<p><a href="https://www.5sah.co.uk/barristers/john-cammegh-kc">John Cammegh KC</a> and <a href="https://www.5sah.co.uk/barristers/oliver-kirk">Oliver Kirk</a> present on how Loss of Control and Diminished Responsibility work in practice, simplyfying the approach and giving useful tips on:</p>
<ul>
<li>
Where Loss of Control might, might not or will not apply<br />
• Tactical approach at the police station<br />
• How to deploy psychiatric evidence<br />
• Strategies for getting Loss of Control to the jury</li>
</ul>
<p><em>Since Provocation as a common law partial defence to murder was revoked and replaced by ss 54 – 56 of the Coroners and Justice Act 2009 the landscape of murder litigation has drastically changed. Rather than providing streamlined and rational criteria the statute has, in practice, served to seriously curtail the defence by giving judges the power to prevent loss of control going to the jury. Some practitioners have commented on the inherent risks involved; others have argued that, in a worst case scenario, the Act offends the defendant’s right to trial by jury.</em></p>
<p><em>However, with a focussed strategy at police interview, to the instruction of medical experts, to careful drafting of the Defence Statement through to conduct of the trial in court, there is no reason why Loss of Control cannot be sustained and successfully deployed.</em></p>
<p><a href="https://www.5sah.co.uk/barristers/john-cammegh-kc">John Cammegh KC</a> is a highly accomplished Silk, expertly placed to bring insight of both prosecuting and defending in multiple trials involving Loss of Control and Diminished Responsibility. John is uniquely experienced in practising at the highest level in both domestic and international criminal courts over the past two decades.</p>
<p><a href="https://www.5sah.co.uk/barristers/oliver-kirk">Oliver Kirk</a> represents clients in the most serious and complex criminal cases. Practising as a solicitor for over 20 years, Oliver headed his own firm, whilst expertly developing for a decade his skills as a Higher Rights Advocate, transferring in 2019 to the Bar and joining 5SAH. Oliver will bring insight from both the solicitor and barrister perspective.</p>

<p><strong><em><u>November 13th 2023 at Frederick’s 106 Camden Passage, Islington, London N1 8EG at 6:30pm</u></em></strong></p>
<p>President, Fadi Daoud and the LCCSA Committee, invite you to join him and the Committee to the LCCSA AGM, which will take place on November 13th 2023 at<span> </span><a href="https://www.fredericks.co.uk/">Frederick’s.</a></p>
<p>The AGM is open to all LCCSA Members and will start at 6:30pm.  This will be followed by a dinner at 7:30pm (you will need to pay for the dinner).</p>
<p>This event takes place traditionally every year and is always a great success.</p>
<p>You will be able to hear our Guest Speaker, Stephen Parkinson, the new Director of Public Prosecutions, speak after dinner. You will also be able to meet members of the Association including  Past Presidents, Honorary Members and Officers of the Association.</p>
<p>We are delighted to be able to have a private room at the ever popular<span> </span><a href="mailto:https://www.fredericks.co.uk/">Frederick’s</a><span> </span>restaurant in Islington, (a 3 minute walk from Angel Tube station).  The dress code will be lounge suits.</p>
<p>The cost this year for the dinner will be £60.00 which includes a 3 course dinner and wine.</p>

										<content:encoded><![CDATA[<p><span>HMCTS will be hosting two in person sessions for practitioners to trial the new Common Platform functionality.</p>
<p>These sessions will take place in Petty France on 19 September.</p>
<p>They will look at the expansion and enhancement of the  document management and case note functionality, for both magistrates’ and Crown Courts, which will replace the Crown Court Digital Case System (DCS) and the new ‘hearing view layout’.</p>
<p>These will be small groups, with a maximum of 10 people in each, so that participants can get the most out of these sessions. The first session will run between 10:30-12:30  and the second 13:30-15:30 and defence practitioners can register for these sessions using the below links.</p>

<p>Representing a child in contact with the law is one of the most important and potentially life changing tasks a lawyer can do. It is also one of the most difficult.</p>
<p>This short evening course, followed by drinks, will form two halves.</p>
<p>The first will deal with key legal provisions. The second, with input from an experienced adolescent forensic psychologist, will equip practitioners to make sure the law factors in the challenges children face.</p>

<li>Modern slavery</li>

<p>Session 2: Understanding the challenges children face</p>
<p>Children facing criminal charges have often experienced huge challenges, especially since Covid. This session will support practitioners to understand and make sure the law takes account of the needs of children who have experienced:</p>

<li>Difficulties with social media</li>
<li>Acute anxiety</li>
<li>Incel behaviour/social isolation</li>
<li>Systemic racism</li>
