New Collection on Japan Tobacco and Smuggling

The Legacy Tobacco Documents Library has added 100 new Philip Morris documents today and a new research collection, JTI Smuggling.

The 42 documents in this new collection were obtained by the Organized Crime and Corruption Reporting Project (OCCRP) and detail Japan Tobacco International's (JTI) smuggling activities throughout Russia, Moldova, the Balkans, Afghanistan and the Middle East, and their subsequent cover-up. New FDA-Tobacco Litigation Page

The UCSF Tobacco Control Archives has a new FDA Lawsuits page in its Tobacco Litigation section. This new page currently contains court documents and other resources surrounding the FDA's ruling regarding new cigarette warning labels and the appeal by the tobacco industry (RJ Reynolds et al., v. FDA). This page will be updated as further litigation occurs and court documents are received.

8 New Papers Added to the Tobacco Docs Bibliography

The last 2 months of 2011 have brought us some fascinating research and analysis of tobacco industry documents and brings the total number of scholarly articles, reports and books/chapters using the documents to 758.

The latest update adds Jackler and Samji's article "The price paid: Manipulation of otolaryngologists by the tobacco industry to obfuscate the emerging truth that smoking causes cancer" and Brandt's "Inventing Conflicts of Interest: A History of Tobacco Industry Tactics." Wertz, et al's PloS article, "The Toxic Effects of Cigarette Additives. LTDL to Receive $6.25M for Document Indexing and Access

The U.S. Department of Justice filed a proposed consent order on December 14, 2011 with a federal district court that finalized requirements for three major tobacco companies to make internal documents public in accordance with an earlier ruling that the companies violated the Racketeer Influenced and Corrupt Organizations Act. The documents have been and will continue to be archived in UCSF’s Legacy Tobacco Documents Library (LTDL).

The order is part of the remedy phase of the largest civil racketeering (RICO) case in the history of the United States and specifies that the companies provide $6.25 million to the court to improve public access and indexing of the documents. These funds will go to the UCSF Legacy Tobacco Documents Library for this purpose.

“These funds will allow us to substantially improve the way investigators, the media and the public are able to research how tobacco companies produce, price and market their products as well as protect their political interests globally,” said Kim Klausner, UCSF Industry Documents Digital Library Manager.

“Research based on the documents has provided a unique insight into how the tobacco industry manipulates scientific and political processes and engineers its products and marketing to maximize its sales,” said Stanton A. Glantz, PhD, UCSF professor of medicine and director of the Center for Tobacco Control Research and Education at UCSF. “By revealing the industry’s behind-the-scenes strategies and involvement, this understanding has transformed public health from city councils to the United Nations.”

UCSF Tobacco Center Fellowship - Still Taking Apps!

Apply now for the Postdoctoral Fellowship in Tobacco Control Research at UCSF: Applications are due January 25, 2012 for fellowships beginning July 2, 2012.

The fellowship supports two years of postdoctoral training in tobacco related research. Postdoctoral fellows will have exposure to diverse training including both didactic coursework and individualized mentoring to build a personalized research program. Fellows have come from medicine, public health, nursing, economics, anthropology, political science, law, sociology, psychology, and cell biology. Prior tobacco research experience is relevant, but not necessary for acceptance.

The CTCRE offers individual mentorship with UCSF faculty along with courses in tobacco specific topics, health policy, cancer control and prevention, grant and scientific writing skills, career development, interdisciplinary research, and biostatistics. UCSF is a global leader in tobacco science, a World Health Organization collaborating center, and home of the Legacy Tobacco Documents Library.

New/Revised Feature:

Last month we rolled out a new field called "Related" which was to be populated with a link to a publicly accessible document if it had the exact same bates number as the document designated as privileged or confidential. Clicking on "Related" would have taken you to this duplicate document which may contain the PDF for viewing. We have rethought this feature and decided to make it more streamlined and comprehensive.

With this new release, we now have a "Public versions" link instead of a specific field in the record (see image below). If a privileged or confidential record has this link, click on it and a search is automatically generated showing all publicly accessible documents that have the same bates number.

Child labour: the tobacco industry's smoking gun

"Financial reports for 2008 by the five big tobacco companies - BAT, Philip Morris, China National Tobacco Company, Imperial Tobacco and Japan Tobacco - show that they collectively earned $300bn. This is more money than the GDP of all but 40 countries worldwide. Part of the reason for those huge profits is that tobacco giants benefit from $1.2bn in unpaid child labour costs, according to Otañez's colleague Prof Stanton Glantz."

New Feature:

With the addition of tens of thousands of new documents from the tobacco companies' "Privilege Logs" and "Confidential Indexes," we find we may actually have a copy of a document designated as privileged or confidential. There are multiple reasons for this. In some lawsuits, plaintiffs have challenged tobacco companies' assertions of privilege and courts ordered the documents to be produced such as with the Bliley documents. If the tobacco companies previously put Bliley Documents on their privilege logs, their privilege assertion generates one entry for a document record in LTDL and a copy from the Bliley Collection or elsewhere generates another record entry in LTDL. Similar processes have occurred as a result of privilege challenges in other lawsuits, including United States v. Philip Morris USA, Inc.

Another way that we may acquire images of such documents occurs when companies voluntarily withdraw their previous privilege claims. This can happen when companies review documents previously withheld on privilege grounds, redact portions that they consider privileged, and post the rest. When these various scenarios occur, there will be more than one record for the document in question, a "privileged" or "confidential" record and a "public" record.

When we find such matches during our ingest of new documents, we will provide a link to the viewable document in a new metadata field called "Related":

Take a look at the 81 documents that were used as supporting documentation for the 1998 Coughlin and Janacek report, "A Review of RJ Reynolds' Internal Documents Produced in Mangini vs. RJ Reynolds Tobacco Company, Civil Number 939359: The Case that Rid California and the American Landscape of 'Joe Camel'."

Magnini vs. RJ Reynolds challenged the company for targeting minors with its "Joe Camel" advertising campaign and the highlighted documents provide an amazing glimpse into how far an industry will go to sell their product.

Vid of the Week - Testimony of PM scientists investigating nicotine in rats

Testimony of Victor DeNoble and Paul Mele, two research scientists formerly employed by Philip Morris to investigate the behavioral and physiological effects of nicotine on rats, measuring self-administration, tolerance, and dependency.
