What a sad week with Bowie gone.
I can remember him well as I loved his music and the musicians that he worked with.
His films, although not a great actor always had something.
His videos were a bench mark for others.

Business wise he was very smart and controlled his music/art very well.

Even towards death and after death Bowie is still inspiring people as the letter shows:

...your death at home: Many people I talk to as part of my job think that death predominantly happens in hospitals, in very clinical settings, but I presume you chose home and planned this in some detail. This is one of our aims in palliative care, and your ability to achieve this may mean that others will see it as an option they would like fulfilled. The photos that emerged of you some days after your death, were said to be from the last weeks of your life. I do not know whether this is correct, but I am certain that many of us would like to carry off a sharp suit in the same way that you did in those photos. You looked great, as always, and it seemed in direct defiance of all the scary monsters that the last weeks of life can be associated with.

...for the music: I had with the lady who had recently received the news that she had advanced cancer that had spread, and that she would probably not live much longer than a year or so. She talked about you and loved your music, but for some reason was not impressed by your Ziggy Stardust outfit (she was not sure whether you were a boy or a girl). She too, had memories of places and events for which you provided an idiosyncratic soundtrack. And then we talked about a good death, the dying moments and what these typically look like. And we talked about palliative care and how it can help. She told me about her mother's and her father's death, and that she wanted to be at home when things progressed, not in a hospital or emergency room, but that she'd happily transfer to the local hospice should her symptoms be too challenging to treat at home.

First of all it is not our business to tell you your business however I advise people to simply do their math. ie if you are going to start up a pie shop then how many pies do you have to sell and at what price to cover the rent, staff, electricity, water, advertising, cost of making the pies, spoilage, etc.

However, most people never do this. They just seem to be in love with the notion that they will be living in Thailand and that their business will finance their retirement. But guess what? This is not good business practice.

I also inform clients that they shouldn't expect to make any profit in the first year and if they can last the first year they will be one of the 10% that do. If you last another year then you are one of the 3% that survive. It is not easy running your own company and the hours are long. Also, forget about holidays as its your company and so who is going to run it when your off on holidays.

Please sit down and work out the math first and then come and see us.

Now if you want to start a company you will need:
to register the company name at the Department of Business Development (DBD)
normally this has register capital of 1-2 million baht capital
if you intend to do work you will need a work permit
you will need a non immigrant B visa
there is a lot of paperwork to do and it can take many weeks
normally immigration gives you a few months visa to sort things out before they give you a 12 month visa
the work permit is associated with you company and therefore
you need 4 Thai staff to work for you - if you are married then there are different requirements
you will need to pay the social security for the Thai staff and yourself
immigration and other departments will pay you a visit and photograph you the office and the staff. Therefore dont cheat and dont make a problem for yourself.

After a month of working you can expect an unexpected visit from a few people that will come and check that you have a work permit. If you dont have one then you may get a fine and you may be deported. The Thai authorities are very strict on people working without permits.

A note of caution is that many people think that they can work setting up their company without a work permit as they think that the business is not up and running. Well, this is not the case as work is work, even when getting the pie shop fitted out.

Finally, you will need legal assistance as most if not all the documents are in Thai and Thai is spoken at the offices that you need to visit.

Then you will need to do the accounts each year. Showing income and outgoings, receipts for social, taxes paid, etc.

How do I get married and divorced in Thailand

Getting married in Thailand is fairly straight forward.

Looking at the legal aspects you can just have a village marriage. However, when you go to the local amphur or city hall and get the marriage registered then it is legal and binding.

Then when you go to your Embassy and have it registered then it comes under Thai and International Law.

If you have a pre nutial then this should be submitted when you do the registration of the marriage. I advise you to have a pre nup as this is your personal property and if you dont have one before you get married then your property becomes common property and the new wife can get up to 50% of your assets.

If you get divorced and its by mutual consent then both partied go to city hall and sign and its done.

Before you get married you will need to produce a single certificate to say you are single or have been divorced and now single.

Also be aware that once you are married to your new Thai wife, that you are up for her debts as well.

For example if she gambles and looses so do you. So be very careful.

How do I check to see if the condo or house I want to buy is free and clear

If you want to buy a house or condo then make sure it is free and clear of any debt and in the persons name that is selling it.

Also make sure it is a chanote land title as there are several kinds of land title here.

In Thailand a condo can be bought 100% in a foreign name, however the whole build must have 51% Thai and 49% foreigner owned.

A house can be owned 100% by a foreigner however the land cannot. So be careful when buying a house and land.

