type="text">拍攝內容</title><content type="html">&lt;blockquote&gt;Lan的家裡很窮，她的媽媽也是海外移工，五年前Lan跟母親說，她已經長大了，應該由她來代替母親到海外工作。於是她來到台灣，先在桃園工廠工作；第二次來台申請到飛盟國際；在這裡遇見驚為天人的Pilar。&lt;br /&gt;&lt;br /&gt;Pilar美艷性感，十足的婆。她們在工廠宿舍共築愛巢，毫不掩飾親密的關係。飛盟關廠之後，Pilar被轉換到高雄去，Lan被轉到林口，兩人硬是被拆散；臨別之際，Pilar異常冷靜，Lan則變成哭哭啼啼的Ｔ。她們現在利用放假日在台中約會。&lt;br /&gt;&lt;br /&gt;&lt;p type="text">拍攝緣起</title><content type="html">2004年11月底，位於台北縣三重市的一家電腦零件工廠（飛盟國際股份有限公司）因為資方掏空資產，積欠員工三個月薪水，引發勞資爭議。當時該工廠共有勞工三百多名，其中123人為菲律賓籍的女性勞工，她們輾轉來到台灣國際勞工協會（TIWA）的辦公室尋求協助。做為一個勞工組織，我們當然義不容辭的進入協助，包括到勞委會陳情、與公司協商、到勞工局開會等等，最後幫她們爭取到工資墊償基金給付積欠的工資，以及外勞很難領到的勞基法所規定的資遣費；然後幾經波折，幫她們轉換了新雇主，讓她們大部分人繼續在台灣工作。&lt;br /&gt;&lt;br /&gt;&lt;span style="font-weight:bold;"&gt;然而在協助這些外勞抗爭的過程中，最最讓我們印象深刻且深深被吸引的是，她們有非常多的同志伴侶，成雙成對，溫馨甜蜜。&lt;/span&gt;&lt;br /&gt;&lt;br type="text">TIWA簡介/ TIWA Introduction</title><content type="html">台灣國際勞工協會成立之宗旨，以增進外籍勞工與本地社群之交流、改善外籍勞工勞動環境與社會處境、增進勞工權益福祉為宗旨。自1989年台灣開放引進外勞已經十四年了，不論是在廠區或是在假日街頭，外籍勞工進入了台灣社會，創造了台灣人從未有過的勞動經驗及社會接觸，他們已成為台灣社會不可迴避的族群。&lt;br /&gt;&lt;br /&gt;The principle of TIWA is to promote the interactions between migrant and local worker, to improve the working condition and social environment for the migrant worker and to increase the rights and benefits for the labor. It’s been 14 years since migrant workers started being imported in 1989. Migrant workers are everywhere in Taiwan who creates the labor experiences and social network, which Taiwanese had never had before.&lt;br /&gt;&lt;span class="fullpost"&gt;&lt;br /&gt;但是，台灣社會制度始終以控制的思維在對待這一群外籍勞工，外籍勞工在勞動條件上墊底，在廉價勞動力的利益之下，外籍勞工成為台灣失業的代罪羔羊，在社會對待上也遭污名化與邊緣化，以經濟發展為主軸的台灣社會意識，並沒有公平地對待這一些來自東南亞經濟弱勢的勞動者。另一群以婚姻形式留在台灣的外籍勞工，就是外籍新娘，因為異國文化、婚姻與家庭角色的期待，她們面臨到更艱困的處境。&lt;br /&gt;&lt;br /&gt;Nonetheless the Taiwan Government Administrated policy had always deal with the migrant workers in the way of dominating them by the system of Taiwan society. As the cheap labor in Taiwan, migrant workers face the worst working condition, become the “scapegoat ” for the raising unemployment rate, and has been marginalized and demonized. Migrant workers in Taiwan have never been fairly treated by the Taiwan society under the thinking of economy development. There are “foreign brides” who work in Taiwan as the migrant workers also. Besides the culture difference, the international marriage brought them to the more difficult situation in the society.