Child Benefit should be made payable to both parents in the event of parental separation or divorce, where both parents continue to play an equal and substantive caring role in their children’s upbringing. Today’s system of only paying Child Benefit to one parent enacts discriminatory laws and policies that lead to imbalances in parents ability to equally care for their children and to maintain an equal status with regards to access to State provisions and benefit entitlements. Child Benefit is often a gateway to other benefits and also can act as a financial incentive by one parent to limit the other parents parenting time to trigger qualification for Child Support payments when no such payments are necessary if shared parenting time and equal split of Child Benefit had established equality of roles. Each case should then be measured on its own merits.

Quand il y a divorce avec enfants; dans beaucoup de cas le parent qui a la garde devient le parent aliénant envers l’ex-conjoint en se servant des enfants.

Au nom de tous les parents qui souffrent (75 à 80 % de papas et 25 à 30 % de mamans) qui ne voient plus leurs enfants soit disant car les enfants ne veulent plus; mais parce qu’ils ont reçu un lavage de cerveau très severe:

1. Je demande de suivre le remède du Professeur Van Gijseghem Psychologue à l’Université de Montréal et l’avis d’autres grands psychologues aussi, de faire le changement de garde le plus rapidement possible dans le cas d’aliénation sévère jusqu’à “DECONTAMINATION DE L’ALIENATION PARENTALE”, ensuite revenir à la garde alternée.
2. Un Rapt parental qu’il soit national ou international, c’est la même chose. Cela doit être hautement punissable.
3. Plus jamais de PARENTECTOMIE. Un enfant a besoin de sa maman et de son papa pour grandir et s’épanouir.
4. Il devrait y avoir de nouvelles formations aux nouveaux parents dans ce cas. Même si l’on a beaucoup d’animosité envers l’autre parent. Ne plus jamais rien dire devant l’enfant.

Nooit meer Ouderverstotingssyndroom na scheiding: Stop PAS!

Bij (echt)scheidingen waarbij kinderen betrokken zijn; gebeurt het nu in (te)veel gevallen, dat de ouder, aan wie de rechtbank de alleenzorg en het gezag over de kinderen heeft toevertrouwd, onder inzet van de kinderen tot een verstotende en vervreemdende ouder wordt jegens de andere ouder en voormalige partner of ex-echtgenoot.

Namens alle ouders die hieronder te lijden hebben en hieraan ten offer vallen (het betreft in 75 tot 80% van de gevallen papa’s en in 25 tot 30% van de gevallen mama’s) en die hun kinderen niet meer kunnen zien of ontmoeten – zogenaamd omdat hun kinderen hen niet langer willen zien, maar in werkelijkheid omdat hun kinderen tegen hen gehersenspoeld en opgezet werden:

1. Verzoek en eis ik dat de hiertegen geadviseerde remedie van Professor van Gijseghem, psycholoog en hoogleraar aan de Universiteit van Montreal, die hierin wordt ondersteund door andere gerenommeerde psychologen, wordt overgenomen en ingevoerd om zo snel mogelijk te komen tot tussentijdse contraire wijziging van het gezag en de zorg over de kinderen naar de andere niet-vervreemdende en niet-verstotende ouder voor een periode net zolang totdat de betrokken kinderen „ONTSMET VERKLAARD ZIJN VAN DE INVLOEDEN EN EFFECTEN VAN OUDERVERSTOTING OF OUDERVERVREEMDING“, om alleen dan het gezag en de zorg over de kinderen opnieuw en definitief te wijzigen in gezamenlijk gezag en gedeelde zorg (co-ouderschap) door beide ouders.
2. Ouderlijke ontvoering van kinderen, of deze nu nationaal binnen de eigen landsgrenzen of internationaal over de landsgrenzen heen plaats vindt, is in essentie hetzelfde. Het dient in hoge mate strafbaar gesteld te worden en ook actief te worden vervolgd door justitie en politie.
3. Er dient nooit meer sprake te zijn van PARENTECTOMIE, het na scheiding wegsnijden van een van de beide ouders uit het leven van betrokken kinderen. Een kind heeft zowel zijn mama als zijn papa nodig om op te kunnen groeien en zich gezond te kunnen ontwikkelen.
4. Er dient ter voorkoming van deze gevallen een nieuwe opleiding en training voor scheidende ouders te worden ontwikkeld, ingevoerd en aan nieuw scheidende ouders te worden aangeboden. Zelfs wanneer er sprake is van negatieve sentimenten jegens de andere ouder, dan dienen ouders toch te leren dat zij het betrokken kind daarvan moeten vrijwaren en het kind daarover niet moeten lastig vallen of mee belasten.

