I woke up this morning to the announcement that Senator Cruz and Governor Kasich have teamed up to “Stop Trump” from getting the Republican nomination for president in the 2016 race.

I was shocked. It evoked an emotion of laughter and then annoyance and then a feeling of this is simply not right. Whether you are rooting for Mr. Donald Trump or not is irrelevant at this moment and let me share with you why.

In the utopia of a fair election, a candidate runs for office, talk to the people about who he is and what he believes in, how he will effectuate those promises on the campaign trail and why he believes he should lead the people. In an utopia democracy, there will be opposition and the opposition is tasked with sharing those same factors with the people over which they hope to rule and the best man win measured by the vote of the people.

We will not get into the delegate math in this article. This is what I have observed..it is politics as per usual. This is the other thing, I have observed, the electorate on both sides of the aisle plus the independents in the balcony, do not want politics as per usual this election cycle.

The combination of a Cruz and Kasich team up...is politics as per usual. Basically, their campaign stopped being about the country which is voting for Mr. Trump and becomes about their desire to become the most powerful person of the free world. Did I say this before, the people are not voting for Cruz and Kasich now. What am I missing? Oh, I get it. They are hoping that people are going to vote party line in the fall even if they dislike their choices because they are programed to do so?

The American Republican voters thus far have stated that they want a Change, they have shown their Choice called Candidate Trump and their Principles while different coalesce around no more establishment politician.

The only message being sent to the American people is that the establishment will do whatever it takes, to have the outsider not get on the inside. So now we depend upon investigative journalists to report to the people, how the Republican party intends to steal or I mean by the party rules unethically legitimately take away the votes earned from the primary voters. This is an election scandal unfolding as a narrative. This is an election scandal that in a 100 years will be listed in the countdown of political mishaps. This no longer is a Republican party matter. It is the rights of the people matter.

Perhaps the American Republican voters should unite and vote for Candidate Trump to send a message to the GOP. The message simply is that if it walks like a duck, quack like a duck, it is a duck and this duck is electorate manipulation.

Perhaps the American Republican voters that voted in the primary should file a class action lawsuit against the GOP if Candidate Trump is the front runner (I know, I know, he does not have the delegates as per the “rules”) and by the Convention rules, he is not selected.

Slavery was boldly legal once until the 13th Amendment. Perhaps the GOP rules need an amendment.

The very man that the pundits accuse of having no principles and decorum, appears to be the only candidate in the race not bending on who he is as a person or as the candidate. You may not like him, you may think he is a xenophobe, racist, anti everything not “White American” and male, but regardless of how you feel, I think ALL people dislike cheaters and I wonder if you attend the convention and vote against the front runner, if it means you are endorsing a system that cheats legitimately.

Ask yourself this:

Would you knowingly endorse a system that cheats?

Almost 40 years since the establishment of the Office of Science and Technology Policy(OSTP) and finally we are seeing progress with respect to diversity and inclusion. Science, Technology, Engineering and Mathematics (STEM) are crucial subject matters to the advancement of mankind. We take for granted our dependency on technology and how automation has made our life meaningful. How many times have you truly admired the minds of the engineers that created the car you rode in to work today? Do you even think about the evolution of writing instruments?

On Wednesday, April 13, 2016, President Barack Obama and the White House hosted the largest science fair since its inception. It included alumni from previous years and about 130 students representing over 30 States. During a press call yesterday, the speakers rightfully lauded the progress of the current administration’s policies and programs such as the My Brother’s Keeper (MBK).

The speakers were the Chief Technology Officer, Megan Smith, Cabinet Secretary and Chair to MBK, Assistant to the President, Dr. Robert Johnson, Ph.D. of the University of Maryland Eastern Shore along with Beverly Bond, Founder and Executive Director of Black Girls Rock, Inc. and Girls Rock Tech, Inc.

The newly announced commitments about the progress made by both the MBK’s program and this Administration’s emphasis on the youths, particularly the underrepresented minority population in STEM is astounding and one the country at large should support in one way or another. Over 250 communities have now committed to the MBK’s community challenge in making sure “every child in this nation has a clear path to success” stated Dr. Johnson.

CTO Megan Smith shared her enthusiasm for the STEM initiatives and its ability to develop the children’s “creative confidence.” It is quite easy to measure the progression of this administration's vision for the Office of Science and Technology Policy. Beverly Bond, the Founder of Black Girl Rocks has announced plans to implement a brother program called King Me.

Ms. Bond plans for King Me to provide an empowerment and leadership platform for boys to increase their critical thinking. The mission of King Me will focus on male leadership, STEM, media literacy and enhancement of critical thinking. It is her hope that the President’s MBK program along with King Me will convert the children from consumers into innovators.

The initiatives and commitments are coast to coast, a great legacy for this administration. The commitment and initiatives are all worthy of involvement. Let me highlight a few.

The highly charged and federally found to be racially divided city of Ferguson, Missouri will benefit from this underrepresented minority youth initiative. $10 million will be dedicated to underserved communities for the training of youths in computer science and information technology through the Ferguson 1000 organization.

Interestingly in our society we often do not think about displaced and disconnected youths with respect to their education and contributions to the future society. Well IDS is changing that vista. They will offer scholarship to 500 youths in jails, prisons, juvenile detention centers, and or homeless shelters. The scholarship will consist of a free virtual coding boot camps, including educational content, relevant software and tablets.

There is an App for everything these days and one of the partners decided to join that positive energy. PBS Science series NOVA will release a free IPad app game called the Black Holes. It is about astrophysics and the objective is to increase the children’s interest in STEM subjects and astronomy.

I started my career as a chemist and now I am a practicing attorney among other things. In my graduating chemistry class of twenty, there were only two African American students and we were both women. President Obama’s administration implementation of My Brother’s Keeper(MBK) will no doubt create a positive impact on black boys becoming men of science. I can sincerely state that my early science teachings prove instrumental to this day.

I close this article feeling like I have contributed to the President’s initiatives and commitments as I write from my Lenovo 100s Chromebook, another partner to the future of our minority youths in STEM.

Honorable Brown in his keynote speech shared that the Jamaican Diaspora is imitating the Jewish and American Diaspora model. Although unlike the Jewish and American Diaspora, Jamaica has a long way to go before discussing absentee ballots to facilitate voting by the Diaspora that are still citizens of Jamaica but residing abroad. Jamaica has always claimed its people off the island as it does those that are on the island. The room erupted in laughter when Hon. Brown even stated that Jamaica will claim you as long as you love it or anyone from it, which includes in-laws. Attorney Phidd of WPT had the pleasure of interviewing Hon. Brown before the event.

WPT: Where did you attend High School in Jamaica?

Hon. Brown: GlenMuir High School

WPT: How long have you been in the position you currently hold? Please state the actual position and…

Hon. Brown: I am Minister of State, Ministry of Foreign Affairs and Foreign Trade. January 6th would have been 1 year.

WPT: Congratulations! Congratulations!

I am sure I will hear most of the projections for trade and the Diaspora in your keynote speech tonight but what are some of the things, some of the bullet points that you would like to make sure that I get out to our audience?