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;台灣國際勞工協會（Taiwan International Workers’Association）成立於民國88年10月30日，是為全國第一個以外籍勞動者為服務對象的本地民間組織，關懷對象遍及外籍勞工與外籍新娘。協會組成成員來自勞工團體、組織工作者以及工會幹部，除了發展本地勞動者與外籍勞工的勞動經驗交流之外，也積極倡議外籍勞工權益，發展外籍勞工自治組織，近年來分別協助台灣印尼外勞協會（TIMWA）與菲律賓勞工協會（KASAPI）成立；同時有鑒於台灣社會充斥的種族隔閡意識形態，積極辦理文化活動，成立外勞樂團，轉化台灣社會對於外籍勞動者的認識，進而實踐尊重包容、公平的社會公義。&lt;br /&gt;&lt;br /&gt;TIWA（Taiwan International Workers’Association） established in October 30, 1999 is the first local NGO in Taiwan which work for the migrant labor with concern for not only the migrant workers but the foreign brides as well. The members of TIWA are labor union members and organizers. TIWA promotes the inter-communication between the local and migrant workers, migrants’ rights and empower the migrants to organize their own independent organization, such as TIMWA for the Indonesian workers and KASAPI for the Filipino workers. Fighting against the ethnic-separation ideology, TIWA promote the migrant culture on the other hand, by helping the migrants create cultural activities such as migrant band etc. in order to transform the typical impression of Taiwan society of the migrant workers. /&gt;與會的菲勞瑪莉安描述，她與同行外勞被送到一家鍋爐廠時，四人整晚都不能入睡，只有不停的哭泣。 &lt;br /&gt;&lt;br /&gt;台灣國際勞工協會秘書長顧玉玲說，不少女外勞因不符新工作要求，被雇主遣返，空出配額來聘僱新男工。她要求政府確保外勞轉職資訊透明，讓外勞有選擇、拒絕的權利。 &lt;br /&gt;&lt;br /&gt;上百名受僱於飛盟電子廠的外籍勞工及本地勞工今天在勞委會大門前，頭上綁著抗議、No Wage、No Food等頭帶，要求勞委會出面協調長達三個月的積欠工資爭議案，協助勞工追討積欠工資及資遣費。&lt;br /&gt;&lt;span class="fullpost"&gt;&lt;br /&gt;經過勞委會、飛盟董事長鄭智元與勞工協商後，資方同意在十二月三十一日終止勞資關係，並於明年一月三日申請歇業。&lt;br /&gt;&lt;br /&gt;勞委會表示，將請台北縣政府協助進行歇業認定，再由勞工保險局、中信局協助辦理積欠工資墊償，及勞工退休準備金支應資遣費事宜。&lt;br /&gt;&lt;br /&gt;112位原在電子工廠裝配IC片的菲籍女外勞，今天在外勞救援團體的安排下，出面指控台灣仲介公司鑽法律漏洞，故意將她們安排到不適任的工廠後，藉故以「不適任」的理由將其遣送回國，以搶得另一新的外勞配額來賺取仲介費。外勞指控「整個轉介過程如同人肉市場的買與賣，以喊號碼的抽籤方式，逼迫外勞完全沒有選擇的權利」。&lt;br /&gt;&lt;span class="fullpost"&gt;&lt;br /&gt;台灣國際勞工協會上午安排這112位菲籍女外勞出面申訴，指控仲介公司是如何惡意轉介。女外勞Yam(化名)表示，她們原本工作的電子工廠倒閉，大家拿不到遣散費和工資，好不容易向勞委會爭取轉換工廠的機會，沒想到竟遭仲介故意將這批瘦弱的女外勞轉介到不適任的工廠，然後以「不適任」之由，強迫將她們遣返回國。&lt;br /&gt; &lt;br /&gt;Yam說，上禮拜勞委會安排她們在三重就業服務中心等待轉介。在現場沒有任何翻譯，也不知道將被換到哪些性質的工廠，當天每個人都被編上1個標籤號碼，由工作人員喊「某某工廠需要幾個名額」的方式，採抽籤來分派，整個過程如同人肉市場的買賣方式一樣，仲介拒絕告知將往何處去，就任由廠商把人帶走。&lt;br /&gt; &lt;br /&gt;可是萬萬沒想到，Yam說，她們有人被送到鋼鐵廠，有人被送到鍋爐廠、水泥拌鑄廠，新老闆一看見她們訝異大喊「怎麼會是女生？」結果第2天就被仲介強押到機場遣返。 &lt;br /&gt;&lt;br /&gt;台灣國際勞工協會指出，仲介公司分明在鑽法律漏洞，利用一般小型工廠搶不到外勞配額的需求，不管男或女、國籍以及是否適任等因素，以「先搶、先有」的方式來搶配額，然後藉故將「不適任者」立即遣返，讓雇主可以多1個配額，重新申請引進，而仲介公司又多1個向新外勞收取仲介費的賺錢機會。&lt;br /&gt; &lt;br /&gt;修淑芬／台北報導 &lt;br /&gt;仲介公司為了搶外勞配額，無所不用其極。這批遭仲介「惡搞」的菲籍女工，被拒絕告知工作環境、地點、性質，等到她們將大包小包的行李打包好，抵達新工廠時，才發現鐵工廠裡頭只有她1個女生，雇主強迫她住進男工宿舍，否則馬上遣返走人，逼迫外勞沒有選擇說「No」的權利。 &lt;br /&gt;&lt;br /&gt;上周台灣國際勞工協會得知這批112位菲籍女外勞的處境後，馬上連夜趕到機場去「攔人」，與工廠、仲介斡旋、協商後，在簽署保證外勞不逃跑的切結書後，才得以將剩下的30位外勞帶回北部安置，但不少人的居留證、護照、行李都還被扣押在仲介公司。 &lt;br /&gt;&lt;br /&gt;&lt;span class="fullpost"&gt;&lt;br /&gt;勞委會指出，飛盟公司允諾提出積欠工資及資遣費清冊，讓勞工確認，並盡力籌措不足之資遣費，該公司同意於12月底終止勞資關係，明年1月3日申請歇業，該公司也同意自救會查職福會的帳，而且，公司需限期繳清積欠工資墊償費及勞保費。&lt;br /&gt;&lt;br /&gt;飛盟公司員工紛紛表示，自今年10月份起，資方藉故不再給付員工工資，經台北縣勞工局協調多次無效，雇主始終推託，該公司已連續5年未發年終獎金，勞工總人數僅2百多人，其中外籍勞工佔125人，本、外勞比例高達1比1，政府竟持續核准違法雇主的外勞申請案。&lt;br /&gt;&lt;br /&gt;勞工不滿表示，眼見年關將至，有些外勞來台工作不到1、2個月，既領不到薪水，也無吃飯錢，經爭取後，外勞才獲得1天1百元飯錢。&lt;br /&gt;&lt;br /&gt;外勞也指出，雖然雇主可能關廠歇業，外勞得以轉換雇主，但未順利轉換雇主者皆得返國，不少外勞遭遣返回國後，事後未領得積欠工資，還得背負大筆仲介債務，他們希望在未領到欠薪之前，不得強制離境，否則勞委會應動用就業安定基金，支付外勞積欠工資，由國家代位求償，向資方持續追討。&lt;br /&gt;&lt;br /&gt;工委會、台灣國際勞工協會等勞工團體表示，飛盟國際公司成立17年，在台灣是備受稅負優惠保護的高科技電子產業，從事電腦主機板及介面卡等加工、製造、買賣，最盛時期在台擁有2500名員工，在2001年時，飛盟在中國斥資數億元設廠，聘僱數千名勞工，隨後在寧波、上海、北京設廠，但昨日出席勞委會協調會的董事長鄭智元仍向員工宣稱公司無錢可發薪，分明「錢進中國債留台灣」。&lt;br /&gt;&lt;br /&gt;勞委會勞資關係處表示，經溝通後，飛盟公司現況已符合「大量解僱勞工保護法」適用範圍，若雇主未依法與勞工協商，將請台北縣政府進行裁罰，北縣勞工局也將在明年元月5日召開正式調解會議，如果該公司符合「大量解僱勞工保護法」第12條禁止董事長及實際負責人出國規定時，在接獲台北縣政府提報資料後，勞委會將在3天內召開審查會議。&lt;br /&gt;&lt;br Furthermore, the pending revision also aims to improve better communication with foreign migrant workers, to enable them to have a better understanding of their new jobs," Meng-liang (蔡孟良), a section chief at the council's Department of Foreign Labor Affairs, said yesterday.&lt;br /&gt;&lt;br /&gt;The CLA is drafting an amendment to the Regulation Governing the Transfer of Foreign Migrant Workers To Employers (外勞轉換僱主作業規定), to allow for three public announcements to be made by foreign migrant workers seeking employment instead of the current two.&lt;br /&gt;&lt;br /&gt;The current regulation stipulates that should the employer of a foreign migrant worker die or emigrate, or the worker have been laid off, the worker may be able to switch employers through a local Vocational and Employment Center by putting up a public announcement.&lt;br /&gt;&lt;br /&gt;Upon seeing the announcement, prospective employers who are interested in hiring these workers may do so by attending public bids held by the center.