Another option is to have the existing marriage annulled. For example, due to different facts that were not apparent to one of the partners at the time of the marriage, a declaration of annulment can be given. If a marriage is declared invalid, it means that the marriage was not legal from the start and therefore did not exist.

Reasons for annulment

A marriage can only be annuled under certain conditions. This fact must be proven when applying for an annulment.

• A spouse concealed key aspects that impact marriage life at the time of marriage. For example, that he is unable to engage in sexual intercourse, has an incurable disease, or marries only for the purpose of inheritance. Even the silence about dependence on intoxicants (drugs or alcohol) can result in an annulment being successful. Annulment – expensive and lengthy

It is not easy to have a marriage annulled in the Philippines. Even if there are serious reasons for the dissolution of the marriage and an annulment is at least legally possible, the way there is long and expensive.

An annulment of a Filipino marriage can only be filed in the court of the applicant’s place of residence. The applicant must be registered at this location for at least 6 months at the time of submission.

For the annulment, costs must be expected from around 4,500 euros or more. However, these are highly dependent on the duration of the entire procedure, the costs for the lawyer and the necessary certificates and expert evaluations/opinions. Generally speaking, the longer the legal proceedings, the more expensive the annulment will be.

Annulment of a marriage in the Philippines – patience is required

The length of the legal process depends on many factors. For example what reason was given when submitting the annulment and whether special reports are necessary to secure evidence. The procedure may also be delayed due to illness or other obstacles.

An exact statement about the duration of the procedure cannot be made, but it should be assumed that it will take at least 6 months, mostly closer to 1.5 years. In individual cases, court hearings can take up to 6 years.

In this topic, we will be going through the different requirements that couples will need to have and what they need to go through in order to be married in the Philippines. 

First things first, whether the couple is to have a church or civil wedding, they must obtain a marriage license first. The groom and bride to be must head and appear together in the local civil registry of the city or municipality in which one of them is a resident.  The marriage license as stated by Article 17 of the family code will be released after 10 working days and either of the couple may pick up the license as there is no delivery option. After the issuance of the license it shall be valid for a total of 120 days and the couple may use it to get married anywhere in the Philippines. 

The following are the documents and information that the couple will need in order to obtain a marriage license:

1. Original birth certificates or baptismal certificate
2. General information must be provided such as full name, residence, and citizenship of legal guardians 
3. In the case that either the bride or the groom is not a Filipino citizen, they must provide their passport and a legal capacity to contact marriage. 
4. In the case that either of the couple is between 18 to 25 years old, they must provide proof to the local civil service that they have had receive marriage counselling.

There are some aspects that Schengen/ tourist visa is likely a big problem for a Filipino citizen. This is usually happened when one has lack of will to return in the country. Many Germans have already failed for their Filipina girlfriend at this hurdle, this seems like pure capricious.

But there are some tips that are not in the official documents, which should be respected at the invitation of the Filipino friend:

• It is recommended not to apply for the full 3 months vacation.
• For the visit, you should refer to a specific occasion (eg wedding, baptism of a relative, fair).
• The eye eats! For the appointment at the Embassy, you should pay attention to dress appropriately. It should avoid: High heels, mini skirt, piercings and tattoos, dazzling gold chains, eye-catching make-up & hair style.
• Even at the first impression, all documents should be neatly arranged and ready to go. There should be no documents in between which suggest the upcoming marriages.
• The most important point is the reaffirmation of the return to the Philippines. Reasons are: house or land ownership, a job, a business of its own or a previous Schengen visa and then returned on time.
• most of all, you should prepare yourself and the Filipina accordingly for the interview of the embassy. False statements lead to a devil’s circle and mean, in most cases, a rejection of the application.

Please also consider the following aspects for a marriage in Hong Kong:

15 days before the wedding, the printed documents must be in Hong Kong.

If you will only come to Hong Kong in order to marry and to execute as soon as possible the administrative wedding process, I recommend you to visit the city on Wednesday. Given that you have to present your original documents 2 days before, the administrative process can be made on a Monday. The whole process should be possible within one week, if you will execute the registration at the Philippine Consulate directly on Wednesday, after the wedding.

2 witnesses are required. It is naturally possible to choose a family member but it is also possible to look in Hong Kong for a witness. A few days before the wedding, you will find a lot of Filipinos who are willing to help you – but do not forget, some expect a small spending money. If you will choose this way, you will find someone in the Hong Kong Park or at the ground floor in front of the Philippine Consulate.

