He argues that trial court failed to properly adhere to the two-step consideration for probation revocation and, as a result, abused its discretion in revoking his probation. Upon review, we conclude that the trial court did not abuse its discretion in revoking the Defendant’s probation and that the record, considered as a whole, supports full revocation as the appropriate consequence. Accordingly, we affirm the judgment of the trial court.&lt;/p&gt;&lt;/div&gt;

            &lt;div class="field field--name-field-opinions-case-brief field--type-text-with-summary field--label-hidden field--item"&gt;&lt;p&gt;Husband and Wife both sought a divorce, with each attributing fault to the other. During the divorce process, Wife alleged to the police, the Department of Children’s Services, and Husband’s military employer that Husband had abused her and their child. Husband denied the allegations and responded with a petition to hold Wife in criminal contempt for making false allegations of abuse. The contempt petition and the military investigation into Wife’s claims remained open at the time of Wife’s deposition. Wife refused, allegedly based on these open matters, to answer questions at her deposition, pleading the Fifth Amendment. The deposition was relocated to the courthouse, where the trial court held an impromptu hearing on the matter. During the hearing, the judge informed Wife that her refusal to answer questions could result in her being held in civil contempt. However, instead of holding Wife in civil contempt, with no warning, the trial court struck Wife’s pleadings and entered a default judgment. Addressing Husband’s pleadings and testimony thereupon, the trial court thereafter entered a final order dividing the parties’ property and fashioning a parenting plan. Wife appealed, arguing, among other things, that the sanctions of striking her pleadings and issuing a default judgment were improper. Because we conclude that Wife had insufficient notice, we vacate the trial court’s sanctions order and remand the case.&lt;/p&gt;&lt;/div&gt;

I agree that the trial court failed to make sufficient findings on the record regarding the grounds on which it found that the Defendant violated the terms of his probation. However, I disagree that a de novo review of the record supports a conclusion that the Defendant committed a technical violation rather than absconding. I will endeavor to briefly explain my reasoning.&lt;/p&gt;&lt;/div&gt;

On appeal, the Defendant contends that the trial court abused its discretion by revoking his probation and ordering him to serve the remainder of his sentence in confinement. We reverse the judgment of the trial court and remand this case for the trial court to reinstate the Defendant to probation.&lt;/p&gt;&lt;/div&gt;

On appeal, he presents three issues for our review: (1) whether the evidence was&lt;br&gt;insufficient to support the Defendant’s convictions for failure to establish identity; (2)&lt;br&gt;whether the State committed a Brady violation when it failed to disclose, prior to the close&lt;br&gt;of the State’s proof, the circumstances surrounding a victim’s identification of the&lt;br&gt;Defendant; and (3) whether trial counsel provided ineffective assistance by (i) failing to&lt;br&gt;take appropriate action when this issue came to light at trial, and (ii) failing to adequately&lt;br&gt;challenge testimony that the Defendant had concealed a long rifle inside his pants. After&lt;br&gt;review, we affirm the judgments of the trial court.&lt;/p&gt;&lt;/div&gt;

Code Ann. § 39-17-1307(b)(1) (Supp. 2022). Pursuant to the plea agreement, the Defendant was to be sentenced as a Range I, standard offender to eight years in confinement. However, the State conditioned this agreement on the Defendant’s appearance at a later court date and his good behavior up to this court date; the State also informed the Defendant that his failure to fulfill these conditions would subject him to a sentencing hearing and the imposition of a sentence in his required sentencing range. When the Defendant failed to appear at this later hearing, the trial court conducted a full sentencing hearing, ultimately sentencing the Defendant as a Range II, multiple offender to twelve years in confinement for his conviction offense. On appeal, the Defendant argues the trial court abused its discretion in denying his request for an alternative sentence, specifically a sentence through the community corrections program. After review, we affirm the judgment of the trial court.&lt;/p&gt;&lt;/div&gt;