&lt;br /&gt;&lt;br /&gt;A labor rights group pointed out, that despite the pending amendment, many foreign migrant workers will still face deportation after being transferred to new employers.&lt;br /&gt;&lt;br /&gt;Ku Yu-ling (顧玉玲), secretary-general of the Taiwan International Workers' Association (TIWA), explained that most employers would bid for laid off foreign migrant workers during the first round because they wanted to keep their hiring quota.&lt;br /&gt;&lt;br /&gt;"If an employer wins the bid for a particular worker, but is not pleased with this new employee of his, he just needs to deport the worker. Once that one is gone, the quota is freed up and he just needs to hire himself a new one," Ku said.&lt;br /&gt;&lt;br /&gt;During the bidding process, due to incomplete information and a lack of translation services, the foreign migrant workers usually know little about their prospective employers and the job descriptions of their new jobs.&lt;br /&gt;&lt;br /&gt;"Often a foreign migrant worker finds that the new job description is completely different from what was described by his manpower broker. Soon, he finds himself being deported," Ku said.&lt;br /&gt;&lt;br /&gt;Ku suggested that, given the current quota system for hiring foreign migrant workers, the CLA should allow for a change of employers without having through go through the bidding process.&lt;br /&gt;&lt;br /&gt;"If a Taiwanese worker is not pleased with his new employer, he may just to quit and look for another job. Due to the expiration of their Alien Residence Certificates (ARC), many are unable to stay in Taiwan long enough to have their disputes settled," said Wu Jing-ru (吳靜如), chairman of TIWA.&lt;br /&gt;&lt;br /&gt;Foreign workers demonstrate outside the Council of Labor Affairs yesterday, urging the council to amend labor laws so that foreign laborers can extend their stay in Taiwan in cases where there is a labor dispute.&lt;br /&gt;PHOTO: CHIANG YING-YING, TAIPEI TIMES&lt;br /&gt;According to Huang Hsiao-ling (黃小陵), general-secretary of the Taiwan Association for Victims of Occupational Injuries, it is common for foreign migrant workers who have suffered occupational injuries to be deported by their employer and manpower broker.