Has Bayantel DSL Connection Really Improved in 2013?

I stopped writing articles about Bayantel and their DSL connection because I can't deny the fact that their internet service has improved a lot in 2013. However, just this morning, I again experienced a few problems. I can't connect to some websites even to my own website. I almost would have blamed my web host for that if I didn't check the Twitter. Some Twitter users (most probably Bayantel subscribers) were tweeting about them not being able to connect to the internet or they have aslow internet connection like the following:

I've tried to ping a few websites and the results were indeed disappointing. 100% pocket loss (screenshots later). It's sad to say this but I thinkBayantel has not really improved in 2013. But what about that statement I said at the beginning of this post "because I can't deny the fact that their internet service has improved"? Well I forgot to clarify their that's at least on my end. Because still I've been seeing complaints from different people probably Bayantel subscribers, on Twitter, in the comment section of different blog sites, from Bloggers as well and from almost everywhere on the internet.

So what's the real status of Bayantel and their DSL service then?

I think it still depends on the area where a subscriber is located. There are some people from particular areas who complain of slow internet, at the same time however, there are also subscribers who seem verysatisfied with the service. So you just really have to investigate; make an informal survey if necessary, do some research about this company before you apply if you're a new customer. Or if you are already subscribed, before calling their customer hotline, I'd recommend you first check whether the problem is really on their end or it's just you who is experiencing connection issues for example. It is very easy to do especially now that there's Twitter and Facebook already. If you're internet connection is intermittent and you live in Cubao for example, see if there are people who have the same issue in Cubao area.
Update:
I've been experiencing intermittent internet connection lately but it may be because now is a holiday? more people connect to the internet so the service can't accommodate the high demand for internet connection. This may be acceptable and understandable depending on the situation but still, it doesn't mean that Bayantel won't have to do anything to improve their infrastructure.
Another update:
Today is the last day of 2013 and just yesterday I've experienced intermittent connection again.

Tapping Cable and Internet Signal is Illegal, Says NTC

On April 17, 2013, President Aquino signed Republic Act No. 10515 or the Anti-Cable Television and Cable Internet Tapping Act of 2013. Now the National Telecommunication Commition (NTC) has issued guidelines through a memorandum circular regarding this law which prohibits any person from tapping to existing cable and internet facilities without authority from the cable operator or internet provider.
Unauthorized connection through wired, wireless, electromagnetic and other means are prohibited as indicated in the law. Also indicated is the appropriate punishment for the violators. This is to protect the legitimate service provider and the paying public according to the government.

Reproducing any stolen cable TV and internet signals through recording, and using it for comercial purposes is also illegal. For the violators, the punishment is an imprisonment between 2 to 5 years, and fine between P50000 and P100000.

The Philippine Cable Television Association Inc. (PCTA) is very positive about the news regarding the signing of the law, saying growth is expected in the cable industry. PCTA president Allan Dungao said,

All of us can now sigh with relief. I remember that we started working and pushing for this law in 2006 on my first term as president of PCTA because I believed then, and I still do now, that the cable industry will grow and revenues will increase once we have this law.

Are you Satisfied with Lazada?

Having an online store in the Philippines is great because now, people don't have to go to Amazon just to order a product which is also available locally. And if you try to place an order on Amazon, there's always a chance that you encounter a seller that doesn't ship their products internationally.

Then Lazada Philippines

Filipinos see them almost everywhere on the net. Advertisements on Youtube videos,
online search results, recommendation from friends; all are factors for the successful promotion of their website. Lazada is relatively new in the country, so you can't just compare them to Amazon at least not yet.

But this post is for those who already tried their service and would like to share their own stories and experiences dealing with Lazada Philippines. To help others who are now planning to buy from lazada.com.ph, we should tell them what to expect and prepare them... for the worst? :)

But it's worth mentioning that one of their payment methods attract a lot of people (including me), I'm talking about the cash on delivery (COD). It is very convenient because

You don't have to worry if for example your order didn't arrive on time.

According to the FAQ section on their website, ten business days is the longest time you should wait for the item you ordered. And three days is the shortest. However they can deliver the item even within 48 hours. That can be true particularly for their Metro Manila customers.

It is also convenient for those who don't have a credit card

Until now, still few people in the country use a credit card. That's why it's only recently when online shopping became more popular for the Filippinos. Prior to Lazada.com.ph, Filipino people would usually go to sulit.com.ph (now olx.ph) to find second hand products.

Sulit.com.ph (olx.ph) however is not a safe place to shop online because
1. You are usually dealing with individuals who just want to get rid of their old items.
2. Most of the sellers don't have a physical store so if the item you bought is defective or has other problems, you will have to contact the seller again to arrange a meetup.
However with Lazada.com.ph, you just have to log-on to their website, make a few clicks and after that all you need to do is wait. It is very safe because
1. You are protected by some laws regarding online shopping or credit card policy.
2. Lazada Philippines has a return policy where you can send them back the item you bought within 14 days.
3. All products you see on their website are genuine unless otherwise stated.

Lazada Philippines Payment Options Other Than COD?

Of course the credit card method is always prefered especially when buying online, as it is very safe. Other methods are Visa, Master Card, Online installment and Paypal.

I have already tried their service once and it was great! Accessible website, easy tcheckout process, helpful customer service representatives and great selection of products. These are the reasons why I'm thinking to shop at Lazada again. But I know they are not perfect. The item I bought from them arrived two weeks after I ordered it. Also when I tried to call their hotline, I had a hard time talking to their CSR people not because they're not good, but because their equipment/system did have somekind of a technical problem. That happened twice. It's like that they're using a VOIP system for their call center and their internet connection had issues. But overall, my experience with them was forgivable.

I recommend Lazada Philippines for those who want to shop online when you are in the Philippines. They ship all over the country. However there's a small delivery charge when the item is below P1000, but I think that's understandable.

NBA Game in the Philippines Soon

On october 10, 2013, Houston Rockets and Indiana Pacers will be playing at the Mall of Asia arena. This will be a great opportunity for the Filipino fans to witness an NBA game and their NBA idols live. The last time a similar event happened was when the NBA selection lead by Coby Bryant, the two-time MVP and Chris Paul of the New Orleans Hornets took on our own PBA selection. This game on Thursday however, is part of the pre-season games of the 2013-2014 NBA season which started on October 5, and will end on October 18.

Few of the NBA players you can expect in that game are James Harden, Jeremy Lin and Chandler Parsons of the Houston Rockets, as well as Paul George and Roy Hibbert of the Indiana Pacers.

Lazada Philippines Customer. Happy or unhappy?

I would like to share my own story when I made my first purchase on Lazada, an online store in the Philippines. Their promotion is good, the website is easy to navigate, the CSRs people are friendly. Everything about this online shopping store seems perfect based on these things. But why do I still encounter unhappy and unsatisfied customers (most of them are bloggers) when I try to search keywords related to Lazada?

My first order

The product is Infiniti JS-8080 PC headset. My plan was to choose cash on delivery as the payment option because,

I wanted to make sure that the item will arrive even it’s only worth P500 or less

I ordered on Friday, September 20, 2013. Fortunately the process went smoothly. After checkout I Immediately received the confirmation email with the details like the order number. The next morning I received another email saying that the order is verified and advised me to expect an email once the headset left the warehouse. That was Saturday so I wasn’t expecting much. Then Monday came but still no headset. Tuesday then Wednesday. On a side note, while waiting for the item, I was just using an earphone originally for the MP3 player. You can’t really enjoy the music using that earphone because it has no bass frequency.

Wednesday evening on September 25, I received an email regarding my order.

We have tried to deliver your order last Sept. 22, 2013 to the shipping address you provided in our system but were unsuccessful.

I replied to that email and also texted the number they gave. I told them to redeliver the item on September 26. Thursday then Friday, I was still using the old crappy earphone while trying to be optimistic about my online purchase. Why does it have to be like that? Is it because the headset is cheap? Is it because I didn’t pay with a credit card? Are they worried that when they deliver the item, the recipient might just cancel the order? On September 27 Friday, I called Lazada to inquire and I was told that they’re going to make a report regarding my problem.

On October 3 I called again to inquire

The customer service representative told me that my order was canceled and he didn’t know why. I want to tell you at this point that I never cursed, never shouted at them. I was disappointed yes, but I am a forgiving person. I had worse experience than this. And besides, Lazada is still a new company. Of course the Filipino people should expect a good service from them. But it seems that 20 months is still not enough for this online store to improve things. Let us give them another um, 10 months? They have a very good website anyway.

Speaking of their website, after that call, I logged on to my account and clicked the buy again button. Like the first time, I received the confirmation email. But hours later, to my surprise, they emailed again informing me my order has been shipped and now they want me to wait for one to two days. And on October 4, the headset has arrived finally and I am so happy!

The following are the things I learned from this experience.

