The Skills Shortage 482 Visa is an employer sponsored visa where employers first need to be approved as a Standard Business Sponsor . That approval is valid for 5 years. It is one of the most popular work visas which we do as a work visas agent

SPONSORSHIP

A business sponsor must to show:

The business is a lawful, operating business

The business can pay a nominated worker

The business commits to meeting its sponsorship obligations,

The nominated occupation must be on the Short Term Skilled Occupations List (STSOL)

The visa under this stream can be valid for up to 4 year

Labour Agreement Stream This stream is for employers who have negotiated a labour agreement with the Australian Government.

Skilling Australians Fund

A Skilling Australians Fund (SAF) levy is payable for each nomination under the TSS program, as follows:

Labour Market Testing

Under the Skills shortage 482 visa specifications, Immigration requires that all positions nominated for TSS visas are advertised in three media for at least one month in the preivous four months.

The nominated position must be advertised in Australia

At least three advertisements must be published, one of which must be on the Government’s JobActive website. The other two advertisements can be in two different places or the same place for two different time periods, such as:

Advertising must have remained live for at least 4 weeks

The role must be advertised in English, with the position title and duties as well as salary range,

VISA

Overseas students holding visas to study in Western Australia can get back into the State without quarantine.

For two years, students from overseas have been kept out of WA due to Covid restrictions.

Now, international students who are already enrolled in Western Australian schools, colleges and universities can enter the State without having to quarantine. This is after WA wound back long-running Covid restrictions. Previously, international students had been barred.

The new move allows students already enrolled in a Western Australian primary school, secondary school, university, college, technical college, or other further education course to enter.

Overseas Students Starting Courses

This applies to those student visa holders who are just starting their courses and those who have been enrolled and studied onshore or offshore in previous years.

From Thursday, 3 March no quarantine is required for vaccinated overseas students entering Western Australia.

However, they will need to have taken Rapid Antigen Test (RAT) within 12 hours of arrival and report any positive result.

Additionally, the student visa holders will need to have a registered WA Government G2G Pass.

There had been fears that Western Australia would fall behind other states which were already open to overseas students for the 2022 school and university year.

Partner Visas

Partner visas are for married partners and de facto partners of both opposite and the same sexes and for those intending to get married.

There are two partner visas – Offshore and Onshore and there is a Prospective Marriage visa for those intending to wed.

In all instances, the applicant must be sponsored by an Australian citizen, or permanent resident.

There are these three major partner visa subclasses and partners are granted a temporary visa after the initial process. Then later, a permanent visa may be granted following an eligibility period. if there is a long-standing relationship or children of the relationship, then the permanent visa may be granted more quickly.

Partner Visas Onshore

If you are in Australia, you are eligible to apply for a Subclass 820 and Permanent visa subclass 801.

Then if the relationship is genuine and continuing two years after the application was lodged then you can be granted a permanent visa.

Partner Visas Offshore

If you are outside Australia you are eligible to apply for the Subclass 309

followed by the Permanent Subclass 100 if your application is successful

Prospective Marriage Visa 300

To apply for this visa, you must be outside Australia and your fiance must be an Australian citizen,

After arriving in Australia, the applicant has nine months in which to marry their fiance.

Once married, holders of this visa can then apply for a Partner 820/801 visa to remain permanently in Australia.

Partner Visas – Complex

Requirements

You must be sponsored by a person who is an Australian citizen, Australian permanent resident or eligible New Zealand citizen.

If you have dependent children or other dependent family members, they may make combined applications with your application provided that they meet certain requirement

Partner visas if your visa was refused or cancelled.

Partner visas also may be one of only a couple of available visa options if your visa has been refused or cancelled since your last visit to Australia.

After that, you may still be able to apply for a Partner visa in Australia if you meet certain criteria including:

You must not have had a partner visa refused since you last entered Australia

You must not have had a visa refused or cancelled on character grounds

Your application must have two statutory declarations from Australian citizens, Australian permanent residents or eligible New Zealand citizens supporting your relationship with your partner.

Partner Visas Work

Partner Visas – HowThey Work

Onshore 820/801 visa

This involves two steps and takes you from temporary residency to permanent residency. You can only apply for the 820 visa if you are in Australia. You cannot apply for it if you are overseas.

The 820 visa is granted first and the 801 some 24 months later. The initial Government visa application charge covers both.

You can stay in Australia on your 820 visa till the permanent 801 visa is granted. Getting the 801 visa makes you a permanent resident.

Offshore 309/100 visa

You must be outside Australia to lodge an application and for the 309 visa. Two years after lodging your temporary 309 visa application, you’ll be assessed for the permanent 100 visa which gives you PR. You will need to evidence your continuing partnership even after the 309 temporary visa has been approved.

Prospective Marriage 300 visa

This is the third partner visa which is available. You have to be outside Australia to apply for it

. It’s a temporary visa on which you can move to Australia and marry your partner.

After you get your 300 visa, you have 9 months to move to Australia and get married.

During this time, you can leave and re-enter Australia as many times as you wish.

Partner Visas – Evidence

It’s important to understand that there’s a great deal of information required to complete a Partner Visa application. This inxludes a lot of information about your family and the relationship itself. Australian Migration Action specialises in preparing applications for Partner Visas.

Student Visa Refunds

If overseas students come to Australian in the next two months they will get their visa charge refunded.

Australia has called for international students to “come on down” to help Australia with workforce shortages

Overseas students who arrive in Australia from 19 January will have their visa application fees refunded to encourage more to enter the country.

The move is to help the nation ease workforce shortages caused by the spread of the Covid Omicron variant.

Student Visa Refunds for 8 Weeks

International students will have their visa fee waived for eight weeks. We want them to join our workforce, the Prime Minister said.

The current Student Visa application charge is $630. So, for the next 8 weeks, students coming to Australia will be refunded their $630 after they arrive.

The Australian government hopes the refund scheme will make a big difference in help fo fill continuing workforce shortages.

The rapid rise of COVID-19 infections has resulted in thousands of people being forced off work due to the virus or being required to self-isolate as a close contact.

The government wants to attract scores of thousands of foreign students to come to the country

Treasurer Josh Frydenberg said the government was putting out the “welcome mat”.

Students Get More Work Hours

The federal government last week announced a 40-hour per fortnight working cap would be removed for foreign students in sectors affected by workforce shortages.

There are currently around 325,000 foreign students in Australia – with an estimated 150,000 still offshore.

the Prime Minister said foreign students working and being trained in health and aged care would, in particular, be “incredibly helpful” as the nation continues to grapple with the pandemic.

The Australian Industry Group also recently backed changes allowing international students to work extra hours saying the visa holders would provide much-needed support to sectors such as transport and hospitality

Australia’s borders only reopened to international students and working holiday makers last December after being shut down in response to the pandemic in March 2020.