No more Parental Alienation Syndrome: Stop PAS!

When there is a divorce or separation with children involved, in (to) many cases, the parent who has been awarded custody by the courts becomes the alienating parent to the former spouse by use of the children.

On behalf of all the parents who suffer (75 to 80% of fathers and 25 to 30% of mothers) and who no longer see their children – so-called because their children no longer wanted to see them, but in reality because their children have been brainwashed very severely:

1. I request and demand the urgent implementation of the cure that was advised by Professor Van Gijseghem, a psychologist at the University of Montreal, supported by other high ranking psychologists, to immediately and intermediately reverse court custody arrangements into awarding contrary custody to the other non-alienating parent as soon as possible in cases of severe alienation, until the child(ren) involved are “DECONTAMINATED FROM THE EFFECTS OF PARENTAL ALIENATION”, to only then reverse court custody arrangements again into final joint physical custody and shared parenting arrangements involving both parents.
2. Parental kidnapping whether national or international, are essentially the same thing. They both must be highly punishable and prosecuted.
3. No more PARENTECTOMIES. A child needs both his mother and his dad to grow up and develop.
4. New post-divorce parenting training and education facilities should be developed, implemented and offered to newly divorced parents in these cases. Even if you have a lot of animosity towards the other parent. Do not ever say anything about it to the child.

Préambule:

Cette pétition est venue à l’idée d’un parent qui n’a plus vu sa fille depuis quatre ans, à la suite du rapt de l’enfant par l’autre parent, vers l’Allemagne.

Aucune autorité n’a eu le courage de s’y opposer.

Ce parent a été rejoint par des pères et des mères, victimes également de la détermination d’un ex conjoint, ou compagnon, à recourir à la prise d’otage pour « régler ses comptes ».

Quand, ne voulant pas confronter la faiblesse de son pouvoir à la volonté puissante des parents aliénateurs, le Politique autorise le rapt, ou la non présentation d’enfant, ou feint d’ignorer l’existence de ces phénomènes, le premier résultat est la perte de tout contact entre l’enfant et le parent laissé pour compte.

Le deuxième est la destruction de l’enfant, dans les mains d’un parent unique et manipulateur, devant des autorités amorphes et hypocrites, qui nous inculquent ainsi le mépris de la Loi.

C’est contre cette fausse ignorance et cette vraie lâcheté, de la part des autorités, que notre pétition veut lutter.

Le but de notre action est d’appeler les autorités à un changement de mentalité. Les lois contre la maltraitance existent dans la plupart des pays d’Europe ; mille et une fausses excuses font qu’elles sont trop rarement appliquées.

Il faut dorénavant que l’Autorité ose reconnaître les maltraitances, ose appliquer les lois.

Le rapt parental et la non présentation de l’enfant sont des maltraitances.

La Pétition :

Il s’agit d’une déclaration de principes.

• Chaque enfant a le droit d’avoir un contact régulier avec ses parents.
• Chaque parent a le droit d’avoir un contact régulier avec son, ou ses, enfant(s).

Diverses lois qui protègent ce rapport entre parents et enfants existent, dans la plupart des pays d’Europe ; mais leur application se fait avec le plus grand laxisme, voire avec lâcheté.

Ainsi, les responsables de la justice et ceux de l’administration ; les politiques et les directeurs d’écoles ; les médecins et les psychologues ne sont guère courageux. Par son refus de réagir face à cette forme de maltraitance de l’enfant, l’Europe des 25, n’est plus capable de protéger les fondements éthiques de notre société.

Ce n’est pas que les lois sont mal faites, c’est que les hommes de loi, chargés de les appliquer, sont lâches.

C’est pour cela que cette pétition existe : elle demande une chose : le retour au respect du droit, à l’application des lois ; l’autorité politique et surtout judiciaire droit redevenir courageuse ; les spécialistes doivent quitter leur approbation implicite du laisser-faire, du laisser détruire l’enfant, pour, au contraire, suggérer l’interdiction du crime, et la reconstruction de l’enfant.

La justice semble trop souvent imperméable à l’éthique et n’être sensible qu’à la détermination, même à nuire, des acteurs du débat judiciaire. Il nous faut donc prouver que la détermination des citoyens, soucieux du bonheur de l’enfant, est plus forte que celle des parents vindicatifs… et adeptes de la prise d’otage.

