Fortunately his injuries have turned out to be reasonably short lasting having resolved within two years, however at the time it was suspected he had fractured his spine.

Indeed, he was treated for a spinal fracture at the scene and subsequently although the X-rays taken at the time have been impossible to read.

In its response to a consultation on tougher regulations for the industry, The MoJ’s claims management regulator published new conduct rules, which will come into force this summer.

It will insist CMC’s can no longer refer to their status as being regulated by the MoJ, which had been construed by some consumers as government endorsement. In addition to this, they will also have to inform clients if they are suspended or have restrictions imposed within 14 days of the enforcement action being taken.

This ‘industry-wide crackdown’ will include enforcing new powers to prevent customers being offered a cash incentive to sign up to a CMC.

These rules have been put in place to root out poor practice and ensure that the consumers are better protected by making contract terms clearer so that they know exactly what the deal is before they part with any money. It is thought that the new rules will help to improve the reputation for the vast majority of CMC’s that do follow the rules and drive out malpractice.

A draft accession agreement was finalised on 5th April by negotiators for the EU and for the 47 Council of Europe signatories to the convention.

This breakthrough will bring EU laws under the jurisdiction of Europe’s human rights court in Strasbourg. This constitutes a major step in the development of human rights in Europe.

Individuals who feel their rights have been violated in one country and have exhausted all of the available domestic remedies can bring their case to the Strasbourg court.

With the vast majority owning an expensive smartphone or Blackberry, taking out cover to protect such a valuable item in case of theft or damage may seem like a sensible move, however, mobile phone users are wasting millions of pounds every year on insurance that doesn’t pay out.

The biggest problem is that people do not fully understand what they are covered for and think they have more protection than they actually do. Did you know most insurers won’t cover the cost of fraudulent calls? If your phone gets stolen and the thief racks up a huge bill – especially if they call overseas – you’ll be left to settle the bill if you fail to report your missing phone quickly enough. This is because phone insurance policies are littered with get-out clauses and loopholes.

Typically you must tell your provider within 24 hours, so it can block your phone from being used, and file a police report within 48 hours, but many people don’t realise their phone has been stolen so quickly and can unwittingly void their own claim.

Also, many policies won’t pay for water damage – which accounts to 15% of all claims. This means that if you get caught out in the rain or accidentally spill a drink over your phone, you’re more than unlikely to get a pay-out. Many also won’t cover any accessories you buy separately to your phone.

Another ‘small-print loophole’ the insurers exploit is that if you doze on a train with your phone next to you and find out it has been stolen, your insurer is again unlikely to pay out. The reason for this is because in the small print, all policies demand that the cutomers take ‘reasonable care’ of their phone and do not leave it unattended in a public place. The same applies if you leave your phone in an unlocked car and it is stolen. Confusingly, each provider has a different interpretation of ‘reasonable care’, so it can often feel like pot luck as to whether your claim is accepted or not. Each policy is different and has its own complicated terms and conditions. Many customers say that if they had realised a policy was so restrictive, they would not have taken it out.

Some customers have even been refused a payout because they were not physically harmed when their phone was stolen. Many insurers have tight exclusions on whether they will pay out in cases of theft.

One solution to the problem could be to not take out a policy and simply ‘self-insure’ by squirreling away, putting a little money aside each month just in case.

This is just another example of how insurers are using small-print to avoid paying out whenever they can.

We obtained expert evidence of his minor but troubling injuries being a deep cut to his knee and lip together with professional photographs showing some scarring. This was used to put the case to the local council who were forced to accept they had breached their duty to maintain the highway.

Arguments ensued around the issue of contributory negligence as is always the case in a jogger injury. Basically, our client was in danger of having his damages reduced by a percentage if a Judge decided that as he was jogging he was not taking all due care.

The settlement we acheived was a brilliant outcome and the client was delighted.
