The Washington Post reported yesterday that the Council voted unanimously to keep its current funding method rather than switch to another that is used in Prince William County. That system appoints a citizen panel to make recommendations on which nonprofit groups to fund and how much. It has been under fire by groups like the Prince William County Symphony, whose members say too much money has gone towards the Manassas Ballet ($1.6 million since fiscal year 2005). One of the biggest advocates for changing the current system is Council member Mark D. Wolfe (R) whose wife, Amy, is the ballet's artistic director. Wolfe abstained from the vote given his relationship to the ballet.

The city decided to keep the current system in part because it believes taxpayer money should be handled by the Council. The current funding system in Manassas appoints a subcommittee of council members who make recommendations to the City Council on which nonprofits should receive support. One change was made, however: The subcommittee will now have only two council members, instead of the usual three.

While an organization can not intervene on behalf of a political campaign, it may undertake certain types of nonpartisan political activities. Yet even in these situations, organizations still need to tread lightly or risk the wrath of the IRS.

In her book “Good Counsel,” Lesley Rosenthal lists some permissible political events for nonprofit organizations:

Voter Education and Voter Registration Drives: These are a-OK for nonprofits as long as there are no biased references to individual candidates or political parties. Timing is also an important factor for the permissibility of these events. For example, distributing newsletters on a candidate’s voting record on issues important to the nonprofit would probably constitute intervention during an election year.

Speeches by Candidates: An organization may invite a political candidate to speak at an event, but only if opposing candidates for the same office are given equal time. The event must not advocate for a certain position.

Facility Rental: A nonprofit that has space for public gatherings may rent space to a candidate looking to make a space, so long as the organization charges the campaign its customary fees and makes the space available to opposing candidates. In addition, the space must be regularly offered by the organization and not specifically for the candidate.

A new study by Johns Hopkins University is giving job seekers yet another reason to flock towards nonprofit jobs.

The NonProfit Times wrote about the report from the Baltimore, Md.-based school that showed that jobs in the nonprofit sector increased an average of 2.1 percent from 2000 to 2010, while for-profit jobs decreased by an average of 0.6 percent annually. This trend even held up during the height of the Great Recession (between 2007 and 2009), with nonprofit employment increasing at an average of 1.9 percent per year while for-profit work declined. The only year in the past decade that nonprofits didn't outperform for-profits was 2005, when both sectors reported a 2-percent increase in jobs.

If you are wondering which industries increased the most, the JHU study has answers to that, too. It cited the greatest increase in jobs in the following fields: Healthcare, education, and social assistance. Those three happen to be the largest employers in the nonprofit sector, with healthcare jobs making up 57 percent of the nonprofit workforce.

There was one bit of negative news for nonprofits. According to the report, for-profit businesses outpaced nonprofit growth when it came to social assistance, education, and nursing home care. As a result, nonprofits in these fields lost market share to for-profits. The reasons for this aren't exactly clear, but insiders are blaming market conditions and the moral tenets of competing industries, which tend to become muddled in tough economic times.

That was the key message that Bill Gates sent when his organization, the Bill & Melinda Gates Foundation, committed $750 million to the Global Fund to Fight AIDS, Tuberculosis, and Malaria. The major gift came in the form of a promissory note, a new funding mechanism that allows an organization to distribute funds based on immediate needs, which leads to greater impact.

The Gates Foundation has always placed a high priority on deadly diseases with its philanthropic efforts. The organization has already contributed $650 million to the Global Fund since its inception 10 years ago at the World Economic Forum, which is a gathering of the world's top business and political leaders. In addition, the foundation has a Global Health Program that uses advances in technology to help save lives in poor nations. Most of this work is done through grants to partner organizations.

Since 2002, investments to the Global Fund have helped develop innovative treatments for AIDS, tuberculosis, and malaria in developing countries around the world. The organization has provided antiretroviral treatment to 3.3 million people, detected and treated 8.2 million people with tuberculosis, and provided 230 million bed nets to families to prevent malaria. These efforts and more have helped save 100,000 lives every month.
Every nonprofit program is different, but they all have at least one thing in common: Concern with contract law. Contracts can provide a lot of legal issues for organizations. Management always needs to be prepared for any situation.

