			<content:encoded><![CDATA[<p>HIPAA, Administrative Simplification (AS) provisions, defines rules and requirement on privacy and security practices of health care information. In Title II, the Department of Health and Human Services (HHS) outlines regulations for the use and dissemination of individual health care information.These rules apply to covered entities, including health plans, health care clearinghouses, such as outsourced billing companies and community health information systems and health care providers that transmit health care information in a way that is regulated by HIPAA. [Code of Federal RegulationsTitle 45, Volume 1]The Privacy Rule establishes regulations for the use and disclosure of Protected Health Information (PHI). PHI is any information about health status, provision of health care, or payment for health care that can be linked to a person. This includes any part of a patient’s medical record or payment history. [Code of Federal Regulations. Title 45, Volume 1]Security Rule deals specifically with Electronic Protected Health Information (EPHI) and requires Administrative Safeguards &#8211; policies and procedures designed to clearly show how the entity will comply with the actCovered entities that out-source parts of their business processes to a trusted third party must ensure that their vendors also have a framework in place to comply with HIPAA requirements. Companies typically gain this assurance through clauses in the contracts stating that the vendor will meet the same data protection requirements that apply to the covered entity. Care must be taken to determine if the vendor further out-sources any data handling functions to other vendors and monitor whether appropriate contracts and controls are in place.A contingency plan should be in place for responding to emergencies. Covered entities are responsible for backing up their data and having disaster recovery procedure. The plan should document data priority and failure analysis, testing activities, and change control procedures.Internal audits play a key role in HIPAA compliance by reviewing operations with the goal of identifying potential security violations. Audits should be both routine and event-based.In order to have an online backup that is HIPAA compliant you need to meet all the requirements of the Final HIPAA Security rule dated February 2003 and required after April 21, 2005.  You should ensure that a backup provider exceeds the standards set in the security rule by encrypting all data before it is sent over a secure SSL connection to the remote backup service. An effective solution is to have the Encryption Key generated by the customer and is known only to the customer and to ensure that the Key is not transmitted to the HIPAA compliant online backup server.  A HIPAA online backup provider should encrypted the data on the server with military grade encryption and not accessible to the backup provider or employees.  Ensure that the local backup client encrypts all data prior to transmission to the remote systems. Data can only be recovered by transmitting it back to the local client that decrypts the data using the encryption key. <br/><br/></p>

<p>Pre-employment screening in UK</p>
<p>Pre-employment screening is used to verify the accuracy of an applicant&#8217;s claims as well as to discover any possible criminal history, workers compensation claims, or employer sanctions.</p>
<p>The problem screening tries to counter</p>
<p>A number of annual reports, including BDO Hayward&#8217;s Fraudtrack and CIFAS&#8217;s (the UK&#8217;s fraud prevention service) &#8216;The Enemy Within&#8217; have showed a rising level of major discrepancies and embellishments on CVs over previous years.Such business fraud cost UK businesses 1.4 bn in 2005,</p>
<p>Almost half (48%) of organizations with fewer than 100 staff experienced problems with vetted employees.</p>
<p>39% of UK organizations have experienced a situation where their vetting procedures have allowed an employee to be hired who was later found to have lied or misrepresented themselves in their application.</p>
<p>However, recent research by Powerchex shows a reverse in the trend. They found that in the 2006/7 period CV discrepancies had fallen by 31% to 13%</p>
<p>So why don&#8217;t more employers vet staff more rigorously?</p>
<p>David Chernick from Reed_(Company) suggests that there are conflicting interests between employers&#8217; recruitment and protection or security activities: &#8220;Whilst the recruitment department focuses on hiring the best staff quickly and effectively, many hiring managers regard background checking as the bottleneck in their recruitment processes.&#8221; He goes on to recommend: &#8220;ring-fencing background and reference checking from the recruitment department can introduce objectivity and know-how and the possibility of using an expert, dedicated service from an outside specialist, screening firm.&#8221;</p>
<p>The Market</p>
