it may be observed that due to bottleneck in some of the departments the production is suffering. The cost auditor should point out the matter to the company and obtain explanations from the management. He then will be in a position to suggest for improvement by rectification of general imbalance in production facilities. In a particular industry it may be observed that packing is the bottleneck. If more labour or improved machinery is available in the packing department the production can be increased to a great extent to cope with the demand.

Productivity is an index of efficiency showing the effectiveness of individual or combined factors used in producing goods or services. Men, machines, capital, power and services all contribute to productivity and the extent to which each does so may be ascertained by the ratio of output to input of each individual factor. Thus the factoral productivities such as labour productivity, material productivity, etc.. should be ascertained by the cost auditor. He should then evaluate the performance of men, machines or other services and compare the present productivity with the productivity of previous year. He will be in a position to suggest for improvement in performance by concentrating on areas offering scope for increased productivity.

The cost auditor should discuss with the management of the company to ascertain the key or limiting factors which may be one or more of the following:

- Absence of demand.
- Stiff competition or availability of cheaper substitutes.
- Non-availability of materials, skilled labour, machines, power etcc.
- Non-availability of transport facilities or infrastructures.

He after discussing with the management might suggest for profit maximization with the optimum use of such scarce resources with the help of linear programming, simulation, etc.. He should study the present inventory policy of the organization. He should examine whether the perpetual inventory system is in operation with due classification of materials by value. He should also see whether maximum, minimum and reorder levels are being fixed by the company and such levels are reviewed from time to time. He would compute stock turnover ration wherever possible. He would also see whether purchases are made following economic ordering quantity policy. He should discuss with the management if there are shortcoming in the inventory policy. This may help him to make suggestions for improvements in performance by improved inventory policies.

The cost auditor may give a qualified report where:

- He has not received any information or explanation, or
- A record has not been maintained as per cost accounting records, rules, or
- The record does not give the information in the manner required by law, or
- A true and fair view of the cost of production etc. is not reflected.

He should write to the company for furnishing information etc.. Where he is submitting a qualified report he should mention under this item the various points of qualifications and reasons therefore in addition to indicating these qualifications in the main certificate of the cost audit report. Where records relating to power generation are not maintained by the company the qualified report may be “Proper record required under the pertaining section of the companies act…” As per rules the cost records should be reconciled periodically, say monthly, quarterly or half yearly but at the end of the accounting year with the financial books of accounts so as to ensure accuracy of the data.

4.	A Central Civil post carrying a pay or a scale of pay the maximum of which is Rs.4,000 or less	Group D

Explanation:- For the purpose of this order –

‘Pay’ has the same meaning as assigned to it in F.R.9(21)(a)(I);
‘Pay or scale of pay’, in relation to a post, means the pay or the scale of pay of the post prescribed under the Central Civil Services (Revised Pay) Rules, 1997.
