Drivers operating in certain types of commerce will be required to submit a current medical examiner’s certificate to their SDLA to obtain a “certified” medical status as part of their driving record. CDL holders required to have a ”certified” medical status who fail to provide and keep up-to-date their medical examiner’s certificate with their SDLA will become ”not-certified” and they may lose their CDL.

For specific State by State requirements for drivers and information related to how a State is handling the Medical Certification requirements, and to determine who to contact for additional information, click on the following link: http://fmcsa.dot.gov/redirect.aspx?page=http://www.aamva.org/aamva/DocumentDisplay.aspx?id={687D99D3-FFB5-4B76-BD6F-F5EF54728BE0

What is changing?

State driver licensing agencies (SDLAs) will be adding your medical certification status and the information on your medical examiner’s certificate to your Commercial driver’s license system (CDLIS) record.

When does this change start? This change starts on January 30, 2012.

What is not changing? The driver physical qualification requirements are not changing.

What are CDL holders required to do?

You must determine what type of commerce you operate in. You must certify to your SDLA to one of the four types of commerce you operate in as listed below,

Interstate non-excepted: You are an Interstate non-excepted driver and must meet the Federal DOT medical card requirements (e.g. – you are “not excepted”).

Interstate excepted: You are an Interstate excepted driver and do not have to meet the Federal DOT medical card requirements.

Intrastate non-excepted: You are an Intrastate non-excepted driver and are required to meet the medical requirements for your State.

Intrastate excepted: You are an Intrastate excepted driver and do not have to meet the medical requirements for your State.

If you are subject to the DOT medical card requirements, provide a copy of each new DOT medical card to your SDLA prior to the expiration of the current DOT medical card.

U.S. Department of Transportation Takes Action to Ensure Truck Driver Rest Time and Improve Safety Behind the Wheel

WASHINGTON – U.S. Transportation Secretary Ray LaHood today announced a final rule that employs the latest research in driver fatigue to make sure truck drivers can get the rest they need to operate safely when on the road. The new rule by the U.S. Department of Transportation's Federal Motor Carrier Safety Administration (FMCSA) revises the hours-of-service (HOS) safety requirements for commercial truck drivers.

“Trucking is a difficult job, and a big rig can be deadly when a driver is tired and overworked,” said Transportation Secretary Ray LaHood. “This final rule will help prevent fatigue-related truck crashes and save lives. Truck drivers deserve a work environment that allows them to perform their jobs safely.”

As part of the HOS rulemaking process, FMCSA held six public listening sessions across the country and encouraged safety advocates, drivers, truck company owners, law enforcement and the public to share their input on HOS requirements. The listening sessions were live webcast on the FMCSA Web site, allowing a broad cross-section of individuals to participate in the development of this safety-critical rule.

“This final rule is the culmination of the most extensive and transparent public outreach effort in our agency’s history,” said FMCSA Administrator Anne S. Ferro. “With robust input from all areas of the trucking community, coupled with the latest scientific research, we carefully crafted a rule acknowledging that when truckers are rested, alert and focused on safety, it makes our roadways safer.”

FMCSA’s new HOS final rule reduces by 12 hours the maximum number of hours a truck driver can work within a week. Under the old rule, truck drivers could work on average up to 82 hours within a seven-day period. The new HOS final rule limits a driver’s work week to 70 hours.

In addition, truck drivers cannot drive after working eight hours without first taking a break of at least 30 minutes. Drivers can take the 30-minute break whenever they need rest during the eight-hour window.

The final rule retains the current 11-hour daily driving limit. FMCSA will continue to conduct data analysis and research to further examine any risks associated with the 11 hours of driving time.

The rule requires truck drivers who maximize their weekly work hours to take at least two nights’ rest when their 24-hour body clock demands sleep the most – from 1:00 a.m. to 5:00 a.m. This rest requirement is part of the rule’s “34-hour restart” provision that allows drivers to restart the clock on their work week by taking at least 34 consecutive hours off-duty. The final rule allows drivers to use the restart provision only once during a seven-day period

Companies and drivers that commit egregious violations of the rule could face the maximum penalties for each offense. Trucking companies that allow drivers to exceed the 11-hour driving limit by 3 or more hours could be fined $11,000 per offense, and the drivers themselves could face civil penalties of up to $2,750 for each offense.
Commercial truck drivers and companies must comply with the HOS final rule by July 1, 2013. The rule is being sent to the Federal Register today and is currently available on FMCSA's Web site at http://www.fmcsa.dot.gov/HOSFinalRule.