Preamble:

This petition came to the mind of a parent who did not see her daughter for over four years, as she had been kidnapped by the other parent, to Germany.

None of the officials of her government was ever brave enough to condemn that kidnapping.

That parent has been in contact with fathers and mothers, equally victims of the determination of an ex’, to resort to hostage taking in order to square his or her accounts.

When the Power is afraid of confronting his nonexistent will against the powerful one of the alienating parent, it authorizes kidnapping, denial of visitation rights, or pretends it does not exist. The first result of such an attitude is the loss of all contacts between the child and the left behind parent.

The second one is the mental destruction of the child, left in the hands of the lone and manipulating parent, in front of nondescript and amorphous authorities, teaching us the contempt of the Law.

Our petition wants to fight against the fake pretence of the non-existence of the problem, and the real cowardice of the Authority.

Through our action, we wish to call those authorities to a change of mind. Laws against the ill-treatment of children do exist in most European countries; millions of bad excuses do that those laws are too often left aside.

The authorities ought to admit that such ill-treatments occur, and ought to dare to apply the law to its fullest extent.

Parental kidnapping and denials of visitation rights are ill-treatments.

The Petition :

It will be a declaration of Principles.

• Each child has the right to a relationship with both his/her parents.
• Each parent has the right to a relationship with his / her child(ren).

Various laws protect this principle of a relationship between parents and children, but the judges do not use them to their fullest extent and, sometimes, do not apply them at all.

The responsible persons in the courts, or in the various administrations; the politicians and the directors of the schools; doctors and psychologists, none of them will show any courage. Through its refusal to react, in front of those ill treatments of the child, the European Union is not able anymore to protect the ethical fundamentals of our society.

The problem is not that laws would be bad ; it is that the people in charge of their use are cowards.

That is the reason why we wrote this petition. We are asking for one thing : the return of the respect of the Law, the use of the law. The political and the judicial authorities must be courageous again. The specialists ought to abandon their implicit approbation of the laisser-faire, of the destruction of the child and, on the contrary, strongly suggest that the crime should be punished, and that the child ought to be reconstructed.

Too often has Justice been seen as separated from Ethics. Too often has it been seen as sensitive only to the determination of the actors of the judiciary debate, even when that determination was a destructive one. We must now show that the determination of the citizens, having in mind the well being of the child, is stronger than the one of vindictive parents whose only joy in life is the hostage taking of innocent children.

Preambule

Dit project om een verzoekschrift op te stellen is ontstaan bij een Belgische ouder die zijn dochter al vier jaar niet meer gezien heeft als gevolg van een kinderontvoering naar Duitsland door de andere ouder.

Geen enkele overheid heeft de moed opgebracht zich daartegen te verzetten.

Bij die ouder hebben zich vaders en moeders aangesloten die slachtoffers zijn van de beslissing van een ex-echtgenoot of een partner om zijn toevlucht te nemen tot een kindergijzeling om “de rekeningen te vereffenen”.

Door de zwakte van haar macht de wil van de vervreemdende ouders niet te weerstaan laat de Politiek de ontvoering of de weigering van het omgangsrecht toe of doet alsof ze het bestaan van die feiten niet kent. Het eerste gevolg is het verlies van elk contact van het kind met de ouder die in de steek gelaten werd.

Een tweede gegeven is de geestelijke aantasting van het kind in de handen van een enige manipulerende ouder onder de ogen van een vormloze en hypocriete overheid, die ons inprent dat niets billijker is dan de wet te misprijzen..

Juist tegen die valse onwetendheid en die waarachtige lafheid van de overheid wil ons verzoekschrift in opstand komen.

Het doel van onze actie is de overheid op te roepen tot een mentaliteitsverandering. In het merendeel van de Europese landen bestaan wetten tegen de mishandeling; duizend en een voorwendsels zorgen ervoor dat ze al te zelden worden toegepast.

Van nu af aan moet de overheid die vormen van kindermishandeling durven erkennen, de wetten durven toepassen.

Ouderontvoering en de weigering van het omgangsrecht met het kind zijn mishandelingen

Petitie/verzoekschrift

Het gaat over een principeverklaring.

• Elk kind heeft recht op regelmatig contact met zijn ouders.
• Elke ouder heeft recht op regelmatig contact met zijn kind(eren).

