	The Federal Aviation Administration (FAA) is proposing a civil penalty of $262,000 against Ameriflight, LLC, of Burbank, Calif., for allegedly violating Department of Transportation Workplace Drug and Alcohol Testing programs and provisions of the company&amp;rsquo;s FAA-approved Antidrug and Alcohol Misuse Prevention Program.&lt;/p&gt;
&lt;p&gt;
	The FAA alleges Ameriflight conducted the Department of Transportation&amp;rsquo;s required pre-employment drug tests, but did not wait to receive verified negative drug test results before hiring 14 people to perform safety-sensitive flight crew or maintenance duties. Ameriflight allegedly used the individuals to perform the safety-sensitive duties, again before receiving verified negative drug test results. The alleged violations of federal regulations occurred between March 2009 and March 2010.&lt;/p&gt;
&lt;p id="yui_3_2_0_5_131437730799687"&gt;
	The FAA also alleges Ameriflight failed to administer periodic alcohol tests to 11 randomly-selected individuals, as required by Department of Transportation regulations and Ameriflight&amp;rsquo;s random testing program.&lt;/p&gt;

	WASHINGTON &amp;ndash; U.S. Transportation Secretary Ray LaHood today announced that the Federal Motor Carrier Safety Administration (FMCSA) and its state and local law enforcement partners across the nation recently conducted 2,782 surprise passenger carrier safety inspections over a nine-day period that resulted in 289 unsafe buses or drivers being removed from our roadways.&lt;/p&gt;
&lt;p&gt;
	The unannounced inspections took place from March 28 through April 6, 2011, as part of FMCSA&amp;rsquo;s ongoing efforts to strengthen passenger carrier safety nationwide.&amp;nbsp; The coordinated enforcement strike force issued out-of-service violation citations to 156 drivers and 262 vehicles.&lt;/p&gt;
&lt;p&gt;
	Previously, from March 12 to March 28, an estimated 3,000 passenger carrier safety inspections were conducted across the country, resulting in nearly 300 passenger carrier vehicles being put out of service during the 17-day timeframe.&lt;/p&gt;
&lt;p&gt;
	&amp;ldquo;Safety is our number one priority,&amp;rdquo; said Secretary LaHood. &amp;ldquo;We will continue to use every resource at our disposal to shut down unsafe passenger bus companies that place motorists at risk and remove drivers from our roads who put passengers in harm&amp;rsquo;s way.&amp;rdquo;&lt;/p&gt;
&lt;p&gt;
	In addition to the strike force inspections, FMCSA and state safety investigators initiated 95 full safety compliance reviews on commercial passenger bus companies. These reviews determine a passenger carrier&amp;rsquo;s safety rating.&lt;/p&gt;
&lt;p&gt;
	&amp;ldquo;Working side-by-side with our state and local law enforcement partners, we can ensure that every passenger bus company and driver operates as safely as possible,&amp;rdquo; said FMCSA Administrator Anne S. Ferro. &amp;ldquo;These strike force activities are one of the many effective tools we use year-round to raise the safety bar for commercial buses and drivers on our nation&amp;rsquo;s roadways.&amp;rdquo;&lt;/p&gt;
&lt;p&gt;
	FMCSA has significantly increased the number of safety inspections and compliance reviews the agency conducts on the nation&amp;rsquo;s estimated 3,700 registered motor coach companies.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;
	The number of roadside safety inspections of motorcoaches has doubled from 12,991 in 2005 to 25,703 in 2010.&amp;nbsp; Compliance reviews on motorcoach companies more than doubled from 457 in 2005 to 1,042 in 2010.&lt;/p&gt;
&lt;p&gt;
	Passenger fatalities have decreased from 57 in 2004 to 46 in 2009, a 19 percent reduction.&lt;/p&gt;
&lt;p&gt;
