OJAI CITY COUNCIL
Regular Meeting 7:30 p.m., March 10, 2009
Council Chambers, Ojai City Hall, 401 S. Ventura Street – Ojai, CA

Members of the public wishing to address the City Council on items appearing on the agenda are requested to complete a "speaker’s card" and file it with the City Clerk prior to the start of the Council meeting.  Cards are available in the Council Chambers and the Lobby.  All comments should be limited to three minutes, unless additional time is granted by the Mayor.  Speakers should state their name and address for the record and must direct their comments to the Council, not the audience or press.  While Council is in session, members of the Council, City staff, and members of the audience are expected to maintain order and decorum and to obey the orders of the Mayor.  Any meeting participant or member of the audience who engages in disorderly conduct, such as hand-clapping, stamping of feet, whistling, using profane language and so on, which disturbs the peace and good order of the meeting, or refuses to comply with the lawful orders of the Mayor may be ordered removed from the meeting, and may be guilty of a misdemeanor.  (Cal. Penal Code Sec. 403.)

Re: Funding of ERAF Payment 
RECOMMENDATION: Ratify the attached Report to the Ventura County Auditor-Controller’s Office regarding how the Redevelopment Agency will meet its Education Revenue Augmentation Fund (ERAF) funding obligation.

DISCUSSION ITEM  

2. Report on City Use of Pesticides
RECOMMENDATIONS:
1. Direct staff to develop an Integrated Pest Management program for the City; and
2. Approve placement of this project as a Priority “2” item on the Public Works Management Priority List.

3. Purchase of New City-Wide Phone System
RECOMMENDATION:  Adopt proposed Resolution No.09- ____ authorizing the purchase of a new city-wide Altigen phone system from Capture Technologies, Inc., at a cost of $26,482, and additional expenditures of $14,141 for necessary network upgrades and reconfiguration of communications services in order to support the new system.

4. Ordinance Regarding Leaf Blowers
RECOMMENDATION:  Direct staff to prepare an ordinance repealing Section 5-11.05(e) of the Municipal Code, dealing with leaf blowers.

5. Revised Public Works Management Priorities
RECOMMENDATIONS:  Approve the Public Works Management Priority list.

6. Code Enforcement Program
RECOMMENDATION:  Direct staff to develop a code enforcement program using additional  part-time staff, and return to Council for appropriate budget amendment(s).

      The County of Ventura Fire Department's Public Information Office tells me that the &lt;strong&gt;BRUSH FIRE at Barnett and Cameron&lt;/strong&gt; in the City of Ventura is receiving a full brushfire response including bulldozers and air support, and that units from the City and County of Ventura are responding. No units from Ojai have been called into service yet.

      As the major annual fundraiser for the &lt;a href="http://www.rotaryojaiwest.org/"&gt;Rotary Club of Ojai West&lt;/a&gt;, empowering them to donate over $20,000 annually to our community and charities around our nation and world, the &lt;a href="http://www.ojaiwinefestival.com"&gt;Ojai Wine Festival&lt;/a&gt; is quite an event.  This year was the Festival's 21st year, featuring at least 38 wineries...ALL from California and MANY very local (there are microbreweries too!)

My wife and i first attended in 2005, to celebrate our near-to-the-date first wedding anniversary.  We brought friends, cheese, and crackers...and made a tradition.  This year was our first with our daughter, who will turn one in August.  There weren't any 2007 wines out yet for us to buy and put away for her, but when they're ready the Wine Festival is where and when we'll select one.  In the four years that i've attended, the weather has been gorgeous (i know, it's Ojai in June next to the lake, but still...), the event has been affordable and superbly staffed, the crowd has been huge and very alive, the vendors have been plentiful and varied, the pourers have been generous and delightfully friendly, and the live music has been grand.