Lazada Philippines was launched in February 2012
Their website is very accessible, responsive, informative and has great selection of products
Lazada CSRs are friendly
One to two days delivery time for Manila customers is possible

Their order tracking system is not reliable
They have poor call center equipment

If you ask me if I can recommend Lazada, I would definitely say yes. But I would also suggest that you try first the cash on delivery (COD) method. They have great selection of products on their website especially in electronics and gadgets categories. So it’s possible that you'll find what you need and unlike in the traditional stores, it will be very convenient if you just make your order online right? This is a short article about the different changes I've made on this website. Like the theme, the widgets and their placement, the domain itself; yes now it has a new domain! I need your help that's why I wrote this post. In the comment section below, I would appreciate it so much if you can put there your observations; your reaction or suggestion and the other things that you want me to improve or any modification that you want me to do here on this blog. The reason why I'm asking this, is because I'm blind. But even I am blind I want to blog, but I am aware of the limitations. For example when I want to change the theme sure I can do that. With the help of a screen reader of course. More about the screen reader here.But in terms of the visual design, that's when I need some assistance from sighted people. To explain further, let's say I want to put social buttons on top of every post. I know exactly where to go in the HTML editor. But when the time that I have to adjust their position or their distance to each other, that's when the problem starts. I need someone who can tell me if there's any issue like that here. I need you to honestly say if there is something wrong with my design. I need to know if I am doing ok or I need to change anything. Thank you for your help.

Old news already because it's been weeks since the video of Chito Miranda, the singer of the band Parokya ni Edgar and his girlfriend Neri Naig has become viral topic on the internet. In fact you may admit it or not, you've probably seen it by now. Not yet? That's good news because I won't recommend or suggest you watch that kind of video because it's just not right. But this post is not here to tell you what's right or not. I wrote this to compare Chito and Wally as the title suggests.

Who the hell is Yosh anyone? Guess what, Wally and Yosh has video like Chito and Neri. Now we're getting somewhere. Again, as the title of the post tells you, this is a comparison between Chito Miranda, the singer of Parokya, and Wally Bayola, one of the hosts of Eat Bulaga.

Now the similarities between Chito and Wally

Both are entertainers
Both can sing but not that good
Both guys are old- Chito is 37 years old and Wally is 40?
Both are considered artists in their respective fields
They are both lucky in my opinion

PLDT Should Give Us Back our Money

This is a very short post about PLDT, (the leading internet provider in the Philippines). I can’t comment on how good their internet service is; if they also have internet connection issues like intermittent connection, slow speed, high latency etc because I have yet to try their service. This is just to talk about our story when we tried to apply for their DSL and landline package.

Applying for a PLDT Service

We went to their office on September 28, 2011. The time of this writing is February 2012; almost five months after. We were asked to fill in the application form and pay the initial charge amounting to P1600. To cut the story short, our application was approved. But for some reason the installation of the landline and the internet didn’t happen and so we talked to them for the reimbursement. We’ve gone to a PLDT branch nearest to us many times, called their hotline number but still we couldn’t get our money back.

I would have to state that, PLDT, Bayantel and other service providers are very good at getting their customers’ money. If the customer can’t pay his bills on time, the company would temporarily disconnect or deactivate the internet or the outgoing feature of his landline phone for example. And if the customer manages to pay his balance, that’s the only time the services are restored. But in this case like we have, we’re asking them to return our money as our application was not successful but it’s now five months but where is our money? When we ask them this question, all they say is that, “the branch has no fund right now and you have to wait”; what?

Bayantel DSL High Latency Issue

Bayantel DSL is giving me reasons to write articles like this. Their subscribers would call their hotline hoping that their problem about their internet connection could be fixed. Unfortunately after several instances of a Bayantel technician visiting their house, the issues still persist. In fact, I can’t see any improvement regarding that intermittent connection problem I discuss in my other posts. And here is another issue that is emerging; about high latency or in a broader term, most people consider it as slow speed when they browse the internet.

What Does High Latency Mean and Does Bayantel Really Have it?

High latency is a delay between sending and receiving data or information over some network; most of the time people call it (lag). Also, when devices on your computer communicate with each other and there are delays, you can also consider calling it latency.

From time to time, every internet provider experiences high latency in their service depending on some factors. In satellite internet service, you have latency when you notice some delay when loading a website for example. It is due to the propagation delay as the data must first travel from the satellite to your computer at a speed of light. In DSL, physical and technical factors also contribute to the delay like when data make network hops or data passing through proxy servers.

But how do you measure latency?

Tools like ping tests and traceroute can measure latency by determining how long it takes a network packet to travel between the source and destination and vice-versa. It is called round-trip time. Round-trip times of not more than 100 milliseconds (MS) are acceptable but below 25MS so desired on DSL or cable connections. But on satellite internet, it is normal to have 500MS or higher.

How do you perform a ping test?

Open the command prompt and type “ping www.yahoo.com” without the quotation marks. And in the ping statistics section, you will find the information you want such as the packet loss and the round-trip times.

How do you perform a traceroute?

You open the command prompt and type “traceroute www.yahoo.com” without the quotation marks. It will show you a list of every network, routers or computers before the data reach the desired destination. Through this, you will know what causes the delay, where it originates and more.

To open the command prompt, click the start button, go to all programs, accessories and click command prompt. Or you can simply type “CMD” without quotation marks on the run dialog box.

SHORT TITLE AND DECLARATION OF POLICY

Section 1. Short Title- This Act shall be known and cited as the "Electronic Commerce Act."
Section 2. Declaration of Policy- The State recognizes the vital role of information and communications technology (ICT) in nation-building; the need to create an information-friendly environment which supports and ensures the availability, diversity and affordability of ICT products and services; the primary responsibility of the private sector in contributing investments and services in ICT; the need to develop, with appropriate training programs and institutional policy changes, human resources for the information age, a labor force skilled in the use of ICT and population capable of operating and utilizing electronic appliances and computers; its obligation to facilitate the transfer and promotions of technology; to ensure network security, connectivity and neutrality of technology for the national benefit; and the need to marshal, organize and deploy national information infrastructures, comprising in both communications network and strategic information services, including their interconnection to the global information networks, with the necessary and appropriate legal, financial, diplomatic and technical framework, systems and facilities.

PART II

ELECTRONIC COMMERCE IN GENERAL

CHAPTER I
GENERAL PROVISIONS

Section 3. Objective- This Act aims to facilitate domestic and international dealings, transactions, arrangements agreements, contracts and exchanges and storage of information through the utilization of electronic, optical and similar medium, mode instrumentality and technology to recognize the authenticity and reliability of electronic data messages or electronic documents related to such activities and to promote the universal use of electronic transactions in the government and by the general public.

Section 4. Sphere of Application- This Act shall apply to any kind of electronic document used in the context of commercial and non-commercial activities to include domestic and international dealings, transactions, arrangements, agreements contracts and exchanges and storage of information.

Section 5. Definition of Terms- For the purposes of this Act, the following terms are defined, as follows:

(a) "Addressee" refers to a person who is intended by the originator to receive the electronic data message or electronic document, but does not include a person acting as an intermediary with respect to that electronic data message or electronic data document."Computer" refers to any device or apparatus singly or interconnected which, by electronic, electro-mechanical, optical and/or magnetic impulse, or other means with the same function, can receive, record, transmit, store, process, correlate, analyze, projects, retrieve, and/or produce information, data, text, graphics, figures, voice, video, symbols or other modes of expression or perform any one or more of these functions.

(b) "Electronic data message" refers to information generated, sent, received or stored by electronic, optical or similar means.

(c) "Information and Communications System" refers to a system for generating, sending, receiving, storing, or otherwise processing electronic documents and includes the computer system or other similar device by or in which data is recorded or stored and any procedures related to the recording or storage of electronic document.

(d) "Electronic signature" refers to any distinctive mark, characteristic and/or sound in electronic from, representing the identity of a person and attached to or logically associated with the electronic data message or electronic document or any methodology or procedures employed or adopted by a person and executed or adopted by such person with the intention of authenticating or approving an electronic data message or electronic document.

(e) "Electronic document" refers to information or the representation of information, data, figures, symbols or other modes of written expression, described or however represented, by which a right is established or an obligation extinguished, or by which a fact may be prove and affirmed, which is receive, recorded, transmitted, stored, processed, retrieved or produced electronically.

(f) "Electronic key" refers to a secret code which secures and defends sensitive information that crossover public channels into a form decipherable only with a matching electronic key.

(g) "Intermediary" refers to a person who in behalf of another person and with respect to a particular electronic document sends, receives and/or stores provides other services in respect of that electronic data message or electronic document.

(h) "Originator" refers to a person by whom, or on whose behalf, the electronic document purports to have been created, generated and/or sent. The term does not include a person acting as an intermediary with respect to that electronic document.

(i) "Service provider" refers to a provider of-

I. Online services or network access or the operator of facilities therefor including entities offering the transmission, routing, or providing of connections for online communications, digital or otherwise, between or among points specified by a user, of electronic documents of the user's choosing; or

II. The necessary technical means by which electronic documents of an originator may be stored and made accessible to designated or undesignated third party.

Such service providers shall have no authority to modify or alter the content of the electronic document received or to make any entry therein on behalf of the originator, addressee or any third party unless specifically authorized to do so, and who shall retain the electronic document in accordance with the specific request or as necessary for the purpose of performing the services it was engaged to perform.

CHAPTER II
LEGAL RECOGNITION OF ELECTRONIC DATA MESSAGES AND ELECTRONIC DOCUMENTS

Section 6. Legal Recognition of Electronic Data Messages- Information shall not be denied validity or enforceability solely on the ground that it is in the form of electronic data message purporting to give rise to such legal effect, or that it is merely incorporated by reference in that electronic data message.

