With the global movement of the #METOO, Nepal is also seeing its part of the sexual harassment and exploitation cases unfolding. In this bid two-time Mayor of Kathmandu Metropolitan City, Keshav Sthapit has been accused of sexually harassment of two women who have came openly in social media with the #METOONEPAL campaign.

Rasmila Prajapati a former employee of Kathmandu Metropolitan City Office accused sthapit of trying to sexually harass her in context of creating urgent topic to meet at a nearby resort where she refused and confronted him the next day. The refusal of the Sthapit’s sexual interest resulted in termination of her contract after assuming office during his second tenure. She said it was an act of revenge for refusing to get exploited.

Similarly, Ujjwala Maharjan a well known poet and journalist stated, "she started receiving calls late at night, not for professional reasons and sthapit continuously harassed with his calls with no reason."

In both cases Sthapit has denied the charges and has threatened to take action against both in court of law.

Sthapit is the current Minister in Province 3 Federal government of Nepal.

The social initiative #JusticeForNirmala has been successfully participated by thousand of supporters who have not only participated in the rallies but have create a social pressure for the government for justice for Nirmala pant.
Nirmala Panta is a 13 year old girl from Bhimdutta-2, Municipality-18, Kanchanpur who was brutally raped and murdered.

She had left her home on Thursday to meet her friend. Her family had filed a missing persons report with police after she did not return home until late evening. Her dead body was found in a sugarcane farm along the Mahendranagar-Ultakham road on July 26.

The Minister for Law, Justice, and Parliamentary Affairs, Sher Bahadur Tamang has been hugely criticized for his public comment expressing his sexist view on medical student of Bangladesh.

During a felicitation program of SEE graduates at Chabhil-based Praxis Int’l Academy, Minister Tamang had said that most of the Nepali female students have to sell themselves to obtain MBBS degree in Bangladesh.

With the profile and image the ministers sexist comment with no grounds shows the level of political culture and practice in Nepal. Nepal has been hugely dominated by the patriarchy society and derogatory and sexist remarks coming out of ministers is certainly not acceptable.

The comment has created a ripple in social media platform about the political culture and way political leaders use such unauthenticated statement.

Though the minister has publicly apologized but the question of his sexist mentality has raised question about the gender gap.

Parbati Budha an Eighteen-year-old was found dead while being in the Chhaupadi hut at Turmakhand Rural Municipality-4 in Achham district.

It has been reported that she was bitten by a poisonous snake on Saturday night. The incident happened while the victim was asleep with her friend Radhika Budha in the hut.

Chhaupadi tradition has been deep rooted in the western parts of the country, wherein menstruating women are considered impure and forced to live in small huts during the menstrual period.

Similarly in January, Gauri Bayak (Budha), 22, was found dead by her neighbours inside a Chhaupadi hut in Turmakhand-3. Villagers suspect that she might have died of smoke suffocation from the fire she had lit to keep herself warm inside the hut.

Abolishing the tradition of chhaupadi, the Nepal government through its parliament has criminalized the practice of chhaupadi as a crime. The new law, which will come into effect in a year’s time, stipulates a three-month jail sentence or a 3,000 rupee fine ($30), or both, for anyone forcing a woman to follow the custom.

In 2005 the Nepal’s Supreme Court banned chhaupadi as a human rights violation, but due to its cultural and tradition it is widely in rural parts of Nepal.

The DurbarMarg gang Rape case takes new turn with the new investigation launched by the NHRC. In a recent press statement, spokesperson of NHRC Mohna Anasri said that the probe committee had started investigation to create better understanding of the case. The NHRC also said that its attention was drawn to such cases where victims are denied justice due to the lack of governance and carelessness shown by authority. In such cases Human rights violation are major issues.

On January 25, a woman who was partying with her friends in Dubarmarg was gang raped at hotel landmark by four men. The woman had claimed that she had been gang-raped by four persons, including her alleged drunken boyfriend. On Friday, when she went to the Durbarmarg Police station the on duty officer did not register her case. It has been reported that DSP Tilak Bharati and Inspector Laxman Singh Thakuri from the Metropolitan Police Circle Durbarmarg had pressured the girl to settle the case with the perpetrators instead of registering her complaint.