Hon. Brown: Well, my main purpose here is to promote the Diaspora conference that is coming up in June and that is June 16-19. It will be in Montego Bay, at the conference center in Montego Bay. Ritz Carlton is the conference hotel and there will be concessionary rates. The theme this year is a “Nation on a Mission: Jamaica Diaspora Partnership for Development,” and our emphasis is on investment and trade and we are essentially pitching to the members of the Diaspora who are interested in Jamaica, that there are several business opportunities available…that we believe that these opportunities provide a value proposition which is a win/win proposition and whilst persons might have been engaged in the Diaspora movement since its inception, we think that this year…actually we are billing this year’s conference as a watershed conference to shift focus to investment and trade. The fact of the matter is that Jamaica has provided a lucrative investment spot for many persons and we believe that the Jamaicans in the Diaspora should seek to take advantage of those opportunities that are becoming available now.

WPT: What about some of the concerns that the Jamaican Diaspora in the United States has that they will be taxed twice based upon the amount of monies they invest. Some of the Jamaicans feel that since they are Jamaicans they should not be taxed again.

Hon. Brown: I am not aware that we have any double taxation. I don’t know where that came from. One of the things I think is that there is a lot of misinformation and that is not unique to members of the Diaspora in the States. That is anywhere you go. As far as I am aware there is an overall push to improve the business environment. Certainly, last year corporate tax was reduced from 29 percent to 25 percent and there is a commitment to further reduce taxation on businesses. One would appreciate that there is also general tax reform that is taking place as part of the improvement of the business environment. This notion of double taxation I don’t know where that came from.

WPT: What are they doing to assist the returning Jamaicans who would like to open a business in Jamaica and see the success of the business there? I had friends who had difficulty in transitioning there business to Jamaica. What are some of the things Jamaica has in place to help those who love Jamaica although it will take some time to get acclimated to the different environment to put things in place.

Hon. Brown: With any business there is a risk factor involved and persons obviously would have to do their due diligence before they set up in any environment. Having said that, what I would recommend are persons who are keen on in investing in Jamaica should seek and identify a local partner who has a better understanding of the landscape and that will allow them to make the transition much easier. In that regard, JAMPRO can facilitate that and help to partner people. But beyond that, this conference will seek to do that as well. We are going to have a marketplace in this conference that will seek to bring interested parties with like-minded people on the ground so that there can be a twinning of ideas. It may be that the area that the person has interest in is already on offer but the company in Jamaica may need, whether it is additional capital or it may need expertise that the person from the Diaspora might have and can bring to bear on that business… and that person could take an equity stake in the business. I can give you an example: Mr. Hawthorne who is the owner of Golden Krust Bakery partnered with Wisynco to carry their line of soft drinks in his chain. So “Bigga” soft drink is now available and other items. So there is scope for that.

WPT: That’s from Jamaica to the Diaspora. What about those that specifically want to still live here (U.S.A) and open a business there but is concerned about the bureaucracy. Are you going to address some of those concerns in the coming years?

Hon. Brown: That is what I am saying. We are working to bring the networking, the business facilitation through JAMPRO. But let’s use that as an example. There are persons who would have taken ideas from here (U.S.A) and set up successfully in Jamaica. Let’s for argument sake talk about bill payments, “Paymaster” is owned by a Jamaican who lived here (U.S.A) and who came back to Jamaica with that idea. Granted to the best of my knowledge that person spends some amount of time in Jamaica. But it is possible to have a business in Jamaica and move between the States and Jamaica. There are persons who currently now do that. Again, I am saying that with any business, people have to be prudent. They have to get on the ground and establish what the lay of the land is…but in most instances it is better to get a local partner who you can put some trust and confidence in to manage your operation whilst you are here. (U.S.A). The technology again will also assist.

WPT: We must wrap up now as the Consul General from Jamaica to Miami, the Hon. Sandra Grant-Griffiths has arrived and I must release you to her. What would you like to be your legacy? I don’t know if it is too early to ask that question, but perhaps you have already thought about that. What do you intend or what would you like to be the legacy of your tenure as the Minister of State for Foreign Affairs and Trade of Jamaica. What would you want me to tell the public?

Hon. Brown: Well, the first thing I want to have in place is a policy on Diaspora and Development, a policy on Immigration and Development. Secondly, more Jamaicans in the Diaspora seizing the opportunity to invest in Jamaica and once those objectives are achieved; I believe that we will have a dynamic relationship both for the country and for the members of the Diaspora.

Top Five Good Courtroom Practice

West Palm Beach, Florida, March 20, 2013-Today at the main courthouse downtown West Palm Beach a lunch seminar placed practicing attorneys and sitting judiciary face to face to discuss Good Courtroom Practice. This was an awesome idea put on by the Palm Beach County Bar Association and moderated by Grasford W. Smith, Esq. of Richman Greer, P.A. The Judicial panel had the Honorable(s) Catherine Brunson, Lucy Chernow Brown, Jack S. Cox and Jeffrey D. Gillen. A quick glance of those in attendance showed a diverse group of attorneys.

After listening to a wealth of suggestions, the following are my top five good courtroom practice to adapt based upon the combined views of the judges:

1. Advance Courtesy Copy of the Documents to the Judge: Send memoranda of law and its accompanying documents directly to the judge at least one week before your UMC hearing.

2. Brief is Better: Make your memoranda of law concise and precise. Take out superfluous and repetitive information.

3. Pay Attention to the Jury:

a) Watch the jurors’ faces and it will tell you how the case is going.

b) Take a non-lawyer with you to observe the body language of the jurors.

c) Ask the jury to take notes. Instruct them on where to take special notice on a document when possible.

d) Think like a juror when presenting your case.

e) Go through the verdict form with the jurors.

f) Talk to the jurors without being condescending and clarify your statements. “Remember there is a reason most newspapers are written on an 8^th grade level”-Judge Gillen.

4. Civility & Playing Nice With Each Other:

a) When an attorney says something rude in Court, turn to the judge to handle the matter. Don’t talk back to the rude attorney. You must maintain your dignity.

b) The rules require it and the judges expect it…try to work with opposing counsel before bringing the matter before the Court.

5. Opening and Closing Statements:

a) Make your opening statement interesting. Make it a story and paint a picture. Make it clear. Openings are often overlooked and they can set the tone for your case.

b) Your summation should be a story. Tie all the important and interesting pieces together.

The Immigrant’s Mother’s Day Is More Emotional Than Commercial

Fort Lauderdale, Florida, May 14, 2012-I had a great Mother’s Day weekend with my parents but in light of my current research on immigrants, I could not help but think of the one main factor affecting immigrants. This factor is the family structure. One of the participants in my research stated that immigration destroys families and it made me reflect on the mothers who have not seen their children in a long time due to immigration bureaucracy or bureau-Crazy as well as financial constraints.

