&lt;p&gt;&lt;em&gt;As most of you know our youngest son, Robert Nielsen (Chief Warrant Officer-2) is a U.S. Marine stationed in Ramadi, Iraq since FEB 2008. Annina bakes goodies and we send him care packages (cookies, candy, magazines, etc) which he shares with his staff. Robert is the Executive Officer for his Company, and he recently let us know of four Marines and one Navy Corpsman within his Company that are not receiving &amp;quot;care packages&amp;quot; from anyone back home. &lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;I thought we ought to &amp;quot;adopt&amp;quot; these five guys and really help Support Our Troops for June and July. Robert suggested we not send anything after 1 AUG 08. Packages normally take one to two weeks to arrive. Robert suggested we include a note card explaining that, CWO-2 Nielsen submitted their name and thank them for their service to our country. You can let them know that you are a friend of Robert's parents who provided their name to you. It is very hot in Ramadi (100 -115 daily), so it is best to not send items that melt easily. We usually fill the void around the cookies with individually wrapped hard candy form Costco. They can eat it and also share it with the local children while on patrol. DO NOT SEND ANY ALCOHOL, as it is strictly prohibited in Iraq. &lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;If you want to send a package to each these five guys, you will need to address it individually, with the Rank and Name listed here, and this address. The US Post Office has special boxes and reduced rates for shipping &amp;quot;care packages&amp;quot; to the FPO address: &lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;Our son in-law, a National Guardsman, spent a year in Iraq as a US Army medic. He left his wife, our daughter, and three young children in upstate New York for that year. Our daughter organized Operation MADPAW: Michael Anthony Dollard Package A Week. For one year his friends and family signed up for a specific week and sent him a package which he shared with his men and with Iraqi children: like beef jerky, chips, videos, toothpaste, magazines, DIsney band aids, bubble gum, hair clips, hot cars, etc. When he signed up for his R &amp;amp; R destination, he signed up for Spokane, the closest commercial airport to Priest Lake where he spent 10 wonderful days at our cabin with his family, including his parents who flew out just to get two days with him. Doesn't matter if you support the US presence in Iraq or not. You honor the men and women who risk life and limb because they said they would. Even though you may not know them, telling them &amp;quot;thanks&amp;quot; is HUGE.&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;The Priest Lake Ambulance Groomer Facility received notification from the Idaho Department of Park and REcreation that our grant application was approved in the amount of $154,663.00&lt;/p&gt;

&lt;p&gt;Our community of Priest Lake, both West and East side, has raised thus far $198,258.00 gift in kind donations and cash donations.&amp;nbsp; We sincerely appreciate those, however, we are still short approximately $40,000.00 and we would sincerely appreciate any additional donations in cash support.&lt;/p&gt;

&lt;p&gt;It will be a benefit to everyone on both sides of the Lake to have an ambulance facility with quicker response time at Priest Lake.&amp;nbsp; It could be important to all of us at one time or another.&lt;/p&gt;&lt;p&gt;If you can assist in this final campaign, please send your check payable to&lt;/p&gt;

&lt;p&gt;With the new fee notices there is alot of information going around about this. I have received some information to help people ascertain what is going on.&lt;/p&gt;

&lt;p&gt;&lt;em&gt;Pecky, the Idaho Panhandle National Forests have mailed the notices for the &lt;br /&gt;new annual fee rates to the 121 Priest Lake Recreation Residence Permit&lt;br /&gt;holders. Should the fees stand as proposed they will be implemented January&lt;br /&gt;1, 2010.&lt;br /&gt;&lt;br /&gt;&lt;/em&gt;&lt;/p&gt;&lt;p&gt;&lt;em&gt;In 2000 Congress passed CUFFA, (Cabin Users Fee Fairness Act) which directs&lt;br /&gt;fees to be 5% of current private land property values. Current property&lt;br /&gt;values are to be determined by an independent highly qualified fee&lt;br /&gt;appraiser.&amp;nbsp; Last summer the Forest Service and the private appraiser met&lt;br /&gt;with the cabinowners and over the winter the appraisals were completed.&lt;br /&gt;North Idaho, including Priest Lake, has experienced a substantial rise in&lt;br /&gt;property values since the last appraisals in 1997.&amp;nbsp; The result is fees are&lt;br /&gt;going up.&lt;br /&gt;&lt;br /&gt;Last summer at the annual cabinowners meeting which I attended, it was&lt;br /&gt;apparent that people understood that property values had increased and&lt;br /&gt;there would be an increase in their annual fees. At that time no one really&lt;br /&gt;knew how much they would rise and the discussion focused on how permitted&lt;br /&gt;lots were different with more use restrictions than private property, and&lt;br /&gt;how these &amp;quot;limitations&amp;quot; should result in reductions to the valuations. The&lt;br /&gt;problem with this is CUFFA firmly set the rules the appraiser and the&lt;br /&gt;Forest Service were to follow.&lt;br /&gt;&lt;br /&gt;People were unhappy in 1997 when fees went up and last summer's meeting&lt;br /&gt;gave a strong indication that they would not be happy with fee&amp;nbsp; increases&lt;br /&gt;in 2008.&amp;nbsp; Interpretations of CUFFA will be a focal point and there likely&lt;br /&gt;will be follow thru on the procedures prescribed in CUFFA to argue fee&lt;br /&gt;increase; such as the cabinowners may secure their own 2nd appraisal.&amp;nbsp; The&lt;br /&gt;Priest Lake Ranger District and the Idaho Panhandle National Forests have&lt;br /&gt;enjoyed a productive working relationship with the cabinowners and their&lt;br /&gt;leadership for 20 years. It will be especially important this summer that&lt;br /&gt;we continue to communicate.&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;Recreation Residence Program&lt;/p&gt;