On Tuesday, the Nepal Police Headquarters had summoned the two police officers from Durbarmarg station who had refused to register the victim’s complaint.

Following wide-spread criticism, the Nepal Police Headquarters had summoned the two officers and formed a team led by Superintendent of Police Ram Dutta Joshi to investigate into the case.
Under the 'Safety Pin Campaign’ the Metropolitan Police Office (MPO) officers have arrested 13 suspects aged between 18 and 30 years in a one week long operation. The campaign was launched in association with community service centres and transport entrepreneurs to discourage sexual harassment on public transport from August 2.

According to MPO, "A team was set up to conduct deceptive operation designed to catch persons making unwanted sexual advances towards female passengers on public transport, mainly the buses. During the operation anyone found sexually harassing female passengers are arrested outright for legal action under the existing laws."

Every day Tens of thousands of women and teenagers have to face various form of sexual harassment in public transport where most cases go unreported. Public vehicles in the Valley are usually overcrowded, providing the molesters with ample opportunities to sexually harass women.

Existing laws define sexual assault as any form of sexual contact or activity like touching, tapping and showing sexually explicit pictures or movies without one’s consent.

The parliament of Nepal has endorsed the the Criminal Code Bill criminalizing an ancient practice that barred women from the home during menstruation period.

Menstruating women in many communities is considered untouchable or impure. Specially in far western region women during menstrual are forced to sleep in a hut away from home known as chaupadi.

The new law stipulates a three-month jail sentence or Rs 3,000 fine, or both, for anyone forcing a woman to follow the custom.

A decade back, the Supreme Court banned chaupadi and its was practiced as a form of culture and tradition.

Tulasi Shahi died in western Dailekh district while being bitten by a poisonous snake in the cowshed following the menstrual tradition of living in a Chhaupadi. The death has seriously raised question about the tradition and lack of awareness about women sexual health and its taboos that are currently being practiced in developing countries.

According to literal meaning, "the word Chhaupadi has its origin from the Raute dialect of Achham district located in the far western part of Nepal where Chhau means menstruation and padi means a woman. Following the practice, women are considered impure and untouchable during their menstrual periods and are therefore not allowed to participated in their daily chore of the household. They are banished or refrain from participating in normal daily activities and are forced to live in isolation and sleep inside a small hut called chhaupadi or goth.

In tradition practice, these huts are especially prepared 20–25 meters away from their own residential homes and are sized around 1×2 m. Culturally, Chhaupadi is a small hut made outside the house for sleeping of woman during the menstrual period of 7 days. Women across the country observe a wide-ranging set of rules based on the belief that menstruation is impure and can be regarded as a gender based violence where the tradition has its various form of practice.

In 2005 the Nepal's Supreme Court banned chhaupadi as a human rights violation, but due to its cultural and tradition it is widely in rural parts of Nepal. In a recent study in 2010 it was found that 19 percent of Nepali women practiced chhaupadi, but in the mid- and far-west, where Shahi lived, the figure was closer to 50 percent.Especially in western district, Jumla, the figure is around 74 percent.

For the tradition like chhaupadi local women have to step up and abolish this darkness of suffering where every mother, daughter and sister goes through. There is a great need of awareness required at grassroots level where international organizations have been working but with such investment, expertise and reports Nepal seems to be lost where every years hundreds of girls are suffering inevitable faith of sexual exploitation, health issues and attacks.

who is to blame for ? The government which banned chhaupadi ages back or the people who practice it in the name of culture and tradition or the international non governmental organization which are working headless with their expertise and consultants.

The question remains unanswered, funding or not, Nepalese women are suffering the consequences of gender base violence where every woman understand the pain of being a Nepali woman.

AND IT EXIST WHICH NEEDS TO STOP..................................................

Makina Khatun of Golbazaar Municipality-13, Siraha was physically assaulted by number of people from her locality for semi nude pictures
that was uploaded by her neighbor in a social media site IMO.