            &lt;div class="field field--name-field-opinions-case-brief field--type-text-with-summary field--label-hidden field--item"&gt;&lt;p&gt;The plaintiff, in his capacity as the executor of the decedent’s estate, commenced this action for breach of a stock purchase agreement against the decedent’s former business partner and the business that they owned together. The agreement comprised two documents: one requiring an initial lump-sum payment of $1 million, and one requiring payment of “$8,000.00 per month for 96 months and two new automobiles with lease payments or purchase payments not to exceed $1,500.00 per month for 96 months.” The decedent also signed a handwritten note in which he agreed to forgive “all debts” if the former business partner honored “all agreements for 1 (one) year after [the decedent’s] death.” The plaintiff later moved for summary judgment based on evidence that the defendants made only 17 monthly cash payments and only 114 of the vehicle payments. In response, the defendants asserted that they made a lump sum payment of $40,000 “in full satisfaction of the debt” before the decedent’s death. The defendants also argued that the debt was forgiven pursuant to the handwritten note. Regardless, the defendants maintained that there was no evidence of missed payments. The trial court granted the motion in part, finding it undisputed that the defendants made only 17 payments. The court also found that the plaintiff was entitled to an award of his attorney’s fees and costs under a “Hold Harmless and Indemnity” clause in the purchase agreement. But the court found a dispute of material fact on whether the defendants breached their obligation to make all car payments. At trial, the defendants moved for a directed verdict due to the plaintiff’s alleged failure to prove damages. The trial court granted the motion because there was no evidence that the defendants missed any car payments. This appeal followed. We affirm the judgment in all respects except for the award of attorney’s fees, which was based on an incorrect interpretation of the contract.&lt;/p&gt;&lt;/div&gt;

The trial court determined that the plaintiffs had proven all of their claims and awarded compensatory and punitive damages against both the business and its owner. On appeal, we conclude that the trial court failed to apply the proper test for piercing the corporate veil and failed to provide sufficient clarity in its damages award. We, therefore, remand the matter to the trial court for the entry of an order consistent with this opinion.&lt;/span&gt;&lt;/p&gt;&lt;/div&gt;

The dispute involves the alleged breach by Houston County of a Letter of Intent pertaining to the purchase of a hospital in Erin, Tennessee. On remand, the trial court ruled in favor of the plaintiff, Acute Care Holdings, LLC (“Acute Care”), by granting its motion for partial summary judgment on the basis that Houston County breached the Letter of Intent. Thereafter, the trial court entered an Agreed Final Judgment awarding Acute Care a judgment of $1,218,062.63 and prejudgment interest of $730,036.65. This appeal followed. Finding no error, we affirm.&lt;/p&gt;&lt;/div&gt;

After one appeal of the dependency and neglect case, the appellant and DCS entered into an agreed order to resolve the matter. According to the appellant, he did not stipulate in the agreed order that he engaged in the alleged misconduct. In a related criminal case, the appellant was indicted by a grand jury and ultimately entered a no contest plea. He did not admit guilt, no conviction was entered, and all charges will be dismissed and expunged if he completes his probation. The Tennessee Department of Health (“DOH” or “the Department”) informed the appellant that it had opened a case against him before the Board of Physician Assistants regarding his fitness to practice “due to the allegations in the [dependency and neglect] matter.” The Department sought certain records from the juvenile court case, and the appellant opposed it. The trial court granted the Department’s motion, and the appellant appealed. We affirm.&lt;/span&gt;&lt;/p&gt;&lt;/div&gt;

Defendant submitted&lt;br&gt;to the violations, and the trial court held a hearing to determine the consequence of his&lt;br&gt;violations. The trial court fully revoked Defendant’s probation and ordered Defendant to&lt;br&gt;serve his sentences. Defendant appeals. Having reviewed the record and the briefs of the&lt;br&gt;parties, we affirm the trial court’s judgments.&lt;/p&gt;&lt;/div&gt;