Section 7. Legal Recognition of Electronic documents- Electronic documents shall have the legal effect, validity or enforceability as any other document or legal writing, and-

(a) Where the law requires a document to be in writing, that requirement is met by an electronic document if the said electronic document maintains its integrity and reliability and can be authenticated so as to be usable for subsequent reference, in that–

i. The electronic document has remained complete and unaltered, apart from the addition of any endorsement and any authorized change, or any change which arises in the normal course of communication, storage and display; and

ii. The electronic document is reliable in the light of the purpose for which it was generated and in the light of all relevant circumstances.

(b) Paragraph (a) applies whether the requirement therein is in the from of an obligation or whether the law simply provides consequences for the document not being presented or retained in its original from.

(c) Where the law requires that a document be presented or retained in its original form, that requirement is met by an electronic document if-

i. There exists a reliable assurance as to the integrity of the document from the time when it was first generated in its final from; and

ii. That document is capable of being displayed to the person to whom it is to be presented: Provided, That no provision of this Act shall apply to vary any and all requirements of existing laws on formalities required in the execution of documents for their validity.

For evidentiary purposes, an electronic document shall be the functional equivalent of a written document under existing laws.

This Act does not modify any statutory any statutory rule relating to admissibility of electronic data massages or electronic documents, except the rules relating to authentication and best evidence.

Section 8. Legal Recognition of Electronic Signatures.- An electronic signature on the electronic document shall be equivalent to the signature of a person on a written document if the signature is an electronic signature and proved by showing that a prescribed procedure, not alterable by the parties interested in the electronic document, existed under which-

(a) A method is used to identify the party sought to be bound and to indicate said party's access to the electronic document necessary for his consent or approval through the electronic signature;
(b) Said method is reliable and appropriate for the purpose for which the electronic document was generated or communicated, in the light of all circumstances, including any relevant agreement;

(c) It is necessary for the party sought to be bound, in or order to proceed further with the transaction to have executed or provided the electronic signature; and

(d) The other party is authorized and enable to verify the electronic signature and to make the decision to proceed with the transaction authenticated by the same.

Section 9. Presumption Relating to Electronic Signatures-In any proceedings involving an electronic signature, it shall be presumed that,

(a) The electronic signature is the signature of the person to whom it correlates; and

(b) The electronic signature was affixed by that person with the intention of signing or approving the electronic document unless the person relying on the electronically designed electronic document knows or has noticed of defects in or unreliability of the signature or reliance on the electronic signature is not reasonable under the circumstances.

Section 10. Original Documents.-

(1) Where the law requires information to be presented or retained in its original form, that requirement is met by an electronic data message or electronic document if;
(a) the integrity of the information from the time when it was first generated in its final form, as an electronic document is shown by evidence aliunde or otherwise; and

(b) where otherwise it is required that information be resented, that the information is capable of being displayed to the person to whom it is to be presented.

(2) Paragraph (1) applies whether the requirement therein is in the form of an obligation or whether the law simply provides consequences for the information not being presented or retained in its original form.

(3) For the purpose of subparagraph (a) of paragraph (1):
(a) the criteria for assessing integrity shall be whether the information has remained complete and unaltered, apart from the addition of any endorsement and any change which arises in the normal course of communication, storage and display ; and

(b) the standard of reliability required shall be assessed in the light of purposed for which the information was generated and in the light of all the relevant circumstances.

Section 11. Authentication of Electronic Data Messages and Electronic Documents.- Until the Supreme Court by appropriate rules shall have so provided, electronic documents, electronic data messages and electronic signatures, shall be authenticated by demonstrating, substantiating and validating a claimed identity of a user, device, or another entity is an information or communication system, among other ways, as follows;

(a) The electronic signatures shall be authenticated by proof than a letter , character, number or other symbol in electronic form representing the persons named in and attached to or logically associated with an electronic data message, electronic document, or that the appropriate methodology or security procedures, when applicable, were employed or adopted by such person, with the intention of authenticating or approving in an electronic data message or electronic document;

(b) The electronic data message or electronic document shall be authenticated by proof that an appropriate security procedure, when applicable was adopted and employed for the purpose of verifying the originator of an electronic data message or electronic document, or detecting error or alteration in the communication, content or storage of an electronic document or electronic data message from a specific point, which, using algorithms or codes, identifying words or numbers, encryptions, answers back or acknowledgement procedures, or similar security devices.

The supreme court may adopt such other authentication procedures, including the use of electronic notarization systems as necessary and advisable, as well as the certificate of authentication on printed or hard copies of the electronic documents or electronic data messages by electronic notaries, service providers and other duly recognized or appointed certification authorities.

The person seeking to introduce an electronic data message or electronic document in any legal proceeding has the burden of proving its authenticity by evidence capable of supporting a finding that the electronic data message or electronic document is what the person claims it on be.

In the absence of evidence to the contrary, the integrity of the information and communication system in which an electronic data message or electronic document is recorded or stored may be established in any legal proceeding –

a.) By evidence that at all material times the information and communication system or other similar device was operating in a manner that did not affect the integrity of the electronic data message or electronic document, and there are no other reasonable grounds to doubt the integrity of the information and communication system,

b.) By showing that the electronic data message or electronic document was recorded or stored by a party to the proceedings who is adverse in interest to the party using it; or

c.) By showing that the electronic data message or electronic document was recorded or stored in the usual and ordinary course of business by a person who is not a party to the proceedings and who did not act under the control of the party using the record.

Section 12. Admissibility and Evidential Weight of Electronic Data Message or electronic document. – In any legal proceedings, nothing in the application of the rules on evidence shall deny the admissibility of an electronic data message or electronic document in evidence –

(a) On the sole ground that it is in electronic form; or

(b) On the ground that it is not in the standard written form, and the electronic data message or electronic document meeting, and complying with the requirements under Sections 6 or7 hereof shall be the best evidence of the agreement and transaction contained therein.

In assessing the evidential weight of an electronic data message or electronic document, the reliability of the manner in which it was generated, stored or communicated, the reliability of the manner in which its originator was identified, and other relevant factor shall be given due regard.

Section 13, Retention of Electronic Data Message or Electronic Document. – Notwithstanding any provision of law, rule or regulation to the contrary –

(a) The requirement in any provision of law that certain documents be retained in their original form is satisfied by retaining them in the form of an electronic data message or electronic document which –

(i) Remains accessible so as to be usable for subsequent reference;
(ii) Is retained in the format in which it was generated, sent or received, or in a format which can be demonstrated to accurately represent the electronic data message or electronic document generated, sent or received;

(iii) Enables the identification of its originator and addressee, as well as the detemination of the date and the time it was sent or received.

(b) The requirement referred to in paragraph (a) is satisfied by using the services of a third party, provided that the conditions set fourth in subparagraph s (I), (ii) and (iii) of paragraph (a) are met.

Section 14. Proof by Affidavit, - The matters referred to in Section 12, on admissibility and Section 9, on the presumption of integrity, may be presumed to have been established by an affidavit given to the best of the deponent's knowledge subject to the rights of parties in interest as defined in the following section.

Section 15. Cross – Examination.

(1) A deponent of an affidavit referred to in Section 14 that has been introduced in evidence may be cross-examined as of right by a party who has introduced the affidavit or has caused the affidavit to be introduced.
(2) Any party to the proceedings has the right to cross-examine a person referred to in section 11, Paragraph 4, sub paragraph c.

CHAPTER III.
COMMUNICATION OF ELECTRONIC DATA MESSAGES OR ELECTRONIC DOCUMENTS

Section 16. Formation of Validity of Electronic Contracts.

(1) Except as otherwise agreed by the parties, an offer, the acceptance of an offer and such other elements required under existing laws for the formation of contracts may be expressed in, demonstrated and proved by means of electronic data messages or electronic documents and no contract shall be denied validity or enforceability on the sole ground that it is in the form of an electronic data message or electronic document, or that any or all of the elements required under existing laws for the formation of contracts is expressed, demonstrated and proved by means of electronic data messages or electronic documents.

(2) Electronic transactions made through networking among banks, or linkages thereof with other entities or networks, and vice versa, shall be deemed consummated upon the actual dispensing of cash or the debit of one account and the corresponding credit to another, whether such transaction is initiated by the depositor or by an authorized collecting party: provided, That the obligation of one bank, entity, or person similarly situated to another arising therefrom shall considered absolute and shall not be subjected to the process of preference of credits.

Section 17. Recognition by Parties of Electronic Data Message or Electronic document. – As between the originator and the addressee of an electronic data message or electronic document, a declaration of will or other statement shall not be denied legal effect, validity or enforceability solely on the ground that it is in the form of an electronic data message or electronic document.

Section 18. Attribution of Electronic Data Message. –

(1) An electronic data message or electronic document is that of the originator if it was set by the originator himself.

(2) As between the originator and the addressee, an electronic data message or electronic document is deemed to be that of the originator if it was sent:

(a) by a person who had the authority to act on behalf of the originator with respect to that electronic data message or electronic document; or

(b) by an information system programmed by, or on behalf of the originator to operate automatically.

(3) As between the originator and the addressee, an addressee is entitled to regard an electronic data message or electronic document as being that of the originator, and to act on that assumption, if:

(a) in order to ascertain whether the electronic data message or electronic document was that of the originator, the addressee properly applied a procedure previously agreed to by the originator for that purpose; or

(b) the electronic data message or electronic document as received by the addressee resulted from the actions of a person whose relationship with the originator or with any agent of the originator enabled that person to again access to a method used by the originator to identify electronic data message or electronic documents as his own.