According to Makina, “Her neighbor
Sanjila took her semi nude photos while she was bathing at the hand pump and uploaded
them on the messaging app IMO without her permission. After
that the villagers who say the pictures came in and assaulted her number of
times. They threatened her not to report the case to the police.”

A person who commits a computer related crime is liable to a fine not exceeding Rs 50,000 and/or imprisonment not exceeding six months, depending on the degree of the offence.

Due to lack of awareness of social media site, the rate of Violence against Women in such scenario has increased and most of the times theses case go unnoticed in view of pressure from the community.

Online Violation against Women is a serious act of offence where greater awareness campaign are required about privacy and social media. Clicking others nude photo and Sharing that without consent is a serious Crime which needs to be disseminated at large.

According to a report of UNESCO,Combatting Online Violence Against Women & Girls: A Worldwide Wake-up Call " Violence Against Women and Girls (VAWG) is already a problem of pandemic proportion; research shows that one in three women will experience some form of violence in her lifetime. Now, the new problem of ‘cyber VAWG’ could significantly increase this staggering number, as our research suggests that 73% of women have already been exposed to or have experienced some form of online violence. With social networks still in their relative infancy, this is a problem that urgently needs to be addressed if the Net is to remain an open and empowering space for all. The sheer volume of cyber VAWG has severe social and economic implications for women’s status on the Internet. Threats of rape, death, and stalking put a premium on women’s emotional bandwidth, take-up time and financial resources including legal fees, online protection services, and missed wages. Cyber VAWG can have a profoundly chilling effect on free speech and advocacy. Women aged 18 to 24 are at a heightened risk of being exposed to every kind of cyber VAWG; they are uniquely likely to experience stalking and sexual harassment, while also not escaping the high rates of other types of harassment common to young people in general, like physical threats."

Jac sm Kee of Association for Progressive Communication’s (APC) says, "Online violence against women is an overt expression of the gender discrimination and inequality that exists offline. Online, it becomes amplified. The most important way to shift this is to enable women and girls to engage with the Internet at all levels – from use, creation, and development to the imagination of what it should and can be."

According to a report published in the Thomson Reuters Foundation, "Poor Nepalese women are being trafficked and duped into selling their skin to be used for penis and breast enlargements in the global cosmetic surgery market." An investigation by the Indian news website Youth Ki Awaaz (Voice of the Youth) said Nepali women were selling 20 square inches (130 square cm) of skin tissue from their backs for $150 to be used in plastic surgery.

The report, by Indian journalist Soma Basu, said the Nepali women were trafficked to brothels in Indian cities such as Mumbai and then later duped into selling their skin. Some victims said they were drugged and their skin removed. The skin tissue is sold onto pathology laboratories in India where it is processed and exported to companies in the United States which manufacture skin and tissue derivative products for the global plastic surgery market.

In most cases Nepalese women are lured into various foreign abroad jobs by recruiters with high income and benefits. The ones who are trafficked illegally, they land up in skin trade industry where they are exploited physically and then further mentally tortured for labor and sexual exploitation. In recent cases organ transplant and specifically kidney transplantation has been widely reported, but cases of trafficking in human skin tissue has been a serious issues of concern. It comes at a point where Nepal current is struggling to balance with safe guarding the rights of women. In a country where there a woman is the President, a woman is the chairman the parliament and a woman is the chief justice why the women of Nepal are featured with such atrocities of human rights.

The definition of child and the age limit might be defined by the legal system of the country but the human rights of basic standards and living has been equally defined for all. Today with so much of technological development and cooperation child Marriage has been one of the major problems of the developing world. Millions and billions have been poured in for the proper awareness and capacity building but it's one of the hurdles that comes-up every now and then.

The problem is not just with the issue of Child-Marriage but the values and ideologies associated with it. Child Marriage is an issue which is culturally inspired in many ways of the least developed and developing countries where there are issues of poverty and hunger. In most of these countries these issues are ignored in view of larger problem that shadows the core issues. In most of the case lack of an adequate legislative framework results in high number of child marriage. While many countries legislate have adopted the minimum legal age for marriage, this is often not effectively enforced at the local level due to lack of monitoring. Similarly, lack of standardization of customary laws that may condone the practice of child marriage where they are prone to violence and sexual abuse. Child marriage is generally more prevalent in jurisdictions that offer fewer
protections for women and girls.

