पेसा (PESA) अधिनियम, 1996 :

पंचायत (अनुसूचित क्षेत्रों में विस्तार) अधिनियम 1996 जो पेसा के नाम से जाना जाता है, संसद का एक कानून है न कि पांचवीं एवं छठी अनुसूची जैसा संवैधानिक प्रावधान। वर्ष 1996 में "भूरिया समिति" के सिफारिशों पर संसद में "पंचायत उपबंध (अनुसूचित क्षेत्रोंं का विस्तार) विधेयक" प्रस्तुत किया गया एवं "पेसा अधिनियम" दोनों सदनों से पारित होने के बाद 24 दिसंबर 1996 को राष्ट्रपति की सहमति से हुआ।

यह कानून की तरह ही है जो संविधान की पांचवीं अनुसूची देश के 10 राज्यों में लागू है। ये हैं- आंध्र प्रदेश, तेलंगाना, छत्तीसगढ़, ओडिशा एवं राजस्थान। ये राज्य 10.4 करोड़ जनजाति लोगों में से 7.6 करोड़ लोगों को समावेशित करते हैं जो 2011 की जनगणना में गिने गए थे। इस प्रकार पेसा के अंतर्गत जनजातियों की 73 प्रतिशत जनसंख्या आ जाती है। दूसरी तरफ छठी अनुसूची में उत्तर-पूर्व का कुछ ही जनजाति क्षेत्र आता है, संपूर्ण उत्तर- पूर्व में जनजातियों की जनसंख्या मात्र 1.24 करोड़ है। इस प्रकार पेसा अधिनियम जनजातियों की बड़ी जनसंख्या को शक्ति प्रदान करता है।

पेसा अधिनियम का महत्त्व :

"पेसा" आदिवासी क्षेत्रोंं में अलगाव की भावना को कम करेगा।
भूमि के अवैध हस्तांतरण पर रोक लगेगी।
प्राकृतिक संसाधनों के नियंत्रण एवं प्रबंधन से आजीविका में सुधार होगा।
सार्वजनिक आबादी में गरीबी और पलायन कम हो जाएगा।
जनजातीय आबादी के शोषण में कमी आएगी क्योंकि वे ऋण देने, शराब की बिक्री, खपत एवं ग्रामीण हाट-बाज़ारों का प्रबंधन करने में सक्षम होंगे।
पेसा अधिनियम जनजातियों में रीति-रिवाजों और जनजातीय आबादी की सांस्कृतिक पहचान एवं विरासत को संरक्षित करेगा।

पेसा अधिनियम द्वारा ग्राम सभा एवं पंचायतों के अधिकार :

अनुसूचित जनजाति को दिये जाने वाले ऋण पर नियंत्रण।
सामाजिक क्षेत्र में कार्यकर्त्ताओं और संस्थाओं, जनजातीय उप-योजना और संसाधनों सहित स्थानीय योजनाओं पर नियंत्रण।
एक उचित स्तर पर पंचायतों को लघु जल निकायों की योजना और प्रबंधन का कार्य सौंपा गया।
एक उचित स्तर पर ग्राम सभा एवं पंचायतों द्वारा खान और खनिजों के लिये संभावित लाइसेंस, पट्टा, रियायतें देने के लिये अनिवार्य सिफारिशें करने का अधिकार।
भूमि अधिग्रहण, पुनर्वास और विस्थापित व्यक्तियों के पुनर्वास में अनिवार्य परामर्श का अधिकार।
भूमि हस्तांतरण को रोकना और हस्तांतरित भूमि की बहाली।
मादक द्रव्यों की बिक्री/खपत को विनियमित करने का अधिकार।
लघु वनोपज का स्वामित्व।
ग्रामीण हाट-बाजारों का प्रबंधन।

पेसा के कार्यान्वयन पर सबसे व्यापक दिशा-निर्देशों को 21 मई 2010 को जारी किए गए थे। दिशा - निर्देशों में राज्यों को निम्न सलाहें दी गई हैं (source : https://pesadarpan.gov.in/rules):

