<p>The California State Bar Task Force on Admissions Regula­tion Reform is exploring whether applicants should receive  a specified amount of practical skills training before being admitted to practice in California.  On April 9 Bar Trustees approved the 21-member Task Force, which will investigate whether to require preadmission training; how much training should be required and how long applicants would have to spend as trainees; training content and how it would improve new lawyers&#8217; competence level; and whether to require a uniform practical skills curriculum or to permit a variety of skills training.  </p>
<p>The study is part of the “<a title="Five-Year Strategic Plan" href="http://www.calbar.ca.gov/LinkClick.aspx?fileticket=2Q6JGJXZrXw%3D&amp;tabid=224&amp;mid=1534" target="_blank">Five-Year Strategic Plan</a>” the Bar released as part of the legislatively-mandated reform process that reshaped the organization and directed its leaders to do a better job of protecting the public.  See <a title="S.B. 163" href="http://www.leginfo.ca.gov/pub/11-12/bill/sen/sb_0151-0200/sb_163_bill_20111002_chaptered.html" target="_blank">S.B. 163 </a>(codified at <a title="The State Bar Act" href="http://leginfo.ca.gov/cgi-bin/displaycode?section=bpc&amp;group=05001-06000&amp;file=6000-6009.7" target="_blank">California Business &amp; Professions Code §§ 6000 <em>et seq</em>. (the &#8220;State Bar Act&#8221;)</a>.</p>
<p>The Task Force is scheduled to issue its recommendations in December 2013.</p>

<p>As reported in the<a title="Sacramento Bee" href="http://www.sacbee.com/" target="_blank"> Bee</a>, however, the law gives victims of debt collection abuse a way to fight back.  The <a title="Fair Debt Collection Practices Act" href="http://www.gpo.gov/fdsys/pkg/USCODE-2010-title15/pdf/USCODE-2010-title15-chap41-subchapV-sec1692.pdf" target="_blank">Fair Debt Collection Practices Act </a>, 15 U.S.C sec. 1692 et. seq., prohibits such unfair debt collection practices, and allows a successful plaintiff to collect, in addition to actual damages, &#8220;statutory&#8221; damages of $1,000 per incident plus court costs and attorneys fees. California&#8217;s debt collection statute, the <a title="Rosenthal Fair Debt Collection Act" href="http://leginfo.ca.gov/cgi-bin/displaycode?section=civ&amp;group=01001-02000&amp;file=1788-1788.3" target="_blank">Rosenthal Fair Debt Collection Practices Act</a>, California Civil Code sec. 1788 et. seq., provides similar relief.  Senate Bill 890, introduced by <a title="Mark Leno" href="http://sd03.senate.ca.gov/news/2012-02-21-protecting-consumers-abusive-debt-collectors" target="_blank">Mark Leno </a>(Dem., San Fransisco), passed by the Senate in January and now in the Assembly, would establish the &#8220;<a title="Fair Debt Buyers Practices Act" href="http://leginfo.ca.gov/pub/11-12/bill/sen/sb_0851-0900/sb_890_bill_20110527_amended_sen_v96.pdf" target="_blank">Fair Debt Buyers Practices Act</a>,&#8221; ensuring that debt buyers substantiate the ownership and validity of the debts they attempt to collect and prohibiting debt buyers from suing to collect a debt if the statute of limitations has expired.</p>

<p>We get quite a few questions about finding the &#8220;legislative intent&#8221; behind a law. Legislative intent can (sometimes!) be determined by creating a legislative history on the law in question—looking at the debates, comments, changes between drafts, and other information about the bill&#8217;s history from introduction to signature. Legislative intent can be used to clarify an ambiguous law, or apply a law to an unforeseen situation.</p>
<p>To help people with these questions, we created a <a title="California Legislative History step-by-step guide" href="http://www.saclaw.org/pages/california-legislative-analysis.aspx" target="_blank">&#8220;Legislative History&#8221; step-by-step guide</a>.  We have just updated the guide with all-new examples and illustrations.</p>
<p>While much of the in-depth information can be found in more archival libraries, such as the <a title="WITKIN STATE LAW LIBRARY OF CALIFORNIA" href="http://www.library.ca.gov/collections/index.html#law" target="_blank">California State Library&#8217;s law library</a>, the Sacramento County Public Law Library has enough information to do a basic history on laws passed since 1968, and get key information (bill numbers and statute citations) for all California laws. In fact, using our guide, you can find much of this information on the Internet for free! Take a look, and as always, let us know any comments or feedback.</p>

