The Indian parliament introduced the Surrogacy (Regulation) Bill 2016 with the aim of legalising altruistic and domestic surrogacy. The bill comes after a decade-long practice of commercial overseas surrogacy in India. The bill also aims to control the exploitation of surrogate child and mother for purposes that are unethical.

However, a major drawback of the bill is the fact that is does not protect a child’s interest. Surrogacy in India may never be the same.

The bill does not make mention of the most fundamental safeguard -- breast feeding for the surrogate child.