आदर्श (मॉडल) पेसा नियमों को अपनाना।
राज्य पंचायती राज अधिनियमों में पेसा के प्रावधानों के अनुरूप संशोधन।
खान एवं खनिज, लघु वनोपज, आबकारी, पैसा उधार देने, आदि पर कानूनों, नियमों, कार्यकारी निर्देशों में संशोधन
ग्राम सभा को सशक्त बनाना और ग्राम सभा द्वावा पालन करने के लिए 2 अक्टूबर, 2009 को जारी दिशा निर्देशों का अनुपालन ।
मिशन मोड के रूप में ग्राम सभा को सक्रिय करना।
पंचायत पदाधिकारियों (निर्वाचित प्रतिनिध एवं कर्मचारी) के लिए पेसा पर नियमित प्रशिक्षण का आयोजन।
पेसा के कार्यान्वयन की समीक्षा करने के लिए मुख्य सचिव की अध्यक्षता में एक अंतर-विभागीय समिति का गठन।
जनजाति सलाहकार परिषदों और जनजातीय अनुसंधान संस्थानों को सक्रिय करना।
पांचवीं अनुसूची क्षेत्रों में प्रशासनिक मशीनरी को मजबूत बनाना।
राज्य निर्वाचन आयोगों को ''गांवों'' को परिसीमित करने के लिए अधिदेश ।
वन अधिकार अधिनियम, 2006 में दी गई लघु वनोपजों की परिभाषा को सभी कानूनों और नियमों में शामिल करना।

क्या है CNT/SPT एक्ट 1908 :

CNT का मतबल छोटानागपुर काश्तकारी अधिनियम.

छोटानागपुर काश्तकारी अधिनियम 1908 और संथालपरगना में आदिवासी जमीन को अवैध तरीके से खरीद को रोकने के लिए अंग्रेजों द्वारा बनाया गया कानून था. परन्तु समय-समय पर इसमें संशोधन होते रहे हैं. हालांकि 108 साल पुराने सीएनटी एक्ट में अब तक लगभग 26 संशोधन हो चुके हैं. CNT एक्ट की धारा 46 के मुताबिक राज्य के छोटानागपुर और पलामू डिविजंस में ST/SC या OBC की जमीन सामान्य लोग नहीं खरीद सकते एवं इन जातियों पर भी बिना उपायुक्त की अनुमति के अपने ही लोगों को जमींन हस्तांतरित करने या बेचने पर पाबंदी है. वहीं दो आदिवासियों के बीच जमीन की बिक्री उपायुक्त की अनुमति से की जा सकती है बशर्ते दोनों एक ही थाना क्षेत्र के रहनेवाले हो एवं गलत तरह से जमीन हासिल करने पर IPC की धारा 463 और 466 के तहत दो से 7 साल तक सजा का प्रावधान है. साथ ही खरीदी हुई जमीन भी मूल रैयत को लौटानी होती है.

