<p><strong>But in July 2024, the Wall Street Journal</strong> presented an in-depth article regarding the lawsuits happening more and more often to small businesses &#8211; not corporations, but small businesses with less than 50 employees.</p>

<p><span>&#8220;The lawsuit was one of more than 1,100 web-accessibility cases brought in the U.S. last year by Mizrahi Kroub. The New York law firm, which has nine lawyers, is the largest filer of these cases, accounting for roughly one-quarter of digital ADA cases</span><span>,</span><span> according to UsableNet, a provider of web-accessibility services.&#8221;</span></p>
<p><span>&#8220;Mizrahi Kroub is part of a cottage industry that has sprung up around website accessibility. It includes plaintiffs who bring these lawsuits and their lawyers; defense lawyers who represent those sued; and consulting firms and software vendors that monitor and update websites.&#8221;</span></p></div></div>

<p><b><i>ADA compliance</i></b><i><span style="font-weight: 400;"> is a set of standards that ensure you adhere to the Americans with Disabilities Act (ADA) which protects against disability-based discrimination.</span></i></p>
<h4>What does it mean to be ADA compliant?</h4>
<p><span style="font-weight: 400;">“What does an ADA-compliant website look like? No clear ADA regulations spell out precisely what compliant web content should entail. <h4>Is the ADA targeting small businesses?</h4>
<p><span style="font-weight: 400;">“Technically, the ADA isn&#8217;t targeting anyone. However, there are law firms that are now seeking out websites, often small businesses, and quickly running a scan and threating legal action for non-compliance. These often require settlement to avoid trial. <h4>Why isn’t my website already ADA compliant?</h4>
<p><span style="font-weight: 400;">“It may technically be compliant, or it may not – the guidelines as to what makes a website ‘compliant’ is incredibly subjective, making it very easy for someone to find items that qualify as violations and issue a lawsuit. <ul>
<li>Photos, images video and audio files on your website must have ALT Tags &#8211; every photo should have a tag (it can be hidden and hovered over to read) that describes what the photo is. This allows users with disabililties to read or hear the description of the file.</li>
<li>Video and audio files should have text transcripts to help hearing impaired users understand content.</li>
<li>Be sure the website language is identified in the header code. This allows text readers to use the language set for the website.</li>
<li>Use color contrasts to assist those with visual impairments, but don’t rely just on color.</li>
<li>Also use consistent easily-readable font sizes &#8211; not too many sizes or colors, which can be confusing for those with low-vision challenges.</li>
<li>Offer alternative recommendations should a user with a disability encounter a problem.</li>
<li>Organize your navigation, links and buttons throughout the website so a user can easily find their way throughout the entire site. (This is just best-practice for ALL websites!)</li>
</ul>

<p>When the cost of using a national training software platform became too great, Curtis, owner of OSHA Training, decided to create a proprietary platform for training videos, that could be managed by him from anywhere.</p>



<p>OSHA training is highly regulated; only a few nationwide training companies are certified to provide online and credentialed classes. Since Curtis is an approved company for training, he wanted to control his own training videos and certifications, rather than pay a third-party for access.</p>



<p>Curtis came to Thin Air Web with a detailed list of items and functions he desired, and we provided those items, as well as many other functions over time.</p>



<p>Training videos are recorded by Curtis, and uploaded to a cloud-managed website management system, which allows potential students to create an account and pay online to participate, test, and receive a certificate of completion.</p>



<p>The online system has layers of security to assure privacy and also allows for a Management Level to allow an HR professional or teacher to enroll several students for courses and certification under one account. The teacher/HR professional can track the progress of students and receive copies of the certificates to submit for verification or class credit.</p>



<p>Many of the courses require several modules for completion and are verified by the Department of Labor with a printable card for employer verification.</p>



<p>One of the specific perks of the online training courses is the ‘self-guided’ pace and the opportunity to log in and out of the system to complete modules at your schedule.</p>



<p>Subscribing to the OSHA Training blog gives the user an updated schedule for trainings and reminders of refresher courses needed to keep certification current.</p>



<p>Thin Air Web has continued to refine and update the training platform, allowing Curtis to change his videos as regulations change.</p>

<p><strong>When you contacted Thin Air, you were initially skeptical about using a virtual company and preferred an in-person company. How did you overcome your initial hesitation and choose Thin Air to take over the design and programming of your website?&nbsp;</strong></p>



<p>We were mostly skeptical about a virtual company by making the assumption that if they weren’t someone we could physically sit down with and talk to, that they would be more inclined to put us on ‘the back burner’ so to speak and not fully understand what were looking for. So, the communication and support we would receive was a high expectation alongside great work. We originally met with Marc who was able to answer all our questions about what Thin Air could provide for us, along with assuring they are here to support us when we needed.&nbsp;</p>



<p><strong>Look Buildings wanted a custom function built into its website &#8211; a true-color Selector that website users could ‘see’ the various combinations of your customized buildings. How was the process of working with Thin Air to get that functionality working on your website?&nbsp;</strong></p>



<p>The process started out quicker and smoother than I thought it would. It seemed like a difficult function to add, but Thin Air got right on it and completed it sooner than I thought it would take them. We understand matching colors was a little difficult, but they even shipped our physical color chart to their location for the designer to see the colors in person and make sure they could match it the best they could. It took a couple of attempts for us to all agree on the color matching, but Thin Air didn’t hesitate to keep working with us until we were pleased. They didn’t make us feel like we were a bother to make some slight changes which was really pleasing as this function was really important to us.&nbsp;</p>



<p><strong>How is working with Thin Air for ongoing availability and changes to your website? Are they responsive to your needs?&nbsp;</strong></p>



<p>Thin Air has proven to be as responsive as they promised us from the beginning. They have not disappointed us at all in regards to a great product, understanding what we want to achieve, providing opinions and options, and communicating promptly without any misunderstandings! All changes or updates they have done for us have been done very quickly.&nbsp;</p>



<p><strong>How do you value your website as part of the overall marketing plan for your business, and what recommendations do you have for a small business looking for a website partner for their needs?</strong>&nbsp;</p>



<p>As a small business our website is very crucial for us to help our customers fully understand our business and visualize our product. This has been a starting point between some of our customers and us to help them find what they’re looking for. Thin Air has helped improve our website’s professional look, content that improves our SEO, and added a great function that improves our customers confidence in their final look of the product. For a small business, I&nbsp;believe your website is more important than trying to create local ads. Consumers of all generations are using the web more and more, and will search for your company directly or use the search engine to find companies like yours to choose from. Your website has become your image, and Thin Air is great to work with as they give you their full attention to what you want to represent on your site for your image, and give helpful feedback or opinions to create it. Plus, they do it in a very timely fashion!&nbsp;</p>