&lt;p&gt;Cabin User Fee Fairness Act&lt;/p&gt;

&lt;p&gt;BACKGROUND – Recreation Residence Program and Fees&lt;/p&gt;

&lt;p&gt;Recreation residences are an historic and well-recognized recreation experience for thousands of cabin visitors. This use is one of the largest single types of special use authorized on National Forest System (NFS) lands. Recreation residences were first authorized in the early 20th century to encourage recreation on the National Forests. The program grew popular over the years and the Forest Service established numerous recreation residence tracts permitting individuals to build and use privately-owned cabins on publicly-owned land. There are currently approximately 14,500 recreation residence authorizations on NFS lands. &lt;/p&gt;

&lt;p&gt;The program is intended for seasonal recreational use, not for commercial purposes or full time residency. There are restrictions regarding cabin size, design, colors, vegetation management, and the like. The program is managed to provide a rustic setting for family-oriented recreational opportunities. &lt;/p&gt;

&lt;p&gt;Early fees nominal, $5 to $10 per year. Modest fee increases were seen over the years. Legislation enacted in the early 1950’s, directed government agencies to obtain market-based fees for private uses of Federal property. For many NFS land special uses, including recreation residences, the standard became 5 percent of the market value of the land encumbered by the permit in the absence of market evidence supporting an alternative fee.&lt;/p&gt;

&lt;p&gt;After an extended period of discussions with cabin owners and organizations representing them, on August 16, 1988 (53 FR 30924), the Forest Service adopted a policy that set forth procedures for administering the program. The 1988 policy included guidance pertaining to the tenure and re-issuance of recreation residence term special use permits; procedures to be followed when a recreation residence site is needed for a higher public purpose; and procedures for determining market value fees for this type of use and occupancy. &lt;/p&gt;

&lt;p&gt;The 1988 policy was appealed, and final regulations were not issued until 1994. The Forest Service began to appraise recreation residence tracts in 1996. In some cases, appraisals completed in 1997 revealed substantial increases in the market value of recreation residence lots since they were last appraised in the late 1970’s and early 1980’s. Land use fees were based on &lt;br /&gt;5 percent of the market value of the lot. The Implicit Price Deflator-Gross National Product had been utilized as an annual adjuster for fees, but this index did not adequately reflect the rise in real estate values. In response, recreation residence permit holders and their associations contacted their congressional representatives, requesting relief from the increased fees. Congress responded to constituent concerns by limiting the Forest Service’s ability to fully implement fee increases through appropriation authorities for fiscal years 1998, 1999, and 2000 and finally with the passage of CUFFA in 2000. &lt;/p&gt;

&lt;p&gt;On May 13, 2003, the Forest Service published a proposed rule (68 FR 25748) to revise current regulations at 36 CFR part 251, subpart B, and proposed Agency directives (68 FR 25751) to &lt;/p&gt;

&lt;p&gt;incorporate the provisions of CUFFA into Departmental regulations and the Forest Service Directive System. The proposed rule and Agency directive notices provided for a 90-day comment period, which ended August 11, 2003. There were no requests for an extension of time. The Forest Service received 950 comments. The majority of comments were from individuals that identified themselves as recreation residence permit holders or organizations representing their interests.&lt;/p&gt;

&lt;p&gt;In drafting proposed regulations, the Forest Service provided interested members of the public the opportunity to review and express opinions on the agency’s interpretations and proposed implementation of CUFFA. Like the proposed regulations, a significant portion of the final regulations is a reiteration of the statutory language found in CUFFA. Revisions to the final rule and Agency directives were made to address respondent concerns received during the comment period. &lt;/p&gt;