In her book "Good Counsel," Lesley Rosenthal lays out the basics of contract law. She writes that contracts must be written with reasonable specificity so that each party can perform their necessary obligations under the agreement. These specifics include the parties to the contract, when or over what period of time the exchange of obligations is to occur, and any other details that are determined to be important to the parties. If none of these details are included the contract may not be considered valid, because it only expresses that an agreement has been reached, rather than a binding agreement.

Once there is an offer and acceptance to an agreement, Rosenthal writes that the parties need to render the agreement in writing and sign the document. This will make the agreement binding. Some organizations do confirm their contracts with oral agreements, but it is safer to do it in writing so you have something to refer back to should an issue arise. Note that "in writing" doesn't necessarily mean on paper. Electronic contracts are equally recognized in most places as binding for both parties.

Now that the contract is written, you can put it away and begin living up to your end of the bargain for the life of the agreement. You will likely never have to look at the contract again unless a problem arises--which is hopefully something you and your management team will be able to avoid.

The NonProfit Times took a look at Romney's tax payments and found that he had given more to charitable organizations ($7 million) than he paid in federal income taxes ($6.2 million). During a recent Republican debate in Florida, Romney said that the American public would be satisfied that he had paid his fair share during the past two years. Let's take a deeper look and see exactly where Romney's money went:

The largest charitable contribution noted was a $1,525,000 donation to the Church of Jesus Christ of Latter-day Saints. Romney is a noted member of the Morman faith, and he has donated at least $4.1 million to the church over the past two years.

For 2010, available tax returns show Romney's itemized deductions totaled $4,519,766. His total income was $21,661,344, with an adjusted gross income of $21,646,507.

None of his income came from wages. They came instead from capital gains, stock dividends, and interest payments.

Romney had an effective tax rate of 13.9 percent. Note that, according to the nonpartisan Tax Foundation, the average effective tax rate for millionaires is 25 percent.

In President Barack Obama's annual State of the Union address last night, he stated his belief that millionaires and billionaires pay a lower rate than average Americans. He announced the so-called "Buffet Rule," where individuals who make more than $1 million would pay 30 percent in taxes. If that rule were in effect in 2010, Romney would have had to pay a lot more in taxes.

There's a lot of work ahead of you while you wait for qualified applicants to apply. One of the things you can do to make this work a little less painful is to lay out a hiring process. In his book "Nonprofit Management 101," Darian Rodriguez Heyman says having such a plan is essential to evaluate candidates. He stresses that any hiring process should allow applicants multiple opportunities to provide evidence of their past success.

Heyman recommends the following process to successfully narrow down your nonprofit's pool of applicants:

Job application review

Phone screen

Initial in-person job interview

Follow-up interview (as many as you deem necessary)

Reference and background checks

Negotiation and hiring

Each of these stages should involve what Heyman calls the "four tenets" of an effective hiring process:

Clarity: Everyone involved knows exactly what you want.

Consistency: Every candidate participates in the same process.

Equity: Every candidate is treated equally.

Legality: The process is nondiscriminatory.

Elizabeth Lower is accused of embezzling around $25,000 from Empty Cradle, according to a report from Channel 10 News San Diego. A member of the organization, which helps families deal with the loss of children, spoke to the station about the situation, which took the nonprofit by surprise. Lower first came to Empty Cradle asking for help after her 6-month old daughter died of sudden infant death syndrome (SIDS). Although she was struggling with the loss, she wanted to volunteer for the organization.

There were no red flags to be found at first. It wasn't until a year ago that Empty Cradle noticed something was wrong. They found they were unable to get in touch with Lower after they found an unpaid bill. Upon closer inspection, they found they had lost between $25,000 and $30,000 from their accounts. Just like that, all of their money was gone.

Lower was arrested at her apartment last Thursday and will be arraigned today. In the mean time, Empty Cradle is left only being able to perform its core services. The case highlights how careful organizations have to be when hiring new volunteers or employees. It wasn't that long ago that the Girl Scouts of America Greater New York affiliate went through a similar situation when their finance director pleaded guilty to stealing thousands of dollars from the organization.

The NonProfit Times and Intacct are proud to host a free webinar on February 14th. It's called "Moving Your Nonprofit Financials to the Cloud: The Do's and Don'ts," and it's a must-attend event for any organization looking into this new technology.

As a nonprofit organization, your accounting needs are more challenging than a for-profit corporation's financials. You probably hear many people around the industry talking about cloud computing, but the last thing you want is to do is deal with another new technology. Is it really worth all the hassle? By attending the upcoming webinar, you will get answers to all the questions you have about the cloud, and learn why thousands of nonprofits are using it to gain control of their finances. You can even ask questions.