Mother’s Day is celebrated with a fanfare in America to the tune greater than $10 billion dollars. However, the cost to a mother who can’t see her children in another country because she can barely pay her bills here is priceless. Priceless is that $300 airfare plus goodies. It is often more prudent to send home the airfare than to visit the children because $300 in most developing countries goes a long way. For example in Jamaica, the conversion would be greater than JA$24,000. Yes priceless because the average person perhaps spent more than one hundred dollars on mom yesterday, while this immigrant mother cried herself to sleep. The media often times focus on illegal immigrants or legal immigrants committing crimes but there is a human side to immigration.

This human side is the very reason why so many parents leave their children behind with hopes of returning for them. Some take them across the border illegally in a ride or die mentality for the lack of a better cliché. The immigration experience is multifaceted and cannot properly be addressed in this article. I just wanted us in our abundance in the U.S.A. (and I do thank the Lord for the abundance) to realize that while spending $200 on our Moms for the weekend seems commendable, it pales in comparison to what our Mothers do for us daily and incomparable to the mother who happens to be an immigrant away from her children.

Tampa, Florida, March 27, 2012-Outrage! Disgust! Sorrow! Empathy! Sympathy! Fear of the Times! Belief in the Justice System! The aforementioned are all the emotions and feelings I have had since the Trayvon Martin Killing was brought to my attention. I was cautious at first to write a blog because I couldn’t believe what was unfolding in the news and each day I had much to say but was so overwhelmed.

But today, I had to put my pen to paper because I need my readers and listeners to think, see and hear me clearly. God does not make mistakes! Trayvon Martin’s death is not and will not be in vain. George Zimmerman’s singularly became the catalyst that has Americans (Black, White, Indian, Asian, Hispanics, etc.) talking about black youths and their fate. That fateful evening/night on February 26, 2012 brought the sunlight called “Justice for All” at its highest and brightest glow on all the “Cities of Sanford”. Mr. Zimmerman whether in self defense or outright murder, took the life of Trayvon Martin but saved the lives of future young black youths who would die unnoticed in the “Cities of Sanford” around our country. Through Mr. Zimmerman’s act all eyes nationally and internationally are beaming on the City of Sanford, Florida. Their eyes are watching the police department, the local government and all derivatives thereof.

As an officer of the court, I could not call for a conviction without knowing all the facts. However, based upon the 9-1-1 tapes released thus far and other corroborated facts that the court of public opinion agrees with, I know I can call for an arrest and then let the remaining facts be weighed by lady justice’s scales. I believe in our justice system and although Richard Pryor once said if you go down to the criminal courts in any downtown where you live, you will not find “justice”, you will only find “just us”, referring to African Americans, I still believe the system works. Please indulge me and take a memory walk. Let’s make Trayvon, the color of water. Let’s make Mr. Zimmerman the color of water. Each of these individual’s reputation irrelevant. Mr. Zimmerman the do good neighborhood watchman takes his personal time and devotes it to looking for unwanted individuals in his gated community reasonably so due to a string of burglaries over the past year. On the night in question he sees Colorless Trayvon Martin, whom he does not know and due to Trayvon’s gait and then subsequent putting on of his hood, Mr. Zimmerman felt uncomfortable and wanted to query the identity of this stranger. We must assume at this point that Mr. Zimmerman knows all the residents by sight and has a right as the neighborhood watchman to know all visitors. If we take that as true, then Mr. Zimmerman in his right as a neighborhood watchman called the police to inform them of his observation and the police through the 9-1-1 dispatcher as its agent, advised him not to follow the stranger, colorless Trayvon Martin. Mr. Zimmerman does not heed the directives of the police and follows the stranger resulting in a dead colorless Trayvon Martin. The undisputed facts revealed Trayvon had permission to be on premises and he was carrying a can of iced tea and a bag of skittles. At this point, do you believe Mr. Zimmerman should be arrested? Should we have a new legal rationale where good intentions erase a bad act? Or should we leave it where good intentions mitigates a bad act?

Do you believe the police should look at Mr. Zimmerman’s act of firing that gun very quizzically? Since, if you lie to an officer you will be arrested, if you flee from an officer when he wants to stop you, you will be arrested, if you pick a fight unprovoked, you will be arrested, wait for it, wait for it, so how do you disobey a police directive to not pursue a stranger, colorless Mr. Trayvon, and then fatally harm that stranger and not be arrested? How?

Roland Martin of CNN said this is not a moment but a “movement.” It is a movement calling for an oversight of the police departments around our country. This is not an attempt to vilify the police. Most professionals must take continuing education to maintain their licenses and livelihood in this country. Do we know if the police department in the City of Sanford was up to par? Will Internal Affairs investigate if Chief Lee wanted to clean up the force but he was outnumbered by his rotten apples subordinates and went along with the botched investigation to keep his $102,000 per year salary?

If you take away the race of these individuals and make them Colorless, there is no way a reasonable person would not request an arrest of Mr. Zimmerman. This is not “a moment but a movement” and it’s called Justice for the Colorless.

West Palm Beach, Florida, March 23, 2012- It amazes me how the years go by but the bad behavior of the banking industry remains the same. This week it was announced that Bank of America (BoA) started a pilot program in a few States where about 1000 homeowners can become renters to avoid foreclosure. BoA will become the landlord and rent the home at market rate to the occupants. It is the bank’s way of keeping families in their community. The homeowner just has to turn over the deed to the house with no opportunity to own that home ever again.

I want to know whose brilliant idea was this. I remember a few years ago this very idea was suggested and the outcry was the morale of the homeowner. How will that family feel renting the home they put their blood and sweat into and the bank refuses to help them stay a homeowner? This is yet another attempt of BoA and the rest of the banking industry thinking profit over people.

I challenge you the reader to ask a friend, a neighbor or a family member about their process in requesting a modification. How many times does the bank request the same documents in a six months period? How many times while they are in the modification process, a foreclosure complaint is filed against them? How many people do you know that received a modification within a short space of time?

Instead of a new program that will displace the homeowner legally although physically remaining in the home, why not adhere to the current programs. Here is a novel idea, keep the homeowner a homeowner and not make them a renter. Any homeowner approached with this nonsense should first let the bank put in writing that they are not eligible for any of the current programs. Get those denials in writing first. After you have exhausted all of the current avenues available to you including filing bankruptcy, wait for the bank to file a foreclosure action against you and fight it in court. This will keep you in your house with you as the deed holder longer and perhaps by the time you are at trial, the enforcement of current federal programs can catch up. I encourage you to send their requests through the U.S. Postal Service using return receipts methods so that you have evidence of each time they received your response. Also, make sure you keep a copy of any document sent to the banks and record all phone calls and to whom in which department you spoke.

The banks are not into the business of real estate and they created this problem and good people should not suffer because the predator’s intent is now coming back to bite them in their wallets. Let’s take a stand against Profit over People in the mortgage Crisis created by the banking industry.

Really Newt? Legal But Not Really Legal! How Slippery of You!

West Palm Beach, Florida, November 27, 2011-I would be putting my law school education and immigration law and business law experience to waste, if I did not comment on Presidential hopeful Newt Gingrich’s latest act of putting his foot in his mouth. Newt stated that he would support a law that allows illegal immigrants to become legal permanent residents(LPR) but they would not be eligible for citizenship. Okay reader let me take a moment and scream again! Pause, pause, pause. Okay, I am calm. WHAT COUNTRY ARE YOU RUNNING FOR PRESIDENT? Newt, the immigration laws we currently have in place requires you to read it before wasting valuable time and money to debate any immigration bill you would put forth, if your statement is a window into your immigration solution brain.

