NEW YORK - Hopefully the third time's a charm when it comes to settling the mess that is the lawsuit revolving around Shepard Fairey-s now-iconic Obama "Hope" poster. Mannie Garcia, the freelance photographer who snapped the original picture while on assignment for the Associated Press in 2006, has joined in the fight: On July 9, Garcia filed a claim stating that the AP is not the owner of the photo, a fact of which he says the organization is well aware.

Garcia argues that he was not technically an employee of the AP when he took the photo, since he was on a temporary assignment and ineligible to receive health benefits or vacation time. He is also challenging Fairey, whom he says unfairly copied the photo.

Fairey is involved in an ongoing dispute with the AP, which claims it owns the copyright for the original photo and accused him of stealing the image. The artist then counter sued when the wire service ran a picture of his poster - without permission - alongside the original photo in a story regarding the dispute.

I always knew it would come down to this.. I read about it before (in like 1997 or something - of course it wasn't related to Obama back then) and well to be honest -- knew it was coming... However! I am waiting to see what the courts decide.. I mean what if the picture was just 'inspiration' .. that would be my defense.

The Terms of Service lay out pretty clearly the rights of ownership of material, but section 11.1 grants Google a "perpetual" and "irrevocable" license to deliver the content. I understand why this would be a necessary provision during the term of the relationship. My question is does this grant of license survive termination of the relationship (as in section 13)? Section 13 defines certain provisions that survive termination (Section 4, and 20.7 for example) but does not address section 11.1. This seems contradictory to the meaning of "prepetual" and "irrevocable". If the right of Google to continue to use the material does survive termination of the relationship, that should be noted in section 13 (along with the other provisions that continue). If the rights of Google do not survive termination, then they are neither perpetual, nor irrevocable and the language should be clarified. I understand it is easier for Google to ask for (require) a perpetual and irrevocable license, but my understanding of the values of Google as a company was that you were less interested in doing what was easy and more focused on "not being evil." I am looking at Picassa to share some family photos, so the copyright issue is not business critical, but since I have a few extra moments this morning and I don't understand how section 11 and section 13 are reconciled, I thought I would ask. I appreciate the quality and availability of a service like Picassa, but I've often found that "standard legal terms" found in click-through licenses sometimes require a bit of push-back from the user in order to help the environment evolve. Thank you for the service (I hope I can agree to your terms) and thank you for your time.

This is a re-post of an article I found a while back at about.com which I thought today I would give a slightly more concise version.

The four Principals are your task - one day at a time. Here goes:

Positive Attitude Diet Day 1: Fill your mind with positives.
Instead of living your life on autopilot, letting any and all thoughts come into your mind, consciously feed your mind positive input. Do this on the first day of every week, and do it throughout the day. Read inspirational books; listen to uplifting music, or call an upbeat person. And by all means, avoid the cynics and gripers.

Positive Attitude Diet Day 2: Affirm yourself.
Of course you may have some doubts about yourself. But on day 2, literally, consciously feed yourself with positive affirmations. As boxing champ Sugar Ray Robinson said, "To be a champ, you have to believe in yourself when nobody else will."

Positive Attitude Diet Day 3: Think only good things about people.
Don't allow ill thoughts to enter your mind. Look for something you like in everyone you meet. One person might have a great smile, and another one might be extremely dedicated to his work. You can always find something you like.

Positive Attitude Diet Day 4: Speak only positive words.
In order to build and maintain a positive attitude, you must speak hopefully about everything -- your job, your customers, your manager, your employees, your children, your health, and your future. Go out of your way to talk optimistically about everything. When you have a positive attitude, you refuse to use a loser's language. As George Schultz, the former U.S. Secretary of State said, "The minute you start talking about what you're going to do if you lose, you have lost."

I live these principal's everyday and I have been for a long long time. I get complimented on these qualities all the time from people who I just meet to people who have known me for a long time. They wonder how can someone be so happy, upbeat and infectious! Now you know my secret... I just believe in the -positive outcome- of -positive input- into the world. I 'stumbled upon' a fantastic photo sharing site quite by accident last week called Radar. Right now, the site is probably a little 'under the radar' so take note that you heard about it here at Robin-Ann.com first!