The speakers for this event will be nonprofit technology and business process expert Jacqueline Tiso from JMT Consulting Group, and Dan Drucker from Intacct. Topics include:

What are the key financial management technology issues facing nonprofit organizations today?

What are the risks moving to cloud computing and how do you protect yourself?

How secure is the cloud and what do you look for when evaluating a vendor?

What are the benefits and challenges of cloud computing for the finance department?

Register for this free webinar today!

How well do you know the jobs at your nonprofit? Even if you think you have it all covered, it's important to undergo a thorough analysis of the positions at your organization.

A job analysis identifies and describes what is happening in the jobs at a nonprofit. All organizations must undergo this process, as it helps to differentiate job and performance requirements based on job content, specifications, and working conditions. All of this information will be crucial when developing a job description.

In "The Big Book Of HR," Barbara Mitchell and Cornelia Gamlem describe the information your organization should obtain in a job analysis:

A job's context or its purpose, its work environment, and its place in the organization.

The duties and responsibilities that employees carry out in the position.

How people in the job are expected to act while accomplishing their work.

In order to get this information, you should:

Get direct employee and supervisor input.

Gather data from multiple incumbents and supervisors.

Use techniques that yield data that is concise, easy to update, and limits bias.

In an article that recently appeared in The NonProfit Times, we looked at how the National Baseball Hall of Fame (NBHF) used this process when upgrading donors. Instead of asking donors to upgrade their membership, the Cooperstown, N.Y.-based organization asks for an additional gift, which upgrades them into their annual donor fund. NBHF uses the same direct mail they send to non-members as part of the soft asking process. Ken Meifert, senior director of development for the organization, estimates they have converted 20 percent of their members (or 6,000) to the annual fund.

The amount of times a nonprofit goes through with a soft ask can make a big difference. Baltimore, Md.-based Catholic Relief Services (CRS) upgrades its donors by recognizing their first gift and encouraging more through mailings. According to Jean Simmons, director of annual giving at CRS, the organization usually sends requests to join a monthly giving campaign once a year to its members. Last year, however, the organization tried a different approach. It sent two mailings: The first was a monthly ask, while the second asked for a one-time only gift or a monthly gift. The result was the strongest increase CRS had seen in the past six to seven years. From their house file of between 280,000 and 300,000 people, Simmons said that 1,487 people ended up opting into the program.

The soft ask can be a very effective way for a nonprofit to upgrade their current donors. Is it the right choice for your organization? Read the full article in The NonProfit Times to find out.

Channel 13 WHAM in the Rochester area reported yesterday that because of the bankruptcy, Kodak was likely to scale down their corporate philanthropy. The company had written on its website that "in the near term … it is likely that we will have to make difficult choices about our philanthropic investments and activities."

Although Kodak's philanthropy has significantly dwindled since 1990, the company and its employees have still funded many groups. For example, the United Way of Greater Rochester has seen millions of dollars come into the organization from Kodak. In addition, Kodak founder George Eastman has financed some of Rochester's greatest institutions, such as the Eastman School of Music, the home of Kodak Hall (which the company recently helped renovate with a $10 million donation).

It's still possible for Kodak to continue donating money during the bankruptcy process, but it will more than likely have to scale back on a major scale while they deal with creditors. You can read more about this story on WHAM's website.

In their book "Make Talent Your Business," Wendy Axelrod and Jeannie Coyle say managers must first acknowledge the existence of organizational politics. You can't tackle a problem, after all, if you don't believe it exists. Further, Axelrod and Coyle encourage leaders to show their employees how to navigate the twisted webs of office politics. They suggest the following tips:

Clarify and adjust assumptions about organization politics. Yes, people often use political skills for unprincipled self-serving. Employees who can read the dynamics, however, can create and sell effective solutions.

Help map the bumpy political terrain. Make sure employees get a full view of the landscape, so they know where danger points occur.

Coach employees to build a portfolio of politically smart approaches. Set a strategy, influence others and adapt familiar skills to political solutions.

Prepare for and sometimes rehearse the handling of complex situations. Employees will do better after having had the opportunity to fine-tune messages, practice handling questions, listen to opposing views, think through their reactions and adapt an appropriate personal presence.

