<p style="TEXT-ALIGN: left">April 28, 2009<br /> <br /><strong>Judge recommends that class action environmental lawsuit proceed</strong></p>
<p style="TEXT-ALIGN: justify"><em>EPA probe does not interfere with lawsuit over TCE groundwater contamination</em><br /> <br />Dayton, Ohio – A class action environmental lawsuit filed by Ohio residents who live near a former Chrysler Motors plant in Dayton should proceed despite a pending investigation into the site by the U.S. Environmental Protection Agency, a magistrate judge has recommended.<br /> <br />The class action environmental lawsuit claims that Chrysler and the plant’s owner, Behr Dayton Thermal Products, negligently, recklessly and intentionally contaminated groundwater. As a result, a plume of underground poisonous vapors expose nearby residents to volatile organic compounds (also known as VOCs), including trichloroethane (also known as TCE) and vinyl chloride. </p>
<p style="TEXT-ALIGN: justify">TCE can cause headaches, lung irritation, dizziness, incoordination and difficulty concentrating. Long-term exposure to TCE can lead to permanent nerve, kidney and liver damage.</p>
<p style="TEXT-ALIGN: justify">The environmental litigation claims that Chrysler has known of the groundwater and soil contamination since at least 1999 but has not stopped it or warned residents of the danger. In addition to the health hazards associated with VOCs, the suit alleges, the residents’ property values have fallen. </p>
<p style="TEXT-ALIGN: justify">The environmental lawsuit, First Property Group Ltd., et al. v. Behr Dayton Thermal Products LLC, et al., 08-cv-329, is pending in the U.S. District Court for the Southern District of Ohio. <br /> <br />Chrysler reported the contamination to the Ohio Environmental Protection Agency in 2006, and the federal EPA began its own probe into the site contamination in November of that year. Lawyers representing Chrysler and Behr Dayton asked the federal court to dismiss or stay the environmental litigation while the EPA investigates.</p>
<p style="TEXT-ALIGN: justify">On April 17, U.S. Magistrate Judge Sharon L. Ovington issued a report to the district court in which she concluded that the environmental lawsuit would not interfere with the EPA’s activities.</p>

<p>Joh<a href="http://legalmediamatters.typepad.com/.a/6a00e550ac9dcc883401156ec93bd6970c-pi" style="DISPLAY: inline" /><span style="FONT-FAMILY: Trebuchet MS">n Campbell</span> of <a href="http://www.simonlawpc.com" target="_blank">The Simon Law Firm</a> was one of the attorneys quoted in the story. In an interview with reporter Allison Retka, <a href="http://www.simonlawpc.com/attorneys/john-e-campbell.html" target="_blank">Campbell</a> stressed the need to investigate the solvency of the defendants </p>
<p>In one blatant mortgage fraud case, Campbell explained he was unable to pursue the case because every entity tainted by the alleged fraud was no longer in business. That meant that even if he won the case, the client would still not obtain any financial relief.</p>
<p>The article also notes that consumer fraud cases can drag on for years. <p>According to a recent annual economic survey conducted by <a href="http://www.mobar.org" target="_blank">The Missouri Bar</a>, “client referrals and referrals from other lawyers continue to be the main sources of new clients coming into the firms.”</p>
<p>The importance of referrals was underscored in the Feb. 23 issue of <em><a href="http://www.molawyersmedia.com" target="_blank">Missouri Lawyers Weekly</a></em>. In the article, “Attracting Referrals,” several high-profile attorneys explained that previous clients and other attorneys are still the primary source of new business. </p>
<p>But to get these referrals, lawyers must produce results. John Simon of <a href="http://www.simonlawpc.com" target="_blank">The Simon Law Firm</a>, explained:</p>
<blockquote dir="ltr" style="MARGIN-RIGHT: 0px">
<p>"It's all about doing good work and establishing relationships. I think they go hand in hand. If you have a good result for someone, that's probably the best advertising you can have." </p></blockquote>
<p>So when your firm obtains a good result, don’t forget to publicize it: </p>
<ul>
<li>Let fellow attorneys know about great outcome by submitting a trial report to the <a href="http://http://www.civil-litigator.com/index.html" target="_blank"><em>Civil Litigator</em></a>, <em>Missouri Lawyers Weekly</em>, <em>Verdict Reporter</em> and Verdict Search. 
<li>Promote the results on the law firm’s Web site. The same write-up that was submitted to trade publications can be modified for inclusion on the site. 
<li>Prepare a <a href="http://legalmediamatters.typepad.com/files/handout.pdf"><span class="at-xid-6a00e550ac9dcc8834011168a9d972970c">Handout</span></a> that can be mailed to former clients and fellow attorneys. Keep a copy of the handout in the law firm’s lobby. </li>
</li></li></ul>
<p>Unfortunately, many lawyers find that carving out the time to submit trial reports is a challenge. When an attorney general settles a suit on behalf of the state her or she represents, a press release announcing the results may be sent out to reporters.  Yet when a private attorney files, settles or wins a lawsuit involving matters of public policy, safety or an incident already widely covered in the press, the act may very well go unnoticed.</p>
<p>This isn’t because reporters make a point of ignoring private attorneys. Short of parking a reporter next to the filing clerk’s office in every courthouse in the state, it is virtually impossible for news organizations to learn about all of the important legal developments that merit ink. </p>
<p>Having represented clients as an attorney, covered lawyers as a legal and investigative reporter and worked with lawyers as a publicist, I’ve seen firsthand what works when it comes to law-related news releases. I’ve distilled these best practices into a set of guidelines that I refer to as the “six C’s” of news releases.</p>
<p style="TEXT-ALIGN: center"><strong /></p>

