from reuters: When Patty Tegeler looks out the window of her home overlooking the Appalachian Mountains in southwestern Virginia, she sees trouble on the horizon. "In an instant, anything can happen," she told Reuters. "And I firmly believe that you have to be prepared."

Tegeler is among a growing subculture of Americans who refer to themselves informally as "preppers." Some are driven by a fear of imminent societal collapse, others are worried about terrorism, and many have a vague concern that an escalating series of natural disasters is leading to some type of environmental cataclysm.

They are following in the footsteps of hippies in the 1960s who set up communes to separate themselves from what they saw as a materialistic society, and the survivalists in the 1990s who were hoping to escape the dictates of what they perceived as an increasingly secular and oppressive government.

Preppers, though, are worried about no government.

The Gulag Archipelago is Solzhenitsyn’s attempt to compile a literary-historical record of the vast system of prisons and labor camps that came into being shortly after the Bolsheviks seized power in Russia in 1917 and that underwent an enormous expansion during the rule of Stalin from 1924 to 1953. Various sections of the three volumes describe the arrest, interrogation, conviction, transportation, and imprisonment of the Gulag’s victims by Soviet authorities over four decades. The work mingles historical exposition and Solzhenitsyn’s own autobiographical accounts with the voluminous personal testimony of other inmates that he collected and committed to memory during his imprisonment. Upon publication of the first volume of The Gulag Archipelago, Solzhenitsyn was immediately attacked in the Soviet press. Despite the intense interest in his fate that was shown in the West, he was arrested and charged with treason on February 12, 1974, and was exiled from the Soviet Union the following day.

In a 6-2 ruling, the court said that, just because material enters the public domain, it is not “territory that works may never exit.” (.pdf)

The top court was ruling on a petition by a group of orchestra conductors, educators, performers, publishers and film archivists who urged the justices to reverse an appellate court that ruled against the group, which has relied on artistic works in the public domain for their livelihoods.

They claimed that re-copyrighting public works would breach the speech rights of those who are now using those works without needing a license. There are millions of decades-old works at issue. Some of the well-known ones include H.G. Wells’ Things to Come; Fritz Lang’s Metropolis and the musical compositions of Igor Fyodorovich Stravinsky.

The court, however, was sympathetic to the plaintiffs’ argument. Writing for the majority, Justice Ruth Ginsburg said “some restriction on expression is the inherent and intended effect of every grant of copyright.” But the top court, with Justice Elena Kagan recused, said Congress’ move to re-copyright the works to comport with an international treaty was more important.

For a variety of reasons, the works at issue, which are foreign and produced decades ago, became part of the public domain in the United States but were still copyrighted overseas. In 1994, Congress adopted legislation to move the works back into copyright, so U.S. policy would comport with an international copyright treaty known as the Berne Convention.

In dissent, Justices Stephen Breyer and Samuel Alito said the legislation goes against the theory of copyright and “does not encourage anyone to produce a single new work.” Copyright, they noted, was part of the Constitution to promote the arts and sciences.

The legislation, Breyer wrote, “bestows monetary rewards only on owners of old works in the American public domain. At the same time, the statute inhibits the dissemination of those works, foreign works published abroad after 1923, of which there are many millions, including films, works of art, innumerable photographs, and, of course, books — books that (in the absence of the statute) would assume their rightful places in computer-accessible databases, spreading knowledge throughout the world.”

Anthony Falzone, executive director of the Fair Use Project at Stanford University and a plaintiff’s lawyer in the case, called the decision “unfortunate” and said it “suggests Congress is not required to pay particularly close attention to the interests of the public when it passes copyright laws.”

The majority, however, rebuffed charges that a decision in favor of Congress’ move would amount to affording lawmakers the right to legislate perpetual copyright terms.

“In aligning the United States with other nations bound by the Berne Convention, and thereby according equitable treatment to once disfavored foreign authors, Congress can hardly be charged with a design to move stealthily toward a regime of perpetual copyrights,” Ginsburg wrote.

It’s not the first time the Supreme Court has approved the extension of copyrights. The last time was in 2002, when it upheld Congress’ move to extend copyright from the life of an author plus 50 years after death to 70 years after death.

The lead plaintiff in the case, Lawrence Golan, told the high court that it will not longer be able to perform Prokofiev’s Classical Symphony and Peter and the Wolf, or Shostakovich’s Symphony 14, Cello Concerto because of licensing fees.

from ap: A quote carved in stone on the new Martin Luther King Jr. memorial in Washington will be changed after the inscription was criticized for not accurately reflecting the civil rights leader's words.