YES THIS IS A COMMON OCCURRENCE AND IT HAS MANY ISSUES THAT HAVE NOT BEEN THOUGHT OUT PROPERLY BY THE TESTATOR (THE PERSON WRITING THE WILL. OFTEN ITS BASED ON TRUST BECAUSE ITS A FAMILY MEMBER OR A RELATIVE OR BEST FRIEND. You might feel pleased to have a chance to do a final and important favor for someone you loved. On the other hand, you might feel you have little choice so that you have to accept the job. In fact, you do have a choice. Even if you feel an obligation to the deceased person -- who has both honored and burdened you by choosing you for the role of executor -- you can decline the job and let it pass to someone else. The information in this article can help you make your decision. (For a rundown of the tasks you'll likely face as executor, see Nolo's Checklist for Executors.) Skills You'll Need

The best executors and trustees are people who are careful, patient, unquestionably honest, well-organized, and committed to doing a good job. Executors must get along with people -- especially the other beneficiaries. I HAVE SEEN FAMILIES FIGHTING OVER WHO GETS WHAT. NOT A PRETTY SIGHT I CAN TELL YOU. THEN WHEN YOU TRY TO EXPLAIN THE LEGAL SITUATION THEY OFTEN TURN ON THE LAWYERS. ITS A PROCESS AND IT TAKES TIME TO SORT OUT PARTICULARLY IF THE ESTATE HAS ASSETS IN OTHER COUNTRIES. They need a good bit of spare time, too. You can expect to spend many, many hours -- lasting six months to a year -- to do the job. You don't, however, need to be a financial wizard or legal expert. You can always get professional or personal help with your financial or legal tasks. You can ask a sibling for help or hire professionals (accountants, tax preparers, lawyers, real estate brokers, and so on) who have the expertise you need. Their fees will be paid from estate funds, not your own pocket.
Some executors happily turn over the whole probate process to a lawyer; others do much of the routine work themselves and consult experts from time to time, to get over rough spots. (Learn more about the executor's job in Nolo's article What Does an Executor Do?) THE BEST WAY IS TO HAND IT OVER TO A LAWYER AS IN THAILAND ALL DOCUMENTS ARE IN THAI AND THE WILL AND THE EXECUTOR MUST GO TO COURT TO PROVE THAT THE WILL IS LEGAL AND BINDING AND THAT THE EXECUTOR IS UP TO THE JOB.

Things to Consider

Every estate and every family situation is unique. The difficulty of serving as executor depends on many factors: the size of the estate, your state's laws, and the complexity of the deceased person's financial affairs, to name a few. A WILL THAT HAS WORLDLY ASSETS IN IT IS A PROBLEM WAITING TO HAPPEN. THE WILL SHOULD NOMINATE THE COUNTRY WHERE THE PERSON LIVES OR IS DOMICILED. THIS WAY THE LAWS OF THAT COUNTRY CAN INFLUENCE MANY PARTS OF THE ESTATE.
Complexity of the job. If the deceased person has left property of modest value, with a few major assets and no estate tax issues, accepting the executor's may not be such a big deal. Or, if you've already been helping manage someone's finances, handling things after death may be a natural extension of your duties. But, if you're unfamiliar with the person's affairs, you may face as many practical problems as legal ones: finding the will, untangling investments, digging up insurance policies, and the like.
If you're being asked to be an executor, the complexity of your state's probate system also matters. The trend is to make the process simpler but, unfortunately, not every state has jumped on this bandwagon. THE EU HAS MADE PROBATE EASIER AND THE TESTATOR CAN NOMINATE THE COUNTRY AND THE LAWS OF THAT COUNTRY TO GOVERN THE WILL.
Personal factors. If you'll inherit most or all of the property, you have a strong incentive to serve as executor. You'll be in charge of what will shortly be your own property, and you won't have other beneficiaries to worry about. If you're one of several beneficiaries, however, it may be helpful to ask yourself some questions about the reality you will face.

