Martin W. Bauer Inducted into the Clay Center Community High School Hall of Fame

Martin Bauer, partner at Martin, Pringle, Oliver, Wallace & Bauer, LLP, was inducted into the Clay Center Community High School (CCCHS) Hall of Fame on Tuesday, March 26, 2013. He was recognized by CCCHS for his civic and professional contributions, and in particular for the advancement of adoption law and creating permanency for children. He was cited as being a “credit to his profession, his community and to CCCHS.”

Martin graduated from CCCHS in 1967. He received his undergraduate degree from Kansas State University in 1971 and his law degree from the University of Kansas School of Law in 1975. He joined Martin Pringle in 1977 and focuses his practice on adoption law, commercial litigation, bankruptcy, condemnation and legal malpractice matters.

Outside of Martin’s busy law practice, he spends his time volunteering his time throughout our community. Active in the Wichita arts community, Martin is on the Board of Directors for Arts Partners and is a past member of the National Board of Directors for the National Assembly of State Arts Agencies. He is also active in Rotary, the University of Kansas Alumni Association and the Wichita Bar Association.

Matthew P. Scott Burrus recently completed his second year at the Washburn University School of Law, where he received a full academic scholarship as a University of Kansas Scholar. He completed his Bachelor of Science degree in Strategic Communication from the University of Kansas in 2008.

Samantha Heady recently completed her second year at the University of Kansas School of Law, and is a Karl T. Wiedemann Scholarship in Law recipient. She completed her Bachelor of Arts in Psychology & Sociology from Pittsburg State University in 2010.

Sam Heaney recently completed his first year at the University of Iowa College of Law, and is a member of the Sports Law Society. He completed his Bachelor of Arts in Communication from Saint Louis University in 2011.

Matt Spahn recently completed his second year at Washburn University School of Law, where was awarded the Legal Research and Writing Top Paper in the Fall of 2010. He completed his of Bachelor of Business Administration from Kansas State University in 2010.

Mike Jones - Mike joined Martin Pringle in 1990 and is highly experienced in defending products liability actions, having participated in cases filed in federal and state courts throughout the United States. He represents aircraft manufacturers and servicers, aircraft-components manufacturers, manufacturers of recreational products, and industrial equipment manufacturers in cases involving personal injury and wrongful death claims, as well as property damage claims. Mike has served as the 2010 Program Chair for DRI's national Product Liability Conference.

Bill Oliver - Bill has more than 40 years experience and has participated as counsel in product liability cases filed in the United Kingdom, France, Turkey, Australia, New Zealand, and the Philippines among other nations. He is well versed in the defenses applicable to those cases, including the General Aviation Revitalization Act (GARA) defenses, the government contractor defense, and procedural issues such as jurisdiction and forum non conveniens. Bill has worked in product liability insurance renewals for 35 years.

Jeff Spahn - Jeff has more than 25 years experience and has represented aircraft and aircraft- components manufacturers, distributors, and service facilities in products liability actions and a variety of commercial litigation matters. He has an active practice litigating disputes involving breach of contract claims under the Uniform Commercial Code (UCC), warranty claims, and aircraft repossession, among other issues. He has participated in numerous arbitration proceedings before the AAA and ICC, giving him a thorough understanding of the alternative dispute resolution (ADR) process.

David Wooding - David has more than 30 years of litigation experience and has extensive experience in products liability matters, defending products liability actions in federal and state courts throughout the United States. His products liability experience includes representing pharmaceutical companies, manufacturers of medical devices, aircraft manufacturers, and aircraft components manufacturers against personal injury and wrongful death claims. David has been active in the Products Liability Advisory Counsel, including serving on PLAC’s conference planning committee in 2006.

The law firm of Martin, Pringle, Oliver, Wallace & Bauer, L.L.P is proud to announce they have donated 60 trees to the City of Wichita and the downtown revitalization project in honor of their 60th anniversary and their founders.

"We are extremely proud of our 60 years in business and to have our headquarters in Wichita. This donation is a way to give back to the city, while also honoring our founders Bob Martin and Kenneth Pringle," said Jeff Kennedy, Martin Pringle’s Managing Partner.

Martin Pringle employees will work with employees from the City of Wichita’s Park and Recreation department to plant 26 of the trees on the lawn south of the Hyatt Hotel on Sunday, October 30, 2011 from 2-4pm. The remaining 34 trees will be planted by City employees in Old Town as a part of the downtown revitalization project.