My only gripe this year is that rather than having &lt;a href="http://www.tomthumbband.com"&gt;Tom Thumb and the Hitchikers&lt;/a&gt; play the entire event, a new act was added that left me less than thrilled: &lt;a href="http://www.sgtpepper.dalyroad.com/"&gt;Sgt. Pepper&lt;/a&gt;, a four piece tribute band that does mostly Beatles tunes...and only sort-of well, in my opinion.  Now, i know it takes a lot to perform musically, and certainly there were plenty of folks willing to let the wine lead them writhing to the dance floor, but i thought the vocal harmonies and the overall playing could have been a little tighter...i've seen live bands communicate nonverbally and just "click" much better.   But hey...for great wine, a free trolley ride to and from, a free boat ride, Los Caporales, and Sea Fresh, i'm not gonna let a band with rough edges get me down.

Tomorrow (Friday April 18th, 2008) sees &lt;a href="http://www.ojaievents.com/event-detail.aspx?ID=2327"&gt;parents socializing about their joys and challenges&lt;/a&gt; and Besant Hill School students &lt;a href="http://www.ojaievents.com/event-detail.aspx?ID=2321"&gt;performing Broadway's 27th longest running musical&lt;/a&gt;.  The long-fenced Wetlands Project between Nordhoff High and Meiners Oaks is &lt;a href="http://ojaivalleynews.blogspot.com/2008/04/ojai-wetlands-project-opens-to-public.html"&gt;newly restored and open&lt;/a&gt; once again to the public, and a rally and fundraising kickoff to &lt;a href="http://www.ojaief.org/Save_Ojai_Schools_Flyer.htm"&gt;Save Ojai Schools&lt;/a&gt; (from State budget cuts) will be held on Sunday April 20th at OUSD Headquarters.  An ongoing art exhibit titled "A Sense of Place" will feature the paintings of &lt;a href="http://www.teganhope.com/"&gt;local artist Tegan Hope&lt;/a&gt; at Busy Babes hair salon until May 31st, and the &lt;a href="http://www.ojainews.com/2008/04/cc_agenda_042208.shtml"&gt;Ojai City Council will meet on Tuesday&lt;/a&gt; the 22nd at 7:30pm.  That same evening, co-founder of &lt;a href="http://www.afterdowningstreet.org/"&gt;afterdowningstreet.org&lt;/a&gt;, David Swanson, will be &lt;a href="http://ojaievents.com/event-detail.aspx?ID=2339"&gt;speaking at the Ojai Retreat&lt;/a&gt; on strategies for saving our Constitution, Economy and Environment.

Just around the corner, the &lt;a href="http://www.venturacountystar.com/news/2008/apr/16/ojai-storytelling-festival-begins-with-a-free-on/"&gt;Ojai Storytelling Festival will open May 1st&lt;/a&gt; in Libbey Bowl, and an organizational meeting for &lt;a href="http://ojaivalleynews.blogspot.com/2008/04/locavore-group-forming-in-ojai.html"&gt;Ojai's new locavore group&lt;/a&gt; is slated for May 10th (&lt;a href="http://www.groups.google.com/group/eat-local-one-year"&gt;sign up here&lt;/a&gt;).

Members of the public wishing to address the City Council on items appearing on the agenda are requested to complete a "speaker’s card" and file it with the City Clerk prior to the start of the Council meeting.  Cards are available in the Council Chambers and the Lobby.  All comments should be limited to three minutes, unless additional time is granted by the Mayor.  Speakers should state their name and address for the record and must direct their comments to the Council, not the audience or press.  While Council is in session, members of the Council, City staff, and members of the audience are expected to maintain order and decorum and to obey the orders of the Mayor.  Any meeting participant or member of the audience who engages in disorderly conduct, such as hand-clapping, stamping of feet, whistling, using profane language and so on, which disturbs the peace and good order of the meeting, or refuses to comply with the lawful orders of the Mayor may be ordered removed from the meeting, and may be guilty of a misdemeanor.  (Cal. Penal Code Sec. 403.)

2.	Adopt Resolution No. 08-____authorizing the City Manager to enter into an agreement by and between the City and Ventura River County Water District (VRCWD) allowing the City to position and maintain a radio antenna on VRCWD property.

j)	Opposition to Woodside Oceanway Liquefied Natural Gas (LNG) Terminal Proposal’s Preferred Off-Load Site
	RECOMMENDATIONS:
1.	Adopt Resolution No. 08-____to join other Ventura County cities in formal opposition to Woodside LNG’s preferred off-load site; and
2.	Authorize Council Members and the City Manager to express said opposition before any and all government or other agencies taking comments on the issue.

k)	Ratification of Lifetime Achievement in the Arts Award
	RECOMMENDATIONS:
1.	Ratify the Arts Commission’s recommendation that Ruth Hemming be the recipient of the 2007 Lifetime Achievement in the Arts Award; and
2.	Ratify the Arts Commission recommendation that City Council award a City plaque to the Ojai Center for the Arts.