<p>Larger companies are more likely to outsource than their smaller counterparts – the average staff size of the companies who outsource is 3,313 compared to 2,162 for those who carry out in-house checks.</p>
<p>Financial services firms had the highest proportion of respondents who outsource the service, with over a quarter (26%) doing so, compared to an overall average of 16% who outsource vetting to a third party provider.</p>
<p>The construction and property industry showed the lowest level of outsourcing, with 89% of such firms in the sample carrying out checks in-house.</p>

<p>The FSA states in their Training &#038; Competence guidance that regulated firms should have:</p>
<p>Adequacy of procedures for taking into account knowledge and skills of potential recruits for the role</p>
<p>Adequacy of procedures for obtaining sufficient information about previous activities and training</p>
<p>Adequacy of procedures for ensuring that individuals have passed appropriate exams or have appropriate exemptions</p>
<p>Adequacy of procedures for assessing competence of individuals for sales roles</p>
<p>The FSA’s statutory objectives:</p>
<p>Protecting consumers</p>
<p>Maintaining market confidence</p>
<p>Promoting public awareness</p>
<p>Reducing financial crime</p>
<p>Usefulness</p>
<p>Employment screening can be a practical, low-cost way to significantly reduce employee theft and dishonesty and notably increase productivity and safety. Certain industries require employment checks on all employees. Examples include the banking, financial, and security industries, transportation industries, childcare, healthcare, and teaching industries, police, law enforcement, and certain military positions. The level of background investigation may vary from industry to industry or position to position. Employers who actively screen their applicants before hiring also face less liability in the event of a workplace accident or crime. Pre-employment screening is a primary way of eliminating or minimizing negligent hiring liability.</p>
<p>There are many companies that provide pre-employment screening services. One such company that has been featured in USA Today and Boardwatch Magazine is interactiveinfo.net.</p>
<p>Integrity testing is a new approach to employment screening. Integrity or honesty surveys pose straightforward questions to applicants in clear language that elicit honest answers or admissions of counterproductive work-related behavior.</p>
<p>These pre-employment tests &#8212; developed with the help of Insight Worldwide&#8217;s industry advisory committee &#8212; adhere to state and federal employment regulations. The tests are typically administered on PDAs loaded with the surveys and supplied by Insight. The Integrity Test flags applicants whose answers revealed a history of counterproductive work behaviors &#8212; or cautions &#8212; in five categories: violence, illegal drug use, workers comp. fraud, theft and dependability.</p>
<p>Pre-employment screening in the US</p>
<p>Laws</p>
<p>Due to the sensitivity of the information contained in consumer reports and certain records, there are a variety of important laws regulating the dissemination and legal use of this information. Most notably, the Fair Credit Reporting Act (FCRA) regulates the use of consumer reports (which it defines as information collected and reported by third party agencies) as it pertains to adverse decisions, notification to the consumer, and destruction and safekeeping of records. If a consumer report is used as a factor in an adverse hiring decision, the consumer must be presented with a “Pre-adverse action disclosure,” a copy of the FCRA summary of rights, and a “notification of adverse action letter.” Consumers are entitled to know the source of any information used against them including a credit reporting company.</p>
<p>Types of Checks</p>
<p>There are a variety of types of investigative searches that can be used by potential employers. Many commercial sites will offer specific searches to employers for a fee. Services like these will actually perform the checks, supply the company with adverse action letters, and ensure compliance throughout the process. It is important to be selective about which pre-employment screening agency you use. A legitimate company will be happy to explain the process to you.</p>
<p>Many employers choose to search the most common records such as criminal records, driving records, and education verification. Other searches such as sex offender registry, credential verification, reference checks, credit reports and Patriot Act searches are becoming increasingly common. Employers should consider the position in question when determining which types of searches to include, and should always use the same searches for every applicant being considered for one position.</p>
<p>Reasons</p>