In an article for The Huffington Post, Lisa Greene-Lewis, managing editor of the TurboTax Blog, wrote about the advantages of filing your tax returns early. She wrote that an estimated 80 percent of taxpayers will get a federal tax refund if they file before the end of February. How much is that refund, you ask? It's expected to top $3,000 this year. That's certainly not chump change.

Lewis also wrote about the value of claiming standard tax deductions. It's important not to leave any money on the table while filing your taxes. Lewis offered some deductions you can claim that will help your cause:

Job Search Expenses: Most Americans were involved in the job search last year, but many probably didn't know they could claim job search expenses as a deduction. It's true: As long as you were searching for work in your same profession, you can deduct expenses such as resume preparation, career seminars, and even travel.

Dependent Friends: Good news: Your support for your deadbeat roommates can finally pay off! If they have been out of a job for a while, they may count as a "qualifying relative." This will allow you to treat them as dependents.

Income Tax Credit: The down economy of the past few years has caused the loss of income for many Americans. If you are counted among that group, you may now qualify for the Earned Income Tax Credit (EIC). The EIC allows you to keep more of what you earned, and can give you a credit of up to $5,000 depending on the size of your family.

State and Local Sales Tax Deduction: If you live in a state with no income tax (Alaska, Florida, Nevada, New Hampshire, South Dakota, Texas, Washington, or Wyoming), you can claim a state and local sales tax deduction. If you don't live in one of those states, a year of heavy spending may still give you a greater deduction.

The two bills, the Stop Online Piracy Act (SOPA) and the PROTECT IP Act (PIPA), have drawn heavy criticism from its detractors, who say that the laws are an assault on the "free and open Internet." The legislation would essentially allow the Justice Department to shut down websites accused of copyright infringement without a traditional court hearing.

You're probably wondering: How would either of these laws affect nonprofits? According to The Huffington Post, SOPA and PIPA could have a huge affect on fundraising. SOPA would give the government the ability to block suspicious sites' Domain Name System (DNS) servers, which convert .com names into IP addresses. This could have a direct impact on a nonprofit's donation process, as interfering with the DNS servers makes websites more vulnerable to identity theft and cyberattacks.

Some organizations are already speaking out against the legislation. In the same piece, The Huffington Post mentioned that Global Voices, an international volunteer community of citizen journalists, is joining the protests by "going dark" for 12 hours. The organization is concerned that the laws would "inflict broad damage" to the work of digital activists around the globe, and would hinder free speech.

It's probably a safe assumption that your nonprofit is looking to find that great employee who will bring their organization to the next level. Too bad everyone else is, too.

Many nonprofits are turning to the Internet for their recruiting. Organizations are finding it much easier to find new employees by using social media sites and online job boards. These are all great recruiting tools, but it's important to remember they aren't your only options.

In “The Big Book of HR,” Barbara Mitchell and Cornelia Gamlem remind organizations of the following recruiting methods to use in addition to the Internet:

Former Employees: Not every employee that left went out on bad terms. If you have a good exiting process, it will be easy to identify the reasons they left, and which ones you would like to have back.

Retirees: It is becoming increasingly difficult for retirees to live without some income. Consider bringing some of these individuals back to do special projects.

Radio/TV Ads: If you have enough room in your budget, take out an ad on the radio or TV to invite job seekers to your career Website.

State Employment Offices: All states have offices where you can list open positions. These agencies do a great job of linking job seekers to open positions, so don't discount the amount of help you can get from them.

Business Weekly reported last week that New Jersey Governor Chris Christie signed The Urban Hope Act, which creates a 10-year pilot program that allows nonprofits to build and operate "renaissance schools" in Newark, Trenton, and Camden. Renaissance schools are similar to the charter school programs that have been running in New Jersey for more than a decade. While charters get reimbursed as much as 90 percent of the district's per-pupil costs, these new schools will get 95 percent. Organizations will be able to apply to local boards and then the state Education Department for up to four schools in each city.

This is the first education-related victory for Christie, a first-term Republican, after he declared 2011 "The year of education reform." The Governor and sponsoring Democrats say The Urban Hope Act will create choices for students who are stuck in districts with failing schools. The original version of the bill would have also allowed for-profit firms to run schools, but that measure didn't make it into the final bill.

The Urban Hope Act is part of a four-bill package that also includes a privately funded school-voucher program, among other reforms. Christie has vowed to renew debate on those measures later in 2012. Make sure to read the full article in Business Weekly.

