We discussed your death and your music, and it got us talking about numerous weighty subjects, that are not always straightforward to discuss with someone facing their own demise. She too, had memories of places and events for which you provided an idiosyncratic soundtrack. And then we talked about a good death, the dying moments and what these typically look like. And we talked about palliative care and how it can help. Therefore dont cheat and dont make a problem for yourself.<br /><br />After a month of working you can expect an unexpected visit from a few people that will come and check that you have a work permit. If you dont have one then you may get a fine and you may be deported. The Thai authorities are very strict on people working without permits.<br /><br />A note of caution is that many people think that they can work setting up their company without a work permit as they think that the business is not up and running. Well, this is not the case as work is work, even when getting the pie shop fitted out.<br /><br />Finally, you will need legal assistance as most if not all the documents are in Thai and Thai is spoken at the offices that you need to visit.<br /><br />Then you will need to do the accounts each year. However, when you go to the local amphur or city hall and get the marriage registered then it is legal and binding.<br /><br />Then when you go to your Embassy and have it registered then it comes under Thai and International Law.<br /><br />If you have a pre nutial then this should be submitted when you do the registration of the marriage. I advise you to have a pre nup as this is your personal property and if you dont have one before you get married then your property becomes common property and the new wife can get up to 50% of your assets.<br /><br />If you get divorced and its by mutual consent then both partied go to city hall and sign and its done.<br /><br />Before you get married you will need to produce a single certificate to say you are single or have been divorced and now single.<br /><br />Also be aware that once you are married to your new Thai wife, that you are up for her debts as well.<br /><br />For example if she gambles and looses so do you. YES THIS IS A COMMON OCCURRENCE AND IT HAS MANY ISSUES THAT HAVE NOT BEEN THOUGHT OUT PROPERLY BY THE TESTATOR (THE PERSON WRITING THE WILL. OFTEN ITS BASED ON TRUST BECAUSE ITS A FAMILY MEMBER OR A RELATIVE OR BEST FRIEND. You might feel pleased to have a chance to do a final and important favor for someone you loved. On the other hand, you might feel you have little choice so that you have to accept the job. In fact, you do have a choice. Even if you feel an obligation to the deceased person -- who has both honored and burdened you by choosing you for the role of executor -- you can decline the job and let it pass to someone else. The information in this article can help you make your decision. Executors must get along with people -- especially the other beneficiaries. I HAVE SEEN FAMILIES FIGHTING OVER WHO GETS WHAT. NOT A PRETTY SIGHT I CAN TELL YOU. THEN WHEN YOU TRY TO EXPLAIN THE LEGAL SITUATION THEY OFTEN TURN ON THE LAWYERS. ITS A PROCESS AND IT TAKES TIME TO SORT OUT PARTICULARLY IF THE ESTATE HAS ASSETS IN OTHER COUNTRIES. They need a good bit of spare time, too. You can expect to spend many, many hours -- lasting six months to a year -- to do the job. You don't, however, need to be a financial wizard or legal expert. You can always get professional or personal help with your financial or legal tasks. You can ask a sibling for help or hire professionals (accountants, tax preparers, lawyers, real estate brokers, and so on) who have the expertise you need. Their fees will be paid from estate funds, not your own pocket.<br /> Some executors happily turn over the whole probate process to a lawyer; others do much of the routine work themselves and consult experts from time to time, to get over rough spots. The difficulty of serving as executor depends on many factors: the size of the estate, your state's laws, and the complexity of the deceased person's financial affairs, to name a few. A WILL THAT HAS WORLDLY ASSETS IN IT IS A PROBLEM WAITING TO HAPPEN. THE WILL SHOULD NOMINATE THE COUNTRY WHERE THE PERSON LIVES OR IS DOMICILED. THIS WAY THE LAWS OF THAT COUNTRY CAN INFLUENCE MANY PARTS OF THE ESTATE.<br /> <strong>Complexity of the job.</strong> If the deceased person has left property of modest value, with a few major assets and no estate tax issues, accepting the executor's may not be such a big deal. Or, if you've already been helping manage someone's finances, handling things after death may be a natural extension of your duties. But, if you're unfamiliar with the person's affairs, you may face as many practical problems as legal ones: finding the will, untangling investments, digging up insurance policies, and the like.<br /> If you're being asked to be an executor, the complexity of your state's probate system also matters. The trend is to make the process simpler but, unfortunately, not every state has jumped on this bandwagon. THE EU HAS MADE PROBATE EASIER AND THE TESTATOR CAN NOMINATE THE COUNTRY AND THE LAWS OF THAT COUNTRY TO GOVERN THE WILL.<br /> <strong>Personal factors.</strong> If you'll inherit most or all of the property, you have a strong incentive to serve as executor. You'll be in charge of what will shortly be your own property, and you won't have other beneficiaries to worry about. If you're one of several beneficiaries, however, it may be helpful to ask yourself some questions about the reality you will face.<br /> <ul><li>If you live far away, will it be too difficult or expensive for you to handle the estate? THIS IS AN ISSUE WE FACE IN THAILAND AS MANY EXPATS ARE ELDERLY AND HAVE RETIRED HERE AND SO THEY NOMINATE A FAMILY MEMBER THAT MUST FLY INTO A COUNTRY AND LANGUAGE / LEGAL SYSTEM THEY DONT UNDERSTAND.</li><li>How likely are family members to let you do your job without second-guessing every decision? IN THAILAND THE EXECUTOR HAS THE FINAL SAY.</li><li>How likely are other inheritors to bicker among themselves or with you? Would conflict be reduced or intensified if someone served as coexecutor with you? NOT IN THAILAND - SOMETIMES THAI888 LEGAL SUGGESTS THAT A CO EXECUTOR WOULD BE BENEFICIAL WHERE CHILDREN UNDER THE AGE OF 20 ARE INVOLVED. So if old age dont get you then a car, bus or motor bike will.<br /><br />If you have property in Thailand then you can die of many ways and so what happens to your assets?<br /><br />Its worse if you are a US citizen as the Embassy can reject your Will for leaving out certain instructions.<br /><br />So please make a Will and if you already have one then please check to see that it is correct.<br /><br />One potential client asked me to check his documents and I said I am sorry but the Embassy will reject this. He was very angry as he went to a reputable Law firm and paid 100% more than we charge.<br />So I guess we claimed another client as they felt we could better look after their interests.<br /><br />I was surprised that the US Embassy claimed that very few expats have Wills. This is really bad as its the family, friends and others that have to pick up the pieces. Legally its a real headache too.<br />Most people just resign and say get someone else to do it. As directed by the website the next of kin needed to download an affidavit from the site and have it notarized and sent to the Bangkok US Embassy. Unfortunately, the site had not been updated and the form used was an old one.<br /><br />The time and money spent on getting the form notarized and sent back to Thailand aside, this next of kin was also emotionally distressed by a family member dying.<br /><br />However, new forms were downloaded, notarized, returned to Thailand.<br /><br />Thai888 Law Company has contacted the US Embassy to make sure the form is correct and we are waiting on confirmation on this. When I have this I will put the link here.<br /><br />Also please be aware that several other statements on the website can be taken other ways. Also one client commented that he was pretty good at searching for things on the internet, however he could not find the affidavit needed.<br /><br />So please contact us if you have any doubts or questions because this is the work we do every day.