            &lt;div class="field field--name-field-opinions-case-brief field--type-text-with-summary field--label-hidden field--item"&gt;&lt;p&gt;Following the denial of his motion to suppress, the Defendant was convicted by a Sequatchie County Jury of driving under the influence (DUI), first offense, a Class A misdemeanor. &lt;u&gt;See&lt;/u&gt; Tenn. Code. Ann. § 55-10-401. He received a sentence of eleven months and twenty-nine days of supervised probation after service of twenty days in jail on weekends. In this appeal, the Defendant argues the trial court erred in overruling his motion to suppress and admitting evidence obtained from an unlawful detention. The Defendant contends his arrest was without reasonable suspicion of criminal activity and unsupported by probable cause in violation of the Fourth and Fourteenth Amendments to the United States Constitution and Article I, Section 7 of the Tennessee Constitution. Because the subsequent detention of the Defendant exceeded the duration of a &lt;u&gt;Terry&lt;/u&gt;-type investigatory stop in violation of the Fourth Amendment, we conclude that any evidence seized as a result should have been suppressed as “fruit of the poisonous tree.” &lt;u&gt;Wong Sun v. United States&lt;/u&gt;, 371 U.S. 471 (1963). Accordingly, we reverse the judgment of the trial court, vacate the Defendant’s conviction, and dismiss the charge in this case.&lt;/p&gt;&lt;/div&gt;

Signal Pump, LLC (“Signal”), a company that builds LED light towers, contracted with Arrow Electronics, Inc. (“Arrow”), a major supplier of electronics components, for Arrow to become Signal’s exclusive supplier. The relationship broke down as Arrow failed to timely supply Signal with parts and Signal failed to pay Arrow. Signal sued Arrow in the Chancery Court for Hamilton County (“the Trial Court”) alleging, among other things, breach of contract and fraud. New York substantive law governed this lawsuit as provided for by the parties’ agreement. Arrow filed a counterclaim against Signal for breach of contract based on Signal’s alleged failure to fully compensate Arrow for its products and services. According to Signal, Arrow’s failure to timely supply parts per the agreement cost Signal massive losses in profits it otherwise would have earned. Arrow, in turn, has asserted throughout that Signal continually changed its requests for parts. After a bench trial, the Trial Court found that both parties breached the agreement. The Trial Court awarded Arrow damages for Signal’s failure to pay. However, the Trial Court declined to award Signal any damages for lost profits, citing a liability limitation clause in the parties’ agreement. Signal appeals. We hold that the liability limitation clause is an exculpatory clause. We modify the Trial Court’s judgment in that respect. Otherwise, we affirm.&lt;/p&gt;&lt;/div&gt;

The DUI convictions merged, and the Defendant received an effective sentence of two years and one day. On appeal, the Defendant claims that the evidence is insufficient to support her DUI convictions. We affirm the judgments of the trial court.&lt;/p&gt;&lt;/div&gt;

            &lt;div class="field field--name-field-opinions-case-brief field--type-text-with-summary field--label-hidden field--item"&gt;&lt;p&gt;For events in 1994, a Shelby County jury convicted the Petitioner, Tony Von Carruthers, of three counts of first degree murder, three counts of especially aggravated kidnapping, and one count of especially aggravated robbery. The Petitioner unsuccessfully appealed his convictions, as well as filed for post-conviction relief, Federal habeas corpus relief, and motions to reopen. As relevant here, in 2021, the Petitioner filed a petition pursuant to the Post-Conviction Fingerprint Analysis Act of 2021. He sought fingerprint analysis comparison of prints taken from the home of two of the murder victims and known latent prints of Ronnie Irving, a man implicated in these murders by co-defendant James Montgomery in 2010. The post-conviction court summarily dismissed the petition after concluding that the Petitioner was not entitled to mandatory or discretionary testing. On appeal, the Petitioner contends that the post-conviction court erred when it denied his petition. After review, we affirm the post-conviction court’s judgment.&lt;/p&gt;&lt;/div&gt;

Several days later, the trial court entered a Military Retired Pay Division Order. Husband’s notice of appeal was filed more than thirty days after the former order, but within thirty days of the latter order. Because we determine that the time for filing an appeal from the order denying Husband’s motion was not affected by the entry of the Military Retired Pay Division Order, we conclude that Husband’s appeal was untimely. Without a timely filed notice of appeal, this Court lacks jurisdiction, and the appeal is dismissed.&lt;/p&gt;&lt;/div&gt;