The major problems of child marriage are

Religious and cultural values

Poverty and hunger

Modern day Slavery Industry

Lack of awareness and communication

Lack of Rules and regulation

Lack of monitoring mechanism

Lack of capacity building

Lack of research and cooperation (Consultant and experts)

Donor agencies sub-standard values

Orthodox and prejudices values related to woman

Limitation of Development plans and policies

Report mentality of development agencies

Lack of Gender Equality values

The International Center for Research on Women ( ICRW) states, " One third of girls in the developing world are married before the age of 18 and 1 in 9 are married before the age of 15. In 2012, 70 million women 20-24 around the world had been married before the age of 18. If present trends continue, 150 million girls will be married before their 18th birthday over the next decade. That’s an average of 15 million girls each year. While countries with the highest prevalence of child marriage are concentrated in Western and Sub-Saharan Africa, due to population size, the largest number of child brides reside in South Asia. Girls living in poor households are almost twice as likely to marry before 18 than girls in higher income households. More than half of the girls in Bangladesh, Mali, Mozambique and Niger are married before age 18. In these same countries, more than 75 percent of people live on less than $2 a day.Girls with higher levels of schooling are less likely to marry as children. In Mozambique, some 60 percent of girls with no education are married by 18, compared to 10 percent of girls with secondary schooling and less than one percent of girls with higher education. Similarly, educating adolescent girls has been a critical factor in increasing the age of marriage in a number of developing countries, including Indonesia, Sri Lanka, Taiwan and Thailand.Girls who marry before 18 are more likely to experience domestic violence than their peers who marry later. A study conducted by ICRW in two states in India found that girls who were married before 18 were twice as likely to report being beaten, slapped or threatened by their husbands than girls who married later. Child brides often show signs symptomatic of sexual abuse and post-traumatic stress such as feelings of hopelessness, helplessness and severe depression."

" Child marriage denies girls their rights and their childhood. It often means the
end of her formal schooling and the start of her life as a wife and mother – frequently resulting in
profound physical, psychological and emotional consequences. Child marriage disproportionally
affects girls, thereby reinforcing gender inequality and limiting millions of girls from fulfilling their
potential and leading happy, safe and productive lives. Child marriage also undermines efforts to reduce global poverty and to build a world that is more equal. It is a violation of human rights, contravening both the Convention on the Rights of the Child and the Convention on the Elimination of All Forms of Discrimination against Women. It has also impeded the achievement of goals laid out in various international development agendas, including the Millennium Development Goals. Ending child marriage will accelerate efforts to achieve a safe, healthy and more prosperous future for girls and women around the world," voices Girls not Brides .

Facts about Child Marriage

Approximately 15 million girls are married every year before they reach 18 years.1 That is, approximately 41,000 every day.

In the developing world, 1 in 3 girls is married by age 18, and 1 in 9 is married by age 15, some as young as eight or nine.2

Child marriage occurs around the world, and cuts across countries, cultures, religions and ethnicities: 45% of girls under age 18 are married in South Asia; 39% in sub-Saharan Africa; 23% in Latin America and the Caribbean; 18% in the Middle East and North Africa; and in some communities in Europe and North America too.3

Niger has the highest prevalence rate of child marriage in the world with 76% of girls getting married before 18 years, while Central African Republic has the highest prevalence of girls getting married before their 15th birthday at 29%.4

India has the highest absolute number of child brides in the world with over 26 million girls marrying before 18 years. Surprisingly countries like Brazil, Mexico and Indonesia also feature in the top ten countries with the highest absolute number of child brides in the world.5

While there has been a decrease in child marriage over the past 30 years, progress remains uneven across regions. While there are substantial variations in the rates of child marriage within and among regions and countries, the rate of progress is not fast enough.

Girls who marry before the age of 18 are more likely to experience physical, sexual, and emotional abuse than those girls who marry later.

Early childbearing also increases the risks to new-borns. In low and middle income countries, babies born to mothers under 20 years of age have a 50% higher risk of being stillborn or of dying within the first few weeks of life than those born to older women.