If you live far away, will it be too difficult or expensive for you to handle the estate? THIS IS AN ISSUE WE FACE IN THAILAND AS MANY EXPATS ARE ELDERLY AND HAVE RETIRED HERE AND SO THEY NOMINATE A FAMILY MEMBER THAT MUST FLY INTO A COUNTRY AND LANGUAGE / LEGAL SYSTEM THEY DONT UNDERSTAND.
How likely are family members to let you do your job without second-guessing every decision? IN THAILAND THE EXECUTOR HAS THE FINAL SAY.
How likely are other inheritors to bicker among themselves or with you? Would conflict be reduced or intensified if someone served as coexecutor with you? NOT IN THAILAND - SOMETIMES THAI888 LEGAL SUGGESTS THAT A CO EXECUTOR WOULD BE BENEFICIAL WHERE CHILDREN UNDER THE AGE OF 20 ARE INVOLVED. AS THAILAND DOES NOT HAVE TRUSTS FOR CHILDREN, THEY HAVE A CONTROLLER OF PROPERTY AND SO IF YOU WANT TO MAKE SURE YOUR CHILDREN RECEIVE THEIR INHERITANCE THEN YOU WOULD NAME OUR COMPANY TO MAKE SURE THEY GET IT. WE WILL CONTROL THE ASSETS AND RELEASE ONLY MONEY FOR FOOD, CLOTHES, SCHOOL, RENT ETC.
If you're worried about taking time away from work to perform your executor's duties, what payment will you be legally entitled to collect for your services? YES OF COURSE THERE ARE FEES BUT WHEN YOU CONSIDER THAT ANOTHER FAMILY MEMBER WILL NEED TO FLY IN, STAY IN A HOTEL, GET TAXI'S EVERYWHERE AND STAY FOR A FEW WEEKS TO TRY AND SORT THINGS OUT, OUR FEES ARE NOT GREAT. IF YOU HAVE TO SELL PROPERTIES AND LIQUIDATE ASSETS YOUR EXECUTOR MAY BE HERE FOR MONTHS.
Is there anyone else willing and able to do a conscientious job or, at least, share the work as a coexecutor? THIS IS DIFFICULT AS THERE WILL NO DOUBT BE DIFFERENCES OF OPINION AND ONE MAY RESIGN BECAUSE OF IT. THEREFORE MORE LEGAL WORK.
If the will names someone else to serve as a coexecutor with you, do you think you'll work well together? IN MOST CASES NO.

There are ways to constructively deal with many potential problems. But thinking about them now will help you prepare mentally for the challenges ahead and may prompt you to figure out creative ways to avoid problems. Finally, you may find that the process of winding up a loved one's affairs is unexpectedly therapeutic. There is satisfaction in knowing that you're doing what the deceased person wanted. I GIVE TALKS AT CLUBS AND MOST PEOPLE DONT HAVE WILLS AND SEVERAL TIMES THE WILL HAS BEEN REJECTED BY THE US EMBASSY. I STRESS THE NEED FOR PLANNING - IE FAIL TO PLAN PLAN TO FAIL. BUILDING AN ESTATE TAKES A LIFETIME AND UN WINDING THE ESTATE IS A SLOW LEGAL PROCESS. I FEEL GOOD WHEN I COMPLETE PROBATE, HOWEVER I ALSO SEE THE WORST IN PEOPLE.
If you don't serve, who will? If you decline the job after the person who names you has died, or resign after serving for a while, someone else must take over. If you're an executor and you haven't yet begun probate, you should simply notify the alternate executor named in the will. If there isn't anyone, someone must either take over informally or begin probate proceedings and ask the court to be appointed an executor. YES A POWER OF ATTORNEY FOR RESIGNING AND APPOINTING ANOTHER EXECUTOR THAT IS ACCEPTABLE TO THE COURTS. IF NO ONE IS FOUND THEN THE PUBLIC PROSECUTOR WILL NOMINATE A LEGAL PERSON TO WIND UP THE ESTATE. If you resign as executor after having started probate court proceedings, you can submit your resignation to the probate court and provide a written record of what (if anything) you have done. The court will then appoint someone to take your place.

I had to laugh the other day when a friend said they were to young to die so they didnt need a Will.

Well news flash - Thailand has the 2nd highest death rate for accidents in the World. So if old age dont get you then a car, bus or motor bike will.

If you have property in Thailand then you can die of many ways and so what happens to your assets?

Its worse if you are a US citizen as the Embassy can reject your Will for leaving out certain instructions.

So please make a Will and if you already have one then please check to see that it is correct.

One potential client asked me to check his documents and I said I am sorry but the Embassy will reject this. He was very angry as he went to a reputable Law firm and paid 100% more than we charge.
So I guess we claimed another client as they felt we could better look after their interests.

I was surprised that the US Embassy claimed that very few expats have Wills. This is really bad as its the family, friends and others that have to pick up the pieces. Legally its a real headache too.

US citizens dying in Thailand and how Thai888 Law Office can help

The US Embassy website Thailand is very confusing and it is difficult to find the correct information.

Sadly a few US citizens have passed away in Thailand over the last month. As directed by the website the next of kin needed to download an affidavit from the site and have it notarized and sent to the Bangkok US Embassy. Unfortunately, the site had not been updated and the form used was an old one.

The time and money spent on getting the form notarized and sent back to Thailand aside, this next of kin was also emotionally distressed by a family member dying.

However, new forms were downloaded, notarized, returned to Thailand.

Thai888 Law Company has contacted the US Embassy to make sure the form is correct and we are waiting on confirmation on this. When I have this I will put the link here.

Also please be aware that several other statements on the website can be taken other ways. Also one client commented that he was pretty good at searching for things on the internet, however he could not find the affidavit needed.
