The Irish data protection commissioner has recommended widespread changes to improve privacy on Facebook—particularly significant because Facebook Ireland [has] responsibility for all non–US and Canadian data.

Suggested changes:

a mechanism for users to make informed choices about how their information is used and shared on the site, including in relation to third party apps;
increased transparency and controls over how personal data is used for advertising purposes;
transparency and control for users via the provision of all personal data held to them on request and as part of their everyday interaction with the site;
the deletion of information held on users and non-users via what are known as social plug-ins, and more generally the deletion of data held from user interactions with the site much sooner than at present;
an update to its data use policy/privacy policy to take account of recommendations as to where the information provided to users could be further improved;
an additional form of notification for users in relation to facial recognition/"tag suggest" that, it is considered, will ensure Facebook Ireland is meeting best practice in this area from an Irish law perspective;
an enhanced ability for users to control tagging and posting on other user profiles; and
an enhanced ability for users to control their addition to groups by friends.

Digital Data on Patients Raises Risk of Breaches

So began a nightmare that cost…nearly $300,000 in legal, private investigation, credit monitoring and media consultancy fees [and] 600 hours dealing with the fallout[.]

[A]s patient records have been digitized, health data breaches have surged. The number of reported breaches is up 32 percent this year…cost[ing] the industry an estimated $6.5 billion last year. In almost half the cases, a lost or stolen phone or personal computer was responsible.

The… Wall of Shame…today includes 380 breaches affecting more than 18 million people.

Complicating matters…[t]he legal burden of protecting patient data…falls on…the physicians and hospitals who entrust[]…their files. "The laws create a perverse outcome…our fault…[not] our breach."

No perversion here, the act of entrustment creates a duty in the entrustor to choose wisely the entrustee and their services. Entrustment does not negate, only obscures, liability. Wonder if securing health information is solving the wrong problem? If more digital use, creates more digital stores, and this creates more digital breaches, then the problem is the number of digital stores.

When I see references to the The Helpful Venn Diagram—you have to laugh, because it is usually cited in settings of a recent breach in privacy. But there's this latent presumption that a free service is a secure service. There's a companion presumption that follows—one's use of the service is concordant with the motives of those offering the service.

You have to step back and ask what is the operant business model? Irony? The quid pro quo, the what–for–what, of social media (the socialization of the web) is the offering of a sharing service because what is shared can be monitized to interested parties external to the participants and facilitators in the sharing. Social media is dependent upon the generation of social data (i.e., Big Data)—data that drives personal sharing, but also the marketing engines core to the business model.

When we are critical of the gift horse, do we betray our blindness of the trojan horse?

Virginia Tech cybersecurity breakthrough keeps sensitive data confined in physical space:

In a breakthrough that could aid spies, keepers of medical records, and parents who want to prevent their kids from "sexting," a team of Virginia Tech researchers has created software to remotely put smart phones under lockdown. The phones are given permission to access sensitive data while in a particular room, but when the devices leave the room, the data is completely wiped.

Dr. Thran had a Facebook account and wanted to share with her friends some of her recent experiences as an Emergency Physician—or just to decompress after a harried shift. The actual details are unknown, but the results are.

Alexandra Nicole Thran, “a 48 year old Emergency Medicine Physician…graduate[d from] Vanderbilt University School of Medicine [in 1988] and…has held a license to practice medicine in Rhode Island since 2002.” (State of Rhode Island Department of Health Board of Licensure and Discipline Consent Order No. C10-157—PDF). The [Westerly Hospital], where Dr. Thran worked, “reported to the Board…that it had terminated [her] clinical privileges…because she had used her Facebook account inappropriately[.]” “[She] did not use patient names and had no intention to reveal any confidential patient information[…but] the nature of one person’s injury was such that the patient was identified by unauthorized third parties.” (id)

Dr Thran was found, in the Consent Order, to be “guilty of ‘unprofessional conduct’ in violation of R.I.G.L. 5-37-5.1(19) by revealing personally identifiable information to third parties.” The law reads: “The term ‘unprofessional conduct’…includes, but is not limited to…(19) [i]ncompetent, negligent, or willful misconduct in the practice of medicine which includes the rendering of medically unnecessary services, and any departure from, or the failure to conform to, the minimal standards of acceptable and prevailing medical practice in his or her area of expertise as is determined by the board. The board does not need to establish actual injury to the patient in order to adjudge a physician…guilty[.]” (id)

She agreed with this finding and accepted a reprimand, CME requirement, and a $500 fine.

Is this harsh? Absolutely, but this is the nexus of healthcare, technology, and our professional livelihoods. It becomes even harsher when one considers that a loss of clinical privileges may mean a loss of employability within a chosen community or region because of Emergency Medicine’s hospital and health system dependencies. What should be done? It’s often referred to has the “coffee shop test” or the “elevator test”—the gist—“use the same ethics and confidentiality online that you use in real life.” And in this context—real professional lives.