<p style="text-align: center"><strong>Candidates for News Releases</strong> </p>
<p>Not every case, legal development or settlement will pique a reporter’s interest. Selecting the proper topic is one key element of an effective news release.</p>
<p>A lawsuit filed when someone sustains soft-tissue injuries in a fender-bender won’t make the news—but a lawsuit filed on behalf of someone who was injured in catastrophic highway crash involving a tractor-trailer that killed several people and was widely covered by the media would certainly merit a press release.</p>
<p>A contract dispute between two parties over the terms of a business lease probably won’t be news. However, a class action on behalf of consumers alleging that the terms written into a payday-loan agreement are predatory is news.</p>
<p>A product liability petition alleging that a mechanic was injured when a tire exploded may not merit a news release, but a suit involving a defective tire that has a record of exploding, has been the target of numerous lawsuits and has injured scores of people would be newsworthy.</p>
<p>Generally a lawsuit is newsworthy if the issue affects a wide swath of the public, rather than just your client, or it involves an incident that has already received attention from the press.</p>
<p style="TEXT-ALIGN: center"><strong>Contents of a News Release</strong></p>
<p>Think of a news release as the CliffsNotes version of the lawsuit. The news release summarizes, in narrative form, the allegations contained within the suit. Except for a quote from the attorney bringing the case, it typically stays within the confines of what is alleged in the petition or complaint.The first sentence, simply stating who is suing whom for what, is followed by a paragraph or two summarizing the factual underpinnings of the case and then a paragraph briefly outlining the legal theories asserted by the plaintiff. </p>
<p>The news release should identify the attorney who filed the case, the caption of the case, the court in which it was filed, the case number and the filing date. It should also include a contact name and phone number for a reporter who wishes to follow up on the case.</p>
<p>The news release may also contain brief statement from the lawyer, perhaps touching on why the suit was filed in the first place—for instance, “We believe that this danger has existed for years, and it is my client’s hope that by bringing this case she will be the last person to be harmed.”</p>
<p style="TEXT-ALIGN: center"><strong>Clear and Concise</strong></p>
<p>While working as a reporter, I made the mistake of using the word “tort” in a story. An editor made a personal appearance at my desk with a copy of the story in his hand. “Are we writing about pastries?” he asked.</p>
<p>I launched into a legal explanation of a tort. He listened patiently and, when I was done, said, “I know what a tort is, but that isn’t important. Our readers are the ones we write for, and many won’t know. Change it.”</p>
<p>The point is that Joe and Sally Sixpack probably don’t have a copy of Black’s Law Dictionary handy. If your news release is packed with legalese, a reporter will have to spend a lot of time translating it. A lawyer who follows Wydick’s exhortation to use plain English will also make the journalist’s job easier.<br />In addition to being clear, a news release should be concise. This isn’t easy. As Mark Twain once said, “I didn’t have time to write a short letter, so I wrote a long one instead.”</p>
<p>An average news story is about 800 words long. The reporter is going to have to make your news fit the space allotted for the piece. If you don’t pare the information down, the reporter will do it for you.</p>
<p>The gold standard for the length of a news release is one page. I don’t always meet that aim, but I never exceed two pages.</p>
<p style="TEXT-ALIGN: center"><strong>Client Communication</strong></p>
<p>Before a news release is sent out, most lawyers will explain to the client why it is appropriate for that particular case.  The lawyer should discuss with the client how any media contacts will be handled if a reporter calls.</p>