I will use your prior acts as evidence that you support big businesses. If the previous statement is true then it stands to reason that you favor some form of legalization so that you can maintain workers for the farms and other jobs that are currently held mostly by the Hispanics who may or may not be illegal. It further stands to reason that you decide to live up to the meaning of your name (i.e. scale less and semi terrestrial) by appeasing your base with the “no path to citizenship” logic but trying to garner votes from the Hispanic community with your pseudo pro-immigration stance.

This article is really not about you but about the fact that you are not aware of the current reach of the immigration laws we have in place. Newt, are you aware that the law currently requires businesses to not hire illegal immigrants but the federal government would rather punish the worker than sanction the business? Are you aware that we have Europeans, okay let me not sugarcoat it, foreign Caucasians working illegally here not just people with a high percentage of melanin? Are you further aware that the United States of America’s Constitution gives the highest form of protection to its citizens and not to its residents?

So if I am to understand you correctly, we will give legal permanent resident (LPR) status to the current illegal population but they cannot become a citizen which means they cannot vote. So they would be paying school taxes and property taxes but cannot vote on how it is being spent in their county/city. Also, you cannot hold most federal jobs unless you are a citizen. So Newt, is it your intention to keep these immigrants from reaching the stars? This is sounding like our current immigration law that allows a LPR to join the arm forces and possibly die for the United States before meeting the eligible time period to become a citizen. Are you going to change that rule Newt, so that the day you join the arm forces, that very day, you are a citizen or at the very least, the day you complete basic training?

The current law requires deportation or removal of a LPR if certain crimes are committed during this status. How do you balance the scales of justice with regard to the application of the law between your LPR and the current LPRs? How do we address the inequity of a LPR that cannot become a citizen based on Newt’s immigration law while on the other hand a business man from Canada, Israel, England, Africa, anywhere depending on the business visa for example L-visa will be allowed to become a LPR and subsequently a citizen. Yes, I know that the business man would have entered the country legally but the glaring truth is execution of the law between those with money and those without. Let’s not go down the money road right now. Some things are just facts and no point in debating them.

Back to Mr. Presidential hopeful Newt Gingrich. I had no emotion or time invested in the presidential race for 2012 but Mr. Gingrich’s comment just touched a nerve because immigration law has many layers at any given time to any applicant and will not be solved with one broad brush.

I have a suggestion though for Newt to ponder. Why not stop accepting H-1B visas applications for the next two years and in that time encourage businesses here to hire from the pool of unemployed professionals? Why not reduce the amount of welfare recipients by encouraging businesses to hire from that pool first and NO TAX INCENTIVES for them to do so? Why not sanction a business that hires an illegal alien as oppose to jailing a person who is earning an honest living?

I could go on and on but what’s the point. Mr. Gingrich and others like him may be more xenophobic than they are about finding a solution for our immigration issue and since I will not be able to get their true feelings, I will end here and SCREAM again. Really Newt? Legal but you don’t count when you should count?

West Palm Beach, Florida, November 07, 2011- Palm Beach County Bar Association (PBCBA) has come a long way since its inception in 1922. There are more women involved as well as more minorities. Most notably is that today, John Howe, Esq., the president, is an African American man born to Jamaican parents. This speaks to the growth of this county and its bar association.

On Friday, October 14, 2011, PBCBA held its Second Biennial Diversity Summit. The keynote speaker was Florida Supreme Court Justice James E.C. Perry and there was a panel representing the cross-section of practice. I was invited to this event by Florida Bar Board of Governor David C.Prather, Partner, Clark, Fountain, La Vista, Prather, Keen & Littky-Rubin. I am grateful to him for my introduction to the Palm Beach County Legal Community in this manner. When I entered this event, I was met with welcoming arms by Attorney Marjorie S. Desporte, Department of Children and Families and Kathy Clark, Administrative Assistant, Palm Beach County Bar Association.

Keynote Speaker Justice Perry’s address was transparent and beautiful. He told of his journey to Florida’s Supreme Court and he did not sugarcoat it. His story is one of persistence and perseverance. He did not let any negative situation that was perceived to be race motivated affect his drive and outlook in his legal career. Whenever he was overlooked for a position or a judicial position, he viewed the rejection by the hiring team as “making a bad choice.” He encouraged us not to be dismayed when we hear the word “no” because “…no is an answer.” He fears that the perception of justice by our citizens may be tied to the race makeup of the judicial system but presses that no matter what “the court must be perceived to be just.”

The panel segment of the summit was very engaging. The panel gave great suggestions on minorities getting employed, staying employed and employers increasing and including minorities in their firms. A few of the comments resonated with me. Willy Ferrer, Esq., U.S. Attorneys Office Southern District, puts the onus on the hiring committee to ensure they are diversity conscious. This was a very important point that often gets overlooked. The human resources department/recruiter is the gatekeeper and we do not know how a company monitors that division to ensure all qualified applicants are put through regardless of race or gender. Anna D. Torres, Esq., Partner at Powers, McNails,Torres & Teebagy was very vocal and one of her suggestions touched on cover letters. Cover letters are often overlooked as important to the applicant but it is very important to the recruiter. Attorney Torres suggests that the cover letter reflect who you are as a person. She suggests giving some personal experience with limited information to help the reader know who you are quickly. Last but not least is a comment by Ethel Isaacs Williams, Regional Manager, Corporate External Affairs, Florida Power & Light. Attorney Williams suggested that minorities once employed by a company should make sure they are included. She suggests that not only should the company be “committed to you” but you must be committed to them.

The Summit appeared to have met one of its objectives which is the dialogue on including minorities once employed. I wanted to hear more from larger firms on why they believe the attrition rate of African Americans in their firm is so high. I wanted to hear how these larger law firms engage the African American Attorneys to stay included and a part of their company’s process. Perhaps in two years at the next Summit these questions will be answered.

Monday, March 14, 2011 brought to my attention a towing and parking lot situation that is a rip-off to Tampa residents and visitors that utilize these private lots.

My car was parked in the Theros Parking Lot located at the corner of Cass Street and Morgan Street across from the greyhound bus station. I went to my scheduled administrative matter at 11 am and when I returned at 3:15pm my car was missing.

I was informed by a colleague where to go and when I went to CIS location, sure enough my car was there.

I was told that my car was impounded for double parking in this practically empty parking lot. I had to pay $119 cash to retrieve my vehicle. Also, please note that you had to give them exact change or they will hold your car over or take the remainder of the funds. This means no credit card of the sort can be used.

For the record I DID NOT DOUBLE PARK. They showed me a photo of my right back tire being on the yellow line and so to them I doubled parked. Well, although I am an attorney and can take this to court, I have decided to help the public by sharing this legalized thievery.