On appeal, the Defendant claims that (1) potential jurors were exposed to prejudicial extraneous information regarding his custodial status, (2) the State committed prosecutorial misconduct during its cross-examination of a defense witness, (3) the trial court improperly limited defense counsel’s impeachment of the State’s confidential informant; and (4) the verdicts are against the weight of the evidence. Based upon the oral arguments and our review of the record and the parties’ briefs, we affirm the judgments of the trial court.&lt;/p&gt;&lt;/div&gt;

The trial court&lt;br&gt;sentenced the Defendant, a Range II offender, to a total effective sentence of twenty years,&lt;br&gt;to be served at 100%. On appeal, the Defendant contends that: (1) the trial court erred&lt;br&gt;when it admitted a video showing that he possessed a firearm on a day different from the&lt;br&gt;day upon which the indicted offenses occurred; (2) his trial counsel was ineffective for&lt;br&gt;failing to object to the admissibility of the video; and (3) the evidence is insufficient to&lt;br&gt;support his convictions related to his possession of a firearm. After review, we affirm the&lt;br&gt;trial court’s judgments.&lt;/p&gt;&lt;/div&gt;

            &lt;div class="field field--name-field-opinions-case-brief field--type-text-with-summary field--label-hidden field--item"&gt;&lt;p&gt;The Defendant, Tyrome Cameron Ferguson, was charged by a Monroe County grand jury&lt;br&gt;with two counts of aggravated assault and one count of reckless endangerment with a&lt;br&gt;deadly weapon relating to an alleged road-rage incident. On the first day of the Defendant’s&lt;br&gt;trial, the trial court found that the State had violated Tennessee Rule of Criminal Procedure&lt;br&gt;16 and declared a mistrial. In a subsequent hearing, the trial court ordered the State to pay&lt;br&gt;defense counsel $500 “as a contribution toward his attorney[’s] fees” as a sanction for its&lt;br&gt;discovery violation. The Defendant’s charges were ultimately dismissed by agreement.&lt;br&gt;The State thereafter filed both an application for extraordinary appeal pursuant to&lt;br&gt;Tennessee Rule of Appellate Procedure 10 and a petition for common law writ of certiorari&lt;br&gt;challenging the trial court’s assessment of $500. We denied the State’s application for an&lt;br&gt;extraordinary appeal but granted its petition for writ of certiorari. State v. Ferguson, No.&lt;br&gt;E2025-00044-CCA-WR-CO (Tenn. Crim. App. Apr. 1, 2025) (Order). Finding that the&lt;br&gt;trial court’s order violated the State of Tennessee’s sovereign immunity from suit, we grant&lt;br&gt;certiorari and reverse and vacate the trial court’s order.&lt;/p&gt;&lt;/div&gt;

            &lt;div class="field field--name-field-opinions-case-brief field--type-text-with-summary field--label-hidden field--item"&gt;&lt;p&gt;In this grandparent visitation action, the grandparents filed a contempt petition, alleging that the child’s father had violated provisions of a previously entered visitation order. At the conclusion of the hearing, the trial court rendered an oral ruling and found the father in contempt. Before the trial court’s entry of a written order regarding contempt, however, the father filed a motion seeking the trial court judge’s recusal. The trial court entered orders adjudicating the contempt charges and the father’s bond before entering a written order adjudicating the recusal issue. The trial court then entered orders awarding attorney’s fees to the grandparents. The father has appealed. Upon review, we determine that the trial court erred by entering further orders before entering an order adjudicating the recusal motion. We therefore vacate the trial court’s August 2023 bond orders and the August 2023 order regarding the second contempt petition, which were entered while the motion to recuse was pending. We reverse the trial court’s orders awarding attorney’s fees to the grandparents. We remand this matter to the trial court for further proceedings consistent with this Opinion.&lt;/p&gt;&lt;/div&gt;