<p>An article is a story based on facts. For a reporter, the main character—the person at the center of the drama—is the plaintiff. Unless the publication is one geared specifically for lawyers, the attorney is often viewed as part of the supporting cast.  That means that a journalist may track down your client and give him or her a call. </p>
<p>Some attorneys instruct their clients to refer all questions to the lawyer, who then answers all questions. Some lawyers will allow the client to be interviewed but only if they are present. Never forget to set up your ground rules with the client ahead of time.</p>
<p style="TEXT-ALIGN: center"><strong>Contact the Relevant Beat Reporter</strong></p>
<p>As a reporter, the news releases that caught my attention were ones sent specifically to me that were relevant to my legal and investigative beat. If I received a press release announcing the opening of a new restaurant and I had time, I might forward it to the restaurant critic. If I didn’t have time, the release was ignored or deleted.</p>
<p>In my experience, the most effective news release is the one with a carefully crafted submission list. Legal reporters may be interested in a lawsuit filed over a catastrophic trucking accident.  Journalists who cover the traffic beat should be included on the list, and any reporter who covered the original incident should receive a copy of the news release as well. Include the local office of a wire service such as the Associated Press on the circulation list.</p>
<p>Newsroom resources are scarce, and the ranks of reporters grow thinner each day. Chances are, a media organization located in an area with no connection to the plaintiffs, the defendants or the incident will not be eager to assign a reporter to the story. However, it may run an article written by a journalist at a wire service such as the Associated Press.</p>
<p style="TEXT-ALIGN: center"><strong>Consideration</strong></p>
<p>A reporter who receives a news release doesn’t simply decide to write a story. He or she typically must pitch the story to an editor before a green light is given. It may take some convincing before an editor gives the OK to a story, but once an article has been assigned the editor expects that it will be turned in. </p>
<p>A reporter has gone out on the limb for you to write the piece. Don’t leave him or her hanging.</p>
<p>Have a file-stamped copy of the lawsuit that can be faxed or e-mailed to the journalist. The reporter will need to personally verify that a lawsuit does indeed exist and makes the allegations that were summarized in the news release.  </p>
<p>Be available for questions. One of the most frustrating things a reporter can encounter is a news release contact who is unavailable. Tight deadlines may mean that an article must be turned in only a few short hours after it is assigned. A television news reporter may need to hastily set up an on-camera interview. Unreturned voice mail or e-mail messages result in a great deal of anxiety.</p>
<p>A lawyer who quickly returns a reporter’s phone call and anticipates requests for copies of lawsuits instantly creates goodwill. The lawyer gains a reputation as someone on whom the reporter can depend. Just as judges compare notes about attorneys who appear before them, journalists share sources and tell one another which ones are likely to call back.</p>
<p>To summarize: Select your candidates for news releases as carefully as you pick your clients. Write the release in a clear, concise manner, and be sure to include content that helps the reporter verify the information. Communicate with your client before the news release is circulated to the relevant contacts, and be considerate of the reporter, who is often working under a tight deadline.<br /></p><xhtml:img xmlns:xhtml="http://www.w3.org/1999/xhtml" src="http://feeds.feedburner.com/~r/typepad/eiam/~4/XDh3l6vLNn4" height="1" width="1" /></div></content>

