On Friday October 1st 65 plus lawyers from Virginia, Maryland, West Virginia, North Carolina, South Carolina, Illinois, Tennessee, Arkansas, Washington DC, and as far away as California and Wyoming. We even had the privilege of two honorable judges from Virginia Beach and Portsmouth, Virginia in attendance. It was a full day of shared knowledge of the EC/IR Intoximeter currently used in 9 states. The speaker lineup consisted of Michael C. Dear Mr. Tillotson,

I would like to express my gratitude to you for representing me in court. I was arrested for Drivinf While Intoxicated. You made a plea agreement with the prosecutor for a charge of reckless driving, 24 hours in jail, and 6 months restricted drivers license. If I had been convicted of a DWI, my Air Force Squadron commander would have had justification to demote me one pay grade, along with other consequences. Because I was convicted of a lesser charge in civil court, my Air Force leadership decided against further military punishment. In a sense, with your representation, my Air Force career was not put in jeopardy.

For future clients, I would like to stress that making the personal sacrifice of serving time in jail benefited my professional career. Instead of trying my case with the odds against me, we decided to make the plea agreement which, in the end was a better deal for me. For this, I thank you Mr. Tillotson.

A letter from a Virginia DWI 1st client..this is why we defend Virginia DWI’s

Our law office just received the following letter:

Dr. Joe Citron & Mark Matney:

I wanted to take a final moment to thank you for all your efforts on my behalf. It’s been a long, arduous road, but I’ve finally reached the end of it. I wouldn’t have made it here had it not been for all of the work that you and Mark put forth.

I arrived at the jail at 9 AM on Thursday morning for my agreed upon 48 hours. I wasn’t looking forward to it, but I knew that it was for the best.

However, God smiled down upon me. At 8:30 AM on *Friday* morning, one of the deputies came to my cell and told me to pack up my things as they were sending me home that morning. I explained to him that I wasn’t supposed to leave until the following day, and his response was that he’d be happy to let me stay the extra 24 hours if I really wanted to argue with him. With that, I grabbed my gear and headed out the door into the welcoming sunlight.

I asked Mark about this and he told me that, while this sort of thing does indeed happen occasionally, it is quite far from common. He also said that there is virtually no chance of any kind that this would come back to haunt me later on down the road and that the courts or the jail would say “You only served part of your sentence.”

I am truly a blessed man.

Sitting in that cell gave me 24 long hours to contemplate my place in this world. After seeing the lengths that the two of you went to for me, I began to think about my own career. I’d always dreamed of serving my country in uniform – hence my continued attempts to join the Army – but I believe now I have a different calling. The very first thing I did upon leaving the jail Friday morning was to walk a block down the street to the Salem Public Library and get two books on law school. I’m very seriously considering becoming a lawyer once I finish the undergraduate degree I’m currently working on. If I can help even one person like the two of you helped me, it will be a career worth having.

Note: Chris was charged with a DWI:1st Offense with the legal defense of Mark Matney and the medical expert Dr. Joe Citron his charges were amended to Reckless driving. Sentence: VASAP, 6 months suspended/restricted license, $750 with $500 suspended, 90 days of jail with 86 days suspended.

— Jason Herzing tried to walk a straight line with both arms at his side. His steps were wobbly, his speech was slurred, and he struggled to obey the commands.

Police recruit Beverly Bond took his blood-alcohol level. It was .17 — more than twice the legal limit of .08.

“What does that mean?” Herzing asks.

“It means I’m going to have to put you under arrest for drinking and driving,” Bond tells him.

This is just the beginning of the DWI-DUI knowledge that Mike will learn over the next few days as he attends the 17th Annual Mastering Scientific Evidence in DUI-DWI Cases.

Seminar Overview

The 17th Annual Mastering Scientific Evidence in DWI/DUI Cases includes many of the top DWI/DUI experts and lawyers in the country. The seminar was founded by William C. “Bubba” Head, one of the deans of DWI defense law, in Atlanta, Georgia, in 1994. Texas Criminal Defense Lawyers Association and the National College for DUI Defense (NCDD) have continued the tradition of excellence for which this seminar has become known. It has been, and remains, the premier DWI/DUI Scientific Evidence seminar
in the country.

The knowledge conveyed by the presentations and experiences of the experts and lawyers included in this program, most of whom are available throughout the seminar to answer questions and discuss issues, is essential to any lawyer practicing DWI/DUI defense anywhere in the United States. Included in the program are longer presentations, which allow the speakers to impart in-depth knowledge—and not just hit the high points. The breath test machine breakout sessions provide lawyers throughout the country exposure to breath test machines and defense issues relevant to their jurisdictions. All the major machines are expected to be at the seminar for attendees to examine.

The culmination of the program is a mock trial, defended by an NCDD Regent, from a real-life case scenario that was tried in front of a real-life jury. The mock trial will be a breath test case. It was chosen because of its similarity to many of the breath test cases routinely handled in the courts in this country. The approach to the defense of this case will be usable across a wide spectrum of DWI breath test cases. It has no single “sexy” issue, but instead is designed to be more similar to the day-in and day-out breath tests cases seen by most DWI practitioners.

This is just one event out of the many Mike attends each year all over the country. Mike is dedicated to staying abreast of the latest scientific, medical,technological, and legal aspects of a DWI/DUI cases. Just as the title of Mike’s new book describes Virginia DUI Law: Understanding the Scientific, Medical, Technological and Legal Aspects of a DUI Case published by West.