DISCUSSION ITEMS  

2.	Appoint Council Sub-Committee to Select Special Legal Counsel 
RECOMMENDATION:
Appoint two members of the Ojai City council to serve as a Sub-Committee that will work with the City Manager to select Special Legal Counsel to advise on the Housing Element of the General Plan.  

3.	Federal Section 5311 Grant Funding Application
RECOMMENDATION:  Adopt Resolution No. 08-____authorizing the City Manager to file an application for Section 5311 entitlement grant funds for public transportation projects in rural areas for FY 2006/2007 in the amount of $250,448.

Welcome to the Meeting of the Board of Supervisors of the County of Ventura, also sitting as the Governing Board of the Ahmanson Ranch Community Services District, County Service Districts, Fire Protection District, Lake Sherwood Community Services District, Redevelopment Agency of the County of Ventura, Watershed Protection District, Ventura County In-Home Supportive Services Public Authority, Ventura County Library, Ventura County Public Financing Authority, and the Waterworks Districts. 
 
The following information is provided to help you understand, follow, and participate in the Board meeting: 
 
Pursuant to California Government Code Section 54953 (a) et. al., time is set aside for citizen presentations regarding County related matters. Those wishing to speak must fill out a speaker card and submit it to the Clerk. Speaker cards for issues not on the agenda must be submitted to the Clerk prior to the beginning of the public comment period. Agendized item, speaker cards must also be submitted before the item is taken up for consideration. The Clerk may not accept any additional speaker cards once an item commences.   
 
 Items on the Consent calendar may be voted on in one motion at the beginning of the meeting.  If you wish to discuss any of these items, please fill out a “Speaker Card ”. The Board will either move the item to the regular agenda or allow the speaker his or her time prior to the Board’s consideration of the Consent Agenda. 
 
 Regular Agenda items are not Time Certain items and they will be heard at the Board’s discretion, either before or after scheduled Time Certain Appointments and Hearings. 
 
Correspondence Agenda matters are being presented to the Board for information. These items require no action or are not ready for Board consideration. The Clerk of the Board may refer these matters to the County Departments and Agencies for acknowledgement, investigation and report back, direct action or response as appropriate.  Members of the public making oral presentations to the Board in connection with one or more agenda or non-agenda items at a single meeting are limited to a cumulative total of time not to exceed five (5) minutes for all of their oral presentations at such meeting unless otherwise provided. The entire public comment period is limited to no more than thirty (30) minutes total for all speakers. NOTE: The Chair may limit the number or duration of speakers on a matter pursuant to amended Resolution #205 of the Board of Supervisors establishing rules relating to oral presentations by members of the public dated September 18, 2001.

Vehicle and pedestrian-vehicle accidents have captured local news as Ojai counted its fifth since New Year’s Eve on Wednesday evening. 

Many accidents involve a single second of inattention or distraction, a moment when one takes for granted, “There is nothing coming.”  We aren’t really looking to see what we might.  We are trying to verify what we already know:  the coast is clear. 

The Ojai Police wants to remind everyone who drives to be careful, give your full attention to the job, and expect the unexpected.  The safest driver is one who gives a little more room, slows down a bit, and looks both directions—really looks. 

Please drive attentively and give yourself plenty of time for your travels.  To cross the street use crosswalks or intersections.  Be alert.  Be alive tomorrow.

BRICK AND WROUGHT IRON FENCE AND ENTRY GATE, AND NEW LANDSCAPING FOR PAT’S LIQUOR, AND TREE PERMIT (T 07-30) TO TRANSPLANT 12 QUEEN PALM TREES TO THE REAR AND SIDE YARD of the subject property located at 710 and 722 E. Ojai Avenue in Ojai, California, Assessor’s Parcel Numbers 022-0-151-010 and 022-0-151-370. The General Plan designation of the site is General Commercial (GC) and the Zoning classification of the site is General Commercial (C-1).  This project is categorically exempt pursuant to the California Environmental Quality Act under section 15303, new construction or conversion of small structures.

