com circulação local, face recente decisão do Superior Tribunal de Justiça
amplamente divulgada na mídia, estampou em manchete que “A partir de agora,
pais que não derem carinho aos filhos serão condenados a pagar indenização a
eles”. &lt;br&gt;
&lt;br&gt;
Com a devida vênia, apressada e equivocada a afirmativa. &lt;br&gt;
&lt;br&gt;
Por primeiro, imperioso que se ressalte que a referida decisão não tem efeito
vinculativo como açodadamente noticiado. Vale dizer, a ela não está atrelado
nenhum outro órgão julgador, não significando, portanto, que se terá
substancial alteração do entendimento que de forma amplamente majoritária vem
prevalecendo. Em segundo lugar, não é definitiva, aliás sequer tomada de forma
unânime pelos julgadores, o que, em tese, viabiliza eventual reexame no próprio
âmbito do STJ, onde até aqui, repita-se, vem prevalecendo entendimento em contrário
ao argumento de que genitor omisso, “condenado a indenizar o filho por não lhe
ter atendido às necessidades de afeto, não encontraria ambiente para
reconstruir o relacionamento...”. &lt;br&gt;
&lt;br&gt;
Penso que ao final e ao cabo é o entendimento que haverá de prevalecer. A
melhor solução para as desavenças familiares é a conciliação e a mediação,
evitando-se o litígio e suas nefastas consequências. Não existe previsão legal
no ordenamento jurídico no sentido de impor aos pais a obrigação de amarem os
filhos e vice-versa, até porque se trata de algo natural, não necessitando, por
óbvio, de regras específicas para que ocorra. Mas mesmo quando esse basilar
princípio de convivência familiar na prática não se concretize, ainda assim,
insisto, não há razoabilidade para que a ausência de afeto reste compensada
pela imposição de indenização pecuniária. &lt;/span&gt;&lt;br&gt;

O final de ano coloca as pessoas em correria. As lojas e ruas dão sinais de um período especial, o ciclo do Natal. Confraternizações se multiplicam, viagens se realizam, aproximações acontecem.&lt;/blockquote&gt;

Para os que estão em conflito, ainda há tempo. A mediação é possível. Embora a descrença na possibilidade de reconstrução de elos e reatamento de diálogo, acreditar em uma forma de atendimento de conflito fora da proposta do processo é possível. Vale a pena investir na mediação.

A mediação tem como característica a voluntariedade. Por isso, quando as pessoas admitem a possibilidade da mediação já deram um passo decisivo à composição e passam a serem artífices, construtores da paz. O professor de Construção de Paz Internacional da Universidade de Notre Dame (EUA) expôs vários aspectos relevantes, entre eles, a diferença básica entre resolução e transformação de conflitos. A primeira abordagem se centra no conteúdo do conflito, de forma mais imediata, e procura conseguir uma solução para o problema que gera a crise. A animação, intitulada “Day &amp;amp; Night”, trata do encontro do Dia com a Noite. No início, esse encontro é marcado por desconfiança frente ao desconhecido “Outro”, mas,  à medida que a suspeita de vai se transformando em curiosidade, eles descobrem que essa nova amizade pode proporcionar-lhes uma enriquecida perspectiva sobre o mundo. Esse curta também pode ser visto uma metáfora da própria aceitação da Mediação de Conflitos por outras áreas mais tradicionais (como o Direito, por exemplo). &lt;/tbody&gt;&lt;/table&gt;&lt;div style="text-align: justify;"&gt;Finalizou no sábado (13/08) o programa internacional “O Modelo Circular Narrativo e os Sistemas Familiares”, na área de mediação familiar, ministrado por Sara Cobb e Carlos Sluzki, com a participação de Francisco Diez e Margarita Solari. Havia, também, Coordenadores Acadêmicos que auxiliaram os participantes, dentre os quais se destaca Marines Suares, cujos livros ajudaram a difundir o modelo circular narrativo na América do Sul. O curso, que ocorreu em Buenos Aires, teve 250 participantes, a grande maioria da Argentina, mas também do Chile, da Colômbia, do Equador e 26 pessoas do Brasil. Foi uma grande oportunidade de atualização sobre um dos modelos mais estudados nos cursos de Mediação de Conflitos. Muitas pessoas ainda acham que sabem mediar, quando na realidade estão conciliando e aconselhando; outras imaginam que fazendo um cursinho de final de semana ou de poucas horas poderão se tornar mediadoras, sendo que isto está longe da realidade. No dia 29 de junho a problemática da formação dos mediadores – e suas implicações na área profissional e pessoal – foi abordado no Grupo de Estudos sobre Mediação do Instituto dos Advogados do Rio Grande do Sul (IARGS). Algumas vezes, em nossas interações diárias, entramos em uma espécie de “piloto automático”, não escutando realmente o que os outros disseram e respondendo com frases feitas. Há um &lt;b&gt;vídeo&lt;/b&gt; interessante a respeito (veja abaixo), uma brincadeira filmada por duas pessoas empenhadas em mostrar o quanto as pessoas não ouvem o que os outros têm a dizer. “Opa, tudo bem? A Fazendinha, por favor, eu vou torturar uma idosa lá”, pergunta um dos &amp;quot;atores&amp;quot;. E o senhor a quem foi buscada a informação prontamente responde: “Virar a esquerda aqui, é a Fazendinha.” O que isso significa? &lt;/tbody&gt;&lt;/table&gt;&lt;div style="text-align: justify;"&gt;Após meses de expectativas, finalmente foi inaugurada em Porto Alegre a primeira Casa de Mediação da Ordem dos Advogados do Brasil (OAB) ontem (16/03). O projeto foi idealizado pela Comissão Especial de Mediação e Práticas Restaurativas da OAB do Rio Grande do Sul (CEMPR) e conta com o incentivo do Ministério da Justiça. &lt;/div&gt;&lt;div style="text-align: justify;"&gt;&lt;br&gt;
&lt;/div&gt;&lt;div style="text-align: justify;"&gt;O evento foi prestigiado por ilustres representantes do Governo do Estado, Tribunal de Justiça do RS, Ministério Público do Estado, Defensoria Pública do Estado, Tribunal Regional Federal entre outros. A pessoa pode ter pós-doutorado em mediação de conflitos, mas se nunca realizou uma mediação, não pode ser considerada mediadora. Da mesma forma, intermediar sem qualquer técnica ou conhecimento dos princípios da mediação a conversa de duas ou mais pessoas não faz de alguém um mediador. É no ponto de equilíbrio entre o conhecimento (teoria) e a habilidade (prática) que reside a mediação. Mas os verdadeiros mediadores são aqueles que refletem conhecimentos e habilidades em suas atitudes cotidianas – e uma dessas atitudes condiz com a gentileza.