<p>They are frequently conducted to confirm information found on an employment application or résumé/curriculum vitae. They may also be conducted as a way to further differentiate potential employees and pick the one the employer feels is best suited for the position. In the United States, the Brady Bill requires criminal checks for those wishing to purchase handguns from licensed firearms dealers. Restricted firearms (like machine guns), suppressors, explosives or large quantities of precursor chemicals, and concealed weapons permits also require criminal checks. Checks are also required for those working in positions with special security concerns, such as trucking, ports of entry, and airline transportation. Other laws exist to prevent those who do not pass a criminal check from working in careers involving the elderly, disabled, or children.</p>
<p>Possible Information Included</p>
<p>The amount of information included on a check depends to a large degree on the sensitivity of the reason for which it is conducted—e.g., somebody seeking employment at a minimum wage job would be subject to far fewer requirements than somebody applying to work for the FBI.</p>
<p>Criminal and incarceration records</p>
<p>Birth certificate or legal status in the country</p>
<p>Litigation records</p>
<p>Employers may want to identify potential employees who routinely file discrimination lawsuits. It has also been alleged that in the U.S., employers that do work for the government do not like to hire whistleblowers who have a history of filing qui tam suits.</p>
<p>Driving and vehicle records</p>
<p>Employers in the transportation sector seek drivers with clean driving records&#8211;i.e., those without a history of accidents or traffic tickets.</p>
<p>Drug tests</p>
<p>are used for a variety of reasons&#8211;corporate ethics, measuring potential employee performance, and keeping workers&#8217; compensation premiums down.</p>
<p>Education records</p>
<p>These are used primarily to see if the potential employee had graduated from high school (or a GED) and in fact received a college degree, graduate degree, or some other accredited university degree. There are reports of SAT scores being requested by employers as well.</p>
<p>Employment records</p>
<p>These usually range from simple verbal confirmations of past employment and timeframe to deeper, such as discussions about performance, activities and accomplishments, and relations with others.</p>
<p>Financial information</p>
<p>Credit scores, liens, civil judgments, or bankruptcy may be included in the report.</p>
<p>Licensing records</p>
<p>A government authority that has some oversight over professional conduct of its licensees will also maintain records regarding the licensee, such as personal information, education, complaints, investigations, and disciplinary actions.</p>
<p>Military records</p>
<p>Although not as common today as it was in the past fifty years, employers frequently requested the specifics of one&#8217;s military discharge.</p>
<p>Social Security Number</p>
<p>(or equivalent outside the US). A fraudulent SSN may be indicative of identity theft, insufficient citizenship, or concealment of a &#8220;past life&#8221;.</p>
<p>Polygraph test</p>
<p>Also known as a psychophysiological detection of deception (PDD) examination.</p>
<p>Other interpersonal interviews</p>
<p>Employers will usually wish to speak with potential employees&#8217; references to gauge employability. More intensive checks can involve interviews with anybody that knew or previously knew the applicant&#8211;such as teachers, friends, coworkers, and family members.</p>

<p>Controversies</p>
<p>Drug tests and credit checks for employment are highly controversial practices. According to the Privacy Rights Clearinghouse, a project of the Utility Consumers&#8217; Action Network (UCAN): &#8220;While some people are not concerned about background investigations, others are uncomfortable with the idea of investigators poking around in their personal histories. In-depth checks could unearth information that is irrelevant, taken out of context, or just plain wrong. A further concern is that the report might include information that is illegal to use for hiring purposes or which comes from questionable sources.&#8221;</p>
<p>In May 2002, allegedly improper post-hire checks conducted by Northwest Airlines were the subject of a civil lawsuit between Northwest and 10,000 of their mechanics.</p>
<p>In the case of an arrest that did not lead to a conviction, employment checks can continue including the arrest record for up to seven years, per § 605 of the Fair Credit Reporting Act:</p>
<p>Except as authorized under subsection (b) of this section, no consumer reporting agency may make any consumer report containing . . . Civil suits, civil judgments, and records of arrest that from date of entry, antedate the report by more than seven years or until the governing statute of limitations has expired, whichever is the longer period.</p>
<p>Subsection (b) provides for an exception if the report is in connection with &#8220;the employment of any individual at an annual salary which equals, or which may reasonably be expected to equal $75,000, or more&#8221;[4].</p>
<p>Some proposals for decreasing potential harm to innocent applicants include:</p>