(4) Paragraph (3) does not apply:

(a) as of the time when the addressee has both received notice from the originator that the electronic data message or electronic document is not that of the originator, and has reasonable time to act accordingly; or

(b) in a case within paragraph (3) sub-paragraph (b), at any time when the addressee knew or should have known, had it exercised reasonable care of used any agreed procedure, that the electronic data message or electronic document was not that of the originator.

(5) Where an electronic data message or electronic document is that of the originator or is deemed to be that of the originator, or the addressee is entitled to act on that assumption, then, as between the originator and the addressee, the addressee is entitled to regard the electronic data message or electronic document as received as being what the originator intended to send, and to act on that assumption. The addressee is not so entitled when it knew or should have known, had it exercised treasonable care or used any agreed procedure, that the transmission resulted in any error in the electronic data message or electronic document as received.

(6) The addressee is entitled to regard each electronic data message or electronic document received as a separate electronic data message o r electronic document and to act on that assumption, except to the extent that it duplicates another electronic data message or electronic document and the addressee knew or should have known, had it exercised reasonable care or used any agreed procedure, that the electronic data message or electronic document was a duplicate.

Section 19. Error on Electronic Data Message or Electronic Document. – The addressee is entitled to regard the electronic data message or electronic document received as that which the originator intended to send, and to act on that assumption, unless the addressee knew or should have known, had the addressee exercised reasonable care or used the appropriate procedure –

(a) That the transmission resulted in any error there in or in the electronic data message or electronic document enters the designated information system, or

(b) That electronic data message or electronic document is sent to an information system which is not so designated by the addressee for the purposes.

Section 20. Agreement on Acknowledgement of Receipt of Electronic Data Message or Electronic Document. – The following rules shall apply where, on or before sending an electronic data message or electronic document, the originator and the addressee have agreed, or in that electronic document or electronic data message, the originator has requested, that receipt of the electronic document or electronic data message be acknowledge:

a.) Where the originator has not agreed with the addressee that the acknowledgement be given in particular method, an acknowledgement may be given by or through any communication by the addressee, automated or otherwise, or any conduct of the addressee, sufficient to indicate to the originator that the electronic data message or electronic document has been received.

b.) Where the originator has stated that the effect or significance of the electronic data message e or electronic document is conditional on receipt of the acknowledgement thereof, the electronic data message or electronic document is treated as though it has never been sent, until the acknowledgement is received.

c.) Where the originator has not stated that the effect or significance of the electronic data message or electronic document is conditional on receipt of the acknowledgement, and the acknowledgement has not been received by the originator within the time specified or agreed or, if no time has been specified or agreed, within the reasonable time, the originator may give notice to the addressee stating that no acknowledgement has been received and specifying a reasonable time by which the acknowledgement must be received; and if the acknowledgement is not received within the time specified an subparagraph (c), the originator may, upon notice to the addressee, treat the electronic data message or electronic document as though it had never been sent, or exercise any other rights it may have.

Section 21. Time of Dispatch of Electronic Data Messages or Electronic Documents. – Unless otherwise agreed between the originator and the addressee, the dispatch of an electronic data message or electronic document occurs when it enters an information system outside the control of the originator or of the person who sent the electronic data message or electronic document on behalf of the originator.

Section 22. Time of Receipt of Electronic Data Messages or Electronic Documents. – Unless otherwise agreed between the originator and the addressee, the time of receipt of an electronic data message or electronic document is as follows:

a.) If the addressee has designated an information system for the purpose of receiving electronic data messages or electronic documents, receipt occurs at the time when the electronic data message or electronic document enters the designated information system: Provide, however, That if the originator and the addressee are both participants in the designated information system, receipt occurs at the time when the electronic data message or electronic document is retrieved by the addressee;

b.) If the electronic data message or electronic document is sent to an information system of the addressee that is not the designated information system, receipt occurs at the time when the electronic data message or electronic document is retrieved by the addressee;

c.) If the addressee has not designated an information system, receipt occurs when the electronic data message or electronic document enters an information system of the addressee.

These rules apply not with standing that the place where the information system is located may be different from the place where the electronic data message or electronic document is deemed to be received.

Section 23. Place of Dispatch and Receipt of Electronic Data Messages or Electronic Documents.- Unless otherwise agreed between the originator and the addressee, an electronic data message or electronic document is deemed to be dispatched at the place where the originator has its place of business and received at the place where the addressee has its place of business. This rule shall apply even if the originator or addressee had used a laptop other portable device to transmit or received his electronic data message or electronic document. This rules shall also apply to determine the tax situs of such transaction.

For the purpose hereof –

a. If the originator or addressee has more than one place of business is that which has the closet relationship to the underlying transaction or, where there is no underlying transaction, the principal place of business.

b. If the originator or the addressee does not have a place of business, reference is to be made to its habitual residence; or

c. The "usual place of residence" in relation to a body corporate, means the place where it is incorporated or otherwise legally constituted.

Section 24. Choice of Security Methods. – Subject to applicable laws and /or rules and guidelines promulgated by the Department of Trade and Industry with other appropriate government agencies, parties to any electronic transaction shall be free to determine the type of level of electronic data message or electronic document security needed, and to select and ethods that suit their need.

PART III

ELECTRONIC COMMERCE IN CARRIAGE OF GOODS

Section 25. Actions Related to Contracts of Carriage of Goods. – without derogating from the provisions of Part Two of this Act, this Chapter applies to any action in connection with, or in pursuance of, a contract of carriage of goods, including but not limited to:

(a) (i) furnishing the marks, number, quantity or weight of goods;

(ii) stating or declaring the nature or value of goods;

(iii) issuing a receipt for goods;

(iv) confirming that goods have been loaded;

(b) (i) notifying a person of terms and conditions of the contract;

(ii) giving instructions to a carrier;

(c) (i) claiming delivery of goods;

(ii) authorizing release of goods;

(iii) giving notice of loss of, or damage to goods;

(d) giving any other notice or statement in connection with the performance of the contract;

(e) undertaking to deliver goods to a named person or a person authorized to claim delivery;

(f) granting, acquiring, renouncing, surrendering, transferring or negotiating rights in goods;

(g) acquiring or transferring rights and obligations under the contract.

Section 26. Transport Documents. – (1) Subject to paragraph (3), where the law requires that any action referred to in Section 25 be carried out in writing or by using a paper document, that requirement is met if the action is carried out by using one or more electronic data messages or electronic documents.

(a) Paragraph (1) applies whether the requirement there in is in the form of an obligation or whether the law simply provides consequences for failing either to carry out the action in writing or to use a paper document.

(b) If a right is to be granted to, or an obligation is to be acquired by, one person and no person, and if the law requires that, in order to effect this, the right or obligation must be conveyed to that person by the transfer, or use of, a paper document, that requirement is met if the right or obligation is conveyed by using one or more electronic data messages or electronic documents: Provided, that a reliable method is used to render such electronic data messages or electronic documents unique.

(c) For the purposes of paragraph (3), the standard of reliability required shall be assessed in the light of the purpose for which the right or obligation was conveyed and in the light of all the circumstances, including any relevant agreement.

(d) Where one or more electronic data messages or electronic documents are used to effect any action in subparagraph (f) and (g) of Section 25, no paper document used to effect any such action is valid unless the use of electronic data message or electronic document has been terminated and replaced by the used of paper documents. A paper document issued in these circumstances shall contain a statement of such termination. The re[placement of the electronic data messages or electronic documents by paper documents shall not affect the rights or obligation of the parties involved.

(e) If a rule of laws is compulsorily applicable to a contract of carriage of goods which is in, or is evidenced by, a paper document, that rule shall not be inapplicable to such a contract of carriage of goods which is evidenced by one or more electronic data messages or electronic documents by reason of the fact that the contract is evidenced by such electronic data message or electronic documents instead of by a paper document.

PART IV

ELECTRONIC TRANSACTIONS IN GOVERNMENT

Section 27. Government Use of Electronic Data Messages, Electronic Documents and Electronic Signature. – Not with standing any law to the contrary, within two (2) years from the date of the effectivity of this Act, all departments, bureaus, offices and agencies of the government, as well as all government-owned and –controlled corporations, that pursuant to law require or accept the filling of documents, require that documents be created, or retained and/or submitted, issue permits, licences or certificates of registration or approval, or provide for the method and manner of payment or settlement of fees and other obligations to the government, shall –

(a) accept the creation, filing or retention of such documents in the form of electronic data messages or electronic documents;

(b) issue permits, licences, or approval in the form of electronic data messages or electronic documents;

(c) require and/or accept payments, and issue receipt acknowledging such payments, through systems using electronic data messages or electronic documents; or

(d) transact the government business and/or perform governmental factions using electronic data messages or electronic documents, and for the purpose, are authorized to adopt and promulgate, after appropriate public hearing and with due publications in newspapers of general circulation, the appropriate rules, regulations, or guidelines, to, among others, specify –

1) the manner and format in which such electronic data messages or electronic documents shall be filed, created, retained or issued;

2) where and when such electronic data messages or electronic documents have to signed, the use of an electronic signature, the type of electronic signature required;

3) the format of an electronic data message or electronic document and the manner the electronic signature shall be affixed to the electronic data messages or electronic documents;

4) the control processes and procedures appropriate to ensure adequate integrity, security and confidentiality of electronic data messages or electronic documents or records of payments;

5) other attributes required to electronic data messages or electronic documents; and

6) the full or limited use of the documents and papers for compliance with the government requirements: provided, That this Act shall be itself mandate any department of the government, organ of state or statutory corporation to accept or issue any document in the form of electronic data messages or electronic documents upon the adoption, promulgation and publication of the appropriate rules, regulations or guidelines.