&lt;p&gt;The final rule and directives were published April 3, 2006. The publication marked the beginning of a two-year transition period before implementation of fees set by the appraisal process required by CUFFA. That period is complete, and with few exceptions, annual fees due in January 2009, will be based either on appraisals completed in the 1990’s or new appraisals conducted pursuant to the provisions of CUFFA. &lt;/p&gt;

&lt;p&gt;Appraisals completed and reviewed in fiscal year 2007 and early 2008 (fairly complete data on about 10 percent of the whole – but notably no results are in from west coast states which host the majority of permits) indicate most fees will be increasing, but by widely varying amounts. These early results indicate that approximately three-quarters of fees will be below $4,000 per year, and over half are between $1,000 and $2,500 per year. Approximately 8 percent of the new fees will be set at $10,000 or more, and of those some 65 percent are under $15,000. The highest valued lot appraised thus far indicated a value of $545,000 and will command a base fee of $27,250. The high end lots typically have access and views of popular lakes and/or have highly sought after mountain views. As work is completed in more of the western states it is anticipated that waterfront and waterview lots will experience increases corresponding with the rapid rise in private property values that have become common place.&lt;/p&gt;

&lt;p&gt;As some fees were still based on late 70’s and early 80’s appraisals and others on mid-90’s appraisals, directly comparing fee increases among holders, especially on a percentage basis, may be misleading. However, since this figure is focused on frequently, the reader should note that the percent change in fee from pre-CUFFA appraisals is extremely variable. Early results indicate fee changes anywhere from down 62 percent to up over 700 percent. About 70 percent of all permits examined thus far will see fee increases less than 200 percent. It is important to bear in mind that real estate values have risen dramatically in the last ten to thirty years, thus significant increases in fees should not have been unexpected. Even with the recent downturn in the residential market, residential prices are up nearly 300 percent nationally since 1980. Different regions are up anywhere from 100 percent to over 600 percent. &lt;/p&gt;

&lt;p&gt;FREQUENTLY RAISED ISSUES&lt;/p&gt;

&lt;p&gt;The Forest Service appraisal process does not adequately consider restrictions on the use of the permitted lot.&lt;/p&gt;

&lt;p&gt;CUFFA [Sec. 606(a)(2)] required the Forest Service to establish an appraisal process to &amp;quot;determine the market value of the fee simple estate of a typical lot or lots considered to be in a natural, native state.&amp;quot; The law goes on to add several caveats to the appraisal process, but none pertaining to permit restrictions. &amp;quot;Fee simple estate&amp;quot; is a legal term which describes absolute, unencumbered ownership rights to a parcel of land. The law therefore requires appraisal of the recreation residence lot, as though vacant, unfettered by permit restrictions.&lt;/p&gt;

&lt;p&gt;Section 607 of CUFFA requires the Forest Service to establish the cabin user fee as an amount &amp;quot;equal to 5 percent of the market value of the lot, as determined in accordance with section 606, reflecting an adjustment to the typical market return due to restrictions imposed by the permit.&amp;quot; Senator Craig, a sponsor of the legislation, entered into the record a section-by-section analysis of the bill. Mr. Craig’s explanation of the fee setting mechanism was as follows: &amp;quot;To determine the annual base cabin use fee, the Secretary shall multiply the market value of the cabin lot by 5 percent. This calculation reflects restrictions imposed by the permit, including the limited term, absence of significant property rights, and the public’s right of access to, and use of, any open portion of the forest lot upon which the cabin is located&amp;quot; (emphasis added).&lt;/p&gt;

&lt;p&gt;CUFFA precludes the Forest Service from considering permit restrictions in the appraisal process.&lt;/p&gt;

&lt;p&gt;The 5 percent rate does not adequately reflect restrictions on the use of the lot. &lt;/p&gt;

&lt;p&gt;In hearings before the Senate Committee on Agriculture, Nutrition, and Forestry, Subcommittee on Forestry, Conservation and Rural Revitalization and the House Subcommittee on Forests and Forest health of the Committee on Resources, the Congress heard extensive testimony on this and related issues. Witnesses testifying before the Senate Committee (March 22, 2000) included representatives of the American Land Rights Association, National Forest Homeowners, Sawtooth Forest Cabin Owners’ Association, Associate Deputy Chief, National Forest System, USDA Forest Service, as well as several private professional real estate appraisers. Witnesses before the House Committee (March 23, 2000) included some of the same individuals, as well as a representative of The Appraisal Foundation.&lt;/p&gt;

&lt;p&gt;The Forest Service testified that the 5 percent rate was agreed upon by the cabin owners during negotiations in the 1980’s. Representatives from the American Land Rights Association and the National Forest Homeowners (NFH) disputed that point. The representatives indicated that they did not object to the 5 percent at the time, but had thought that permit restrictions would be reflected in the appraisal process. It is worthy of note that CUFFA, as drafted at the time of the hearings, included detailed language requiring significant adjustments in the appraisal process for permit restrictions as well as directing the appraiser as to appropriate weight to be placed on comparable sales. &lt;/p&gt;