December 16, 2011

TxDOT Offers Truck Toll Promotion on SH 130, SH 45SE this Holiday Season
Bypass I-35 congestion in Austin for $9 or less

AUSTIN – ‘Tis the season for giving and the Texas Department of Transportation (TxDOT) has
a great gift in mind – traffic congestion relief on Interstate 35.

This holiday season, TxDOT will reduce tolls for trucks to take the 56-mile State Highway 130
and SH 45SE bypass around Austin. Starting December 21, 2011 through January 4, 2012, all
motorists who choose to avoid traffic congestion through the Austin area and travel nonstop
between Georgetown and Buda on the SH 130/SH 45SE toll bypass will pay the passenger
vehicle (two-axle) toll rate. For trucks with four axles or more, this means a savings of more than
67 percent.

“The department is continuously looking for ways to free up capacity on I-35, and encouraging
trucks and through traffic to use the bypass is one of those ways,” said Phil Wilson, TxDOT
executive director. “We thought the holiday travel season was the perfect time to give this a try.”

I-35, from SH 71 to US 183, is the fourth-most highly congested roadway in Texas. Last year,
families on vacation, commuters traveling to work, and truckers working to get their shipments
to market on-time experienced more than 4.6 million hours of delay. Traditionally, traffic
congestion on I-35 increases approximately five percent during peak holiday travel times,
including Christmas and New Year’s Day. The state-of-the-art network of tollways was built to
offer an alternative to Austin-area traffic congestion, while enhancing safety and connectivity.

“I hope these temporary rates will encourage large trucks and other through traffic to take SH
130 and SH 45SE to bypass Austin-area traffic, resulting in greater travel time savings and less
congestion on I-35,” Wilson said. “Plus, with the newly-set 75 mile-per-hour speed limit, it will
help all motorists get to their destination sooner. It really is a win-win for everybody.”

TxDOT also recommends motorists sign up for a TxTag to pay their tolls. TxTAG makes paying
tolls simple and fast. There's no stopping or slowing down to pay, and drivers pay the lowest toll
rates throughout the state. To open an account, contact the Customer Service Center at 1-888-
468-9824 or sign up online at www.txtag.org. While using an electronic toll tag is the easiest,
least expensive way to pay tolls, Pay By Mail (PBM) is also an option for all users of TxDOT’s
Austin-area toll roads.

Toll rates on other Austin-area toll roads including Loop 1, SH 45N and 183A remain unchanged
during this promotion.

Drivers with electronic toll tags – TxTag, the Dallas/Fort Worth area TollTag and the Houston EZ
TAG – always receive the cheapest toll rates on Austin-area toll roads. Motorists without an
electronic toll tag are welcome to use the toll roads through the PBM option; however, toll rates
are slightly higher to offset the costs related to processing the license plate information. Also, a
$1 fee is applied to each monthly bill for PBM customers.

For more information call TxDOT’s Government & Public Affairs Division at (512) 463-8700.

The Texas Department of Transportation
TxDOT is responsible for maintaining over 80,000 miles of road and for supporting aviation, rail and public transportation across the
state. TxDOT and its more than 12,000 employees strive to empower local leaders to solve local transportation problems, and to
use new financial tools, including tolling and public-private partnerships, to reduce congestion and pave the way for future economic
growth while enhancing safety, improving air quality and increasing the value of the state’s transportation assets. Find out more at

FOR IMMEDIATE RELEASE MAY 24, 2011

Annual Truck Driving Championship focuses on trucking safety within state’s $3.6 billion dollar industry

Competitors combine for more than 140 million accident-free miles

OKLAHOMA CITY – More than 100 truck drivers from across the state will compete for the title of ‘King of the Road’ during a two-day competition in June held in Oklahoma City. Organized by the Oklahoma Safety Management Council and the Oklahoma Trucking Association, the 2011 Annual Truck Driving Championship will test the drivers’ knowledge of and ability to perform trucking safety practices and procedures. This year’s competitors combine for more than 140 million accident-free miles throughout their careers.