If you must utilized downtown, DO NOT USE THIS PARKING LOT! If you must use this parking lot, please make sure you take a picture of your vehicle, how you are parked and the lot before you leave the location. It has come to my attention through my colleague that it is a constant practice of this parking lot. If you live in Tampa, please let the county commissioners and the city council members become aware of this. If this has happened to you before, please comment on this blog so that the respective politicians in Tampa, Florida can become aware of this and audit their records to see how many other citizens they have legally stolen from. Remember, take a picture when you park at THEROS PARKING LOT AT CASS STREET AND MORGAN STREET IN TAMPA, FLORIDA.

We Are Citizens of the World – Continuing the Legacy of Martin Luther King, Jr.

A lecture series is typically an underutilized program by the community within the immediate vicinity of most universities. However, the University of South Florida (USF) seem to have figured out the needs of its surrounding community because on Thursday, January 20, 2011 the Marshall Student Center Ballroom was bursting at its seams. The Event…Tampa Bay Black Heritage Festival (TBBHF) partnership with USF’s Lecture Series. The Speaker…Martin Luther King, III. The Atmosphere…riveting and holding onto to every word uttered.

I had the pleasure of asking Mr. King one question during the reception prior to his lecture. I wanted to know what speech, saying or thoughts he has of his late father during his most private moments. His response was simply remembering the faith his father had and how much of a praying man his father was. He went on to say he remembers, and I paraphrase, standing for justice, for righteousness and for truth in his most private times. This set the tone of the evening for me.

Martin Luther King, III is a humble and fascinating man. He was recently honored by invitation from and is now a member of the Alpha Phi Alpha fraternity and in 2006 established his own company “Realizing a Dream.” My blog however is not about his traditional accolades but about his message.

He shared with us his true dilemma of whether we should “celebrate” or “observe” his father’s birthday which is a federal holiday. After many anecdotes, several lighthearted moments and a few outbursts of agreement from the crowd, we were given his perspective of how to treat Martin Luther King, Jr.’s holiday. We heard about his father’s three evils to eradicate which are poverty, racism and militarism. He opined about our legal system with respect to criminals. He believes that it should be called the “Criminal System” instead of the “Criminal Justice System” because “justice” is missing. To bring this point home, he quoted the late Richard Pryor, who said “When you go to the courthouse looking for “justice”, you will find “just us”(us refers to African Americans).” The audience laughed as they equally murmured “true”.

Martin Luther King, III in his own right not only continues the rich legacy of his father but has also created his own. He wishes to see and is working towards society having a “communal atmosphere and attitude” to lift up everyone. His wish list continues with the hopes of every American having a “decent” home and health care. He challenges the current political system to explain how we can “spend on death and defense” and not on “life and the preservation of life.”

He brought us into his life and how he lives by his mother’s teachings that you should “despise the evil act but still love the individual.” This was a poignant moment in his speech because he reminded us that through the ages of 10 until 18, he experienced the death of his father, uncle disappearing and his grandmother being gunned down in church. His perspective of Martin Luther King, Jr. is that we should “give to the next generation.” He views our existence as a “world community” and that we are “citizens of the world.” His parents taught him to love self, family, community and God. When you sit and listen to Mr. King, you can connect the dots of his parents’ unity with how they brought up their children. Coretta Scott King attended Antioch College and the words of the school’s first president Horace Mann lives on and left an indelible mark on Martin Luther King, III…“Be ashamed to die until you have won a victory for humanity.”

Martin Luther King, III believes that we should “observe” his father’s birthday and the defining moment to determine “celebration” will be when we as a nation start to love unselfishly and seeking nothing in return. This is known theologically and philosophically as “Agape” Love.

Leadership: The Right to Be Civil Through the Eyes of a Black Journalist

Tampa, Florida, January 20, 2011-The Tampa Bay Black Heritage Festival (TBBHF) for over a decade has carved out ten days of pure unadulterated celebration of Minorities locally and nationally. Every year, the Tampa Bay community looks forward to the two day street festival, its world renowned artists, local sponsors, food and activities. However, the Heritage Festival boasts more than just fun and games. The week and a half long list of activities includes financial education, empowerment, art and movie review, lecture series and health education to name a few.

Civil Rights, female, journalist, 1950’s, Ivy League education and Tampa Bay had one thing in common on January 19, 2011 and that was Dorothy Butler Gilliam. Ms. Gilliam was the keynote speaker at the Heritage Leadership Luncheon, a prominent event for TBBHF. It was more important this year to a small group of us and we are the members of Tampa Bay Association of Black Journalists (TBABJ), the local chapter of the National Association of Black Journalists (NABJ).

When Ebony T. Grimsley, Secretary of TBABJ brought the suggestion for the group to attend it was a unanimous vote and the group secured a table at the event to hear this legend in the field of journalism.

Ms. Gilliam joined the Washington Post in 1961 during the height of the Civil Rights movement. She was their first Black female reporter with a long list of accolades to follow her through her life until retirement in 2003. Ms. Gilliam’s career is impressive which include working at Tuskegee Institute and Jet Magazine.

However, I was most impressed not just with her career but with the oral history she shared about the tenacity of a young Black person during the time when Black life was not worth a dollar and a Black woman life was worth even less. Ms. Gilliam resting comfortably in her slender frame was a fighter, visionary and had a larger than life determination to succeed. She demonstrated it when she told of a sua sponte decision to go to Little Rock, Arkansas to cover the nine African American students' journey in integrating Little Rock Central High School in 1957. This time the story was not told from the perspective of just the racial tension and animosity during those times. It was told through the eye of a young woman who although she was educated from Lincoln University, because she was an African American, she could not wear a press badge boldly. She told of the cramped living conditions the journalist endured at the risk at being lynched. She watched her boss get pummeled by humans and the system and she decided the story had to be told and she would join the other Black journalists in telling it, do or die. She did… that I, a blogger, attorney and an educator, can now reap the benefit of hearing for myself what it means to be committed to your craft in spite of, despite of and without excuses. A Heritage Leadership Luncheon indeed!

It was an interesting story and so I leave you with this question? When was the last time you took the initiative to evaluate your career, community efforts, familial situation and think out of the box for the benefit of the next generation? What’s Your Cause?™

Civility in Politics: The McCain Perspective

Tampa, Florida- The University of South Florida’s campus is no stranger to me due to my affiliations but on October 20, 2010 I did not know what to expect. As I entered the auditorium and observed the young minds waiting eagerly on the University Lecture Series guest speaker, Ms. Meghan McCain, I wondered if it would be an informative night or just the continued political rhetoric.

Although I was not impressed by her entrance or the delivery of her speech for an intellectual forum, I was impressed by her honesty and willingness to stand on her principles. She emphasized her support for gay rights and marriage equality and interspersed throughout the speech was the promoting of her book. She laid out for the young people that she believes that the Republican Party needs new ideas while being guided by old ones. She took us through what she deems her evolution into a Republican. She admits that she rebelled against her father and registered as an Independent 8 yrs ago upon turning 18 yrs old and later voted for John Kerry. Her claim is that her opportunity on the campaign trail gave her new insight into the Party and lead her to be a card carrying Republican. Here’s the thing, Ms. McCain somehow convinced herself that she wasn’t always a Republican at heart despite being born and raised by Senator John McCain. As I sat there listening, I wanted to shout “you were always a Republican, so it is not an evolution but more of an acceptance.” I’m glad I did not because as I listened more she became more apparent.