&lt;p&gt;The Forest Service did not present any studies to support the 5 percent rate. According to the transcript of the hearing, in response to questioning Associate Deputy Chief Brouha stated in general terms that &amp;quot;recognition of the terms and conditions of the permit as opposed to the terms and conditions found in typical land leases is reflected in the 5 percent of land value fee determination. Current return rates based on recent market analysis reflect a range of return rate for real estate of between 8 and 12 percent. The 5 percent would reflective(sic) of the difference.&amp;quot;&lt;/p&gt;

&lt;p&gt;Written testimony from Richard M. Betts, MAI, ASA, SRA, a professional real estate appraiser engaged by the cabin owners also disputed the 5 percent rate. The testimony indicated that the rates quoted by the Forest Service, which he said were between 10 to 17 percent, were too high for rural lands. The testimony indicated that &amp;quot;rural rates for 20 year leases with annual indexing, secured by development of cabins, often also secured by the expense of developing water, septic, electricity and roads, are more in the 7 to 10 percent range, leaving a relatively slim discount for the substantial ownership and use restrictions, &lt;br /&gt;so well documented in prior hearings on this topic.&amp;quot; Though Mr. Betts indicated this is a &amp;quot;slim discount,&amp;quot; the reader should bear in mind that the difference between a 7 percent rate and a 5 percent rate represents a fee reduction of 28.6 percent. A reduction from 10 percent to 5 percent results in a 50 percent drop in fees. &lt;/p&gt;

&lt;p&gt;After consideration of the testimony, and of Mr. Craig’s September 2000 remarks indicating the 5 percent rate reflected permit restrictions, the Congress enacted CUFFA which required a fee equal to 5 percent of the appraised value of the fee simple estate.&lt;/p&gt;

&lt;p&gt;Significant fee increases may force some cabin owners to sell their cabins, but due to the increased fees the cabins may be difficult to sell.&lt;/p&gt;

&lt;p&gt;CUFFA provides permit holders the opportunity to obtain a second appraisal, at their own expense, if the holder is unhappy with the appraisal obtained by the Forest Service. If a holder is still dissatisfied with a fee determination, the deciding official’s fee decision is subject to the administrative appeal process. In addition, CUFFA provides for a phase in of significant fee increases. If fees increase by 100 percent or more, the increase is phased in over a three year period. The Forest Service has no statutory authority to adjust a market value-based land use fee according to the holder’s financial status or ability to pay. &lt;/p&gt;

&lt;p&gt;No fees have yet been established pursuant to CUFFA. As of April 2008, perhaps 10 percent of permit holders have been given notice of new fees, but none have been implemented. A handful of holders have notified the Forest Service that they intend to obtain a second appraisal, but no second appraisals have yet been submitted. &lt;/p&gt;

&lt;p&gt;Cabin owners have cited anecdotal evidence of losses in cabin value, and noted a case on Lake Wenatchee (Washington) where a cabin owner attempted to sell his cabin at auction with a $50,000 floor, and had no bidders. The Forest Service has no information on the quality of the cabin which was offered for sale. The Forest Service has not yet appraised any of the Lake Wenatchee lots under CUFFA, so new fees are not yet known. &lt;/p&gt;

&lt;p&gt;The Forest Service has noted cabins currently listed for sale in southern California in the $300,000 plus range. The Forest Service has also noted that past sales of cabins have been at prices thought to be well in excess of the value of the structure. (The structure is all the cabin owner has to sell. Permits are not transferable.) Sale prices in excess of structure value indicate that sellers were obtaining a premium for location and the presumption that the permit would transfer to the new cabin owner. Such a premium is an indication that past fees were below market. As new fees approach market rent, cabin sale prices should more closely reflect structure value.&lt;/p&gt;&lt;/div&gt;

(PLSAR) is pleased to announce that they will be presenting the 2008 Huckleberry Festival on Saturday, August 2nd, 2008.  The Huckleberry Festival will become PLSAR's primary annual fundraising event.  &lt;/p&gt;

&lt;p&gt;The 2008 Festival, an entertaining family event, will feature the ambiance of the Priest Lake Golf Course, with a quality arts and crafts fair, food booths, commercial booths, and excellent bluegrass music from 10 AM to 5 PM.  There will also be a golf tournament followed by a BBQ dinner for the golfers and their spouses.  (Only 200 dinner tickets are available.)  Bring a chair or picnic blanket to enjoy the day's finale for a "Blues on the Green" concert open to all after 6 PM. It will be a jam packed, fun filled family day sure to become an annual Priest Lake tradition.  You are invited to help support Priest Lake Search and Rescue and the 2008 Huckleberry Festival.