RECOMMENDATION:

3.    LOT LINE ADJUSTMENT (LLA 08-01) BETWEEN TWO PARCELS SO THAT EACH 
LOT IS COTERMINOUS WITH EACH, EFFECTIVELY MERGING THE PARCELS of the subject property located at 611 Pearl Street, Ojai, California, Assessor’s Parcel Numbers 023-0-141-390 and 023-0-141-400.  The General Plan Land Use designation and Zoning classification of the property is Village Mixed Use (VMU).  The proposed project is categorically exempt from the California Environmental Quality Act under Section 15305, Minor Alterations in Land Use Limitations.

PUBLIC HEARING  

2.	Community Development Block Grant Public Hearing Application for Funding Program Year 2008/2009 
RECOMMENDATIONS:
1.	Conduct a public hearing to receive input on the proposed use of Federal Community Development Block Grant (CDBG) funds for program year 2008/2009; and

2.	Provide staff with direction on funding priorities to then return to the City Council February 26, 2008 with recommendations for the allocation of CDBG funds for 2008/2009.

3.	Priority List of Planning Projects 
RECOMMENDATION:  Approve the Priority List of Planning Projects, which serves as a work program for long-range planning for the Community Development Department.

4.	Grant Award Acceptance for an Ojai Valley Emergency Advisory Radio System 
RECOMMENDATION:  Authorize the Mayor to sign Resolution 08-____allowing the City of Ojai to accept funds from the Ventura County Sheriff’s Office of Emergency Services (OES), in the amount of $50,000 to purchase and install an Emergency Advisory Radio System (EARS) that will serve the City of Ojai, as well as other communities in the Ojai Valley.

ROLL CALL 
On a call of the roll the following Council Members reported present:  Carol Smith; Steve Olsen, Joe DeVito, and Sue Horgan.  Also present were:  City Manager, Jere Kersnar; City Attorney, Monte Widders; Ojai Chief of Police, Capt. Bruce Norris; Ventura County Fire Protection District, Battalion Chief, Scott Schuster; Finance Director, Susie Mears; Public Works Director, Mike Culver; and City Clerk, Carlon Strobel.

RECOMMENDATION:  Adopt Resolution No. 08-01 directing the City Engineer to 
prepare the annual Engineer’s Report for Landscaping Maintenance District No. 1. 
 
d) Preparation of Annual Engineer’s Report for Plaza Maintenance Assessment 
District No. 2 for FY 2008/2009

2. Change in Building Standards 
 
City Manager Kersnar presented an introduction to the staff report. 
 
Mayor Horgan opened the public hearing and seeing that no one wished to speak, closed the public hearing. 
 
MOTION:  Council Member Olsen moved and Council Member Smith seconded to read by title only the proposed Ordinance No. 799 amending Ojai Municipal Code Sec. 9-1.902 to include the amended building standards adopted by the Ventura County Fire Protection District (VCFPD) and pass the Ordinance to its second reading. 
 
The result of the roll call vote: 
 AYES:  Smith, Olsen, DeVito, Horgan 
 NOES:  None 
 ABSENT: Hanstad 
 
 
DISCUSSION ITEMS 
 
3. Commission Appointments 
 
Mayor Horgan, Appointments Sub-Committee, submitted a report recommending 
appointments to the Arts Commission and the Parks and Recreation Commission. 
 
MOTION:  Mayor Pro Tem DeVito moved and Council Member Olsen seconded to ratify the appointment of Roger Conrad to the Arts Commission.  The motion passed unanimously. 
 
MOTION:  Mayor Pro Tem DeVito moved and Council Member Olsen seconded to ratify the appointment of Colby Fletcher as Youth Commissioner to the Parks and Recreation Commission.  The motion passed unanimously. 
 
 
The Ojai City Council then recessed and convened as the Redevelopment Agency.  Subsequent to hearing those items before them, the Redevelopment Agency adjourned and reconvened as the Ojai City Council.