Schuchardt was licensed to practice law in Tennessee in 2008. Beginning in 2019, several individuals reported Mr. Schuchardt to the Board of Professional Responsibility. These complaints detailed conduct that implicated the following rules of professional conduct (“RPC”): RPC 1.1 (Competence), 1.3 (Diligence), 1.4(a)–(b) (Communication), 1.5(b) (Fees), 1.7(a)(1) (Conflict of Interest), 1.16(d) (Declining or Terminating Representation), 3.2 (Expediting Litigation), 3.3(a)(1) (Candor Toward the Tribunal), 3.4(c) (Fairness to Opposing Party and Counsel), 4.2 (Communication with a Person Represented by Counsel), 4.4(a)(1) (Respect for the Rights of Third Persons), 8.1(a) (Bar Admission and Disciplinary Matters), 8.2(a)(2) (Judicial and Legal Officials), 8.4(c) (Misconduct-Dishonesty/Fraud/Deceit/Misrepresentation), and 8.4(d) (Misconduct-Administration of Justice). A Hearing Panel of the Board of Professional Responsibility found that Mr. Schuchardt violated these RPCs on forty-seven occasions and recommended disbarment. The Knox County Chancery Court affirmed. Mr. Schuchardt now asks us to reverse. Because ample evidence supports the decisions below, we affirm Mr. Schuchardt’s disbarment.&lt;/p&gt;&lt;/div&gt;

The Petitioner appealed, and this court affirmed the trial court’s judgments. &lt;em&gt;State v. Coy J. Cotham, Jr.&lt;/em&gt;, M2012-01150-CCA-R3-CD, 2014 WL 3778613, at *1 (Tenn. Crim. App. July 31, 2014). Subsequently, the Petitioner filed a petition for post-conviction relief pursuant to the Post-Conviction DNA Analysis Act, which the post-conviction court summarily dismissed. On appeal, the Petitioner maintains that he is entitled to DNA testing of a blue towel recovered from his vehicle. Following our review of the record, we affirm the post-conviction court’s denial of relief.&lt;/p&gt;&lt;/div&gt;

On July 17, 2025, the Petitioner filed multiple post-conviction motions, including a “post-conviction relief packet,” which was related to her DUI offense, and also to a separate offense to which she had previously pleaded guilty, been given probation, and her ensuing probation violation convictions. The post-conviction court entered an order stating that the petition was not signed under oath subject to penalty of perjury and gave the Petitioner fifteen days to file an amended petition, and it denied all her other motions. The Petitioner filed a motion stating that her petition was, in fact, properly verified and indicating her refusal to file an amended petition. The post-conviction court summarily dismissed the petition. After review, we affirm the post-conviction court’s judgment.&lt;/p&gt;&lt;/div&gt;

In 2015, through a series of electronic communications sent from Kentucky, Lacy persuaded the owner of a car dealership in Tennessee to wire him funds for a Mercedes. But Lacy never delivered the Mercedes or returned the funds. In this appeal, we consider whether a Tennessee court had statutory territorial jurisdiction to convict Lacy of theft for that conduct. We conclude that it did. We further conclude that Lacy’s theft conviction was supported by sufficient evidence. We therefore uphold Lacy’s conviction and affirm the judgment of the Court of Criminal Appeals&lt;/p&gt;&lt;/div&gt;

At one point, the defendant agreed to make a&lt;br&gt;$50,000 loan to the plaintiff so that the trading could continue. The agreement was&lt;br&gt;evidenced by a promissory note in which the plaintiff agreed to repay the loan and to share&lt;br&gt;any losses incurred. The loan was secured by a deed of trust executed on the plaintiff’s&lt;br&gt;residence. Subsequently, the parties lost approximately $210,342. The plaintiff then filed&lt;br&gt;a declaratory judgment action in which he claimed that the deed of trust was void because&lt;br&gt;the loan funds had never been disbursed. The defendant filed an answer and counterclaim&lt;br&gt;alleging that the plaintiff owed him the balance of the loan plus interest. He also sought&lt;br&gt;reimbursement for a portion of the losses that the parties had incurred. The chancery court&lt;br&gt;determined that the defendant had never disbursed the loan funds. Accordingly, it held that&lt;br&gt;the deed of trust and the portion of the promissory note which required repayment of the&lt;br&gt;loan balance were void due to a lack of consideration. However, the chancery court also&lt;br&gt;held that the portion of the promissory note in which the plaintiff agreed to share losses&lt;br&gt;was effective and left the defendant entitled to damages. The plaintiff appeals. We affirm.&lt;/p&gt;&lt;/div&gt;