The OSMC sponsors the annual truck driving challenge as a way to highlight the industry’s ongoing efforts to keep themselves and all motorists safe on the state’s roadways, said Kimberly Gonzalez, Truck Driving Championship chairwoman. She said the biggest hurdle facing truck drivers on the roads is anticipating the other motorist’s next move.

A recent national survey revealed that nearly 80 percent of all truck-involved accidents are caused by the motorist operating the passenger vehicle, not by the truck driver.

“Not only do truck drivers have to worry about maneuvering their vehicle on the roadways, they also have to anticipate the other drivers’ moves,” said Gonzalez. “Trucks are carrying thousands of pounds of goods and cannot come to a complete stop at a moment’s notice. It takes a fully-loaded truck traveling at 65 miles per hour more than the length of a football field to stop. If more motorists understood that fact, they would think twice about swerving in front of it on the highway.”

Dan Case, Oklahoma Trucking Association executive director, said the state’s economy heavily depends upon the state’s truck drivers. The industry creates more than 82,000 jobs from 4,500 companies based in Oklahoma, which contributes more than $3.1 billion in salaries.

“Our state’s economy would be crippled without the men and women who transport our groceries, clothes, and oil and gas throughout our state,” said Case. “About 75 percent of Oklahoma communities rely exclusively on goods transported to them via truck. Without these vehicles on our roadways, many of us would not enjoy the lifestyle to which we are accustomed.”

In addition to the jobs and salaries, Case also said trucking companies paid 41 percent of the total state and federal highway taxes and fees in Oklahoma, despite representing only 16 percent of the vehicles on the road.

Gonzalez also said spectators are welcome to attend the closed-course, driving challenge portion of the competition that takes place Saturday, June 4 from 8 a.m. to noon. Other phases of the competition include a written exam comprised of 40 multiple-choice questions, a one-on-one interview and pre-trip inspection, which is judged by Oklahoma Highway Patrol Troop S members.

The OSMC’s 2011 Truck Driving Championship will be held June 3 and 4 in Oklahoma City, with the actual driving course located on the OSU-OKC Precision Driving Center at 3501 West Reno. The closed-course, driving challenge will take place Saturday, June 4 from 8 a.m. to noon. This challenge portion of the event is open to spectators and there is no ticket fee. For more information about the OSMC and the competition, visit www.oksafetymanagementcouncil.com or call the Oklahoma Trucking Association at (405) 525-9488.

High Winds, Blowing Dust Expected to Close I-40

Threat of Dust Storm Could Slow Northern Arizona Traffic Today

PHOENIX — High winds and blowing dust are expected to impact Northern Arizona and will likely prompt the closure of Interstate 40 east of Flagstaff today.

The National Weather Service is predicting strong gusting winds as high as 50 mph today. Drivers should expect long delays and be aware of the lack of appropriate detour routes.

The I-40 westbound closure is expected to be set at milepost 252 in Winslow, where the traffic will be diverted into the city. The eastbound closure, east of Flagstaff, would begin at milepost 219 at the Twin Arrows interchange, where traffic will be turned around.

In addition, State Route 99 at the Leupp interchange with I-40 will be closed as well.

Closures of I-40 can last hours due to the nature of the storms. In the past, similar conditions have been strong enough to cause high-profile vehicles to be blown over. Blowing dust has reduced visibility to near zero. With the threat of a storm, ADOT crews will be closely monitoring conditions.

Drivers planning trips along I-40 this week are urged to monitor travel conditions by calling 5-1-1 within Arizona, 1.888.411.ROAD outside the state, or via the Web at www.az511.gov. Because weather conditions can quickly evolve, drivers are encouraged to regularly check in with ADOT’s Traveler Information Service. Motorists should delay or detour travel plans if necessary.

ADOT, along with the Arizona Department of Public Safety, will continue to work as a public safety team to support Arizona’s highways and drivers and will closely monitor conditions on I-40 while maintaining driver safety. I-40 is a critical national corridor for commercial traffic and there are few other alternatives across Northern Arizona.