Her candor was astounding. When asked about her political aspirations, she said she was too honest for that profession. Needless to say, if you did not know who Christine O’Donnell was before meeting Ms. McCain last night, you certainly left knowing that McCain thinks O’Donnell does not belong anywhere in the political arena. If O’Donnell’s parapraxis is demonstrative that she does not know or understand the first amendment, then Ms. McCain’s opinion of her may be well placed.

Ms. McCain’s message was current for our times because she appealed to the Republican Party to “stop being stubborn and closed minded.” She pointed out that the MSNBC’s Keith Oberman and Talk Radio Show Host Rush Limbaugh were equally doing damage for each major political party to their respective listeners. A point I believe most citizens would agree is an accurate perception. I applaud her to tell Republicans not to be racist and even more so respect her for espousing that the Arizona Immigration Bill although it might protect her immediate borders from terrorists, it is racists as it currently stands.

Ms. McCain described herself as a “Progressive Republican” and after listening to her views on the NY Mosque, immigration, women being civil to other women and her support of Charlie Crist for the U.S. Senate, I have concluded that she is an “Independent.” After all, if you are not an extremist, you are moderate and if you are a moderate, more likely than not, you have supported issues for each major party and if that is the case, I pronounce you an independent. Side Bar: I believe most of us are independents but we are not carrying the Political Card to prove it.

Good luck Ms. McCain with your book and your tour, while you are a card carrying Republican it is good for that Party because the world knows they need a voice of reason such as yours albeit the mask of an Independent which I predict is the moniker for the next generation of voters.

It was an evening befitting the motto of Haiti, translated “In Unity There is Strength.” Last night a private reception held at the Consulate General of the Republic of Trinidad and Tobago, Miami, Florida in honor of the Honorable P J Patterson, former Prime Minister of Jamaica was a microcosm of the Caribbean.

The Most Hon. Percival James Patterson, O.N., O.C.C., P.C., Q.C., was appointed by the heads of Caricom as the special representative of the Caribbean Community on Haiti. Prime Minister Patterson is in town as the guest speaker at the 12th Annual Eric E. Williams Memorial Lecture to be held October 15, 2010 at Florida International University. The Eric E. Williams Memorial Lecture Series is presented through a collaborative effort of the Eric Williams Memorial Collection, African & African Diaspora Studies and the School of International and Public Affairs at F.I.U. Erica Williams Connell the daughter of Eric Williams and the Executive at the Memorial Collection stood proud as she observed the legacy of her father, a pioneer for the Caribbean.

The evening started with the Chair of Caricom Consular Corp. Haiti’s own Consul General Ralph Latortue welcoming the attendees and honoring the prime minister. CG Latortue’s standing at the podium was significant for the moment and historical for the future because it was in recent years that Haiti became a full member of Caricom. Although Haiti has been a member on and off throughout the years, it was the Hon. P J Patterson during his tenure that helped to solidify Haiti’s position with Caricom. Prime Minister Patterson spoke briefly but not without hinting that Miami may very well be a Caribbean City.

The room was filled with local politicians and Island Consuls General representing, Bahamas, Belize, Haiti, Jamaica and Trinidad. Consul General Laurie Marie West of the Republic of Trinidad and Tobago addressed those in attendance. She emphasized that the night with all the wonderful delicacies depicting the cuisine of Trinidad and the rest of the Caribbean was a result of the concerted effort of the Caribbean community.

After a series of speakers such as mayors and council members representing local government, Dr. Carole Boyce Davies read a litany of proclamations. It was a great feeling throughout the evening as the community celebrates the coming together of the Diaspora to support the reconstruction of Haiti.

I would be remiss if I did not mention that in attendance were Marlon Hill, Esq. one of the founders of the Caribbean Bar Association (CBA), current President of the CBA Sheldon Philp, Esq., immediate Past President Cherine Valbrun, Esq., Hulbert H. James of the Diaspora Project, President of the Grenadian Association, Roslyn Alic-Batson, Pat Montaque of WAVS 1170 AM, Executive body of the Lily Foundation for Human Development, Kaye Chung of Caribbean Airways- Air Jamaica and last but not least, Cheryl Wynter of Jamaica Information Service.

It was an honor for me to have interviewed the former Prime Minister of Jamaica along with the Consuls General and I will report on those interviews in Part III of this article.

TAMPA, FLORIDA- It was only a few weeks ago my Pastor told us about the acronym W.E.L. What is that you ask? It means “Will Explain Later”. In that, sometimes you cannot explain in the immediate the reason something occurs and at that moment do not question it. Just wait. The answer will appear later. I had a W.E.L. moment in covering this story. Typically, I write on a story immediately after observation, but the Haitian Memorial and coverage of the Ambassador was a little different.

I did not want to report on this heart wrenching story in a heart wrenching manner. We know the story and it has been told in many different ways on major news media outlet such as CNN, Times, Tampa Tribune etc. I knew I wanted to do more than reporting and every time I sat down to pen this story to paper, or computer as is the case, my brain was bored until, earlier this week. My W.E.L. moment occurred at the United Negro College Fund’s Annual Luncheon in Tampa, Florida. The keynote speaker was Tampa’s own Mayor Pam Iorio. How is this related to the Haitian Memorial and Ambassadeur Raymond Joseph’s visit? Well, she gave her family history. In that her father was an immigrant from Italy. She is a first generation immigrant. She told of her father’s drive to achieve and succeed in this country from speaking very little English to becoming a professor. She shared that the Fannie Lou story was one of her women’s uplifting historical moment that keeps her going.

Again, what does that have to do with the tragedy in Haiti? Everything! It draws a nexus between Tampa’s Mayor and the immigrants and their descendants’ here in Tampa. In Tampa, the Caribbean population is dispersed but in St. Petersburg, Florida, there are more concentrated. Due to this fact, the local government in St. Pete was always aware of the issues affecting their immigrant community namely the Haitians and the Russians. Mayor Bill Foster at the press conference on Thursday, February 18, 2010 regarded the press conference of Ambassadeur Raymond Joseph as a “tragic but civic occasion.” Mayor Foster further appointed two emissaries to Haiti. The appointees prior to the appointments had established relationships in place with the Haitian community.

The Ambassadeur’s visit to the Tampa Bay area to attend the memorials would not have been possible without the planning efforts of Sanya Grandchamp of Mango Network, the alliance of all the Caribbean Organizations in Tampa and friends of the Caribbean. For weeks this coalition worked tirelessly with the American Red Cross to raise funds for Haiti.

The Ambassadeur is certainly a man we should all get the opportunity to meet and converse. He is genuine and has an undying love for his country, their people and overall friendships. I went to interview him and ask just a couple of questions, “what are we doing to give a semblance of normalcy to the students?” “Are we able to hold school for at least a couple of hours daily?” His faced immediately expressed the sadness of what he had to espouse which is, we [Haiti] are not there yet. The extreme sadness was explained unwittingly a little later when he was gifted a book by the Carver G. Woodson Museum. His thank you speech repeated an answer to an earlier private question, in that if he had a wand, he would fix the educational system in Haiti. This man loves education and education of young people.

