변상금관련 법조항, 국민의 평등권 침해

안녕하십니까?

저는 한 사건(변상금부과처분취소)에 두 개의 서로 다른 확정 판결로 민소법 제451조 제1항 제10호(동법 제457조 적용)로 재심을 준비 중 여러 가지 자료를 찾다가 행정청의 국유재산변상금부과 처분이 이 나라 헌법정신에 위배된다는 사실(평등권침해)을 알게 되었습니다.

자료1. 국유지, 공유지 변상금과 취득 시효관계

자료에서 보듯 국공유지를 무단으로 점유한 자에 대해서는 이 변상금부과처분이 국가의 재정적 이익을 위해서 보호받아야 마땅하나 최근 강남구 포이동(판자집 화재사건) 사건에서 보듯, 국가나 지방자치단체가 선의의 사업목적으로 국공유지를 제공했는데, 그 국공유지의 사유화를 막기 위해 변상금부과처분을 했다면 없는 국민들의 밥그릇을 두 번 뺏는 잘못된 처분이 될 수 있음을 저의 사건에서 경험한 것입니다. 그리고 이와 같은경우가 적지 않다는 것입니다.

저의 사건의 경우는,

1974년경 국가(박정희 정권)가 국책사업인 새마을사업을 시행하면서, 제가 사는 동네 일대(당시 국유지 혹은 철도부지)의 판자촌에 대한 주택개량사업을 시행하였습니다. 시멘트(양회)을 무상 공급하면서 3층으로 건축을 한 후 대지에 대해 불하를 해 주었습니다. 그런데, 경계한 이웃들은 불하를 다 받았는데, 저를 비롯한 7가구는 공부상 지목이 도로라는 이유로 불하대상에서 제외된 것입니다. 그리고 이 지역에 다른 곳에서도 불하를 받지 못한 곳이 여러 곳 있습니다.

불하를 받지 못한 불평등도 억울한데......... 2004. 8. 12. 구청이 느닷없이 공용재산인 도로를 무단점유하고 있다고 보아 1999. 8. 13. ~ 2004. 7. 31. 까지의 변상금 1억5천만원 정도를 부과한 것입니다. 이 처분에서 피처분자들은 저를 선정당사자(원고)로 삼아 제소하여, 대법원 2007두3688호(피고 서울특별시 동대문구청)로 파기 환송하여 서울고법 2007누15812호로 2007. 10. 17.자 원고의 청구취지를 인용, 변상금처분이 무효가 되었습니다.

그러나, 행정청은 처분 취지를 바꾸어 2003. 1. 1. ~ 2007. 12. 31.기간의 사용료부과처분을 재차 하였으나 이 처분도 서울행정법원 2007구합47640호로 원고의 청구취지를 인용하면서 “새마을사업으로 건축승인을 해 준 이래로 원고 등이 이 사건의 대지를 사용, 수익할 정당한 법적 지위에 있을 뿐 아니라 건축승인을 해 준 1974년경부터 묵시적 공용폐지의 의사가 있었다고 봄이 상당하다”라 판시하여 사용료부과처분이 잘못된 것이라 판결한 것입니다.

그러자, 행정청은 상기 사용료부과처분과 유사기간인 2004. 9. 1. ~ 2008. 8. 31.동안의 변상금부과처분을 역시 또다시 처분하면서 변상금최초처분일인 2004. 8. 12.부터 이 사건 토지에 대한 사용승락이 철회된 것이라고 대법원 2007. 11. 29. 선고 2005두8375 판례를 인용했던 것입니다. 이 사건은 서울행정법원 2008구합41007호로 기각되어 2010. 4. 15.자 대법원에서 상고심절차에관한특례법으로 심리불속행기각 되어 변상금부과처분의 대상이 된다고 한 제1심의 판결이 확정된 것입니다.

이렇게 됨으로 한 사건 ‘변상금부과처분취소의 소송물’이 각기 다른 확정판결, 한번은 변상금이 아니라 하고, 다른 한번은 변상금이라고 하는 서로 반대의 판결로 기판력이 서로 충돌하게 된 것입니다.

소송물이 대법원에서 파기 환송되어 판결확정일자(확정판결의 기속력)가 2007. 11. 7.인데 2004. 8. 12.자 최초변상금부과처분일을 사용승락철회일로 삼아 2004. 9. 1. ~ 2008. 8. 31.동안의 변상금부과처분이 정당하다고 한 판결이 확정된 것입니다. 즉, 점유자들의 점유원인에 대한 정당성이 서울특별시 내지 동대문구청에 의해 말미암은 것과 사용 승락이 철회 되었다면, 기 판결에 따른 새로운 행정행위가 있어야 하는데 이를 아예 무시한 잘못을 간과한 것입니다.

