It has been revealed that a man died in a serious work accident after drowning. The construction worker was killed after falling into an underground water tank, in a job that should have taken three people, but was carried out by just him. The inquest jury ruled the employer to be professionally negligent for the cause of the accident, which saw the 47-year-old drown to death, and ruled that there were ‘defects in the system of working which contributed to the accident’. The nine-woman jury also ruled that the worker being a non-swimmer was relevant to the circumstances of his death. They ruled that the victim, of Toberdoney Road in Dervock, near Ballymoney, was “one man doing a three-man job” and said there were “unclear instructions” regarding the work he was involved in. The jury further ruled there was “inadequate supervision” on the site of a pumping station at West Bay, Portrush, on the day Mr Johnston died on October 6, 2006. Senior Coroner John Leckey said it was already found by a pathologist that the labourer died as a result of drowning and he said that the jury had to conclude whether or not there were any faults in the system of working, which lead to the incident. He noted that as the victim could not swim, this could also have been a major factor as to why he was unable to save himself, when he fell into the water tank. In addition, he passed on his sympathy to the worker’s family and pointed out that a jury had been allocated because the man died in a work accident. In a cruel twist of fate, the victim had only been working at his employer for one week. He was a driver of a telescopic handler on the construction site in Portrush on the week of his death. He was hired by the firm to build a waste treatment plant for the Water Service to help improve the water quality at bathing beaches. The inquest heard no-one witnessed the worker fall into the well as he was working alone, moving steel mesh which formed a temporary covering on top of the six-metre well, which was around half full with water. The inquest was told it was a job which should have been carried out by three people – one driving a telescopic handler and two others to guide the mesh. Terrible work accident Nancy Henry, from the Health & Safety Executive, said someone falling into the water in the tank may have had a chance of surviving if they had been able to swim as there was a ladder in the tank. Over the last five years more than £4 million was awarded to patients from the Aneurin Bevan Health Board and claims have soared by 40%.

The figures were obtained under the Freedom of Information Act. In 2009, 136 clinical error claims were made against the organisation, formerly known as the Gwent Healthcare NHS Trust. This number is an increase of 21% – up from the 112 claims launched in 2008 and 41% on the 96 claims filed in 2005.

Whilst an injury lawyer linked the rise to a greater awareness of failings in the healthcare system, health ministers stated there the increase was due to the recession.

Ken Thomas, lawyer for a Newport firm, noted that due to changing times, a compensation claim is more accessible.  He furthered that because of increased press coverage of clinical negligence claim cases combined with a greater willingness to question doctors’ decisions than there was 20 years ago, this has led to more people pursuing claims.

Mr Thomas said that among the medical negligence cases settled in Gwent last year were cases involving care of the elderly, drug error, misdiagnosis of fatal conditions, misdiagnosis of injuries in casualty and nursing negligence.

He said major claims, including those involving brain damage which can lead to payouts of millions of pounds, tend to take more than a decade to be settled, whereas minor claims can be resolved within months.

Out of all the cases, liability was admitted in 17 of the 2009 claims and £76,029 paid out in damages – compared to 28 in 2008, leading to a pay out of £211,654, and 44 in 2005, resulting in a pay out of £2,793,010.

Mr Thomas expects settlements to be made in many more of the last five years’ cases over the coming years.

A spokesman for the Aneurin Bevan Health Board said: “The picture in terms of increased numbers of clinical negligence claims is reflected across Wales.  There is a direct link between increases in negligence claims and periods of economic recession.

“Obviously not every claim is found to be justified and solicitors at Welsh Health Legal Services will continue to robustly defend cases on our behalf.”

Husband files claim

One individual who suffered from medical negligence was a man from Oakdale, whose wife died through a clinical blunder.

The 64-year-old sued Gwent Healthcare Trust after his wife died at Newport’s Royal Gwent Hospital, in March 2002. It is thought that she died because a valve blockage in her heart was not detected.

Through his case, he stressed that negligence will only stop if people complain about the system and share their negative experiences.

An investigation into his wife’s death found it was the system, rather than individuals, at fault and changes were made as a result of her death.

The widower said: “The more people that complain and take them to court, the more impact hopefully it will have in the end and changes will be made for the better.”
