Toll Brothers Offers 3.99% Loans

The home builder is slashing borrowing costs for new buyers in an effort to revive the abysmal market.

NEW YORK (CNNMoney.com) -- One of the nation's largest builders is trying to shock the flatlining new-home market into action with an incentive plan that will slash monthly mortgage payments for qualified buyers.

Luxury homebuilder Toll Brothers Inc., said Wednesday that it will offer buyers of its existing new-home inventory a 30-year, fixed-rate mortgage at an interest rate of 3.99% with no points paid up-front. That contrasts with a rate of 5.59% for the average 30-year, fixed-rate mortgage with 0.3 up-front point, as reported this week by Bankrate.com.

A buyer taking a Toll Brothers mortgage, as opposed to the 30-year rate quoted by Bankrate, could lower their monthly mortgage payments to $1,988 from $2,391, a savings of $403 a month on a $417,000 loan (the maximum mortgage loan that will be bought or guaranteed by Fannie Mae (FNM, Fortune 500) or Freddie Mac (FRE, Fortune 500) in most places).

"The offer is aimed at people waiting for the rates to drop," said Don Salmon, CEO of TBI Mortgage, the Toll subsidiary that will provide the mortgages. "It will be a strong catalyst for potential buyers to get off the fence."

New home sales have been extremely slow. In November, the latest month for which statistics are available, sales of new homes fell to an annualized rate of 407,000, down 2.9% from 419,000 in October and off 35.3% from November 2007.

The Toll Brothers (TOL, Fortune 500) offer is only in effect through Sunday, so buyers will have to act quickly. It's available on homes in 270 Toll communities across 21 states, according to Fred Cooper, Toll's senior VP of financing. He said the program has drawn an immediate response; the phones have been ringing off the hook.

Then, late Thursday, the company sweetened its offer, announcing that the 3.99% rate could also be locked in for as long as nine months. That option is aimed at Toll customers who want to purchase a new, built-to-suit home, rather than existing inventory.

Tough Times Ahead

Real Estate projections for 2009-2010 are grim, and there is no way to sugar coat the news. Housing experts met in Las Vegas this week for the International Builders' Show to discuss trends and projections on "the recovery" and to meet with expert economists.

Economists predict there will be further declines in homes prices, new construction starts and the number of home sales, while mortgage defaults, foreclosures and unemployment rates continue to climb. It is the simple supply and demand theory...a "turn around" will not happen until the quantity of unsold homes that are on the market decrease. There are too many homes for sale on the market with not enough buyers in the market to purchase them. Buyer confidence is at an all time low for making significant purchases in this economy when the uncertainty of employment stability looms over all our heads.

To make matters worse, a risk index predicts that 97 % of the nation's metropolitan areas had a greater probability of home prices falling over the next two years. In addition, over half of these metropolitan areas have a risk index of home price declines greater than 50 %.

Housing Prices Have Hit 2004 Levels

The offer you receive today is most likely going to be the best offer you are going to get for a very long time. Michelle Meyer, an economist at Lehman Brothers Holdings Inc. in New York, said in an interview with Bloomberg Television "In terms of prices, we don't think we'll see a bottom until the end of next year."

The number of closed transactions are slightly up from 2007 to 2008. According to the Florida Association of Realtors press release on Monday, Palm Beach County had 652 sales in July, that number is up 8 percent from 605 sales a year ago. The median price of home in Palm Beach County is currently $291,300 falling 22 percent from $372,200 a year ago.

South Florida Sellers are having an extremely difficult time coming to terms with the hard reality that their properties are no longer valued at what they thought their properties should be. Buyers actively searching for a home are aware the market is in their favor and are quite verbal that there is a massive amount of inventory to select from and that price is their motivation!

In the Luxury Real Estate Market, Sellers are slowly and painfully accepting that what is happening elsewhere at lower price points is also "trickling up" to their unique market. Fewer Buyers are purchasing second homes in this volatile economy, financing is harder to secure, purchasing homes for cash is a thing of the past, and rising country club dues and fees are becoming less and less attractive. We are noticing that the younger, wealthier Buyers are choosing to go into more moderate priced homes or gated communities to gain "more house for their money". The appeal of moving into the fancy, very expensive gated golf community has lost a lot of its luster in the last couple of years.

