With lawyers getting rained on from a great height (literally) we could all do with a little good news right now.

The Law Society upping the cost of a practising certificate by nearly 20 per cent was not it (see story).

With professional indemnity insurance forcing many high street firms out of business, a bill of £1,180 a year (up from £995 in 2008) is not what the doctor ordered.

New Law Society chief executive Des Hudson blamed the rise on the Legal Services Act (LSA) and a fall in the number of practising certificate holders.

To Hudson's credit, he also said it was the society's aim to "drive down" the cost once the LSA has been implemented, back to 2008 levels.

However, with even more certificate holders finding themselves out of a job or quitting to open olive farms in Tuscany, its member list is unlikely to improve anytime soon.

It was both prudent and wise, then, that the society has frozen its salaries over 2009.

About time too - Hudson received a hefty £71,200 pay rise in 2008. A repeat this year would probably have caused a minor riot.

The new Denning

David Neuberger's trajectory from Law Lord to Master of the Rolls mimics both Lord Woolf and Lord Denning (see story).

What's more, his move is a welcome bit of PR for the bench, which was singled out this week in the Milburn social mobility report for a bit of a kicking (see story).

For one of the advisers on that report was none other than the new Master of the Rolls, who has made his interest in diversity very clear, having chaired the Bar Council working party on widening access to the profession in 2006-07.

But Neuberger hasn't got the MR job because he knew a few people from government committees. There was no other obvious candidate for the post; he was fast-tracked through the Court of Appeal, spending just three years there before being promoted to the Lords.

You can virtually hear the roars of approval at the bar from here.

"He's bright, imaginative, and young," says one bar source. (Lord Neuberger is 61).

"It couldn't have been anyone else," says another.

Still, that leaves a space among the 12-strong Supreme Court justices for October.

Sumption, surely?

Earlier this week it emerged that former Edwards Angell Palmer & Dodge corporate partner Stephen Connoni is suing his old firm.

Connoni alleges Edwards Angell fired him without a firm-wide vote or the cash he says it owes him.

The Boston-based firm, which hired Connoni in 2007 from K&L Gates only to fire him a year later, claims the partner breached terms of his agreement regarding the level of business and revenue he would generate.

Whatever the outcome of the case, which will be heard in New York on 4 August, it has highlighted the enormous pressure partners are under as the financial crisis continues.

Are we likely to see other partners take a similar path when evicted from the partnership due to poor performance?

As legal commentator Bruce MacEwen puts it, "It asks a lot of questions about expectations and what partners can realistically deliver during the downturn".

Connoni's case demonstrates an interesting point. Can firms truly expect partners to reach meaty revenue targets and should they be able to penalise them when the downturn means those targets are missed?

The case brings to mind the US "impossibility" defense to criminal charges (Google it when you have a second - you'll find cases relating to shooting stuffed deer and tree stumps).

MacEwen puts it rather more eloquently.

"Asking for excessive revenue at the moment is like asking a labourer if he can lift 200 pounds by himself," says MacEwen. "It can't be done."

What's 591 ft tall, has 40 floors and looks like a big fat vegetable?

Anyone working in the City's square mile will immediately recognise arguably London's most famous building, the Gherkin.

What they might not know is that as of this week it has a new tenant.

As we report today, Greenberg Traurig Maher - home of former Mayer Brown co-vice chair Paul Maher - is officially launching in London this very week with brand spanking new offices in the iconic building (see story). Confident stuff.

But that's not all. Guess which firm London's newest US entrant is subletting from?

If you said "Mayer Brown" you win a cucumber soaked in vinegar.

Yes, Maher is moving back in with Mayer. Could be a bit of a pickle but word is he's stumping up around £1m in rent for the honour.

That'll no doubt smooth over any Mayer Brown feathers that remain ruffled after the Greenberg man's exit earlier this year.

Think of it as a leaving present.

Law: In a class of its own

Is the legal profession off-limits to people from poorer backgrounds? Labour supremo Alan Milburn certainly seems to think so (see story).

His report on social mobility has just singled out the law as being particularly dominated by the wealthy.

The paper makes for interesting, if predictable, reading. The revelation that most lawyers hail from the chattering classes is right up there in shock value terms with the news that bears defecate in woods.

And most people seem to agree that a legal system staffed entirely by middle class white men is a bad thing. It's when you attempt to solve the problem that arguments start.

Milburn seems to suggest that universities should give preferential treatment to youngsters from poorer backgrounds, something that will whip Daily Mail readers across the country into a fury, no doubt.

In contrast, the College of Law's chief executive Nigel Savage thinks that abandoning training contracts is the answer.

Whatever the solution, correctly identifying the problem is a good start.

Asked for a statement, the Law Society referred The Lawyer to its Diversity Charter, which deals with ethnicity, religion, gender and sexuality.

So, er, not social background at all then.

Such a response will leave class crusaders shaking their heads in dismay. If the representative body for solicitors can't seem to grasp the problem, what hope is there?

Cadwalader Wickersham & Taft has found a new London home. As you might expect, it's quite a bijou dwelling.

A series of layoffs and defections over the past few months have left the London office looking rather empty of late. Only a couple of years ago, Cadwalader's London office had 13 partners and around 50 lawyers.

Now there are just four partners and a dozen or so associates.

So, instead of having this diminutive crew rattle around the 35,000 square feet of 265 Strand, Cadwalader has taken just two floors of Dashwood House on Old Broad Street (see story) so they can all be near each other.

The property move underlines the fact that the US firm that was first to make widespread layoffs at the start of the downturn has been anything but immune on the other side of the Atlantic.

Last year during Cadwalader's second wave of cuts during the 2008 summer it shed 11 associates in the City. This was soon followed by a seven-partner walkout to Paul Hastings this January.

Cadwalader insists it is still dedicated to the London market and is keen to rebuild its UK capabilities. But given the size of its new office, it's more likely to be building a bungalow than a tower.

Caution is everything.

In-housers have had it pretty much all their way of late, with strict pitch criteria meaning they can dictate terms and even get their law firms to do some menial work for their companies. It looks like that balance of power is not going unchallenged, however.

As we reveal today, one City firm - which has asked not to be identified - has decided not to compete for a place on Serco's upcoming panel review simply because there will be too much work involved.

"We're not going to pitch," a partner at the firm in question says (see story). "The last effort was huge, we did hundreds of pages for our pitch and haven't got much work out of it. We have too many other things to do."

To be fair, in-housers have been making even greater demands of their panel firms in recent months. Among them, Sainsbury's general counsel Nick Grant challenged the firms on his legal panel to compete against each other in a Dragons' Den-style contest (see story) while a raft of others, including Bupa general counsel Paul Newton, have been using e-auctions in a bid to drive down their external legal spends (see story).

You can hardly blame them; with legal work becoming ever more commoditised general counsel need to find a way to distinguish between their firms. After a prolonged period of jumping through hoops, however, it looks like private practice could be about to fight back.
