Many personal injury cases are settled and never see trial. When a case fails to be settled by agreement between the parties however it will go before a judge and sometimes a jury. Unlike settlements and arbitration things can get unpredictable during a trial. The judge or jury will make the determination based on the evidence and their opinion will in fact rule the day regardless of agreement of parties.

Both plaintiff and defendant will try to meet the burden of a “preponderance of evidence” and each will get an opportunity to present their evidence before the court. In such cases not only will liability be determined but also the award of damages that will be paid.

YOU can expect a general progression during a personal injury case going to trial. First there will be jury selection (if the case will be utilizing a jury). That will be followed with opening statements from both parties. From there various witnesses will be called and both sides will get the opportunity to examine(ask questions of) the witness. In the case of witnesses who the other party brought the questions allowed is known as cross examining the witness.

Among those witnesses may be a special kind of witness known as expert witness who generally will be speaking to information analyzed from your case or to give some established information about something that relates to your case (although they were not present at the scene).

Finally closing statements will be heard and then deliberation time will be taken for the judge or the jury to determine who has “won” the case and what they “winner” should be awarded.