&lt;br /&gt;&lt;br /&gt;"But some of these workers are sharp enough to sense that they are about to be deported, and they will try to escape," Huang said.&lt;br /&gt;&lt;table width="150" align="right"&gt;&lt;tr&gt;&lt;td&gt;&lt;b&gt;"Many foreign workers in labor disputes, or who have suffered occupational injuries, or have even been raped by their employers, are deported right away."&lt;br /&gt;&lt;br /&gt;Wu Jing-ru, chairman of the TIWA&lt;/b&gt;&lt;/td&gt;&lt;/tr&gt;&lt;/table&gt;&lt;br /&gt;In the past, lack of legal help was an obstacle.&lt;br /&gt;&lt;br /&gt;Before the establishment of the Legal Aid Foundation last July, most disputes involving foreign migrant workers were not resolved because they could not afford to hire a lawyer, Huang said.&lt;br /&gt;&lt;br /&gt;The foundation provides free legal assistance to low-income families and those who cannot afford to hire legal professionals.&lt;br /&gt;&lt;br /&gt;In response to the rights groups' protest, the CLA said ARC extensions can only occur under certain circumstances.&lt;br /&gt;&lt;br /&gt;"In cases that involve criminal litigation, such as sexual assaults where defendants need to testify in court, extensions are normally granted," said Tsai Meng-liang (蔡孟良), a section chief at the council's department of foreign labor affairs.&lt;br /&gt;&lt;br /&gt;Article 29 of the Immigration Law (入出國及移民法) states that aliens must apply for an extension before their residence visa expires if they need to remain in Taiwan.&lt;br /&gt;&lt;br /&gt;However, in civil cases, extensions are harder to get.&lt;br /&gt;&lt;br /&gt;Due to the time-consuming nature of civil lawsuits, the CLA advises foreign workers to appoint a trustee to represent them once they have left the country.&lt;br /&gt;&lt;br /&gt;Tsai also said that there are two types of paperwork deadlines that a foreign migrant worker needs to be aware of.&lt;br /&gt;&lt;br /&gt;"The first is the employment permit issued by the CLA, the other is the ARC, which is issued by a local police station. In a special circumstance where an ARC extension is needed, one just needs to go to the police station to make the request," Tsai said.