इतिहास

झारखंड का आदिवासी समाज मुग़ल शासन काल के अंत तक मुख्यत: कबिलाई समाज हुआ करता था, ब्रिटिश ज़माने में आकर कुछ-कुछ व्यकितगत या पारिवारिक सम्पत्ति दिखने लगी थी। सदियों से वे जो भी खेती- बारी करते थे, शिकार करते थे वह समाज के सभी सदस्यों में बांट दिया जाता था। जमीन पर व्यकितगत मालिकाना नहीं था,सामूहिक मालिकाना हुआ करता था। अर्थात् जमीन किसी एक व्यक्ति का नहीं अपितू पूरे कबीला या समाज की सम्पत्ति होती थी। आदिवासी समाज किसी भी राजा को कर या टैक्स नहीं देते थे। राजा के सेनापति या वरीय अधिकारी आने पर उसे कुछ भेंट या नजराना दे देते थे। इससे अधिक कुछ भी नहीं। जंगल पर आदिवासी समाज का स्वाभाविक अधिकार हुआ करता था। अकाल,सूखा, अभाव के दिनों में जंगल ही उनको सरंक्षण देता था। फल,कंद,मूल,पत्ते,पशु-पक्षी आदि के सहारे वे जीवित रहते थे। अभाव के बावजूद उनका जीवन सहज,निर्मल व आनंदमय था। शाल-सागवान के जंगल में, चांदनी रात में जब नगाड़ा और मांदर के थाप पर आदिवासी युवक -युवती नृत्य करते थे, वह एक नयनाभिराम दृश्य हुआ करता था। पर जब अंग्रेज इस देश में आये,उनके शासनकाल में सब रातोंरात बदल गया। प्लासी के युद्ध के बाद बंगाल, बिहार(झारखंड सहित ),ओड़िशा का इलाका ईस्ट इंडिया कंपनी के हाथों में चला गया। शासन का बागडोर हाथ में आते ही अंग्रेजों ने जमीन का सर्वे कराना शुरू किया। कहाँ कितनी ज़मीन है,मालिकाना किसके पास है इसका लेखा-जोखा तैयार किया जाने लगा। उद्देश्य था कहाँ से कितना टैक्स वसूला जा सकता है, इसकी पूरी जानकारी हासिल करना। आदिवासी समाज से जंगल का अधिकार छीन लिया गया। घोषणा कर दी गयी कि जंगल से मधू,फल,कंद,मूल कुछ भी नहीं लिया जा सकता।पशु -पक्षी का शिकार पर भी पाबंदी लगा दी गयी। इसका अर्थ था आदिवासी समाज को भुखमरी की स्थिति में पहुँचा देना। उन दिनों धान या दूसरे फसलों की खेती बहुत ही कम हुआ करती थी। जो भी फसल का उत्पादन होता था,वह भी सिंचाई,खाद,बीज आदि के अभाव में अति नगण्य मात्रा में ही होता था। इस स्थिति में जंगल, आदिवासी समाज के लिए ममतामयी माँ जैसा था। जन्म से लेकर मृत्यु तक हर एक रीति -रिवाज जंगल के शाल के पेड़ के नीचे ही आयोजित होता था।

अंग्रेजी हुकूमत स्थापित होने के बाद, ईस्ट इंडिया कंपनी के कर्मचारी के रूप में अन्य राज्यों से लोग आने लगे। अचानक सेठ-साहूकार-महाजनों की एक पूरी जमात तैयार हो गयी। थोड़ा बहुत पैसा उधार देकर पूरी की पूरी जमीन अपने नाम पर ये सेठ-साहूकार लिखा लिये। जमीन सर्वे के समय कहीं हड़िया पीलाकर,कहीं पर झूठा मुकदमा में फसाकर आदिवासियों की जमीन हड़पने का काम शुरू हुआ। पुलिस-महाजन-साहूकार-कंपनी की मिलीभगत से आदिवासी समाज अपनी ही जमीन में बंधुआ मजदूर की भांति काम करने के लिए मज़बूर होता चला गया। आदिवासी युवतियों को जबरन भोग्य वस्तु में तब्दील कर दिया गया। आदिवासी समाज क्षोभ, असंतोष और आक्रोश से उबल रहा था। यही आक्रोश ज्वालामुखी बनकर फूट पड़ा पहले बाबा तिलका माझी के नेतृत्व में सन 1784 में व हो विद्रोह के रूप में सन 1820 में। सिदो-कान्हू के नेतृत्व में सन 1855 में शुरू हुआ 'हूल ',जिसे हम संथाल विद्रोह के नाम से भी जानते है। सिर्फ तीर -धनुष से लैस आदिवासी लड़ाकों (जिसमें भारी संख्या में महिलाएं भी थी ) ने प्रशिक्षण प्राप्त व आधुनिक शस्त्रों से लैस ब्रिटिश फौज को कई मोर्चे पर परास्त किया। परंतु बाद में बाहर के राज्यों से विशाल ब्रिटिश फौज ले आकर इस विद्रोह को कुचल दिया गया। सैकड़ो आदिवासी वीर व वीरांगनाएं शहादत दी। पर ये शहादत बेकार नहीं गयी। इसी संघर्ष के मशाल को लेकर सन 1880 में शुरू हुआ सरदार विद्रोह और उसके बाद बिरसा मुंडा के नेतृत्व में उलगुलान।एक के बाद एक विद्रोह ने ब्रिटिश हुकूमत को झकझोर दिया। ब्रिटिश हुकूमत कितना भयभीत था वह इस बात से पता चलता है जब भारत के गवर्नर ने ब्रिटेन के सेक्रेटरी ऑफ स्टेट को पत्र लिखकर कहा कि 'हम बारूद की ढेर पर बैठे हुए है '

