Motor vehicle accidents involving autos, 18-wheelers, pedestrians, bicycles and motorcycles are extremely common in Alabama. Too often, an auto accident victim will assume his only option is to sue the at-fault driver...who may only have minimal limits. Fortunately, Alabama car accident law allows a variety of legitimate claims to be made for full compensation.

In an effort to explain the options available to a car accident victim, we will consider a example involving a tractor-trailer accident: you are driving to the courthouse to file a document for your employer, a law firm. En route, you are rear-ended by an overloaded tractor-trailer and transported to the hospital with serious injuries. Additionally, during the accident sequence, your seat belt failed to restrain you, causing a severe head injury. In this example, you have several options.

First, and most obvious, you have a direct claim against the tractor-trailer driver. You also have a claim against his employer for negligently overloading his truck and/or allowing him to operate it while overloaded.

Second, if the tractor-trailer's liability insurance is either expired or insufficient, you cam make a claim for underinsured/uninsured benefits with your own auto insurance carrier.

Thirdly, since you were injured while in the course and scope of your employment, you have a worker's compensation claim in addition to the main claim against the tractor-trailer driver.

Finally, you may very well have a product liability claim against the manufacturer of your automobile for the failure of the seatbelt to properly restrain you during the accident, particularly if the failure caused or enhanced your head injury.

If you have sustained serious car accident damages, always consider all your options. Additionally, be aware that Alabama has a statute of limitations for all personal injury litigation. Finally, seek advice from a Birmingham car accident attorney if you have questions about your legal rights.

Continue reading "Alabama Car Accident Claim Options"