&lt;br /&gt;&lt;br /&gt;An employment permit is issued to an employer; The title, emblazoned in extra large print, reads, “Filipina Servants' Blackmail Scam: They Target the Famous.” The article claims that Filipina domestic workers use the strategy of falsely accusing their male employers of rape or sexual harassment in order to change employers and to get money. We strongly protest this kind of sexist and racist representation!&lt;br /&gt;&lt;br /&gt;The entire article cites no concrete evidence for its claims, it simply uses inflammatory headlines in order to demonize Filipina household workers as blackmailers” (literally, “disappearing fairies,” ie, women who trick men into having affairs with them in order to blackmail them). The article quotes such secondary sources as the “speculations” of an employee of the Taipei Labor Bureau, and a Taipei City legislator who relies on a “rumor”he heard from a broker. The writer urgently warns employers to be careful not to fall into the trap of Filipina servants accusing them of rape.  They represent Filipina victims of sexual assault as cunning criminals.  This kind of discourse is both sexist and racist. Not only is it alarmist and sensationalist, it reinforces negative social stereotypes and biases. This is a truly regressive direction for the mainstream media to take.&lt;br /&gt;&lt;br /&gt;The article has foreign domestic workers' sexual harassment and rape cases as its topic.  But it never discusses any specific cases, nor does it investigate any of the structural factors behind these cases.  It only demonizes a minority community that is already discriminated against. When foreign women household workers are raped, not only is it almost impossible for them to find anyone to help them, they face the possibility of being illegally deported by their employers as a way to avoid the courts.  When foreign household workers are sexually harassed by their employers or their family members, or by their brokers, even if they call the concerned government bureau, they will be told that unless they can provide concrete evidence, they cannot get any support. This article does not attempt to understand the situation of these vulnerable foreign workers.  The reporters did not ask any of the relevant government bureaus, in situations where there is not enough concrete evidence, how they decide that a sexual harassment or rape charge is “made up.” They did not ask, after so many “true” sexual harassment and rape cases, how is the government providing protection for victims? Rather, they blame the victims, and demonize the vulnerable Filipina domestic workers.  