Verscheidene wetten die de relatie tussen ouders en kinderen beschermen, bestaan in de meeste Europese landen; maar ze worden slechts met de grootste laksheid, zeg maar lafheid toegepast. Door te weigeren de Wet toe te passen, ziet de rechter elke ethiek over het hoofd.

Op die manier tonen de verantwoordelijke instanties van justitie, van de administratie; de politici en de schooldirecteurs; de artsen en de psychologen hun gebrek aan moed. Door te weigeren te reageren tegen deze vorm van kindermisbruik, is het Europa van de 25 niet langer in staat de ethische grondslagen van onze maatschappij te beschermen.

Niet de wetten zijn fout gemaakt, maar de personen die ermee belast zijn de wet toe te passen, gedragen zich lafhartig.

Daarom is dit verzoekschrift in het leven geroepen : het vraagt één zaak : de terugkeer naar het respect voor het recht, voor de toepassing van de wetten ; de politieke en vooral de gerechtelijke overheid moeten opnieuw moedig worden ; de specialisten moeten hun impliciete instemming met een laat-maar-begaan – het kind te laten beschadigen – opgeven, maar integendeel het verbod het misdrijf te plegen suggereren en zorgen voor het herstel van het kind.

Het gerecht lijkt al te vaak ontoegankelijk voor de ethiek en slechts gevoelig te zijn voor de beslistheid – zelfs om te schaden – van de actoren van het juridische debat. Die verantwortlichen Personen in den Gerichten oder in den verschiedenen Verwaltungen, die Politiker und die Direktoren der Schulen, Ärzte und Psychologen, keiner von ihnen hat Mut. Durch ihre Weigerung zu reagieren, und die erkrankten Kinder zu behandeln. Auch die Europäische Union ist nicht in der Lage, Sie zu schützen, um die ethischen Grundlagen unserer Gesellschaft zu sichern.

To będzie zbiór zasad.

• Każde dziecko ma prawo do związku z obojgiem rodziców.
• Każdy rodzic ma prawo do związku ze swoim dzieckiem.

Różne prawa bronią tej zasady utrzymywania więzi między rodzicami a dziećmi, ale sędziowie nie używają ich w ich najpełniejszych rozmiarach, a czasami nie stosują ich w ogóle.

Odpowiedzialne osoby w sądach i różnego rodzaju instytucjach; politycy i dyrektorzy szkół, lekarze i psycholodzy; nie wykazują odwagi. Przez ich brak reakcji na tak chore traktowanie dziecka, Unia Europejska nie jest zdolna do obrony etycznych fundamentów naszego społeczeństwa.

Problemem nie jest wadliwe prawo; problemem jest to, że ludzie, poprzez wybór argumentów jakich używają, okazują się tchórzami.

To jest powód, dla którego napisaliśmy tę petycję. Prosimy o jedną rzecz: o powrót respektowania prawa, powrót do używania prawa. Polityczne i sądowe władze muszą znowu być odważne. Specjaliści powinni porzucić ich ukrytą aprobatę unikania interwencji i niszczenia dziecka oraz, z drugiej strony, silnie sugerować, że każde przestępstwo powinno być ukarane i że dziecko powinno być emocjonalnie odbudowane.

El petition:

• “Cada hijo tiene con pleno derecho la posibilitad que tenga contactos regulares con sus padres”
• Todos los padres tienen derecho que tener contactos regulares con sus hijos.

Varias leyes que protegen este vínculo entre los padres y los hijos exista en casí todos los paises de Europa, pero sus aplicaciones son superficiales y cobardes.

Así es de los encargados de la justicia, los de la administración, los politicos, los directores de escuelas, los medicos, los psicólogos, todos estan apenas valientes.

Es para eso que existe está petición: Exige que los derechos sean respetados y las leyes aplicadas; la autoridad judiciaria y politica tiene que ser de nuevo valiente.

Los profecionales tienen que abandonar su implícito consentimiento al “dejar de la mano”, a los que quieren destruir a los hijos. Al contrario deben affirmar sus oposiciones contra el crimen, permitiendo asi la reconstrucción de los hijos.

La justicia parece impermeable la mayoría de las veces a la ética y sólo està sensible a la resolución de los que intervienen en la batalla judiciaria. Hay que pruebar que la resolución de los ciudadanos que se preocupen de la felicidad del hijo es mucho mas fuerte que la resolución de los padres vindicativos que practican la tomada de rehén.”