상기 상반된 판결에 대해 재심을 준비하느라 자료를 찾던 중 이 변상금관련 법조항이 국민의 이익을 위해서, 그리고 우월적 지위에 있는 국가의 공권력이 진정으로 가난한 국민들의 밥그릇을 빼앗아 가는 악법이 되지 않도록 개정(혹은 보완)되어야 마땅함을 경험하고,

이에 변상금관련 법조항이 보호받을 권리가 있는 소외된 국민을 위해 그리고 점유원인에 대한 귀책사유가 국가에 있는 경우 그 책임을 국민들에게 떠넘기지 않는 평등한 관계로의 법률로 개정의 길이 열릴 수 있도록 제안합니다. 그럼, 건승하시길 기원 드립니다.

혹시 위 변상금부과처분취소의 소송물과 관련, 민소법 제451조 제1항 제10호 <재심을 제기할 판결이 확정판결에 어긋날 때>(동법 제457조에 의율) 경우의 판결문이나 자료를 어디에서 구할 수 있는 지 알려주시면 은혜를 잊지 않겠습니다. 제 소송물이 재심대상이 된다고는 하지만 그 인용율이 낮음으로 시간이 걸리더라도 자료를 충분히 구하고자 함입니다.

국내 무슬림 수가 14만에 이르는 현재 서울 이슬람 사원 일대는 이슬람 상점들이 들어서면서 ‘이슬람 거리‘로 변하고 있다.
한 라면업체에서 무슬림을 겨냥한 라면까지 출시하는 등 무시 못 할 시장 세력으로 떠오르고 있지만 일반인의 인식은 아직도 이전과 별반 다르지 않다.
실제 제작진이 실시한 이슬람과 무슬림에 대한 국민 의식 조사에서도 이슬람에 호감을 갖고 있다는 의견이 9%에도 못 미치고, 10명 중 7명 이상이 가족 구성원과 무슬림과의 결혼을 반대하는 것으로 나타나는 등 이슬람에 대한 우리 사회의 부정적 의식이 확인됐다.
문제는 무슬림 수가 늘면서 종교와 문화 차이로 해체 위기를 맞고 있는 무슬림 가정도 늘고 있고, 이슬람의 확산을 경계하는 다른 종교와의 마찰 가능성도 커지고 있다는 점이다.
제작진은 “무슬림 증가를 계기로 다문화 다민족 사회가 될 미래 한국 사회의 평화적 공존 방법을 모색해 볼 시간을 마련했다”고 제작 이유를 밝혔다

One of the best walks in Seoul is the path along Seoul Fortress Wall, especially the length between Sukjeongmun, which opened to the public in 2007, and Changuimun. It is not only readily accessible but also wooded, historical, and has great panoramic views of Seoul.

The area around Mt. Bukaksan had been forbidden 38 years to the public access as a military security area. But it was first open to Koreans from 1st April 2006, only the area from Hongryunsa temple to the Sukjeongmun gate to Chotdaebawi Rock(Candle stick's rock). Since 15th Aug. 2008, it has been opened to foreigners as well. They are required to make a reservation at least 1 week in advance.

Furthermore, since 5th April 2007, the whole area of Mt. Bukaksan from Waryong Park passing by Sukjeongmun gate, the top[Baekak Maru(ridge) above 3] to Changeuimun gate(above 1~4) has been opened.

나(me) DO YOU sounded 나두유(naduyu).

Korean say 나도(nadoyo)요(be or do) is ME TOO, but "dialect or accent" of chungcheong province in Korea speak 나두유(naduyu) instead of 나도요(nadoyo).

If all goes well I hope to get to advanced by the end of this year 2010 *fighting*. As for japanese I had a long time interest in it and studied it a liitle bit for fun, took a 4 month beginner class in GBC which i passed with a perfect GPA aahaha,, but I didn't keep up with it for all of 2009... however I will start re learning again!! aja!~ Drawing started out a s a childhood hobby now is gonna be my life time job : )

"Friday-Weekend -주말"

이번 주말은 너무 즐겁게 보냈다.

금요일은, 5시동안 있는 수업이 끝난 후, 이바라는 동급생과 같이 중국뷔페에서 점심을 먹기로 했는데 교실 밖에서 만나서 근처에 있는 버스 정류장으로 걸어갔다.

이바는 금요일에 수업이 없어서 집에서 늦게까지 잘 수 있었고 나는 그게 너무 부러웠었다. 그 수업을 들으려면 5시쯤 일어나 6시 30분쯤 버스를 타야했기 때문에 이번학기는 정말 힘들었다

그리고 눈이 심하게 많이 내려서 버스가 엄청 느리게 갔다. 그래서 학교에 늦게 도착했고 교수님은 화가 났었다.그리고 늦게 수업에 들어가면, 앉아 있는 학생들이 나를 쳐다봐서 너무 불편했다.