This kind of discriminatory discourse has no place in a mainstream publication such as the China Times Weekly. 原污染廠址整治、土地變更解套，張俊雄院長就下令撤消行政院 RCA 專案小組，經罹癌員工一再要求仍拒不回復對話窗口，貫徹張內閣「報喜不報憂」的政策，事關人命的難題，就撤消專案、充耳不聞，令千餘名受害員工求救無門。 &lt;br /&gt;&lt;span class="fullpost"&gt;&lt;br /&gt;美國家電第一品牌 RCA 在台灣設廠二十餘年，三氯乙烯、四氯乙烯等多重化學有機溶劑的不當處理，造成嚴重污染的土壤、永不復原的地下水，以及員工千餘人罹患肝癌、肺癌、大腸癌、胃癌、鼻咽癌、乳癌…等各式癌症和不明原因的腫癌。&lt;br /&gt;&lt;br /&gt;RCA 職業性癌症事件爆發以來，政府相關部門一直以研究、調查拖諉對罹癌員工的責任，面對工人的醫療、勞保給付、求償等問題，要工人自行到醫院取得職業病證明，而當 RCA 資方有意將資金撤離台灣，又只會催促工人快提起訴訟，進行假扣押，彷彿官方只是一個中間仲裁者，可以無視職災舉證需要龐大的流行病學追蹤調查，而上億元的假扣押費於罹病工人更不啻是天方夜譚！&lt;br /&gt;&lt;br /&gt;政府只是中立的調處單位嗎？八十七年，監察院曾針對 RCA 案正式發出 87 院台財自第 872200631 號糾正文，明白指出勞委會、衛生署、環保署等相關單位僅對土壤、地下水的污染進行調查整治，卻對員工、居民的罹病狀況置之不理，「確有失當」，且政府部門未有效協助罹病工人取得補償或救濟「顯有疏失」 ，要求相關部門「檢討改善」。&lt;br /&gt;&lt;br /&gt;事隔三年，從舊政府到新政府，罹病工人仍在獨自扛負醫療費用，死傷人數每個月都在增加。依勞委會六十四年六月起至八十年五月間針對 RCA 廠的八次勞動檢查記錄來看，RCA 工廠多次違反「有機溶劑中毒預防規則」、「勞工健康管理規則」和「勞工安全衛生設施規則」，監察院早已指出勞委會「每僅以函請改善處置，致影響該廠勞工日後健康，實未善盡政府保障勞工之責。」如果當年勞委會採取有效的行政措施，積極落實勞檢，督導 RCA 工廠進行改善，環保署也善盡督導事業廢棄物管理職責，制止 RCA 公司違法傾倒廢溶劑，那麼哪裡會有今日的 RCA 事件呢？主管機關未有效進行第一線的把關，任令不知情的工人日復一日與毒為伍，造成逾千名員工罹癌、病亡的慘劇，官方難道不是扮演 RCA 資方謀殺台灣工人的幫凶嗎？ &lt;br /&gt;&lt;br /&gt;在職業病因果證明的推斷上，監察院報告早已指出「三氯乙烯及四氯乙烯等有機溶劑，該等物質對人體雖無充份資料證據顯示有致癌性，但仍能產生毒性作用及慢性作用之傷害，或具致癌及產生其他病變之催化作用。」但勞委會卻一再以流行病學研究不足、本案事發久遠、現場無法重建、病歷取得困難等問題，遲遲無法為受害員工作出職業病鑑定。任令罹癌工人死亡人數已增至 216 人，相關職災給付、補償仍遙遙無期。&lt;br /&gt;&lt;br /&gt;至今，罹病工人仍面對職業病鑑定未果、生活照顧沒有著落、訴訟經費沈重、極需追縱健檢及醫療補助的多重困境，而 RCA 公司已於去年底向經濟部投番會正式申請減資，意圖以利潤轉移至國外股東的方式掏空台灣公司資金………，內憂外患夾殺，正是需要政府出面積極有效協助的時候，行政院卻在此時無故撤銷 RCA 跨部會專案小組，對於千餘名受害勞工而言，無異是雪上加霜。&lt;br /&gt;&lt;br /&gt;更進一步來看，RCA 來台設廠的時代背景是 70 年代外資大量湧進、以勞力密集的初級電子產業為主的經濟政策，輔以大批來自農村的廉價勤奮女工、不必付出環境勞安成本、懮惠免稅等利多條件。在此同時，也埋下了日後公害、職災不斷的隱憂。1972年，同樣是美商投資的飛歌電子淡水廠，出現了台灣第一宗大型集體職災，造成多名女工傷亡，導因就是三氯乙稀、四氯乙烯！飛歌事件揭露了台灣在勞動安全法令上的嚴重不足，乃致催生了後來的「勞工安全衛生法」。九ｏ年代以來，從塵肺症老礦工、潛水夫症捷運工人、到 RCA 罹癌員工等近幾年重大的集體職業病，放在職業病只佔了勞保給付不到百分之 0.75 的數據上來看，更暴露了現有職業病的預防、通報、認定、補償制度的千瘡百孔。&lt;br /&gt;&lt;br /&gt;行政院無故撤銷 RCA 專案小組，就好像是將死傷逾千人的 RCA 案結案上鎖，不僅受害員工後續的求償堪憂，更失掉了建立職業病相關體系的社會契機。 &lt;br type="text">勞委會假「錢流管理系統」之名 行合法化歧視之實</title><content type="html">&lt;span style="font-weight:bold;"&gt;CLA Use the Name of "Money-Flow management" to Legalize the Discrimination&lt;/span&gt;&lt;br /&gt;勞委會近日規劃對外勞的薪資進行「錢流管理」，試圖以控制外勞薪資取得和應用的管道，解決外勞薪資被積欠與仲介費超收的問題。