Section 28. RPWEB Promote the Use of Electronic Documents or Electronic Data Messages in Government and to the General Public.- Within two (2) years from the effectivity of this Act, There shall be installed an electronic online network in accordance with Administrative Order 332 and House of Representatives Resolution 890, otherwise known as RPWEB, to implement Part IV of this Act to facilitate the open, speedy and efficient electronic online transmission, conveyance and use of electronic data messages or electronic documents amongst all government departments, agencies, bureaus, offices down to the division level and to the regional and provincial offices as practicable as possible, government owned and controlled corporations, local government units, other public instrumentalities, universities, colleges and other schools, and universal access to the general public.

The RPWEB network shall serve as initial platform of the government information infrastructure (GII) to facilitate the electronic online transmission and conveyance of government services to evolve and improve by better technologies or kinds and electronic online wide area networks utilizing, but not limited to, fiber optic, satellite, wireless and other broadband telecommunication mediums or modes.

To facilitate the rapid development of the GII, the Department of Transportation and Communications, National Telecommunications Commissions and the National Computer Center are hereby directed to aggressively promote and implement a policy environment and regulatory framework that shall lead to the substantial reduction of costs of including, but not ; limited to, lease lines, land, satellite and dial-up telephone access, cheap broadband and wireless accessibility by government departments, agencies, bureaus, offices, government owned and controlled corporations, local government units, other public instrumentalities and the general public, to include the establishment of a government website portal and a domestic internal exchange system to facilitate strategic access to government and amongst agencies thereof and the general public and for the speedier flow of locally generated internal traffic within the Philippines.

The physical infrastructure of cable and wireless system for cable TV and broadcast excluding programming content and the management thereof shall be considered as within the activity of telecommunications for the purpose of electronic commerce and to maximize the convergence of ICT in the installation of the GII.

Section 29. Authority of the Department of Trade and Industry and Participating Entities. – The Department of Trade and Industry (DTI) shall direct supervise the promotion and development of electronic commerce in the country with relevant government agencies, without prejudice to the provision of Republic Act 7653 (Charter of Bangko Sentral ng Pilipinas) and Republic Act No. 337, (General Banking Act) as amended.

Among others, the DTI is empowered to promulgate rules and regulations, as well as provide quality standards or issue certifications, as the case may be, and perform such other function as may be necessary for the Implementation of this Act in the area of electronic commerce to include, but not limit to, the installation of an online public information and quality and price monitoring system for goods and services aimed in protecting the interests of the consuming public availing of the advantages of this Act.

PART V

FINAL PROVISIONS

Section 30. Extent of Liability of a Service Provider. – Except as otherwise provided in this Section, no person or party shall be subject to any civil or criminal liability in respect of the electronic data message or electronic document for which the person or party acting as a service provider as defined in Section 5, merely provides access if such liability is founded on –

(a) The obligations and liabilities of the parties under the electronic data message or electronic document;

(b) The Making, publication, dissemination or distribution of such material or any statement made in such material, including possible infringement of any right subsisting in or in relation to such material. Provided, That

i. The service provider does not have actual knowledge, or is not aware of the facts or circumstances from which it is apparent, that the making, publication, dissemination or distribution of each material is unlawful or infringes any rights subsisting in or in relation to such material;

ii The service provider does not knowingly receive a financial benefit directly attributable to the unlawful or infringing activity; and

iii. The service provider does not directly commit any infringement or other unlawful act and does not endues cause another person or party to commit any infringement or other unlawful act and/or does not benefit financially from the infringing activity or unlawful act or another person or party; Provider, further, That nothing in this Section shall affect –

(a) Any obligation founded on contract;

(b) The obligation of a service provider as such under a licensing or other regulatory regime established under written law;

(c) Any obligation imposed under any written law;

(d) The civil liability of any party to the extent that such liability forms the basis for injunctive relief issued by a court under any law requiring that the service provider take or refrain from action necessary to remove, block or deny access to any material, or to preserve evidence of a violation of law.

Section 31. Lawful Access. – Access to an electronic file, or an electronic signature of an electronic data message or electronic document shall only be authorized and enforced in favor of the individual or entity having a legal right to the possession or the use of plaintext, electronic signature or file or solely for the authorized purposes. The electronic key for identity or integrity shall not be made available to any person or party without the consent of the individual or entity in lawful possession of that electronic key;

Section 32. Obligation of Confidentiality. – Except for the purposes authorized under this Act, any person who obtained access to any electronic key, electronic data message or electronic document, book, register, correspondence, information, or other material pursuant to any powers conferred under this Act, shall not convey to or share the same with any other person.

Section 33. Penalties. - The following Acts, shall be penalized by fine and/or imprisonment, as follows:

(a) Hacking or crackling with refers to unauthorized access into or interference in a computer system/server or information and communication system; or any access in order to corrupt, alter, steal, or destroy using a computer or other similar information and communication devices, without the knowledge and consent of the owner of the computer or information and communications system, including the introduction of computer viruses and the like, resulting in the corruption, destruction, alteration, theft or loss of electronic data messages or electronic documents shall be punished by a minimum fine of One Hundred Thousand pesos (P 100,000.00) and a maximum commensurate to the damage incurred and a mandatory imprisonment of six (6) months to three (3) years;

(b) Piracy or the unauthorized copying, reproduction, dissemination, or distribution, importation, use, removal, alteration, substitution, modification, storage, uploading, downloading, communication, making available to the public, or broadcasting of protected material, electronic signature or copyrighted works including legally protected sound recording or phonograms or information material on protected works, through the use of telecommunication networks, such as, but not limited to, the internet, in a manner that infringes intellectual property rights shall be punished by a minimum fine of One Hundred Thousand pesos (P 100,000.00) and a maximum commensurate to the damage incurred and a mandatory imprisonment of six (6) months to three (3) years;

(c) Violations of the Consumer Act of Republic Act No. 7394 and other relevant to pertinent laws through transaction covered by or using electronic data messages or electronic documents, shall be penalized with the same penalties as provided in those laws;

(d) Other violations of the provisions of this Act, shall be penalized with a maximum penalty of One million pesos (P1,000,000.00) or six (6) years imprisonment.

Section 34. Implementing Rules and Regulations. – The DTI, Department of Budget and Management and the Bangko Sentral ng Pilipinas are hereby empowered to enforced the provisions of this Act and issue implementing rules and regulations necessary, in coordination with the Department of Transportation and Communications, National Computer Center, National information Technology Council, Commission on Audit, other concerned agencies and the private sector, to implement this Act within sixty (60) days after its approval.

Failure to Issue rules and regulations shall not in any manner affect the executory nature of the provisions of this Act.

Section 35. Oversight Committee. – There shall be Congressional Oversight Committee composed of the Committees and Trade and Industry/Commerce, Science and Technology, Finance and Appropriations of both the Senate and House of Representatives, which shall meet at least every quarter of the first two years and every semester for the third year after the approval of this Act to oversee its implementation. The DTI, DBM, Bangko Sentral ng Pilipinas, and other government agencies as may be determined by the Congressional Committee shall provide a quarterly performance report of their actions taking in the implementation of this Act for the first three (3) years.

Section 36. Appropriations. - The amount necessary to carry out the provisions of Sections 27 and 28 of this Act shall be charged against any available funds and/or savings under the General Appropriations Act of 2000 in the first year of effectivity of this Act. Thereafter, the funds needed for the continued implementation shall be included in the annual General Appropriations Act.

Section 37. Statutory Interpretation. – Unless otherwise expressly provided for, the interpretation of this Act shall give due regard to its international origin and the need to promote uniformity in its application and the observance of good faith in international trade relations. The generally accepted principles of international law and convention and electronic commerce shall likewise be considered.

Section 38. Variation of Agreement. – As between parties involved in generating, sending, receiving, storing or otherwise processing electronic data message or electronic document, any provisions of this Act may be varied by agreement between and among them.

Section 39. Reciprocity. – All benefits, privileges, advantages or statutory rules established under this Act, including those involving practice of profession, shall be enjoyed only by parties whose country origin grants the same benefits and privileges or advantages to Filipino citizens.

Section 40. Separability Clause. – The provisions of this Act are hereby declared separable and in the event of any such provision is declared unconstitutional the other provisions to remain in the force and effect.

Section 41. Repealing Clause. – All other laws, decrees, rules and regulations or parts thereof which are inconsistent with the provisions of this Act are hereby repealed, amended or modified accordingly.

Section 42. Effectivity. – This Act shall take effect immediately after its publication in the Official Gazette or in at least two (2) newspapers of general circulation.

Bayantel Intermittent Connection is Unacceptable

How many times should I call them and tell them that my connection is intermittent? They visit our house five times but until now the problem persists. As what they instructed, we replaced the wire but same issue, (intermittent). We make sure that we pay our bills on time to avoid these things from happening but we’re getting the exact opposite.

I wish I had the opportunity to change my provider or at least investigate more extensively before I chose their service. But it would be useless even I did all these things because I had been given no other options as Bayantel looks like the only internet provider available in the area.

I know this is not a problem on our end anymore because I happened to know one Bayantel subscriber living not so far from us and she’s also experiencing frequent internet disconnection. The only difference we have is that she’s using a router and I am not. Router enables you to reconnect to the internet automatically when the internet connection drops. However, if you have a direct connection like I do, you need to manually use a dialer to reestablish a connection.