Bill to Make OSHA’s Successful Voluntary Protection Program Permanent Introduced in Senate and House

WASHINGTON, D.C. – Senator Michael B. Enzi (R-Wyo.), Ranking Member on the Senate Health, Education, Labor and Pensions (HELP) Committee, joined today with Senator Mary Landrieu (D-La.), Chair of the Senate Small Business Committee, to introduce legislation to make one of the most successful workplace health and safety programs for both public and private employers permanent. Similar legislation was introduced in the House by Representative Tom Petri (R-Wisc.), senior Republican on the Subcommittee on Higher Education and Workforce Training, and Representative Gene Green (D-Texas). The Voluntary Protection Program (VPP) Act (S.807 and H.R. 1511) would codify a successful program operated by the Occupational Safety and Health Administration (OSHA) to encourage workplaces to incorporate voluntary programs to improve the health and safety of their worksites. Since VPP was created in 1982, it has grown to incorporate more than 2500 worksites that cover approximately one million employees. A 2007 report noted that federal VPP worksites saved the government more than $59 million by avoiding injuries, and that private sector VPP participants saved more than $300 million.Participating workplaces have an illness and injury rate that average 50 percent below that of their industry.

“The Voluntary Protection Programs have encouraged a culture of health and safety in the workplace that saved the government and private sector millions of dollars by avoiding injuries and illness,” said Senator Enzi. “And in this economy every little bit helps. As a former small business owner myself, I understand that maintaining a safe workplace is just as important as turning a profit. This bipartisan bill would ensure that these successful programs continue while helping expand the program to include more of America’s small businesses. I hope my colleagues will support this crucial legislation because preserving these programs that make worksites safer is something both parties should agree on.”

“The number one responsibility of any employer is providing a safe workplace for its employees,” Senator Landrieu said. “The VPP is a great example of how the right public-private partnership can succeed in reducing accidents at work, but these partnerships are not a replacement for stricter mandatory workplace safety guidelines, especially in dangerous occupations. While we can never guarantee complete safety in any workplace, reducing accidents saves lives, increases productivity and saves money for businesses, workers and taxpayers.”

“We need a more effective relationship between OSHA and employers, and I think the Voluntary Protection Plan helps,” said Representative Petri. “Yes, there are times when OSHA has to be heavy handed, but most employers want to run safe workplaces. There is a lot to be gained by having OSHA recognize employers who have demonstrated a commitment to workplace safety. When OSHA does that, it creates an incentive for other employers to follow suit - and that improves safety and saves money on enforcement costs at the same time.”

“The Voluntary Protection Program is one of the few programs that has achieved unified support from both union and non-unionized labor, small and large businesses, and government,” said Representative Gene Green. “I am proud to work with colleagues on both sides of the aisle to codify this important safety program that saves money while protecting workers. In Texas alone, 327 worksites participate in this program that employ, in total, over 50,000 workers.”

April 1, 2011
PR# 11-020

Drivers and occupants most at risk in construction zone mishaps; National Work Zone Awareness Week kicked off

A century of dedication and hard work was recognized at gatherings in Tulsa and Oklahoma City Friday as the Oklahoma Department of Transportation not only marks 100 years of service to the traveling public, but also reminds motorists of the importance of added caution in construction zones.
Now, more than ever, with faster travel speeds and technologies such as cell phones and other mobile devices, drivers and passengers are more at risk for injury and death, especially in work zones.Statistics show that four out of five of those killed in work zones are motorists and passengers in vehicles traveling through the work zone, indicating that the way you drive in work zones has a direct effect on your own safety, as well as the safety of the workers.Nationwide, 667 people were killed in highway work zone collisions in 2009, the most recent year of available complete statistics. In Oklahoma, 18 people lost their lives between January and November 2010.
Also in 2010, preliminary figures show that 748 people were injured in 1,407 collisions in Oklahoma work zones – the highest number of work zone collisions and greatest amount of injuries in the last decade. Many of those collisions resulted from following too closely, traveling at unsafe speeds and driver inattention, including the dangerous habit of talking or texting on a cell phone or other mobile device.
On a national level, Work Zone Awareness Week takes place April 4-8. This year’s theme is “Safer driving equals safer work zones – for everyone” and highlights the need for caution on the road and especially through construction areas. In Oklahoma, to emphasize the seriousness of the situation, those involved with work zones and roadway safety gathered in Oklahoma City and Tulsa to kick off the annual focus on roadway safety.
“In this centennial year of ODOT, we recognize all who have worked so hard to create and improve Oklahoma’s transportation system. We also remember the 54 ODOT employees who, during those 100 years, have been killed in the line of duty – a figure surpassing that of any other Oklahoma state agency,” ODOT Chief Engineer Gary Evans said.