Ambassadeur Joseph always take the time when being interviewed or in giving a speech, whether he is on CNN or in a small gathering to remind the listeners of the part Haiti played in assisting in the Louisiana purchase and that they are the first freed Black Republic. This is seminal. The unfortunate tragedy of the earthquake in Haiti brought attention to the Haitian immigrant population across the world and to the Caribbeans here in Tampa. The international community has risen and will continue to rise to the challenge to assist Haiti to become self sustaining after the earthquake.

Here in Tampa, we have offered our hospitals, citizens and resources to the victims of this natural disaster. However, the big picture is that the Caribbeans at large, English speaking, Dutch Speaking, Spanish Speaking and French to name a few showed their numbers in Tampa. This number will be further counted as we approach March, census month. Both Mayor Iorio and Mayor Foster have gone above and beyond the call of their office to reach out to the Haitian community in this tragedy. Each donated their land space for the memorials and honored those grieving with their presence.

Reverend Gerly Germain of the Bethanie Seventh-day Adventist Haitian Church of Tampa, gave a tribute at the Tampa Haitian Memorial. It was so touching because he lost his father in the earthquake. His father survived the initial earthquake but on his way to pick up his wife, a building succumbed to the earthquake and fell on his SUV. Reverend Germain’s church has shipped hundreds of thousands of food and tents to the Haiti. However, your assistance is still needed to send more food and tents. Tents especially are in great demand as rainy season is upon them. You may contact Reverend Germain to donate food and tents at (813) 802-2808.
It took a tragedy and humanity to pull the dispersed Caribbean community out of their neighborhoods to the focus point of civic need and I hope they continue to show their support for all causes in Tampa Bay and show their numbers because Haiti’s motto is so apropos and should be the Caribbean’s motto…… “In Unity There is Strength.”!

The Empowerment of Black Men Through Corporate and Individual Partnerships

Seagram’s Gin’s Pursuit of Excellence Training Institute Graduation was held at the InterContinental Hotel in Westshore, Tampa on February 23, 2010. I was invited to this event by a colleague Attorney Charles M. Holloman II. He knows I champion diversity and matters that affect the community and thought I would enjoy the event and get to observe an evening with his organization, The 100 Black Men of Tampa Bay, Inc. What I experienced was simply beautiful.

The food was just right with vegetarian selections and seafood that was beyond delicious. (I mention vegetarian selections because these events tend to cater mostly to carnivores of which I am not one.) The food was duly noted and the chef deserves a pay raise. The emcee for the event was Steve “Stu” Robinson of WBTP-FM's. This article however is not about food, Mr. Robinson and ambience. It is about the positive impact a community that partners can have on its citizens. Seagram’s Gin’s Pursuit of Excellence Training Institute selects ten young Black men between ages 25-32 for a program that “celebrates African American Male Achievement”. This “cause-related” employment and job initiative is Seagram’s Gin’s way of giving back to the community in which they do business. The young men are mentored by business men of all races and a $2,500 scholarship was given to the highest achiever, 29 year old Reginald L. Burns, II. The ten graduates representing Tampa Bay are Downy Belidor (28), Alphonso Cromartie (26), Raul Gordon (26), Joseph Harris (26), Keto Hodges (29) and he is from Haiti, Dominic Lewis (31), Rashad Peterson (26), Elbert Taylor (31), Michael Williams (27) and Reginald L. Burns, II(29).

The room was filled with family and friends of the graduates. However, I observe three men being the proudest of the program and the initiative and they are Mr. Albert Lee, Jr., Mr. Henry Bell and Mr. Bill Cherrie. Mr. Cherrie, Vice President of Multicultural Marketing for Pernod Ricard USA, Parent company of Seagram’s was as genuine as you can get. Often times these corporate programs appear as a tax right off or some form of tokenism. I will say in my conversation with him, I was able to quickly discern that he is astute. He is a Caucasian man in the right position because race is not an issue for him, excellence is. He believes in the corporate program and it was not a routine initiative for him.

Mr. Lee, Jr. is the Chairman of the Corporation to Develop Communities (CDC) of Tampa, Inc. board. Mr. Lee, Jr. not slated to speak but was invited by the CEO of the CDC, Ms. Toni Watts to give a few words. His few words were not only plenty but powerful and empowering. He commanded the room as he started to address us because he made us recognize the young men and recognize each and every person that paved the way for the minority community in Tampa. Special recognition was given to Ms. Chloe Coney who had the vision for the CDC. The room was all ears even the inanimate things because Mr. Lee, Jr. brought home that each of the graduates already have in them what they needed to succeed from the day they were created and that the partnerships were merely tools to assist them in achieving. It was a great speech, a speech for champions, a speech for excellence.

Mr. Henry Bell, the outgoing president for the 100 Black Men of Tampa Bay, Inc., addressed us from the “It Takes a Village” angle. It was well suited for the event. These men were mentored by business men that simply wanted to see other men achieve, the very essence of the 100 Black Men.

Service is so important. All of us should volunteer in one form or another. This was emphasized by the keynote speaker, Edward A. Johnson, Manager of East Tampa Community Redevelopment Area. He encouraged the young men to give back to Tampa or any community that this experience leads them to because it is about caring for your fellow man.

Mr. Cherie during our conversation wondered about a practicing attorney blogging. I told him that there are about 80,000 lawyers in Florida and community events makes my life interesting. I hope this story empowers your organization to also make a difference.

I don’t drink alcohol but I’ll toast with a Seagram’s ginger ale with real lemon…cheers to Seagram’s Gin.

Ms. Phidd expressed to those in attendance how thrilled and honored she was to have been personally asked by Co-Founder Attorney Stewart and Chair person Attorney Person to host the event. “…30 years ago when the founders launched this event, I was merely a child in Jamaica, West Indies.” Ms. Phidd beamed from the podium. “To see myself now an American citizen and being a part of such a historic event means the world to me.” She continued.

Tampa Organization of Black Affairs, known as TOBA host a leadership breakfast every year on Martin Luther King, Jr.’s birthday. The event boasted politicians, educators, activist groups, local government and various corporate entities. There is a youth oratorical competition held months prior to the event and the runner up was featured at the Sponsor’s reception. The winner, who featured at the breakfast this year, was born to Haitian immigrants.

TOBA’s mission to continue to advance the minority community and reach a cross section of Tampa Bay was certainly magnified at the reception and at the breakfast. This event marked the beginning of a great year on the circuit for Ms. Phidd and what better way to start it than with colleagues and a good cause.

The event this year honors 36 principals from local public schools. In addition, there are three exceptional public housing students selected as the recipient of the Dr. Margaret Fisher Scholarship. The keynote speaker is Hillsborough County School Board Superintendent Mrs. Maryellen Elia.

Talk show host Alicia M. Phidd is a practicing attorney and an adjunct Associate Professor at a local university. Naturally, she is excited to emcee an event that champions education and the great principals that make it possible for all children in the public school system. Although her law degree was obtained from a private institution, her foundation was set by attending a public high school as well as a State University in New York.