Mike Pappas, head of The Keyes Co. in Miami, said Palm Beach County's price plunge shows buyers are demanding bargains. "The only way you're going to move a property today is because of price," Pappas said. "You're seeing that reflected in the numbers."

Pappas and others say property owners shouldn't expect the value of their homes to rise much more than the rate of inflation, which hovered at about 3 percent a year during the boom. "The market is taking the excesses out and penalizing us to get back to the normal, historic appreciation trend," Pappas said. "It's a painful process."

For months, Realtors have been noticing that that their phones are beginning to ring with calls from eager buyers and the number of showings have also increased. Realtors have all been hoping that the end might be in sight soon. But more skeptical observers say prices have further to fall before they're affordable and attractive to Buyers. "We've been saying prices were going to go back to 2003 levels," said Jack McCabe, a housing analyst based in Deerfield Beach. "Now, I'm starting to think it may be even worse than that." McCabe pointed to the glut of homes on the market, and he said prices remain out of reach.

What's more, he expects the flood of foreclosures to continue to hurt home values. "We've probably seen only 30 percent of the foreclosures we're going to see over the next few years," McCabe said. The number of sales in Palm Beach County rose slightly to 652 in July, up 8 percent from a year ago but down 12 percent from the previous month.

Home prices in Palm Beach County have plunged to a four-year low in July, only to raise new questions about just how much farther can property values fall. The last time the median home price in Palm Beach County was $300,000 it was May 2004, when property values were in the middle of their stratospheric rise. Late 2005, when Palm Beach County real estate was the hottest investment this side of Google, home prices have dropped 30 percent. "It's a massive dip over the past couple years, there's no two ways about it," said John Mike, president of the Realtors Association of the Palm Beaches. "The buying public is unnerved about what's been happening in the general economy."

The median condo price in Palm Beach County was $152,300, down 15 percent from a year ago. The number of sales jumped 16 percent.

The national housing market continued to struggle, too, the National Association of Realtors said Monday. The national median existing-home price was $212,400 in July, down 7.1 percent from a year ago, when the median was $228,600. Home sales, however, rose 3.1 percent.

Sales of existing homes in the South tumbled 18 percent in July from a year ago, while the median price fell 3.5 percent to $179,300.

Home Sellers Suffering Huge Losses

25% of home sales result in loss

Values have fallen so far in many cities that sale prices don't cover what sellers originally paid. That means more hard times before markets recover.

NEW YORK (CNNMoney.com) -- More homeowners than ever are selling at a loss, propelling the real estate market deeper into crisis.

In the 12 months that ended June 30, nearly 25% of all homes sold nationwide fetched less than sellers originally paid, according to real estate Web site Zillow.com.

While the nation's double-digit decline in home prices has been well documented, the new report underscores the economic force of those price declines. Homeowners are walking away with much less in their pocket when they sell. And that affects more than the real estate market.

"It's stunning what's happening out there," said Stan Humphries, Zillow's vice president of data and analytics, who looked at statistics that date back to 1996. "The numbers are the worst we've seen and it's not just the magnitude of the problem but the scope - so many markets are affected."

In Merced, Calif., 63% of homes sold during the past 12 months brought in less than what the owner paid. Prices there have fallen 40% over the past 12 months and 56% from their 2006 peak.

About 63% of sellers in Stockton, Calif., lost money during the same period, 60% in Modesto, Calif., 55% in Las Vegas and 38% in Phoenix.

And the trend has worsened in recent months. In Merced, 74.9% of sellers took a loss when they sold during the three months ended June 30 compared with just 28.7% during the same period in 2007.

The experience of one would-be seller in Cape Coral, Fla., illustrates the kinds of losses sellers are suffering. The homeowner, who asked not to be named, paid $147,000 in 2003 for a three-bed, two-bath ranch. Prices have dropped there more than 22% in the past 12 months.

He said he made a 10% downpayment and spent big on upgrades, including two renovated baths. The house was appraised at $279,000 two years ago. Two months ago: $140,000. He has been trying to sell it for more than a year and has dropped the price to $129,900.

"It's terrible," he said. "I'm taking a major loss. I'll probably have to bring a check to the closing."