No matter it is one of the burning issues of today where in most parts of the world girl child are suffering the consequences of being deprived. To some extent the development agencies are now working towards developing and targeting the problems but having said that is it just their issue.
Our daughters, & sisters are still facing the problem of being vulnerable. we have to understand that till the time, we give gender equality in our core-values things will not move ahead. So a heightened awareness program targeting all needs to be adopted.

The United Nations Office on Drugs and Crime (UNODC ) is out with its Global Report on Trafficking in Persons 2016. The report states children make up almost a third of all human trafficking victims worldwide, where women and girls comprise 71 per cent of human trafficking victims. It covers 136 countries and provides an overview of patterns and flows of trafficking in persons at global, regional and national levels, based primarily on trafficking cases detected between 2012 and 2014. As UNODC has been systematically collecting data on trafficking in persons for more than a decade, trend information is presented for a broad range of indicators.
The thematic chapter of the 2016 edition of the Global Report looks at how migrants and refugees can be vulnerable to trafficking in persons, en route or at destination. It also analyses the particular condition of people escaping war, conflict and persecution. Most countries have passed legislation that criminalizes trafficking in persons as a specific offence; many have done so recently. The Global Report shows that there is a relation between how long a country has had proper trafficking legislation on its books, and how many convictions it reports. Countries with longer-standing legislation record, on average, more convictions. That said, the overall criminal justice response to trafficking in persons, which has historically been very weak, has not improved significantly.

Laxmi Pariyar of Sano Bangthali-7, Kavre was tortured with feces and beaten to death for accusations of practicing witchcraft on Friday. A complaint was filed by laxmi brother on Sunday 11th December 2016.

According to filed police report, "Laxmi Pariyar was a 32 years old woman who was tied with ropes, beaten and fed with feces by locals Hira Lama and his mother Kaili Tamang on December 5. She was reportedly found dead under mysterious circumstances. Her body was found about 200 meters away from her home in a shed of Ram Bahadur Upreti. Locals informed the police after discovering the body."

On preliminary examination, Laxmi had bruises under her right eye, forehead, and traces of bloods from her nose. Her dead body has been sent to Tribhuvan University Teaching Hospital (TUTH) in the capital for post mortem.

Every year hundreds of cases of women being killed or tortured are registered where the state has enforced law against VAW but still due to lack proper awareness people act against the law.

Though various efforts are being done in the name of awareness and VAW but every now and then there seems to a new laxmi coming up with the issues of justice and her outcry of pain.
The case of laxmi is among thousands who suffered the ill fate of being accused of witch or bokshi where major of such cases are witnessed and enacted by educated people. Until and unless women break this orthodox and prejudices by speaking and working together things doesn't seems to be changing. I think women have to step up and lead the process of fighting against this battle against VAW.

The human trafficking rate in Nepal has gone up by 150 percent as compared to last year. According to experts after the earthquake of 2015 the numbers have tentatively increased as compared to last year. In the fiscal year 2015-16, a total of 212 cases were reported which was 16 percent higher when compared to the fiscal year 2014-15 that reported 181 cases.

Human trafficking problem has been a major hurdle where poverty, low-income and high illiteracy rate have been reasoned the cause. Most of the people are trafficked in the name of high salary jobs to foreign countries where they are mentally and physically abused and exploited. In most of the cases people are channeled through various networks of agents from one country to another.

The US State Department, Trafficking in Persons Report 2016 states that Nepal is a source, transit, and destination country for men, women, and children subjected to forced labor and sex trafficking. Nepali women and girls are subjected to sex trafficking in Nepal, India, the Middle East, Asia, and subSaharan Africa. Nepali men, women, and children are subjected to forced labor in Nepal, India, the Middle East, Asia, and the United States in construction, factories, mines, domestic work, begging, and the adult entertainment industry.

A joint collaboration of the United Nations Population Fund Asia-Pacific Regional Office and the Australian Department of Foreign Affairs and Trade is launching an initiative titled "KNOW VAWdata" which will help to collect and analyse data on the extent and nature of violence that women experience, using robust and reliable methodologies.