<p>Furnishing the applicant with a copy of the report before it is given to the employer, so that any inaccuracies can be addressed beforehand; and</p>
<p>Allowing only conviction (not arrest) records to be reported.</p>
<p>In New Zealand, criminal checks have been affected by the Clean Slate Act 2004, which allows individuals to legally conceal &#8220;less serious&#8221; convictions from their records provided they had been conviction-free for at least seven years.</p>
<p>In Michigan, the system of criminal checks has been criticized in a recent case where a shooting suspect was able to pass an FBI check to purchase a shotgun although he had failed the check for a state handgun permit. According to the spokesman of the local police department,</p>
<p>&#8230; you could have a clear criminal history but still have contacts with law enforcement that would not rise to the level of an arrest or conviction [that can be used] to deny a permit whether or not those involved arrests that might show up on a criminal history.</p>
<p>The Brady Campaign to Prevent Gun Violence has criticized the federal policy, which denies constitutional rights based on a criminal check only if the subject has been accused of a crime.</p>
<p>Public Records Pay Sites</p>
<p>Taking advantage of public records availability in the United States, a number of Web based companies began purchasing U.S. public records data and selling it online, primarily to assist the general public in locating people. Many of these sites advertise background research and provide employers and/or landlords with fee-based checks.</p>
<p>However, there has been a growing movement on the web to use advertising-based models to subsidize these checks. These companies display targeted ads next to the reports delivered to landlords or employers. Some of the reports provided by these pay sites are only expanded versions of a basic (people search) providing a 20 year history of addresses, phone numbers, marriages and divorces, businesses owned and property ownership. Usually, these sites will also provide a nationwide criminal report for an added charge. <br/><br/></p>

			<content:encoded><![CDATA[<p>Throughout the historic 2008 presidential campaign, much attention has been given to the personalities of the candidates. Many know that John McCain survived a horrific ordeal as a POW in Vietnam. Many know that Obama was raised by a single mother in Hawaii, who sometimes had to go on welfare to support her children. And many are now aware of Sarah Palin&#8217;s pregnant teenage daughter and the death of Joe Biden&#8217;s wife in an automobile crash over 30 years ago.<br />
However, if you ask many supporters of Obama or McCain, very few can tell you where their candidates stand on such issues as health care. Consequently, 45 million Americans live without adequate health care.<br />
Both presidential candidates plan to guarantee health care for all Americans.<br />
&#8220;We now face an opportunity-and an obligation-to turn the page on the failed politics of yesterday&#8217;s health care debates&#8230;My plan begins by covering every American,&#8221; said Obama in 2007. &#8220;If you already have health insurance, the only thing that will change for you under this plan is the amount of money you will spend on premiums. That will be less. If you are one of the 45 million Americans who don&#8217;t have health insurance, you will have it after this plan becomes law. No one will be turned away because of a preexisting condition or illness.&#8221;<br />
Obama believes not enough money is spent on prevention and public health, citing the obesity epidemic in this country. According to his website, less than four cents of every medical dollar is spent on prevention.  His health plan will provide subsidies for working families that do not qualify for Medicaid and Medicare and allow participants to move to different jobs without changing plans.<br />
McCain wants to put the patients in control of their health care plan by encouraging competition among insurance companies with a greater variety, lower costs and like Obama portability of insurance plans. The Arizona senator will allow citizens to remain with their company&#8217;s insurance but will give every family a direct refundable tax credit totaling $5,000 and $2,500 for individuals to offset the high cost of health care. He is also encouraging health savings accounts, which would allow families to control what options they pay for.<br />
Senator Obama&#8217;s plan would create a National Health Insurance Exchange, which would act as a watchdog group by implementing rules and standards for insurance companies to guarantee fairness and accessibility.<br />
The GOP hopeful will attempt to encourage greater competition within our drug market through a quicker development of generic prescription drugs. The Democratic nominee plans to allow Americans to buy their meds from other developed countries if the prices are lower outside the country. He will increase the use of generic medicine in Medicare and Medicaid and stop big drug companies from prohibiting generic drugs in the marketplace.<br />