The board will aid the transition from a two-year residency program, to a full four-year program, and is charged with promoting the expansion of the KU Medical School’s Wichita campus.

Mr. Kennedy is a KU alumnus, and currently serves on the Board of Directors for the KU National Alumni Association, as well as the Wichita Chapter of the KU Alumni Association. He also serves on the Dean’s Steering Committee for the KU School of Medicine-Wichita. Mr. Kennedy is on the Advisory Board of the Wichita Chamber of Commerce, the Board of Directors for the Greater Wichita Area Sports Commission and is a Board of Trustees member for the Wichita Art Museum.

Ms. Adams joined Martin Pringle in 2001. After living briefly in New Jersey, where she worked as a federal law clerk, Ms. Adams returned to Martin Pringle in 2008. Her practice primarily focuses on litigation support and briefing in both state and federal courts. She provides legal analysis, research and writing in various civil litigation matters, including contested adoptions, oil and gas matters, products liability, and medical malpractice defense. She received her undergraduate degree from Duke University and went on to receive her J. D. from Pace University School of Law, cum laude. Ms. Adams is admitted to practice in Kansas and offers 16 years of legal experience.

Ms. Jennings joined the firm after having clerked at Martin Pringle for two summers during law school and joined the firm after graduating from the Washburn University School of Law, cum laude, in 2005. Her practice focuses on civil litigation, including employment litigation, where she represents clients in a wide range of matters, including breach of employment contract actions, covenant-not-to-compete claims, workers compensation retaliation claims, and Occupational Safety and Health Administration (OSHA) compliance. Ms. Jennings litigation experience also includes insurance defense, trust and probate litigation and intellectual property law. She is active in the Society for Human Resource Management, the Wichita Bar Association, the Defense Research Institute and she serves on the Board of Trustees for Young Professionals of Wichita. EHR/EMR “Meaningful Use” and Certification

The American Recovery and Reinvestment Act of 2009 (ARRA), contains the provisions for Health Information Technology for Economic and Clinical Health (HITECH). Through HITECH, the Department of Health and Human Services (HHS)[1] intends to incentivize healthcare providers to engage in "meaningful use" of "certified" EHR or EMR. Until recently, the definition of "meaningful use" has been speculative. On January 13, 2010, the Centers for Medicare and Medicaid Services, a division of HHS, released Notices of Proposed Rule Making (NPRMs)[2] which provide some additional guidance regarding "meaningful use" and "certified" EHR/EMR.

Office Management: Termination of Employees in the Physician’s Office

Kansas is an “at-will” employment state. In practical terms, this means that unless employees have a contract with different provisions, their employment can be terminated for a good reason, a bad reason, or no reason – as long as it does not violate protections afforded under the law. Most physicians and office administrators know that employees cannot be terminated based upon their gender or race. These are examples of protections afforded under state and federal law that provide exceptions to at-will employment. Other Kansas and federal statutes afford additional protections.

In 1999, a report issued by the Institute of Medicine found medical errors were a leading cause of mortality and morbidity in the United States. This ignited those in the health care world. Following this report, in 2002, the National Quality Forum developed a list of 27 serious and “preventable” conditions which should never happen to a hospital patient. In 2006, another condition was added to make the total list 28. These events became known as “never events”. The name seems unfortunate in that all related to the health care industry recognize there is never a “never”.

Health Care Reform – Stay Tuned

On June 9, 2009, the Senate Health, Education, Labor and Pensions (HELP) Committee released a draft bill to reform the nation’s health care system. The draft bill, called the Affordable Health Choices Act, is a 615-page bill that includes numerous provisions touching many different areas of health care. Included in the bill are provisions prohibiting health care insurers from discriminating against individuals on the basis of an individual’s health status, preexisting conditions, medical condition or history, claims experience, disability, or genetic information, among other things. The Act also contains numerous other provisions pertaining to the design and implementation of regionalized systems for emergency care, health care workforce loan repayment programs, expansion of Medicaid coverage, and insurance market reforms.

Health Care Providers and Identity Theft – Ensuring Compliance with the “Red Flags” Rule

Beginning August 1, 2009, the Federal Trade Commission will start enforcing the Red Flags Rule – a law that requires certain businesses and organizations, including healthcare providers, to develop and implement a written program to identify, detect, and respond to warning signs, or “red flags,” of identify theft. A “red flag” is a pattern, practice, or specific activity that indicates the possible existence of identity theft.”
