Governance, Security and Justice in Fragile Conflict Affected Situations (JRSP)

Project Objectives:

During its inception year, the consortium will produce a number of evidence papers to provide a basis for a defined programme of future research. A series of stakeholder consultations will also take place during 2011 with the objective of establishing a baseline of data that identifies critical gaps in the literature and assesses how stakeholders prioritise research needs. The JSRP aims to think creatively about the interface of research, policy and stakeholders and will approach its research from the perspective of those who live in conflict-affected situations and who are the supposed end-users of good governance policies. The way in which these end-users seek to provide justice and security is often achieved by methods that are outside - but not disconnected from - state level government and these have been termed hybrid governance structures.

The JSRP seeks to provide a better understanding of the relationship between 'official' and 'hybrid' structures and to address such questions as:

How do hybrid governance structures manifest themselves, change and develop in what are generally considered to be 'fragile' states?
What policy responses will support hybrid governance structures that are developmental and oriented towards poverty reduction?
What policies have been shown to have an adverse impact on the end-user?

Research during the operational phase of the programme aims to use a wide range of methodology including:

local-level ethnographic research of 'vernacular' poltiics
quantitative analysis of conflict and hybrid politics and the creation of new datasets
the use of new approaches such as crowd-sourcing and web-crawling
video documentation, cartoon commentaries and artistic storytelling

The consortium will undertake research in several regions, including in the following countries : Sudan, DRCongo, Uganda, Somalia, Ethiopia, CAR, former Yugoslavia, and Afghanistan and its neighbours.

Summary: There is considerable but diverse experience of return in the Balkans, including mass return after war in the context of international civil administration in Bosnia and Kosovo, forced return of failed asylum seekers and irregular migrants in several other countries, and possible voluntary return of migrants at the end of the migration 'project', not least in Albania. This workshop aimed to bring together these diverse experiences and to have some discussion about definitions with the aim of producing some conclusions of value to researchers and policy makers covering:

· What influences whether return is sustainable

Summary: This paper reports on the findings of a survey conducted by the Sussex Centre for Migration Research on migration and poverty in three regions of Eastern Europe and Central Asia in 2006. The research included a review of available literature, and field-level discussions with policy-makers in four countries/territories (Moldova, Tajikistan, Kosovo and Georgia). For each of the three regions (Western Balkans, the 'European Neighbourhood' and Central Asia), the paper explores the context of poverty and development and general migration trends, before focusing on policies orientated towards migration management, and the broader impact of migration on poverty. It concludes with a number of policy recommendations. Four further working papers complement this paper, each on one of the case study countries mentioned above.

Summary: The return of refugees and other migrants represents an issue of growing concern for governments and international organisations working in the refugee and migration fields. In the Balkans in particular, large-scale international returns of refugees to Bosnia and Kosovo have occurred alongside intense efforts to promote so-called 'minority return' of displaced people within the two territories. This interest in return comes from a number of directions, including domestic political concerns in countries and regions of origin, as well as a desire to promote 'durable solutions' for forced migrants. Yet return has also become a highly politically charged process in a number of contexts, both for returnees and those who did not migrate or flee, leading many observers to question the notion of an unproblematic return 'home'. Specifically, doubts remain both about the conditions and voluntariness of return, the ability of individual returnees to re-integrate in their home countries and regions, and the wider sustainability of the return process.

This paper seeks to provide an overview of recent policy interest in returns globally, as well as to and within the Balkans, before setting out a definition of what might be considered 'sustainable' return in the region. For example, it is possible to draw a distinction between narrow indicators of the 'sustainability' of return, such as whether returnees subsequently re-emigrate after their return, and wider definitions, which see 'sustainability' as including both the extent to which individual returnees are able to reintegrate in their home societies, and the wider impact of return on macro-economic and political indicators. It is argued that the development of robust indicators of the sustainability of return could assist in monitoring the impact of return programmes, providing valuable insight on return policies. Equally important, such indicators present one way in which return can be assessed against broader development objectives in countries of origin in general, and post-conflict countries in particular.