This post is to warn you if you are in the stage of finding an internet or phone provider particularly if you are in the Philippines. I’d like to say that before you choose Bayantel, I recommend to visit some internet forums, read any blogs, ask people in your area and find other ways to know more about this internet provider in the country. It can help you decide whether you still want to pursue with Bayantel or consider other providers.

Most of the time when Filipinos watch TV shows like teleserye or a Filipino movie, they ignore the significant component of the plot because they are more focused on the actors or how their story is going to end. When I say
actors, meaning they don’t care much about the characters; what is important to them is to see their idols on the screen. Sadly but it is the reality. But what is this component I’m talking about?

When you enjoy something, you must never let logic get too much in the way. I list some of the flaws and most annoying similarities you can find in Filipino TV shows if you just watch more wisely.

Philippine TV series and films cliché list

Romantic movies and series

The movie usually starts by showing a female character while she attempts to recover from her tragic relationship. This is the right time when the leading man appears usually to help her. Concluding the story, they become boyfriends and girlfriends only to end up with their own version of a breakup. But like most of the story, they will eventually find their way back to each other and they will live happily ever after.

The other version of it is when the film or a series shows two characters who never met. And one day, they accidentally bump into each other but, it’s not like a normal love at first sight! In Filipino love story, someone is going to be rude to the point that the other character would hate him or her so much and the fighting begins. But it won’t be long until you realize that it is only a romance in the making. Like our first story, it is possible that there will be a twist. But again, it will definitely come to a good ending after all the conflicts have been resolved.

How about this storyline. A female character belongs to a powerful family. Then an ordinary guy surfaces and they eventually fall in love with each other. But as you expected, the family of the girl would do everything in their power to ruin this romantic relationship.

Action Films in the Philippines

I notice that Filipino action films have many obvious similarities and when you recognize them while watching, your focus on the story will be lost and you will start to look for more inaccuracies. This is the time when you are criticizing instead of appreciating the movie.

The villain is always a politician for example a congressman.
The bad guys sell illegal drugs.
At the end of the film, you will discover who the real enemy is, someone from the government! Read the first item in the list.
The family of the main character would be the victim of a crime which would mean (revenge!) For example, the main character returns home. While they are eating or just having fun, a car stops in front of the house and the next scene; bam bam bam!
In Pinoy movies, the hero has unlimited supply of bullets.
Watch closely, when the main character is being chased, the bullets from the pursuers always hit the ground.
The hero only feels the pain when his leading lady treats his wounds.
The moment of truth begins when the main character says the title of the movie.
You know that the bad guy is in his hideout when you see a pool and of course, his chicks.
If the hero needs a gun, he always finds one.
The bad guy has beard and his women are always present.
The police always arrive late.
The goons enter where the party is happening, and they shoot all the food on the table but all the guests are alive.
The leader when talking to the hoodlums always says, “you know what to do”.
The hero saves the girl from the rapists and they become lovers.
The car chase always ends in a car explosion, Filipino version!

More Pinoy movie trademarks

When English language is used in the pinoy movie, usually it is formal English.
If there’s a swimming pool in the scene, you also see an orange juice with a small umbrella.
Breakfast of the rich people includes, a loaf of bread, bananas, hotdogs, bacon and fried eggs.
Visitors are always offered an orange juice but they never drink it.
You can easily recognize all the extras in the movie because of their clothes, hairstyle and make-up.
In teleserye, when a person wants a revenge, he or she will hire a professional killer
In teleserye, the kontrabida can manipulate everyone as long as the story requires
In teleserye, explosion effect is a must. What do I mean by this? The ending always features a very intense scenes where they sometimes show exploding buildings, car involved in an accident of course for drama purposes and let's not forget the firefight.

Bayantel, Intermittent DSL Connection, Lost Dial tone During Bad Weather, Slow Speed

Just reading the title alone, you will have an idea what’s going to be the tone of this article. Like their internet connection, my desire of recommending this phone/internet provider is also intermittent. Sometimes their good but there are times they suck. I won’t change my stand anyway, that their customer service is superb! However that won’t change the fact that they suck at giving a decent internet service.

Bayantel, the telephone company

Bayan Telecommunications Inc., is founded in 1986 and is owned by the Lopez group of companies. They provide phone, wireless and broadband services across the country. Today they cover almost 33 percent of the country’s population that’s why they are known to be one of PLDT’s competitors in the industry. Landline telephone, DSL, wireless phone (Bayan Phone), are just a few examples of their products which Filipinos find as their alternative when they want to try other provider than PLDT which currently is the leading telecommunications company in the Philippines.

Intermittent connection

I’ve discussed this subject several times like in this article which I wrote a year ago. It means that this problem of Bayan DSL is like a normal thing that should be dealt with and you would consider a perennial issue when you are a subscriber of Bayantel. As I said, every internet provider in the Philippines has intermittent connection problem, but they should do something about it. I also observe that each of them treats their customer’s concerns differently, but the solutions and the results seem to have some similarity. They reset the modem, they change it sometimes, they would visit you house and check everything that they suspect as to be the cause of the problem you’re having, the customer service representative you’re talking to would suggest a system clean up on your end; meaning you check if you store some computer virus and if you do you remove it as well as those unnecessary garbage like internet cookies temp files etc., or to the point that you’d be told to reformat your hard drive completely, heh!

I’m not trying to be a smartass, I’m just telling you to provide us the services you promise and advertise Bayantel! Like other issues for example the slow internet speed, high latency and some other things which your customers complain everyday, it’s time for you to act on these before you lose your subscribers.

Put the Little Girl to Sleep

I woke up this morning discovering that this phrase (Put the Little Girl to Sleep) is trending on Twitter. Actually I watched the news last night and even saw this as a flash news
as I understand it’s from urgent press conference made by one of Arroyo’s spokespersons. Honestly, I didn’t react so much when I first heard this like I wasn’t taking any side or opinion about Arroyo issues. But as I said, when I opened my Twitter account I found this trending and I was surprised! Now the Piolo/KC breakup issue has been dead (thanks to (Put the Little Girl to Sleep).

The other day they revealed the latest problem of Gloria.

Doctors confirm that Gloria Arroyo has Colitis (Inflammation of the colon). And just now an imminent threat to her life? I don’t know if there’s a single person in this planet that would believe in their stories but the root of all this is I think when Filipinos start to have some confrontation regarding Arroyo’s detention whether she should be put in a regular cell or as a house arrest.

People also suspect that The Arroyo camp is lying about her true medical condition so it’s no surprise if they also reject the idea about this (Put the Little Girl to Sleep) thing. And if Arroyo is killed today, her spokespersons can easily accuse the government as the killer because just recently they allegedly discovered the plot. How clever eh?

Internet Explorer

History

Internet Explorer that has a codename of (O’Hare) was first released by Microsoft in August 1995 and was a part of Microsoft Plus! – an add-on pack for Windows 95. It’s not included in the first release of 95 however, it was on the OEM version of the operating system. Version 2 supports 32-bit Windows and Macintosh (another operating system). A year later, IE 3 (the more stable version of the browser) and was designed particularly for Windows Operating System was released together with the browser’s interesting features for the users. Features such as the email capability, .gif and .jpg support, audio streaming support and many more have become the most favorite and have played a big role in its success that time.

Then, almost yearly, Internet explorer had its newer versions, and today, almost fifteen years later, it’s still the most popular browser and has a 90 percent share on the market. But Firefox on the other hand, is not just going to accept it, correct? Maybe the reason for this is that Microsoft is still giving the software for free and this I think is the most popular thing to do where ever you are in the world! Enough of those jokes and let’s talk about Firefox, IE’s closest rival.

The winner?

Based on the statistics I’m getting from different sources, Firefox is the winner! Almost 80 percent of my visitors use Firefox but many Filipinos still prefer IE based on what I observed. Most of the people I know choose Internet explorer maybe because when they first open their computers, Internet explorer is what they will see on their desktop as it’s included in Windows operating system and requires no more installation but just the simple optimization and they can start to browse the world wide web right away. Unlike Firefox as most of us know, it’s third party and you need to install it separately and some people are not comfortable with this kind of extra work. But I personally use Firefox because of security or safety reasons. However, I’m having some troubles with Firefox lately and am thinking to change my browser if the issues persist. An unidentified plug-in causes my browser to stop functioning and I have to end the process from the task manager to resolve it. Some of the people I know have told me that they also experienced crashes when using Firefox but still, they don’t want it uninstalled from their machines. Weird? I know that’s why I wrote this blog.

So there’s no winner between these two browsers because people may change their preference anytime and they may even alternate IE and Firefox depending on the situation. Some websites out there show some data comparing Firefox and Internet explorer, but they don’t recommend their results to be accurate and relevant because of some factors that influence their procedure when determining the winner.

Why is Philippines so behind in terms of technological advancements?

Filipinos love new stuff like the latest gadgets; computers, cell phones, game consuls, computer peripherals, computer programs, websites like social networking sites, home equipments like TV sets, home theater systems, wireless devices or services that use wireless
say wireless mics, wireless guitars, wireless keyboards, LCD monitors, latest models of their favorite products for example guitars, cars, MP3s or similar electronic devices etc. Filipinos also love to sing new songs, play new genre, wear new clothes, try any new services, go to many places, experience any adventure, talk to any kind of people andshow their talents to the world.So Filipinos I think are very updated and so aware, but only of ideas, tricks, strategies, workaround for any kind of products like iPhone, PSP, Play station, computer software, CDs and DVDs; talking about burning movies and music etc. But do they have their own inventions? Yes! They invented the word (IMITATION)! But except of copyright laws, there are no any other rules or policies on this earth that prevent them to apply their invention. Oh I almost forgot, chocolates, they love chocolates too!

