The way they internet or Roads evolved into existence is a case study for creating a platform, and then allowing use to dictate the regulation.  When it comes to implementing safer roads we can go faster on, we simply decided to restrict road speeds.  After all, we have airports, and physical travel is fairly intuitive.

When it comes to network access, there are plenty who recognise the value in being able to control the space.  So we get exclusivity contracts in place for handsets, and would likely have similar monopolies if we didn't have a central body able to legislate itself rich from the coming competition.  

The problem is, legislators got where they are for their ability to unpick complexity, as opposed to a Steve Jobs like ability to drive towards simplicity. I can go .5 miles south or 1.5 miles North on Allens Creek Road and can access cellular networks. Here we are unable to get over the air television unless it is through a satellite provider (ie. Dish/ Directv).