The short-sale solution

Many sellers are so underwater that their only solution is a short sale. Elsa Bell, a claims adjuster, bought her Riverside, Calif., house in 2006 for $330,000, using a no-down-payment loan. In April she put the house on the market for $275,000, but it hasn't sold.

"The bank is willing to do a short sale, and we have an offer of $170,000 on the house, but we believe the bank will turn that down," Bell said.

A short sale is when a lender agrees to take less than the amount it is owed on a mortgage and forgives the remaining debt.

For Bell, whatever the sale brings, it's going to be a lot less than what she paid.

The good news is that she should get out of the deal fairly clean. Since she has little invested, she has little to lose. The bad news is that a short sale may mean a hit to her credit score.

Nationwide, nearly a third of all homeowners who bought since 2003 owe more on their homes than the homes are worth. And those that, like Bell, put little or none of their own money into the home purchases, are more likely to try to sell short or simply abandon their homes.

"They hand over their keys and walk away from the homes," says Danielle Babb, a real estate investor, instructor at the University of California Irvine and author of "Finding Foreclosures."

That adds to foreclosure rates. Zillow reported that nearly 15% of U.S. existing home sales during the last 12 months involved foreclosed homes.

That trend will almost surely continue.

In Stockton, Calif., 2006 buyers now owe a median of nearly $171,000 more than their homes are worth. In Salinas, Calif., 2006 buyers now have median negative equity of $161,000, and in Merced, the figure is nearly $160,000.

Broader impact

A plethora of sellers taking losses can have a chilling effect on people's lives, says Dean Baker, co-director of the Center for Economic and Policy Research in Washington.

People don't want to sell at a loss, so they put off their plans, whether it's a move for a better job opportunity elsewhere or trading up to a larger home.

"That will delay the [market correction]," said Baker. "It takes time for people to recognize that [these losses] are real."

A quick turnaround is not likely. More than $200 billion in adjustable rate mortgages are scheduled to reset during the second half of 2008, according to the National Association of Realtors, and loans of all types defaulting at high rates. There is also about 11 months of inventory at the current rate of sales.

"With $3.9 million unsold homes on the market, prices will have to come down even more before the market stabilizes," said Zillow's Humphries

Welcome Back to the Mizner Country Club-Real Estate News:

Let's get started since there is a lot to cover this week! Mizner Country Club currently has (62) Active Listed Properties for sale, (2) Pending Properties awaiting closing and a total of (9) Properties that have Sold Year-to-Date in 2008.

If we take a look at the same time frame last year in 2007, Mizner Country Club had (17) Year-to-Date (January thru July) sold properties as opposed to only (9) properties sold so far in 2008. It is quite evident that our community has greatly been affected by the current state of the national and local real estate market.

Performance for the community is way off from last year's sales numbers. Pricing is still the main issue as to why so many homes have lingered on the market for so long in Mizner. We notice as Real Estate Professionals, that when a property is well priced from the inception of the listing, a sale is much more quickly achieved than those that remain at higher list prices. Buyers are out there! But they are refusing to negotiate and enter into contracts with Sellers that are holding firm at 2005 prices.

If Only... We Should All Be This Lucky!

While the rest of the entire country is having a difficult time selling their properties in this tough real estate market, it seems that life for those who live and sell property on Palm Beach island is a bit rosier and more surreal than ever. Palm Beach has experienced record breaking sales in 2008. Making it an extremely lucrative selling year for both the Sellers and the Realtors on the island.

Recently, the Addison Mizner-designed "Casa Nana Estate" has been put on the market for an astounding $72.5 Million! Not to shabby... since it was purchased back in 2003 for a then record price of $30.25 Million. It seems this property has a bit of a lucky streak, it has set three sales records in its history. Casa Nana's beauty has often been compared to another magnificent property on Palm Beach, "Mar-a-Lago" owned by Donald Trump.

Speaking of Mr. Trump, take a look a yesterday's Palm Beach Daily News:

Donald Trump Closed Record $95 Million Deal
For Palm Beach Mansion

Donald Trump closed the deal Tuesday on his record sale of 515 N. County Road, the former Abe Gosman estate, to Russian fertilizer mogul Dmitry Rybolovlev. The sale of the six-acre estate was announced in May. Palm Beach attorney Paul Rampell represented Trump in the transaction.