On appeal, the Defendant asserts that: (1) the trial court erred when it found the victim competent to testify; (2) the trial court erred when it allowed the victim’s mother to be present during the victim’s testimony; (3) the trial court erred in admitting the victim’s forensic interview; (4) the victim failed to identify the Defendant at trial; and (5) the cumulative effect of these errors undermined the Defendant’s right to a fair trial. After review, we affirm the trial court’s judgments.&lt;/p&gt;&lt;/div&gt;

On&lt;br&gt;appeal, the Defendant asserts that the trial court erred when it: (1) admitted three of his&lt;br&gt;prior convictions for impeachment purposes; and (2) imposed the fine set by the jury&lt;br&gt;without making the statutorily required findings. After review, we affirm the trial court’s&lt;br&gt;judgment but vacate the imposition of the fine. We remand the case for a sentencing&lt;br&gt;hearing with respect to the imposition of the fine.&lt;/p&gt;&lt;/div&gt;

            &lt;div class="field field--name-field-opinions-case-brief field--type-text-with-summary field--label-hidden field--item"&gt;&lt;p&gt;The defendant, Timothy Sedman, pled guilty to attempted aggravated sexual battery, and&lt;br&gt;the trial court imposed a sentence of six years’ incarceration in the Tennessee Department&lt;br&gt;of Correction. On appeal, the defendant argues the trial court erred in denying his request&lt;br&gt;for alternative sentencing. After reviewing the record and considering the applicable law,&lt;br&gt;we affirm the judgment of the trial court. However, we remand the case for corrected&lt;br&gt;judgment forms in counts one through five and counts seven through twenty.&lt;/p&gt;&lt;/div&gt;

            &lt;div class="field field--name-field-opinions-case-brief field--type-text-with-summary field--label-hidden field--item"&gt;&lt;p&gt;The Petitioner, Cedric Taylor, entered a guilty plea to possession with intent to deliver twenty-six grams or more of cocaine and resisting arrest, for which he received an effective sentence of fourteen years in confinement. The Petitioner sought post-conviction relief claiming ineffective assistance of counsel based on trial counsel’s failure to pursue a motion to suppress to challenge the constitutionality of the stop and subsequent search of his vehicle, and trial counsel’s failure to appeal his sentence. The Petitioner also claimed that his guilty plea was unknowingly and involuntarily entered due to trial counsel’s misleading advice that he would likely be sentenced to probation. Following a hearing, the post-conviction court granted relief, in part, and ordered a delayed appeal based on trial counsel’s failure to appeal the Petitioner’s sentence. This court subsequently affirmed the trial court’s denial of the Petitioner’s request to serve his sentence on community corrections. &lt;u&gt;See&lt;/u&gt; &lt;u&gt;State v. Taylor&lt;/u&gt;, No. M2024-00192-CCA-R3-CD, 2024 WL 3879116, at *1 (Tenn. Crim. App. Aug. 20, 2024), &lt;u&gt;appeal denied&lt;/u&gt; (Tenn. Nov. 14, 2024). The post-conviction court entered an order denying the issues that were held in abeyance, and the Petitioner now appeals. Upon review, we affirm the judgment of the post-conviction court&lt;/p&gt;&lt;/div&gt;

            &lt;div class="field field--name-field-opinions-case-brief field--type-text-with-summary field--label-hidden field--item"&gt;&lt;p&gt;In this post-divorce action, the trial court conducted a two-day hearing regarding the mother’s petition to modify the parties’ permanent parenting plan. At the conclusion of the hearing, the father moved for involuntary dismissal pursuant to Tennessee Rule of Civil Procedure 41. The trial court granted the motion, determining that modification of the parenting plan was not warranted because the mother had not met her burden to prove that there had been a material change of circumstance affecting the minor child’s well-being. The trial court accordingly dismissed the mother’s petition with prejudice and awarded the father his reasonable attorney’s fees pursuant to Tennessee Code Annotated § 36-5-103(c). Discerning no reversible error, we affirm. We further determine that Father is entitled to his reasonable attorney’s fees on appeal.&lt;/p&gt;&lt;/div&gt;