아무튼, 버스를 타면서 친구한테 그렇게 말했다. 언제 버스를 내려가서 길을 건너야 했는데, 더러운 눈이 길에 많아서 건너가는 게 무섭게 보였다. 왜냐하면, 난 새로 산 장화를 신었기 때문이다. 엄청 조심해서 건넜지만 결국 장화도 더러워졌고 진짜 짜증 났다. 하지만 중국음식점에 들어가서 맛있는 음식을 먹으니 기분이 금새 좋아졌다. 맛있는 음식은 항상 날 기분 좋게 만든다. 날 치유해주는 것만 같다. 식사를 끝내고, 다시 버스를 타고 지하철에서 Eaton Center 쇼핑센터까지 30분 더 걸렸다.

드디어, 쇼핑 센터에 도착했다.

나는 오랫동안 쇼핑을 못했기 때문에 많이 기대를 하고 있었다.

2 시간 동안 구경하고 쇼핑을 했는데, 내 친구가 보라색 원피스를 아직 못 찾았다. 우리는 모든 가게를 돌아다녀 봤지만, 보라색 원피스를 찾는 건 너무 힘들었다. 친구는 언니 결혼식에 가기 위해서 보라색 원피스를 꼭 입어야 했다. 결국 그 원피스를 못 찾았지만, 액세서리도 많이 사고 즐거운 시간을 보냈다. 집에 돌아오자마자, 인터넷으로 한국어와 일본어를 공부하고, 네이트온으로 친구와 함께 늦은 시간까지 대화를 했다. 다음 날 아침에는 숙제도 많이 하고 그림도 많이 그렸다. 그리고 한국 문법과 어휘를 많이 외웠다! 일요일이 되고 그냥 하루 종일 쉬면서 이 일기를 썼다. 여러분들! 읽어줘서 고맙습니다. 또 일기 쓸게요~~ 기다려주세요(28th Feb., 2010 by Hana Saker)

"그림을 그리는 건"

그림을 그리는 건 나한테 이 세상에 가장 중요한 것이야. 나는그림을 그리는 할수 없었으면 살기도 싫었을텐데 말이야. 예쁜 그림을 내 명사를 기쁘게 하는데요. 슬플때는, 마음이 아플때는 외로울 때눈, 혹은 기쁠때는 그림을 그리기가 도음이 되거든요. 그림을 기리기로 자신의 마음을 다른 사람이 더 알아들을 수 있기 때문이야.

In the whole entire world Drawing is the most important thing for me. What I'm saying is that If I wasn't able to draw I don't think that I would even want to live. Beautiful drawings make my soul happy. At sad times, and times when you're bored or even times when you feel happy drawing can be of help. Through your drawings you can help others understand your mind.

이 노트를 한국어로 쓰는 게 영어로 쓰기보다 더 쉬웠어요. ㅎㅎ 이상하네~

"한국어으로 일기장 Korean diary"

3 주 전에 개학 이었다.나는 새로운 학교를 시작했다. 언젠가 캠퍼스를 봤는데 너무 깜짝 놀랐다. 학교 캠퍼스는 좀 크고 예쁘다. 학교 식당도 크다! 나는 친구 하고 같이 거기에서 점심을 먹었다. 음식이 싸고 맛있더라!! 요즘 학교에 매일 가서 힘들다!!

수업을 6개 들어서 날마다 많은 숙제를 해야한다. 아이구..... 근데 내 전공 (애니메이션)을 좋아해요!!!....그리고, 집에서 학교 까지 좀 가깝다!! 버스 랑 지히철로 45분 걸린다. 버 스 안에 있을 땐 한국어를 공부 할 수 있어서, 행복해요!!!! 집에 자유 시간 있으면 한국어를 또 많이 배운다. 나는 TOPIK 시험을 보고 싶다. 그 시험이 한국 말 시험이다. ......아... 이 번 달에 일기장을 그렇게 많이 안 써서 조금 슬프다.... 안타깝다!!! 뭐를 더 써야할지 몰라서, 여러분, 좋은 밤 보내세요.!!! I asked her "are you batheing or swimming?" She said "swimming of coz..huhuhuhu"

I asked again " no....i just think batheing at there...kukuku"

She replied like this "hehehe...swimming pool at my brother's apartment ......... mmmm ... what's that means? i dont understand..huhuhu"

Finally I said "swimming ......dog or frog style. ..i think u r dog style ....rite????"

She was replied "aaaaa... both style... not my style becoz i dont know how to swim ... muahahahhahahaah!!!"