Though Trump calls it a $100 million deal, the deed lists the sale price as $95 million. Trump, in a call from his office in New York, said the higher figure includes closing costs. The document stamp for the deed is $665,000.

The slightly shaved price still sets the record for a Palm Beach property and possibly the United States. It demolishes the recent record, $81.5 million, paid in April for 1236 S. Ocean Blvd.

Trump said he was not sure whether reports indicating Rybolovlev purchased the property as an investment, rather than a personal home, are true.

"I really don't know for what purpose," Trump said. "I'd imagine it'd be for a home but I don't know, other than I know he made a great deal. I think time will prove that out."

The real estate developer and reality show star said reports that he spent $25 million to renovate the mansion are false.

Construction permits issued since Trump bought the property in 2004 have a listed value of $502,470, according to Jackie Kervey, records manager for the Town of Palm Beach.

"I always looked at it as a teardown," Trump said.

In any event, Trump said, the size of the sale is positive news for Palm Beach. "It's good because of the times," he said, referring to the nation's economic downturn.

Toll Brothers Reports $93.7 Million Loss

PHILADELPHIA — Luxury-home builder Toll Brothers Inc. on Tuesday posted a second-quarter loss that was smaller than Wall Street expected, as a hefty write-down driven by joint ventures was offset by other income.

Shares of Toll Brothers rose 64 cents, or 3.1 percent, to $21.60.

Chief Executive Robert Toll said demand continues to be weak in most markets as buyers stay skittish in the face of continued home price declines.

In a conference call with analysts, Toll also noted that investment funds have been showing interest in buying distressed properties. They're willing to partner with people in the housing industry in these purchases, providing even 80 to 90 percent of the capital.

But Toll said if their investment doesn't perform, then they might try to dump the homes _ and in so doing prolong the housing downturn.

"We've been outbid by the players that have raised the funds for this specific purpose. I hope everything works out for them," Toll said. "But if it doesn't, you may see this (investment) prolongs for quite a bit of time the problems that we've got."

Toll Brothers itself will continue to offer incentives to get people to buy homes _ a concession uncharacteristic of the builder that speaks to the severity of the housing market.

But Deutsche Bank analyst Nishu Sood said the builder should more aggressively discount because "by holding prices the company is just delaying the inevitable as prices are unlikely to revisit boom time levels for a prolonged period."

The company hasn't written off as much as other builders, and as such has a higher share of these charges to come, he wrote in a research note.

For the period ended April 30, Horsham, Pa.-based Toll reported a loss of $93.7 million, or 59 cents per share, compared with a year-ago profit of $36.7 million, or 22 cents per share.

The quarter included a pretax write-down of $288.1 million, which included $85 million from joint ventures with other builders on land development.

Toll also posted $40.2 million in gains from a property condemnation process, in which municipalities compensate landowners for taking their parcels to develop parks and other projects.

Without these charges and gain, Toll earned $81.3 million, or 49 cents per share, compared with $109.6 million, or 66 cents, a year ago.

Revenue fell 30 percent to $818.8 million from $1.17 billion last year.

Analysts surveyed by Thomson Financial expected a loss of 89 cents per share including charges on sales of $818.5 million.

Net contracts, an indication of future business, fell by 58 percent to $496.5 million in the quarter from a year ago. Cancellations totaled $234.1 million, down from $274.7 million last year.

The average home price on net contracts fell to $534,000 from $710,000 in 2007's second quarter.

Geographically, sales fell 45 percent in the southern states of Florida, Georgia, the Carolinas and Texas. The mid-Atlantic, covering Pennsylvania, Delaware, Maryland, Virginia and West Virginia, declined by 39 percent. The west, comprising California, Arizona, Colorado and Nevada, was down 28 percent.

Toll's northern region of New Jersey, New York, Connecticut, Rhode Island, Illinois, Massachusetts, Michigan and Minnesota fell 3.3 percent.

Net contracts fell 79 percent in the north, 62 percent in the west, 44 percent in the mid-Atlantic and 31 percent in the south. But the housing meltdown isn't affecting Manhattan, where Toll said homes have temporarily sold out.

The company said the quarter's backlog of homes ordered but not yet delivered totaled $2.08 billion, down 50 percent year-over-year.
