Patients who might be on a tug of war between life and death can make things easier in the future by creating a living will. Do not be misled by the term—it has nothing to do with a traditional will or trust that is used to distribute properties and possessions after a person’s death. Instead, living wills are documents that clearly explain the type of medical treatments and health care a patient would prefer if they are unable to make decisions for themselves because of terminal illness, state of unconsciousness, and other situations that render them incapacitated.

An equally popular option that is quite similar to living wills is the durable power of attorney (DPA). Also called the medical power of attorney, DPA is a legal document that allows a person to pick someone (a family member, a friend, or a person who knows you well) to make medical decisions on your behalf if you are unable to do so such as during a state of coma or mental incapacity. DPA is oftentimes considered the more powerful alternative to living wills.

A person may opt to create both documents to ensure that everything goes smoothly in the future. After all, they are allowed in most states and are not exclusive of each other. For instance, some states like California have made a standard form available that has both a will and a DPA. Most of the time, it is more advantageous to have these two documents so that the decisions not covered in one of them can be compensated by the other.
But before you go about preparing these documents, it pays to know the differences between the two. Here are some of the differences:

1. DPA allows you to assign someone to make the health care decisions for you, while a will does not. In a will, the decision all comes from the person who has signed the document.

2. Unlike living wills, DPAs does not necessarily indicate the kind of medical treatment preferred by a patient if he becomes incapacitated.
3. DPAs may include just about any health care decision. That means these documents place no restriction to permanent consciousness or terminal illness. On the other hand, living wills are limited to those two conditions.

Every state has its own laws governing living wills and DPAs—how they should be prepared, who should be the witnesses, when the document will become effective, and how the instructions will be executed. There are states that provide a standard form and require it to be notarized. Others specify the number of witnesses for the documents. If you are planning to draft your own will or DPA, make sure that you know every rule set by your state.

Aside from making an online research, you can consult a lawyer to know the legal implications of the document you are going to prepare.

Conversation turned feverish this week that an arrest is almost imminent in the death of Michael Jackson.  From day one there has been speculation that the doctor that lived with The King Of Pop was not being perfectly open about what happened that fateful morning in the Holmby Hills section of Los Angeles.  Here’s a run down of what we do know, we think we know and everything in between as we count down to the release of the autopsy results and the decision of the LAPD whether to pursue charges or not.

From the very first news reports there seemed to be contradictions about how the doctor first found Michael.  Some reports seemed to suggest Michael collapsed while playing with his kids and with several people present.  Then other reports said he was asleep and the doctor simply found him either not breathing or breathing ‘shallow’.  There also seems to be conflicting reports as to whether he was found in his own bedroom or the bedroom of the doctor. 

The confusion continues with further reports that an IV drip, IV stand, Oxygen canisters and vials of various drugs including Propofol, a potent anesthetic were found close to where Michael was.  Then come conflicting reports between the paramedics who treated Michael and the doctor as to whether Michael did or did not have a pulse.  The doctor claims he did.  The paramedics apparently claim he was already dead by the time they arrived but were ordered by the doctor to not pronounce him dead and take him to the hospital to try and resuscitate him.  While they did this and the ‘official’ time and place of death was at the hospital, it seems most believe that Michael was dead before anyone even arrived at the house. 

This brings us to the 911 call.  Much has been made about the fact it apparently took upwards of 30 minutes before the doctor called 911 after finding Michael.  The doctor claims this is because he did not know the address by heart and that he did not have a land line.  Then, during the 911 call we hear the security guard tell the 911 operator that CPR is being performed on a bed.  The 911 operator mentions that this is not ideal and that it should be taking place on a hard surface like a floor.  The doctor apparently then proceeded to move him to the floor. 

This 911 call, when it was made and what happened during it brings up many questions.  First, is it reasonable that a full 30 minutes went by before a call was made to 911?  30 minutes is a substantial period of time.  If the doctor really ‘found’ Michael Jackson it seems the first thing any logical person would do is to call 911, before starting any kind of cpr.  Secondly, how did the doctor ‘find’ Michael and why would he be checking to see if his breathing was ‘shallow’ as he has stated.  Does it seem logical that the doctor just randomly walked into Michael Jackson’s room uninvited and started to notice his breathing?  This doesn’t seem reasonable.

What should we make of all the iv equipment in Michael’s room and the iv drip and stand?  What about the needle marks on Michael? Are we to believe that this has nothing to do with his demise when the toxicology tests apparently have shown that an overdose of Propofol is the primary cause of his cardiac arrest?  It has been revealed that during Michael Jackson’s last big tour he used Propofol and had a doctor travel with him to ‘put him under’ each night in order to get sleep while battling constant insomnia.  The doctor would then ‘bring him back up’ in the morning…in essence using anesthesia as a sleep aid.  Was this happening again and is this why the current doctor was being paid $150,000 a month so as to enable Michael’s addiction to Propofol?

Perhaps the most important question of all then is what moral and legal obligation does a doctor have to prevent a patient from using a drug in an illegal fashion.  What punishment does the doctor deserve if he’s found to have not only not stopped Michael but actually acted as the administer of the drug to Anesthetize Michael?  If Michael was willing to take such a chance with his life, should the full brunt of the blame fall on the doctor?  What roll did Michael’s fame and influence have in coercing the doctor to break the law and should this be taken into account if the doctor were found guilty?  Either way, a civil or criminal trial of some kind is almost certain.  We’ll follow it all at www.MichaelJacksonMurderTrial.com

According to various mainstream media reports, Los Angeles Police Department officer Stephanie Lazarus has been charged with the serious criminal offense of premeditated murder some twenty-three odd years after the death of Sherri Rae Rasmussen.