<p><strong>Conditional certification granted to title-company closing agents alleging that they were denied overtime.</strong></p>
<p>St. Louis – A federal judge has certified an unpaid overtime collective action suit on behalf of closing agents from five Midwestern states who worked in the offices of LandAmerica Commonwealth Title.</p>
<p>On May 21, 2008, Deborah Jost, Renee Karpel-Morris, Joni Jegel and Genevieve Dahl, closing agents who worked in Missouri offices of Commonwealth Land Title Insurance Company, doing business as LandAmerica Commonwealth Title, sued their employer in the U.S. District Court for the Eastern District of Missouri on behalf of themselves and similarly situated employees.</p>
<p>The suit, which seeks unpaid overtime and liquidated damages under the Fair Labor Standards Act of 1938, alleges that LandAmerica engaged in a pervasive pattern or practice of denying overtime benefits by:</p>
<p><span>

<li>Encouraging workers to underreport hours so as not to incur overtime</li></ul></span>

<li>Eliminating log-in and log-off computer information and time-stamped e-mail to thwart time tracking</li></ul></span>

<p>In a ruling dated Jan. 27, U.S. District Court Judge Catherine Perry granted the conditional certification to residential closing agents in Missouri, Michigan, Kansas, Wisconsin and Nebraska who worked for LandAmerica between May 21, 2005, and the present.</p>
<p>In <em>Jost, et al. v. Commonwealth Land Title Insurance Co</em>., case No. 4:08CV734, Perry wrote that the evidence revealed that four supervisors for the title insurance company, ranging from a senior vice president to a St. Louis manager, “either instructed escrow officers (and employees with other job titles but similar duties) to work off the clock and not to record all hours actually worked, or knew that this was occurring.”</p>

<p>David T. Butsch, a litigator with more than 20 years’ experience, has successfully pursued multimillion-dollar class action cases for consumers, represented banks and self-insured businesses and defended insurance companies. He is a frequent presenter at civil litigation seminars and serves as the civil procedure editor of Missouri Courts and CLE Bulletin, published by the Missouri Bar. Rated an AV lawyer by Martindale Hubbell, Butsch was named a Missouri/Kansas Superlawyer in 2006.</p>
<p>Butsch graduated cum laude from St. Mary’s University of San Antonio. He received his law degree from Saint Louis University Law School in 1988 and served as articles editor for the Saint Louis University Law Journal.</p>
<p>James J. Simeri has a broad range of civil litigation experience. In class action cases, he has represented not only consumers but also employees with wage claims, and he has arbitrated securities cases before the National Association of Securities Dealers on behalf of both customers and broker-dealers. Simeri has handled employment cases involving wrongful termination and discrimination claims, in addition to noncompete-agreement disputes. </p>
<p>Simeri served as an officer in the U.S. Navy and was stationed aboard an amphibious assault ship before obtaining his law degree from Northwestern University. Simeri earned his undergraduate degree from Northwestern University.</p>
<p>Matthew R. Fields has extensive experience handling asbestos litigation cases in both Missouri and Illinois. He concentrates in the areas of business and commercial litigation and insurance defense, where he has a successful track record in high-stakes litigation. </p>