The option to marry with a “civil celebrant” – it may take a few days until you get your certificate, if you have chosen this way.

First of all, I would like to introduce you the process of Hong Kong marriage – from the beginning to the end. At first, it seems complicated and strange to go detour of a marriage across Hong Kong. Well, I thought that too. This is due to the obstacles of marriage in the Philippines or in Germany. My personal motive for getting married in Hong Kong was the marriage requirements of German authorities, which made the issue of a marriage visa unnecessarily difficult.

Why should a Hong Kong marriage be better?

The recognition in Germany is definitely advantage. Read more about the advantages about the marriage in hong kong. After issuing the certificate of marriage in Hong Kong, this can be certified by a so-called apostille. You can do the apostille in High Court Hong Kong. This makes the visa of family reunion for Germany recognized automatically. Only the certificate of A1-German is required to be past. The A1 test is conducted by Goethe Institute in Manila.

In our case, we sent an inquiry via email to the Marriage Registration and Records Office in Hong Kong (eg: announcement of our intended marriage). This is our first step for Hong Kong marriage.

After the announcement, the Marriage Registration and Records Office in Hong Kong  sent us a form sheets to complete the application.

• The “Notice of Intended Marriage” form must be completed and notarized.
• The form “Information Required for Registration of Marriage in Hong Kong” must be completed.

In addition, the following are the requirements for Hong Kong marriage:

People from the Philippines who get married into a German, needs to learn German language. One must prove that they have knowledge in  basic German language  before the departure. You must achive the A1 language certificate for the requirement of visa (for example, Marriage / Family Reunion visa ). The few bureaucratic processes and documents needed make it a very attractive and viable alternative for international couples. It was exactly the same for us. After severe problems to receive a marriage visa for Germany, we luckily found out about Hong Kong.

With the international apostille, which is recognized and gets accepted by the Germany embassy in Manila (Philippines) immediately, (and anywhere else for that matter) we were able to apply for the family reunion visa following our marriage in Hong Kong.

However, on Facebook groups and also various forums, people are still discussing and questioning whether or not a marriage in Hong Kong is worth it – which brings me to my first question.

When is it worth marrying in Hong Kong
and when is it actually not?

When you try and get married in Germany or the Philippines, the process takes very long because of the so-called certificate examination process, which is a process that authorities use to stretch out the time of your application.

The chances of this examination to take place following a marriage in Hong Kong are almost non-existent. It can happen, but rarely does, which is why so many German/Philippine couples decide to get married in Hong Kong.

We often receive calls or emails from couples following the successful wedding in Hong Kong. Almost always they just want to say thank you to us for providing them with the solution to their problem.

In some cases though, they tell us that they have been summoned for further certificate examination, which could have been prevented.

The further certificate examination has not been requested because of the marriage in Hong Kong itself, but almost always because there were mistakes on the documents coming from the Philippines. A birth certificate that got registered too late is one of the primary reasons.

Marriage in Hong Kong – what is a late registration?

A late registration means, that at the time of birth of the person in question, the personalization and identification had not been carried out properly.

This is something that needs to be corrected before hand but can take some time. It requires many different types of proofs from the PSA, to legitimize that the person is who they claim to be.

On top of that, this checking is not being carried out by someone from the German embassy, but from a separate caseworker.

Due to all these different complexities, we did a poll to see what people have to say about all this, and 2 opinions were dominant:

1. The vast majority has recommended a marriage in Hong Kong
2. In addition, it shows that this was due to a large number of people experiencing huge problems with a marriage in Germany and the Philippines – often due to the very lengthy process of bureaucratic obstacles.

The Questionnaires and Research are clear

The results we had received are very clear indeed; most people favoured a wedding in Hong Kong.

Just as we had assumed, many people told us about the numerous problems they unfortunately experienced with trying to get married in Germany or the Philippines. 

Our summary to a marriage in Hong Kong:

A marriage in Hong Kong is by far the superior choice, especially if you are not being summoned to a further certificate examination, which we prevent though in almost all cases, with the correct submission of all relevant documents, including a correct birth certificate.

However, we found out that even if that was to happen, a wedding in Hong Kong is still much faster and a simpler process than the other options available to couples.