It will be an effective tool for researchers and field workers in collecting data to bring about policy and behaviourial change to stop VAW.

In Asia-Pacific, surveys have indicated that between 15 per cent and 68 per cent of women have experienced physical or sexual violence, at the hands of an intimate partner, across different countries, read the statement.

“We have estimates that globally about one out of three women suffers physical or sexual violence at some point in her life, usually at the hands of her spouse or intimate partner,” said Yoriko Yasukawa, UNFPA Asia-Pacific regional director in the statement.

“We’ve made progress in recent years in documenting this violence in a number of countries. Now, under this initiative, we’ll expand this work, ultimately benefiting millions of women, helping us move closer to fulfilling one of the most important targets under the Sustainable Development Agenda — that of bringing about an end to the scourge of violence against women,” Yasukawa added.

As per the data of the Women Rehabilitation Centre (WOREC), a women rights advocacy organisation, has reported 206 VAW cases from the mid-May to mid-June (the Nepali month of Jeth) where a total 131 cases were recorded in the previous month.

Similarly, it reports that 12 percent of the recorded cases last month were rape cases while nine percent were other sexual assaults.
More than half of the rape survivors (77 per cent) are minor, below the age of 16, according to WOREC.

Likewise, 36 percent of the total recorded cases were physical assaults. Four percent were beaten over dowry and witchcraft-related issues. 25 percent of women were mentally tortured.

The organisation said the nationwide increase in the VAW cases was a serious issue that needs to be addressed immediately.

A disable was gang raped by Armed Police Force(APF) men in Shivaraj Municipality ward 10, Kapilbastu. It has been reported that the 35-year old woman, who cannot speak not listen was gang raped when she was grazing her buffaloes in the jungle near the APF barrack.

She is currently admitted to Thapathali-based Maternity Hospital on June 16 and is currently going under psychotherapeutic treatment in sign language.

As the number of women migrant workers are increasing for foreign jobs, the number of exploitation cases and Violence Against Women(VAW) cases are also increasing tremendously. As per the report National Human Rights Commission (NHRC) states thousands of Nepali women are being trafficked every year as sex workers and bonded labourers, where China and South Korea are emerging as new destinations. These women are forced to sex or work slavery with no rights and no options of return. Most of the victims come from a background of poverty and broken families with no education where they have no way of return.

Records shows that around 20,000 Nepalis women were trafficked in the two fiscal years ending mid-July 2015, a number swollen by the disruption caused by earthquakes in April and May last year.
Some of the preliminary studies say that India remains the biggest destination country, but rising numbers of women and girls are also being trafficked to China and South Korea.

Last year's earthquakes in Nepal, which caused widespread damage and displaced millions, greatly increased the vulnerability of women and children, In the three months after the quakes, 1,233 women and children were reported missing, and the risk of their being trafficked increased by an estimated 15 to 20 percent.

8,000 Nepalese citizens were trafficked annually in Nepal stated a reported reveled by National Human Rights Commission (NHRC) on Tuesday.

The report states that 16,000 citizens, mostly women and children were trafficked in the past two fiscal years – 2013 to 2014 and 2014 to 2015 while a majority of the cases fail to get reported in Nepal Police. As per the report only 185 cases were registered between 2013 and 2014, whereas only 181 cases were registered from 2014 to 2015.

The report highlights that the main reason is under-reporting and under-registration of human trafficking cases, including an overlap in measures of Foreign Employment Act and the Human Trafficking and Transportation Control Act. The report claimed that the number of the interception of the vulnerable persons had increased after the earthquake, an increase by no less than 15 per cent before and after three months of the earthquake.

The study showed that in terms of destination of trafficking, the majority of victims were being trafficked to India, but that there were also cases of internal trafficking and trafficking to the Gulf States.

Trafficking route is reported to be the main official border points with India and China.

It said that trafficking of girls to South Korea and China for the purpose of marriage is also growing in Nepal.

Records showed that most of the trafficking cases were from eastern districts of Jhapa and Morang, whereas most of the victims belonged to indigenous nationalities.