I write all these things because I don’t see any problem with them. It’s just that they appreciate the technological improvements or development that would happen in our modern time.In the Philippines, you will notice that many Filipinos have cell phones but not all of them have jobs. In the Philippines also, not all homes have computers or broadband services but most of Filipinos who know how to use the computer have Facebook accounts. But the big question is, how is that possible?

Let’s be more serious.

Let’s talk about history.

In the early part of 20th century, Americans began to influence the lives of Filipinos by shaping our education system, changing our laws etc. They also added new genre to our music and entertainment, offered additional choices of food and many more. They taught us to be more liberal; in short, Philippines is westernized! Filipinos started to see some innovations from national infrastructures to their home appliances, and that marked the beginning of our awareness in technology. That’s the reason why we Filipinos love technology so much. Because Philippines is one of the countries in Southeast Asia which received the modernization that US offered to Asian countries in the later part of 20th century, Filipinos easily adapted to this kind of innovation and they started to integrate it with their daily lives. Every time there are new gadgets or new inventions, Filipinos are so excited to try them.

Today while everyone all over the world talks about Facebook, Youtube and iPhone, in the Philippines, Filipinos are not just talking about them but they are also using them. In fact, when iPhone became available in the market, one Filipino claiming to have the first iPhone in the country was even featured in the national news. That’s how our culture evolved and that answered the question above. Still wondering why Filipinos are so behind in technology in general? Well, I’ll answer it straight.

In my own opinion, having the latest technology in the world doesn’t mean you are advanced. Acquiring just the finished products are not enough but you really need to also have the necessary knowledge about them. Let me elaborate as my answer isn’t straight. Your dinner means eating in the restaurant every night as you don’t know how to cook your own food. Question, does it make you a complete person? Do you consider yourself independent?

Still confused? I don’t know what else to say.

Alaska vs San Miguel – LA Tenorio’s Buzzer Beater - PBA

The game happened on December 5, 2010 and that’s the last game of SMB and Alaska’s second to the last.

No bearing as they call it, San Miguel Beermen played a relaxed game type of basketball in the first half. Alaska Aces easily built a big twenty point advantage at the end of the first quarter 38-18. Then, in the second quarter, Alaska continued to dominate, as their lead became 31 67-36 before SMB finished the first half with the score 67-41. Then, in the second half of the game, SMB proved why they are the number one team in the PBA by making a big comeback in the third quarter. They came within 14, and they took the fourth quarter more seriously.

13 seconds remaining, after San Miguel called a timeout, and the score is 89-86 Alaska, SMB’s guard Dondon Hontiveros made a three point shot with five seconds remaining in the game to make the score tied at 89. Then, with no timeout left, LA Tenorio, the point guard of Alaska threw a buzzer beater three point shot to make it 92-89 Alaska winning the game.

Bayantel Strikes Again!

Will Bayantel always be like this?

I don’t want to destroy their credibility and that will never be the intention of this blog but it seems that they push me too hard now. I regularly download from Sendspace and before I was satisfied with what speed I get but recently it all changed without any obvious reasons.

The lockin policy prevents the growing number of unsatisfied subscribers to change their internet provider from the time they begin to experience some of the issues mentioned here. Following is the list of problems you may or may not have when you try their DSL service.

Slow internet connection

The formula to compute your actual speed is (80 percent of advertized speed divided by 8). For instance, I applied for 1mbps package, what would be my actual download speed or what should I expect? I write the steps on how to get the answer for this below.

Note: 1mb is equal to 1024kb.

Note: 80 percent of 1024kb is 819kb.

Formula

(819/8 =102)

So expect to have a download speed of 102KBPS when you have 1mbps connection.

What does it mean?

It means that when you download a 4MB file for example an MP3 file and your transfer rate is 102KBPS, you will finish the download in 32 to 40 seconds. But because of Bayantel’s SOD, you can finish it in 20-26! Unfortunately, I don’t get this speed right now not even close! I get 19kbps would you believe it?

Intermittent connection

To be fair,I am happy to say that I’m not experiencing frequent disconnection so far but I encourage you to read my article that talks about Bayantel’s intermittent connection and other issues.

Unstable dial tone during bad weather

Yes only in the Philippines and only with Bayantel!

Every time we experience bad weather during the rain for example, we also get bad service from Bayantel. We usually lost our dial tone and our internet connection will start to become unstable too. Sometimes that’s not always the case. The dial tone is there but the line will have a popping noise which is also annoying. After their technicians fix the problem, and the rain starts to fall again, the problem will be back again and the technicians will go back again and will try to fix the problem again. Again, as what I always say, this is not an attack Bayantel, it’s just my simple story that I want to share with your potential customers.

Incompetent CSRs and technicians

I don’t want to talk about this because of some reasons so I’ll make it short. I called their hotline number one time and the CSR I talked to didn’t help me. The story behind it is that I don’t want to elaborate.

Sound effects during the whole episode
The sound quality overall
The melody of his songs; in fairness, “Original Pilipino Music” is what I’m talking about
The amazing talent of their keyboardists
The audio quality; microphones are superb!
I’m not sure of the term but the transition from one music to another; blending well with the sound effects

Sound quality of a TV show is sometimes an unpopular topic to discuss for some audience because they know that watching is just all about what you can see and what is appealing to your eyes. But you will notice that to see the best content, it must blend first with the sound because when they are not synchronized, there would be a big difference and you will surely know it. For example, when Willie (the host), is saying something about their sponsors and the sound technician does not play the appropriate sound effects, the excitement will be lost and the beauty of advertising will be compromised. So as when the contestant sings and the accompaniment does not blend with him/her, the contestant will be confused and most of the time the contestant becomes prone to errors.

Music is nice to hear however, all of the components of it must be present. I must say
That in Willing Willie, the keyboardist is, lucking in skills to earn my appreciations to what he does for Willing Willie, and I would suggest that Willing Willie officials should look for other alternatives to their musicians and sound technicians.

There are many factors why it’s number 1. Below are few of those reasons why Kapamilya maintains its ranking and status of being “the number 1 TV network in the Philippines”.

Quality of almost all shows from morning until I go to bed

Umagang kayganda is definitely without question, giving a “kaygandang umaga”! Then having SpongeBob in the lineup of their “Umaganda” gives them a large number of audience. Showtime then prepares you to have a wonderful afternoon together with Pilipinas Win na Win which features lots of music performances, game shows, comedy and a great hosting over all. Then in the afternoon some inspirational stories through their “Hapontastic”, a set of Drama series, and some foreign shows, anime and sometimes, local movies. Then here goes the evening local news TV Patrol which brings the latest updates about our economy, environmental issues, society, politics, entertainment, sports and many more. Then because of Filipino’s culture in watching TV (whatever term applicable), Primetime bida after the news, offers a variety of drama shows, latest showbiz updates etc.

From morning to evening, variety would be the term for ABS-CBN Kapamilya Network, because they are committed to give the best contents to all Filipinos from all levels and always making sure that the audience will get satisfied when they turn on their TV sets.

Responsible Journalism

This is already proven; this is why Loren Legarda and Noli de Castro succeeded in politics. Because citizens believed and trusted them, they’ve given them so much respect and elected them to be their public servants. ABS-CBN earned people’s support in short.

ABS-CBN Broadcasting Company is known for giving public services and makes some efforts to support the government’s programs/policies. Whether it’s for the environment or for the poor, they ensure that their efforts go directly to the beneficiaries. I wanted to list some of their programs and services but it would be impossible for me because I would not know the specific details about them. And the other reason is they are too many and I wouldn’t want to make any assumption on what they do or what they are for. If you prefer, you may visit their website and check the latest information about their foundations, services and other things regarding the efforts of that TV network.

I’m not in any way affiliated with ABS-CBN and they didn’t pay me for this. I just wanted to write stories like this for the people to know; those Filipinos in particular.

According to Wikipedia, James Lindenberg has started the
television industry here in the Philippines
in 1946 with his company Bolinao Electronics Company (BEC). And transformation and merging took place in the following years until the name
ABS-CBN Broadcasting Corporation
has surfaced to the world with tremendous success in the following years and decades. This TV station since then pioneered some technological improvements in Philippine media and slowly gained its popularity. Since 1960s, the Lopez family is the group who is behind its success and people who know
this TV network also have the idea who runs this business. So the people are just focusing on one family when this TV station and the other sister companies
have issues on their names whether they are good or bad. The family is always blamed when something happens in other words; like when
Meralco
is increasing its electricity charges or when their game show allegedly cheats. At present, despite those accusations, survey done by the survey firm still
confirms the TV station’s audience share all over the Philippines is still higher than its competitor GMA. But let’s discuss about this matter later.

GMA 7

According to Wikipedia,
GMA network
started as a radio station DZBB of Loreto F. de Hemedes Inc. in 1950. It is owned by an American war correspondent Robert Stewart. Only in 1960 when the
TV station GMA 7 was introduced. This is the third TV station in the country in its time however. And since then GMA network has made its own history in
TV industry in the Philippines. It also had its big part in the country’s politics and also witnessed big events like the Martial law in
President Marcos
time and until the restoration of democracy when the next president was installed. But the history of GMA never stops. Today it is the closest competitor
of ABS-CBN.