We would never explicitly tell you to not get married in Germany or the Philippines, but the bureaucratic obstacles created in this process are simply not present when marrying in Hong Kong.

So besides our own experience, we were able to determine that a marriage in Hong Kong is indeed the easiest solution for mixed couples from Europe and Asia.

In fact, for almost any country it is one, if not the, easiest way to get married and have that marriage be accepted and recognized worldwide for visa purposes.

Some coountries are allowed to enter without visas for a stay not exceeding thirty (30) days to the Philippines. Therefore, Travelers just need to provided their valid tickets for their return journey to port of origin or next port of destination and their passports valid for a period of at least six (6) months beyond the contemplated period of stay in the country.

In addition to free Philippines visa, it is important to show the round-air ticket or an onward ticket at every time, if necessary.

Travelers need leave beefore the end of the permitted 30-day visa-free in the country and in case of re-entry, visitors can have the sum of all visa-free not more than 90 days per half-year stay in the Philppines. Your residence permit on the passport is stamped on the arrival airport. This rule applies to most people from Germany, Holland, Austria, Switzerland, Turkey and several other countries.

For travellers who are planning a longer stay in Philippines, there is also the possibility of a Visa application status at the Philippine Embassy; tourist Visas are issued with a maximum validity of 60 days. The non-immigrant Visa is valid for a stay of up to 90 days. Both types of Visas are extended by 30 days as a rule

Visitors need to apply for Philippines visa in oder to stay longer than 6 months in the Philippines.

The visitor must apply for the Philippines visa  to the Philippine Embassy or Consulate and bring the following documents:

• A completed visa application (form No. 2-A) for each applicant
• Passport of the applicant for at least 6 months for at least 6 months after the subsequent exit from the Philippines validity
• A passport size photo
• Return ticket or a ticket confirmed by the travel agency

Visitors can applied the following visa types (rounded figures) in the embassy:

• 3 month visa (entry A) 27, – €
• 6 month visa (multiple entries) 54, – €
• 12 months visa (multiple entries) about 81, – €

Balikbayan visa:

If you arrive with a Filipino in order to marry him/her, a so-called Balikbayan stamp will be stamped into the passport after presenting of the marriage contract. This entitles the holder to stay for one year with free of charge and without prior application. This stamp will also be given, if a Filipino adopted another citizenship.

Permanent Residence: The following documents are required if a spouse of a Filipino wants to have residence permission without much effort and financial evidence:

• Complete application
• Passport (on site Tourist Visa with)
• Med. reconnaissance detection (possibly translated in English)
• Police clearance certificate
• 6 passport photos 1 x 1 and 6 passport photos 2 x 2
• Marriage contract

Basically anyone can get the so-called permanent or resident Visa for the Philippines, but it is connected with different financial cost. In addition to the “normal requirements” such as the passport application, passport photos, health certificate, and etc. the following documents will also be required:

Marriage: If a foreigner will be married to a Filipino/Filipina, a Permanent Resistance Visa (13 A) is applied in the visa:

• Completed application
• “Petitions” of the Filipino spouse
• Fee of 20.000, – Peso (10,000 for the request & 10,000 for the exhibition)
• Certificate of good conduct of the phil. Embassy; Berlin
• Marriage certificate in English, issued or certified by the phil. Embassy
• Birth certificate of the phil. spouse authenticated by the NSO
• Immigration Clearance Certificate (provides immigration)
• Health certificate issued by an certificated doctor or hospital by the PLRA
• 6 passport photos 2 x 2
• Proof  that the person is able to take care himself and his family
• There will be also other possibilities to obtain the VISA; for this please contact the next Immigration office.
• This VISA can also be issued by the Philippine Embassy in Germany

A duration of Philippines visa is applied for those who are not married to a Filipino nationals at the Philippines, this will be issued by the PLRA and it is grouped in two categories:

Without a pension:

35 – 49 years old: 50,000 – US $ on a fixed deposit account at the Philippines
50 years and older: 20,000 – US $ on a fixed deposit account at the Philippines
Former Filipinos: 1500, – US $ on a fixed deposit account at the Philippines
Formerly foreign. Ambassador: 1500 – on a fixed deposit account at the Philippines (applies to Ambassador & staff of foreign organizations who have served the Philippines.)

With a pension of at least US $ 800 (single) or 1000, – US $ (couple):

from 50 years old: 10,000 – US $ on a fixed deposit account at the Philippines