<p>St. Louis, MO – The law firm of <a href="http://www.careydanis.com">Carey &amp; Danis LLC</a> has filed a class action lawsuit on behalf of persons who purchased auction-rate securities from H&amp;R Block, Inc. (NYSE: BAC), and H&amp;R Block Financial Advisors, Inc., between Aug. 26, 2003 and Feb. 13, 2008 and who continued to hold the securities as of Feb. 13, 2008.</p>
<p>The class action lawsuit, <em>La Grave v. H&amp;R Block, Inc., et al.</em>, 08-cv-667, is pending in the U.S. District Court for the Southern District of Illinois.  The suit alleges that H&amp;R Block, Inc. and its subsidiary H&amp;R Block Financial Advisors, Inc., violated Sections 10(b) and 20(a) of the Securities Exchange Act of 1934 by deceiving investors about the investment characteristics of auction rate securities and the auction market in which the securities are traded.</p>
<p>Auction rate securities are municipal or corporate debt securities or preferred stocks that pay interest at rates set through periodic auctions.  The instruments typically have long-term maturity dates or no maturity date.</p>
<p>The suit filed on Sept. 24 claims that, pursuant to uniform sales materials and top-down management directives, H&amp;R Block offered and sold auction-rate securities to the public as highly liquid cash-management instruments and as suitable alternatives to money market mutual funds.  On Feb. 13, 2008, all of the major broker-dealers, including H&amp;R Block, withdrew their support for the auctions.  The suit claims that, as a result, investors have been unable to liquidate their auction-rate securities. </p>
<p>The lawsuit alleges that H&amp;R Block failed to disclose the following material facts about the auction-rate securities it sold to the class:</p>
<ul>
<li>The auction rate securities were not cash alternatives like money market funds but were instead complex long-term financial instruments with 30-year maturity dates. </li>
</ul>
<ul>
<li>The auction rate securities were only liquid at the time of the sale because H&amp;R Block and other broker-dealers were artificially supporting and manipulating the market to maintain the appearance of liquidity and stability. </li>
</ul>
<ul>
<li>H&amp;R Block and other broker-dealers routinely intervened in the auctions for their own benefit to set rates and to prevent all-hold auctions and failed auctions. </li>
</ul>
<ul>
<li>H&amp;R Block continued to market auction rate securities as liquid investments even after H&amp;R Block and other broker-dealers determined that they would likely be withdrawing support for the periodic auctions and that a freeze of the auction rate securities market would result. </li>
</ul>
<p>Investors who purchased or acquired auction rate securities from H&amp;R Block between Aug. 26, 2003, and Feb. 13, 2008, and who continued to hold the securities as of Feb. 13, 2008, may request appointment as lead plaintiff by the Court on or before Nov. 24, 2008.  A lead plaintiff is a representative party acting on behalf of other class members.  To be appointed, the Court must conclude that the investor’s claims are typical of other class members’ and that the investor will adequately represent the class.  The investor’s ability to share in any recovery is not affected by the decision to serve as lead plaintiff.  The investor may retain Carey &amp; Danis LLC, or other attorneys, to serve as counsel.</p>

&lt;p&gt;More and more same-sex couples are traveling to California and Massachusetts to be married—but, unfortunately, once they leave either state, these couples do not have the same legal rights as heterosexual married couples. &lt;/p&gt;

&lt;p&gt;“You could plan a romantic vacation to California and tie the knot while you are there; however, all of the rights and responsibilities legally inherent to the marriage will not cross the border with you,” said Papa. “When you return home, you are simply an unmarried couple living together.”&lt;/p&gt;

&lt;p&gt;As a result, same-sex and unmarried couples find themselves unable to make health care decisions for each other, won’t be able to stop family members from taking assets in the event that one of the partners dies, and may not even be able to visit each other in the intensive care unit.&amp;nbsp; Many do not realize that legal action can be taken to ensure that these couples will have the same rights as married couples in such situations.&lt;/p&gt;

&lt;p&gt;The legal tools discussed at the seminar can also help unmarried couples who end a relationship by choice. In Missouri, assets belong to the person who purchased them. If one partner pays for a house and the other partner supplies the labor to rehab it, the rehabber could walk away empty-handed should the relationship come to an end. A partnership agreement mediated at the beginning of a relationship will ensure that assets are fairly distributed, protecting both parties if they decide to part ways.&amp;nbsp; &lt;/p&gt;