	In 2009, the Obama Administration sought to make long-needed improvements to motorcoach safety through a new Motorcoach Safety Action Plan. The U.S. Department of Transportation (DOT) has proposed rules that will require buses to have seat belts and electronic on-board recorders to replace easily falsified paper records of driver hours and determine how best to strengthen driver heath requirements and enforcement programs.&lt;/p&gt;
&lt;p&gt;
	Last year, DOT also sought to curb distracted driving incidents by adopting a regulation banning commercial drivers from texting behind the wheel and initiating a rulemaking to ban hand-held mobile phone use.&lt;/p&gt;

The company was renamed ST Aerospace San Antonio in November 2009 and is a subsidiary of Singapore Technologies Aerospace, Ltd.; however, the alleged violations occurred before the company changed its name.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt; &lt;/p&gt;
&lt;p&gt;&lt;span style="color: #808080;"&gt;The FAA alleges San Antonio Aerospace failed to conduct required pre-employment &lt;span id="lw_1295549560_7"&gt;drug tests&lt;/span&gt; and receive verified negative &lt;span id="lw_1295549560_8"&gt;drug test results&lt;/span&gt; before hiring 90 people to perform safety-sensitive functions, a violation of federal safety regulations. Twenty-five of the employees performed safety-sensitive work before the results of their &lt;span id="lw_1295549560_9"&gt;drug tests&lt;/span&gt; were known. The violations occurred between March 24, 2007 and May 8, 2008.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt; &lt;/p&gt;
&lt;p&gt;&lt;span style="color: #808080;"&gt;“Required pre-employment &lt;span id="lw_1295549560_10"&gt;drug testing&lt;/span&gt; is an important part of the government’s effort to ensure safety at all levels of transportation,” said &lt;span id="lw_1295549560_11"&gt;U.S. Transportation Secretary Ray LaHood&lt;/span&gt;. “We take these violations very seriously. ”&lt;/span&gt;&lt;/p&gt;
&lt;p&gt; &lt;/p&gt;
&lt;p&gt;&lt;span style="color: #808080;"&gt;The FAA alleges San Antonio Aerospace did not administer pre-employment drug tests to 62 workers and did not receive verified negative results prior to the date those workers were hired. Twenty-three of the workers performed safety-sensitive work before the tests were administered and before the company received verified negative results.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt; &lt;/p&gt;
&lt;p&gt;&lt;span style="color: #808080;"&gt;Another 22 workers received the required pre-employment drug test, but the company did not receive verified negative results until after those workers were hired. Two of those workers performed safety-sensitive tasks before the company received verified negative results. Another six workers took their pre-employment drug tests on the day they were hired.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt; &lt;/p&gt;
&lt;p&gt;&lt;span style="color: #808080;"&gt;“Safety is compromised when our regulations are skirted or ignored,” said FAA Administrator Randy Babbitt. “The traveling public has to be confident that the people who perform work on their planes are complying with those regulations. ”&lt;/span&gt;&lt;/p&gt;
&lt;p&gt; &lt;/p&gt;

	The &lt;span id="lw_1295639875_2"&gt;Federal Aviation Administration&lt;/span&gt; (FAA) is proposing a $170,000 civil penalty against Pemco World Air Services of Dothan, Ala., for allegedly failing to administer pre-employment &lt;span id="lw_1295639875_3"&gt;drug tests&lt;/span&gt; for two individuals the company hired for safety-sensitive positions.&lt;/p&gt;
&lt;p&gt;
	The FAA also cited Pemco for failing to carry out required follow-up drug or alcohol testing on eight individuals reinstated after completing return-to-duty training during 2008.&amp;nbsp; In all, the company failed to carry out 24 required follow-up tests.&amp;nbsp; Failing to administer the pre-employment and reinstatement tests are violations of the &lt;span id="lw_1295639875_4"&gt;Federal Aviation Regulations&lt;/span&gt;.&lt;/p&gt;
