The streaming giant is not taking this perceived threat lying down.

According to “a person close to the situation” Netflix is ”shopping questions related to data caps to the Senate Commerce Committee members in anticipation of tomorrow’s oversight hearing with all five FCC commissioners,” Comcast, AT&T and TWC apply usage caps to Netflix and other streaming services when usage gets too high, but exempt their own services, a practice Netflix feels is unfair.

Last week, Netflix argued the following in a lobbying call made to the FCC:

“Broadband caps should be applied fairly to all online video sources or eliminated entirely,”

Amazon took the same position last month in front of the Commerce Committee:

“Although internet subscribers should pay for the bandwidth they use, immutable or unrealistically priced data caps could hinder or prevent competitive products and services made possible by online video . . . Consumer choice, without impairment, must be preserved.”

The original series game is becoming increasingly popular as pay-TV and streaming companies seek to obtain and retain fickle viewers.

The new DirecTV series, entitled Rogue and starring Thandie Newton, goes into production this August and will premiere next summer. Netflix has already launched its own original series, Lilyhammer, and has several more in the wings, including a relaunch of the defunct Arrested Development. Hulu Plus has also jumped into original programming with the series Battleground.

In a few years, will the pay-TV and streaming/VOD landscape be littered with original content and a diminished offering of licensed studio titles?

Over the last year, however, Bewkes’ tone has gradually shifted away from the hard line rhetoric of the past and has become more reflective of the realities of today’s home entertainment market.

Case in point: in a recent appearance on Charlie Rose, Bewkes made several comments that hinted at a shifting attitude towards consumers. Discussing ways to keep the sales of packaged media such as DVDs and Blu-rays going in the face of kiosk rentals and VOD, Bewkes said the following (very uncharacteristic for him) comment:

“The bad news is [movies] may have to be cheaper,”

Bewkes also said that he still supports the theatrical distribution of movies, but can foresee an end to the traditional months-long gap between theatrical and disc release. The sticking point will be finding common ground between theater owners and content distributors:

“We can to do it in a way that doesn’t undermine the theater experience,”

So says Coinstar CFO Scott Di Valeri, whose company is parent to Redbox.

Speaking at a financial services conference today, Di Valerio stated that Warner’s seat at Redbox’s negotiating table is wide open if the studio would like to pick up talks where they left off a few months ago. Says Di Valerio:

“We always believe having good relationships and good distribution agreements with your partners is the right way to go . . . If Warner wanted to come back and talk we would have the conversation with them and see what it looks like.”

Warner and Redbox’s content agreement lapsed a few months back when the studio and the kiosk operator couldn’t come to an agreement regarding Warner’s demand for a 56-day delay of new release titles. Redbox implemented a workaround effort to keep its kiosks stocked with the most in-demand Warner titles—a strategy that seems to be working.

Di Valerio was quick to emphasize that the delay window is really the only point of contention between the two companies:

“We’re in it for the long haul doing the workaround for Warner product . . . We have an overall good relationship with Warner. We agree with them on 99% of the items for the most part. It’s really the length of delay that is the sticking point for us. It’s not like we are adversaries. We just have a disagreement on that one point.”