Speaking to Children is Not a Novel Idea for Politicians

This morning on the Alicia Marie Phidd Report we discussed many things including President Obama’s Speech scheduled for Tuesday, September 8, 2009. The speech is set to engage students and speak on personal responsibility among other things. The Department of Education suggested classroom activity for before, during and after speech to all grade levels.

This speech has been politicized by Republicans as a speech of indoctrination due to some of the suggested activity including the students write to the President suggesting how they can help. Some schools are electing not to broadcast the speech for technical difficulties and other miscellaneous reasons. In addition, parents are threatening to remove their children from school on Tuesday.

I feel the need to blog on this matter because it is politicized to the effect that it is being called an indoctrination of young minds. This is just appalling. Parents have the option to not send their children to school that day. The schools have the option to not use the suggested classroom activities. What exactly is the problem here? I submit to you my public that you go to the www.ed.gov website and familiarize yourself with the suggested activity relative to the grade of your child and then make your determination.

In the recent past, former Presidents Reagan and Bush addressed students and it was televised nationwide. The speech of President Reagan is archived on my website for your viewing. After you review it, let me know if you have a problem with that speech and then review President Obama’s speech to be released on Monday and let me know your thoughts on the comparison.

If we believe that the message of personal responsibility is good and that young people, i.e. kids can give meaningful insights, then why shouldn’t their questions and thoughts be solicited?

For the record, the former Presidents who were Republicans were opposed by the democrats on their intended speech as well. My directive to you is to stop politicizing matters and issues that can make the country as a whole better. If you disagree, do it on good solid factual reasons and not propaganda. Parents, please “parent” and always try to educate yourself on matters so you can make informed decisions.

Judicial Justice & Society Rhetoric

This week in review has everyone heads spinning. First let’s lead off with a theory. Let me ask you this…if you committed an act that society deems a crime. You were arrested and you plead guilty and saved tax payers some money from a trial cost. You served some time in jail for this crime. You are now back into society, would you want your friends and family to shun you, not want to house you or feed you? If you wanted a job, would you not expect to be hired? Let’s substitute friends and family with society. Would you expect society to have a conversation about you and the crime you committed and whether they should forgive you? Remember the answer and now let’s get into the story. The Michael Vick Story.

Mr. Vick a horrific person when he participated and funded dog fights. In addition, perhaps contributed to the death of several dogs during the course of his dog fighting career. He served 18 months in prison and during that time lost his home and millions of dollars. He was released a few weeks ago and since then landed a job with the Eagles football franchise. He has teamed up with the Humane Society and offered a public apology for his heinous criminal acts. Shouldn’t that be the end of it? Should we not at this point forgive him and let him live his life?

Well, the answer is no for hundreds of people that are actually picketing the decision of the football franchise to hire Mr. Vick. I was listening to talk radio this past week and heard a caller said that she believed in the judicial system what kind of message is that since he will be making his millions of dollars. Another said, he does not want to watch football and cheer for a team that such a reprehensible person is on.

Okay, here is my take on it. Legally, our judicial system worked where a crime against animal has a jail sentence and the perpetrator Mr. Vick served his time. He had a career before he went to jail and he resumed that career upon returning from work. His old employer did not want to hire a felon but another company was okay with his felony and hired him. Here is my question you on your moral high horse. If his career was that of a cashier that makes $10/hr and he served his jail time for the same crime and upon his return to society went back to that career would you feel the same way?

If the answer is yes, then when was the last time you requested Walmart or any establish that you frequent on a weekly basis to let you know their employees committed a crime and what crime was it so you determine if you want to boycott that establishment?

I’m not done! If the answer to the scenario regarding the cashier is No! then, you are not having a problem with the franchise hiring him on moral grounds you are having a problem with his current and future earnings. I then find you morally reprehensible and despicable. The situation is simple, a man commits a crime, he serves his time, he returns to society and becomes a viable person in society by working. He is not a societal burden because he went into the penal system. Those of you that are against his return to work because that is what it is, work, those of you that are against it should truly weigh your outrage. Do you want a society that does not believe in rehabilitation or a society that hates the rich?

Think about it seriously, unless you are self employed it is a rich person that is hiring you, so you can pay your bills. This man served 18 months in jail for killing dogs and the Lockerbie Bomber served 21 years in jail for killing 270 or so people. Turn your outrage to the Lockerbie Bomber situation because that requires disgust at the politicians that released a terrorist on compassion.

Mr. Vick should live his life in peace because if you don’t like him then don’t watch the franchise he plays for and use that time spent watching football to go PLAY with your children and have quality family time with them so they too may not be a statistic one day.

Morality and the Work Place

This week I couldn’t help but discuss this trend I’m observing all over our nation regarding employment, perception and morality. In late July of 2009 pursuant to newspaper reports and an on air interview of the husband by NBC, a town manger was fired because of his wife’s occupation. The town manager of Fort Myers Beach, Mr. Scott Janke was hired in March, 2008. He got married to Anabella Moto in October, 2008. In late July, 2009 the Mayor, Larry Kiker learnt of Mr. Janke’s wife’s position and held an emergency meeting to discuss Mr. Janke’s employment or termination. The contract allows them to fire Mr. Janke by majority vote of the city council for any reason. The reason for the termination was reported that Mr. Janke, (keep in mind he is the employee), that Mr. Janke’s wife’s occupation was an inaccurate image for Fort Myers Beach. What is the wife’s occupation, you ask? Oh, she is a porn star.

Let me tell you of another situation before entering the discussion. In Ohio, Gahanna, Ohio to be exact, Officer Fithen filed an harassment suit against his own police department. He alleges among other things that since his wife posed for playboy, it has been unbearable at work and there are constant requests for autographed copies of that particular edition of Playboy. There are some issues with the department on whether they denied paying him when he is on duty with the national guard. However, for our purposes, even the chief of police Mr. Ken Bell requested an autographed copy of the magazine contributing allegedly to the harassment.

So this is my question to you. Do you believe the morality of your spouse should be imputed to you with respect to your employment? Should the legitimate employment of your spouse be tied to you?

Okay, so I have never done a show or blog without offering some substantial information and then expect your discussion. Here it is. Let’s start with Officer Fithen case. Ohio has its own laws separate from Florida. I’m a business law, i.e. contracts attorney as well as immigration attorney for Florida. Therefore I will speak with generalities. Harassment cases typically arise when the environment is unbearable at work. There is sexual harassment and hostile environment. I’m not sure which type Officer Fithen filed under but my guess is that of hostile environment. Although there may be some legitimacy to his claims under the current employment law, I’m concerned about attaching a spouse’s job and or behavior to an employee.

Think about it! Is the reverse true, where Mrs. Janke should be looked upon has a high moral pornstar because her husband is a town manager? If the reverse is not true then how can that be fair? I understand the whole idea of your conduct and your friends should be of optimum character especially when you are a public figure or of a position that requires a high moral standard. Even so, it seems gut feeling wrong that an employee should be punished at his job for the legal occupation of his/her spouse.
