Недопустимість звуження «чорнобильських» доплат через Закон про Держбюджет. </b></div><div style="text-align: justify;"><ul><li><b>Правова суть: </b>ПФУ періодично намагається зменшувати додаткову пенсію (або доплату за проживання/працю на забруднених територіях) чи прив&#39;язувати її до зменшених базових величин, посилаючись на Прикінцеві положення Законів про Державний бюджет України на відповідний рік.</li><li><b>Позиція ВС:</b> Верховний Суд підтвердив, що Закон про Держбюджет не може скасовувати або змінювати норми спеціального закону (Закону № 796-XII). Його реалізація — це завжди результат активного юридичного тиску з боку громадянина через адміністративні та судові механізми.</div><div style="text-align: justify;"><br></div><div style="text-align: justify;">Давайте розберемо аналітичну суть того, як цей механізм функціонує в реальності, які його слабкі місця та що є головним тригером для його запуску.</div><div style="text-align: justify;"><br></div><h2 style="text-align: justify;">1. Юридичний механізм реалізації</h2><div style="text-align: justify;">Відповідальність держави перед громадянином реалізується через три ключові етапи:</div><div style="text-align: justify;"><ul><li>Встановлення протиправності дій: Спочатку потрібно офіційно довести, що орган влади (наприклад, Пенсійний фонд, податкова чи соцзахист) діяв незаконно або допустив бездіяльність. Суд визнав, що обмеження суми індексації «стелею» у 1500 гривень є протиправним.</div><div style="text-align: justify;"><br></div><div style="text-align: justify;"><b>Суть справи: як ПФУ занижував виплати</b></div><div style="text-align: justify;"><br></div><div style="text-align: justify;">Пенсіонер, який постраждав внаслідок Чорнобильської катастрофи та перебуває на обліку в ГУ ПФУ в Донецькій області, звернувся до суду через несправедливий перерахунок пенсії. У березні 2025 року під час планової індексації його пенсія мала зрости на 2625,37 грн.</div><div style="text-align: justify;"><br></div><div style="text-align: justify;">Проте чиновники ПФУ, керуючись урядовою Постановою № 209 від 25.02.2025, просто «відрізали» більшу частину цієї суми.