All in all, Rasmussen was found on the floor of her Van Nuys townhouse badly beaten and had been shot three times with a 38 caliber gun in the chest. Rasmussen reportedly was newly married to an ex-boyfriend of the now accused LAPD officer Lazarus, so jealousy was an obvious motive in the alleged crime, if it can be actually proven beyond a reasonable doubt in front of a jury of her peers.

As things stand now, Lazarus is being held without bail after a four-month sting was set up and executed, involving collecting of cups and utensils for DNA testing. This is just the latest in a string of somewhat bizarre crimes that have rocked the Los Angeles area in recent years. After all, this case may not be quite as high profile of a legal case as the O.J. Simpson trial, the Phil Spector murder case or the long murder trial involving veteran television actor and ‘Beretta’ star Robert Blake, but is really just as bizarre and intriguing.

The original theory by the police department in question was that the woman had entered her home and interrupted a burglary, after taking the day off work. Two men were found in the area that were suspected of burglaries and also carrying a weapon. The police believed them to be the right suspects, due to stereo equipment that was stacked up near the woman’s body and her missing car.

Lazerus became a suspect after the cold case was reviewed, during an original review of the unsolved crime in 2003 by a newly formed unit; DNA testing was done, which was not available in 1986 when the murder took place. But, it was not until it was reviewed again recently that Lazarus became a suspect. Having said that, though, it should be noted that Lazerus is presumed innocent unless proven guilty in court of law and currently is only a charged suspect in the crime, not a convicted criminal.

The evidence does not look favourable to her at this time, however. DNA samples from the original murder scene and items collected during the sting are reportedly a match to the LAPD officer. This may be difficult to overcome in a court of law, but it is probable that she will have a first rate Los Angeles criminal defense attorney, perhaps even a celebrity calibre attorney, to represent her in this rather high profile case.

Lazarus had also reported that a gym bag had been stolen from her vehicle in 1986 that along with some clothing, money, and tapes, also had her personal 38-caliber gun. The bag was never found and investigators now believe it to be the gun used in the murder and was likely thrown in the ocean.

Recent media reports have brought attention to the U.S. border with Mexico and the crisis brought about by an exploding and increasingly dangerous drug trade. Examples of this crisis include countless reports of local Mexican officials being murdered by those associated with the drug trade in Mexico. While much of the intelligence focus in the U.S. for the past seven years appears to have been upon the Middle East and South Asia, a crisis does exist on the U.S. southern border with Mexico and requires dedicated intelligence analysts and federal agents to ameliorate the situation. This article explains the current border crisis along with the Obama administration plan to address this situation, as well as some analysis on how intelligence agency ‘related jobs might be affected by this recent legislation.

The Crisis

The deterioration of security along the U.S.-Mexico border has increased significantly over the past year. Drug cartels, bolstered by the increasing U.S. demand for illegal drugs as well as the ease with which sophisticated weapons can be purchased in the U.S., are growing in influence throughout the border region. One report indicates that over 90% of drug cartel weapons originate from the U.S. and that around 90% of illegal drugs that come into the U.S. enter through Mexico.1 The “drug war” has been linked to around 7,000 deaths in the past sixteen months in the border region.2

U.S. Response

In early March, President Calderón of Mexico ordered over 7500 soldiers and 1700 federal officers into Ciudad Juarez, the Mexican city across the border from El Paso.3 In addition to the Mexican military bulking up its border presence, U.S. authorities are becoming more prominently involved in this crisis. The Obama administration recently announced a number of steps which would be taken to address this crisis:

- The Obama administration will spend close to $700 million in 2009 to work with Mexican law enforcement; around $30 million in stimulus funds will be applied to local and state law enforcement agencies along the border.

- The Department of Homeland Security (DHS) announced that 360 agents will be sent to both Border Patrol and ICE units on the U.S./Mexican border, along with 100 ATF agents.

- DHS, the Department of Justice, and the Treasury Department are increasing efforts and personnel along the southwest U.S. border. This plan includes doubling border security task force teams, increasing the number of local law enforcement officers and intelligence analyst positions, tripling the number of DHS intelligence analysts working along the southwest border, and increasing ICE staff in the U.S. embassy in Mexico.

- The Drug Enforcement Agency (DEA) will now allocate 29% of its domestic agent positions to southwest border field divisions, along with an increase in ATF agents. Furthermore, the FBI is creating a Southwest Intelligence Group, which will become a clearinghouse of all FBI activities related to Mexico.4

Southern border crisis effects upon Intelligence Agency Analyst and Federal Agent Jobs

Given the increase in attention and funding for southwest border security initiatives, intelligence agency jobs and federal agent job opportunities will be increasing significantly. This could mean that in the coming year, more openings for intelligence agency jobs and federal agent jobs that focus on border security will be available for qualified individuals that have the education and/or work experience to help this cause. Those individuals with a Spanish language background, regional experience, or specific functional experience or advanced education, such as a master’s degree in a security-related field will be in demand. Despite the current global economic crisis, U.S. government agencies such as DHS, FBI, and DEA, among others, will continue to hire individuals to fill intelligence agency-related jobs such as intelligence analysts as well as federal agent positions in order to mitigate the crisis brought about by illicit drug trade.