The inscription currently reads: "I was a drum major for justice, peace and righteousness." The phrase is chiseled into one side of a massive block of granite that includes King's likeness emerging from the stone. It became a point of controversy after the memorial opened in August.

A spokesman for the U.S Department of the Interior said Friday that Secretary Ken Salazar decided to have the quote changed. The Washington Post first reported on Friday the decision to change the inscription.

The phrase is modified from a sermon known as the "Drum Major Instinct," in which the 39-year-old King explained to his Atlanta congregation how he would like to be remembered at his funeral. He made the February 1968 speech just two months before he was assassinated in Memphis, Tenn.

In the speech, King's words seem more modest than the paraphrased inscription: "Yes, if you want to say that I was a drum major, say that I was a drum major for justice. Say that I was a drum major for peace. I was a drum major for righteousness. And all of the other shallow things will not matter."

Poet Maya Angelou previously said the truncated version made King sound like "an arrogant twit" because it was out of context.

Solipsism: Solipsism ( /ˈ s ɒ l ɨ p s ɪ z əm /) is the philosophical idea that only one's own mind, alone, is sure to exist. The term comes from Latin solus (alone) and ipse (self). Solipsism as an epistemological position holds that knowledge of anything outside one's own mind is unsure. The external world and other minds cannot be known, and might not exist outside the mind. As a metaphysical position, solipsism goes further to the conclusion that the world and other minds do not exist. Although the number of individuals sincerely espousing solipsism has been small, it is not uncommon for one philosopher to accuse another's arguments of entailing solipsism as an unwanted consequence, in a kind of reductio ad absurdum. In the history of philosophy, solipsism has also served as a skeptical hypothesis.
Reason: Reason is a term that refers to the capacity human beings have to make sense of things, to establish and verify facts, and to change or justify practices, institutions, and beliefs.[1] It is closely associated with such characteristically human activities as philosophy, science, language, mathematics, and art, and is normally considered to be a definitive characteristic of human nature.[2] The concept of reason is sometimes referred to as rationality and sometimes as discursive reason, in opposition to "intuitive reason".[3]
1. Reason or "reasoning" is associated with thinking, cognition, and intellect. Reason, like habit or intuition, is one of the ways by which thinking comes from one idea to a related idea. For example, it is the means by which rational beings understand themselves to think about cause and effect, truth and falsehood, and what is good or bad.
2. In contrast to reason as an abstract noun, a reason is a consideration which explains or justifies some event, phenomenon or behaviour.[4] The ways in which human beings reason through argument are the subject of inquiries in the field of logic.
3. Reason is closely identified with the ability to self-consciously change beliefs, attitudes, traditions, and institutions, and therefore with the capacity for freedom and self-determination.[5]
Fallacies: In logic and rhetoric, a fallacy is usually an improper argumentation in reasoning resulting in a misconception or presumption. By accident or design, fallacies may exploit emotional triggers in the listener or interlocutor (appeal to emotion), or take advantage of social relationships between people (e.g. argument from authority). Fallacious arguments are often structured using rhetorical patterns that obscure any logical argument.
1. Fallacies can be used to win arguments regardless of the merits. Among such devices, discussed in more detail below, are: "ignoring the question" to divert argument to unrelated issues using a red herring, making the argument personal (argumentum ad hominem) and discrediting the opposition's character, "begging the question" (petito principi), the use of the non-sequitor, false cause and effect (post hoc ergo propter hoc), bandwagoning (everyone says so), the "false dilemma" or "either-or fallacy" in which the situation is oversimplified, "card-stacking" or selective use of facts, and "false analogy". Another favorite device is the "false generalization", an abstraction of the argument that shifts discussion to platitudes where the facts of the matter are lost. There are many, many more tricks to divert attention from careful exploration of a subject.[1]
2. Fallacies can generally be classified as informal (premises fail to support the proposed conclusion, but the argument is structured properly) or formal (logical structure is flawed).

from brasschecktv.com: To follow-up and accentuate yesterday's video on the public school/prison system, this news clip elaborates on the increasing police presence in schools and the drastic increase in students being arrested. On the surface you might think that the numbers would be related to increased drug usage or violence, and there is that, but look deeper and you'll find that much of it is due to a ridiculous and ever expanding list of arrestable offenses and increasing police presence. I, myself, can remember a time when a senior prank was just a prank, not a felony. The criminalization of youthful behavior promotes both conformity and disenfranchisement, so at the end of the day we are left with a bunch of mindless automatons (good citizens) or thoughtless rebels (who will eventually populate the real prison system). School police increasingly arresting American students...