Both candidates favor utilizing technological advancements to assist doctors in their daily operations. In addition, both favor reforming insurance to prevent frivolous lawsuits against doctors. And Obama favors mandatory health care coverage for children, allowing young Americans coverage under their parents&#8217; insurance until age 25.<br />
Whether you are Democrat or Republican, young or old, rich or poor, issues such as health care are life or death situation for many Americans. And unlike other publications Regal Magazine will dedicate the next two months to covering the issues that are most important to all Americans, not the issues that will have no affect on providing a better future for Americans. <br/><br/></p>

			<content:encoded><![CDATA[<p>The 2008 election has brought the topic of &#8220;affordable health care&#8221; and &#8220;affordable health insurance&#8221; to the forefront and, along with it, a slew of misconceptions. So, what is true and what is false? The purpose of the following article is to dispel some of these myths and misconceptions and provide information to make a muddy topic a bit clearer.1. The first misconception is that, for some reason, Americans equate affordable health care to be &#8220;socialized medicine.&#8221; This is not the case at all. According to Wiktionary, socialized medicine is &#8220;an umbrella term for any system of government-run health care.&#8221; Many people balk at the idea of socialized medicine because the citizens inevitably pick up the costs through higher taxes. Affordable health care, on the other hand, is as simple as the phrase states &#8211; it is health care with costs low enough for everyone to afford. The government does not necessarily oversee it and individuals are free to go to physicians of their choice. It is not discriminatory to those with lower incomes and services are equal whether one is poor or financially privileged. 2. Another misconception is that the current total of uninsured Americans is not as high as many journalists and polls report, and that this is a relevant fact that points to the lack of necessity for affordable health care. The Kaiser Family Foundation even stated that their numbers include those who have been without insurance for two years or more. The Congressional Budget Office also said that just under half of those lacking health insurance will be without coverage for less than four months, due to being in between jobs. These numbers beg the following question, however: What about those who have something catastrophic occur within those four months that they are without insurance? Without adequate coverage, their medical bills could potentially lead to major hardships.3. A third misconception is that the only people without health insurance are those who are poor.  This is simply not true. Americans of all income levels are without health insurance. In fact, at least half of all bankruptcies in the United States are due to medical bills. Because individuals are already paying high premiums due to not having affordable health care, when medical bills begin to accumulate, Americans are unable to pay both the premium costs as well as the mounting medical bills. And with the unemployment rate rising, more people are falling into the category of being without health insurance. Whether they are losing the insurance that came with the job they lost, or whether they are unable to continue paying the premiums due to a lack of income, the rate of uninsured Americans is on the rise. As illustrated above, the need for affordable health care and insurance has become more crucial than ever. The current economic crisis, along with job losses being on the rise, could lead to detrimental effects on the health of Americans. Affordable health care would offer a safety net for both minor and major medical issues. <br/><br/></p>

			<content:encoded><![CDATA[<p>Though the recent campaign for presidency brought affordable health care into the limelight, many small business owners and their employees felt this struggle long before it gained public attention. One of President Obama’s campaign calling cards is his plan for affordable health care. Intertwined within the general theme of affordable health insurance was the more specific aid to assist small businesses in providing health care for their employees. <br/><br/>If California is any indication of the lack of affordable health care in small businesses created in the rest of the United States, there is a major problem. According to Small Businesses for Affordable Healthcare, out of all the businesses in California, more than three million employees are uninsured. Those who do have the luxury of health insurance provided by their small business employers have faced a rise in premium costs at over fifty percent. These grim numbers have made small businesses in California less than an ideal place to work. <br/><br/>In January 2008, the House Committee on Small Business met with many small business owners and heard first hand of the obstacles often faced by countless entrepreneurs. Though close to fifty million individuals nationwide struggle with being uninsured, more than half of these are either employees of small business owners, or the employers who operate the businesses. The magnitude of these statistics is outrageous, and small business owners have tried, unsuccessfully thus far, to fight a seemingly never ending cycle.  <br/><br/>Business are, unjustifiably so, having to make harsh decisions, such as laying off some employees in order to provide health insurance to those they choose to remain employed. Resources that should be spent developing and growing a business are instead being put to use dealing with the incredible amount of medical claim paperwork. Businesses are literally failing, in part, due to this health care crisis. <br/><br/>An article from the Robert Wood Johnson Foundation cited business owners as listing health care costs to be the most important problem they deal with in the companies. Imagine beginning employed with a small business and having a particular health care plan. Then, as time goes by, the business you work for begins cutting various benefits out of your health care plan and asking you to pay more and more of the premiums. This is exactly what many small business employees face. Because of rising health care costs, employers are unable to keep up with existing plans. In order to keep the employees insured, sacrifices must be made. <br/><br/>Although developing policy that will provide affordable health care in small businesses is not necessarily a new venture, small business owners and their employees are putting their hope in the new presidential administration to finally “get the job done.” They wish to be able to offer a good, affordable health care plan to their employees and focus on growing the business. More than anything, they are fed up with having to make a decision between the two.  <br/><br/>How it plays out, the world shall see. <br/><br/></p>

Often referred to as universal health care, national health care is a system of health care provided and run by a country&#8217;s government. The system grants free health care access to every citizen of the country. The exact healthcare services offered to citizens for free may vary from country to country, meaning that there will be some services which require personal expense to be able to access them. However, the vast majority of health services will be provided for free and paid for by national taxation. Many countries offer universal health care today, one of the first to do so successfully being Germany. The first country to ever implement such a system however, was Great Britain.<br />
Amongst the other countries to offer such a system are France, Australia, and Italy. Almost all of the more economically developed countries around the world offer some kind of universal health care system with the exception of the United States of America. In the USA the only way to access medical care is to have medical insurance. Whilst most industrialized countries offer some kind of free medical service to their citizens the structure of this system can vary quite a bit between nations. One example of this is policies regarding private medical care. In the UK it is common practice for doctors to offer private medical services outside of the free public system, but other countries have greater restrictions on such private medical practice.<br />
Universal health care is a very broad term that has many possible applications. However, the key feature is the provision of a free health service to citizens of a nation. Systems of this sort require huge sums of money to run. As such countries usually pay for such a system through national taxes which all citizens pay. In exchange for paying these taxes citizens are then granted free access to the national health system. It is the government&#8217;s decision as to who is entitled to health care and what sort of treatments are to be made available on the system. In some systems patients may have to pay for some part of the treatment whilst receiving the rest for free. This is a form of heavily subsidized treatment.<br />
Systems such as these have been proven to work extremely well in a number of countries around the world. Whilst these systems are inevitably very difficult to manage, the benefits largely outweigh the costs. Owing to this fact, many American citizens and politicians have suggested that such a system may be of benefit to the USA. Rising rates of medical insurance in the USA have driven many to see a national health system as a good solution. In recent times medical insurance costs have risen out of reach of the average citizen meaning that many choose to go without insurance every year. The difficulty with this is that if medical treatment does become necessary the costs of such treatment are enough to make a family bankrupt. Opposition to this view states that taxes are levied on those who least need such care. <br/><br/></p>
