The importance of consistent adherence to break policies.

Martin, Pringle, Oliver, Wallace & Bauer, L.L.P. is pleased to present the March/April 2013 issue of Employment Law Briefing. In it we discuss:

An airline’s “competitive transfer” policy for disabled employees, which was alleged to violate the Americans with Disabilities Act;

We show how a court’s “mixed-motive analysis” led to a favorable ruling for a fired employee who claimed gender and race discrimination; and

Why it’s important for whistleblowers seeking False Claims Act protection to clarify their intentions, and why severity of misbehavior counts in retaliation claims.

The ideas we discuss in Employment Law Briefing are relevant to your success, and we would welcome your questions or comments. We realize that we cannot fully address these complex issues in a few short articles, so we invite you to call us at 316.265.9311 to discuss your needs.

Martin, Pringle, Oliver, Wallace & Bauer, L.L.P. is pleased to present the May/June 2012 issue of Employment Law Briefing. In it we discuss:

The three-part test used to determine whether an employee is administratively exempt from the Fair Labor Standards Act requirements regarding pay;

How the Equal Employment Opportunity Commission defines a “qualified individual with a disability” vs. how a circuit court interprets that definition;

Whether the First Amendment protected the “ministerial exception” in a case in which a teacher at a religious school sued her employer for wrongful termination; and

Whether a plaintiff who had unintentionally overstayed her leave was nevertheless covered under the Family and Medical Leave Act (FMLA).

The ideas we discuss in Employment Law Briefing are relevant to your success, and we would welcome your questions or comments. We realize that we cannot fully address these complex issues in a few short articles, so we invite you to call us at 316.265.9311 to discuss your needs. Martin, Pringle, Oliver, Wallace & Bauer, L.L.P. would be glad to assist you in any way we can.

Martin, Pringle, Oliver, Wallace & Bauer, L.L.P. is pleased to present the

March/April 2012 issue of Employment Law Briefing. In it we discuss:

Why the Fifth Circuit allowed an age-discrimination case alleging a hostile work

environment to proceed, even though it had never before held that Title VII could be used

to address a claim of hostile work environment based on age;

How a college administrator’s comment endangered the school’s defense in an

Americans with Disabilities Act case;

Why a hospital official’s failure to be completely forthcoming contributed to the

hospital’s losing a hostile work environment and retaliation case; and

A case in which an employer offered a returning service member a position with less

commission-earning opportunity than his pre-leave position.

The four conditions employers must meet before they may lawfully request that their employees take a polygraph test;

Whether a performance improvement plan could be considered an adverse employment action, and the basis for an age discrimination case;

Whether recent completion of a drug rehab program necessarily qualifies an employee for protection under the Americans with Disabilities Act; and

Whether someone who is extended a job offer, only to see it withdrawn when it’s discovered she’s commenced a lawsuit against her former employer, is protected as an employee under the Fair Labor Standards Act.

Martin, Pringle, Oliver, Wallace & Bauer, L.L.P. is pleased to present the May/June 2011 issue of Employment Law Briefing. In it we discuss:

Why it’s important to keep the Uniformed Services Employment and Reemployment Rights Act (USERRA) in mind when a civilian company evaluates the job performance of a military service member;

How a company that tries to address sexual harassment in the workplace may find itself being sued for not trying hard enough;

Whether a worker’s resignation is actually a “constructive discharge” if it occurs immediately following a disciplinary hearing; and

Whether requiring employees to repay training costs if they resign within a certain time frame constitutes a kickback under the Fair Labor Standards Act.

Whether an employer’s use of a recorded conversation violated the federal Wiretap Act;

We show what happened when an attorney, representing a woman claiming discrimination on national-origin grounds, appealed to the jury by disparaging another national group; and

We look at a case in which an employee sued over the need for an American Sign Language (ASL) interpreter, and another in which only periodic sexual harassment was alleged.

A glance of topics covered in this issue:

Why it’s important for employees to maintain ongoing communication with their employers — whether it involves reporting worker harassment, or suggesting a different workplace accommodation if an employer’s suggestion isn’t feasible

We show that an employee’s actual innocence of the employer’s proffered accusation might not be sufficient in an age discrimination case

Office Management: Termination of Employees in the Physician’s Office

Kansas is an “at-will” employment state. In practical terms, this means that unless employees have a contract with different provisions, their employment can be terminated for a good reason, a bad reason, or no reason – as long as it does not violate protections afforded under the law. Most physicians and office administrators know that employees cannot be terminated based upon their gender or race. These are examples of protections afforded under state and federal law that provide exceptions to at-will employment. Other Kansas and federal statutes afford additional protections.

In 1999, a report issued by the Institute of Medicine found medical errors were a leading cause of mortality and morbidity in the United States. This ignited those in the health care world. Following this report, in 2002, the National Quality Forum developed a list of 27 serious and “preventable” conditions which should never happen to a hospital patient. In 2006, another condition was added to make the total list 28. These events became known as “never events”. The name seems unfortunate in that all related to the health care industry recognize there is never a “never”.