इसके बाद ब्रिटिश सरकार ने दो महत्वपूर्ण कदम उठाया। पहला, जो आदिवासी जनसमूह जमीन जायदाद खोकर सर्वहारा में तब्दील हो गया उन्हें असम व उत्तरी बंगाल के चाय बगानों में तथा उत्तरी व पूर्वी भारत के विभिन्न हिस्सों में रेललाइन बिछाने का काम देकर भेज दिया गया। यही आदिवासी मज़दूर बाघ,हाथी,सांप जैसे जंगली जानवर व मलेरिया, टाइफाइड जैसी गंभीर बीमारियों से लड़कर चाय बगान व रेलवे लाइन बिछाने का काम किया था। यहीं थे भारत के प्रथम भूमिहीन मज़दूर जिनके पास अपने दोनों हाथ अर्थात् श्रम के अलावा और कुछ भी नहीं था। मार्क्सवाद की परिभाषा में इन्हें ही कहा जाता है 'Wage Labour' या सर्वहारा वर्ग। गरीब आदिवासी जनसमूह को उनकी मातृभूमि से दूर भेजने का उद्देश्य यही था कि यदि वे अपनी मातृभूमि में रह जाए तो जरूर शोषण, जुल्म के खिलाफ एक के बाद एक विद्रोह होता ही रहेगा। इसलिए जहाँ तक हो सके इन्हें सुदूर प्रांतों में भेज दिया गया।

आदिवासियों के आक्रोश को शांत करने के लिए, आदिवासियों की जमीन,बाहर से आए सेठ-साहूकारों के पास न चला जाए। इसके लिए CNT Act (Chotanagpur Tenancy Act) छोटानागपुर क्षेत्र के लिए और कोल्हान क्षेत्र के लिए आया Wilkinson’s Rule और आज़ादी के बाद आया SPT Act (Santhal pargana Tenancy Act) संथाल परगना क्षेत्र के लिए,संविधान की 5th Schedule (पांचवी अनुसूची) और बाद में PESA कानून। परंतु धीरे -धीरे इन कानूनों में, विशेषकर सीएनटी एक्ट में बार-बार संशोधन किया गया। इस फैसले ने आदिवासी क्षेत्रों में पत्थलगड़ी की घटनाओं (Pathalgadi Movement) को जन्म दिया है जो वन अधिकार अधिनियम, 2006 और पंचायत (अनुसूचित क्षेत्रों तक विस्तार) अधिनियम, 1996 [Panchayats (Extension to Scheduled Areas) Act, 1996- PESA] के कार्यान्वयन की मांग की जा रही हैं।

The Motor Vehicle Department was put in existence under section 213(1) of the Motor Vehicles Act, 1988. The MVA, as it’s also known, is a central act that is enforced across the country. This department is responsible for making sure all the provisions under this act are enforced accordingly. It’s headed by the Transport Commissioner, who heads the RTO (Regional Transport Office) of every city. The RTO’s job is to make sure all the functions laid out by the Motor Vehicles Act, 1988 are carried out properly.

RTO is Regional Transport Office, which is, in essence, a bureau of the central Government that is responsible for the registration of vehicles. An RTO is located in every state and issues driving licenses and vehicle registration cards. Today, the RTO offices provide digitized cards in most states.