然而，這個所謂的「錢流管理系統」是否能達到勞委會的目的呢？我們將就以下幾點進行探討。&lt;br /&gt;&lt;br /&gt;&lt;span class="fullpost"&gt;&lt;br /&gt;&lt;span style="font-weight:bold;"&gt;【積欠薪資問題】&lt;/span&gt;&lt;br /&gt;&lt;br /&gt;這樣的系統目的，確實凸顯了勞委會終於看到外勞被積欠薪資問題的嚴重性，但是，一點也解決不了外勞被積欠的薪資仍舊拿不回來的問題。以最近家喻戶曉的許純美積欠外勞薪資案為例，許純美明白表示，她確實扣著外勞的薪資不願意給付，而且勞工局也以此違法事實處分其六萬元的罰款。但是，外勞仍舊無法拿回她的血汗錢！就算主管機關將來透過該系統，明白地得知雇主未定時給付薪資，但是仍然無法對外勞提供相對的補償。外勞被積欠的薪資，唯有實施「雇主聘僱外勞保證金」制度，才能在雇主積欠薪資的狀況發生時，從保證金扣除作為外勞欠薪的補償。&lt;br /&gt;&lt;br /&gt;&lt;span style="font-weight:bold;"&gt;【仲介費超收問題】&lt;/span&gt;&lt;br /&gt;&lt;br /&gt;該系統中，將外勞的薪資規劃為「可支用儲金」及「不可支用儲金」兩部分。勞委會表示，「可支用儲金」將透過固定的帳戶設定，轉帳給付「仲介費、服務費、貸款及匯款」等「固定支出」；並將透過此固定支出的追蹤，監督仲介扣款問題云云。&lt;br /&gt;&lt;br /&gt;但是，就目前的仲介相關費用的規定，台灣仲介並不能向外勞收取「仲介費」；每個月所扣的（第一年1800、第二年1700、第三年1500）費用是「服務費」，也就是「有服務才能收費」。然該系統將「服務費」界定為「固定支出」之一，實推卸了查察大部分仲介沒有服務卻仍然收費的責任，而有圖利仲介的嫌疑。&lt;br /&gt;&lt;br /&gt;再者，「貸款」和「國外匯款」一直是仲介公司巧立名目變相收費的方式之一。許多不肖的仲介公司就算在「外國人來華工作費用及工資切結書」上登錄該外勞並無任何借貸（以符合輸出國政府驗證程序的查驗），卻仍以在外勞出國前強迫其簽下的「個人借貸單據」私自向外勞收取高額費用，雇主和外勞在不清楚相關規定下，仍然被要求以現金給付該款項。這種情況，屢見不鮮。而這是「錢流管理系統」的制式帳戶規定完全無法避免的。更進一步地，這樣的系統，將會使得更多不肖的仲介業者，將「私人借貸」、「國外匯款」等伎倆作為收取高額費用的主要手段，私自向外勞以現金給付的方式收費。外勞無法取得相關法規訊息而遭受的剝削，卻被勞委會一句「如果外勞要袒護仲介業者，勞委會也沒辦法」帶過，實是怠忽「政令宣導」職守的拖詞。&lt;br /&gt;&lt;br /&gt;&lt;span style="font-weight:bold;"&gt;【就業歧視與階級歧視】&lt;/span&gt;&lt;br /&gt;&lt;br /&gt;在銀行業高度興趣這塊被勞委會規劃出來，每年約720億元大餅的同時，勞委會實違反了「勞基法」與「就業服務法」中，不得扣取保證金及他人財物等相關規定，且有圖利銀行業者之嫌。在2001年因違反「國際人權公約」而廢止的「強迫儲蓄」條款，現在又要以「不可支用儲金」的名義再度復辟。更有甚者，「錢流管理系統」的設計將這樣的「強迫儲蓄」與來台工作機會掛勾（外勞申請入國簽證前，需與完全未知的銀行，簽訂扣款帳戶授權書，否則不給予入國簽證），是明白地以公權力進行就業歧視的作為！&lt;br /&gt;&lt;br /&gt;另外，這個僅對「外勞」設計的錢流管理系統中所指稱的外勞，即是「藍領階級」的外籍勞動者。勞委會先以「就業服務法」規劃出外籍勞動者的不同階級，施以不同的管制規定（如，藍領外勞不得轉換雇主 ─ 違反「國際人權公約」中，任何人得以有選擇職業的自由），現又愈加以「錢流管理系統」的設計，將其視為潛在的犯罪（逃跑）者，而需以公權力限制私人薪資的使用、欲以公權力侵犯其個人隱私。在在顯示出勞委會在政策規劃上明顯地階級歧視，侵害藍領階級外籍勞動者的基本人權！&lt;br /&gt;&lt;br /&gt;&lt;span style="font-weight:bold;"&gt;【尊重外勞知的權力　才是正本清源之道】&lt;/span&gt;&lt;br /&gt;&lt;br /&gt;勞委會口口聲聲地為保障外籍勞工的權益，卻以「沙豬思想」設計出各種的「保護措施」，實是緣木求魚不切實際的作為。殊不知「給他魚，不如教他釣魚」的基本道理？&lt;br /&gt;&lt;br /&gt;如果外勞有足夠的協助管道（有效的語言及法令支援系統），當雇主積欠薪資時，難道他們會不願意透過相關管道，主動告知主管機管處理？如果外勞被告知充分的法律規定，如果各主管機關能落實地執法保障其基本權益，則仲介超收其任何費用時，難道他們會不願意主動尋求協助？&lt;br /&gt;&lt;br /&gt;我們認為，將「外勞講習」列入聘僱外勞程序中必要的環節，使主管機關克盡政令宣導之責，讓外勞充分瞭解其自身權利的相關規定，尊重外勞知的權利，才是避免惡質雇主欠薪、虐待、甚至導致外勞逃跑，不肖仲介業者高額獲利、剝削等問題的正本清源之道。 &lt;br /&gt;&lt;/span&gt;&lt;div class="blogger-post-footer"&gt;&lt;img