The direct link to me and my posts is /people/robinann/ and I ask, no insist you check it out because it is truly awesome. So awesome in fact that I posted my first Apple 'Customer Review' for Radar, and this is what I said:

I've tried just about every app to keep twitter and facebook updated simultaneously - finally an app that does the job! Radar is a photo driven community - so your posts have to have to have pictures; but aren't you taking pictures with your phone anyway? As a stand alone community, Radar is almost too cool for words. I wasn't planning on the warm reception I received when I signed up, and the creators are knee deep involved every day. I see and talk to them regularly in the app and on the website. I have a new (2nd/3rd/4th) home on the web - totally unexpected; it's at Radar.net. I highly recommend this app.

So go on.. even if you don't have iPhone, you can upload with just email, which makes this website for everyone - except those in the XXX industry (As official admin-in-training: I flagged my first post today; you should have seen it! 8^0 lol.)

I admit, I was against the iPhone from the beginning. First, it was too expensive. Then it was over popularized, then I just thought hey! I'm already living without it and besides, I'm weilding a "Windows Mobile" phone which is very amazing in it's own reight.. So who cares about that old iPhoney thingy anyway.. Then, I found myself downloading .cab files like it was goin' out of style.. trying to get my phone to do miraculous things. But I knew I had crossed the line when I downloaded one of those program install files which made my home screen look like an iPhone home screen. THAT was the last straw. I knew then it was only a matter of time. So yes! this post was created on my slick shiny silky smooth sexy iPhone.. And I couldn't be a more pround owner of about well.. Anything at this point in my life. If everything in my life ran as smooth as this phone I would be ... very happy to give loads of money away like Bill Gates is doing to charities and such. I mean, how did I live without this phone?!! It makes me wonder, does Bill Gates own his own iPhone? [update 2/12/2009 : No. Bill Gates does NOT have an iPhone ref: http://i.gizmodo.com/5162674/iphones-and-ipods-banned-at-gates-home - lol] The program posting this blog post is called LifeCast and I'm hoping it works as well as my other experiences with this device, since this is the trial run for the program. How to Blog 'Posts' as a 'Blogger' Author

I am here to give you the quick and easy way to write your own website. Get ready for about 30 - 40 minutes of learning which you will help you, your business and your website become a greater resource for your own self, your friends and your customers!

Each of my directions will come with a sample image for you to follow along, and of course I am always there if you need help while in the process so feel free to contact me anytime for help!

The first step is to learn how to blog 'posts' to your website. This is easy. After you have accepted the invitation to blog on your new website from Google's Blogger, log yourself into the online software.

Click images to open larger.

You should automatically be brought to your dashboard, and if you have several blogs like me you will see a listing for all of them. Click on the link for 'New Post' and we will get on to the next step.

Now you should see the post form. Just fill out what you want to say ie: the title for the post, and the body of text. You can also add photos here with the correct html tags (more on html image tags in a minute).

When posting images, it is of UTMOST importance to get the code for the images correct, or your entire post will at the least not show the image and at the worst mess up your entire page! So, when you copy the code from flickr (or wherever), make sure you get all-of-it. The code is in a 'Share This' drop-down menu on the top right, the code is in a drop-down link called 'Embed it'.

Once you have written everything you want to say and added any picture links you like, then it is time to post your hard work! Hit the "Publish" button and give it a minute to work...

You might see this page, just please be patient. Worst case scenario, you will have to log out of blogger and then log back in later to publish when it is not so busy.. sometimes blogger gets a headache..

OK, now you should eventually see this page which mean your page has published to your website. You should now go check to make sure it looks right.

Viola! You should see a brand new post like this!

If it doesn't look right, check back to your blogger page and click to 'Edit Posts'; See if you can find the code error; it is most likely to be in the html for the image. Try copying the code again and then republishing.