A proclamation signed by Gov. Mary Fallin will be presented to the state Transportation Commission at its April 4 meeting, declaring Work Zone Awareness Week in Oklahoma.
Drivers are reminded to stay alert and heed warnings when approaching the familiar orange cones and barricades of marked construction zones by dedicating full attention to the roadway, avoiding the use of mobile devices or changing radio stations, leaving an adequate stopping distance between vehicles and allowing additional time to arrive at their destinations.

This year’s Work Zone Awareness Week is sponsored in Oklahoma by ODOT, Oklahoma Turnpike Authority, Federal Highway Administration, Oklahoma Highway Safety Office, Oklahoma Highway Patrol, The Association of Oklahoma General Contractors, City of Oklahoma City, City of Tulsa and AAA-Oklahoma.

FOR IMMEDIATE RELEASE

Oklahoma Trucking Association Announces Safety Winners

The Oklahoma Trucking Association (OTA) and Oklahoma Safety Management Council (OSMC) announced their winners for the 2010 Fleet Safety Awards this past week in Oklahoma City.

The 2010 Grand Trophy, presented by Great West Casualty Company, was awarded to Big Mac Tank Trucks of Enid, Oklahoma.

Broken Arrow resident, John Hill, from Oklahoma Tank Lines – United Petroleum Transports, was selected as the 2010 Oklahoma Driver of the Year. Throughout Hills’ 26 years as a professional driver, he has accumulated over 1,862,350 accident-free miles. He and his wife, Jann, are very active volunteers with the Broken Arrow School District PTA. John also served in the United States Marine Corps.

OTA member companies are eligible to apply for the Fleet Safety Awards and the placement is chosen by the lowest accident frequency rating in Oklahoma. If the company places in their division category, they then become eligible for the Grand Trophy award. This award is chosen by three judges from various law enforcement agencies and is based on the company’s overall safety performance record, their safety plan, hiring practices and outside council involvement. OTA member companies can also submit a nomination packet for a driver that they believe has gone above and beyond the call of duty for consideration as an Oklahoma Professional Driver.

A 2004 Peterbilt semi truck was stolen from Yukon on 12-20-10. Oklahoma Tag 2DK958. Last 4 of VIN 5790 This is a show truck loaded with chrome. The owner feels that there is a strong possibility that it was chopped down for the chrome.

It was taken from inside a gated yard. The suspect used an industrial-type fork lift to make an opening in the fence. It would appear that whoever took the truck knew how to use heavy equipment and had knowledge of this specific truck and its location. A stolen vehicle report was made by Yukon Police Department.

If anyone has any information about this truck please contact Lt. Hofer - Yukon Police Department at 405-354-2553.

Central to ATA’s campaign is its SafeDriverHours.com website containing data and information designed to assist the industry in responding to the Obama Administration’s proposal.

As part of the campaign, ATA is urging trucking companies to engage their drivers, educate them on the proposed changes, and strongly encourage them to submit their written objections to FMCSA as soon as possible but no later than February 28, 2011 on any parts of the proposal with which they have concerns. ATA’s goal is have tens of thousands of professional drivers submit their individual concerns and objections to FMCSA. To help carriers and drivers with this task, ATA has included the following on the SafeDriverHours.com website:
A summary of the proposed HOS changes to help educate drivers, found by clicking here.
An easy to read chart comparing the proposed changes to the current HOS rules to help educate drivers, found here.
Talking points for drivers, a template to help drivers draft their thoughts, and easy instructions for drivers on how to send their comments to FMCSA, found by clicking here.
Carriers and drivers can and will make a difference in the outcome of this rule if they communicate why the current rules work, and why proposed changes are impractical, overly restrictive, and will lead to compliance, enforcement and safety problems.

ATA is counting on the trucking industry and drivers to overwhelm FMCSA with objections like never before to make a real difference in the outcome of this HOS rulemaking process! Comments and objections should be submitted as soon as possible but no later than February 28, 2011.