UPDATE 2: Updated the blog post with new information.

We had some big news break in the nonprofit sector this morning, as Charleston, S.C.-based Blackbaud announced the acquisition of rival software firm Convio of Austin, Texas, for $275 million.

The acquisition would give the combined organizations an annual revenue of $440 million, free cash flow of $66.5 million, and net debt of $240 million. Blackbaud will acquire all outstanding shares of Convio's common stock for $16 per share. The purchase is expected to finalized during the first quarter of this year.

Some things to note about the acquisition:

According to Jane Eggers, senior vice president of products and marketing at Blackbaud, only a "small handful of people" at the organization knew the acquisition was happening.

Executives at both firms had been talking about a deal for years, but the timing wasn't right up until a few months ago.

Convio President and CEO Gene Austin will join Blackbaud in a leadership post. He will report to Blackbaud President and CEO Marc Chardon.

There was no mention about the future of Convio co-founder Vinay Bhagat. Eggers told NPT that it wasn't something she could speak to before the deal closes.

The deal will be structured as a cash tender offer followed by a merger.

Blackbaud will finance the transaction through existing cash balance, expansion and extension of the company’s current debt facility, as well as newly issued syndicated debt.

The Advertiser recently wrote an article about executive compensation for nonprofit CEOs. They focused on Sandra Purgahn, president and CEO of Goodwill Industries of Acadiana. She earned $132,825 in 2010, and that number was $15,000 higher in 2009 because of a performance bonus. Purgahn and her husband, Charles, founded Goodwill of Acadiana in 1990, and have been in charge of the organization ever since. Charles still works there as vice president of business services, earning $101,304 in 2010. Two other VPs at Goodwill earned $91,768 and $83,748 in 2010 according to the organization's Form 990.

The board of the organization defended the couple's salaries to The Advertiser, saying they are in line with similarly sized organizations. Even after their revenue dropped by $200,000 in 2010, Goodwill would still classify as a mid-large sized organization. If you are interested in finding out the pay of other nonprofit CEOs, you should check out The NonProfit Times' 2011 Salary and Benefits Report. You can also read the full story on Sandra Purgahn in The Advertiser.

Nonprofits have to deal with lapsed donors everyday, and how they handle them makes all the difference. It's easy enough to hang your head and move on to the next one, but that will be doing your nonprofit a disservice. Instead of giving up, put on your detective hat and find out why they went away. Getting feedback from donors is always a good way to find out what you can improve.

In their book "Wired and Dangerous," Chip R. Bell and John R. Patterson list some questions you can ask your donors to get a better understanding of how your organization can improve:

What is one aspect about our organization that you view as "very positive?"

Complete this sentence: What I like least about what you do is...

Complete this sentence: What I like most about what you do is...

What are the first words that come to mind when you think about working with us?

What area of our organization needs the most improvement?

Was there ever a time when we left you disappointed? If so, briefly describe the incident and list ways that we could have handled the situation better (if at all).

What would you like to see us do that no other organization in our industry is doing?

What have we not asked that we should have?

When employers post their jobs to the Nonprofit Job Seeker, they have the option to make them "featured jobs." This is done to give the job the highest possible exposure. We had one of those jobs posted today from The Lathrop Community Group, Inc.
They are currently seeking a Director of Facilities to help keep their buildings in excellent condition. Duties would include developing, planning, organizing, and directing the functions of the maintenance department. But then again it can also make it that much more complicated.

While some nonprofits would rather not have to deal with the potential headaches that come with technology like computers and smartphones, it’s simply unavoidable in today’s society. An organization will quickly fall behind if it is using outdated technology. In his book “Nonprofit Management 101,” Darian Rodriguez Heyman lists some dos and don’ts for nonprofits when managing technology. Let’s start with the dos:

DO let your mission and strategy be your guides when making technology decisions.

DO establish strong systems. Your staff can’t get much mission-critical work done if they have to reboot the computers every hour.

DO plan! You don’t have to get out your crystal ball to plan effectively for your technology needs.

DO evaluate continuously. You can’t learn from your experiences if you never stop to reflect.

Here are the don’ts:

DON’T make technology decisions based solely on cost. Cost is only one factor in determining the value and expense of technology.

DON’T forget to include staff in your technology decisions. You’ll need allies as you implement new systems.

DON’T select mission-critical software like a donor database without first documenting your key business processes.