			<content:encoded><![CDATA[<p><a href="http://blog.saclaw.org/wp-content/uploads/2012/04/installment-payments2.jpg"><img class="alignleft size-thumbnail wp-image-2586" style="margin: 2px; border: black 2px solid;" title="installment payments" src="http://blog.saclaw.org/wp-content/uploads/2012/04/installment-payments2-150x150.jpg" alt="" width="150" height="150" /></a><a href="http://leginfo.ca.gov/cgi-bin/displaycode?section=ccp&amp;group=00001-01000&amp;file=577-582.5" target="_blank">California Code of Civil Procedure §582.5</a> allows a judgment debtor in a limited civil case (where the amount demanded is $25,000 or less) to ask the court for an order allowing the judgment to be paid in installments. This request may be granted for &#8220;good cause&#8221; at any time after the judgment, even if the judgment debtor never answered the complaint. In determining the amount of the installment payments, a court considers the same factors it would consider in reviewing a <a title="Claim of Exemption from Bank Levy" href="http://www.saclaw.org/pages/claim-exemption-bank-levy.aspx" target="_blank">request for a claim of exemption</a>, including the judgment debtor’s source and amount of income and his or her expenses.</p>
<p>A request for a judgment to be paid in installments is made through a written motion. A “motion” is a request made in a case asking the court to issue an order of some sort. There is no Judicial Council form for making a motion; instead, the motion must be typed on 28-line <a href="http://www.saclaw.org/uploads/SacramentoPleadingWeb.doc" target="_blank">pleading paper</a>. A Motion to Pay Judgment in Installments generally consists of five parts: Notice of Motion; Motion; Points and Authorities; Declaration; and [Proposed] Order.</p>
<p><span id="more-2553"></span></p>
<p>The Notice of Motion lets the opposing party know when and where the motion is scheduled to be heard, while the Motion lets the court and the opposing party know what is being requested. The Points and Authorities explains to the court and the opposing party the legal basis of the motion, while the Declaration provides evidence, sworn under penalty of perjury, supporting the motion. A [Proposed] Order is prepared for the Judge to sign.</p>

to ensure that a property owner has access to direct sunlight. In
particular, it focuses on laws designed to prohibit vegetation on adjacent
properties from shading solar energy equipment, such as photovoltaics

by states and focuses on California’s Solar Shade Control Act as a model

This paper examines the sections of California law known collectively as the Solar Rights Act (hereinafter
“the Act”), and reviews lawsuits brought under the Act.3 Through the Act, which was enacted in 1978, the
legislature sought to balance the needs of individual solar energy system owners with other property owners
by developing solar access rights.4 The Act limits the ability of covenants, conditions, and restrictions,
(hereinafter “CC&amp;Rs;”) typically enforced by homeowner associations (hereinafter “HOAs”), and local
governments to restrict solar installations. These are perhaps the most well known and frequently contested
provisions of the Act.5 However, the Act also creates the legal right to a solar easement and requires local
governments to preserve passive cooling and heating opportunities to the extent feasible in new development
projects.&lt;/li&gt;

This paper examines Sections 25980–25986 of the California Public Resources Code,3 known as the Solar
Shade Control Act (hereinafter “the Act”), and reviews lawsuits brought under the Act. Through the Act,
which was enacted in 19784 and later amended in 2008,5 the Legislature sought to balance the desired effects
of planting trees and shrubs for shade and visual appeal with the desire for increased use of solar energy
devices, whose performance can be hindered by shade from nearby vegetation. The Act provides for specific
and limited controls of trees and shrubs to protect the use of nearby solar energy systems&lt;/li&gt;