Popularity

90s was ABS-CBN’s decade. GMA was just still getting their audience share at that time.
Kapamilya network,
was dominating every minute of Filipinos’ TV habit, facts say. So the word “competition” was often used by TV fanatics. But number of people who appreciate
GMA is getting bigger and bigger and areas that GMA rules widen. But still I should say, even the rivalry has started that time; the
Kapamilya is still the choice
all over the Philippines because of their signal strength. That is the biggest issue for GMA until now, the “TV signal” for them is their number 1 enemy
because GMA believers and GMA itself assume that ABS-CBN is just hurting them with this advantage. Correct but not so I guess, because facts say again,
that quality shows of ABS-CBN are still network’s biggest edge. This is proven by the awards gathered by the Kapamilya and the award giving bodies who
carefully recognize who is better between the two.

It is about a child who has the power to heal with his friend that he calls “bro”. Based on the story, this “bro” is believed to be The Lord God who uses
Santino (child’s name) to strengthen everyone’s faith and also to send His message to the world particularly to this small town where the plot is taking
place. GMA for a moment doesn’t have this type of storyline and they just counter its popularity by putting an action/drama with little fantasy series
Zoro. Unfortunately for the Kapuso network, this is ineffective maybe because Filipino people as world knows, are so religious that’s why they prefer this
TV show of ABS-CBN than action-drama of GMA!

of ABS-CBN on the other hand has also its own share in the ratings because the stars are still fresh; they are improving and have the talents and the looks.
I’m still trying to find a match for this show from GMA but got no luck or maybe there’s really none? The nearest maybe is the newest addition to GMA’s
lineup (All my life) but still it is far to compare. Tayong dalawa is about a competition between two guys who happened to be brothers and are both PMAers
to win a girl’s heart. This is also topping the TV ratings and sometimes tailing May bukas pa.

Next to them is Angel Locsin’s Only You
also from Kapamilya. This talent was from GMA but decided to be a Kapamilya after her contract has ended with the kapuso network. When her first series
Lobo aired on ABS-CBN, the ratings that time wasn’t that friendly to Angel maybe because of what she’s done with GMA. But this is history and now other
media research company is telling the Philippines her current position in the ranking of who’s the most watched female celebrity in primetime shows. Marian
Rivera her counterpart as Kapuso network is claiming looked like the current holder of the title because of her own TV series Dyesibel which topped the
ratings winning against Angel’s Lobo. But that was before. Now Marian is shooting her own remake of Darna which Angel did her own when she’s still a talent
of GMA.

Who really deserves?

Most of the people are asking what is really the number 1 TV station in the country. The answer to this is subject to an intense research and complex mathematics.Manipulation
of any kind of data isn’t going to help; as it is just a way of hiding the accurate representation of how the statistics is interpreted in its smallest pattern.
The popularity of a TV network means nothing if it’s not expertly analyzed. We don’t base on clamors here in other words.

As of June 27, 2009 ABS-CBN has 50% audience share compared to GMA which only got 33%; that is according to this article Majority of the shows of ABS-CBN are on the top spot, as of this date. And the following results tell no difference. If you observe the results from the
two media research groups however, you will be confused who’s telling the truth. AGB survey shows in Mega manila GMA is leading the race but the nationwide
results from TNS say that ABS-CBN is the number 1 TV network in the country.

So if you want to know who really deserves to be called as the true number 1, just find the answer in your hearts. Watch these TV networks, watch their
shows and see for yourselves, who gets your emotions meaning which of the two makes you cry or laugh, who satisfies your viewing needs/tastes and which
of their shows get you hooked.

This article will focus on how to get the best but free antivirus, anti-spyware and firewall for your computer. I only mentioned those three as they are just the only security tools you need when you start exposing your machine to the world (I’m talking about the world wide web).
I write based on my personal experiences and all software which I’m going to mention here are those which I’ve been using for years in short, well-tested!

When did I start to use AVG?

I started to learn how to use the computer in 2004. That time, the term (computer virus) isn’t new for me. A friend, who was helping me on everything about my new computer has installed guess what, (Norton Internet Security) on my machine. At first, I didn’t care whatever software he wanted to install; and that anti-virus was just one of those ignored helpers. He told me that every 8:00AM, Norton is scheduled to scan the whole system and I would recognize it because when that time comes, navigation on my computer would become slower as it would require a big amount of my RAM “WHAT”? Because I’m just infant in using the computer, I’d easily accept it as I thought it’s normal because anti-virus carefully checks for any bad intruder hiding on my hard drive and to do this, it would need lots of my resources?

To cut the story short, after 30 days, the trial time has expired and Norton stopped functioning. That’s the time when I began to ask for any free alternative. Then, AVG, (the anti-virus I’m using until now) had been suggested to me by some people I know and from the results of my Google searches. To prove the authenticity of my own story, I want to remind you that the first website of AVG is not avg.com; if I really remember it correctly, grisoft.com was where I’ve downloaded the old AVG versions.

Performance of this anti-virus

If Norton takes a lot of your RAM, AVG is the opposite. I once set AVG to scan automatically every 8:00AM but unlike six years ago, I hardly notice when the process starts. Also, compared to Kaspersky (another security software), again, I hope you don’t get mad and bored, “it is free”! Well, that’s just a joke right there… In my personal opinion, if Kaspersky is very effective in fighting those bad instructions, so is AVG. And sometimes, AVG is the only anti-virus which can detect certain types of malware. The update process is also impressive for me as it’s done regularly.

Anti-spyware, The Difference Between Virus and Spyware

Spyware is a computer software that usually gets some information from the user’s computer without his or her consent. By its name you will notice that the job of this malware is to expose some security weaknesses on your system and spy for any activity like when you browse the internet and use a credit card for your online purchases. Like viruses, you can get it by installing free software from the internet such as games and other utility software for your computer. You will know if you already get infected if you experience any of the following:

Slow internet browsing
When you open a website, you are automatically redirected to another page
Computer freezes, become frequent and without any known reasons
strange messages on your screen asking you to click a link which will bring you to a website where you can get a free security software (most of the time fake software)
Your homepage is changed without your permission
And many more unusual activities

Now the recommended anti-spyware

Malwarebytes is a free anti-malware program which can be downloaded from this website. Like the other anti-spyware tools out there which require you to pay for their license key to fully activate the functionality of the program, the performance of Malwarebytes is almost identical or sometimes even better than the paid ones. Talking about their intelligent detection process, any harmful sets of source code on your computer will surely be exposed and terminated for you! It can trace almost anything from viruses, adware, malware or any type of spyware. Malwarebytes also offers a real-time protection but you also have to get a license key for this but I think it’s not really necessary as this functionality (real-time protection) is already available in AVG free.

How about your firewall? Is it really important?

Yes it’s important like anti-virus. Firewall prevents any unsolicited connection coming from outside of your home network or even within your own network. For instance, any computer that is attempting to connect to your computer and intentionally or unintentionally install viruses or any malware will be blocked based on your firewall settings. It will analyze any traffic sent from outside and prevent any activity if it’s unusual. To clarify, firewall doesn’t trace viruses but it can stop the source if it displays strange behavior. But what if not? That’s the time when your anti-virus will come into play. This is the reason why you should regularly update your anti-virus or any security software on your computer to prevent these kind of attacks.

Recommended firewall

Any security software you can find on the internet which offer bundled products has firewall included most of the time. Like the paid version of AVG, Kaspersky, Norton, Spyware Doctor, McAfee, Zonealarm, etc. But my recommendation is not included on that list. Why? Because I only recommend free software which is the most popular thing to do anyway. Just kidding. But what’s that firewall I’m talking about? The answer can be found on Windows operating system! Yes! It’s the Windows firewall!

(Bayan DSL): Is it good service they provide?

Another problem that you may encounter when you subscribe to Bayan DSL is the (intermittent connection). I know every provider has this kind of issue on their service, but this article will be focusing on Bayan DSL
as this is my current Internet provider right now.

Causes of intermittent connection

There are many factors to consider before calling their hotline number to ask for a technician to visit your house. Below is the list of the possible issues you should know.

Incorrect wiring inside the house
Defective wiring outside the house
Noisy line
Equipment near or in the range of your computer/modem
Modem itself
Bad weather
Congestion in the area
Software problem/virus
LAN problem
>OS problem
Home network overload
Other factors

Every time I experience this kind of problem on their service, I call their CSRs to ask for help. The common solution they provide is the (connection reset) or (port reset). They would ask me about the status of the lights on the modem especially the DSL light. They’ve told me that Ethernet light does blink and is normal but the DSL light should be stable all the time. Then, the technician will visit me and have the wiring checked then the modem. My experience is, they usually replace your modem thinking that it’s causing the problem. My advice is, don’t let the technician go until you both monitor the stability of the connection by waiting for fifteen or even thirty minutes; sounds rude? LOL.

The best thing you can get from them without question is their response time! Hours from your first call, expect them to be knocking on your door? Well, there’s more! If 24 hours and the trouble their service had caused you hasn’t been fixed, rebate of 500PHP or even your bill for the whole month would be offered to you; all you need to do is to make a formal request.

Finding an internet provider in the Philippines without intermittent connection problem is I think hard and impossible, but giving the best service if not perfect is a must for them as we, their customers should get what we pay for.