&lt;p&gt;
	The FAA inspected Pemco&amp;rsquo;s pre-employment test program three times, and each time the FAA determined it had not complied with the requirements. &lt;p&gt;The IFR provides instructions to employers, collectors, laboratories, and Medical Review Officers (MRO) for use of the new Department of Health and Human Services (HHS) Federal Drug Testing Custody and Control Form (CCF), and it offers at technical amendment to laboratories regarding mandatory reporting of confirmed positive drug / drug metabolites quantitations to MROs. &lt;span style="text-decoration: underline;"&gt;The effective date of the IFR is October 1, 2010.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;&lt;span style="text-decoration: underline;"&gt;Regarding Use of the CCF:&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;1. DOT-regulated employers and their services agents are authorized to begin using the new CCF on &lt;span style="text-decoration: underline;"&gt;October 1, 2010.&lt;/span&gt;&lt;/p&gt;
&lt;ol&gt; &lt;/ol&gt; 
&lt;ul&gt;
&lt;li&gt;A copy of the new CCF can be found by just &lt;a href="http://www.neweradrugtesting.com/files/Attachment.pdf" target="_blank" title="New CCF Form"&gt;Clicking Here&lt;/a&gt;:&lt;/li&gt;
&lt;/ul&gt;
&lt;p&gt;2.  The IFR provides instructions for:&lt;/p&gt;
&lt;p&gt;a. Filling out step 1-D on Copy 1 of the new CCF, which now lists includes the Federal testing authorities - HHS; DOT; and Nuclear Regulatory Commission (NRC), with further specificity for the DOT Agencies - FMCSA; FAA; FRA; FTA; PHMSA; and the USCG;&lt;/p&gt;
&lt;p&gt;b. Filling out Step 5-A on Copy 1 of the new CCF, which now lists MDMA, MDA, and MDEA, as well as "Δ-THCA" after "Marijuana Metabolite" and "BZE" after "Cocaine Metabolite" to specify the drug analytes;&lt;/p&gt;
&lt;p&gt;c. Filling out the Step 6 on Copy 2 of the new CCF, which now has a line for the MRO to note the drug(s) for which a positive result is verified, and a new line item "other" for documenting other "refusal to test" situations - for example, when there is no legitimate medical explanation for the employee providing an insufficient amount of urine;&lt;/p&gt;
&lt;p&gt;d. Filling out Step 7 on Copy 2 of the new CCF, which now has a box the MRO is to check if a split specimen is reported as cancelled; and&lt;/p&gt;
&lt;p&gt;e. Revised instructions for completing the CCF are on the reverse side of Copy 5.&lt;/p&gt;
&lt;p&gt;3. &lt;span style="text-decoration: underline;"&gt;Use of old CCFs is permitted through September 30, 2011&lt;/span&gt;, because of the large number of existing supplies. If the old CCF is used on or before September 30, 2011, collectors and laboratories will:&lt;/p&gt;
&lt;p&gt;a. &lt;strong&gt;&lt;span style="text-decoration: underline;"&gt;Collector:&lt;/span&gt;&lt;/strong&gt; Write in the specific DOT Agency under which the specimen is collected in the Remarks Section in Step 2 on Copy 1 of the old CCF.&lt;/p&gt;
&lt;p&gt;b. &lt;strong&gt;&lt;span style="text-decoration: underline;"&gt;Laboratory:&lt;/span&gt;&lt;/strong&gt; Before transmitting a confirmed positive drug test for MDMA, MDA, of MDEA, as appropriate, to the MRO, check "positive" box and write in the specific MDMA, MDA, or MDEA analyte in the "Remarks" section in Step 5-A of Copy 1.&lt;/p&gt;
&lt;p&gt;&lt;span style="text-decoration: underline;"&gt;Other Items: &lt;/span&gt;&lt;/p&gt;
&lt;ul&gt;
&lt;li&gt;In harmonizing with HHS, Part 40 will required mandatory reporting of confirmed positive drug /  drug metabolite quantitations by laboratories to MROs.&lt;/li&gt;
&lt;/ul&gt;
&lt;ul&gt;
&lt;li&gt;A new section &lt;span&gt;§40.14 was added to spell-out, in one place, the information employers and their C/TPAs must routinely provide to collectors. &lt;br /&gt;&lt;/span&gt;&lt;/li&gt;
